COUNCIL IMPLEMENTING REGULATION (EU) 2022/2228
of 14 November 2022
implementing Regulation (EU) 2018/1542 concerning restrictive measures against the proliferation and use of chemical weapons
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) 2018/1542 of 15 October 2018 concerning restrictive measures against the proliferation and use of chemical weapons (1), and in particular Article 12 thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:

On 15 October 2018, the Council adopted Regulation (EU) 2018/1542. |
|
(2) |
On 20 August 2020, Alexei Navalny, a prominent opposition leader in Russia, was poisoned with a toxic military-grade nerve agent of the Novichok group, as confirmed by specialised laboratories in Germany, France and Sweden, as well as by the Organisation for the Prohibition of Chemical Weapons (OPCW). This poisoning constitutes a use of chemical weapons under the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction (the ‘Chemical Weapons Convention’) and a serious breach of international law. The Union reiterates its strong concerns that the Russian Federation has not reacted to international calls for a thorough and transparent investigation into the assassination attempt against Alexei Navalny. |

The Union has strongly condemned the use of chemical weapons by Syria and its failure to respect its international obligations under the Chemical Weapons Convention, as substantiated through comprehensive and thorough investigations carried out by the United Nations and the OPCW. The Union has raised these concerns in various fora and urges Syria to return to full compliance with the Chemical Weapons Convention. |

In that context, and in view of the continued threat posed by the proliferation and use of chemical weapons, ten persons and one entity should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures set out in Annex I to Regulation (EU) 2018/1542. |

Annex I to Regulation (EU) 2018/1542 should therefore be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Regulation (EU) 2018/1542 is amended as set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Therefore, Artur Zhirov was engaged in preparations for the use of chemical weapons and he provided technical and material support for using chemical weapons. |

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) No 269/2014 of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (1), and in particular Article 14(1) thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:

On 17 March 2014, the Council adopted Regulation (EU) No 269/2014. |

(2) |
The Union remains unwavering in its support for Ukraine’s sovereignty and territorial integrity. |

The Iranian regime provides military support for Russia’s unprovoked and unjustified war of aggression against Ukraine. On 20 October 2022, the Council adopted Implementing Regulation (EU) 2022/1985 (2). |
|
(4) |
In view of the gravity of the situation, the Council considers that two individuals and two entities involved in the development and delivery of Unmanned Aerial Vehicles to Russia should be added to the list of natural and legal persons, entities and bodies subject to restrictive measures set out in Annex I to Regulation (EU) No 269/2014. |

Annex I to Regulation (EU) No 269/2014 should therefore be amended accordingly, |

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) No 359/2011 of 12 April 2011 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Iran (1), and in particular Article 12(1) thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:

On 12 April 2011, the Council adopted Regulation (EU) No 359/2011. |
|
(2) |
On 25 September 2022, the High Representative of the Union for Foreign Affairs and Security Policy issued a declaration on behalf of the Union deploring the widespread and disproportionate use of force by the Iranian security forces against nonviolent protestors, which led to high numbers of deaths and injuries. The declaration also stated that those responsible for the killing of Mahsa Amini must be held accountable and called on the Iranian authorities to ensure transparent and credible investigations to clarify the number of deaths and persons arrested, to release all non-violent protestors and to provide due process to all detainees. Furthermore, the declaration stressed that Iran’s decision to severely restrict internet access and block instant messaging platforms blatantly violates freedom of expression. Finally, the declaration stated that the Union will consider all the options at its disposal to address the killing of Mahsa Amini and the way Iranian security forces have responded to the ensuing demonstrations. |

On 17 October 2022, the Council adopted Implementing Regulation (EU) 2022/1955 (2), including eleven persons and four entities in the list of natural and legal persons, entities and bodies subject to restrictive measures in Annex I to Regulation (EU) No 359/2011 for their involvement in serious human rights violations in Iran. |

In that context, and in line with the Union’s commitment to address all issues of concern with Iran, including the human rights situation, one person should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures in Annex I to Regulation (EU) No 359/2011. |

Ahmad Vahidi has been the Iranian Minister of Interior since 25 August 2021. As such, he is responsible for Iran’s Law Enforcement Forces (LEF). Since he took office, an unprecedented number of military and security officials have been appointed to provincial governorships who play key roles in coordinating crowd-control activities by police special forces, the Basij militia and the Islamic Revolutionary Guard Corps (IRGC). Blatant and severe human rights violations by the LEF, such as the indiscriminate shooting with live ammunition at peaceful protesters, including children, have been widely documented since protests surrounding the death of Mahsa Amini started in mid-September 2022. Over 70 protesters died and hundreds were seriously injured, including children. Since the beginning of the demonstrations, police forces have also arbitrarily detained numerous human rights defenders and journalists. Vahidi has also publicly advocated for a harsh approach towards persons participating in the demonstrations. He is therefore responsible for serious human rights violations in Iran. |

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 29 thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:

On 15 October 2018, the Council adopted Decision (CFSP) 2018/1544 (1) concerning restrictive measures against the proliferation and use of chemical weapons. |
|
(2) |
On 20 August 2020, Alexei Navalny, a prominent opposition leader in Russia, was poisoned with a toxic military-grade nerve agent of the Novichok group, as confirmed by specialised laboratories in Germany, France and Sweden, as well as by the Organisation for the Prohibition of Chemical Weapons (OPCW). This poisoning constitutes a use of chemical weapons under the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction (the ‘Chemical Weapons Convention’) and a serious breach of international law. The Union reiterates its strong concerns that the Russian Federation has not reacted to international calls for a thorough and transparent investigation into the assassination attempt against Alexei Navalny. |

The Union has strongly condemned the use of chemical weapons by Syria and its failure to respect its international obligations under the Chemical Weapons Convention, as substantiated through comprehensive and thorough investigations carried out by the United Nations and the OPCW. The Union has raised these concerns in various fora and urges Syria to return to full compliance with the Chemical Weapons Convention. |

In that context, and in view of the continued threat posed by the proliferation and use of chemical weapons, ten persons and one entity should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures set out in the Annex to Decision (CFSP) 2018/1544. |

The Annex to Decision (CFSP) 2018/1544 should therefore be amended accordingly, |

The Annex to Decision (CFSP) 2018/1544 is amended as set out in the Annex to this Decision.
Article 2
This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

On 17 March 2014, the Council adopted Decision 2014/145/CFSP (1). |

The Union remains unwavering in its support for Ukraine’s sovereignty and territorial integrity. |

The Iranian regime provides military support for Russia’s unprovoked and unjustified war of aggression against Ukraine. On 20 October 2022, the Council adopted Decision (CFSP) 2022/1986 (2). |
|
(4) |
In view of the gravity of the situation, the Council considers that two individuals and two entities involved in the development and delivery of Unmanned Aerial Vehicles to Russia should be added to the list of persons, entities and bodies subject to restrictive measures set out in the Annex to Decision 2014/145/CFSP. |

Further action by the Union is needed in order to implement certain measures. |

Whereas:

On 12 April 2011, the Council adopted Decision 2011/235/CFSP. |

On 25 September 2022, the High Representative of the Union for Foreign Affairs and Security Policy issued a declaration on behalf of the Union deploring the widespread and disproportionate use of force by the Iranian security forces against nonviolent protestors, which led to high numbers of deaths and injuries. The declaration also stated that those responsible for the killing of Mahsa Amini must be held accountable and called on the Iranian authorities to ensure transparent and credible investigations to clarify the number of deaths and persons arrested, to release all non-violent protestors and to provide due process to all detainees. Furthermore, the declaration stressed that Iran’s decision to severely restrict internet access and block instant messaging platforms blatantly violates freedom of expression. Finally, the declaration stated that the Union will consider all the options at its disposal to address the killing of Mahsa Amini and the way Iranian security forces have responded to the ensuing demonstrations. |

On 17 October 2022, the Council adopted Implementing Decision (CFSP) 2022/1956 (2), including eleven persons and four entities in the list of persons and entities subject to restrictive measures in the Annex to Decision 2011/235/CFSP for their involvement in serious human rights violations in Iran. |

In that context, and in line with the Union’s commitment to address all issues of concern with Iran, including the human rights situation, one person should be included in the list of persons and entities subject to restrictive measures in the Annex to Decision 2011/235/CFSP. |

Vahidi has also publicly advocated for a harsh approach towards persons participating in the demonstrations. He is therefore responsible for serious human rights violations in Iran. |
