COMMISSION IMPLEMENTING REGULATION (EU) 2023/861
of 26 April 2023
amending Annex I to Implementing Regulation (EU) 2023/594 laying down special control measures for African swine fever
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of the consignments of those animals and products thereof within the Union and their exports to third countries. |

(2) |
Commission Implementing Regulation (EU) 2023/594 (2) lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States (3), which are listed or whose areas are listed in Annexes I and II. |

The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2023/594 was last amended by Commission Implementing Regulation (EU) 2023/835 (4) following changes in the epidemiological situation as regards that disease in Italy, Poland and Lithuania. Since the date of adoption of that Implementing Regulation, the epidemiological situation as regards that disease in certain Member States concerned has evolved. |

Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2023/594 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (5). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (6) of the World Organisation for Animal Health (WOAH) and justifications for zoning provided by the competent authorities of the Member States concerned. |

Since the date of adoption of Implementing Regulation (EU) 2023/835 there has been an outbreak of African swine fever in a wild porcine animal in Latvia, and the epidemiological situation in certain zones listed as restricted zones I and II in Poland has improved as regard wild porcine animals, due to the disease control measures being applied by this Member State in accordance with Union legislation. |

In April 2023, one outbreak of African swine fever in a wild porcine animal was observed in the Dienvidkurzemes Region in Latvia, in an area currently listed as a restricted zone II in Annex I to Implementing Regulation (EU) 2023/594 located in close proximity to an area currently listed as a restricted zone I in that Annex. This new outbreak of African swine fever in a wild porcine animal constitutes an increased level of risk, which should be reflected in Annex I to Implementing Regulation (EU) 2023/594. Accordingly, this areas of Latvia currently listed as a restricted zone I in Annex I to Implementing Regulation (EU) 2023/594, that is in close proximity to the area listed as a restricted zone II affected by this recent outbreak, should be listed as a restricted zone II in Annex I to Implementing Regulation (EU) 2023/594 and the current boundaries of restricted zone I need to be redefined to take account of this outbreak. |

Following this recent outbreak of African swine fever in a wild porcine animal in Latvia and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in this Member State has been reassessed and updated in accordance with Articles 5, 6 and 7 of Implementing Regulation (EU) 2023/594. In addition, the risk management measures in place have been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2023/594. |

Additionally, taking into account the effectiveness of the disease control measures for African swine fever for wild porcine animals in the restricted zones II listed in Annex I to Implementing Regulation (EU) 2023/594 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 64, 65 and 67 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Mazowieckie, Podkarpackie and Małopolskie regions in Poland, currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2023/594 should now be listed as restricted zones I in that Annex, due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zones II for the past twelve months. The restricted zones II should now be listed as restricted zones I taking account of the current African swine fever epidemiological situation. |

Further, on the basis of the information and justification provided by the Polish competent authority taking into account the effectiveness of the disease control measures for African swine fever for wild porcine animals in certain restricted zones I, and in the restricted zones that those restricted zones I are bordering, listed in Annex I to Implementing Regulation (EU) 2023/594 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 64, 65 and 67 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Podkarpackie region in Poland, currently listed as restricted zones I in Annex I to Implementing Regulation (EU) 2023/594 should now be delisted from that Annex due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zones I, and in the zones that those restricted zones I are bordering, for the past twelve months. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner new restricted zones of a sufficient size should be demarcated for Latvia and Poland, and listed as restricted zones I and II, as well as certain parts of restricted zones I should be delisted for Poland in Annex I to Implementing Regulation (EU) 2023/594. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the epidemiological situation in the surrounding areas. |

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2023/594 by this Implementing Regulation take effect as soon as possible. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Implementing Regulation (EU) 2023/594 is replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Decision 1999/70/EC concerning the external auditors of the national central banks, as regards the external auditors of Hrvatska narodna banka
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to Protocol No 4 on the Statute of the European System of Central Banks and of the European Central Bank, annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, and in particular Article 27.1 thereof,
Having regard to the Recommendation of the European Central Bank of 7 March 2023 to the Council of the European Union on the external auditors of Hrvatska narodna banka (ECB/2023/4) (1),
Whereas:

The accounts of the European Central Bank (ECB) and of the national central banks of the Member States whose currency is the euro are to be audited by independent external auditors recommended by the Governing Council of the ECB and approved by the Council of the European Union. |
|
(2) |
Hrvatska narodna banka is subject to Article 27.1 of the Statute of the European System of Central banks and of the European Central Bank since 1 January 2023. |
|
(3) |
The mandate of Hrvatska narodna banka’s current external auditors, KPMG Croatia d.o.o., will end after the audit for the financial year 2024. |
|
(4) |
The Governing Council of the ECB therefore recommended that the Council approves the current auditors, KPMG Croatia d.o.o., as the external auditors of Hrvatska narodna banka for the financial years 2023 and 2024. |
|
(5) |
Following the recommendation of the Governing Council of the ECB, Council Decision 1999/70/EC (2) should be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The following paragraph is added to Article 1 of Decision 1999/70/EC:
‘20. KPMG Croatia d.o.o. are hereby approved as the external auditors of Hrvatska narodna banka for the financial years 2023 and 2024.’.
Article 2
This Decision shall take effect on the date of its notification.
Article 3
This Decision is addressed to the European Central Bank.

on setting out the amounts corresponding to 20 % of the overall overachievement of certain Member States in the period from 2013 to 2020 pursuant to Regulation (EU) 2018/842 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/842 of the European Parliament and of the Council of 30 May 2018 on binding annual greenhouse gas emission reductions by Member States from 2021 to 2030 contributing to climate action to meet commitments under the Paris Agreement and amending Regulation (EU) No 525/2013 (1), and in particular Article 11(5) thereof,
Whereas:

Regulation (EU) 2018/842 establishes Union and national targets for the reduction of greenhouse gas emissions by 2030 and provides for the establishment of a safety reserve corresponding to up to 105 million tonnes CO2 equivalent, under the condition that the overall Union emissions reduction target is met. The safety reserve will be available, under certain circumstances, for Member States whose 2013 Gross Domestic Product (GDP) per capita was below Union average and whose cumulative greenhouse gas emissions from 2013 to 2020 in the sectors covered by that Regulation are below their cumulative annual emission allocations for the same years. On a first round of distribution of the Safety Reserve, each qualifying Member State may only receive the amount of allocations equivalent to 20 % of its 2013-2020 overachievement. |

(2) |
Pursuant to Regulation (EU) 2018/842, the Commission is to publish, after the review referred to in Article 19 of Regulation (EU) No 525/2013 of the European Parliament and of the Council (2), for each Member State that fulfils the two conditions set out in Article 11(2), points (a) and (b), of that Regulation, the amounts corresponding to 20 % of the overall overachievement in the period from 2013 to 2020. |

(3) |
The Commission has completed the review, required by Article 19 of Regulation (EU) No 525/2013, and has set out the Member States’ greenhouse gas emissions inventories for the year 2020 in Commission Implementing Decision (EU) 2022/1953 (3). |
|
(4) |
According to data published by Eurostat in April 2016 (4), in 2013 Bulgaria, Czechia, Estonia, Greece, Spain, Croatia, Italy, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Portugal, Romania, Slovenia, and Slovakia had a GDP below the Union average. |
|

The values of greenhouse gas emissions and of the greenhouse gas emissions allocations of the Member States in each year of the period 2013 to 2020 are available in the European Union transaction log set up pursuant to Article 20 of Directive 2003/87/EC of the European Parliament and of the Council establishing a system for greenhouse gas emission allowance trading within the Union (5). With the exception of Malta, the cumulative greenhouse gas emissions of each of the above-mentioned Member States in the years from 2013 to 2020, in the sectors covered by Regulation (EU) 2018/842, were below the cumulative annual emission allocations of the Member State for the years in the same period. |

Since Bulgaria, Czechia, Estonia, Greece, Spain, Croatia, Italy, Cyprus, Latvia, Lithuania, Hungary, Poland, Portugal, Romania, Slovenia, and Slovakia meet the two conditions set out in Article 11(2), points (a) and (b), of Regulation (EU) 2018/842, the amounts corresponding to 20 % of the overall overachievement for that period should be published for each of those Member States, |
HAS ADOPTED THIS DECISION:
Article 1
The amounts corresponding to 20 % of the overall overachievement of the Member States fulfilling the conditions set out in Article 11(2), points (a) and (b), of Regulation (EU) 2018/842 in the period from 2013 to 2020 are set out in the Annex to this Decision.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

amending Decision ECB/2014/16 concerning the establishment of an Administrative Board of Review and its Operating Rules (ECB/2023/11)
THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) No 1024/2013 of 15 October 2013 conferring specific tasks on the European Central Bank concerning policies relating to the prudential supervision of credit institutions (1), and in particular Article 24 thereof,
Whereas:

In the light of the experience gained since the establishment of the Administrative Board of Review, it is necessary to clarify and adapt certain aspects of its Operating Rules, which are laid down in Decision ECB/2014/16 of the European Central Bank (2), as amended by Decision (EU) 2019/1378 of the European Central Bank (ECB/2019/27) (3), in particular with respect to the role of alternates, the scope of the review by the Administrative Board of Review, the assessment of the admissibility of the request for review by the Administrative Board of Review, the methodology for the apportionment of the costs of the review incurred by the applicant and by the European Central Bank in the context of a review by the Administrative Board and certain organisational and practical matters. |

Therefore, Decision ECB/2014/16 should be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Amendments
Decision ECB/2014/16 is amended as follows:

(1) |
in Article 3, paragraph 4 is replaced by the following: ‘4. In case of permanent incapacity, death, resignation or removal from office of a member of the Administrative Board, the Governing Council shall (a) designate one alternate as a member of the Administrative Board and appoint an alternate in that alternate’s place, or (b) appoint a new member of the Administrative Board. Any appointment made pursuant to this paragraph shall be made in accordance with the procedure laid down in Article 4(2).’ |

in Article 4, paragraph 2 is replaced by the following: ‘2. Following a public call for expressions of interest published in the Official Journal of the European Union, the Executive Board, after hearing the Supervisory Board, shall submit nominations for the members of the Administrative Board and the two alternates to the Governing Council for appointment.’ |

in Article 7, paragraph 4 is replaced by the following: ‘4. The notice of review shall: (a) state the grounds on which it is based; (b) if an application is made for the review to have suspensory effect, state the grounds of such application; and (c) have attached to it copies of any documents on which the applicant intends to rely. The notice of review should have attached to it the contested decision and, if the notice of review exceeds 10 pages, it should include a summary of the grounds and documents specified in points (a) to (c).’ |

The notice of review shall clearly indicate the applicant’s full contact details so that the Secretary may send communications to the applicant or its representative as the case may be. Where the notice of review is incomplete, the Secretary shall set a time limit of a maximum of five working days within which the applicant shall complete the notice of review. Where, in the view of the Administrative Board, the applicant fails to complete the notice of review within the set time limit, the Secretary shall notify the applicant within ten working days from the expiry of that set time limit that the administrative review procedure could not be initiated because the applicant did not complete the notice of review. The notification shall state that under Article 24(11) of Regulation (EU) No 1024/2013 the administrative review procedure is without prejudice to the right to bring proceedings before the Court of Justice in accordance with the Treaties. Where the administrative review procedure is not initiated due to the absence of a complete notice of review, an opinion on the review shall not be adopted.’ |

Article 11 is replaced by the following: ‘Article 11 Admissibility of the request for review 1. Before examining the procedural and substantive conformity of an ECB decision with Regulation (EU) No 1024/2013, the Administrative Board shall determine the admissibility of the request for review. 2. If the Administrative Board deems the request for review manifestly inadmissible, it may declare the request for review inadmissible within 10 working days from the receipt of the complete notice of review. The Administrative Board shall state the reasons on which that assessment is based. 3. Where the Administrative Board declares that the request for review is inadmissible in accordance with paragraph 2, the Secretary shall notify the applicant immediately. The notification shall state that under Article 24(11) of Regulation (EU) No 1024/2013 the administrative review procedure is without prejudice to the right to bring proceedings before the Court of Justice in accordance with the Treaties. Where the request for review is declared inadmissible in accordance with paragraph 2, an opinion on the review shall not be adopted. 4. Where paragraph 2 does not apply, the Administrative Board shall rule on the admissibility of the request for review in the opinion on the review it adopts pursuant to Article 16. In this case, the Secretary shall notify the applicant within 10 working days from the receipt of the complete notice of review that the Administrative Board shall rule on the admissibility of the request for review in the opinion on the review. 5. A notice of review filed in respect of a new decision of the Governing Council as referred to in Article 24(7) of Regulation (EU) No 1024/2013 shall not be admissible.’ |

‘ANNEX
Methodology for the apportionment of the costs of the review incurred by the applicant and by the European Central Bank in the context of a review by the Administrative Board
In cases in which the Governing Council abrogates the initial decision or amends its operative part as a consequence of the notice of review, the ECB will reimburse the costs incurred by the applicant in the context of the review, with the exclusion of any disproportionate costs incurred by the applicant in submitting written or oral evidence and in respect of legal representation, which will be borne by the applicant. In any case, the reimbursement by the ECB of costs incurred by the applicant shall not exceed EUR 50 000 for each individual review by the Administrative Board.
In cases in which the Governing Council replaces the initial decision with a decision of identical content or amends only the non-operative part of the initial decision as a consequence of the notice of review, and in cases in which the Administrative Board declares a request for review inadmissible, the applicant will contribute to the costs incurred by ECB in the context of the review. Natural persons must pay a lump sum of EUR 500. Legal persons must pay a lump sum of EUR 5 000. The payment of this lump sum remains without prejudice to the application of Article 13 of this Decision.
In cases in which the applicant withdraws a notice of review pursuant to Article 7(6) of this Decision, as well as in cases where this is justified in view of the specific circumstances, the applicant and the ECB will bear their own costs, if any.
