DECISION OF THE EEA JOINT COMMITTEE No 41/2022

of 23 February 2022

amending Annex V (Free movement of workers) and Annex VIII (Right of establishment) to the EEA Agreement [2022/1109]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2021/2288 of 21 December 2021 amending the Annex to Regulation (EU) 2021/953 of the European Parliament and of the Council as regards the acceptance period of vaccination certificates issued in the EU Digital COVID Certificate format indicating the completion of the primary vaccination series (1) is to be incorporated into the EEA Agreement.

(2)

Annexes V and VIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is added in point 10 (Regulation (EU) 2021/953 of the European Parliament and of the Council) of Annex V to the EEA Agreement:

 

‘, as amended by:

32021 R 2288: Commission Delegated Regulation (EU) 2021/2288 of 21 December 2021 (OJ L 458, 22.12.2021, p. 459).’

Article 2

The following is added in point 11 (Regulation (EU) 2021/953 of the European Parliament and of the Council) of Annex VIII to the EEA Agreement:

 

‘, as amended by:

32021 R 2288: Commission Delegated Regulation (EU) 2021/2288 of 21 December 2021 (OJ L 458, 22.12.2021, p. 459).’

Article 3

The text of Delegated Regulation (EU) 2021/2288 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 4

This Decision shall enter into force on 23 February 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE No 42/2022

amending Annex V (Free movement of workers) and Annex VIII (Right of establishment) to the EEA Agreement [2022/1110]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2021/2301 of 21 December 2021 amending Implementing Decision (EU) 2021/1073 laying down technical specifications and rules for the implementation of the trust framework for the EU Digital COVID Certificate established by Regulation (EU) 2021/953 of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2)

Annexes V and VIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 10a (Commission Implementing Decision (EU) 2021/1073) of Annex V to the EEA Agreement:

Article 2

Commission Implementing Decision (EU) 2021/2057 of 24 November 2021 establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the Republic of Singapore to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Decision (EU) 2021/2113 of 30 November 2021 establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the Republic of El Salvador to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council (3) is to be incorporated into the EEA Agreement.

Annexes V and VIII to the EEA Agreement should therefore be amended accordingly,

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

Commission Implementing Decision (EU) 2021/2187 of 9 December 2021 establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the Republic of Lebanon to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision (EU) 2021/2188 of 9 December 2021 establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the United Arab Emirates to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

Commission Implementing Decision (EU) 2021/2189 of 9 December 2021 establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the Republic of Cabo Verde to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council (3) is to be incorporated into the EEA Agreement.

Annexes V and VIII to the EEA Agreement should therefore be amended accordingly,

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2021/1705 of 14 July 2021 amending Delegated Regulation (EU) 2020/692 supplementing Regulation (EU) 2016/429 of the European Parliament and the Council as regards rules for entry into the Union, and the movement and handling after entry of consignments of certain animals, germinal products and products of animal origin (1) is to be incorporated into the EEA Agreement.

(2)

Commission Delegated Regulation (EU) 2021/1706 of 14 July 2021 amending and correcting Delegated Regulation (EU) 2020/688 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council, as regards animal health requirements for movements within the Union of terrestrial animals and hatching eggs (2) is to be incorporated into the EEA Agreement.

(3)

This Decision concerns, inter alia, legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement.

(4)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(5)

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION

Article 1

Part 1.1 of Chapter I of Annex I to the EEA Agreement shall be amended as follows:

Commission Implementing Regulation (EU) 2021/1008 of 21 June 2021 amending Annex I to Implementing Regulation (EU) 2021/620 as regards the disease-free status of Croatia and a region of Portugal from infection with Brucella abortus, B. melitensis and B. suis in bovine animal populations, amending Annex VIII thereto as regards the disease-free status of Lithuania and certain regions of Germany, Italy and Portugal from infection with bluetongue virus (serotypes 1-24) and amending Annex XIII thereto as regards the disease-free status of Denmark and Finland from infectious haematopoietic necrosis (1) is to be incorporated into the EEA Agreement.

This Decision concerns legislation regarding, inter alia, live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement.

(3)

(2)

Commission Implementing Regulation (EU) 2020/1773 of 26 November 2020 amending Regulation (EC) No 429/2008 on detailed rules for the implementation of Regulation (EC) No 1831/2003 of the European Parliament and of the Council as regards the preparation and the presentation of applications and the assessment and the authorisation of feed additives (2) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2020/1823 of 2 December 2020 amending Regulation (EU) No 234/2011 implementing Regulation (EC) No 1331/2008 of the European Parliament and of the Council establishing a common authorisation procedure for food additives, food enzymes and food flavourings (3) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2020/1824 of 2 December 2020 amending Implementing Regulation (EU) 2017/2468 laying down administrative and scientific requirements concerning traditional foods from third countries in accordance with Regulation (EU) 2015/2283 of the European Parliament and of the Council on novel foods (4) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2021/148 of 8 February 2021 amending Regulation (EU) No 257/2010 setting up a programme for the re-evaluation of approved food additives in accordance with Regulation (EC) No 1333/2008 of the European Parliament and of the Council on food additives (5) is to be incorporated into the EEA Agreement.

(6)

Commission Implementing Regulation (EU) 2021/842 of 26 May 2021 amending Implementing Regulation (EU) No 307/2012 as regards transparency and confidentiality requirements for the EU risk assessment of substances under scrutiny (6) is to be incorporated into the EEA Agreement.

(7)

This Decision concerns legislation regarding feedingstuffs and foodstuffs. Legislation regarding feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC (1) is to be incorporated into the EEA Agreement.

(2)

Regulation (EU) 2018/858 repeals Directive 2007/46/EC of the European Parliament and of the Council (2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(3)

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex II to the EEA Agreement shall be amended as follows:

(1)

the following is inserted after point 50 (Regulation (EU) 2019/26 of the European Parliament and of the Council):

32018 R 0858: Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC (OJ L 151, 14.6.2018, p. 1).

The provisions of the Regulation shall, for the purposes of the EEA Agreement, be read with the following adaptations:

(a)

in Article 9(1) to (5), the words “the Commission” shall be replaced with the words “the EFTA Surveillance Authority” when the type-approval has been granted in one of the EFTA States;

(b)

the EFTA States shall participate in the Forum for Exchange of Information on Enforcement established in Article 11 and the Forum on Access to Vehicle Information established in Article 66;

(c)

in Article 15(2), the words “or the EFTA Surveillance Authority if the type-approval has been granted in one of the EFTA States” shall be added after the words “the Commission”;

(d)

notwithstanding the provisions of Protocol 1 to this Agreement, in Article 53(1)-(6) the words “or the EFTA Surveillance Authority with regard to the EFTA States”, shall be added after the words “the Commission”;

(e)

notwithstanding the provisions of Protocol 1 to this Agreement, in Article 54 the words “or the EFTA Surveillance Authority with regard to the EFTA States”, shall be added after the words “the Commission”;

(f)

notwithstanding the provisions of Protocol 1 to this Agreement, in Article 56(6), the words “or the EFTA Surveillance Authority with regard to the EFTA States”, shall be added after the words “the Commission”;

(g)

the following subparagraph shall be added to Article 85(1):

“The tasks in Article 85(1) shall for undertakings concerned in the EFTA States be carried out by the EFTA Surveillance Authority.”;

(h)

the following subparagraph shall be added to Article 85(4):

“For the EFTA States, the EFTA States shall determine the allocation of the amounts of the administrative fines.” ’;

(2)

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2022/1128]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2020/1255 of 7 September 2020 amending Regulation (EC) No 1881/2006 as regards maximum levels of polycyclic aromatic hydrocarbons (PAHs) in traditionally smoked meat and smoked meat products and traditionally smoked fish and smoked fishery products and establishing a maximum level of PAHs in powders of food of plant origin used for the preparation of beverages (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(3)

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Point 54zzzz (Commission Regulation (EC) No 1881/2006) of Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

The following indent is added:

‘-

2.

The text of adaptation (b) shall be replaced by the following:

The following shall be added to the list in paragraph 7 of Article 7:

Commission Regulation (EU) 2021/1317 of 9 August 2021 amending Regulation (EC) No 1881/2006 as regards maximum levels of lead in certain foodstuffs (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2022/1138]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2021/1398 of 4 June 2021 amending Delegated Regulation (EU) 2017/654 supplementing Regulation (EU) 2016/1628 of the European Parliament and of the Council with regard to the acceptance of approvals granted in accordance with Regulations Nos 49 and 96 of the Economic Commission for Europe of the United Nations (UNECE) (1) is to be incorporated into the EEA Agreement.

(2)

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 1f (Commission Delegated Regulation (EU) 2017/654) of Chapter XXIV of Annex II to the EEA Agreement:

Article 2

This Decision shall enter into force on 19 March 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*).

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2018/1793 of 20 November 2018 approving amendments to the technical file of a geographical indication for a spirit drink listed in Annex III to Regulation (EC) No 110/2008 resulting in changes to its main specifications (‘Ron de Guatemala’ (GI)) (1) is to be incorporated into the EEA Agreement.

(2)

Regulation (EU) 2019/787 of the European Parliament and of the Council of 17 April 2019 on the definition, description, presentation and labelling of spirit drinks, the use of the names of spirit drinks in the presentation and labelling of other foodstuffs, the protection of geographical indications for spirit drinks, the use of ethyl alcohol and distillates of agricultural origin in alcoholic beverages, and repealing Regulation (EC) No 110/2008 (2), as corrected by OJ L 316I, 6.12.2019, p. 3 and OJ L 178, 20.5.2021, p. 4, is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2019/1350 of 12 August 2019 registering a geographical indication of a spirit drink under Article 30(2) of Regulation (EU) 2019/787 of the European Parliament and of the Council (‘Absinthe de Pontarlier’) (3) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2020/623 of 30 April 2020 approving amendments to the specification for a spirit drink whose name is registered as a geographical indication (Ratafia de Champagne) (8) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2020/1286 of 9 September 2020 approving amendments to the specification for a spirit drink whose name is registered as a geographical indication (Scotch Whisky) (9) is to be incorporated into the EEA Agreement.

(10)

Commission Implementing Regulation (EU) 2020/1287 of 9 September 2020 approving amendments to the specification for a spirit drink whose name is registered as a geographical indication (Hierbas de Mallorca) (10) is to be incorporated into the EEA Agreement.

(11)

Commission Implementing Regulation (EU) 2020/2079 of 8 December 2020 approving amendments to the product specification for a spirit drink whose name is registered as a geographical indication (Münchener Kümmel) (11) is to be incorporated into the EEA Agreement.

(12)

Regulation (EU) 2019/787 repeals Regulation (EC) No 110/2008 of the European Parliament and of the Council (12), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(13)

Commission Regulations (EU) No 164/2012 (13), (EU) No 1065/2013 (14), (EU) No 97/2014 (15), (EU) No 98/2014 (16), (EU) No 426/2014 (17), (EU) 2015/210 (18), (EU) 2016/235 (19), (EU) 2016/1067 (20), (EU) 2018/175 (21), (EU) 2018/1098 (22), (EU) 2018/1850 (23), (EU) 2018/1871 (24), (EU) 2019/335 (25) and (EU) 2019/674 (26), which are incorporated into the EEA Agreement, have become obsolete and are consequently repealed under the EEA Agreement.

This Decision concerns legislation regarding spirit drinks. Legislation regarding spirit drinks shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XXVII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XXVII of Annex II to the EEA Agreement shall be amended as follows:

(1)

The text of point 9 (Regulation (EC) No 110/2008 of the European Parliament and of the Council) is replaced by the following:

32019 R 0787: Regulation (EU) 2019/787 of the European Parliament and of the Council of 17 April 2019 on the definition, description, presentation and labelling of spirit drinks, the use of the names of spirit drinks in the presentation and labelling of other foodstuffs, the protection of geographical indications for spirit drinks, the use of ethyl alcohol and distillates of agricultural origin in alcoholic beverages, and repealing Regulation (EC) No 110/2008 (OJ L 130, 17.5.2019, p. 1), as corrected by OJ L 316I, 6.12.2019, p. 3 and OJ L 178, 20.5.2021, p. 4.

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

(a)

The provisions of the Regulation shall not prejudice the right of the EFTA States to prohibit, on a non-discriminatory basis, the placing on their national market of spirit drinks for direct human consumption which exceed an alcoholic strength of 60%.

(b)

The EFTA States shall be invited to send observers to the meetings of the Committee for Spirit Drinks, as referred to in Article 47, dealing with matters which fall within acts referred to in the Agreement. The representatives of the EFTA States shall participate fully in the work of the Committee, but shall not have the right to vote.

(c)

Paragraph 4(d) of Protocol 1 to the Agreement shall not apply to Chapter III of the Regulation.’

(2)

Directive (EU) 2019/2162 of the European Parliament and of the Council of 27 November 2019 on the issue of covered bonds and covered bond public supervision and amending Directives 2009/65/EC and 2014/59/EU (2) is to be incorporated into the EEA Agreement.

(3)

Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

The following indent is added in point 14a (Regulation (EU) No 575/2013 of the European Parliament and of the Council):

The provisions of the Directive shall, for the purposes of the Agreement, be read with the following adaptations:

(a)

As regards the EFTA States, the words “Union legal acts” in Article 16(4) and the words “Union law” in Article 25(1) shall read “provisions of the EEA Agreement”.

(b)

In Article 30, as regards the EFTA States, the words “8 July 2022” shall read “the date referred to in the second subparagraph of Article 32(1)”.

(c)

As regards the EFTA States, the first and second subparagraphs of Article 32(1) shall read as follows:

“1.

The EFTA States shall adopt and publish, by 8 January 2023, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall immediately inform the EFTA Surveillance Authority thereof.

They shall apply those measures at the latest from 8 July 2022 or from a date designated under national law no later than six months thereafter.”.’

Article 2

The texts of Regulation (EU) 2019/2160 and Directive (EU) 2019/2162 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on the day following the last notification under Article 103(1) of the EEA Agreement (*).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE No 86/2022

of 18 March 2022

amending Annex XX (Environment) to the EEA Agreement [2022/1154]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Decision (EU) 2019/1597 of 3 May 2019 supplementing Directive 2008/98/EC of the European Parliament and of the Council as regards a common methodology and minimum quality requirements for the uniform measurement of levels of food waste (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision (EU) 2019/2000 of 28 November 2019 laying down a format for reporting of data on food waste and for submission of the quality check report in accordance with Directive 2008/98/EC of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

(3)

By virtue of Decision of the EEA Joint Committee No 318/2021 of 29 October 2021, Article 9(5) and (8) of Directive 2008/98/EC does not apply to Liechtenstein.

(4)

Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 32fff (Commission Implementing Decision (EU) 2019/1004) of Annex XX to the EEA Agreement:

32019 D 1597: Commission Delegated Decision (EU) 2019/1597 of 3 May 2019 supplementing Directive 2008/98/EC of the European Parliament and of the Council as regards a common methodology and minimum quality requirements for the uniform measurement of levels of food waste (OJ L 248, 27.9.2019, p. 77).

Article 2

The texts of Delegated Decision (EU) 2019/1597 and Implementing Decision (EU) 2019/2000 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 19 March 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*), or on the day of the entry into force of Decision of the EEA Joint Committee No 318/2021 of 29 October 2021 (3), whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

Commission Implementing Decision (EU) 2021/19 of 18 December 2020 laying down a common methodology and a format for reporting on reuse in accordance with Directive 2008/98/EC of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2)

By virtue of Decision of the EEA Joint Committee No 318/2021 of 29 October 2021, Article 9 (4), (5), (7) and (8) and Article 37 (3) of Directive 2008/98/EC does not apply to Liechtenstein.

(3)

Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following point is inserted after point 32ffh (Commission Implementing Decision (EU) 2019/2000) of Annex XX to the EEA Agreement:

‘32ffi.

32021 D 0019: Commission Implementing Decision (EU) 2021/19 of 18 December 2020 laying down a common methodology and a format for reporting on reuse in accordance with Directive 2008/98/EC of the European Parliament and of the Council (OJ L 10, 12.1.2021, p. 1).’.

Article 2

The text of Implementing Decision (EU) 2021/19 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 19 March 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*), or on the day of the entry into force of Decision of the EEA Joint Committee No 318/2021 of 29 October 2021 (2), whichever is the later.

Article 4

Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 32fhd (Commission Implementing Decision (EU) 2016/2323) of Annex XX to the EEA Agreement:

Article 2
