COMMISSION IMPLEMENTING REGULATION (EU) 2022/917

of 13 June 2022

amending Annex I to Implementing Regulation (EU) 2021/605 laying down special control measures for African swine fever

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,

Whereas:

(1)

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries.

(2)

Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex.

(3)

The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Commission Implementing Regulation (EU) 2022/889 (3) following changes in the epidemiological situation as regards that disease in Italy.

(4)

Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health and justifications for zoning provided by the competent authorities of the Member States concerned.

(5)

There have been new outbreaks of African swine fever in wild porcine animals in Germany and Poland, as well as in kept porcine animals in Poland. In addition, the epidemiological situation in certain zones listed as restricted zones II and III in Poland has improved as regard kept porcine animals, due to the disease control measures being applied by that Member State in accordance with Union legislation.

(6)

In May and June2022, several outbreaks of African swine fever in wild porcine animals were observed in the state of Saxony in Germany in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to an area in the state of Brandenburg in Germany currently listed as restricted zone I thereof. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area in the state of Brandenburg currently listed as restricted zone I in that Annex, that is in close proximity to the area listed in restricted zone II in the state of Saxony affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks.

(7)

Also, in May and June 2022, several outbreaks of African swine fever in wild porcine animals were observed in the state of Saxony in Germany in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to areas currently listed as restricted zones I thereof. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area currently listed as restricted zone I in that Annex, that is in close proximity to the area listed in restricted zone II in the state of Saxony affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks.

(8)

Further, in June 2022, one outbreak of African swine fever in a wild porcine animal was observed in the Dolnośląskie region in Poland in an area currently not listed as restricted zone in Annex I to Implementing Regulation (EU) 2021/605. This new outbreak of African swine fever in a wild porcine animal constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently not listed as restricted zone in that Annex, affected by this recent outbreak of African swine fever, should now be listed as restricted zone II in that Annex and the current boundaries of restricted zone I also need to be redefined to take account of this recent outbreak.

(9)

Additionally, in June 2022, one outbreak of African swine fever in a wild porcine animal was observed in the Wielkopolskie region in Poland in an area currently listed as restricted zone I in Annex I to Implementing Regulation (EU) 2021/605. This new outbreak of African swine fever in a wild porcine animal constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently listed as restricted zone I in that Annex, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of this recent outbreak.

(10)

In addition, in June 2022, two outbreaks of African swine fever in kept porcine animals were observed in the Wielkopolskie region in Poland in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605. Those new outbreaks of African swine fever in kept porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently listed as restricted zone II in that Annex, should now be listed as restricted zone III in that Annex instead of as restricted zone II thereof and the current boundaries of restricted zone II also need to be redefined to take account of those recent outbreaks.

(11)

Following those recent outbreaks of African swine fever in wild porcine animals in Germany and Poland, as well as in kept porcine animals in Poland and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in those Member States has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605.

(12)

Also, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in the restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 64, 65 and 67 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in Warmińsko - Mazurskie and Lubuskie regions in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zones III for the past twelve months. The restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation.

(13)

Finally, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in the restricted zone II listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 64, 65 and 67 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in Wielkopolskie, region in Poland, currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zone I in that Annex, due to the absence of African swine fever outbreaks in kept and wild porcine animals in those restricted zone II for the past twelve months. The restricted zone II should now be listed as restricted zone I taking account of the current African swine fever epidemiological situation.

(14)

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new restricted zones of a sufficient size should be demarcated for Germany and Poland and duly listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the situation in the surrounding areas.

(15)

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible.

(16)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

COMMISSION IMPLEMENTING DECISION (EU) 2022/919

of 8 June 2022

amending Commission Decision 2005/381/EC as regards the questionnaire for reporting on the application of Directive 2003/87/EC of the European Parliament and of the Council

(notified under document C(2022) 3604)

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a system for greenhouse gas emission allowance trading within the Union and amending Council Directive 96/61/EC (1), and in particular Article 21(1) thereof,

Whereas:

(1)

Article 21(1) of Directive 2003/87/EC requires Member States to submit annual reports to the Commission on the application of that Directive.

(2)

Commission Decision 2005/381/EC (2) sets out in its Annex a questionnaire to be used by the Member States for the drawing up of annual reports aimed at establishing a detailed account of the application of Directive 2003/87/EC.

(3)

Directive (EU) 2018/410 of the European Parliament and of the Council (3) amended Directive 2003/87/EC so as to reflect the commitment that the European Council took in 2014 to reduce the overall greenhouse gas emissions of the Union by at least 40 % below 1990 levels by 2030.

(4)

In order to implement the amendments of Directive (EU) 2018/410, Commission Implementing Regulation (EU) 2018/2066 (4) laid down revised rules for the monitoring and reporting of greenhouse gas emissions and activity data pursuant to Directive 2003/87/EC in the trading period of the Union emissions trading system commencing on 1 January 2021 and subsequent trading periods. In addition, Commission Implementing Regulation (EU) 2018/2067 (5) laid down revised provisions for the verification of reports submitted pursuant to Directive 2003/87/EC and for the accreditation and supervision of verifiers. That Implementing Regulation also laid down provisions for the mutual recognition of verifiers and peer evaluation of national accreditation bodies pursuant to Article 15 of Directive 2003/87/EC. Implementing Regulation (EU) 2018/2067 applies to the verification of greenhouse gas emissions and tonne-kilometre data from 1 January 2019 and to the verification of data relevant for the update of ex ante benchmarks and for the determination of free allocation to installations.

(5)

Moreover, the rules for the free allocation of emission allowances were updated by Commission Delegated Regulation (EU) 2019/331 (6) and Commission Implementing Regulation (EU) 2019/1842 (7).

(6)

It is therefore necessary to reflect in Decision 2005/381/EC the amendments to Directive 2003/87/EC and to the related implementing and delegated acts. Moreover, further experience gained by the Member States and the Commission in using the questionnaire has shown the need to improve the efficiency of the reporting and the coherence of the information reported.

(7)

Decision 2005/381/EC should therefore be amended accordingly.

(8)

The measures provided for in this Decision are in accordance with the opinion of the Climate Change Committee,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 2005/381/EC is replaced by the text set out in the Annex to this Decision.

COMMISSION IMPLEMENTING DECISION (EU) 2022/920

of 13 June 2022

concerning certain emergency measures relating to African swine fever in Italy

(notified under document C(2022) 4094)

(Only the Italian text is authentic)

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(2) thereof,

Whereas:

(1)

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries.

(2)

In the event of an outbreak of African swine fever in wild porcine animals, there is a serious risk of the spread of that disease to other wild porcine animals and to establishments of kept porcine animals.

(3)

Commission Delegated Regulation (EU) 2020/687 (2) supplements the rules for the control of the listed diseases referred to in Article 9(1), points (a), (b) and (c) of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882 (3). In particular, Articles 63 to 66 of Delegated Regulation (EU) 2020/687 provide for certain measures to be taken in the event of an official confirmation of an outbreak of a category A disease in wild animals, including African swine fever in wild porcine animals. Notably, those provisions provide for the establishment of an infected zone and prohibitions on movements of wild animals of listed species and products of animal origin thereof.

(4)

Commission Implementing Regulation (EU) 2021/605 (4) lays down special disease control measures regarding African swine fever. In particular, in the event of an outbreak of that disease in wild porcine animals in an area of a Member State, Article 3, point (b), of that Implementing Regulation provides for the establishment of an infected zone in accordance with Article 63 of Delegated Regulation (EU) 2020/687. In addition, Article 6 of that Implementing Regulation provides that that area is to be listed as a restricted zone II in Part II of Annex I thereto and that the infected zone, established in accordance with Article 63 of Delegated Regulation (EU) 2020/687, is to be adjusted without delay to comprise at least the restricted zone II. The special control measures for African swine fever laid down in Implementing Regulation (EU) 2021/605 include, inter alia, prohibitions on movements of consignments of porcine animals kept in restricted zones II and products thereof outside those restricted zones.

(5)

Following an outbreak of African swine fever in a wild porcine animal in the Rieti Province, in the Lazio Region in Italy, that Member State informed the Commission of the African swine fever situation in its territory, and, in accordance with Delegated Regulation (EU) 2020/687 and Implementing Regulation (EU) 2021/605, it established an infected zone.

(6)

Commission Implementing Decision (EU) 2022/875 (5) was adopted following the information received from that Member State concerning that outbreak.

(7)

Since the date of adoption of Commission Implementing Decision (EU) 2022/717 (6), the epidemiological situation in Italy has not evolved with respect to African swine fever in the Rieti Province, in the Lazio Region, and accordingly Italy has implemented the required control measures and it has collected additional surveillance data.

(8)

In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, it is necessary to identify at Union level the infected zone for African swine fever in Italy in collaboration with that Member State. This infected zone takes account of the current epidemiological situation in Italy.

(9)

In order to prevent the further spread of African swine fever, pending the listing of the area of Italy affected by the recent outbreak as a restricted zone II in Part II of Annex I to Implementing Regulation (EU) 2021/605, the special control measures for African swine fever laid down therein, that apply to movements of consignments of porcine animals kept in restricted zones II and products thereof outside those zones, should also apply to movements of those consignments from the infected zone established by Italy following that recent outbreak, in addition to the measures laid down in Articles 63 to 66 of Delegated Regulation (EU) 2020/687.

(10)

Accordingly, that infected zone should be listed in the Annex to this Decision and it should be subject to the special control measures for African swine fever that apply to restricted zones II laid down in Regulation (EU) 2021/605. However, due to this new epidemiological situation of African swine fever and taking account of the increased immediate risk of the further spread of the disease, movements of consignments of kept porcine animals and products thereof to other Member States and to third countries should not be authorised from the infected zone in accordance with that Implementing Regulation. The duration of that zoning should be also laid down in this Decision.

(11)

Therefore, in order to mitigate the risks arising from the recent outbreak of African swine fever in wild porcine animals in Italy, this Decision should provide that the movements to other Member States and third countries of consignments of porcine animals kept in the infected zone and products thereof should not be authorised by Italy until the expiry date of this Decision.

(12)

Accordingly, the infected zone in Italy should be established immediately and listed in the Annex to this Decision and the duration of that zoning fixed.

(13)

In addition, Implementing Decision (EU) 2022/875 should be repealed and replaced by this Decision.

(14)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

Italy shall ensure that an infected zone for African swine fever is established immediately by the competent authority of that Member State in accordance with Article 63 of Delegated Regulation (EU) 2020/687 and Article 3, point (b) of Implementing Regulation (EU) 2021/605, and that it comprises at least the areas listed in the Annex to this Decision.

Article 2

Italy shall ensure that the special control measures for African swine fever applicable to restricted zones II laid down in Implementing Regulation (EU) 2021/605 apply in the areas listed as an infected zone in the Annex to this Decision, in addition to the measures laid down in Articles 63 to 66 of Delegated Regulation (EU) 2020/687.

Article 3

Italy shall ensure that consignments of porcine animals kept in the areas listed as an infected zone in the Annex and products thereof are not authorised for movements to other Member States and to third countries.

Article 4

Implementing Decision (EU) 2022/875 is repealed.

Article 5

This Decision shall apply until 31 August 2022.

Article 6

This Decision is addressed to the Italian Republic.

In addition, Article 21(1) of that Delegated Regulation provides that the restricted zone is to comprise a protection zone, a surveillance zone, and if necessary further restricted zones around or adjacent to the protection and surveillance zones.

(4)

Commission Implementing Regulation (EU) 2021/605 (4) lays down special disease control measures regarding African swine fever. In particular, Article 3, point (a), of that Implementing Regulation provides for the establishment of a restricted zone in the case of an outbreak of African swine fever in kept porcine animals, in accordance with Article 21(1) of Delegated Regulation (EU) 2020/687.

(5)

Germany has informed the Commission of the current African swine fever situation on its territory, following an outbreak of that disease in kept porcine animals in the state of Baden-Württemberg confirmed on 25 May 2022, and, in accordance with Delegated Regulation (EU) 2020/687 and Implementing Regulation (EU) 2021/605, it has established a restricted zone, which comprises protection and surveillance zones, where the general disease control measures laid down in Delegated Regulation (EU) 2020/687 are applied, in order to prevent the further spread of that disease.

(6)

Commission Implementing Decision (EU) 2022/857 (5) was adopted following the information received from that Member State concerning that outbreak.

(7)

Since the date of adoption of Implementing Decision (EU) 2022/857, the epidemiological situation in Germany has not evolved with respect to African swine fever in the state of Baden-Württemberg, and accordingly Germany has implemented the required control measures and it has collected additional surveillance data.

(8)

Accordingly, the areas identified as protection and surveillance zones in Germany should be set out in the Annex to this Decision and the duration of that regionalisation fixed.

(9)

In addition, Implementing Decision (EU) 2022/857 should be repealed and replaced by this Decision.

(10)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed.

HAS ADOPTED THIS DECISION:

(b)

the protection and surveillance zones referred to in paragraph (a) comprise at least the areas listed in the Annex to this Implementing Decision.
