DECISION OF THE EEA JOINT COMMITTEE No 84/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/2239]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2022/1484 of 7 September 2022 postponing the expiry date of the approval of DDACarbonate for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision (EU) 2022/1486 of 7 September 2022 postponing the expiry date of the approval of acrolein for use in biocidal products of product-type 12 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1487 of 7 September 2022 postponing the expiry date of the approval of etofenprox for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (3) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1488 of 7 September 2022 postponing the expiry date of the approval of K-HDO for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (4) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1489 of 7 September 2022 postponing the expiry date of the approval of spinosad for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (5) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1494 of 7 September 2022 on the unresolved objections regarding the conditions for granting an authorisation for the biocidal product Mouskito Spray in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (6) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1495 of 8 September 2022 postponing the expiry date of the approval of medetomidine for use in biocidal products of product-type 21 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (7) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1496 of 8 September 2022 postponing the expiry date of the approval of tebuconazole for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (8) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1497 of 8 September 2022 determining whether a product containing ‘Capsicum oleoresin expeller pressed’ is a biocidal product, pursuant to Article 3(3) of Regulation (EU) No 528/2012 of the European Parliament and of the Council (9) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2022/1515 of 8 September 2022 on the unresolved objections regarding the conditions for granting an authorisation for the biocidal product Mouskito Junior Lotion in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (10) is to be incorporated into the EEA Agreement.

(11)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 12zzzzzzzzd (Commission Implementing Decision (EU) 2022/874) of Chapter XV of Annex II to the EEA Agreement:

Article 2

The texts of Implementing Decisions (EU) 2022/1484, (EU) 2022/1486, (EU) 2022/1487, (EU) 2022/1488, (EU) 2022/1489, (EU) 2022/1494, (EU) 2022/1495, (EU) 2022/1496, (EU) 2022/1497 and (EU) 2022/1515 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 29 April 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
