Information relating to the entry into force of the Agreement between the European Union and the Republic of North Macedonia on operational activities carried out by the European Border and Coast Guard Agency in the Republic of North Macedonia
The Agreement between the European Union and the Republic of North Macedonia on operational activities carried out by the European Border and Coast Guard Agency in the Republic of North Macedonia will enter into force on 1 April 2023, the procedure provided for in Article 22(2) of the Agreement having been completed on 27 February 2023.

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications (‘Prosciutto di Parma’ (PDO))

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Italy’s application for the approval of amendments to the specification for the protected designation of origin ‘Prosciutto di Parma’, registered under Commission Regulation (EC) No 1107/96 (2), as amended by Regulation (EC) No 102/2008 (3). |

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (4) as required by Article 50(2)(a) of that Regulation. |

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the amendments to the specification should be approved, |
HAS ADOPTED THIS REGULATION:
Article 1
The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Prosciutto di Parma’ (PDO) are hereby approved.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Annexes V and XIV to Implementing Regulation (EU) 2021/404 as regards the entries for Canada, the United Kingdom and the United States in the lists of third countries authorised for the entry into the Union of consignments of poultry, germinal products of poultry and fresh meat of poultry and game birds

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 230(1) and 232(1) and (3) thereof.
Whereas:

Regulation (EU) 2016/429 provides that consignments of animals, germinal products and products of animal origin must come from a third country or territory, or zone or compartment thereof, listed in accordance with Article 230(1) of that Regulation in order to enter the Union. |
|
(2) |
Commission Delegated Regulation (EU) 2020/692 (2) lays down the animal health requirements that consignments of certain species and categories of animals, germinal products and products of animal origin, from third countries or territories, or zones thereof, or compartments thereof in the case of aquaculture animals, must comply with in order to enter the Union. |
|
(3) |
Commission Implementing Regulation (EU) 2021/404 (3) establishes the lists of third countries, or territories, or zones or compartments thereof, from which the entry into the Union of the species and categories of animals, germinal products and products of animal origin falling within the scope of Delegated Regulation (EU) 2020/692 is permitted. |
|
(4) |
More particularly, Annexes V and XIV to Implementing Regulation (EU) 2021/404 set out the lists of third countries, or territories, or zones thereof authorised for the entry into the Union, respectively, of consignments of poultry, germinal products of poultry, and of fresh meat from poultry and game birds. |
|
(5) |
Canada has notified the Commission of three outbreaks of highly pathogenic avian influenza in poultry in the province of Quebec, which were confirmed between 31 January 2023 and 8 February 2023 by laboratory analysis (RT-PCR). |
|
(6) |
Moreover, the United Kingdom has notified the Commission of three outbreaks of highly pathogenic avian influenza in poultry in the county of Fife (1) and in Stirling Local Authority area (1) in Scotland, United Kingdom, and in county of Norfolk (1), England, United Kingdom, which were confirmed between 2 February 2023 and 21 February 2023 by laboratory analysis (RT-PCR). |

Additionally, the United States has notified the Commission of ten outbreaks of highly pathogenic avian influenza in poultry in the states of California (1), Kansas (1), New York (1), Mississippi (2) and Pennsylvania (5), United States, which were confirmed between 1 February 2023 and 22 February 2023 by laboratory analysis (RT-PCR). |

Following those recent outbreaks of highly pathogenic avian influenza, the veterinary authorities of Canada, the United Kingdom and the United States established control zones of at least 10 km around the affected establishments and implemented a stamping-out policy in order to control the presence of highly pathogenic avian influenza and limit the spread of that disease. |
|
(9) |
Canada, the United Kingdom and the United States have submitted information to the Commission on the epidemiological situation on their territory and the measures they have taken to prevent the further spread of highly pathogenic avian influenza. That information has been evaluated by the Commission. On the basis of that evaluation and in order to protect the animal health status of the Union, the entry into the Union of consignments of poultry, germinal products of poultry, and fresh meat of poultry and game birds from the areas under restrictions established by the veterinary authorities of Canada, the United Kingdom and the United States due to the recent outbreaks of highly pathogenic avian influenza should no longer be authorised. |

Furthermore, Canada has submitted updated information on the epidemiological situation on its territory in relation to 15 outbreaks of highly pathogenic avian influenza in poultry establishments in the provinces of Alberta (3), British Columbia (2), Ontario (4), Quebec (3) and Saskatchewan (3), Canada which were confirmed between 19 September 2022 and 6 December 2022. |

In addition, the United Kingdom has submitted updated information on the epidemiological situation on its territory in relation to six outbreaks of highly pathogenic avian influenza in poultry establishments on Orkney Islands (2) and East Ayrshire (1) in Scotland, United Kingdom, and in counties of Cheshire (1) and Yorkshire (2), England, United Kingdom which were confirmed between 28 August 2022 and 8 November 2022. |

Moreover, the United States has submitted updated information on the epidemiological situation on its territory in relation to 77 outbreaks of highly pathogenic avian influenza in poultry establishments in the states of Arkansas (1), California (7), Colorado (1), Iowa (2), Minnesota (16), Mississippi (1), Nebraska (1), New York (1), North Dakota (4), Oregon (1), Pennsylvania (3), South Dakota (15), Tennessee (1), Utah (16), Washington (3) and Wisconsin (4), United States, which were confirmed between 29 March 2022 and 8 December 2022. |

Canada, the United Kingdom and the United States have also submitted information on the measures they have taken to prevent the further spread of highly pathogenic avian influenza. In particular, following those outbreaks of that disease, Canada, the United Kingdom and the United States have implemented a stamping out policy in order to control and limit the spread of that disease, and they have also completed the requisite cleaning and disinfection following the implementation of the stamping out policy on the infected poultry establishments on their territories. |

The Commission has evaluated the information submitted by Canada, the United Kingdom and the United States and concluded that the outbreaks of highly pathogenic avian influenza in poultry establishments have been cleared and that there is no longer a risk associated with the entry into the Union of poultry commodities from the zones of Canada, the United Kingdom and the United States from which the entry into the Union of poultry commodities was suspended following those outbreaks. |

(15) |
Annexes V and XIV to Implementing Regulation (EU) 2021/404 should be therefore amended to take account of the current epidemiological situation as regards highly pathogenic avian influenza in Canada, the United Kingdom and in the United States. |
|
(16) |
Taking into account the current epidemiological situation in Canada, the United Kingdom and the United States as regards highly pathogenic avian influenza and the serious risk of its introduction into the Union, the amendments to be made to Annexes V and XIV to Implementing Regulation (EU) 2021/404 by this Regulation should take effect as a matter of urgency. |

Commission Implementing Regulation (EU) 2023/139 (4) amended Annex V and Annex XIV to Implementing Regulation (EU) 2021/404 by amending in Annex V and in Annex XIV the rows for the zone CA-2.99, by setting the opening date of this previously closed zone in the entries for Canada. As errors have been detected concerning the closing date of the zone CA-2.99 in Annexes V and XIV, the rows for the zone CA-2.99 in Annexes V and XIV should be corrected accordingly. This correction should apply from the date of application of Implementing Regulation (EU) 2023/139. |

Commission Implementing Regulation (EU) 2023/268 (5) amended Annex V and Annex XIV to Implementing Regulation (EU) 2021/404 by amending in Annex V and in Annex XIV the rows GB-2.136 to GB-2.218, by setting the opening dates of these two previously closed zones in the entries for the United Kingdom. As one error has been detected concerning the definition of the zone GB-2.218 in Annex V, which could create confusion, the setting of the closing and opening dates for the zones GB-2.136 and GB-2.218 in Annex V should be reiterated. This correction should apply from the date of application of Implementing Regulation (EU) 2023/268. |

Article 3
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

authorising the placing on the market of bovine milk osteopontin as a novel food and amending Implementing Regulation (EU) 2017/2470

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2015/2283 of the European Parliament and of the Council of 25 November 2015 on novel foods, amending Regulation (EU) No 1169/2011 of the European Parliament and of the Council and repealing Regulation (EC) No 258/97 of the European Parliament and of the Council and Commission Regulation (EC) No 1852/2001 (1), and in particular Article 12(1) thereof,

Regulation (EU) 2015/2283 provides that only novel foods authorised and included in the Union list of novel foods may be placed on the market within the Union. |
|
(2) |
Pursuant to Article 8 of Regulation (EU) 2015/2283, Commission Implementing Regulation (EU) 2017/2470 (2) has established a Union list of novel foods. |
|
(3) |
On 27 March 2020, the company Arla Foods Ingredients Group P/S (‘the applicant’) submitted an application for an authorisation to the Commission in accordance with Article 10(1) of Regulation (EU) 2015/2283 to place bovine milk osteopontin (‘bmOPN’) on the Union market as a novel food. The applicant requested for bovine milk osteopontin to be used in infant formula and follow-on formula as defined in Regulation (EU) No 609/2013 of the European Parliament and of the Council (3) and in milk-based drinks intended for young children, at levels not exceeding 151 mg/L in the final product. |
|

On 27 March 2020, the applicant also made a request to the Commission for the protection of proprietary data for certificates of analyses and batch testing, stability reports and unpublished study (4) reports. |
|
(5) |
On 9 October 2020, the Commission requested the European Food Safety Authority (‘the Authority’) to carry out an assessment of bovine milk osteopontin as a novel food. |
|
(6) |
On 26 January 2022, the Authority adopted its scientific opinion on Safety of bovine milk osteopontin as a Novel food (5) in accordance with Article 11 of Regulation (EU) 2015/2283. |
|
(7) |
In its scientific opinion, the Authority concluded that bovine milk osteopontin is safe under the proposed conditions of use for infants and young children up to 35 months of age at levels not exceeding 151 mg/L. Therefore, that scientific opinion gives sufficient grounds to establish that bovine milk osteopontin, when used at levels not exceeding 151 mg/L, intended for use in infant formula (IF), follow-on formula and milk-based drinks intended for young children, fulfils the conditions for its placing on the market in accordance with Article 12(1) of Regulation (EU) 2015/2283. |

The opinion of the Authority follows the assessment of the safety of novel foods, in accordance with Regulation (EU) 2015/2283, and does not consider whether all other Union requirements for the placement of a food in the EU market are met. Therefore, infant formula and follow-on formula containing bovine milk osteopontin on the EU market must comply with the requirements of Regulation (EU) No 609/2013 and Commission Delegated Regulation (EU) 2016/127 (6). |
|

In its scientific opinion, the Authority also noted that its conclusion on the safety of the novel food was based on the scientific data from the certificates of analyses and batch testing, stability reports and unpublished study reports without which it could not have assessed the novel food and reached its conclusion. |
|

The applicant declared that they held proprietary and exclusive rights of reference to the scientific data from the certificates of analyses and batch testing, stability reports and unpublished study reports at the time they submitted the application and that the third parties cannot lawfully use or refer to those data |
|
(11) |
The Commission assessed all the information provided by the applicant and considered that it has sufficiently substantiated the fulfilment of the requirements laid down in Article 26(2) of Regulation (EU) 2015/2283. Therefore, the previously mentioned scientific data should be protected in accordance with Article 27(1) of Regulation (EU) 2015/2283. Accordingly, only the applicant should be authorised to place bovine milk osteopontin on the market within the Union during a period of five years from the entry into force of this Regulation. |
|
(12) |
However, restricting the authorisation of bovine milk osteopontin and the reference to the scientific data contained in the applicant’s file for the sole use by it does not prevent subsequent applicants from applying for an authorisation to place on the market the same novel food provided that their application is based on legally obtained information supporting such an authorisation. |
|
(13) |
As the source of the novel food comes from bovine milk, which is listed in Annex II to Regulation (EU) No 1169/2011 of the European Parliament and of the Council (7) as one of a number of substances or products which may cause allergies or intolerances, foods containing bovine milk basic protein isolate, such as bovine milk osteopontin, should be appropriately labelled following the requirements laid down in Article 21 of that Regulation. |

(14) |
It is appropriate that the inclusion of bovine milk osteopontin as a novel food in the Union list of novel foods contains the information referred to in Article 9(3) of Regulation (EU) 2015/2283. |
|
(15) |
Bovine milk osteopontin should be included in the Union list of novel foods set out in Implementing Regulation (EU) 2017/2470. The Annex to Implementing Regulation (EU) 2017/2470 should therefore be amended accordingly. |
|

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
1. Bovine milk osteopontin is authorised to be placed on the market within the Union.
Bovine milk osteopontin shall be included in the Union list of novel foods set out in Implementing Regulation (EU) 2017/2470.
2. The Annex to Implementing Regulation (EU) 2017/2470 is amended in accordance with the Annex to this Regulation.
Article 2
Only the company Arla Foods Ingredients Group P/S (8) is authorised to place on the market within the Union the novel food referred to in Article 1, for a period of five years from 26 March 2023, unless a subsequent applicant obtains an authorisation for that novel food without reference to the scientific data protected pursuant to Article 3 or with the agreement of Arla Foods Ingredients Group P/S.
Article 3
The scientific data contained in the application file and fulfilling the conditions laid down in Article 26(2) of Regulation (EU) 2015/2283 shall not be used for the benefit of a subsequent applicant for a period of five years from the date of entry into force of this Regulation without the agreement of Arla Foods Ingredients Group P/S.
Article 4
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Article 13(3) of Regulation (EC) No 1907/2006 provides that, where tests on substances are required to generate information on intrinsic properties of substances, they are to be conducted in accordance with the test methods laid down in a Commission Regulation or in accordance with other international test methods recognised as being appropriate by the Commission or the European Chemicals Agency. |

Commission Regulation (EC) No 440/2008 (2) contains, in its Annex, test methods recognised as being appropriate for generating information on the physicochemical, toxicological and eco-toxicological properties of chemicals for the purpose of Regulation (EC) No 1907/2006. |
|

Most of the test methods contained in the Annex to Regulation (EC) No 440/2008 are equivalent to internationally agreed and accepted methods (such as test guidelines of the Organisation for Economic Cooperation and Development). These methods are frequently reviewed and modified to reflect the state of science. |
|
(4) |
Repeating the full description of those internationally agreed and accepted methods in the Annex to Regulation (EC) No 440/2008 for the purpose of their incorporation into the Union legislation has led to delays in adapting that Regulation to scientific progress. As a consequence, the test methods laid down in the Annex to Regulation (EC) No 440/2008 are frequently not aligned with the most up-to-date version of the corresponding international methods. Relatedly, new international test methods are added to Regulation (EC) No 440/2008 only after a prolonged period of time. |
|

This situation has created uncertainty for registrants under Regulation (EC) No 1907/2006, as well as for duty holders under other Union legislation, as to which methods should be used for the generation of data for the purposes of that Regulation and other legislation. Article 13(2) of Regulation (EC) No 1907/2006 provides that methods are to be regularly reviewed and improved with a view to reducing testing on vertebrate animals and the number of animals involved, and that the Commission is to, if appropriate, make a proposal as soon as possible to amend Regulation (EC) No 440/2008, so as to replace, reduce or refine animal testing. Furthermore, Article 13 of Directive 2010/63/EU of the European Parliament and of the Council (3) on the protection of animals used for scientific purposes, makes it a legal obligation in the Union to use an alternative method that does not entail the use of a live animal, instead of an animal method, once such method is recognised under the legislation of the Union. Any delays to the process of introducing new alternative methods into Regulation (EC) No 440/2008 therefore could hinder a timely uptake of such methods once they are adopted at international level. |

In the Decision in case 23/2018/SRS, the European Ombudsman suggested to the Commission to intensify its efforts to simplify and speed up the process for introducing new alternative test methods under Regulation (EC) No 440/2008. Also, the European Parliament, in its resolution 2021/2784(RSP) of 16 September 2021 on plans and actions to accelerate the transition to innovation without the use of animals in research, regulatory testing and education, recalled that Article 13 of Regulation (EC) No 1907/2006 requires that the test method requirements be updated as soon as non-animal methods become available. |
|

Therefore, in order to ensure that Regulation (EC) No 440/2008 provides correct, up-to-date and relevant test methods that are appropriate to generate information under Regulation (EC) No 1907/2006, a table should be included in the Annex to that Regulation, giving a comprehensive list of such methods with a reference to the respective international test method. The inclusion of a reference to an international test method in the table should be considered as a recognition by the Commission of such method for the purposes of Article 13(3) of Regulation (EC) No 1907/2006. |
|

Full descriptions of test methods in Parts A, B and C of the Annex to Regulation (EC) No 440/2008 that no longer correspond to the most recent version of an international test method should be deleted from that Annex to prevent tests being performed following protocols that do not provide state-of-the-art scientific information. |
|
(9) |
Certain test methods set out in the Annex to Regulation (EC) No 440/2008, as well as their corresponding international test methods, are no longer considered appropriate to generate new information under Regulation (EC) No 1907/2006. The test methods B.22. Rodent dominant lethal test; B.25. Mouse heritable translocation; B.34. One-generation reproductive toxicity study; B.35. Two-generation reproductive toxicity study; B.39. Unscheduled DNA synthesis (UDS) test with mammalian liver cells in vivo; and C.15. Fish, Short term toxicity test on Embryo and Sac Fry Stages; should therefore be deleted from that Annex and there should be no entry referring to them in the table set out in that Annex. |

Regulation (EC) No 440/2008 should therefore be amended accordingly. |

HAS ADOPTED THIS REGULATION:
Article 1
The Annex to Regulation (EC) No 440/2008 is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EC) No 1881/2006 as regards maximum levels of arsenic in certain foods

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EEC) No 315/93 of 8 February 1993 laying down Community procedures for contaminants in food (1), and in particular Article 2(3) thereof,
Whereas:

Commission Regulation (EC) No 1881/2006 (2) sets maximum levels for certain contaminants in foodstuffs, including inorganic arsenic in a range of foodstuffs. |
|
(2) |
Arsenic is a ubiquitous metalloid present at low concentrations in rocks, soil and natural ground water. In addition, anthropogenic activity has also contributed to increase the levels of arsenic in the environment through industrial emissions (mining, smelting of non-ferrous metals and burning of fossil fuels) as well as with the use of arsenic as part of fertilisers, wood preservatives, insecticides or herbicides. Although dermal and inhalation exposure is possible, food and drinking water are the principal routes of exposure to arsenic. |

On 12 October 2009, the Scientific Panel on Contaminants in the Food Chain (‘the CONTAM Panel’) of the European Food Safety Authority (‘the Authority’) adopted an opinion on arsenic in food (3). In that opinion, the CONTAM Panel concluded that the provisional tolerable weekly intake (PTWI) of 15 μg/kg body weight (b.w.), established by the Joint FAO/WHO Expert Committee on Food Additives (‘JECFA’) was no longer appropriate, as data had shown that inorganic arsenic causes cancer of the lung, of the urinary bladder and the skin, and that a range of adverse effects had been reported at exposures lower than those reviewed by the JECFA. |
|

The CONTAM Panel identified a range of ‘benchmark dose lower confidence limit’ (BMDL01) values between 0,3 and 8 μg/kg b.w. per day for cancers of the lung, skin and bladder, as well as skin lesions. In its scientific opinion, the CONTAM Panel concluded that the estimated dietary exposures to inorganic arsenic for average and high level consumers in Europe are within the range of the BMDL01 values identified, and that therefore the possibility of a risk to some consumers cannot be excluded. |
|

The scientific opinion identified high consumers of rice in Europe, such as certain ethnic groups and children under three years of age, as most subjected to inorganic arsenic dietary exposure. Dietary exposure to inorganic arsenic for children under three years old, including from rice-based foods, was estimated to be about 2 to 3-fold that of adults. |
|

In its scientific report of 2014 (4) on the dietary exposure to inorganic arsenic in the European population, the Authority identified grain-based products as the main contributor to the exposure, and rice, milk and dairy products as important contributors. However, the heterogeneity of the food consumption data, the conversion of total arsenic to inorganic arsenic and the treatment of left censored data represented significant uncertainties in the exposure assessment. |
|

In light of that information, Commission Regulation (EU) 2015/1006 (5) set maximum levels for the presence of inorganic arsenic only in rice and rice-based products and in accordance with Commission Recommendation (EU) 2015/1381 (6), Member States were called upon to monitor, during 2016, 2017 and 2018, the presence of arsenic in foods, preferably by determining the content of inorganic and total arsenic and, if possible, other relevant arsenic species, in a wide variety of foods. |
|

In its scientific report of 2021 (7), the Authority assessed the chronic dietary exposure to inorganic arsenic, taking into account the most recent occurrence data for inorganic arsenic in food. It concluded that across the different age classes, the main contributors to the dietary exposure to inorganic arsenic were rice, rice-based products, grains and grain-based products not containing rice and drinking water. The Authority has further concluded that particular foodstuffs indicated for the young population (e.g. cereal-based food for infants and young children and biscuits, rusks and cookies for children, infant formulae, follow-on formulae, foods for special medical purposes intended for infants and young children and young child formulae, baby foods and fruit juices) made a relevant contribution in the dietary exposure to inorganic arsenic in this population group. |
|
(9) |
The existing mean and 95th percentile exposures to arsenic in food still lie within the range of the BMDL01 values identified in the CONTAM Panel scientific opinion of 2009. It is therefore appropriate to establish new maximum levels for commodities contributing to exposure to arsenic and lower existing maximum levels, where feasible on the basis of the occurrence data. |
|
(10) |
The Codex Alimentarius sets a maximum level of 0,5 mg/kg for total arsenic in salt (8). It is appropriate to set the same maximum level in Union legislation. |
|
(11) |
Regulation (EC) No 1881/2006 should therefore be amended accordingly. |
|
(12) |
Taking into account that certain foodstuffs covered by this Regulation have a long shelf life, foodstuffs that were lawfully placed on the market before the date of application of this Regulation should be allowed to remain on the market. |
|
(13) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
The Annex to Regulation (EC) No 1881/2006 is amended in accordance with the Annex to this Regulation.
Article 2
Foodstuffs that were lawfully placed on the market before the entry into force of this Regulation may remain on the market until their date of minimum durability or use-by date.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Annexes II, III and V to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for isoxaben, novaluron and tetraconazole in or on certain products

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (1), and in particular Article 14(1), point (a), Article 18(1), point (b), and Article 49(2) thereof,

For isoxaben, novaluron and tetraconazole maximum residue levels (‘MRLs’) were set in Part A of Annex III to Regulation (EC) No 396/2005. |
|
(2) |
For isoxaben, the European Food Safety Authority (‘the Authority’) submitted a reasoned opinion on the review of the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (2). The Authority recommended lowering the existing MRLs for fruits and tree nuts, root and tuber vegetables, bulb vegetables, melons, pumpkins, witloof, chives, celery leaves, stem vegetables, sage, rosemary, thyme, basil, oilseeds and oil fruits, cereals, and chicory roots, in line with the principle of setting MRLs at levels as low as reasonably achievable and based on sufficient supporting data for the current good agricultural practices (‘GAPs’). It recommended keeping the existing MRLs for courgettes and beans (fresh, without pods) based on sufficient supporting data for the current GAPs. As there is no risk for consumers with any of those MRLs, it is appropriate to set the MRLs for those products in Annex II to Regulation (EC) No 396/2005 at the level identified by the Authority. |

For isoxaben, the Authority further concluded that the MRLs for cotton seed, herbal infusions (dried, flowers), herbal infusions (dried, roots), and hops should be set at the current limits of determination (‘LOD’) specific to each product, in line with the principle of setting MRLs at levels as low as reasonably achievable and based on the current GAPs. However, as some information was not available, further consideration by risk managers was required. Therefore, while these MRLs are considered safe, they will be reviewed. The review will take into account the information available within two years from the publication of this Regulation. As there is no risk for consumers, it is appropriate to set the MRLs for those products at the LODs specific to each product in Annex II to Regulation (EC) No 396/2005. |

For isoxaben, an application pursuant to Article 6(1) of Regulation (EC) No 396/2005, requesting a modification of the existing MRL for peas (fresh, without pods) was submitted. As regards this application, a Member State made a request to use the fast-track procedure, foreseen in the Technical Guidelines on the MRL setting procedure (3), to set an MRL based on residue trials on beans (fresh, without pods). The Authority has recently assessed residue trials on beans (fresh, without pods) in the framework of the review of the existing MRLs for isoxaben and gave a reasoned opinion on the proposed MRL (4). This opinion from the Authority relies on the current scientific and technical knowledge on the subject. As it is appropriate to extrapolate from the residue trials on beans (fresh, without pods) to peas (fresh, without pods), as confirmed by the existing Union guidelines on extrapolation of MRLs (5), it is unnecessary to request the Authority to provide a reasoned opinion on peas (fresh, without pods). It is therefore appropriate to set the MRL for peas (fresh, without pods) at the same level as the MRL for beans (fresh, without pods) on the basis of the residue trials performed on beans (fresh, without pods) in Annex II to Regulation (EC) No 396/2005. |

For novaluron, the Authority submitted a reasoned opinion on the review of the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (6). In view of various data gaps on toxicologically relevant issues, including uncertainties regarding possible endocrine disruptor properties of that active substance, the Authority could not rule out harmful effects on human health with the MRLs for novaluron in all products. It is therefore appropriate to set the MRLs for all products at the LODs specific to each product in Annex V to Regulation (EC) No 396/2005. |
|

For novaluron, the European Union reference laboratories for residues of pesticides proposed to change the residue definition to ‘Novaluron (sum of constituent isomers)’ to clarify that residues can occur at any isomer ratio, as novaluron is a chiral compound. The Commission considers this new residue definition to be appropriate as it will ensure a high level of consumer protection and facilitate controls by enforcement authorities, and it does not affect the Authority’s reasoned opinion. Therefore, in accordance with Article 14(2)(f) of Regulation (EC) No 396/2005, the residue definition for novaluron should be ‘Novaluron (sum of constituent isomers)’. |
|

For tetraconazole, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (7). It recommended keeping the existing MRL for kaki/Japanese persimmons based on sufficient supporting data for the current GAPs. As there is no risk for consumers, it is appropriate to set the MRL for kaki/Japanese persimmons in Annex II to Regulation (EC) No 396/2005 at the level identified by the Authority. |
|

For tetraconazole, the Authority further concluded that the MRLs for loquats, apricots, peaches, table grapes, wine grapes, strawberries, cucumbers, gherkins, courgettes, rye, wheat, sugar beet root, products of animal origin except bovine liver and horse liver, and milks should be lowered in line with the principle of setting MRLs at levels as low as reasonably achievable and based on the current GAPs. It concluded that the MRLs for apples, pears, quinces, medlars, witloofs, globe artichokes, linseeds, rapeseeds, and birds’ eggs should be maintained based on the current GAPs. It further concluded that the MRLs for tomatoes, aubergines, melons, pumpkins, watermelons, chicory roots, bovine liver and horse liver should be raised based on the current GAPs. However, as some information was not available, further consideration by risk managers was required. Therefore, while these MRLs are considered safe, they will be reviewed. The review will take into account the information available within two years from the publication of this Regulation. As there is no risk for consumers, it is appropriate to set the MRLs for those products in Annex II to Regulation (EC) No 396/2005 at the levels identified by the Authority. |

For tetraconazole, the Authority identified that no residue trials were available to derive MRL values for peppers, barley, buckwheat, maize, millet, oat, rice, and sorghum, so that further consideration by risk managers was required. In the absence of such trials, the Commission considers that it is appropriate to set the MRLs for those products at the LODs specific to each product in Annex II to Regulation (EC) No 396/2005. |

For isoxaben and tetraconazole, to allow for the normal marketing, processing and consumption of products, this Regulation should not apply to products, which have been produced in the Union or imported into the Union before the new MRLs become applicable and for which a high level of consumer protection is maintained. |

(17) |
A reasonable period should be allowed to elapse before the new MRLs become applicable, in order to permit Member States, third countries and food business operators to adapt themselves to the requirements which result from the modification of the MRLs. |
|
(18) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annexes II, III and V to Regulation (EC) No 396/2005 are amended in accordance with the Annex to this Regulation.
Article 2
As regards the active substances isoxaben and tetraconazole in and on all products, Regulation (EC) No 396/2005 as it stood before being amended by this Regulation shall continue to apply to products which were produced in the Union or imported into the Union before 26 September 2023.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
It shall apply from 26 September 2023.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications (‘Prosciutto di San Daniele’ (PDO))
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,
Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Italy’s application for the approval of amendments to the specification for the protected designation of origin ‘Prosciutto di San Danielle’, registered under Commission Regulation (EC) No 1107/96 (2). |
|

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (3) as required by Article 50(2)(a) of that Regulation. |
|
(3) |
On 21 June 2022 the Commission received a notice of opposition and the related reasoned statement of opposition from a legal person established in the United Kingdom. |
|
(4) |
The opponent alleged that the amendments were contrary to Article 5(1) and Article 7(1) of Regulation (EU) No 1151/2012, since they introduced excessive and unjustified restrictions on raw materials and would have resulted, if approved, in unequal treatment of the operators to the advantage of Italian producers. The opposition was deemed admissible. Consequently, by letter dated 24 August 2022, the Commission invited Italy and the opponent to engage in appropriate consultations to seek an agreement. |
|

Following the consultations, an agreement was reached between Italy and the opponent, which was communicated to the Commission by letter of 21 November 2022. As a result, the opponent withdrew its opposition and agreed that no changes were needed to the proposed amendments to the product specification of protected designation of origin ‘Prosciutto di San Daniele’. |
|

On 23 June 2022 the Commission received a notice of opposition from the Netherlands, which was followed by a reasoned statement of opposition sent on 25 August 2022. In accordance with Article 51(2) of Regulation (EU) No 1151/2012, the notice of opposition is to be followed within two months by a reasoned statement of opposition. In the present case, the reasoned statement of opposition from the Netherlands was not sent within the prescribed deadline. Therefore, the opposition from the Netherlands is deemed inadmissible. |
|

In the light of the above, the Commission considers that the amendments to the specification for the protected designation of origin ‘Prosciutto di San Daniele’ should be approved, |
HAS ADOPTED THIS REGULATION:
Article 1
The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Prosciutto di San Daniele’ (PDO) are hereby approved.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

A new service – Helpline for Victims of Violence Against Women – has been identified by the Commission as a service of social value that may benefit from a harmonised number. For these reasons, the Annex to Decision 2007/116/EC should be amended to introduce the additional reserved number of 116 016. |

(3) |
Decision 2007/116/EC should therefore be amended accordingly. |
|
(4) |
The measures provided for in this Decision are in accordance with the opinion of the Communications Committee, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Decision 2007/116/EC is replaced by the Annex to this Decision.
Article 2
Member States shall take all necessary measures to ensure that as from 30 April 2023 the competent National Regulatory Authority can assign the number that is added to the list of numbers reserved for harmonised services of social value in the Annex.

amending the Annex to Implementing Decision (EU) 2021/641 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:

Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and may have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into establishments where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other establishments where poultry or captive birds are kept. |
|
(2) |
Regulation (EU) 2016/429 establishes a new legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI. |
|
(3) |
Commission Implementing Decision (EU) 2021/641 (3) was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI. |
|
(4) |
More particularly, Implementing Decision (EU) 2021/641 provides that the protection, surveillance and further restricted zones established by the Member States following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection, surveillance and further restricted zones in the Annex to that Implementing Decision. |
|
(5) |
The Annex to Implementing Decision (EU) 2021/641 was recently amended by Commission Implementing Decision (EU) 2023/343 (4) following outbreaks of HPAI in poultry or captive birds in Czechia, Germany, France, the Netherlands, Austria, Poland, Romania and Slovakia that needed to be reflected in that Annex. |
|
(6) |
Since the date of adoption of Implementing Decision (EU) 2023/343, Germany, France, Hungary and Poland have notified the Commission of new outbreaks of HPAI in establishments where poultry or captive birds were kept, located in Lower Saxony and Thuringia Lander in Germany, in Bretagne and Normandie administrative regions in France, in Bács-Kiskun and Hajdú-Bihar counties in Hungary and in Łódź, Lubusz, Warmian-Masurian and West Pomeranian voivodeships in Poland. |
|
(7) |
In addition, Spain has notified the Commission of an outbreak of HPAI in an establishment where poultry were kept, located in Lleida Province. |
|
(8) |
The competent authorities of Germany, Spain, France, Hungary and Poland have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around those outbreaks. |
|
(9) |
In addition, the competent authorities of France decided to establish further restricted zones in addition to the protection and surveillance zones established for certain outbreaks located in that Member State. |
|
(10) |
The Commission has examined the disease control measures taken by Germany, Spain, France, Hungary and Poland in collaboration with those Member States, and it is satisfied that the boundaries of the protection and surveillances zones Germany, Spain, France, Hungary and Poland, established by the competent authority of those Member States are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed. |
|
(11) |
In the Annex to Implementing Decision (EU) 2021/641 there are currently no areas listed as protection and surveillance zones for Spain. |
|
(12) |
In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Germany, Spain, France, Hungary and Poland, the protection and surveillance zones duly established by those Member States in accordance with Delegated Regulation (EU) 2020/687, as well as the further restricted zones established by France. |
|
(13) |
Therefore, the areas listed as protection and surveillance zones for Germany, France, Hungary and Poland, as well as the areas listed as further restricted zones for France in the Annex to Implementing Decision (EU) 2021/641 should be amended. |
|
(14) |
In addition, protection and surveillance zones should be listed for Spain in the Annex to Implementing Decision (EU) 2021/641. |
|
(15) |
Accordingly, the Annex to Implementing Decision (EU) 2021/641 should be amended to update regionalisation at Union level to take account of the protection and surveillance zones duly established by Germany, Spain, France, Hungary and Poland and of the further restricted zones established by France in accordance with Delegated Regulation (EU) 2020/687, and the duration of the measures applicable therein. |
|
(16) |
Implementing Decision (EU) 2021/641 should therefore be amended accordingly. |
|
(17) |
Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2021/641 by this Decision take effect as soon as possible. |

not approving d-Allethrin as an existing active substance for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 89(1), third subparagraph, thereof,
Whereas:

Commission Delegated Regulation (EU) No 1062/2014 (2) establishes a list of existing active substances to be evaluated for their possible approval for use in biocidal products. That list includes (RS)-3-Allyl-2-methyl-4-oxocyclopent-2- enyl-(1R,3R;1R,3S)-2,2-dimethyl-3-(2-methylprop-1-enyl)-cyclopropanecarboxylate (mixture of 4 isomers 1R trans, 1R: 1R trans, 1S: 1R cis, 1R: 1R cis, 1S 4:4:1:1) (‘d-Allethrin’) (CAS No: 231937-89-6). |

D-Allethrin has been evaluated for use in biocidal products of product-type 18, (insecticides, acaricides and products to control other arthropods), as described in Annex V to Regulation (EU) No 528/2012. |
|
(3) |
Germany was designated as the rapporteur Member State and its evaluating competent authority submitted the assessment report together with its conclusions to the European Chemicals Agency (‘the Agency’) on 11 January 2017. After the submission of the assessment report, discussions took place in technical meetings organised by the Agency. |
|
(4) |
In accordance with Article 75(1), point (a), of Regulation (EU) No 528/2012, the Biocidal Products Committee prepares the opinion of the Agency regarding the applications for approval of active substances. In accordance with Article 7(2) of Delegated Regulation (EU) No 1062/2014, the Biocidal Products Committee adopted the opinion of the Agency on 12 October 2021 (3), having regard to the conclusions of the evaluating competent authority. |
|
(5) |
According to the opinion of the Agency, biocidal products of product-type 18 containing d-Allethrin cannot be expected to meet the criteria laid down in Article 19(1), points (b)(iii), and (iv), of Regulation (EU) No 528/2012. |
|
(6) |
In its opinion, the Agency noted that the proposed reference specifications, established on the basis of data provided by one of the applicants, are not in line with the composition of the material that was used for testing to generate the toxicological data provided by the applicants. As a result, on the basis of the data provided in the applications, it could not be established whether the representative biocidal products could fulfil the criteria referred to in Article 19(1), point (b) of Regulation (EU) No 528/2012. |

(7) |
According to the opinion of the Agency, based on the available toxicological data, an unacceptable risk has been identified for the general public due to secondary exposure to genotoxic photometabolites formed after the application of the representative products. |
|
(8) |
In addition, according to the opinion of the Agency, an unacceptable risk to the environment has been identified for the aquatic compartment (surface water and sediment) and for soil. |
|
(9) |
In conclusion, no safe use could be identified when considering the risks to human health and the environment for each of the representative biocidal products submitted in the applications. |
|
(10) |
The conditions for approval of d-Allethrin laid down in Article 4(1) of Regulation (EU) No 528/2012 are therefore not met. |
|
(11) |
Taking into account the opinion of the Agency, it is not appropriate to approve d-Allethrin for use in biocidal products of product-type 18. |
|
(12) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS DECISION:
Article 1
D-Allethrin (CAS No: 231937-89-6) is not approved as an active substance for use in biocidal products of product-type 18.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

postponing the expiry date of the approval of 4,5-Dichloro-2-octyl-2H-isothiazol-3-one for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 14(5) thereof,
After consulting the Standing Committee on Biocidal Products,
Whereas:

4,5-Dichloro-2-octyl-2H-isothiazol-3-one (‘DCOIT’) was included in Annex I to Directive 98/8/EC of the European Parliament and of the Council (2) as an active substance for use in biocidal products of product-type 8. Pursuant to Article 86 of Regulation (EU) No 528/2012, it is therefore considered approved under that Regulation subject to the conditions set out in Annex I to Directive 98/8/EC. |
|
(2) |
The approval of DCOIT for use in biocidal products of product-type 8 (‘the approval’) is to expire on 30 June 2023. On 23 December 2021, an application was submitted in accordance with Article 13(1) of Regulation (EU) No 528/2012 for the renewal of the approval (‘the application’). |
|
(3) |
On 24 October 2022, the evaluating competent authority of Norway informed the Commission that it had decided, pursuant to Article 14(1) of Regulation (EU) No 528/2012, that a full evaluation of the application was necessary. Pursuant to Article 8(1) of that Regulation, the evaluating competent authority is to perform a full evaluation of the application within 365 days of its validation. |
|
(4) |
The evaluating competent authority may, as appropriate, require the applicant to provide sufficient data to carry out the evaluation, in accordance with Article 8(2) of Regulation (EU) No 528/2012. In that event, the 365-day period is suspended for a period that may not exceed 180 days in total unless a longer suspension is justified by the nature of the data requested or by exceptional circumstances. |
|
(5) |
Within 270 days of receipt of a recommendation from the evaluating competent authority, the European Chemicals Agency is to prepare and submit to the Commission an opinion on renewal of the approval of the active substance in accordance with Article 14(3) of Regulation (EU) No 528/2012. |
|
(6) |
Consequently, for reasons beyond the control of the applicant, the approval is likely to expire before a decision has been taken on its renewal. It is therefore appropriate to postpone the expiry date of the approval for a period of time sufficient to enable the examination of the application. Taking into account the time-limits for evaluation by the evaluating competent authority and for preparation and submission by the European Chemicals Agency of its opinion, and the time needed to decide whether the approval of DCOIT for use in biocidal products for product-type 8 may be renewed, the expiry date should be postponed to 31 December 2025. |

(7) |
After the postponement of the expiry date of the approval, DCOIT remains approved for use in biocidal products of product-type 8 subject to the conditions set out in Annex I to Directive 98/8/EC, |
HAS ADOPTED THIS DECISION:
Article 1
The expiry date of the approval of 4,5-Dichloro-2-octyl-2H-isothiazol-3-one for use in biocidal products of product-type 8 set out in Annex I to Directive 98/8/EC is postponed to 31 December 2025.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
