supplementing Regulation (EU) 2019/2033 of the European Parliament and of the Council with regard to regulatory technical standards for own funds requirement for investment firms based on fixed overheads

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2019/2033 of the European Parliament and of the Council of 27 November 2019 on the prudential requirements for investment firms and amending Regulations (EU) No 1093/2010, (EU) No 575/2013, (EU) No 600/2014 and (EU) No 806/2014 (1), and in particular the fourth subparagraph of Article 13(4) thereof,
Whereas:

Considering that not all investment firms are required to have audited financial statements, rules specifying own funds requirement for investment firms based on fixed overheads should allow investment firms to calculate fixed overheads requirement also on the basis of non-audited financial statements, where investment firms are not obliged to have audited financial statements. Furthermore, where the audited financial statements do not cover a period of 12 months, a calculation should be performed by the investment firm to produce an equivalent annual amount, in order to ensure consistency with the requirement of Article 13(1) of Regulation (EU) 2019/2033. |

(2) |
Given that the difference between the gross and net profits with regard to a firm’s financial situation are represented by the fixed costs of running the firm’s business, the deduction from the total costs of an investment firm of the employees’, directors’ and partners’ shares in profit referred to in Article 13(4) of Regulation (EU) 2019/2033 should be understood to refer to the net profits. |
|
(3) |
Moreover, since payment of staff bonuses and other remuneration may be deferred over time and could follow different agreement structures, those staff bonuses and other remuneration should be considered as dependent on net profit where this would have no impact on the firm’s capital position, either due to payments having already been made or due to the absence of the obligation of payment in case of absence of net profit. |

Investment firms are to include fixed costs of third parties in the calculation of their total expenses. However, where those costs are not fully incurred on behalf of the investment firms, they should be included up to the amount attributable to the investment firm. |
|
(5) |
Not all investment firms use International Financial Reporting Standards and there are differences in the applicable accounting standards in the calculation of the total costs. Elements to be deducted by investment firms from their total expenses used for the calculation of the fixed overheads requirement should be further specified, in addition to those provided in Article 13(4) of Regulation (EU) 2019/2033, in order to ensure comparability in the calculation of the fixed overheads requirement. |

(6) |
Consistently with the particularity of the business of commodity and emission allowance dealers, expenses related to raw materials should be deducted by commodity and emission allowance dealers from the total expenses used in calculating their fixed overheads requirement. |
|
(7) |
In case an investment firm that is a market maker is wound down, it stops providing its market making services and hence no longer incurs the trading fees it normally incurs when providing those services. So those fees should be excluded from the total expenses used to calculate the fixed overheads requirement. At the same time, in case of a wind down, the market maker may continue to have an inventory of securities that it normally uses in its market making activities. If that inventory is liquidated, it would give rise to trading fees that should be included in the total expenses used for calculating the fixed overheads requirement. |

Fixed overheads can evolve at a similar pace as the activities of the investment firm, and in that case should not be considered material changes for the purposes of Article 13(2) of Regulation (EU) 2019/2033. However, there may be circumstances where changes, such as shifts in the business models or mergers and acquisitions, may occur and result in significant variations in the projected fixed overheads. Therefore, rules specifying own funds requirement for investment firms based on fixed overheads should establish objective thresholds based on the projected fixed overheads for the purpose of specifying the notion of material change. |

(9) |
This Regulation is based on the draft regulatory technical standards submitted by the European Banking Authority to the Commission after having consulted the European Securities and Markets Authority. |
|
(10) |
The European Banking Authority has conducted open public consultations on the draft regulatory technical standards on which this Regulation is based, analysed the potential related costs and benefits and requested the advice of the Banking Stakeholder Group established in accordance with Article 37 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council (2). |
HAS ADOPTED THIS REGULATION:
Article 1
Calculation of the fixed overheads requirement
1. For the purposes of Article 13(1) of Regulation (EU) 2019/2033, the ‘figures resulting from the applicable accounting framework’ shall refer to figures of an investment firm’s most recent audited annual financial statements after distribution of profits or annual financial statements where investment firms are not obliged to have audited financial statements.
2. Where the investment firm’s most recent audited financial statements do not reflect a 12-month period, the investment firm shall divide the amounts included in those statements by the number of months that are reflected in those financial statements and shall subsequently multiply the result by 12, so as to produce an equivalent annual amount.
3. For the purposes of Article 13(4), first subparagraph, point (b), of Regulation (EU) 2019/2033, employees’, directors’ and partners’ shares in profits shall be calculated on the basis of the net profits.
4. For the purposes of Article 13(4), first subparagraph, point (a), of Regulation (EU) 2019/2033, staff bonuses and other remuneration shall be considered to depend on the net profit of the investment firm in the respective year where both of the following conditions are met:

(a) |
the staff bonuses or other remuneration to be deducted have already been paid to employees in the year preceding the year of payment, or the payment of the staff bonuses or other remuneration to employees will have no impact on the firm’s capital position in the year of payment; |
|
(b) |
with respect to the current year and future years, the firm is not obliged to award or allocate further bonuses or other payments in the form of remuneration unless it makes a net profit in that year. |
5. Where third parties, including tied agents, incurred fixed expenses, on behalf of the investment firms, that are not already included within the total expenses in the annual financial statements referred to in paragraph 1, those fixed expenses shall be added to the total expenses of the investment firm. Where a breakdown of the third party’s expenses is available, an investment firm shall add to the figure representing the total expenses only the share of those fixed expenses applicable to the investment firm. Where such a breakdown is not available, an investment firm shall add to the figure representing the total expenses only its share of the third party’s expenses as it results from the business plan of the investment firm.
6. In addition to the items for deduction referred to in Article 13(4) of Regulation (EU) 2019/2033, the following items shall also be deducted from the total expenses, where they are included under total expenses in accordance with the relevant accounting framework:

(a) |
fees, brokerage and other charges paid to central counterparties, exchanges and other trading venues and intermediate brokers for the purposes of executing, registering or clearing transactions, only where they are directly passed on and charged to customers. Those shall not include fees and other charges necessary to maintain membership or otherwise meet loss-sharing financial obligations to central counterparties, exchanges and other trading venues; |
|
(b) |
interest paid to customers on client money, where there is no obligation of any kind to pay such interest; |
|
(c) |
expenditures from taxes where they fall due in relation to the annual profits of the investment firm; |
|
(d) |
losses from trading on own account in financial instruments; |
|
(e) |
payments related to contract-based profit and loss transfer agreements according to which the investment firm is obliged to transfer, following the preparation of its annual financial statements, its annual result to the parent undertaking; |
|
(f) |
payments into a fund for general banking risk in accordance with Article 26(1), point (f), of Regulation (EU) No 575/2013 of the European Parliament and of the Council (3); |
|
(g) |
expenses related to items that have already been deducted from own funds in accordance with Article 36(1) of Regulation (EU) No 575/2013. |
In addition to the items listed in the first subparagraph, market makers, as defined in Article 4(1), point (7), of Directive 2014/65/EU of the European Parliament and of the Council (4), may also deduct the following amount (A):

trading fees paid by the market maker for transactions for which the market maker provides market-making activities (yearly amount), where those fees have not directly been passed on and charged to customers; |
|
C |
= |
trading fees that would be incurred to sell a portfolio of securities equivalent to the largest end-of-day inventory of securities, held by the market maker for market-making purposes, over the preceding year. |
Article 2
Calculation of the fixed overheads requirement for commodity and emission allowance dealers
Commodity and emission allowance dealers may deduct expenditure on raw materials in connection with an investment firm trading in derivatives of the underlying commodity.
Article 3
The notion of material change
A material change referred to in Article 13(2) of Regulation (EU) 2019/2033 shall be considered to have occurred where either of the following conditions are met:

(a) |
a change, either in the form of an increase or in the form of a decrease, in the business activity of the firm results in a change of 30 % or greater in the firm’s projected fixed overheads of the current year; |
|
(b) |
a change, either in the form of an increase or in the form of a decrease, in the business activity of the firm results in changes in the firm’s own funds requirements based on projected fixed overheads of the current year equal to or greater than EUR 2 000 000. |
Article 4
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing a derogation from Article 43(1) of Regulation (EU) 2016/2031 of the European Parliament and the Council as regards the import conditions for introduction into the Union of wood packaging material in the form of ammunition boxes, originating in the United States of America, under the control of the United States Department of Defence, and manufactured before 1 September 2007
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/2031 of the European Parliament and the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC (1), and in particular Article 43(2),
Whereas:

Commission Implementing Decision (EU) 2015/179 (2) authorised Member States to provide for a temporary derogation from certain provisions of Council Directive 2000/29/EC (3) in respect of special conditions concerning the introduction into the Union of wood packaging material of conifers (Pinopsida) in the form of ammunition boxes originating in the United States of America, under the control of the United States Department of Defence. Since the validity of this Decision expired on 31 December 2020, new rules should be adopted in order to allow the introduction of such ammunition boxes under certain conditions also in future. |
|
(2) |
Article 43(1) of Regulation (EU) 2016/2031 provides for specific requirements for the introduction into the Union of wood packaging material, which should comply with the International Standard for Phytosanitary Measures No 15 (ISPM 15): Regulation of Wood Packaging Material in International Trade (4), guaranteeing that the wood packaging material has been subjected to approved phytosanitary treatment. |
|
(3) |
Certain wood packaging material of conifers (Pinopsida) in the form of boxes used in the transport of ammunition and manufactured in the United States of America before 1 September 2007, have been subject to treatments which are not in line with the applicable requirements set out in Annex I to ISPM 15 and therefore do not fulfil the conditions set out in Article 43(1) of Regulation (EU) 2016/2031. |

(4) |
On 7 September 2018, the United States of America requested a prolongation of the derogation under Implementing Decision (EU) 2015/179 for wood packaging material made of softwood and an extension of the scope of the derogation to wood packaging material made of hardwood. The United States of America have accompanied the above-mentioned request with a dossier which represents a follow-up to a previous pathway analysis of the United States Department of Defence as regards softwood ammunition boxes, complementing it by a pathway analysis for hardwood ammunition boxes. |
|
(5) |
The Commission has concluded, on the basis of the information supplied by the United States of America and following a discussion with the relevant expert group on a derogation for introduction into the Union of wood packaging material in the form of ammunition boxes from United States of America, that the boxes referred to in recital 3 and used in the transport of ammunition, both of soft and hard wood, do not present any risk of spreading plant pests, provided that certain conditions are met. These conditions concern the date of production of those ammunition boxes, the absence, or the limited presence, of bark, the treatment and repair of such boxes, as well as their storage and transport. |
|
(6) |
This derogation should only apply to wood packaging material in the form of ammunition boxes originating in the United States of America, which has been manufactured before 1 September 2007, as boxes manufactured after that date have undergone a treatment in accordance with ISPM 15. |
|
(7) |
Therefore, such wood packaging material in the form of ammunition boxes originating in the United States of America, both of soft and hard wood, should be allowed to be introduced into, as well as stored and moved within, the Union territory, as long as it fulfils the conditions set out in this Regulation. |
|
(8) |
In order to ensure effective controls and overview of the potential phytosanitary risks, any operator moving or storing wood packaging material in the form of ammunition boxes originating in the United States of America, after the respective relevant checks, should notify the respective competent authority concerning the movement or storage of the boxes concerned. |
|
(9) |
In order to assure a swift response to any potential phytosanitary risk from wood packaging material in the form of ammunition boxes originating in the United States of America, Member States should immediately inform each other and the Commission when they become aware of a consignment not complying with the requirements concerning the conditions for introduction into the Union set out in this Regulation. In addition, they should, on an annual basis, provide the Commission and the other Member States with information on the imports made, in order to assess the application of this Regulation. |
|
(10) |
The conditions for the derogation introduced by this Regulation should apply until 31 July 2025 to allow for the review of the implementation of its measures, and to examine whether they effectively address the phytosanitary risk of the import of that wood packaging material. |
|
(11) |
Since Implementing Decision (EU) 2015/179 expired already on 31 December 2020, this Implementing Regulation should enter into force on the third day after its publication in the Official Journal of the European Union, in order to ensure the swiftest possible introduction of this wood packaging material into the Union. |
HAS ADOPTED THIS REGULATION:
Article 1
Authorisation to provide for derogation and conditions for the ammunition boxes
Wood packaging material in the form of boxes, actually in use in the transport of ammunition, manufactured before 1 September 2007, and originating in the United States of America, under the control of the United States Department of Defence (‘the boxes’), is exempted from the requirements of Article 43(1) of Regulation (EU) 2016/2031, where:
|
(a) |
the boxes fulfil the conditions set out in the Annex to this Regulation; and |
|
(b) |
the requirements in accordance with Articles 2, 3 and 4 are fulfilled. |
Article 2
Notification obligation
1. At least five working days before the intended introduction of a consignment as referred to in Article 1, the importer shall notify the competent authorities of the Member State of the point of entry of its intention to introduce the consignment. Within the same period, the importer shall also provide the same notification to the competent authorities of the Member State of the first place of storage, where that place differs from the point of entry.
2. The notification referred to in paragraph 1 shall include the following elements:

(a) |
date of intended introduction; |
|
(b) |
an inventory of the consignment concerned identifying the boxes forming part of it; |
|
(c) |
name and address of importer; |
|
(d) |
address of the point of entry of intended introduction; |
|
(e) |
address of the first place of storage, where that differs from the point of entry. |
Article 3
Checks by the competent authorities
1. The competent authorities of the Member State of the point of entry shall check the presence and completeness of the document described in point 7 of the Annex. They shall also check compliance of a representative sample of each consignment with the following points of the Annex:
|
(a) |
points (1) and (2) concerning the display of the respective marks; |
|
(b) |
point (3) concerning repaired boxes; |
|
(c) |
point (4) concerning the absence of bark; |
|
(d) |
point (5) concerning the moisture content level; |
2. By derogation from paragraph 1, where the first place of storage differs from the point of entry, the competent authorities of the Member State of the first place of storage shall carry out the check described in that paragraph.
Article 4
Storage and movement of the boxes
1. Prior to and after the conduct of the checks referred to in Article 3, the boxes shall remain stored in closed buildings.
2. Any movement of the boxes may only take place in closed containers, or under full protective cover.
Article 5
Notification of non-compliance
Member States shall notify the Commission and the other Member States of each consignment not complying with the conditions set out in the Annex.
That notification shall take place no later than three working days after the date when the competent authority becomes aware of such a consignment.
Article 6
Reporting on imports
By 31 January of each year, the Member State of the first place of storage shall provide the Commission and the other Member States with information on the number of consignments introduced into their territories and with a report on the checks referred to in Article 3 carried out between 1 January and 31 December of the preceding year.
Article 7
Expiry date
This Regulation shall expire on 31 July 2025.
Article 8
Entry into force
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX
Conditions for the introduction of ammunition boxes as referred to in Article 1
The boxes referred to in Article 1 shall satisfy the following conditions:

(1) |
they display a mark confirming that they have been manufactured by 31 August 2007; |
|
(2) |
they display a mark indicating that they have been treated with a wood preservative approved by the Environmental Protection Agency of the United States of America. |
|
(3) |
in case the boxes have been repaired since manufacture, the wood used for that purpose fulfils the conditions set out in Article 43(1) of Regulation (EU) 2016/2031; |
|
(4) |
the boxes are made of wood. That wood must either be completely debarked or only contain visually separate and clearly distinct small pieces of bark. Those pieces of bark must comply with either of the following requirements:
|
|
(5) |
their moisture content level is not more than 20 %; |
|
(6) |
they have been stored in closed buildings and transported in closed containers, or under full protective cover; |
|
(7) |
they are accompanied by a document issued by the United States Department of Defence confirming compliance with the conditions set out in points (4), (5) and (6). |

COMMISSION IMPLEMENTING REGULATION (EU) 2022/1457

amending Implementing Regulation (EU) 2017/2330 as regards the terms of authorisation of iron (II) chelate of amino acids hydrate as a feed additive for all animal species

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 13(3) thereof,
Whereas:

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such an authorisation. |
|
(2) |
The use of iron (II) chelate of amino acids hydrate as a feed additive was authorised for all animal species by Commission Implementing Regulation (EU) 2017/2330 (2). |
|
(3) |
In accordance with Article 13(1) of Regulation (EC) No 1831/2003, the Commission requested the European Food Safety Authority (‘the Authority’) to issue an opinion on whether the authorisation of iron (II) chelate of amino acids hydrate as a feed additive would still meet the conditions laid down in Article 5 of Regulation (EC) No 1831/2003, if modified as proposed by the applicant. That modification consists in the extension of the protein sources for the amino acids and in the introduction of a minimum specification for free amino acids and of a tighter specification of the iron content. The request was accompanied by the relevant supporting data. |
|
(4) |
The Authority concluded in its opinion of 29 September 2021 (3) that the modifications of the terms of authorisation applied for do not modify the conclusions reached in the previous assessments on the safety for the target species, consumers, environment and efficacy of the feed additive. The Authority concluded that the additive should be considered a skin and eye irritant and a skin sensitizer, and stated a potential risk due to exposure by inhalation. Therefore, the Commission considers that appropriate protective measures should be taken to prevent adverse effects on human health, in particular as regards the users of the additive. The Authority does not consider that there is a need for specific requirements of post-market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |

(5) |
The assessment of the proposed modifications to the authorisation shows that the conditions for authorisation as provided for in Article 5 of Regulation (EC) No 1831/2003 are satisfied. |
|
(6) |
For reasons of clarity, the composition of the additive should be modified to include the indication that the additive consists of a preparation. |
|
(7) |
Implementing Regulation (EU) 2017/2330 should therefore be amended accordingly. |
|
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
In the Annex to Implementing Regulation (EU) 2017/2330, the entry for iron (II) chelate of amino acids hydrate is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Implementing Regulation (EU) 2016/1095 as regards the terms of authorisation of zinc chelate of amino acids hydrate as a feed additive for all animal species

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 13(3) thereof,
Whereas:

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such an authorisation. |
|
(2) |
The use of zinc chelate of amino acids hydrate as a feed additive was authorised for all animal species by Commission Implementing Regulation (EU) 2016/1095 (2). |
|
(3) |
In accordance with Article 13(1) of Regulation (EC) No 1831/2003, the Commission requested the European Food Safety Authority (‘the Authority’) to issue an opinion on whether the authorisation of zinc chelate of amino acids hydrate as a feed additive would still meet the conditions laid down in Article 5 of Regulation (EC) No 1831/2003, considering a modification of the terms of that authorisation. That modification consists of an extension of the protein sources for the amino acids and the introduction of a minimum specification for free amino acids and of a tighter specification of the zinc content. The request was accompanied by the relevant supporting data |

The Authority concluded in its opinion of 29 September 2021 (3) that the modifications of the terms of authorisation applied for do not modify the conclusions reached in the previous assessments on the safety for the target species, consumers, environment and efficacy of the feed additive. The Authority concluded that the additive should be considered a skin and eye irritant and a skin sensitiser and stated a potential risk due to exposure by inhalation. Therefore, the Commission considers that appropriate protective measures should be taken to prevent adverse effects on human health, in particular as regards the users of the additive. The Authority does not consider that there is a need for specific requirements of post-market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |

The assessment of the proposed modifications to the authorisation shows that the conditions for authorisation, as provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. |
|
(6) |
For reasons of clarity, the composition of the additive should be modified to include the indication that the additive consists of a preparation. |
|
(7) |
Implementing Regulation (EU) 2016/1095 should therefore be amended accordingly. |
|
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
In the Annex to Implementing Regulation (EU) 2016/1095, the entry of zinc chelate of amino acids hydrate is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 13(3) thereof,

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such an authorisation. |

The use of the organic form of selenium produced by Saccharomyces cerevisiae CNCM I-3060 as a feed additive was authorised for all animal species by Commission Implementing Regulation (EU) 2019/804 (2). |
|
(3) |
In accordance with Article 13(1) of Regulation (EC) No 1831/2003, the Commission requested the European Food Safety Authority (‘the Authority’) to issue an opinion on whether the authorisation of the organic form of selenium produced by Saccharomyces cerevisiae CNCM I-3060 as a feed additive would still meet the conditions laid down in Article 5 of Regulation (EC) No 1831/2003, if modified as proposed by the applicant. That modification consists of increasing the minimum concentration of selenium in the feed additive. The request was accompanied by the relevant supporting data. |

The Authority concluded in its opinion of 10 November 2021 (3) that the modification of the terms of authorisation proposed by the applicant do not modify the conclusions reached in the previous assessments on the safety for the target species, consumers, environment and efficacy of the feed additive. The Authority concluded that the additive is hazardous by inhalation, is not irritant for the eyes, skin and is not a dermal sensitiser. The Authority did not consider that there is a need for specific requirements of post-market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |

In view of the Authority’s opinion, the Commission therefore considers that appropriate protective measures should be taken to prevent adverse effects on human health, in particular as regards the users of the additive. |
|
(6) |
The assessment of the modification to the authorisation proposed by the applicant shows that the conditions for authorisation set out in Article 5 of Regulation (EC) No 1831/2003 are fulfilled. |
|
(7) |
Implementing Regulation (EU) 2019/804 should therefore be amended accordingly. |
|
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |

amending Annex I to Implementing Regulation (EU) 2021/605 laying down special control measures for African swine fever

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
|
(2) |
Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex. |
|
(3) |
The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Commission Implementing Regulation (EU) 2022/1413 (3) following changes in the epidemiological situation as regards that disease in Germany, Italy and Latvia. |
|
(4) |
Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health (WOAH) and justifications for zoning provided by the competent authorities of the Member States concerned. |
|
(5) |
Since the date of adoption of Implementing Regulation (EU) 2022/1413 there have been new outbreaks of African swine fever in kept porcine animals in Lithuania and Latvia, as well as new outbreaks of African swine fever in wild porcine animals in Poland. Also, the overall epidemiological situation of African swine fever in Italy has not improved. |
|
(6) |
In August 2022, several outbreaks of African swine fever in kept porcine animals were observed in the Marijampole county in Lithuania in areas currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to areas listed as restricted zones II thereof. Those new outbreaks of African swine fever in kept porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Lithuania currently listed as restricted zones II in that Annex, that are in close proximity to the areas listed in restricted zones III affected by those recent outbreaks of African swine fever, should now be listed as restricted zones III in that Annex instead of as restricted zones II thereof and the current boundaries of restricted zones II also need to be redefined to take account of those recent outbreaks. |
|
(7) |
In addition, in August 2022, one outbreak of African swine fever in kept porcine animals was observed in the Marijampole county in Lithuania in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605. This new outbreak of African swine fever in kept porcine animals constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Lithuania currently listed as restricted zone II in that Annex, affected by this recent outbreak of African swine fever, should now be listed as restricted zone III in that Annex instead of as restricted zone II thereof and the current boundaries of restricted zone II also need to be redefined to take account of this recent outbreak. |

Also, in August 2022, several outbreaks of African swine fever in wild porcine animals were observed in the Zachodniopomorskie region in Poland in an area currently listed as restricted zones I in Annex I to Implementing Regulation (EU) 2021/605. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently listed as restricted zone I in that Annex, affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks. |

Additionally, in August 2022, one outbreak of African swine fever in kept porcine animals were observed in the Kuldigas county in Latvia in an area currently listed as restricted zone III in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to an area listed as restricted zone II thereof. This new outbreak of African swine fever in kept porcine animals constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this areas of Latvia currently listed as restricted zone II in that Annex, that is in close proximity to the area listed in restricted zone III affected by this recent outbreak of African swine fever, should now be listed as restricted zone III in that Annex instead of as restricted zone II thereof and the current boundaries of restricted zone II also need to be redefined to take account of this recent outbreak. |
|

Finally, on 27 May 2022, a case of African swine fever in a wild porcine animal was observed in Italy in the Rieti Province, in the Lazio Region. Commission Implementing Decisions (EU) 2022/875 (6) and (EU) 2022/920 (7) were adopted in response to this case. Implementing Decision (EU) 2022/920 repealed and replaced Implementing Decision (EU) 2022/875 and it applies until 31 August 2022. Implementing Decision (EU) 2022/920 provides for the establishment of an infected zone in accordance with Article 63 of Commission Delegated Regulation (EU) 2020/687 (8), as well as the special control measures for African swine fever applicable to restricted zones II laid down in Implementing Regulation (EU) 2021/605. |
|
(11) |
Considering the overall epidemiological situation of African swine fever in Italy and the epidemiology of that disease and also taking account of international standards, such as the Terrestrial Animal Health Code of the WOAH, this area of Italy affected by this outbreak of African swine fever, should now be listed as restricted zone I and II in Annex I to Implementing Regulation (EU) 2021/605. |
|
(12) |
Following those recent outbreaks of African swine fever in kept porcine animals in Lithuania and Latvia, as well as in wild porcine animals in Poland and considering risks arising from the African swine fever situation in wild porcine animals in Italy in taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in those Member States has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605. |
|
(13) |
In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new restricted zones of a sufficient size should be demarcated for Italy, Latvia, Lithuania and Poland and duly listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the situation in the surrounding areas. |
|
(14) |
Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible. |
|

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1

COMMISSION IMPLEMENTING DECISION (EU) 2022/1461
of 26 August 2022
concerning exemptions from the extended anti-dumping duty on certain bicycle parts originating in the People’s Republic of China pursuant to Regulation (EC) No 88/97
(notified under document C(2022) 6011)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1), and in particular Article 13(4) thereof,
Having regard to Council Regulation (EC) No 71/97 of 10 January 1997 extending the definitive anti-dumping duty imposed by Regulation (EEC) No 2474/93 on bicycles originating in the People’s Republic of China to imports of certain bicycle parts from the People’s Republic of China, and levying the extended duty on such imports registered under Regulation (EC) No 703/96 (2) and in particular Article 3 thereof,
Having regard to Commission Implementing Regulation (EU) 2020/45 of 20 January 2020 amending Implementing Regulation (EU) 2019/1379 as regards the extension of the anti-dumping duty imposed on imports of bicycles originating in the People’s Republic of China to imports of certain bicycle parts originating in the People’s Republic of China by Council Regulation (EC) No 71/97 (3),
Having regard to Commission Regulation (EC) No 88/97 of 20 January 1997 on the authorisation of the exemption of imports of certain bicycle parts originating in the People’s Republic of China from the extension by Council Regulation (EC) No 71/97 of the anti-dumping duty imposed by Council Regulation (EEC) No 2474/93 (4), and in particular Articles 4 to 7 thereof,
After informing the Member States,
Whereas:
|
(1) |
An anti-dumping duty applies on imports of essential bicycle parts originating in the People’s Republic of China (‘China’) (‘the extended duty’) as a result of the extension of the anti-dumping duty imposed on imports of bicycles originating in China by Regulation (EC) No 71/97. |
|
(2) |
Under Article 3 of Regulation (EC) No 71/97 the Commission is empowered to adopt the necessary measures to authorise the exemption of imports of essential bicycle parts which do not circumvent the anti-dumping duty. |
|
(3) |
Those implementing measures are set forth in Regulation (EC) No 88/97 (‘the exemption Regulation’) establishing the specific exemption system. |
|
(4) |
On that basis the Commission has exempted a number of bicycle assemblers from the extended duty (‘the exempted parties’). |
|
(5) |
As provided for in Article 16(2) of the exemption Regulation, the Commission has published in the Official Journal of the European Union subsequent lists of the exempted parties (5). |
|
(6) |
The most recent Commission Implementing Decision (EU) 2022/505 (6) concerning exemptions under the exemption Regulation was adopted on 23 March 2022. |
|
(7) |
For the purposes of this Decision, the definitions set out in Article 1 of the exemption Regulation apply. |
1. REQUESTS FOR EXEMPTION
|
(8) |
Between 15 July 2020 and 30 March 2022, the Commission received from the parties listed in Tables 1 and 2 requests for exemption with the information required to determine whether these requests were admissible in accordance with Article 4 of the exemption Regulation. |
|
(9) |
The parties requesting exemption were given an opportunity to comment on the Commission’s conclusions concerning the admissibility of their requests. Their comments have been addressed in recitals (22) to (27). |
|
(10) |
In accordance with Article 5(1) of the exemption Regulation, pending a decision on the merits of requests from the parties requesting exemption, the payment of the extended duty in respect of any imports of essential bicycle parts declared for free circulation by these parties listed in Tables 1 and 2 below was suspended as from the day on which the Commission received their respective duly substantiated requests pursuant to Article 4(1) and (2) of the exemption Regulation. |
2. AUTHORISATION OF EXEMPTION

(11) |
The examination of the merits of the request from the parties listed in Table 1 has been concluded. Table 1
|
|
(12) |
The Commission established during its examination that the value of the parts originating in China constituted less than 60 % of the total value of the parts of all the bicycles assembled by the parties listed in Table 1. |
|
(13) |
Consequently, the Commission concluded that the assembly operations of the parties listed in Table 1 respectively fall outside the scope of Article 13(2) of Regulation (EU) 2016/1036. |
|
(14) |
For that reason, and in accordance with Article 7(1) of the exemption Regulation, the parties listed in Table 1 fulfilled the conditions for exemption from the extended duty. |
|
(15) |
In accordance with Article 7(2) of the exemption Regulation, the exemption should take effect as from the date of receipt of the duly substantiated request pursuant to Article 4(1) and (2) of the exemption Regulation. The customs debts in respect of the extended duty from the parties requesting exemption should therefore be considered void from the same date. |
|
(16) |
The interested parties were informed of the Commission’s conclusions on the merits of their requests respectively and were given an opportunity to comment thereon. |
|
(17) |
Since the exemption applies only to the parties specifically referred to in Table 1, the exempted parties should notify the Commission (7) without delay of any changes to this exemption (for instance, following a change in the name, legal form or address or following the setting up of new assembly entities). |
|
(18) |
In case of change in reference, the exempted party should provide relevant information, including on any modification in its activity linked to assembly operations. Where appropriate, the Commission will update the references accordingly. |
3. SUSPENSION OF PAYMENTS OF THE DUTIES FOR PARTIES UNDER EXAMINATION

(19) |
The examination of the merits of the requests from the parties listed in Table 2 is ongoing. Pending a decision on the merits of their requests, the payment of the extended duty by these parties is suspended. |
|
(20) |
Since the suspensions apply only to the parties specifically referred to in Table 2, these parties should notify the Commission (8) without delay of any changes to these (for instance following a change in the name, legal form or address or following the setting up of new assembly entities). |
|
(21) |
In case of change in reference, the party concerned should provide all relevant information, including on any modification in its activities linked to assembly operations. Where appropriate, the Commission will update the references to such party. Table 2

(22) |
Decathlon Sp. z o.o. Poland (‘Decathlon’) listed in Table 2 commented by requesting the Commission to reconsider the date of effect of the suspension of payments of the duties for parties under examination. |
|
(23) |
Decathlon claimed that the request for exemption was lodged on 1 December 2021 together with the necessary documents and information in order for the Commission to determine its admissibility and therefore, the suspension of payments of the duties should take effect as from that date. |
|
(24) |
In this regard, Article 4(3) of the exemption Regulation states that the admissibility of requests of exemption is determined when it is duly substantiated pursuant to Article 4(1) and (2) of the same Regulation. |
|
(25) |
The request of exemption lodged by Decathlon on 1 December 2021 was not duly substantiated to determine its admissibility. The Commission informed Decathlon accordingly and requested additional information as well as missing documentation pursuant to Article 4(2) of the exemption Regulation. |
|
(26) |
Decathlon provided the missing documentation and information on 31 January 2022 and 21 March 2022. Therefore, the request for exemption lodged by Decathlon was considered duly substantiated only as of 21 March 2022 and accordingly this is the date of effect of the suspension of payment of the extended duties. |
|
(27) |
For the above, the date of 21 March 2022, as previously disclosed, is confirmed and the request of Decathlon dismissed. |
4. UPDATE OF REFERENCES TO EXEMPTED PARTIES
|
(28) |
Between 16 November 2021 and 24 May 2022, the exempted parties listed in Table 3 notified the Commission of changes in their addresses. The Commission, after having examined the information submitted, concluded that those changes do not affect the assembly operations with regard to the conditions of exemption or suspension set forth in the exemption Regulation. |
|
(29) |
While the exemption of these parties from the extended duty authorised in accordance with Articles 5(1) or 7(1) of the exemption Regulation remains unaffected, the references to these parties should be updated. Table 3

5. SUSPENSION OF PAYMENTS OF THE DUTIES FOR PARTIES UNDER EXAMINATION LIFTED (WITHDRAWAL OF REQUESTS FOR EXEMPTION)

The suspension of payment of the duties for the parties under examination should be lifted for the parties listed in Table 4. Table 4

(31) |
On 27 July 2020 and on 25 November 2020 the Commission received from the parties listed in Table 4 a request for exemption with the information required to determine whether the respective requests were admissible in accordance with Article 4(1) of the exemption Regulation. |
|
(32) |
In accordance with Article 5(1) of Regulation (EC) No 88/97, pending a decision on the merits of the requests, the payment of the extended duty in respect of any imports of essential bicycle parts declared for free circulation by the parties listed in Table 4 was suspended as from the day on which the Commission received their requests for exemption respectively. |
|
(33) |
TARIC additional codes C557 and C609 were assigned to Berria Bike S.L. Spain (‘Berria Bike’) and Nextbike GmbH, Germany (‘Nextbike’) respectively, in order to identify the imports of essential bicycle parts declared for free circulation and subject to the suspension of the payment of the extended duty. |
|
(34) |
On 25 March 2022 the Commission received from Berria Bike a request to withdraw the application for an exemption while the examination of its merits was ongoing and the payment of the extended duty was suspended. |
|
(35) |
The Commission accepted the withdrawal and consequently the suspension of the payment of the extended duty should be lifted. The extended duty should be collected as from the date of receipt of the request for exemption submitted by Berria Bike, namely the date on which the suspension took effect, that is 27 July 2020. |
|
(36) |
On 30 March 2022 the Commission received from Berria Bike a new request for exemption with the information required to determine whether this request was admissible in accordance with Article 4(1) of the exemption Regulation. |
|
(37) |
In accordance with Article 5(1) of the exemption Regulation, pending a decision on the merits of the new request, the payment of the extended duty in respect of any imports of essential bicycle parts declared for free circulation by Berria Bike was suspended as from the day on which the Commission received its new duly substantiated request for exemption pursuant to Article 4(1) and (2) of Regulation (EC) No 88/97, that is 30 March 2022. |
|
(38) |
Accordingly, pending a decision on the merits of the latest exemption request, the new date on which the suspension of the extended duty took effect should be changed to 30 March 2022. |
|
(39) |
On 5 May 2022 the Commission received from Nextbike a request to withdraw the application for an exemption while the examination of its merits was ongoing and the payment of the extended duty was suspended. |
|
(40) |
The Commission accepted the withdrawal and consequently the suspension of the payment of the extended duty should be lifted. The extended duty should be collected as from the date of receipt of the request for exemption submitted by Nextbike, namely the date on which the suspension took effect, that is 25 November 2020. |
|
(41) |
The parties listed in Table 4 were informed of the Commission’s conclusions and were given an opportunity to comment thereon. No comments were received, |
HAS ADOPTED THIS DECISION:
Article 1
The parties listed in the Table in this Article are hereby exempted from the extension by Council Regulation (EC) No 71/97 of the definitive anti-dumping duty on bicycles originating in the People’s Republic of China imposed by Council Regulation (EEC) No 2474/93 (9) to imports of certain bicycle parts from the People’s Republic of China.
In accordance with Article 7(2) of Regulation (EC) No 88/97 the exemption shall take effect as from the date of receipt of the parties’ request. This date is provided for in the Table column headed ‘Date of effect’.
The exemption shall apply only to the parties specifically referred to in the Table in this Article.
The exempted parties shall notify the Commission without delay of any change to their name and address, providing all relevant information, in particular on any modification in the party’ activities linked to assembly operations with regard to the conditions of exemption.

Article 2
The parties listed in the Table in this Article are under examination in accordance with Article 6 of Regulation (EC) No 88/97.
The suspensions of payment of the extended anti-dumping duty in accordance with Article 5 of Regulation (EC) No 88/97 shall be effective as from the dates of receipt of the parties’ respective supension requests. Those dates are provided for in the Table column headed ‘Date of effect’.
Those suspensions of payments shall apply only to the parties under examination specifically referred to in the Table in this Article.
The parties under examination shall notify the Commission without delay of any changes in their assembly operations linked to the conditions of suspension and provide the Commission with all relevant information as evidence. These changes include but are not limited to, any changes of the parties’ names, activities, legal forms, addresses.

The suspension of the payment of the extended anti-dumping duty pursuant to Article 5 of Regulation (EC) No 88/97 is hereby lifted during the period 27 July 2020 to 29 March 2022 for the party listed in the Table in this Article under TARIC additional code C557.
The extended duty shall be collected as from 27 July 2020 to 29 March 2022.

on the requirements for the means of audio and video communication for the interview pursuant to Article 27(5) of Regulation (EU) 2018/1240 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/1240 of the European Parliament and of the Council of 12 September 2018 establishing a European Travel Information and Authorisation System (ETIAS) and amending Regulations (EU) No 1077/2011, (EU) No 515/2014, (EU) 2016/399, (EU) 2016/1624 and (EU) 2017/2226 (1), and in particular Article 27(5) thereof,
Whereas:

(1) |
Regulation (EU) 2018/1240 established a European Travel Information and Authorisation System (ETIAS) as a system for third-country nationals exempt from the requirement to be in possession of a visa when crossing the external borders. It has laid down the conditions and procedures to issue or refuse a travel authorisation. |
|
(2) |
The ETIAS National Unit of the Member State responsible, when examining and deciding on applications for travel authorisations, may under certain conditions invite the applicant to an interview in his or her country of residence. In principle, this interview should take place at its consulate located the nearest to the place of residence of the applicant. |
|
(3) |
Audio and video communication should facilitate the application procedure taking into account recent technological developments, providing different ways to conduct a remote interview. Therefore, it is necessary to define the requirements for the remote audio and video means of communication. These requirements should include rules on data protection, security and confidentiality. It is also necessary to adopt rules on the testing, selection and operation of the tools. |

Concerning the handling of personal data this decision refers to Regulation (EU) 2016/679 of the European Parliament and of the Council (2). In this context, where the interview is recorded, the applicant shall be notified about the recording and consent to the recording before the start of the interview. |

(5) |
Given that Regulation (EU) 2018/1240 builds upon the Schengen acquis, in accordance with Article 4 of Protocol No 22 on the position of Denmark, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, Denmark notified the implementation of Regulation (EU) 2018/1240 in its national law. Denmark is therefore bound by this Decision. |

This Decision constitutes a development of the provisions of the Schengen acquis in which Ireland does not take part (3); Ireland is therefore not taking part in the adoption of this Decision and is not bound by it or subject to its application. |

(7) |
As regards Iceland and Norway, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the association of those two states with the implementation, application and development of the Schengen acquis (4), which fall within the area referred to in Article 1, point A of Council Decision 1999/437/EC (5). |

As regards Switzerland, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (6), which fall within the area referred to in Article 1, point A of Decision 1999/437/EC, read in conjunction with Article 3 of Council Decision 2008/146/EC (7). |

As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (8) which fall within the area referred to in Article 1, point A of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2011/350/EU (9). |

This Decision constitutes an act building upon, or otherwise relating to, the Schengen acquis within, respectively, the meaning of Article 3(1) of the 2003 Act of Accession, Article 4(1) of the 2005 Act of Accession and Article 4(1) of the 2011 Act of Accession. |

HAS ADOPTED THIS DECISION:
Article 1
Requirements for the means of audio and video communication including as regards data protection, security and confidentiality
Requirements for the means of audio and video communication, including as regards data protection, security and confidentiality to interview an applicant pursuant to Article 27(4) of Regulation (EU) 2018/1240 are set out in this Decision and in the Annex.
Article 2
Testing of suitable tools
1. The European Union Agency for the Operational Management of Large-Scale IT Systems in the Area of Freedom, Security and Justice (eu-LISA) shall analyse descriptions of tools for audio and video communication available on the market, compare them to the requirements set out in the Annex and pre-select tools for audio and video communication whose descriptions meet the requirements.
2. eu-LISA shall, in cooperation with the national authorities, test the pre-selected tools for audio and video communication. The tests shall, as far as possible, take into consideration the requirements set out in the Annex.
3. eu-LISA shall analyse the results of the tests and provide to Member States a list of suitable tools which are recommended.
4. At the request of the Commission, eu-LISA shall reanalyse the description of tools available on the market, compare these with the requirements set out in the Annex and, where needed, test pre-selected tools for the purpose of recommending to Member States an updated list of suitable tools.
Article 3
Selection of suitable tools and their operation
1. The ETIAS National Units shall use:

(a) |
a tool selected from the list of suitable tools referred to in Article 2(3); |
|
(b) |
any other tool that meets the requirements set out in the Annex. |
Member States shall be responsible for the analysis whether the tools referred to in the first subparagraph, point (b), meet the requirements of the Annex and for their testing.
2. The ETIAS National Units shall be responsible for the monitoring of the operation of the tools and for ensuring that the tools meet the requirements set out in the Annex to this Decision and comply with Regulation (EU) 2016/679.
Article 4
Entry into force
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
