amending Annexes I and III to Delegated Regulation (EU) No 906/2014 supplementing Regulation (EU) No 1306/2013 of the European Parliament and of the Council as regards the calculation methods of public intervention expenditure

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy and repealing Council Regulations (EEC) No 352/78, (EC) No 165/94, (EC) No 2799/98, (EC) No 814/2000, (EC) No 1290/2005 and (EC) No 485/2008 (1), and in particular Article 20(2) and (3) thereof,
Whereas:

Commission Delegated Regulation (EU) No 906/2014 (2) lays down detailed rules applicable to public intervention expenditure under the European Agricultural Guarantee Fund (EAGF). The provisions of that Regulation need to be adapted in order to take into account that public intervention is used only occasionally. |

Part I of Annex I to Delegated Regulation (EU) No 906/2014 defines the applicable interest rates for the financing of public intervention expenditure under the EAGF. |
|
(3) |
In order to determine those interest rates, the Member States are to notify to the Commission the average interest rate they actually bore during a reference period. If a Member State did not bear any interest costs, because it did not have agricultural products in public storage, the Commission is to fix the reference interest rate based on average reference interest rates. For Member States that use the euro, the reference rate is the euro Interbank Offered Rate (EURIBOR). For Member States whose currency is not the euro, the reference rate is the Interbank Offered Rate (IBOR). |

Given the decreasing number of transactions underlying the EURIBOR, the euro short-term rate (€STR) should be provided as a fall-back rate for cases where the EURIBOR is not available. For Member States whose currency is not the euro, the possibility to use the fall-back rate replacing the national IBOR should also be provided. |

Currently, pursuant to the rules set out in Part I of Annex I to Delegated Regulation (EU) No 906/2014, the Commission is to adopt, for every accounting year, an implementing regulation fixing the interest rate, even if there is no change to the interest rate and even if there are no products in public storage. For reasons of simplification and resource efficiency, it is appropriate to provide that the Commission implementing regulation fixing the interest rate remains in force until its repeal. The Commission should thus update the interest rate only if a public storage intervention takes place or an intervention buying-in is expected to take place. |

Part I, point 4, of Annex III to Delegated Regulation (EU) No 906/2014 lays down the rules for establishing the applicable standard amounts for the Union when fewer than four Member States place a given product in public storage. However, it may occur that more than four Member States place a given product in public storage but fewer than four Member States notify their recorded costs. To avoid legal uncertainty in establishing the applicable standard amounts, a provision should be added for cases where fewer than four Member States notify their recorded costs. |

Part II, point 3, of Annex III to Delegated Regulation (EU) No 906/2014 provides that the Commission may roll over the standard amounts fixed previously for a product where there was no public storage, or there will be no public storage, for the current accounting year. For reasons of simplification and resource efficiency, the applicable standard amounts should not be fixed routinely every year. Instead, the Commission implementing decision fixing those standard amounts should remain applicable until it is repealed. |

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications (‘Raschera’ (PDO))
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,
Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Italy’s application for the approval of amendments to the specification for the protected designation of origin ‘Raschera’, registered under Commission Regulation (EC) No 1263/96 (2), as amended by Implementing Regulation (EU) No 1086/2013 (3). |
|

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (4) as required by Article 50(2)(a) of that Regulation. |
|

The Commission received a letter opposing to the approval of the amendment from a natural person resident in Italy on 19 February 2021. A second letter was then sent on 8 November 2021 by the same natural person enclosing additional elements against the amendment. |
|
(4) |
In accordance with Article 51(1), second subparagraph, of Regulation (EU) No 1151/2012, natural or legal persons having a legitimate interest, resident or established in the Member State from which the application was submitted are excluded from the opposition procedure as they already had the opportunity to participate in the national opposition procedure in accordance with Article 49(3), of Regulation (EU) No 1151/2012. Accordingly, the letters of opposition from the natural person resident in Italy are deemed inadmissible. |

In the light of the above, the Commission considers that the amendments to the specification for the protected designation of origin ‘Raschera’ should be approved, |
HAS ADOPTED THIS REGULATION:
Article 1
The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Raschera’ (PDO) are hereby approved.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

The French language version of Commission Regulation (EU) No 142/2011 (2) contains an error in the title of and in point 1 of section 2 of Chapter VI of Annex XIV as regards the listing of third countries, rendering the meaning opposite to the one intended. |

The French language version of Regulation (EU) No 142/2011 should therefore be corrected accordingly. The other language versions are not affected. |

amending Implementing Regulation (EU) No 540/2011 as regards the approval periods of the active substances flubendiamide, L-ascorbic acid, spinetoram and spirotetramat

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (1), and in particular Article 17, first paragraph, thereof,
Whereas:

Part B of the Annex to Commission Implementing Regulation (EU) No 540/2011 (2) sets out the active substances approved under Regulation (EC) No 1107/2009. |
|
(2) |
Commission Implementing Regulation (EU) 2020/2007 (3) extended the approval period of the active substance spirotetramat from 30 April 2024 until 31 July 2024, spinetoram and L-ascorbic acid from 30 June 2024 until 30 September 2024 and flubendiamide from 31 August 2024 until 30 November 2024. The extensions were necessary because Commission Implementing Regulation (EU) 2020/1740 (4) advanced the date of submission of the dossiers in support of the renewal of approval by 3 months. Therefore, it was necessary to maintain the date of the dossier submission as required under Commission Implementing Regulation (EU) No 844/2012 (5), while giving applicants time to prepare and submit the dossiers in the required format. |

As regards flubendiamide, L-ascorbic acid, spinetoram and spirotetramat, no applications for renewal of approval in accordance with Article 5(1) of Implementing Regulation (EU) 2020/1740 were submitted within 3 years before the respective expiry date of approval laid down in the Annex to this Regulation. |
|
(4) |
The extensions of the approval periods of those active substances, provided for by Implementing Regulation (EU) 2020/2007, are no longer justified. It is therefore appropriate to provide that the approvals of these substances expire at the dates they would expire without the extension. |
|
(5) |
Implementing Regulation (EU) No 540/2011 should therefore be amended accordingly. |
|
(6) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
The Annex to Implementing Regulation (EU) No 540/2011 is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Implementing Regulation (EU) 2018/2019 as regards certain plants for planting of Juglans regia L., Nerium oleander L. and Robinia pseudoacacia L. originating in Turkey, and amending Implementing Regulation (EU) 2020/1213 as regards the phytosanitary measures for the introduction of those plants for planting into the Union territory

Having regard to Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC (1), and in particular Article 42(4), third subparagraph, thereof,
Whereas:

Commission Implementing Regulation (EU) 2018/2019 (2) establishes, on the basis of a preliminary assessment, a list of high risk plants, plant products and other objects. |
|
(2) |
Commission Implementing Regulation (EU) 2018/2018 (3) lays down specific rules concerning the procedure to be followed, in order to carry out the risk assessment referred to in Article 42(4) of Regulation (EU) 2016/2031 for high risk plants, plant products and other objects. |
|
(3) |
Following a preliminary assessment, 34 genera and one species of plants for planting, originating from all third countries, were included in the Annex to Implementing Regulation (EU) 2018/2019 as high risk plants, amongst which are the genera Juglans L., Nerium L. and Robinia L. |
|
(4) |
In accordance with Regulation (EU) 2016/2031, if it is concluded, on the basis of a risk assessment, that a plant, plant product or other object originating in a third country, group of third countries or a specific area of the third country concerned, poses an unacceptable pest risk, but that that risk can be reduced to an acceptable level by applying certain measures, the Commission is to remove that plant, plant product or other object from the list established by the Annex to Implementing Regulation (EU) 2018/2019 and add it to the list referred to in Article 41(2) of Regulation (EU) 2016/2031. |

That list is provided for by Commission Implementing Regulation (EU) 2020/1213 (4). |

On 9 August 2019, Turkey submitted to the Commission a request for export to the Union of two-year-old grafted plants for planting of Juglans regia L., which are bare-rooted, free of leaves and with a maximum diameter of 2 cm at the base of the stem. That request was accompanied by the respective technical dossier. |
|
(7) |
On 19 May 2021, the European Food Safety Authority (‘the Authority’) adopted a scientific opinion regarding the commodity risk assessment of Juglans regia L. plants for planting from Turkey (5). The Authority identified Anoplophora chinensis, Euzophera semifuneralis, Garella musculana, Lasiodiplodia pseudotheobromae and Lopholeucaspis japonica as pests relevant for those plants for planting, evaluated the risk mitigation measures described in the dossier for those pests and estimated the likelihood of their freedom from those pests. |

On 27 November 2019, Turkey submitted to the Commission a request for export to the Union of one-to-four-year-old plants for planting with growing medium of Nerium oleander L. That request was accompanied by the respective technical dossier. |
|
(9) |
On 25 March 2021, the Authority adopted a scientific opinion regarding the commodity risk assessment of Nerium oleander L. plants for planting from Turkey (6). The Authority identified Phenacoccus solenopsis as pest relevant for those plants for planting, evaluated the risk mitigation measures described in the dossier for that pest and estimated the likelihood of their freedom from that pest. |

On 27 November 2019, Turkey submitted to the Commission a request for export to the Union of three-to-seven-year-old, bare-rooted plants for planting and plants in growing medium of Robinia pseudoacacia L. That request was accompanied by the respective technical dossier. |
|

On 25 March 2021, the Authority adopted a scientific opinion regarding the commodity risk assessment of Robinia pseudoacacia L. plants from Turkey (7). The Authority identified Anoplophora chinensis, Lopholeucapsis japonica, and Pochazia shantungensis as pest relevant for those plants for planting, evaluated the risk mitigation measures described in the dossier for those pests and estimated the likelihood of their freedom from those pests. |
|

On the basis of those opinions, the measures necessary to address the risk of those pests should be adopted as phytosanitary import requirements, in order to ensure that the phytosanitary risk from introduction of the specified plants into the Union is reduced to an acceptable level. |
|
(13) |
Therefore, the following plants should be removed from the Annex to Implementing Regulation (EU) 2018/2019: plants for planting of Juglans regia L. originating in Turkey, which are up to 2 years old, bare rooted, free of leaves and with a maximum diameter of 2 cm at the base of the stem, plants for planting of Nerium oleander L. originating in Turkey which are up to 4 years old, and plants for planting of Robinia pseudoacacia L. originating in Turkey which are up to 7 years old and with a maximum diameter of 25 cm. Those plants for planting should be added to the Annex to Implementing Regulation (EU) 2020/1213 and, if applicable, the necessary phytosanitary import measures should be set out therein. |

Given the uncertainties identified in those dossiers by the Authority, the sole application of the measures proposed by Turkey in the dossiers cannot reduce to an acceptable level the risk from the introduction of the specified plants into the Union. In order to reduce the phytosanitary risk to such a level, it should be required that those plants have been grown in pest-free sites of production, in addition to the measures already proposed in the dossiers by Turkey. |

Anoplophora chinensis and Lopholeucaspis japonica are listed as Union quarantine pests in Annex II to Commission Implementing Regulation (EU) 2019/2072 (8). Euzophera semifuneralis, Garella musculana, Lasiodiplodia pseudotheobromae, Phenacoccus solenopsis and Pochazia shantungensis are not yet included in that list but may fulfil the conditions to be included once a complete risk assessment has been carried out. |

In line with Article 42(5) of Regulation (EU) 2016/2031, the risk assessment will be carried out within a reasonable period of time. However, given the demand for imports, temporary phytosanitary measures concerning Euzophera semifuneralis, Garella musculana, Lasiodiplodia pseudotheobromae, Phenacoccus solenopsis and Pochazia shantungensis are necessary and appropriate until the risk assessment has been completed. |
|
(17) |
In order to comply with obligations deriving from the World Trade Organization Agreement on the application of sanitary and phytosanitary measures (9), the import of those commodities in the Union should start within the shortest possible delay. Therefore, this Regulation should enter into force on the third day following that of its publication in the Official Journal of the European Union. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |

Article 1
Amendment of Implementing Regulation (EU) 2018/2019
The Annex to Implementing Regulation (EU) 2018/2019 is amended in accordance with Annex I to this Regulation.
Article 2
Amendment of Implementing Regulation (EU) 2020/1213
The Annex to Implementing Regulation (EU) 2020/1213 is amended in accordance with Annex II to this Regulation.
Article 3
Entry into force
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Annex I to Implementing Regulation (EU) 2021/605 laying down special control measures for African swine fever

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:

(1) |
African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
|
(2) |
Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex. |

The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Implementing Regulation (EU) 2022/440 (3) following changes in the epidemiological situation as regards that disease in Bulgaria, Italy and Poland. |

Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health and justifications for zoning provided by the competent authorities of the Member States concerned. |

Since the date of adoption of Implementing Regulation (EU) 2022/440 there have been new outbreaks of African swine fever in wild porcine animals in Latvia and Slovakia. In addition, the epidemiological situation in certain zones listed as restricted zones III in Slovakia improved as regards kept porcine animals, due to the disease control measures being applied by this Member State in accordance with Union legislation. |

In March 2022, several outbreaks of African swine fever in wild porcine animals were observed in the Dienvidkurzemes county in Latvia in an area currently listed as restricted zone I in Annex I to Implementing Regulation (EU) 2021/605. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Latvia currently listed as restricted zone I in that Annex, affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof and the current boundaries of restricted zone I also need to be redefined to take account of those recent outbreaks. |

Also, in March 2022, several outbreaks of African swine fever in wild porcine animals were observed in the Liptovský Mikuláš and Banská Bystrica regions in Slovakia in areas currently listed as restricted zones I in Annex I to Implementing Regulation (EU) 2021/605. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Slovakia currently listed as restricted zones I in that Annex, affected by those recent outbreaks of African swine fever, should now be listed as restricted zones II in that Annex instead of as restricted zones I thereof and the current boundaries of restricted zones I also need to be redefined to take account of those recent outbreaks. |

Following those recent outbreaks of African swine fever in wild porcine animals in Latvia and Slovakia and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in those Member States has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605. |

In addition, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Slovakia in accordance with Commission Delegated Regulation (EU) 2020/687 (6), and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the Nové Zámky District in Slovakia, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be delisted from that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past three months. Also, certain zones currently listed as restricted zones I in Annex I to Implementing Regulation (EU) 2021/605 and bordering those restricted zones III should now be delisted from that Annex to take account of the effectiveness of those disease control measures. |

Finally, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Slovakia in accordance with Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the Lučenec District in Slovakia, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past three months. Those restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new restricted zones of a sufficient size should be demarcated for Latvia and Slovakia and duly listed as restricted zones I and II in Annex I to Implementing Regulation (EU) 2021/605. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the situation in the surrounding areas. |
|
(12) |
Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible. |
|

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Implementing Regulation (EU) 2021/605 is replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

HAS ADOPTED THIS DECISION:
Article 1
Mr Charles MICHEL is hereby re-elected President of the European Council for the period from 1 June 2022 until 30 November 2024.

This Decision shall be notified to Mr Charles MICHEL by the Secretary-General of the Council.

fixing the definitive allocation of Union aid to Member States for school fruit and vegetables and for school milk for the period from 1 August 2022 to 31 July 2023 and amending Implementing Decision (EU) 2021/462

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) No 1370/2013 of 16 December 2013 determining measures on fixing certain aids and refunds related to the common organisations of the markets in agricultural products (1), and in particular Article 5(6) thereof,
Whereas:

(1) |
Pursuant to Article 3 of Commission Implementing Regulation (EU) 2017/39 (2), Member States wishing to participate in the Union aid scheme for the supply of fruit and vegetables, bananas and milk in educational establishments (the school scheme) are to submit to the Commission by 31 January each year their request for Union aid relating to the next school year and, if applicable, update the request for Union aid relating to the ongoing school year. |

(2) |
In order to ensure the effective implementation of the school scheme, the allocation of Union aid for school fruit and vegetables and for school milk among participating Member States should be fixed on the basis of the amounts indicated in the request for Union aid by those Member States and taking into account the transfers between Member State’s indicative allocations referred to in Article 23a(4)(a) of Regulation (EU) No 1308/2013 of the European Parliament and of the Council (3). |

(3) |
All Member States notified the Commission of their request for Union aid for the period from 1 August 2022 to 31 July 2023, specifying the amount of aid requested for school fruit and vegetables or for school milk, or for both parts of the scheme. In the case of Belgium, France, Cyprus and Sweden, the amounts requested took account of the transfers between the indicative allocations. |
|
(4) |
In order to maximise the full potential of available funds, the unrequested Union aid should be reallocated to Member States participating in the school scheme that indicate, in their request for Union aid, their willingness to use more than their indicative allocation, should additional resources be available. |
|
(5) |
In their request for Union aid for the period from 1 August 2022 to 31 July 2023, Sweden sought less than the indicative allocation for school fruit and vegetables. Bulgaria, Czechia, Denmark, Germany, Estonia, Ireland, Spain, Croatia, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, the Netherlands, Austria, Poland, Slovenia and Slovakia notified their willingness to use more than the indicative allocation for school fruit and vegetables. No Member State sought less than the indicative allocation for school milk. |

(6) |
On the basis of the notified information by Member States, the definitive allocation of Union aid for school fruit and vegetables and for school milk for the period from 1 August 2022 to 31 July 2023 should be fixed. |
|
(7) |
Commission Implementing Decision (EU) 2021/462 (4) fixed the definitive allocation of Union aid for school fruit and vegetables and for school milk among Member States wishing to participate in the school scheme for the period from 1 August 2021 to 31 July 2022. Some Member States updated their request for Union aid relating to that school year. Germany, Spain and the Netherlands notified transfers between the definitive allocation for school fruit and vegetables and the definitive allocation for school milk. Belgium and the Netherlands sought less than the definitive allocation for school fruit and vegetables and/or for school milk. Czechia, Denmark, Germany, Estonia, Ireland, Spain, Latvia, Lithuania, Luxembourg, Hungary, Malta, Austria, Slovakia and Sweden notified their willingness to use more than the definitive allocation for school fruit and vegetables and/or for school milk. |

(8) |
Implementing Decision (EU) 2021/462 should therefore be amended accordingly. |
|
(9) |
The measures provided for in this Decision are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |
HAS ADOPTED THIS DECISION:
Article 1
The definitive allocation of Union aid for school fruit and vegetables and for school milk among Member States participating in the school scheme for the period from 1 August 2022 to 31 July 2023 is set out in Annex I.
Article 2
Annex I to Implementing Decision (EU) 2021/462 is replaced by the text set out in Annex II to this Decision.
Article 3
This Decision is addressed to the Member States.

on monitoring the presence of furan and alkylfurans in food
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 292 thereof,
Whereas:

Furan and alkylfurans, which include methylfurans such as 2-methylfuran, 3-methylfuran and 2,5-dimethylfuran, are process contaminants that are formed in foods during thermal processing. |
|
(2) |
The European Food Safety Authority (EFSA) Panel on Contaminants in the Food Chain adopted a scientific opinion in 2017 on the risks that the presence of furan and methylfurans in food poses to public health (1). It concluded that the current levels of exposure to furan indicate a health concern. As for methylfurans, the opinion concluded that they may add significantly to the overall exposure to furan and alkylfurans and therefore increase the health concern. However, as data are lacking on the presence of methylfurans in food EFSA recommended producing additional data in this area. 2-methylfuran and 3-methylfuran can be reliably quantified with the currently available methods of analysis, while further work is needed for the reliable analysis of 2,5-dimethylfuran. However, if the used method of analysis enables it, it would be appropriate to analyse and quantify 2,5-dimethylfuran and to report the data. |

Furthermore, the scientific literature has recently pointed to the presence of food contaminants related to alkylfurans other than methylfurans, such as 2-pentylfuran and 2-ethylfuran. It would therefore be appropriate to analyse and quantify such additional (non-methylfurans) alkylfurans, provided that the method of analysis is reliable for this purpose. |

The results of the monitoring of furan and alkylfurans must be reliable and comparable. It is therefore appropriate to provide instructions on sampling and analytical performance criteria. |

(6) |
EFSA has a mandate from the European Commission to collect all available data on the occurrence of chemical contaminants in food and feed. These data are used in EFSA’s scientific opinions and reports on contaminants in food and feed. |
|
(7) |
It is therefore appropriate to recommend that furan and alkylfurans in food be monitored and the data reported to EFSA. |
HAS ADOPTED THIS RECOMMENDATION:

1. |
Member States should, with the active involvement of food business operators, monitor furan, 2-methylfuran and 3-methylfuran in food, in particular in coffee, jarred baby food (including baby food in containers, tubes and pouches), ready-to-eat soup, potato-based crisps, fruit juices, breakfast cereals, biscuits, crackers and crispbread. |

2. |
To ensure that the samples are representative, Member States should follow the sampling procedures laid down in part B of the Annex to Commission Regulation (EC) No 333/2007 (2). Food business operators should also apply this sampling procedure or an equivalent sampling procedure, ensuring the sample is representative. |

For the analysis of furan, 2-methylfuran and 3-methylfuran in coffee and jarred baby food, Member States and food business operators should use a method that complies with the following criteria:
For the analysis of furan in foods other than coffee and jarred baby food, Member States and food business operators should use a method that complies with these criteria and the limit of quantification (LOQ) should not be higher than 5 μg/kg. For the analysis of 2-methylfuran and 3-methylfuran in foods other than coffee and jarred baby food, laboratories should have quality control procedures in place to ensure the reliability of the obtained analytical results where the LOQ should not be higher than 5 μg/kg. |

If the used method of analysis enables the determination of alkylfurans other than 2-methylfuran and 3-methylfuran, Member States and food business operators should determine those alkylfurans. |

5. |
Member States and food business operators should provide the monitoring results to EFSA by 30 June of each year, in line with the requirements of EFSA’s Guidance on Standard Sample Description (SSD) for Food and Feed and EFSA’s additional specific reporting requirements (3). |
