COMMISSION IMPLEMENTING REGULATION (EU) 2022/702
of 5 May 2022
concerning the authorisation of great mullein tincture as a feed additive for certain animal species

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 9(2) thereof,
Whereas:

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such an authorisation. |
(2) |
In accordance with Article 7 of Regulation (EC) No 1831/2003 an application was submitted for the authorisation of great mullein tincture. That application was accompanied by the particulars and documents required under Article 7(3) of Regulation (EC) No 1831/2003. |
(3) |
The application concerns the authorisation of great mullein tincture as a feed additive for all animal species, to be classified in the category ‘sensory additives’ and in the functional group ‘flavouring compounds’. |
(4) |
The applicant requested great mullein tincture to be authorised also for use in water for drinking. However, Regulation (EC) No 1831/2003 does not allow the authorisation of ‘flavouring compounds’ for use in water for drinking. Therefore, the use of great mullein tincture in water for drinking should not be allowed. |

The European Food Safety Authority (‘the Authority’) concluded in its opinions of 12 November 2019 (2) and 24 June 2021 (3) that, under the proposed conditions of use, great mullein tincture does not have adverse effects on animal health, consumer health or the environment. However, no conclusions could be drawn for long-living animals (pets and other non-food producing animals, horses and animals for reproduction). The Authority also concluded that in the absence of data, great mullein tincture should be considered as a dermal/eye irritant or a skin sensitiser. Therefore, the Commission considers that appropriate protective measures should be taken to prevent adverse effects on human health, in particular as regards the users of the additive. |

The Authority further concluded, that great mullein tincture is recognised to flavour food and its function in feed would be essentially the same as that in food, therefore, no further demonstration of efficacy is considered necessary. It also verified the report on the methods of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |

The assessment of great mullein tincture shows that the conditions for authorisation, as provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. Accordingly, the use of the substance should be authorised as specified in the Annex to this Regulation. |
(8) |
The fact that great mullein tincture is not authorised for use as a flavouring in water for drinking, does not preclude its use in compound feed which is administered via water. |
(9) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
The substance specified in the Annex, belonging to the additive category ‘sensory additives’ and to the functional group ‘flavouring compounds’, is authorised as an additive in animal nutrition, subject to the conditions laid down in that Annex.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

concerning the renewal of the authorisation of a preparation of Bacillus velezensis DSM 15544 as a feed additive for weaned piglets, the authorisation for all avian species and categories, amending Implementing Regulation (EU) 2016/897, Implementing Regulation (EU) 2017/2312 and Implementing Regulation (EU) 2018/1081 and repealing Regulation (EU) No 333/2010, Regulation (EU) No 184/2011 and Implementing Regulation (EU) 2019/893 (holder of the authorisation: Asahi Biocycle Co. Ltd., represented in the Union by Pen & Tec Consulting S.L.U.)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 9(2) thereof,
Whereas:

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting and renewing such an authorisation. |
(2) |
A preparation of Bacillus velezensis DSM 15544, previously taxonomically identified as Bacillus subtilis C-3102 (DSM 15544), was authorised for 10 years as a feed additive for weaned piglets by Commission Regulation (EU) No 333/2010 (2), for chickens reared for laying, turkeys, minor avian species and other ornamental and game birds by Commission Regulation (EU) No 184/2011 (3), for laying hens and ornamental fish by Commission Implementing Regulation (EU) 2016/897 (4), for sows, suckling piglets and dogs by Commission Implementing Regulation (EU) 2017/2312 (5), for pigs for fattening by Commission Implementing Regulation (EU) 2018/1081 (6) and for chickens for fattening by Commission Implementing Regulation (EU) 2019/893 (7). |

The authorisation of the preparation of Bacillus velezensis DSM 15544 for chickens reared for laying, turkeys, minor avian species and other ornamental and game birds expired on 18 March 2021. |
(4) |
In accordance with Article 13(3) and Article 14(1) of Regulation (EC) No 1831/2003, in conjunction with Article 7 thereof, two applications were submitted for the renewal of the authorisation of a preparation of Bacillus velezensis DSM 15544 as a feed additive for weaned piglets, for a new authorisation for chickens reared for laying and for breeding, turkeys for rearing, fattening, breeding and laying, minor poultry species and all other avian species for rearing, fattening, laying and breeding, requesting the additive to be classified in the additive category ‘zootechnical additives’ and for the modification of the terms of the authorisation. The modification relates to change of the name of the additive. The applications were accompanied by the particulars and documents required under Articles 7(3), 13(3) and 14(2) of that Regulation. |

The European Food Safety Authority (‘the Authority’) concluded in its opinions of 30 September 2020 (8) and 29 September 2021 (9) that the applicant has provided data demonstrating that the preparation of Bacillus velezensis DSM 15544 complies with the existing conditions of authorisation under the proposed conditions of use. The Authority concluded that the preparation of Bacillus velezensis DSM 15544 does not have an adverse effect on animal health, consumer safety or the environment. It also stated that the preparation is not a dermal/eye irritant or a skin sensitiser but should be considered a respiratory sensitiser. Therefore, the Commission considers that appropriate protective measures should be taken to prevent adverse effects on human health, in particular as regards users of the additive. The Authority also concluded that the additive should be taxonomically designated as Bacillus velezensis DSM 15544 and that the preparation has the potential to be efficacious as a zootechnical additive in feedingstuffs. The Authority does not consider that there is a need for specific requirements of post-market monitoring. The Authority also verified the report on the methods of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |

On 2 December 2020, the applicant, represented in the Union by Pen & Tec Consulting S.L.U., submitted relevant supporting data concerning a change of the name of the holder of authorisation in accordance with Article 13(3) of Regulation (EC) No 1831/2003. The applicant claimed that the current name of the company, holder of the authorisation, has been changed to ‘Asahi Biocycle Co. Ltd.’. |

That proposed change of the terms of the authorisation is purely administrative in nature and does not entail a fresh assessment of the additive concerned. The Authority was informed of the application. |
(8) |
Implementing Regulation (EU) 2016/897, Implementing Regulation (EU) 2017/2312 and Implementing Regulation (EU) 2018/1081 should therefore be amended accordingly. |
(9) |
The assessment of the preparation of Bacillus velezensis DSM 15544 shows that the conditions for authorisation, as provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. Accordingly, the authorisation of that additive should be renewed as specified in the Annex to this Regulation. |
(10) |
As a consequence of the renewal of the authorisation of a preparation of Bacillus velezensis DSM 15544 as a feed additive under the conditions laid down in the Annex to this Regulation, Regulation (EU) No 333/2010, and Regulation (EU) No 184/2011 should be repealed. |
(11) |
Since safety reasons do not require the immediate application of the modifications to the conditions of authorisation of the preparation of Bacillus velezensis DSM 15544, it is appropriate to allow a transitional period for interested parties to prepare themselves to meet the new requirements resulting from the renewal of the authorisation. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Renewal of the authorisation
The authorisation of the additive specified in the Annex, belonging to the additive category ‘zootechnical additives’ and to the functional group ‘gut flora stabilisers’, is renewed subject to the conditions laid down in that Annex.

Amendments to Implementing Regulation (EU) 2016/897
Implementing Regulation (EU) 2016/897 is amended as follows:

Article 5
Transitional period
1. The additive specified in the Annex to this Regulation, as well as in Implementing Regulation (EU) 2016/897, in Implementing Regulation (EU) 2017/2312, in Implementing Regulation (EU) 2018/1081 and in Implementing Regulation (EU) 2019/893, and premixtures containing it, which are produced and labelled before 26 November 2022 in accordance with the rules applicable before 26 May 2022 may continue to be placed on the market and used until the existing stocks are exhausted.
2. Compound feed and feed materials containing the additive specified in the Annex to this Regulation, as well as in Implementing Regulation (EU) 2016/897, in Implementing Regulation (EU) 2017/2312, in Implementing Regulation (EU) 2018/1081 and in Implementing Regulation (EU) 2019/893, which are produced and labelled before 26 May 2023 in accordance with the rules applicable before 26 May 2022 may continue to be placed on the market and used until the existing stocks are exhausted if they are intended for food-producing animals.
3. Compound feed and feed materials containing the additive specified in the Annex to this Regulation, as well as in Implementing Regulation (EU) 2016/897and in Implementing Regulation (EU) 2017/2312 which are produced and labelled before 26 May 2024 in accordance with the rules applicable before 26 May 2022 may continue to be placed on the market and used until the existing stocks are exhausted if they are intended for non food-producing animals.
Article 6
Repeal
Regulation (EU) No 333/2010, Regulation (EU) No 184/2011 and Implementing Regulation (EU) 2019/893 are repealed.
Article 7
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending and correcting certain Annexes to Implementing Regulation (EU) 2021/404 as regards the entries for Canada, the United Kingdom and the United States in the lists of third countries authorised for the entry into the Union of consignments of poultry, germinal products of poultry and fresh meat of poultry and game birds

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Articles 230(1), 232(1) and 232(3) thereof.
Whereas:
(1) |
Regulation (EU) 2016/429 requires that consignments of animals, germinal products and products of animal origin must come from a third country or territory, or zone or compartment thereof, listed in accordance with Article 230(1) of that Regulation in order to enter the Union. |
(2) |
Commission Delegated Regulation (EU) 2020/692 (2) lays down the animal health requirements with which consignments of certain species and categories of animals, germinal products and products of animal origin from third countries or territories, or zones thereof, or compartments thereof, in the case of aquaculture animals, must comply with in order to enter the Union. |
(3) |
Commission Implementing Regulation (EU) 2021/404 (3) establishes the lists of third countries, or territories, or zones or compartments thereof, from which the entry into the Union of the species and categories of animals, germinal products and products of animal origin falling within the scope of Delegated Regulation (EU) 2020/692 is permitted. |
(4) |
More particularly, Annexes V and XIV to Implementing Regulation (EU) 2021/404 set out the lists of third countries, or territories, or zones thereof authorised for the entry into the Union, respectively, of consignments of poultry, germinal products of poultry, and of fresh meat from poultry and game birds. |

Canada notified the Commission of an outbreak of highly pathogenic avian influenza in poultry. The outbreak is located in the province of Alberta, Canada and was confirmed on 10 April 2022 by laboratory analysis (RT-PCR). |

Canada, the United Kingdom and the United States have submitted information to the Commission on the epidemiological situation on their territory and the measures they have taken to prevent the further spread of highly pathogenic avian influenza. That information has been evaluated by the Commission. On the basis of that evaluation and in order to protect the animal health status of the Union, the entry into the Union of consigments of poultry, germinal products of poultry, and fresh meat from poultry and game birds from the areas under restrictions established by the veterinary authorities of Canada, the United Kingdom and the United States due to the recent outbreaks of highly pathogenic avian influenza should no longer be authorised. |

Moreover, the United Kingdom has submitted updated information on the epidemiological situation on its territory in relation to fifteen outbreaks of HPAI confirmed in poultry establishments. The United Kingdom has also submitted the measures it has taken to prevent the further spread of that disease. In particular, following this outbreak of HPAI, the United Kingdom has implemented a stamping out policy in order to control and limit the spread of that disease. In addition, the United Kingdom completed the requisite cleaning and disinfection measures following the implementation of the stamping out policy on the infected poultry establishments on its territory. |
(27) |
The Commission has evaluated the information submitted by the United Kingdom and concluded that the fifteen HPAI outbreaks in poultry establishments for which the United Kingdom have submitted updated information have been cleared and that there is no longer any risk associated with the entry into the Union of poultry commodities from the zones of the United Kingdom from which the entry into the Union of poultry commodities have been suspended due to these outbreaks. |

Commission Implementing Regulation (EU) 2022/649 (4) amended the rows for zone GB-2.44 in the entry for the United Kingdom in Annex V and Annex XV to Implementing Regulation (EU) 2021/404. As an error has been detected, the rows for the zone GB-2.44 should be corrected accordingly. That correction should be applicable from the date of application of Implementing Regulation (EU) 2022/649. |

Annexes V and XIV to Implementing Regulation (EU) 2021/404 should be therefore amended accordingly. |

Taking into account the current epidemiological situation in Canada, the United Kingdom and the United States as regards highly pathogenic avian influenza and the serious risk of its introduction into the Union, the amendments to be made to Implementing Regulation (EU) 2021/404 by this Regulation should take effect as a matter of urgency. |

amending Annex I to Implementing Regulation (EU) 2021/605 laying down special control measures for African swine fever

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:
(1) |
African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
(2) |
Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex. |
(3) |
The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Commission Implementing Regulation (EU) 2022/587 (3) following changes in the epidemiological situation as regards that disease in Latvia and Poland. |

Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health and justifications for zoning provided by the competent authorities of the Member States concerned. |

Since the date of adoption of Implementing Regulation (EU) 2022/587 there have been new outbreaks of African swine fever in wild porcine animals in Germany and Slovakia. In addition, the epidemiological situation in certain zones listed as restricted zones III in Poland improved as regards kept and wild porcine animals, due to the disease control measures being applied by that Member State in accordance with Union legislation. |

In April 2022, several outbreaks of African swine fever in wild porcine animals were observed in the state of Mecklenburg-Western Pomerania in Germany in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to an area currently listed as restricted zone I thereof. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Germany currently listed as restricted zone I in that Annex, that is in close proximity to the area listed in restricted zone II affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks. |

Also, in April 2022, several outbreaks of African swine fever in wild porcine animals were observed in the Banská Bystrica region in Slovakia in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to an area currently listed as restricted zone I thereof. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Slovakia currently listed as restricted zone I in that Annex, that is in close proximity to the area listed in restricted zone II affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks. |

Following those recent outbreaks of African swine fever in wild porcine animals in Germany and Slovakia and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in those Member States has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605. |

Furthermore, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the Dolnośląskie and Lubuskie regions in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past three months. Those restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation. |

Moreover, taking into account the effectiveness of the disease control measures for African swine fever for kept and wild porcine animals in restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the Świętokrzyskie region in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones I in that Annex, due to the absence of African swine fever outbreaks in those restricted zones III in kept porcine animals for the past three months and in wild porcine animals for the past twelve months. Those restricted zones III should now be listed as restricted zones I taking account of the current African swine fever epidemiological situation. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new restricted zones of a sufficient size should be demarcated for Germany, Poland and Slovakia and duly listed as restricted zones I and II in Annex I to Implementing Regulation (EU) 2021/605. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the situation in the surrounding areas. |
(12) |
Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible. |

COMMISSION IMPLEMENTING DECISION (EU) 2022/706
of 5 May 2022
laying down rules for the application of Decision No 1313/2013/EU of the European Parliament and of the Council, as regards criteria and procedures for recognising long-standing commitment and extraordinary contributions to the Union Civil Protection Mechanism

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Decision No 1313/2013/EU of the European Parliament and of the Council of 17 December 2013 on a Union Civil Protection Mechanism (1), and in particular Article 32(1), point (hb) thereof,
Whereas:
(1) |
In order to recognise and honour long-standing commitment and extraordinary contributions to the Union Civil Protection Mechanism (‘the Union Mechanism’), Decision No 1313/2013/EU provides that the Commission may award medals to the relevant recipients. |
(2) |
In order to award such Union Mechanism medals (‘UCPM medals’), the Commission should lay down the criteria and procedures for recognising long-standing commitment and extraordinary contributions to the Union Mechanism. |
(3) |
Given the cross-sectoral approach of the assistance provided through the Union Mechanism, UCPM medals should be awarded to Union and third country citizens, including civil protection personnel, disaster management personnel, military personnel of Member States, or personnel of other relevant authorities or bodies for contributions rendered to the Union Mechanism. The UCPM medals can be awarded to natural persons or modules, including intervention teams, technical assistance and support teams (‘TAST’), and other response capacities registered in the Common Emergency Communication and Information System (‘CECIS’). |
(4) |
In order to cover the activities of the entire disaster management cycle, the material scope of recognising and honouring longstanding commitment and extraordinary contributions to the Union Mechanism should encompass prevention, preparedness and response actions. |
(5) |
In accordance with Article 20a(3) of Decision No 1313/2013/EU, the Commission should award two types of UCPM medals: a medal for long-standing commitment and a medal for extraordinary contribution. It is therefore necessary to define eligibility criteria for the award of each type of medal. |
(6) |
As UCPM medals were introduced in the Union Mechanism with Decision (EU) 2019/420 of the European Parliament and of the Council (2), the period to be taken into consideration for determining the eligibility of potential recipients of UCPM medals should be set taking into account the date of adoption thereof, which is 21 March 2019. |
(7) |
The Commission and Member States should be entitled to nominate potential recipients. In order to evaluate potential recipients, any such nominations should be assessed by an Award Board, which should consist of the Commission’s representatives. The Award Board should convene to make recommendations to the Commission to decide on the UCPM medals. |
(8) |
In order to pay homage to the recipients in an appropriate manner, UCPM medals should be awarded at a formal ceremony, such as the European Civil Protection Forum or other formal ceremonies on an ad-hoc basis. |
(9) |
In order to ensure inclusion and promote equality, gender balance and geographical distribution should be taken into account when deciding to award UCPM medals. |
(10) |
In order to ensure transparency, the Commission should maintain a register of awarded UCPM medals. |
(11) |
The measures provided for in this Decision are in accordance with the opinion of the Civil Protection Committee referred to in Article 33(1) of Decision No 1313/2013/EU, |
HAS ADOPTED THIS DECISION:
Article 1
Subject matter
This Decision sets out the criteria and procedures to award Union Civil Protection Mechanism medals (‘UCPM medals’) in order to recognise and honour longstanding commitment and extraordinary contributions to the Union Civil Protection Mechanism (‘Union Mechanism’).
Article 2
Definitions
For the purposes of this Decision, the following definitions shall apply:
(1) |
‘person of good character’ means a person who is clear of any previous criminal convictions; |
(2) |
‘outstanding bravery’ means exceptional courage or courageous endurance above expectations while that is shown in action; |
(3) |
‘extraordinary meritorious achievement’ means very high level of accomplishment, which is beyond what is ordinary or usual. |
Article 3
Types of UCPM medals
1. The Commission shall award the following two types of UCPM medals:
(a) |
medal for long-standing commitment; |
(b) |
medal for extraordinary contribution. |
2. Recipients of the medals shall not be entitled to any financial benefit.
3. The UCPM medals shall not be awarded more than once per type to the same natural person, modules, intervention teams, TAST and other response capacities. They may be awarded posthumously.
Article 4
Eligibility
1. UCPM medals may be awarded to the following natural persons for their contribution to the Union Mechanism:
(a) |
members of the civil protection and disaster management personnel of the Member States or of participating States to the Union Mechanism; |
(b) |
members of other authorities, entities or bodies contributing to the actions under the Union Mechanism; |
(c) |
Union citizens or third country citizens. |
Those natural persons shall be of good character.
2. UCPM medals may also be awarded to the following entities for their contribution to the Union Mechanism:
(a) |
modules established in accordance with Decision No 1313/2013/EU; |
(b) |
intervention teams as defined in Article 2(4) of Commission Implementing Decision 2014/762/EU (3); |
(c) |
technical assistance and support teams (‘TAST’) as defined in Article 2(5) of Implementing Decision 2014/762/EU; |
(d) |
other response capacities as referred to in Article 9(4) of Decision No 1313/2013/EU. |
Those entities shall be registered in the Common Emergency Communication and Information System (CECIS).
3. Union staff subject to Staff Regulations of Officials of the European Union and the Conditions of Employment of Other Servants of the Union, laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68 (4) shall not be eligible for the UCPM medals.
Article 5
Eligibility period
The eligibility period for awarding UCPM medals shall begin on 21 March 2019.
Article 6
Medal for long-standing commitment
The UCPM medal for long-standing commitment may be awarded to eligible recipients referred to in Article 4(1) and (2) who fulfil one of the following conditions:
(a) |
they have been deployed on at least three occasions in response operations under the Union Mechanism; |
(b) |
they have shown long-standing professional commitment to prevention or preparedness actions under the Union Mechanism. The periods of time dedicated by the eligible recipients concerned to such actions shall be taken as an acknowledgment of their commitment. |
Article 7
Medal for extraordinary contributions
The UCPM medal for extraordinary contribution may be awarded to eligible recipients referred to in Article 4(1) and (2) who fulfil one of the following conditions:
(a) |
they have demonstrated an act of outstanding bravery, an extraordinary meritorious achievement or an activity beyond what might reasonably be expected during a response operation under the Union Mechanism; |
(b) |
they have contributed an extraordinary meritorious achievement to the development of the Union Mechanism at large. |
Article 8
Nomination
1. The Commission and Member States may submit nominations to the Award Board for the award of:
(a) |
UCPM medals for long-standing commitment based on the criteria laid down in Article 6; |
(b) |
UCPM medals for extraordinary contribution based on the criteria laid down in Article 7. |
2. The Commission, through the Emergency Response Coordination Centre, shall regularly review nominations and report to the Award Board when the criteria referred to in Article 6 are fulfilled.
Article 9
Award Board and award decision
1. An Award Board shall be established to review the nominations submitted by the Commission or the Member States in accordance with Article 8 and make recommendations to the Commission with respect to the award the UCPM medals.
2. The Award Board shall consist of three representatives of the Commission.
3. The Commission shall convene the Award Board at least 1 month prior to the holding of any ceremony referred to in Article 11(1).
The Award Board shall take into account the gender balance and geographical distribution when deciding upon the award of the UCPM medals.
Article 10
Revoking and renouncing the awarded UCPM medals
1. The Commission shall revoke any of the UCPM medals awarded in the event of criminal conviction, or any action that is dishonourable or that may harm the interests of the Union.
2. The recipients shall reserve the right to renounce the awarded UCPM medal.
Article 11
Awards ceremony of UCPM medals
1. UCPM medals shall be awarded at the European Civil Protection Forum, or where appropriate, at formal ceremonies on an ad-hoc basis.
2. UCPM medals shall be handed over to the recipients or their representatives by a representative of the Commission.
3. Where the recipient of the UCPM medal is a module, intervention team, TAST or other response capacity, the UCPM medal shall be handed over to the team leader or their representative who receives it on behalf of the respective module, intervention team, TAST or other response capacity.
Article 12
Design and online public register
1. The Commission shall determine the design and model of the UCPM medals.
2. The Commission shall maintain an online public register of recipients of UCPM medals.
Article 13
Wearing of the UCPM medals
The wearing of the UCPM medals shall be governed by the relevant regulations of the recipient’s State.
Article 14
Addressees
This Decision is addressed to the Member States.

THE PARTNERSHIP COUNCIL,
Having regard to the Trade and Cooperation Agreement between the European Union and the European Atomic Energy Community, of the one part, and the United Kingdom of Great Britain and Northern Ireland, of the other part (the ‘Trade and Cooperation Agreement’), and in particular Article 14(1) thereof;
Whereas:

Article 14 provides that the Parties shall facilitate the organisation of a Civil Society Forum to conduct a dialogue on the implementation of Part Two. |
(2) |
The Partnership Council shall adopt operational guidelines for the conduct of the Forum. |
HAS ADOPTED THIS DECISION:
Article 1
The operational guidelines of the Trade and Cooperation Agreement’s Civil Society Forum, as set out in the Annex, are hereby adopted.
Article 2
This Decision shall enter into force on the date of its adoption.

Article 14(1) and Article 14(2) of the Trade and Cooperation Agreement between the European Union and the European Atomic Energy Community, of the one part, and the United Kingdom of Great Britain and Northern Ireland, of the other part (the ‘Trade and Cooperation Agreement’) provides that the Parties shall facilitate the organisation of a Civil Society Forum composed of representatives of the civil society of the European Union and the United Kingdom of Great Britain and Northern Ireland (the United Kingdom) that shall meet at least once a year, unless otherwise agreed by the Parties. The Trade and Cooperation Agreement further provides that the Partnership Council shall adopt the operational guidelines for the conduct of the Forum.
1. PARTICIPANTS
According to Article 14(3) of the Trade and Cooperation Agreement (1), the Civil Society Forum will gather representatives of the civil society of the European Union and the United Kingdom, namely representatives of business and employers’ organisations (but not individual private companies), trade unions, academia, and non-governmental organisations in different branches of society relevant to the areas covered by Part II of the Trade and Cooperation Agreement. The Parties will apply their respective rules and practices on the registration of civil society representatives in order to promote a balanced representation of civil society organisations.
For practical reasons, the number of physical participants in the Civil Society Forum will be limited to 60 representatives from Civil Society on each side, unless the Parties agree otherwise. Those representatives will be able to attend the Civil Society Forum meetings in person or by electronic means. The Parties may agree to hold the meeting entirely virtually in accordance with Article 14(2) of the Trade and Cooperation Agreement. The Civil Society Forum will be open to other members of civil society organisations, who register in advance, to observe.
2. SCOPE
The discussions of the Civil Society Forum will cover the areas in Part II of the Trade and Cooperation Agreement: trade, aviation, road transport, social security coordination and visas for short-term visits, fisheries and other provisions.
3. TIMING, ORGANISATION AND AGENDAS
The Trade and Cooperation Agreement establishes that the Civil Society Forum will meet at least once a year, unless otherwise agreed by the Parties. The Civil Society Forum will meet in close proximity to the meeting of the Trade Partnership Committee, unless otherwise agreed by the Parties. The co-chairs of the Trade Partnership Committee and Trade Specialised Committees and the co-chairs of the Specialised Committees on Energy, Air Transport, Aviation Safety, Road Transport, Social Security Coordination and Fisheries will be able to participate in the Forum when matters within their remit are discussed in the Forum.
The Civil Society Forum will be organised by the Party that is responsible for hosting the meeting of the Trade Partnership Committee, meaning that the location of the Forum will alternate between the European Union and the United Kingdom, unless otherwise agreed by the Parties. The Party hosting the Forum will provide the venue and facilitate the meeting (e.g. provide links for registration and virtual participation).
The Parties will endeavour to consult their respective Domestic Advisory Groups on possible agenda items before agreeing a draft agenda with the other party. The Parties will endeavour to publish the draft agendas 15 days before the date of the Civil Society Forum meeting.
The hosting Party will draft the results and conclusions of the Civil Society Forum in agreement with the other Party, within 30 days of the meeting. The results and conclusions of each of the meetings will be shared with the Partnership Council, Trade Partnership Committee and the Specialised Committees on Energy, Air Transport, Aviation Safety, Road Transport, Social Security Coordination, Fisheries and will be made publicly available.
In accordance with Article 14(1), second sentence of the Trade and Cooperation Agreement, the Partnership Council may amend the present guidelines, including to address issues arising during their implementation.
(1) The Civil Society Forum shall be open for the participation of independent civil society organisations established in the territories of the Parties, including members of the domestic advisory groups referred to in Article 13 of the Trade and Cooperation Agreement. Each Party shall promote a balanced representation, including non-governmental organisations, business and employers’ organisations and trade unions, active in economic, sustainable development, social, human rights, environmental and other matters.
