amending Regulation (EU) No 224/2014 concerning restrictive measures in view of the situation in the Central African Republic
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215 thereof,
Having regard to Council Decision 2013/798/CFSP of 23 December 2013 concerning restrictive measures against the Central African Republic (1),
Having regard to the joint proposal from the High Representative of the Union for Foreign Affairs and Security Policy and the European Commission,
Whereas:

On 10 March 2014, the Council adopted Regulation (EU) No 224/2014 (2) in order to give effect to certain measures provided for in Decision 2013/798/CFSP. |
(2) |
On 29 July 2022, the United Nations Security Council (UNSC) adopted Resolution 2648 (2022). That Resolution extends the measures and amends the exceptions to the arms embargo. |
(3) |
On 20 September 2022, the Council adopted Decision (CFSP) 2022/1626 (3), which amends Decision 2013/798/CFSP in accordance with UNSC Resolution 2648 (2022). |
(4) |
Certain of those amendments fall within the scope of the Treaty on the Functioning of the European Union and regulatory action at the level of the Union is therefore necessary in order to implement them together with technical adjustments in light of previous UNSC Resolutions, in particular with a view to ensuring their uniform application by economic operators in all Member States. |

Regulation (EU) No 224/2014 should therefore be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
In Regulation (EU) No 224/2014, Article 3 is replaced by the following:
‘Article 3
By way of derogation from Article 2, the prohibitions laid down in that Article shall not apply to the provision of technical assistance, financing or financial assistance or brokering services:
(a) |
intended solely for the support of or use by the United Nations Multidimensional Integrated Stabilisation Mission in the Central African Republic (MINUSCA), the Union missions and the French forces deployed in the Central African Republic, as well as other United Nations Member States’ forces providing training and assistance as notified in accordance with point (b); |
(b) |
related to supplies of non-lethal equipment and provision of assistance, including operational and non-operational training to the Central African Republic security forces, including State civilian law enforcement institutions, intended solely for support of or use in the Central African Republic process of Security Sector Reform (“SSR”), in coordination with MINUSCA, provided that the provision of assistance and services have been notified in advance to the Sanctions Committee; |
(c) |
related to supplies of non-lethal military equipment intended solely for humanitarian or protective use, provided that the provision of such assistance or services has been notified in advance to the Sanctions Committee; |
(d) |
related to protective clothing, including flak jackets and military helmets, temporarily exported to the Central African Republic by United Nations personnel, personnel of the Union or its Member States, representatives of the media and humanitarian and development workers and associated personnel, for their personal use only; |
(e) |
related to supplies of weapons and ammunition, military vehicles and equipment to the CAR security forces, including state civilian law enforcement institutions, where such weapons, ammunition, vehicles or equipment are intended solely for support of, or use in, the CAR process of SSR, provided that the provision of such assistance or services has been notified in advance to the Sanctions Committee.’. |
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

supplementing Regulation (EU) No 575/2013 of the European Parliament and of the Council with regard to regulatory technical standards on emerging markets and advanced economies

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 575/2013 of 26 June 2013 of the European Parliament and of the Council on prudential requirements for credit institutions and amending Regulation (EU) No 648/2012 (1), and in particular Article 325ap(3), third subparagraph, thereof,
Whereas:

The market risk own funds requirements under the alternative standardised approach set out in Article 325c to Article 325ay of Regulation (EU) No 575/2013 require, for the calculation of the own funds requirement under the sensitivities-based method set out in Article 325d to Article 325k, the application of the risk weights for equity risk specified in Table 8 of Article 325ap of that Regulation pursuant to the delegated act referred to in Article 461a. Since markets constituting advanced economies and emerging markets are mutually exclusive categories, it should be clarified that all markets not constituting advanced economies should be regarded as emerging markets. |

When determining which markets constitute advanced economies and which ones constitute emerging markets, it is necessary, on the one hand, to ensure a level playing field and, on the other hand, to establish a risk-based approach. In that respect, specifying the list of countries that constitute advanced economies is deemed the most appropriate solution in light of the approach followed by the Basel Committee on Banking Supervision (BCBS) and the need to achieve a common implementation of the calculation methodology of the related market risk requirements in all Member States. While BCBS international standards should be taken into consideration, it should be specified that markets of the Member States that are less volatile than the markets recognised as advanced economies in accordance with those international standards constitute advanced rather than emerging market economies. Furthermore, the determination of advanced and emerging market economies should have due regard to the establishment of an internal market in the Union, the presence of the European Economic Area, and the specificities related to overseas countries and territories of some Member States. |

This Regulation is based on the draft regulatory technical standards submitted to the Commission by the European Banking Authority. |

The European Banking Authority has conducted open public consultations on the draft regulatory technical standards on which this Regulation is based, analysed the potential related costs and benefits, and requested the advice of the Banking Stakeholder Group established in accordance with Article 37 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council (2), |
HAS ADOPTED THIS REGULATION:
Article 1
Advanced economies and emerging markets
1. For the purposes of specifying risk weights for the sensitivities to equity and equity repo rate risk factors in accordance with Article 325ap of Regulation (EU) No 575/2013, the following countries shall constitute advanced economies:
(a) |
Member States of the European Union; |
(b) |
the overseas countries and territories which have special relations with Denmark, France or the Netherlands, including Faeroe Islands and those listed in Annex II to the Treaty on the Functioning of the European Union; |
(c) |
the following third countries:

2. For the purposes of specifying risk weights for the sensitivities to equity and equity repo rate risk factors under Article 325ap of Regulation (EU) No 575/2013, countries not listed in paragraph 1 of this Article shall constitute emerging markets.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

derogating from Delegated Regulation (EU) 2017/891 for the year 2022 as regards the value of marketed production, the national strategy and the recovery of Union financial assistance for multiannual commitments in the fruit and vegetables sector due to the crisis caused by Russia’s invasion of Ukraine
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 37, points (a) and (c), and Article 173(1) thereof,
Whereas:

Due to the current crisis caused by Russia’s invasion of Ukraine on 24 February 2022, which commenced shortly after the COVID-19 crisis, farmers in all Member States are facing exceptional difficulties. Measures should be introduced with a view to responding to extensive movement restrictions, disruption of supply chains and logistic problems that are generated by the invasion. Given the long-term disruption of logistics and supply chains, the severe disturbances in the sector are likely to continue and possibly even deteriorate. Logistical problems have made farmers in the EU vulnerable to the economic disruption caused by this crisis, and they are currently facing financial difficulties and cash-flow problems. |

Recognised producer organisations and associations of producer organisations in the fruit and vegetables sector in all Member States have encountered exceptional difficulties in the planning, management and implementation of operational programmes. This may have the consequence of delaying the implementation of these operational programmes and therefore producer organisations and associations of producer organisations may fail to conform to the requirements laid down in Union legislation for those operational programmes, in particular in Commission Delegated Regulation (EU) 2017/891 (2). Producer organisations are also vulnerable to the disruption and disturbance caused by the Russia’s invasion of Ukraine and are experiencing financial difficulties and cash-flow problems caused by a disruption of the supply chains. They are experiencing logistical problems and difficulties in harvesting their produce due to a shortage of workforce and difficulties in reaching consumers due to disruption of the supply chain. This is having a direct impact on the financial stability of producer organisations and on their capacity to implement operational programmes. This is further influencing the ability of producer organisations to introduce measures and actions targeting the effects of this crisis. |

Reductions in the value of marketed production in the fruit and vegetables sector caused by Russia’s invasion of Ukraine will have a major impact on the amount of Union aid received by producer organisations in the subsequent year, as the amount of Union aid is to be calculated as a percentage of the value of marketed production of each producer organisation. If substantial loss in the value of marketed production were to occur in 2022 for reasons linked to Russia’s invasion of Ukraine, producer organisations would risk losing their recognition as producer organisations, as one of the criteria for such recognition is reaching a certain minimum value of marketed production fixed at a national level. This would put the long-term stability of producer organisations at risk. Therefore, it is appropriate to provide that if a reduction of at least 35 % in the value of a product were to occur in the year 2022 for reasons linked to Russia’s invasion of Ukraine and outside the responsibility and control of producer organisations, the value of marketed production for 2022 should be established at 100 % of the value of marketed production for the previous period. In view of the extensive economic impact of Russia’s invasion of Ukraine on the fruit and vegetables sector, the threshold of 65 % of the value of marketed production in the previous period, laid down in Article 23(4) of Delegated Regulation (EU) 2017/891, is insufficient to achieve economic and financial stability for the producer organisations concerned by such loss of value of marketed production. |

Member States should also be exempted for the year 2022 from the obligation laid down in Article 27(5) of Delegated Regulation (EU) 2017/891, to set in their national strategies the maximum percentages of the operational fund which may be spent on individual measures or types of action. This should ensure greater flexibility for producer organisations to take measures to address the effects of Russia’s invasion of Ukraine in the fruit and vegetables sector. |

In order to ensure the financial stability of producer organisations, Union financial assistance received for multiannual commitments in the fruit and vegetables sector, such as environmental actions, should not be recovered and reimbursed to the European Agricultural Guarantee Fund, as provided for in Article 36(3) of Delegated Regulation (EU) 2017/891, if their long-term objectives could not be realised because of their interruption in the year 2022 for reasons linked to Russia’s invasion of Ukraine. |

In view of the necessity to take immediate action, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union. Given that the implementation of operational programmes is based on a calendar year, the derogations relating to the ceiling of Union financial assistance and on the balance of measures set out in the national strategy of Member States provided for in Article 1(1) and (2) of this Regulation should apply retroactively from 1 January 2022, |
HAS ADOPTED THIS REGULATION:
Article 1
Derogations from Delegated Regulation (EU) 2017/891 for the year 2022
1. By way of derogation from Article 23(4) of Delegated Regulation (EU) 2017/891, if in the year 2022, a reduction of at least 35 % in the value of a product occurred for reasons outside the responsibility and control of the producer organisation, the value of marketed production of that product shall be deemed to represent 100 % of its value in the previous reference period. The producer organisation shall prove to the competent authority of the Member State concerned that these conditions are met.
2. By way of derogation from Article 27(5) of Delegated Regulation (EU) 2017/891, the obligation on Member States to set out in the national strategy the maximum percentages of the operational fund which may be spent on any individual measure or type of action in order to ensure a balance between different measures, shall not apply for the year 2022.
3. By way of derogation from Article 36(3) of Delegated Regulation (EU) 2017/891, Union financial assistance for multiannual commitments, such as environmental actions, shall not be recovered and reimbursed to the EAGF where their long-term objectives and expected benefits cannot be realised in the year 2022 because of the interruption of those commitments in the year 2022 for reasons linked to Russia’s invasion of Ukraine.
Article 2
Entry into force and application
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
Article 1(1) and (2) shall apply from 1 January 2022.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2022/1624

amending Implementing Regulation (EU) 2018/607 imposing a definitive anti-dumping duty on imports of steel ropes and cables originating in the People’s Republic of China as extended to imports of steel ropes and cables consigned from Morocco and the Republic of Korea, whether declared as originating in these countries or not, following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1) (‘the basic Regulation’), and in particular Articles 11(3) and 13(4) thereof,
Whereas:
1. PROCEDURE
1.1. Previous investigations and measures in force

By Regulation (EC) No 1796/1999 (2), the Council imposed definitive anti-dumping duties on imports of steel ropes and cables (‘SRC’) originating in the People’s Republic of China (‘PRC’), Hungary, India, Mexico, Poland, South Africa and Ukraine (‘the original measures’). |
(2) |
By Regulation (EC) No 1858/2005 (3), the Council, following an expiry review in accordance with Article 11(2) of the basic Regulation, maintained the original measures imposed on imports of SRC originating in the PRC, India, South Africa and Ukraine. The measures applicable to imports originating in Mexico expired on 18 August 2004 (4). As Hungary and Poland became members of the European Union on 1 May 2004, the measures were terminated on that date. The measures applicable to imports originating in India expired on 17 November 2010 (5). |
(3) |
In May 2010, by Implementing Regulation (EU) No 400/2010 (6) the Council extended the definitive anti-dumping duty imposed by Regulation (EC) No 1858/2005 on imports of SRC, originating in the PRC, to imports of SRC, consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not, as a result of an anti-circumvention investigation in accordance with Article 13 of the basic Regulation (‘the anti-circumvention measure’). Certain Korean exporting producers were granted an exemption from the anti-circumvention measure as they were not found to circumvent the definitive anti-dumping duties. |

In January 2012, by Implementing Regulation (EU) No 102/2012 (7), the Council, following an expiry review in accordance with Article 11(2) of the basic Regulation imposed the anti-dumping duty with regards to imports of SRC originating, inter alia, in the PRC as extended to imports from the Republic of Korea. By the same Regulation, the Council terminated the proceeding with regards to imports of SRC originating in South Africa. |
(5) |
In April 2018, by Implementing Regulation (EU) 2018/607 (8) the Commission following an expiry review in accordance with Article 11(2) of the basic Regulation, imposed an anti-dumping duty with regards to imports of SRC originating in the PRC as extended to, inter alia, the Republic of Korea. |
(6) |
The definitive anti-dumping duties currently in force amount to 60,4 %. |
1.2. Name change request
(7) |
On 6 May 2020, Young Heung Iron & Steel Co., Ltd, one of the Korean exporting producers having an exemption from the anti-circumvention measure as mentioned in recital (3), informed the Commission that it had changed its name to Youngwire (‘Youngwire’ or ‘the company’). |
(8) |
Youngwire requested the Commission to confirm that the change of name does not affect the right of the company to benefit from exemption from the extended anti-dumping duty which was granted to it under its previous name. |
(9) |
The Commission examined the information supplied and concluded that Youngwire has undergone a reorganisation, including through the acquisition of the assets of another Korean exporter also benefitting from the exemption, Dae Heung Industrial Co. Ltd. |
(10) |
The Commission considered that these significant changes, which have come to light in the context of the name change request, could have affected the company’s eligibility for an exemption from the anti-circumvention measures. |
(11) |
Therefore, the Commission considered there was sufficient evidence that the circumstances on the basis of which the exemption was granted to Youngwire under its previous name may have significantly changed and that these changes were of a lasting nature warranting the initiation of a partial interim review. |
1.3. Initiation of a partial interim review
(12) |
On 5 August 2021, based on the information mentioned in recitals (9) to (11), the Commission decided on its own initiative to initiate a partial interim review limited in scope to the examination of the exemption granted to Youngwire under its previous name, in accordance with Article 11(3) in conjunction with Article 13(4) of the basic Regulation. The purpose of the review was to establish whether Youngwire is still entitled to an exemption from the anti-circumvention measure. |
1.4. Review investigation period

The investigation covered the period from 1 January 2015 to 30 June 2021 (‘the review investigation period’). Data were collected for the investigation period to investigate, inter alia, whether there is change in the pattern of trade following the reorganisation of the company and what, if any, are the procedures and controls that Youngwire has in place in order to prevent Chinese products being sold as Korean and thereby circumventing the duties. More detailed data, including sales and purchase data on transaction level were collected for the period from 1 July 2020 to 30 June 2021 (‘the reporting period’). |
1.5. Interested parties

In the Notice of Initiation (9), interested parties were invited to contact the Commission in order to participate in the review. In addition, the Commission specifically informed Youngwire about the initiation of the review and invited it to participate. |
(15) |
Interested parties had an opportunity to comment on the initiation of the review and to request a hearing with the Commission and/or the Hearing Officer in trade proceedings. |
1.5.1. Questionnaires
(16) |
The Commission sent a questionnaire to Youngwire, which also submitted a questionnaire reply. |
1.5.2. Verification visit
(17) |
The Commission sought and verified all the information deemed necessary for establishing whether Youngwire is still entitled to an exemption from the anti-circumvention measure. A verification visit pursuant to Article 16 of the basic Regulation was carried out at the premises of Youngwire in Changwon and Busan, the Republic of Korea. |
2. PRODUCT UNDER REVIEW

The product subject to this review is the same as in the original investigation and in the following expiry reviews, that is steel ropes and cables including locked coil ropes, excluding ropes and cables of stainless steel, with a maximum cross-sectional dimension exceeding 3 mm, originating in the PRC (‘the product under review’), currently falling under CN codes ex 7312 10 81, ex 7312 10 83, ex 7312 10 85, ex 7312 10 89 and ex 7312 10 98 (TARIC codes 7312108119, 7312108319, 7312108519, 7312108919 and 7312109819), as extended to the same ropes and cables consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not (TARIC codes 7312108113, 7312108313, 7312108513, 7312108913 and 7312109813). |
3. EXAMINATION OF THE EXEMPTION GRANTED TO YOUNG HEUNG/YOUNGWIRE

As mentioned in recital (12), the scope of the current partial interim review was limited to the examination of whether the exemption granted to Youngwire is still valid after its reorganisation. Notably, the investigation assessed whether the company was engaged in circumvention practices as defined in Article 13(1) and (2) of the basic Regulation. |

According to Article 13(1) of the basic Regulation, the Commission first examined whether there was a change in the pattern of trade involving Youngwire following its reorganisation and change of name. |
3.1. Change in the pattern of trade
(21) |
Youngwire’s export sales to the Union had remained overall on a relatively stable level during the review investigation period, without noticeable change after the reorganisation. Also, there was no increase in imports from the PRC during the review investigation period before or after the reorganisation. |
(22) |
During the anti-circumvention investigation, Youngwire was one of the producers related to an exporting producer from the PRC subject to the original measures. However, there was no evidence that such relationship was established or used to circumvent the measures in place on imports originating in the PRC and therefore, the exemption was granted. The present investigation found that this situation had not changed after the reorganisation of Youngwire. |

The investigation also revealed that Youngwire purchased some of the product under review from its related company in the PRC. However, the product under review purchased from its related company in the PRC before and after the reorganisation and the name change was only resold on the domestic market in the Republic of Korea and other export markets, whereas it was not exported to the Union. Furthermore, the volumes purchased from its related company did not increase following the reorganisation. Therefore, the Commission concluded that there was no evidence that after the reorganisation of Youngwire, nor during review investigation period any change in the pattern of trade within the meaning of Article 13(1) of the basic Regulation involving the company took place. |
3.2. Transhipment of Chinese produced SRC through the related company in the Republic of Korea

The Commission further examined whether there was any practice, process or work referred to in the third subparagraph of Article 13(1) of the basic Regulation that would indicate circumvention. In this regard, the Commission first assessed whether the company had sufficient actual production of steel ropes and cables that corresponded to the export sales to the Union. The Commission found that the company indeed had sufficient production of steel ropes and cables that corresponded to the export sales to the Union. |
(25) |
Second, as mentioned in recital (21), the company also purchased some of the product under review from its related company in the PRC. The Commission examined the procedures and controls preventing Chinese products being sold as Korean and thereby circumventing the duties. The Commission therefore reviewed Youngwire’s IT-systems used for tracing the self-produced products through the production process and sales and substantively checked the documentary evidence to ensure that only products exported to the Union and produced by the company benefiting from the exemption to the anti-circumvention measures. This also included substantive testing of the transactions that took place throughout the whole review investigation period. |
(26) |
The investigation revealed that the company’s tracing system ensured that products benefiting from the exemption of the anti-circumvention measure were produced by Youngwire in its own production facilities in the Republic of Korea. |
(27) |
On this basis, the Commission concluded that products under review exported to the Union market could be unequivocally traced and that no transhipment of Chinese produced products to the Union market by the company took place during the review investigation period. |
3.3. Assembly operations
(28) |
The Commission also assessed whether there was any indication of circumventing of the anti-dumping measures in force by assembly operations pursuant to Article 13(2) of the basic Regulation. |

According to Article 13(2) of the basic Regulation, an assembly operation shall be considered to circumvent the measures in force where:

The Commission collected and verified detailed information on Youngwire’s raw material sourcing, production processes and cost accounting. The investigation revealed that the value of the raw materials imported and used in the production process did not exceed the threshold of 60 % of the total value of the parts of the assembled product, as defined in Article 13(2) of the basic Regulation. The Commission also ascertained that the value added to the parts, brought in, exceeded the 25 % threshold, as defined in Article 13(2) of the basic Regulation. |

On this basis, the investigation concluded that there were no assembly operations taking place that would be qualified as circumventing the measures pursuant to Article 13(2) of the basic Regulation. In view these findings it was not necessary to assess the remaining criteria in Article 13(2) of the basic Regulation. |
4. CONCLUSION AND DISCLOSURE

Based on the above, the investigation did not establish any circumvention practises involving Youngwire. Consequently, the partial interim review shall be terminated without withdrawing the exemption from the extended duties granted to Youngwire. |
(33) |
The Commission also established that the change of name was properly registered with the relevant authorities in the Republic of Korea. In light of the findings of this partial interim review, the change of name and the related organisation change did not result in any new relationship with other groups of companies which were not investigated by the Commission or could affect the rights of the exporter to benefit from the exemption from the circumvention measures as established in the Implementing Regulation (EU) No 400/2010 and confirmed by Implementing Regulation (EU) 2018/607. |
(34) |
Accordingly, this change of name does not affect the findings of Implementing Regulation (EU) No 400/2010 and in particular the exemption from the anti-dumping duty rate granted to it. |

The name change should take effect as of the date on which the company informed the Commission that it had changed its name as indicated under recital (7) above. |

Given the considerations in the recitals above, the Commission considered it appropriate to amend Implementing Regulation (EU) 2018/607 to reflect the changed name of the company previously attributed to additional TARIC code C969. |

Interested parties were informed accordingly and were granted an opportunity to submit comments. |

The Commission received comments only from Youngwire. The company agreed with the Commission’s findings and conclusions. However, it pointed out that in consideration of the long procedures, i.e. the time frame of this interim review and, in addition, of the delay in the its initiation, the company had been exporting the product concerned to the Union under the name Young Heung Iron. In view of this, the company requested that the name change should only be affected as from entering into force of the current Regulation, or alternatively, it requested the Commission to attribute the additional code A969 to Youngwire as of 6 May 2020 and to Young Heung Iron & Steel Co., Ltd for the period 6 May 2020 until the entry into force of the current Regulation. According to the company, this solution would be in line with the findings of the investigation that the two names related to the same company. |

In this respect, the Commission concluded that Young Heung Iron & Steel Co., Ltd and Youngwire are in fact the same company for the purpose of the anti-dumping duty. Since the company, under any of the two names, remains entitled to the duty exemption, the Commission considered it appropriate that the effects of this Regulation as regards the name change of the company should only take place as from entering into force of this Regulation. |

on the consequences of the decision of the High Representative on the reorganisation of the civilian crisis management structures in the European External Action Service as regards the function of Civilian Operation Commander for civilian crisis management missions

By Decision ADMIN(2022)50 of 3 August 2022, the High Representative of the Union for Foreign Affairs and Security Policy (the ‘High Representative’) decided on a reorganisation of the central administration of the European External Action Service (EEAS), in particular as regards the management of the civilian planning and conduct capability (CPCC) referred to in Article 4(3), point (a), 3rd indent of Council Decision 2010/427/EU (1). |

In particular, the High Representative decided that as from 16 September 2022, the CPCC will be placed under the authority of a Managing Director and no longer under the authority of a Director. |

The Managing Director of the CPCC will also exercise, on the basis of, and in accordance with, each decision of the Council establishing a civilian crisis management mission pursuant to Article 42(4) and Article 43(2) of the Treaty on European Union, the function of Civilian Operation Commander. |

As a consequence of the decision of the High Representative to place the civilian planning and conduct capability (CPCC) within the EEAS under the authority of a Managing Director, the relevant provisions of existing Council decisions establishing a civilian crisis management mission providing that the Director of the CPCC shall be the Civilian Operation Commander shall apply to the Managing Director of the CPCC.
Article 2
This Decision shall enter into force on the date of its adoption.
It shall apply from 16 September 2022.

COMMISSION IMPLEMENTING DECISION (EU) 2022/1627
of 19 September 2022
amending the Implementing Decision (EU) 2021/641 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States
(notified under document C(2022)6786)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c), thereof,
Whereas:
(1) |
Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and may have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into establishments where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other establishments where poultry or captive birds are kept. |
(2) |
Regulation (EU) 2016/429 establishes a new legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI. |
(3) |
Commission Implementing Decision (EU) 2021/641 (3) was adopted within the framework of Regulation (EU) 2016/429 and it lays down emergency measures at Union level in relation to outbreaks of HPAI. |
(4) |
More particularly, Implementing Decision (EU) 2021/641 provides that the protection, surveillance and further restricted zones established by the Member States following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection, surveillance and further restricted zones in the Annex to that Implementing Decision. |

The Annex to Implementing Decision (EU) 2021/641 was recently amended by Commission Implementing Decision (EU) 2022/1483 (4) following outbreaks of HPAI in poultry or captive birds in Germany, Spain, France, the Netherlands and Portugal that needed to be reflected in that Annex. |
(6) |
Since the date of adoption of Implementing Decision (EU) 2022/1483, Germany, Spain, France and the Netherlands have notified the Commission of further outbreaks of HPAI in establishments where poultry or captive birds were kept, located in the Lower Saxony Land in Germany, in the Guadalajara Province in Spain, in the Ain, Ille-et-Vilaine, Meuse and Somme Departments in France, and in the Gelderland, Friesland, Noord-Holland, Overijssel, Zuid-Holland and Utrecht Provinces in the Netherlands. |
(7) |
The competent authorities of Germany, Spain, France and the Netherlands have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around those outbreaks. |
(8) |
In addition, certain outbreaks confirmed in Germany and in the Netherlands are located in close proximity to the border between those two Member States. Accordingly, the competent authorities of these Member States have duly collaborated with regard to the establishment of the necessary protection and surveillance zones, in accordance with Delegated Regulation (EU) 2020/687, as the protection and surveillance zones extend into the territory of both the Netherlands and Germany. |

The Commission has examined the disease control measures taken by Germany, Spain, France and the Netherlands in collaboration with those Member States and it is satisfied that the boundaries of the protection and surveillances zones in Germany, Spain, France and the Netherlands established by the competent authority of those Member States are at a sufficient distance from the establishments where the outbreaks of HPAI have been confirmed. |

In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Germany, Spain, France and the Netherlands, the protection and surveillance zones established by those Member States in accordance with Delegated Regulation (EU) 2020/687. |

Therefore, the areas listed as protection and surveillance zones for Germany, Spain, France and the Netherlands in the Annex to Implementing Decision (EU) 2021/641 should be amended. |
(12) |
In addition, Implementing Decision (EU) 2021/641 applies until 30 September 2022. However, the duration of the restrictions applicable in the restricted zones established by Germany, Spain, France and the Netherlands in accordance with Delegated Regulation (EU) 2020/687 extends beyond 30 September 2022. |
(13) |
Moreover, due to the ongoing findings of HPAI viruses in wild birds in the Union and the risks of the spread of that disease by migratory wild birds during their autumn migration season, there is an increasing risk of further outbreaks in poultry and captive birds. |
(14) |
It is therefore appropriate to prolong the period of application of Implementing Decision (EU) 2021/641 until 30 September 2023, to cover the upcoming annual migration season of migratory wild birds. This prolongation also takes into account current developments in the epidemiological situation in the Union as regards HPAI and the corresponding risks to animal health resulting from possible further outbreaks of that disease. Article 4 of that Implementing Decision should therefore be amended accordingly. |

Furthermore, during the recent high risk periods of the autumn and spring migration of the wild birds, a high number of outbreaks were confirmed in poultry and captive birds in the Union. Consequently, the number of the areas listed in the Annex to Implementing Decision (EU) 2021/641, representing the restricted zones established by the Member States for those outbreaks, increased significantly and it became difficult to identify which areas corresponded to which outbreaks. Therefore, to facilitate a better understanding of the corresponding link between the various outbreaks and their respective restricted zones, a new column should be added to the tables in Parts A and B of the Annex to Implementing Decision (EU) 2021/641, to include the reference number of the particular outbreak, as notified by the Member State to the Commission and the other Member States via the Animal Diseases Information System (ADIS) in accordance with Article 3 of Commission Implementing Regulation (EU) 2020/2002 (5). |

Accordingly, the Annex to Implementing Decision (EU) 2021/641 should be amended to update regionalisation at Union level to take account of the protection and surveillance zones duly established by Germany, Spain, France and the Netherlands in accordance with Delegated Regulation (EU) 2020/687, and the duration of the measures applicable therein. |

In addition, a new column should be added to the tables in Parts A and B of the Annex to Implementing Decision (EU) 2021/641, to include the ADIS reference numbers of the outbreaks corresponding to the areas listed as protection and surveillance zones. |
(18) |
Implementing Decision (EU) 2021/641 should therefore be amended accordingly. |
(19) |
Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to Implementing Decision (EU) 2021/641 by this Decision take effect as soon as possible. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
