DECISION (EU) 2023/136 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL
of 18 January 2023
amending Directive 2003/87/EC as regards the notification of offsetting in respect of a global market-based measure for aircraft operators based in the Union

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 192(1) thereof,
Having regard to the proposal from the European Commission,
After transmission of the draft legislative act to the national parliaments,
Having regard to the opinion of the European Economic and Social Committee (1),
Having regard to the opinion of the Committee of the Regions (2),
Acting in accordance with the ordinary legislative procedure (3),
Whereas:

The Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA) of the International Civil Aviation Organization (ICAO) has been in operation since 2019 as regards the monitoring, reporting and verification of emissions, and is intended to be a globally applied market-based measure aiming to offset international aviation carbon dioxide emissions from 1 January 2021 above a fixed emissions level with certain offset credits. |

The Paris Agreement, adopted in December 2015 under the United Nations Framework Convention on Climate Change (UNFCCC) (4), entered into force in November 2016. Its Parties have agreed to hold the increase in the global average temperature well below 2 °C above pre-industrial levels and to pursue efforts to limit the temperature increase to 1,5 °C above pre-industrial levels. That commitment has been reinforced with the adoption of the Glasgow Climate Pact in November 2021, in which the Conference of the Parties recognised that the impacts of climate change would be much lower at a temperature increase of 1,5 °C, compared with 2 °C, and resolved to pursue efforts to limit the temperature increase to 1,5 °C. |

Subject to the differences between Union legislation and the provisions in the First Edition of Annex 16, Volume IV, to the Convention on International Civil Aviation – Carbon Offsetting and Reduction Scheme for International Aviation, establishing the International Standards and Recommended Practices on Environmental Protection for CORSIA (CORSIA SARPs), and which were notified to ICAO following the adoption of Council Decision (EU) 2018/2027 (5), and subject to the manner in which the European Parliament and the Council amend Union legislation, the Union intends to implement CORSIA through Directive 2003/87/EC of the European Parliament and of the Council (6). |

Commission Delegated Regulation (EU) 2019/1603 (7) was adopted in order to appropriately implement the rules of CORSIA for monitoring, reporting and verification of aviation emissions. The offsetting within the meaning of the CORSIA SARPs is calculated on the basis of CO2 emissions verified in accordance with that Delegated Regulation. |

Due to a large decrease in aviation emissions in 2020 as a consequence of the COVID-19 pandemic, the ICAO Council decided in its 220th session in June 2020 that 2019 emissions should be used as baseline for calculating the offsetting to be carried out by aircraft operators for the years 2021 to 2023. That decision was endorsed by the ICAO 41st Assembly in October 2022. |

Aviation emissions did not exceed their collective 2019 levels in 2021. On 31 October 2022, ICAO determined that the Sector Growth Factor (SGF) for 2021 emissions equals zero. The SGF is a parameter of the CORSIA methodology used to calculate operators’ annual offsetting requirements. Therefore, aircraft operators’ additional offsetting is to be zero for the year 2021. |

Member States should implement CORSIA by notifying aircraft operators that hold an air operator certificate issued by a Member State and aircraft operators that are registered in a Member State of those aircraft operators’ offsetting in respect of the year 2021 by 30 November 2022. |
|

Since the objectives of this Decision cannot be sufficiently achieved by the Member States but can rather, by reason of its scale and effects, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union. In accordance with the principle of proportionality as set out in that Article, this Decision does not go beyond what is necessary in order to achieve those objectives. |

It is important to ensure there is legal certainty for national authorities and for aircraft operators as regards CORSIA offsetting for the year 2021, as soon as possible in 2022. Accordingly, this Decision should enter into force without delay. |
|
(10) |
Without prejudice to the adoption of a Directive of the European Parliament and of the Council amending Directive 2003/87/EC as regards the contribution of aviation to the Union’s economy-wide emissions reduction target, and appropriately implementing a global market-based measure, this Decision is intended to be a purely temporary measure that is only to apply pending the expiration of the transposition period of that Directive. In the event that the transposition period has not expired by 30 November 2023 and ICAO determines that the SGF for 2022 emissions equals zero, Member States should notify aircraft operators that their offsetting requirements in respect of the year 2022 amount to zero. If the SGF for 2022 emissions is different from zero, the Commission should be able, where appropriate, to submit a new proposal for the calculation and the notification of those offsetting requirements. |

Directive 2003/87/EC should therefore be amended accordingly, |
HAVE ADOPTED THIS DECISION:
Article 1
In Article 12 of Directive 2003/87/EC, the following paragraphs are added:
‘6. By 30 November 2022, Member States shall notify aircraft operators that, in respect of the year 2021, their offsetting requirements within the meaning of paragraph 3.2.1 of ICAO’s International Standards and Recommended Practices on Environmental Protection for Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA SARPs) amount to zero. Member States shall notify aircraft operators that fulfil the following conditions:
|
(a) |
the aircraft operators hold an air operator certificate issued by a Member State or are registered in a Member State, including in the outermost regions, dependencies and territories of that Member State; and |
|
(b) |
they produce annual CO2 emissions greater than 10 000 tonnes from the use of aeroplanes with a maximum certified take-off mass greater than 5 700 kg conducting flights covered by Annex I to this Directive and by Article 2(3) of Commission Delegated Regulation (EU) 2019/1603 (*1), other than those departing and arriving in the same Member State, including the outermost regions of that Member State, from 1 January 2021. |
For the purposes of the first subparagraph, point (b), CO2 emissions from the following types of flights shall not be taken into account:

(i) |
state flights; |
|
(ii) |
humanitarian flights; |
|
(iii) |
medical flights; |
|
(iv) |
military flights; |
|
(v) |
firefighting flights; |
|
(vi) |
flights preceding or following a humanitarian, medical or firefighting flight, provided that such flights were conducted with the same aircraft and were required to accomplish the related humanitarian, medical or firefighting activities or to reposition the aircraft after those activities for its next activity. |
7. Pending a legislative act amending this Directive as regards the contribution of aviation to the Union’s economy-wide emission reduction target and appropriately implementing a global market-based measure, and in the event that the period for the transposition of such a legislative act has not expired by 30 November 2023, and the Sector Growth Factor (SGF) for 2022 emissions, to be published by ICAO, equals zero, Member States shall, by 30 November 2023, notify aircraft operators that, in respect of the year 2022, their offsetting requirements within the meaning of paragraph 3.2.1 of ICAO’s CORSIA SARPs amount to zero.
Article 2
This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

amending Regulation (EC) No 1893/2006 of the European Parliament and of the Council establishing the statistical classification of economic activities NACE Revision 2

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1893/2006 of the European Parliament and of the Council of 20 December 2006 establishing the statistical classification of economic activities NACE Revision 2 and amending Council Regulation (EEC) No 3037/90 as well as certain EC Regulations on specific statistical domains (1), and in particular Article 6(2) thereof,
Whereas:

In order to function, the internal market requires statistical standards applicable to the collection, transmission and publication of national and Union statistics so that businesses, financial institutions, governments and all other operators in the internal market can have access to reliable and comparable statistical data. To this end, it is vital that the various categories for classifying activities in the Union be interpreted uniformly in all the Member States. |

(2) |
Reliable and comparable statistics are necessary to enable businesses to assess their competitiveness, and are useful to the Union institutions in preventing distortions of competition. |
|
(3) |
Regulation (EC) No 1893/2006 established a common statistical classification of economic activities in the European Community (hereinafter referred to as ‘NACE Rev. 2’), to meet the requirements of statistics at the time of its adoption, and for as long as it remained in line with the technological environment and the structure of the economy, as well as with the relevant international economic and social classifications. |
|

Regulation (EC) No 1893/2006 empowers the Commission to adopt delegated acts, amending Annex I, to take account of technological or economic developments or to align it with other economic and social classifications. |
|
(5) |
Since the entry into force of NACE Rev. 2 on 1 January 2008, globalisation and digitalisation have changed the way in which many economic activities provide goods and services. New activities have gained in importance while others have lost importance in the global economy. Rapid changes have also taken place in the information-technology environment. In addition, the increased awareness of the impact of the economy on the environment has created specialised activities to protect the environment. |
|
(6) |
The international comparability of economic statistics requires that the Member States and the Union institutions use classifications of economic activities that are directly linked to the International Standard Industrial Classification of all Economic Activities (ISIC). |
|
(7) |
Following the adoption by the Statistical Commission of the United Nations of Revision 5 of the International Standard Industrial Classification of All Economic Activities (‘ISIC Rev. 5’), the NACE classification should be adapted in order to maintain its comparability and consistency with the standards for classifying economic activities used at international level. |
|
(8) |
By taking new economic activities rendered possible by recent structural, scientific and technological developments into account, the NACE classification should more closely reflect the reality of current economic activities in the Union. |
|
(9) |
An up-to-date NACE classification is central to the Commission’s ongoing efforts to modernise the production of Union statistics. This up-to-date classification is expected to contribute, through more comparable and relevant data, to better economic governance at both Union and national level. |
|
(10) |
Regulation (EC) No 1893/2006 should therefore be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Regulation (EC) No 1893/2006 is replaced by the Annex to this Regulation.
Article 2
1. This Regulation shall apply to the data transmissions to the Commission (Eurostat) relating to each reference period from 1 January 2025.
2. By way of derogation from paragraph 1, this Regulation shall apply to the data transmissions from the following dates:

(a) |
for Council Regulation (EC) No 530/1999 (2), as regards:
|
|
(b) |
for Regulation (EC) No 2150/2002 of the European Parliament and of the Council (3), it shall apply to the data transmissions relating to each reference period from 1 January 2026; |
|
(c) |
for Regulation (EC) No 450/2003 of the European Parliament and of the Council (4), it shall apply to the data transmissions relating to each reference period from 1 January 2027; |
|
(d) |
for Regulation (EC) No 138/2004 of the European Parliament and of the Council (5), it shall apply to the data transmissions relating to each reference period from 1 January 2028; |
|
(e) |
for Regulation (EC) No 1552/2005 of the European Parliament and of the Council (6), it shall apply to the data transmissions relating to each reference period from 1 January 2030; |
|
(f) |

COMMISSION IMPLEMENTING REGULATION (EU) 2023/138

laying down a list of specific high-value datasets and the arrangements for their publication and re-use

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive (EU) 2019/1024 of the European Parliament and of the Council of 20 June 2019 on open data and the re-use of public sector information (1), and in particular Article 14(1) thereof,
Whereas:

(1) |
It transpires from Directive (EU) 2019/1024 that an EU-wide list of datasets with a particular potential to generate socio-economic benefits and with harmonised re-use conditions is a significant enabler of cross-border data applications and services. |
|
(2) |
The main objective of establishing the list of high-value datasets is to ensure that public data of highest socio-economic potential are made available for re-use with minimal legal and technical restriction and free of charge. |
|
(3) |
Harmonising the implementation of the re-use conditions of high-value datasets entails the technical specification for making the datasets available in a machine-readable format and via application programming interfaces (APIs). Making high-value datasets available under optimal conditions strengthens the open data policies in the Member States, building on the principles of findability, accessibility, interoperability and reusability (FAIR principles). |
|
(4) |
Annex I to Directive (EU) 2019/1024 lays down the themes of high-value datasets by listing six thematic data categories: 1) geospatial; 2) earth observation and environment; 3) meteorological; 4) statistics; 5) companies and company ownership; and 6) mobility. |
|
(5) |
Following a wide stakeholder consultation and given the result of the impact assessment for this Implementing Regulation, the Commission identified, within each of the six data categories, several datasets of particularly high value and the arrangements for their publication and re-use. The provisions of Union and Member State legislation that go beyond the minimum requirements set out in this Implementing Regulation, in particular in cases of sectoral law, are to continue to apply. |
|
(6) |
Pursuant to Directive (EU) 2019/1024, the requirement to make high-value datasets available free of charge shall not apply to libraries, including university libraries, museums and archives. Member States may exempt individual public sector bodies, upon their request and in line with the criteria set out in the Directive from the requirement to make high-value datasets available free of charge for a period not exceeding two years from the date of the entry into force of this Implementing Regulation. |
|
(7) |
Directive (EU) 2019/1024 stipulates in its Article 14(3) that this Implementing Regulation shall provide that the availability of high-value datasets free of charge is not to apply to specific high-value datasets held by public undertakings where that would lead to a distortion of competition in the relevant markets. However, data held by public undertakings are not included in the scope of this Implementing Regulation. |
|
(8) |
Where making high-value datasets available for re-use entails the processing of personal data, such processing should be carried out in accordance with Union law on the protection of individuals with regard to the processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (2) and including any provisions of national law further specifying the application of the GDPR. Member States should make use of appropriate methods and techniques (such as generalisation, aggregation, suppression, anonymisation, differential privacy or randomisation), thus making as much data as possible available for re-use. |
|
(9) |
In addition to Directive (EU) 2019/1024, other Union legal acts, including Directive 2007/2/EC of the European Parliament and of the Council (3) and Directive 2005/44/EC of the European Parliament and of the Council (4) may be of relevance for the re-use of public sector information falling within the scope of this Implementing Regulation, notably where those Union acts lay down common requirements for data quality and interoperability. |
|
(10) |
Regarding all thematic categories, especially the category ‘companies and company ownership’, Member States are encouraged to go beyond the minimum requirements with respect to the scope of datasets and arrangements for re-use set out in this Regulation. |
|
(11) |
Member States should be able to complement the datasets listed in the Annex to this Regulation with public sector information already accessible, whenever such data are thematically related and considered of high value based on the criteria described under Article 14(2) of Directive (EU) 2019/1024. When this includes information that constitutes personal data, adding such information to the datasets must be necessary, proportionate and genuinely meet objectives of general interest. |
|

It is the objective of Directive (EU) 2019/1024 to promote the use of standard public licences available online for re-using public sector information. The Commission’s Guidelines on recommended standard licences, datasets and charging for the re-use of documents (5) identify Creative Commons (‘CC’) licences as an example of recommended standard public licences. CC licences are developed by a non-profit organisation and have become a leading licensing solution for public sector information, research results and cultural domain material across the world. It is therefore necessary to refer in this Implementing Regulation to the most recent version of the CC licence suite, namely CC 4.0. A licence equivalent to the CC licence suite may include additional arrangements, such as the obligation on the re-user to include updates provided by the data holder and to specify when the data were last updated, as long as they do not restrict the possibilities for re-using the data. |

The European Data Protection Supervisor was consulted in accordance with Article 42(1) of Regulation (EU) 2018/1725 of the European Parliament and of the Council (6) and delivered an opinion on 15 July 2022. |
|

The measures set out in this Implementing Regulation are in accordance with the opinion of the Committee on open data and the re-use of public sector information set out in Article 16 of Directive (EU) 2019/1024, |
HAS ADOPTED THIS REGULATION:
Article 1
Subject matter
1. This Implementing Regulation establishes the list of high-value datasets belonging to the thematic categories set out in Annex I to Directive (EU) 2019/1024 and held by public sector bodies among the existing documents to which that Directive applies.
2. This Implementing Regulation also lays down the arrangements for publishing and reusing high-value datasets, in particular the applicable conditions for re-use and the minimum requirements for disseminating data via application programming interfaces (‘APIs’).
Article 2
Definitions
For the purposes of this Implementing Regulation, the following definitions shall apply:

The definitions set out in Article 2 of Directive (EU) 2019/1024 shall apply. |
|
(2) |
The definitions set out for datasets in the geospatial, earth observation and environment and meteorological categories in Directive 2007/2/EC shall apply. |
|
(3) |
The definitions set out for datasets in the mobility category under Directive 2007/2/EC and Directive 2005/44/EC shall apply. |
|
(4) |
‘key attribute’ means a characteristic of an object or an entity in a dataset, such as a national identification code or name; |
|
(5) |
‘granularity’ means the level of detail of the dataset; |
|
(6) |
‘application programming interface (API)’ means a set of functions, procedures, definitions and protocols for machine-to-machine communication and the seamless exchange of data; |
|
(7) |
‘bulk download’ means a function that enables a download of an entire dataset in one or several packages. |
Article 3
Arrangements for publication applicable to all categories of high-value datasets
1. Public sector bodies holding high-value datasets listed in the Annex shall ensure that the datasets described or referenced in the Annex are made available in machine-readable formats via APIs corresponding to the reasonable needs of re-users. Where indicated in the Annex, the datasets shall also be made available as a bulk download.
2. Those public sector bodies referred to in paragraph 1 shall set out and publish the terms of use of the API and the quality of service criteria on its performance, capacity and availability. The terms of use shall be available in a human-readable and machine-readable format. Both the terms of use and the quality of service criteria shall be compatible with the arrangements for the re-use of high-value datasets laid down in accordance with Article 4.
3. API terms of use shall be accompanied by API documentation in a Union or internationally recognised open, human-readable and machine-readable format.
4. Public sector bodies referred to in paragraph 1 shall designate a point of contact for questions and issues related to the API with a view to ensure the availability and maintenance of the API and ultimately the smooth and effective publication of the high-value datasets.
5. Public sector bodies holding high-value datasets listed in the Annex shall ensure that the datasets are denoted as high-value datasets in their metadata description.
Article 4
Arrangements for re-use applicable to all categories of high-value datasets
1. An exemption granted by a Member State in accordance with Article 14(5) of Directive (EU) 2019/1024 shall be published online, in the same way as the list of public sector bodies referred to in Article 6(3) of Directive (EU) 2019/1024.
2. To facilitate the availability of datasets for re-use covering longer periods of time, the obligations imposed under this Regulation shall also apply to existing machine-readable high-value datasets created before the date of application of this Regulation.
3. High-value datasets shall be made available for re-use under the conditions of the Creative Commons Public Domain Dedication (CC0) or, alternatively, the Creative Commons BY 4.0 licence, or any equivalent or less restrictive open licence, as set out in the Annex, allowing for unrestricted re-use. A requirement of attribution, giving the credit to the licensor, can additionally be required by the licensor.
4. High-value datasets shall be made available in accordance with the arrangements for the publication and re-use as set out in the Annex.
Article 5
Reporting
1. By 2 years after entry into force of this Implementing Regulation Member States shall provide the Commission with a report on the measures they have carried out to implement this Implementing Regulation. Where appropriate, the information under paragraph 3 can be provided through references to relevant metadata.
2. Each Member State shall provide an updated version of the report upon the request of the Commission which should be made every 2 years.
3. The report shall contain the following information:

(a) |
a list of specific datasets at Member State level (and, where relevant, subnational level) corresponding to the description of each high-value dataset in the Annex to this Regulation and with online reference to metadata that follow existing standards, such as a single register or open data catalogue; |
|
(b) |
persistent link to the licensing conditions applicable to the re-use of high-value datasets listed in the Annex to this Regulation, per dataset referred to in point a); |
|
(c) |
persistent link to the APIs ensuring access to the high-value datasets listed in the Annex to this Regulation, per dataset referred to in point a); |
|
(d) |
where available, guidance documents issued by the Member State on publishing and reusing their high-value datasets; |
|
(e) |
where available, the existence of data protection impact assessments carried out in accordance with Article 35 of Regulation (EU) 2016/679; |
|
(f) |
the number of public sector bodies exempted in accordance with Article 14(5) of Directive (EU) 2019/1024. |
Article 6
Entry into force and application
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
It shall apply from 16 months after entry into force of this Regulation.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX
1. GEOSPATIAL
1.1. Datasets in scope
The geospatial thematic category includes datasets within the scope of the INSPIRE data themes Administrative units, Geographical names, Addresses, Buildings and Cadastral parcels as defined in Annex I and Annex III to Directive 2007/2/EC of the European Parliament and of the Council (1). In addition, it includes Reference parcels and Agricultural parcels as defined in Regulation (EU) No 1306/2013 of the European Parliament and of the Council (2) and of Regulation (EU) No 1307/2013 of the European Parliament and of the Council (3) and the related delegated and implementing acts (4). Their granularity, geographical coverage and the key attributes are listed in the table below. 2. EARTH OBSERVATION AND ENVIRONMENT
2.1. Datasets in scope
The earth observation and environmental category includes earth observation, including space-based or remotely-sensed data, as well as ground-based or in situ data, environmental and climate datasets within the scope of the INSPIRE data themes listed in the first table below and defined in Annexes I-III to Directive 2007/2/EC, and datasets produced or generated in the context of the legal acts listed in the second table below. The most up-to-date datasets as well as historical versions of datasets available in machine-readable format at all levels of generalisation available up to the scale of 1:5 000 covering the entire Member State when combined are included. If datasets are not available at this scale, but are available at higher spatial resolution(s) (13), they shall be provided at the available spatial resolution.
Furthermore, consistent with and without affecting the relevant access regimes as defined in Directive 2003/4/EC, the earth observation and environmental thematic category includes all “Environmental information”, as defined in Article 2 of Directive 2003/4/EC of the European Parliament and of the Council (14), and the environmental information listed in Directive 2003/4/EC, Article 7 “Dissemination of environmental information”.

4. STATISTICS
4.1. Datasets in scope
The statistics thematic category includes statistical datasets except microdata related to reporting obligations as defined in the legal acts listed in the table below.
In order to identify in a complete manner the relevant legal references in the legal acts, for some of the datasets it is necessary to refer to concepts from a number of provisions and Annexes, as presented below in Tables 1-18. For those datasets, the definitions from the legal acts referred to in the table below apply. The legal acts are also applicable where it is indicated so in the footnotes to Tables 1-18.
Time series shall begin no later than at the date of application of the respective legal act listed in the table below.

6. MOBILITY
6.1. Datasets in scope
The mobility thematic category includes datasets within the scope of the INSPIRE data theme ‘Transport networks’ as set out in Annex I to Directive 2007/2/EC, at all levels of generalisation available up to the scale of 1:5 000 covering the entire Member State when combined. If datasets are not available at the scale of 1:5 000, but are available at higher spatial resolution(s) (87), they shall be provided at the available spatial resolution. The datasets include as key attributes national identification code, geographical position as well as links with cross-border networks, where available.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 230(1) and 232(1) and (3) thereof.
Whereas:

Regulation (EU) 2016/429 provides that consignments of animals, germinal products and products of animal origin must come from a third country or territory, or zone or compartment thereof, listed in accordance with Article 230(1) of that Regulation in order to enter the Union. |
|
(2) |
Commission Delegated Regulation (EU) 2020/692 (2) lays down the animal health requirements that consignments of certain species and categories of animals, germinal products and products of animal origin, from third countries or territories, or zones thereof, or compartments thereof in the case of aquaculture animals, must comply with in order to enter the Union. |
|
(3) |
Commission Implementing Regulation (EU) 2021/404 (3) establishes the lists of third countries, or territories, or zones or compartments thereof, from which the entry into the Union of the species and categories of animals, germinal products and products of animal origin falling within the scope of Delegated Regulation (EU) 2020/692 is permitted. |
|

More particularly, Annexes V and XIV to Implementing Regulation (EU) 2021/404 set out the lists of third countries, or territories, or zones thereof authorised for the entry into the Union, respectively, of consignments of poultry, germinal products of poultry, and of fresh meat from poultry and game birds. |

Canada has notified the Commission of nine outbreaks of highly pathogenic avian influenza in poultry in the provinces of British Columbia (7), Quebec (1) and Ontario (1), Canada, which were confirmed between 29 November 2022 and 29 December 2022 by laboratory analysis (RT-PCR). |

Moreover, the United Kingdom has notified the Commission of 11 outbreaks of highly pathogenic avian influenza in poultry in the counties of Cumbria (1), Norfolk (3), North Yorkshire (1), Suffolk (1) and Yorkshire (1) in England, United Kingdom and in the council areas of Angus (1), Fife (1), Moray (1) and Perth and Kinross (1) in Scotland, United Kingdom, which were confirmed between 14 December 2022 and 10 January 2023 by laboratory analysis (RT-PCR). |

Additionally, the United States has notified the Commission of 17 outbreaks of highly pathogenic avian influenza in poultry in the states of California (1), Colorado (2), Indiana (1), Minnesota (2), Missouri (1), Nebraska (1), South Dakota (3), Tennessee (4) and Washington (2), United States, which were confirmed between 8 December 2022 and 22 December 2022 by laboratory analysis (RT-PCR). |

Following those recent outbreaks of highly pathogenic avian influenza, the veterinary authorities of Canada, the United Kingdom and the United States established control zones of at least 10 km around the affected establishments and implemented a stamping-out policy in order to control the presence of highly pathogenic avian influenza and limit the spread of that disease. |
|
(9) |
Canada, the United Kingdom and the United States have submitted information to the Commission on the epidemiological situation on their territory and the measures they have taken to prevent the further spread of highly pathogenic avian influenza. That information has been evaluated by the Commission. On the basis of that evaluation and in order to protect the animal health status of the Union, the entry into the Union of consignments of poultry, germinal products of poultry, and fresh meat of poultry and game birds from the areas under restrictions established by the veterinary authorities of Canada, the United Kingdom and the United States due to the recent outbreaks of highly pathogenic avian influenza should no longer be authorised. |

Furthermore, Canada has submitted updated information on the epidemiological situation on its territory in relation to 13 outbreaks of highly pathogenic avian influenza in poultry establishments in the provinces of Alberta (4), British Columbia (1), Manitoba (1), Ontario (6) and Saskatchewan (1), Canada, which were confirmed between 10 April 2022 and 6 October 2022. |

In addition, the United Kingdom has submitted updated information on the epidemiological situation on its territory in relation to five outbreaks of highly pathogenic avian influenza in poultry establishments in the counties of Devon (4) and Pembrokeshire (1) in England, United Kingdom, which were confirmed between 6 August 2022 and 9 September 2022. |

Canada and the United Kingdom have also submitted information on the measures they have taken to prevent the further spread of highly pathogenic avian influenza. In particular, following those outbreaks of that disease, Canada and the United Kingdom have implemented a stamping out policy in order to control and limit the spread of that disease, and they have also completed the requisite cleaning and disinfection following the implementation of the stamping out policy on the infected poultry establishments on their territories. |

The Commission has evaluated the information submitted by Canada and the United Kingdom and concluded that the outbreaks of highly pathogenic avian influenza in poultry establishments have been cleared and that there is no longer a risk associated with the entry into the Union of poultry commodities from the zones of Canada and the United Kingdom from which the entry into the Union of poultry commodities was suspended following those outbreaks. |

Annexes V and XIV to Implementing Regulation (EU) 2021/404 should be therefore amended to take account of the current epidemiological situation as regards highly pathogenic avian influenza in Canada, the United Kingdom and in the United States. |
|
(15) |
Taking into account the current epidemiological situation in Canada, the United Kingdom and the United States as regards highly pathogenic avian influenza and the serious risk of its introduction into the Union, the amendments to be made to Annexes V and XIV to Implementing Regulation (EU) 2021/404 by this Regulation should take effect as a matter of urgency. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annexes V and XIV to Implementing Regulation (EU) 2021/404 are amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
|
(2) |
Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex. |
|
(3) |
The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Commission Implementing Regulation (EU) 2022/2568 (3) following changes in the epidemiological situation as regards that disease in Slovakia. Since the date of adoption of that Implementing Regulation, the epidemiological situation as regards that disease in certain Member States concerned has evolved. |
|
(4) |
Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health (WOAH) and justifications for zoning provided by the competent authorities of the Member States concerned. |

Since the date of adoption of Implementing Regulation (EU) 2022/2568 there have been several outbreaks of African swine fever in wild porcine animals in Poland. Also, the epidemiological situation in certain zones listed as restricted zones III in Poland and Slovakia has improved as regard kept and wild porcine animals, due to the disease control measures being applied by those Member States in accordance with Union legislation. |
|

In December 2022, one outbreak of African swine fever in a wild porcine animal was observed in the Śląskie region in Poland, in an area currently not listed in Annex I to Implementing Regulation (EU) 2021/605. This new outbreak of African swine fever in a wild porcine animal constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently not listed as a restricted zone in that Annex, affected by this recent outbreak of African swine fever, should now be listed as a restricted zone II in that Annex and the current boundaries of restricted zone I also need to be redefined to take account of this recent outbreak. |

Accordingly, this area of Poland currently listed as a restricted zone I in that Annex, affected by this recent outbreak of African swine fever, should now be listed as a restricted zone II in that Annex and the current boundaries of restricted zone I also need to be redefined to take account of this recent outbreak. |

In addition, in January 2023 one outbreak of African swine fever in a wild porcine animal was observed in the Warmińsko – Mazurskie region in Poland, in an area currently listed as a restricted zone I, in Annex I to Implementing Regulation (EU) 2021/605. This new outbreak of African swine fever in a wild porcine animal constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently listed as a restricted zone I in that Annex, affected by this recent outbreak of African swine fever, should now be listed as a restricted zone II in that Annex and the current boundaries of restricted zone I also need to be redefined to take account of this recent outbreak. |

Following those recent outbreaks of African swine fever in wild porcine animals in Poland and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in this Member State has been reassessed and updated in accordance with Articles 5, 6 and 7 of Implementing Regulation (EU) 2021/605. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605. |

Also, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in the restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687 (6), and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Warmińsko – Mazurskie region in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in these restricted zones III for the past three months, while the disease is still present in wild porcine animals. The restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation. |

Further, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in the restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Świętokrzyskie region in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones I in that Annex, due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zones III for the past 12 months. The restricted zones III should now be listed as restricted zones I taking account of the current African swine fever epidemiological situation. |

Also, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in the restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Slovakia in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the WOAH Code, certain zones in the Zvolen region in Slovakia, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past three months, while the disease is still present in wild porcine animals. The restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner new restricted zones of a sufficient size should be demarcated for Poland and Slovakia and listed as restricted zones I and II. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the epidemiological situation in the surrounding areas. |
|

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Implementing Regulation (EU) 2021/605 is replaced by the text set out in the Annex to this Regulation.

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(4), first subparagraph, in conjunction with Article 218(9) thereof,
Having regard to the proposal from the European Commission,
Whereas:

The Agreement between the European Union and Japan for an Economic Partnership (‘the Agreement’) was concluded by the Union by Council Decision (EU) 2018/1907 (1) and entered into force on 1 February 2019. |
|
(2) |
Pursuant to Article 16.18(4), point (d), of the Agreement, the Committee on Trade and Sustainable Development (the ‘Committee’) is to establish a list of at least 10 individuals who are willing and able to serve as experts on the panel to be convened to examine matters concerning the interpretation or application of the relevant Articles of Chapter 16. |

(3) |
Pursuant to Article 16.18(2) of the Agreement, the Committee is to adopt the rules of procedure for the panel of experts. |
|
(4) |
It is appropriate to establish the position to be taken on the Union’s behalf in the Committee, as the envisaged decision will be binding on the Union. |

(5) |
Pursuant to Article 22.3(3) of the Agreement, the Committee may take decisions in writing, |
HAS ADOPTED THIS DECISION:
Article 1
The position to be taken on the Union’s behalf within the Committee on Trade and Sustainable Development established under the Agreement between the European Union and Japan for an Economic Partnership as regards the establishment of the list of individuals who are willing and able to serve as experts and the adoption of the rules of procedure for the panel of experts, as referred to in Article 16.18 of that Agreement, shall be based on the draft decision of the Committee attached to this Decision.
Article 2
This Decision shall enter into force on the date of its adoption.

ANNEX 2
RULES OF PROCEDURE OF THE PANEL OF EXPERTS
In procedures of panel of experts under Chapter 16 (Trade and Sustainable Development) of the Agreement between the European Union and Japan for an Economic Partnership, the following rules apply:
I. Definitions
|
1. |
In these Rules of Procedure:
|
II. Appointment of experts
|
2. |
The co-chair of the requesting Party of the Committee shall be responsible for the organisation of the lot referred to in subparagraph 4(c) of Article 16.18 of the Agreement, and shall inform the co-chair from the responding Party, with due anticipation, about the date, time and venue of the lot. The co-chair from the responding Party may be present or be represented by another person when the lots are drawn. Representatives of both Parties may also be present. In any event, the lot shall be carried out with the Party or Parties that are present. |
|
3. |
The Parties shall inform in writing each individual who has been appointed to serve as an expert pursuant to Article 16.18 of the Agreement of his or her appointment. Each individual shall confirm his or her availability to both Parties within five days of the date on which he or she was informed of his or her appointment. |
III. Code of Conduct
|
4. |
The Code of Conduct shall apply, mutatis mutandis, to the experts serving in the Panel of Experts. |
IV. Organisational meeting
|
5. |
Unless the Parties agree otherwise, the Parties shall meet with the panel within seven days of the date of the establishment of the panel in order to determine those matters that the Parties or the panel deem appropriate, including:
Only the experts and the representatives of the Parties who are officials or other persons of a government department or agency or any other public entity may take part in this meeting in person or via telephone or video conference. |
V. Notifications

6. |
Any request, notice, written submission or other document transmitted by:
|
|
7. |
Any notification referred to under paragraph 6 shall be made by email or, where appropriate, any other means of telecommunication that provides a record of the sending thereof. Unless proven otherwise, such notification shall be deemed to be received on the date of its sending. |
|
8. |
Minor errors of a clerical nature in a request, notice, written submission or other document related to the panel proceedings may be corrected by delivery of a new document clearly indicating the changes. |
|
9. |
If the last day for delivery of a document falls on a legal holiday of Japan or of the European Union or on any other day on which the offices of the Government of a Party are officially or by force majeure closed, the document shall be deemed received on the next working day. At the organisational meeting referred to in paragraph 5, each Party shall submit a list of its legal holidays and any other days on which its offices are officially closed. Each Party shall keep its list updated during the panel procedure. |
VI. Written submissions
|
10. |
The requesting Party shall deliver its written submission no later than 20 days after the date of establishment of the panel. The responding Party shall deliver its written counter-submission no later than 20 days after the date of receipt of the written submission of the requesting Party. |
VII. Requests for information and advice
|
11. |
In accordance with paragraph 3 of Article 16.18 of the Agreement, the panel should seek information and advice from the relevant international organisations or bodies for matters related to International Labour Organization instruments or multilateral environmental agreements, as it deems appropriate. |
|
12. |
Before seeking information and advice from the entities referred to in paragraph 11, the panel shall allow the Parties the opportunity to comment on the list of entities and the requests to be addressed to them. |
|
13. |
The panel shall submit any information obtained pursuant to paragraph 11 to the Parties, which shall have an opportunity to comment on such information. |
VIII. Operation of the panel
|
14. |
The chairperson of the panel shall preside at all of its meetings. A panel may delegate to the chairperson the authority to make administrative and procedural decisions. |
|
15. |
Unless otherwise provided for in Article 16.18 of the Agreement or in these Rules of Procedure, the panel may conduct its activities by any means, including telephone, facsimile transmissions or computer links. |
|
16. |
Where a procedural question arises that is not covered by Article 16.18 of the Agreement or these Rules of Procedure or the Code of Conduct, the panel, after consulting the Parties, may adopt an appropriate procedure that is compatible with those provisions. |
|
17. |
The panel may modify any time period other than the time periods set out in Article 16.18 of the Agreement and make any other procedural or administrative adjustment in the proceedings after consulting with the Parties. When the panel consults with the Parties, it shall inform the Parties in writing of the proposed modification or adjustment and the reason therefor. |
IX. Hearings
|
18. |
Based upon the timetable determined pursuant to paragraph 5, after consulting with the Parties and the other experts, the chairperson of the panel shall determine the date and time of the hearing. |
|
19. |
Unless the Parties agree otherwise, the venue shall alternate between the Parties with the first hearing to be held in the responding Party. Unless the Parties agree otherwise, the Party in which the hearing takes place shall:
|
|
20. |
Unless the Parties agree otherwise, and without prejudice to paragraph 49, the Parties shall share the expenses derived from the logistical administration of the hearing. |
|
21. |
The chairperson of the panel shall notify in due course the Parties, in writing, of the date, time and venue of the hearing. This information shall be made publicly available by the Party in which the hearing takes place, unless the hearing is closed to the public. |
|
22. |
As a general rule there should be only one hearing. If the dispute involves issues of exceptional complexity, the panel may convene additional hearings on its own initiative or, upon request of either Party, after consulting the Parties. For each of the additional hearings, paragraphs 18 to 21 apply mutatis mutandis. |
|
23. |
Any hearing of the panel shall be open to the public unless the Parties agree otherwise or the submissions and arguments of a Party contain confidential information. There should be no audio or visual recording of the hearing by the public. Hearings held in closed session shall be confidential in accordance with paragraph 39. |
|
24. |
All experts shall be present during the entirety of the hearing. |
|
25. |
Unless the Parties agree otherwise, the following persons may attend the hearing, irrespective of whether the hearing is open to the public:
|
|
26. |
No later than five days before the date of a hearing, each Party shall deliver to the panel a list of the names of persons who will make oral arguments or presentations at the hearing on behalf of that Party and of other representatives and advisers who will be attending the hearing. |
|
27. |
The panel shall conduct the hearing in the following manner, ensuring that the requesting Party and the responding Party are afforded equal time in both argument and rebuttal argument:

The panel may direct questions to either Party at any time during the hearing. |
|
29. |
The panel shall arrange for a transcript of the hearing to be prepared and delivered to the Parties as soon as possible after the hearing. The Parties may comment on the transcript and the panel may consider those comments. |

Each Party may deliver a supplementary written submission concerning any matter that arose during the hearing within 10 days of the date of the hearing. |
X. Deliberations
|
31. |
Only the experts may take part in the deliberations of the panel. |
XI. Questions in writing
|
32. |
The panel may at any time during the proceedings submit questions in writing to one or both Parties. Any questions submitted to one Party shall be copied to the other Party. |
|
33. |
Each Party shall provide the other Party with a copy of its response to the questions submitted by the panel. A Party shall be given an opportunity to provide comments in writing on the other Party’s response within five days of the receipt of such copy. |
XII. Replacement of experts
|
34. |
If any of the experts of the original panel withdraws, is unable to participate, or otherwise needs to be replaced in panel proceedings pursuant to Article 16.18 of the Agreement, paragraph 4 of Article 16.18 of the Agreement applies mutatis mutandis. |
|
35. |
Where a Party considers that an expert does not comply with the requirements of the Code of Conduct and for this reason should be replaced, that Party shall notify the other Party within 15 days from the time at which it obtained sufficient evidence of the expert’s failure to comply with the requirements of the Code of Conduct. |
|
36. |
Where a Party considers that an expert other than the chairperson does not comply with the requirements of the Code of Conduct, the Parties shall consult and, if they so agree, select a new expert in accordance with paragraph 34.
If the Parties fail to agree on the need to replace the expert, either Party may request that this matter be referred to the chairperson of the panel, whose decision shall be final. If, pursuant to this request, the chairperson finds that the expert does not comply with the requirements of the Code of Conduct, a new expert shall be selected in accordance with paragraph 34. |

37. |
Where a Party considers that the chairperson of the panel does not comply with the requirements of the Code of Conduct, the Parties shall consult and, if they so agree, select a new chairperson in accordance with paragraph 34.
If the Parties fail to agree on the need to replace the chairperson, either Party may request that the matter be referred to the two remaining experts. The experts shall decide, no later than 10 days after the date of delivery of the request, whether there is a need to replace the chairperson of the panel. The decision by the experts on the need to replace the chairperson shall be final. If the experts decide that the chairperson does not comply with the requirements of the Code of Conduct, a new chairperson shall be selected in accordance with paragraph 34. |

38. |
The proceedings shall be suspended for the period taken to carry out the procedures provided for in paragraphs 34 to 37. |
XIII. Confidentiality
|
39. |
The panel and the Parties shall treat as confidential any information submitted by a Party to the panel which that Party has designated as confidential. Where a Party submits a confidential version of its written submissions to the panel, it shall also, upon request of the other Party, provide within 20 days of the date of the request, a non-confidential version of the submissions that could be disclosed to the public. Nothing in these Rules of Procedure precludes a Party from disclosing its own submissions to the public to the extent that it does not disclose any information designated by the other Party as confidential. The panel shall meet in closed session if the submissions and arguments of a Party contain confidential information. The panel and the Parties shall maintain the confidentiality of the hearing of the panel where the hearing is held in closed session. |
XIV. Ex parte contacts
|
40. |
The panel shall not meet or communicate with a Party in the absence of the other Party. |
|
41. |
An expert shall not discuss any aspect of the subject matter of the proceedings with one Party or both Parties in the absence of the other experts. |
XV. Amicus curiae submissions
|
42. |
Unless the Parties agree otherwise within three days of the date of the establishment of the panel, the panel may receive unsolicited written submissions from any natural persons of a Party or legal persons established in a Party, who are independent from the Governments of the Parties, provided that the submissions are received within 10 days of the date of the establishment of the panel. |
|
43. |
The submissions shall be concise and in no case longer than 15 pages at double space, and shall be directly relevant to a factual or a legal issue under consideration by the panel. The submissions shall contain a description of the person providing the submissions including:
Any person shall specify in its submissions the interest that it has in the proceedings. The submissions shall be drafted in the languages chosen by the Parties in accordance with paragraphs 45 and 46 of these Rules of Procedure. |

44. |
The panel shall list in its report all the submissions it has received pursuant to paragraphs 42 and 43. The panel is not obliged to address in its report the arguments made in such submissions. Those submissions shall be provided to the Parties for their comments. The comments of the Parties which have been submitted to the panel within 30 days shall be taken into consideration by the panel. |
XVI. Language and translation
|
45. |
During the consultations referred to in Article 16.17 of the Agreement, and no later than the time of the organisational meeting referred to in paragraph 5, the Parties shall endeavour to agree on a common working language for the proceedings before the panel. Each Party shall notify the other Party, no later than 90 days after the adoption of these Rules of Procedure by the Committee in accordance with paragraph 2 of Article 16.18 of the Agreement, a list of languages for which it has a preference. The list shall include at least one working language of the WTO. |
|
46. |
If the Parties are unable to agree on a common working language, each Party shall make its written submissions in its chosen language, providing at the same time a translation into one of the working languages of the WTO notified by the other Party in accordance with paragraph 45, where appropriate. The Party responsible for organising the oral hearing shall arrange for the interpretation of oral submissions into the same working language of the WTO, where appropriate. |
|
47. |
The interim and final report of the panel shall be issued in the common working language. If the Parties have not agreed on a common working language, the interim and final report of the panel shall be issued in the working languages of the WTO referred to in paragraph 46. |
|
48. |
A Party may provide comments on the accuracy of the translation of any translated version of a document drawn up in accordance with these Rules of Procedure. |
|
49. |
In case a translation or interpretation of written and oral submissions of a Party in the relevant working language of the WTO is necessary, that Party shall bear the costs thereof. |
XVII Panel Report
|
50. |
The panel shall present an interim and a final report to the Parties in accordance with paragraph 5 of Article 16.18 of the Agreement. The final report shall be made publicly available. The panel should not disclose its report before publication by the Parties. |
XVIII Revision
|
51. |
These Rules of Procedure may be revised by agreement between the Parties. |

THE COMMITTEE,
Having regard to the Agreement of 21 June 1999 between the European Community and the Swiss Confederation on the Carriage of Goods and Passengers by Rail and Road (1) (‘the Agreement’), and in particular Article 52(4) thereof,
Whereas:

Under Article 51(2) of the Agreement, the Community/Switzerland Inland Transport Committee (‘the Joint Committee’) is responsible for the monitoring and application of the provisions of the Agreement and implements the adaptation and revision clauses referred to in Articles 52 and 55 thereof. |
|
(2) |
Under Article 52(4) of the Agreement, the Joint Committee adopts, inter alia, decisions revising Annex 1 so as to incorporate therein, as and where necessary and on a basis of reciprocity, amendments to the relevant legislation or decides on any other measure aimed at safeguarding the proper functioning of the Agreement. |
|

By Decision No 2/2019 of 13 December 2019 (2), the Joint Committee, on the one hand, revised Annex 1 to the Agreement so as to incorporate substantive provisions of Directive (EU) 2016/797 of the European Parliament and of the Council (3) and Directive (EU) 2016/798 of the European Parliament and of the Council (4) and, on the other, adopted transitory provisions to maintain smooth rail traffic between Switzerland and the European Union. The transitory provisions set out in Articles 2, 3, 4 and 5 of Decision No 2/2019 were initially applicable until 31 December 2020. By Decision No 2/2020 of 11 December 2020 (5), the Joint Committee extended their applicability until 31 December 2021. By Decision No 2/2021, their applicability was extended until 31 December 2022 (6). |

By Decision No 1/2021 of 17 December 2021, the date by which certain Swiss national rules listed in Annex 1 to the Agreement that may be incompatible with the technical specifications for interoperability should have been reviewed to decide whether to remove, amend or keep them was extended until 31 December 2022. In view of the stage reached in the review, that date should be changed to 31 December 2023 for those national rules that have not yet been reviewed. |

Pending the adoption of the final provisions replacing the current transitional arrangements, the provisions laid down in Articles 2, 3, 4 and 5 of Decision No 2/2019 should be extended until 31 December 2023 in order to maintain smooth rail traffic between Switzerland and the European Union. |

Directive 2008/68/EC of the European Parliament and of the Council of 24 September 2008 (7) extends to national transport the uniform rules contained in the European Agreement of 30 September 1957 concerning the International Carriage of Dangerous Goods by Road (ADR), the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID) and the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN). Article 6(2) and (3) of Directive 2008/68/EC allows Member States to request derogations from the annexes to the ADR and the RID for the carriage of small quantities of dangerous goods within their territory or for local transport. Switzerland has drawn up a list of such derogations. They are set out in Annex 1 to the Agreement. Those derogations were extended at the end of 2016 and will expire on 1 January 2023. On 29 September 2022 Switzerland requested that they be extended again. Article 6(4) of Directive 2008/68/EC allows the derogations to be extended for a maximum period of 6 years. It is therefore appropriate to extend the derogations until 1 January 2029. It is also necessary to correct the national references of the derogations, which have been amended since the last extension, in Annex 1 to the Agreement, |

Decision No 2/2019 of the Joint Committee of 13 December 2019 is amended as follows:

Article 6(3) is replaced by the following: ‘3. Annex 1 identifies the applicable national rules and specific cases that are potentially incompatible with Union law. If compatibility with Union law has not been established by 31 December 2023, those national rules and specific cases may no longer be applied unless the Joint Committee decides otherwise. ’ |

In Article 8, the second paragraph is replaced by the following: ‘Articles 2, 3, 4 and 5 shall apply until 31 December 2023. ’ |

Domestic waste which cannot be classified by the expert may be transported to a treatment centre in small quantities identified by package and by transport unit.

Comments: These rules may only be applied to the transport of domestic waste containing dangerous goods between public treatment sites and waste disposal installations.
