DECISION OF THE EEA JOINT COMMITTEE No 80/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/2236]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2021/2086 of 5 July 2021 amending Annexes II and IV to Regulation (EU) 2019/1009 of the European Parliament and of the Council for the purpose of adding precipitated phosphate salts and derivates as a component material category in EU fertilising products (1) is to be incorporated into the EEA Agreement.

(2)

Commission Delegated Regulation (EU) 2021/2087 of 6 July 2021 amending Annexes II, III and IV to Regulation (EU) 2019/1009 of the European Parliament and of the Council for the purpose of adding thermal oxidation materials and derivates as a component material category in EU fertilising products (2) is to be incorporated into the EEA Agreement.

Commission Delegated Regulation (EU) 2021/2088 of 7 July 2021 amending Annexes II, III and IV to Regulation (EU) 2019/1009 of the European Parliament and of the Council for the purpose of adding pyrolysis and gasification materials as a component material category in EU fertilising products (3) is to be incorporated into the EEA Agreement.

(4)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indents are added in point 1 (Regulation (EU) 2019/1009 of the European Parliament and of the Council) of Chapter XIV of Annex II to the EEA Agreement:

‘—	32021 R 2086: Commission Delegated Regulation (EU) 2021/2086 of 5 July 2021 (OJ L 427, 30.11.2021, p. 120),

—	32021 R 2087: Commission Delegated Regulation (EU) 2021/2087 of 6 July 2021 (OJ L 427, 30.11.2021, p. 130),

—	32021 R 2088: Commission Delegated Regulation (EU) 2021/2088 of 7 July 2021 (OJ L 427, 30.11.2021, p. 140).’

Article 2

The texts of Delegated Regulations (EU) 2021/2086, (EU) 2021/2087 and (EU) 2021/2088 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 29 April 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 77/2023 of 28 April 2023 (4), whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
