DECISION OF THE EEA JOINT COMMITTEE No 315/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1404]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2023/464 of 3 March 2023 amending, for the purpose of its adaptation to technical progress, the Annex to Regulation (EC) No 440/2008 laying down test methods pursuant to Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals (1) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2023/470 of 2 March 2023 not approving d-Allethrin as an existing active substance for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Decision (EU) 2023/471 of 2 March 2023 postponing the expiry date of the approval of 4,5-Dichloro-2-octyl-2H-isothiazol-3-one for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (3) is to be incorporated into the EEA Agreement.

(4)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

The following indent is added in point 12zza (Council Regulation (EC) No 440/2008):

‘—	32023 R 0464: Commission Regulation (EU) 2023/464 of 3 March 2023 (OJ L 68, 6.3.2023, p. 37).’

Article 2

The texts of Regulation (EU) 2023/464 and Implementing Decisions (EU) 2023/470 and (EU) 2023/471 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 9 December 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (4).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
