COMMISSION IMPLEMENTING REGULATION (EU) 2021/1460

of 9 September 2021

amending for the 322nd time Council Regulation (EC) No 881/2002 imposing certain specific restrictive measures against certain persons and entities associated with the ISIL (Da'esh) and Al-Qaida organisations

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with the ISIL (Da'esh) and Al-Qaida organisations (1), and in particular Article 7(1)(a) and Article 7a(5) thereof,

Whereas:

(1)

Annex I to Regulation (EC) No 881/2002 lists the persons, groups and entities covered by the freezing of funds and economic resources under that Regulation.

(2)

On 6 September 2021, the Sanctions Committee of the United Nations Security Council decided to remove one entry from the list of persons, groups and entities to whom the freezing of funds and economic resources should apply.

(3)

Annex I to Regulation (EC) No 881/2002 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EC) No 881/2002 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

In Annex I to Regulation (EC) No 881/2002, the following entry under the heading ‘Natural persons’ is deleted:

DECISION (EU) 2021/1461 OF THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES

of 8 September 2021

appointing two Advocates-General to the Court of Justice

THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 19 thereof,

Having regard to the Treaty on the Functioning of the European Union, and in particular Articles 253 and 255 thereof,

Whereas:

(1)

Under Articles 5 and 7 of Protocol No 3 on the Statute of the Court of Justice of the European Union, and following the resignation of Mr Gerard HOGAN as of 6 October 2021, an Advocate-General should be appointed to the Court of Justice for the remainder of the term of office of Mr HOGAN, which runs until 6 October 2024.

Mr Anthony COLLINS has been nominated for this post.

(3)

Moreover, the terms of office of 14 Judges and six Advocates-General of the Court of Justice will expire on 6 October 2021. Appointments to these posts should therefore be made for the period starting on 7 October 2021 and expiring on 6 October 2027.

Ms Laila MEDINA has been nominated for the post of Advocate-General of the Court of Justice.

(5)

The panel set up by Article 255 of the Treaty on the Functioning of the European Union has given a favourable opinion on the suitability of these candidates to perform the duties of Advocate-General of the Court of Justice,

HAVE ADOPTED THIS DECISION:

Article 1

Mr Anthony COLLINS is hereby appointed Advocate-General of the Court of Justice for the period from 7 October 2021 to 6 October 2024.

Article 2

Ms Laila MEDINA is hereby appointed Advocate-General of the Court of Justice for the period from 7 October 2021 to 6 October 2027.

Article 3

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

DECISION (EU) 2021/1462 OF THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES

of 8 September 2021

appointing a Judge to the General Court

THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 19 thereof,

Having regard to the Treaty on the Functioning of the European Union, and in particular Articles 254 and 255 thereof,

Whereas:

(1)

The terms of office of 23 Judges of the General Court expired on 31 August 2019.

(2)

In that context, Mr Pēteris ZILGALVIS has been nominated for the post of Judge of the General Court.

(3)

The panel set up under Article 255 of the Treaty on the Functioning of the European Union has given a favourable opinion on the suitability of this candidate to perform the duties of Judge of the General Court.

(4)

Mr Pēteris ZILGALVIS should therefore be appointed for the period from the date of entry into force of this Decision to 31 August 2025,

HAVE ADOPTED THIS DECISION:

Article 1

Mr Pēteris ZILGALVIS is hereby appointed Judge of the General Court for the period from the date of entry into force of this Decision to 31 August 2025.

Article 2

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.
