POLITICAL AND SECURITY COMMITTEE DECISION (CFSP) 2021/1127

extending the mandate of the Head of Mission of the European Union Border Assistance Mission for the Rafah Crossing Point (EU BAM Rafah) (EU BAM Rafah/1/2021)

THE POLITICAL AND SECURITY COMMITTEE,

Having regard to the Treaty on European Union, and in particular the third paragraph of Article 38 thereof,

Having regard to Council Joint Action 2005/889/CFSP of 25 November 2005 on establishing a European Union Border Assistance Mission for the Rafah Crossing Point (EU BAM Rafah) (1), and in particular Article 10(1) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

Pursuant to Article 10(1) of Joint Action 2005/889/CFSP, the Political and Security Committee (PSC) is authorised, in accordance with Article 38 of the Treaty, to take the relevant decisions for the purpose of exercising political control and strategic direction of the European Union Border Assistance Mission for the Rafah Crossing Point (EU BAM Rafah), including the decision to appoint a Head of Mission.

(2)

On 13 October 2020 the PSC adopted Decision (CFSP) 2020/1548 (2), appointing Mr Mihai-Florin BULGARIU as Head of Mission of EU BAM Rafah from 1 November 2020 to 30 June 2021.

(3)

On 28 June 2021 the Council adopted Decision (CFSP) 2021/1065 (3), extending the mandate of EU BAM Rafah from 1 July 2021 to 30 June 2022.

(4)

The High Representative of the Union for Foreign Affairs and Security Policy has proposed to extend the mandate of Mr Mihai-Florin BULGARIU as Head of Mission of EU BAM Rafah until 30 June 2022,

HAS ADOPTED THIS DECISION:

Article 1

The mandate of Mr Mihai-Florin BULGARIU as Head of Mission of EU BAM Rafah is hereby extended from 1 July 2021 to 30 June 2022.

Article 2

This Decision shall enter into force on the date of its adoption.

It shall apply from 1 July 2021.

THE POLITICAL AND SECURITY COMMITTEE,

Having regard to the Treaty on European Union, and in particular the third paragraph of Article 38 thereof,

Having regard to Council Decision 2013/354/CFSP of 3 July 2013 on the European Union Police Mission for the Palestinian Territories (EUPOL COPPS) (1), and in particular Article 9(1) thereof,

Whereas:

(1)

Pursuant to Article 9(1) of Decision 2013/354/CFSP, the Political and Security Committee (PSC) is authorised, in accordance with Article 38 of the Treaty, to take the relevant decisions for the purpose of exercising the political control and strategic direction of the European Union Police Mission for the Palestinian Territories (EUPOL COPPS), including the decision to appoint a Head of Mission.

(2)

On 13 October 2020 the PSC adopted Decision (CFSP) 2020/1541 (2), appointing Ms Nataliya APOSTOLOVA as Head of Mission of EUPOL COPPS from 15 November 2020 to 30 June 2021.

(3)

On 28 June 2021 the Council adopted Decision (CFSP) 2021/1066 (3), extending EUPOL COPPS from 1 July 2021 until 30 June 2022.

The High Representative of the Union for Foreign Affairs and Security Policy has proposed to extend the mandate of Ms Nataliya APOSTOLOVA as Head of Mission of EUPOL COPPS from 1 July 2021 to 30 June 2022,

HAS ADOPTED THIS DECISION:

Article 1

The mandate of Ms Nataliya APOSTOLOVA as Head of Mission of the European Union Police Mission for the Palestinian Territories (EUPOL COPPS) is hereby extended from 1 July 2021 to 30 June 2022.

Article 2

This Decision shall enter into force on the date of its adoption.

It shall apply from 1 July 2021.

COMMISSION IMPLEMENTING DECISION (EU) 2021/1129

of 5 July 2021

setting out the annual breakdown of available allocations under the Just Transition Fund per Member State

(notified under document C(2021) 4872)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Regulation (EU) 2021/1056 of the European Parliament and of the Council of 24 June 2021 establishing the Just Transition Fund (1), and in particular Article 3(4) thereof,

Whereas:

(1)

In order to set out an appropriate financial framework for the Funds it is necessary to set out the annual breakdown of available allocations by Member State.

(2)

This annual breakdown should include the additional resources from the European Union Recovery Instrument (2), in accordance with Article 4(3) of Regulation (EU) 2021/1056 and with Article 109(1) of Regulation (EU) 2021/1060 of the European Parliament and of the Council (3).

(3)

For reasons of programming by the Member States, the specific breakdown should be given in 2018 prices to set out the resources effectively available after deducting the amount for technical assistance at the initiative of the Commission and the support to administrative expenditure. For reasons of transparency, breakdowns should be expressed also in current prices,

HAS ADOPTED THIS DECISION:

Article 1

The annual breakdown of available allocations by Member State under the Just Transition Fund is set out in the Annex.

Article 2

This Decision is addressed to the Member States.

COMMISSION IMPLEMENTING DECISION (EU) 2021/1130

of 5 July 2021

setting out the list of regions eligible for funding from the European Regional Development Fund and the European Social Fund Plus and of Member States eligible for funding from the Cohesion Fund for the period 2021-2027

(notified under document C(2021) 4894)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021 laying down common provisions on the European Regional Development Fund, the European Social Fund Plus, the Cohesion Fund, the Just Transition Fund and the European Maritime, Fisheries and Aquaculture Fund and financial rules for those and for the Asylum, Migration and Integration Fund, the Internal Security Fund and the Instrument for Financial Support for Border Management and Visa Policy (1), and in particular Article 108(4) thereof,

Whereas:

The European Regional Development Fund (ERDF) and the European Social Fund Plus (ESF+) support the Investment for jobs and growth goal in all regions corresponding to level 2 of the common classification of territorial units for statistics (hereinafter referred to as ‘NUTS level 2’), which was established by Regulation (EC) No 1059/2003 of the European Parliament and of the Council (2), as amended by Commission Regulation (EU) 2016/2066 (3).

In order to set out an appropriate financial framework for the ERDF and the ESF+, it is necessary that the Commission set up a list of regions fulfilling the respective criteria laid down in Annex XXVI to Regulation (EU) 2021/1060 of each of the three categories of regions (less developed regions, transition regions and more developed regions) at NUTS level 2.

For the same reason, it is also necessary that the Commission set up the list of Member States that are eligible for funding from the Cohesion Fund in accordance with Article 108(3) of Regulation (EU) 2021/1060.

(4)

For reasons of transparency, the codes and names of the NUTS level 2 regions applicable from 1 January 2021 in accordance with Regulation (EC) No 1059/2003, as amended by Commission Delegated Regulation (EU) 2019/1755 (4), should also be included into the Annexes to this Decision.

The list of eligible regions and Member States should therefore be set up accordingly,

HAS ADOPTED THIS DECISION:

Article 1

1.   The regions eligible for funding from the ERDF and ESF+ under the category of less developed regions are listed in Annex I.

2.   The regions eligible for funding from the ERDF and the ESF+ under the category of transition regions are listed in Annex II.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021 laying down common provisions on the European Regional Development Fund, the European Social Fund Plus, the Cohesion Fund, the Just Transition Fund and the European Maritime, Fisheries and Aquaculture Fund and financial rules for those and for the Asylum, Migration and Integration Fund, the Internal Security Fund and the Instrument for Financial Support for Border Management and Visa Policy (1), and in particular Article 109(2) and the second subparagraph of Article 110(3) thereof,

Having regard to Regulation (EU) 2021/1059 of the European Parliament and of the Council of 24 June 2021 on specific provisions for the European territorial cooperation goal (Interreg) (2) supported by the European Regional Development Fund and external financing instruments , and in particular Article 9(3) thereof,

Whereas:

(1)

In order to set out an appropriate financial framework for the Funds it is necessary to set out the annual breakdown by Member State of global resources allocated under the Investment for jobs and growth goal and the European territorial cooperation goal (Interreg).

(2)

It is necessary to set out the annual breakdown by Member State of specific resources allocated according to the different categories of regions as specified in the Investment for jobs and growth goal.

(3)

It is necessary to set out the annual breakdown of additional funding in favour of outermost regions in France, Spain and Portugal, and regions in Finland and Sweden fulfilling the criteria laid down in Article 2 of Protocol No 6 to the 1994 Act of Accession.

(4)

For reasons of transparency, it is appropriate to set out the annual breakdown by Member State of specific resources for the European Regional Development Fund (ERDF) and the European Social Fund Plus (ESF+) while taking into account that the amounts of the ERDF and the ESF+ allocated to each Member State should equal the amounts of specific resources allocated according to the different categories of regions and specific resources in favour of outermost regions in France, Spain and Portugal, and regions in Finland and Sweden fulfilling the criteria laid down in Article 2 of Protocol No 6 to the 1994 Act of Accession allocated to the same Member State.

It is necessary to set out the annual breakdown by Member State of specific resources for the Cohesion Fund, reduced by the amounts to be transferred by Member States to the Connecting Europe Facility.

It is necessary to set out the amount to be transferred from each Member State’s Cohesion Fund allocation to the Connecting Europe Facility (3).

(7)

For reasons of transparency, it is appropriate to set out the annual breakdown of specific resources for the European Urban Initiative under direct or indirect management by the Commission.

(8)

For reasons of transparency, it is appropriate to set out the annual breakdown of the ESF+ resources for the Investment for jobs and growth goal for transnational cooperation supporting innovative solutions under direct or indirect management by the Commission.

(9)

For reasons of transparency, it is appropriate to set out the annual breakdown of the ERDF resources under the Investment for jobs and growth goal for interregional innovative investments under direct or indirect management by the Commission.

(10)

It is necessary to set out the annual breakdown by Member State of global resources for the European territorial cooperation goal (Interreg) and of specific resources for the four components thereof in accordance with Article 9(2) of Regulation (EU) 2021/1059.

(11)

For reasons of transparency, global breakdowns should be given both in 2018 and current prices.

(12)

For reasons of programming by the Member States, the specific annual breakdowns should be given in current prices to reflect the indexation of 2% per year in accordance with the third subparagraph of Article 109(1) of Regulation (EU) 2021/1060 and to set out the resources effectively available after deducting the support to the Connecting Europe Facility, the technical assistance at the initiative of the Commission, the allocation for the European Urban Initiative under direct or indirect management, transnational cooperation supporting innovative solutions under direct or indirect management under the ESF+ and interregional innovative investments under direct or indirect management,

HAS ADOPTED THIS DECISION:

Article 1

1.   The annual breakdown of global resources by Member State under the Investment for jobs and growth goal is set out in Annex I.

2.   The annual breakdown by Member State of global resources allocated to less developed regions under the Investment for jobs and growth goal and available for programming is set out in Annex II.

3.   The annual breakdown by Member State of global resources allocated to transition regions under the Investment for jobs and growth goal and available for programming is set out in Annex III.

4.   The annual breakdown by Member State of global resources allocated to more developed regions under the Investment for jobs and growth goal and available for programming is set out in Annex IV.

5.   The annual breakdown by Member State of global resources allocated to additional funding for the outermost regions identified in Article 349 TFEU and the NUTS level 2 regions fulfilling the criteria laid down in Article 2 of Protocol No 6 to the 1994 Act of Accession under the Investment for jobs and growth goal and available for programming is set out in Annex V.

6.   The annual breakdown by Member State of global resources allocated to the ERDF under the Investment for jobs and growth goal and available for programming is set out in Annex VI.

7.   The annual breakdown by Member State of global resources allocated to the ESF+ under the Investment for jobs and growth goal and available for programming is set out in Annex VII.

RULES APPLICABLE TO CIVIL AVIATION

The ‘applicable provisions’ of the following acts shall be applicable in accordance with this Agreement unless otherwise specified in this Annex or in Annex II to this Agreement (transitional provisions). Where necessary, specific adaptations for each individual act are set out hereafter:
