COUNCIL IMPLEMENTING REGULATION (EU) 2021/997

implementing Article 8a(1) of Regulation (EC) No 765/2006 concerning restrictive measures in respect of Belarus

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 765/2006 of 18 May 2006 concerning restrictive measures in respect of Belarus (1), and in particular Article 8a(1) thereof,

Having regard to the proposals from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 18 May 2006, the Council adopted Regulation (EC) No 765/2006.

(2)

On 9 August 2020, Belarus conducted presidential elections, which were found to be inconsistent with international standards and marred by the repression of independent candidates and a brutal crackdown on peaceful protesters in the wake of those elections. On 11 August 2020, the High Representative of the Union for Foreign Affairs and Security Policy issued a declaration on behalf of the Union, assessing that the elections were neither free nor fair. It was also stated that measures against those responsible for violence, unjustified arrests and falsification of election results could be taken.

(3)	Given the escalation of the serious human rights violations in Belarus, and the violent repression of civil society, democratic opposition and journalists as well as of persons belonging to national minorities, additional designations of persons and entities should be adopted.

(4)

On 24 and 25 May 2021, the European Council adopted conclusions in which it strongly condemned the forced landing of a Ryanair flight in Minsk, Belarus, on 23 May 2021 endangering aviation safety, and the detention by Belarusian authorities of journalist Raman Pratasevich and Sofia Sapega. It called on the Council to adopt additional listings of persons and entities as soon as possible on the basis of the relevant sanctions framework.

(5)	78 persons and 7 entities should therefore be added to the list of persons and entities subject to restrictive measures set out in Annex I to Regulation (EC) No 765/2006,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EC) No 765/2006 is hereby amended as set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

In particular, she has prosecuted journalists Katsiaryna Bakhvalava (Andreyeva) and Darya Chultsova for recording peaceful protests, based on the groundless charges of “conspiracy” and “violating public order”. She has also prosecuted members of Belarusian civil society e.g. for taking parts in peaceful protests, and paying tribute to murdered protester Aliaksandr Taraikousky. She has continuously asked the judge for long-term prison sentences.	21.6.2021
				She is therefore responsible for serious human rights violations and for seriously undermining the rule of law, as well as for the repression of civil society and democratic opposition.

The journalists, who recorded peaceful protests, were accused of violations of public order and sentenced to two years of prison. Mr Hara was also involved in initiating of politically motivated criminal proceedings against Siarhei Tsikhanousky – opposition activist and husband of presidential candidate Svetlana Tsikhanouskaya.	21.6.2021
			POB: Tbilisi, former Georgian SSR (now Georgia) Gender: male Nationality: Belarusian	As the Head of the Intergovernmental Commission created by the Office of the General Prosecutor to investigate citizens' complaints about abuse of powers by law enforcement officers, Dzmitry Hara is responsible for inaction of this institution, since no case of such an investigation is known, despite applications for the initiation of criminal cases complaining about the use of violence, ill-treatment and torture. As of March 2021, he is the Chairman of the Investigative Committee of Belarus. In this position he is responsible for prosecuting human rights defenders and participants in peaceful protests.
				He is therefore responsible for serious human rights violations and for seriously undermining the rule of law, as well as for the repression of civil society and democratic opposition
106.	Aliaksei Kanstantsinavich STUK Alexey Konstantinovich STUK	Аляĸсей Канстанцiнавiч СТУК Алеĸсей Константинович СТУК	Deputy Prosecutor General of the Republic of Belarus DOB: 1959 POB: Minsk, former USSR (now Belarus) Gender: male Nationality: Belarusian	In his position of Deputy Prosecutor General, Aliaksei Stuk bears responsibility for politically motivated criminal cases against opposition, journalists, civil society and regular citizens. He is responsible for tightening the Prosecutor's Office's control of citizens' activities in localities and work places and is responsible for applying excessive legal responsibilities on participants in peaceful protests. He publicly stated that the Office of Prosecutor General would work to identify "illegal" citizen associations and suppress their activities.	21.6.2021
				He is therefore responsible for serious human rights violations and seriously undermining the rule of law, as well as for the repression of civil society and democratic opposition.

He was also involved in initiating of politically motivated criminal proceedings against Siarhei Tsikhanousky - opposition activist and husband of presidential candidate Svetlana Tsikhanouskaya. He is therefore responsible for serious human rights violations and seriously undermining the rule of law, as well as the repression of civil society and democratic opposition.	21.6.2021

Through these legislative activities, she is responsible for serious violations of human rights, including the right of peaceful assembly, and the repression of civil society and democratic opposition. These legislative activities also seriously undermine democracy and the rule of law in Belarus.	21.6.2021

Through these legislative activities, he is responsible for serious violations of human rights, including the right of peaceful assembly, and the repression of civil society and democratic opposition. In his articles, democratic opposition and civil society are systematically highlighted in a negative and derogatory way, using falsified information. He is one of the main sources of state propaganda, which supports and justifies the repression of the democratic opposition and of civil society.	21.6.2021

In December 2020, he received the prize "Golden Letter", handed over by representatives of the Belarussian Ministry of Information. In January 2021, Lukashenka signed a decree awarding Mukavozchyk a medal "For labour merits". He is therefore benefitting from and supporting the Lukashenka regime.
112. He is directly responsible for the way in which the State Television presents information about the situation in the country, thus lending support to the authorities, including Lukashenka. He is therefore supporting the Lukashenka regime.	21.6.2021

In his support for Lukashenka, he frequently used inflammatory language, and encouraged the violence of the state apparatus against peaceful protesters. He is therefore supporting the Lukashenka regime.	21.6.2021

				He made public comments condemning the sportsmen of Belarus expressing their protests against the Lukashenka regime, namely protesting against violence and persecution of peaceful protesters, journalists, human rights activists. He is a long-time friend of Aliaksandr Lukashenka and thanks to this association has accumulated significant wealth and influence among the political elite in Belarus. “Safmar”, a company controlled by Gutseriev, was the only Russian oil firm that carried on supplying oil to Belarussian refineries during the energy crisis between Belarus and Russia in early 2020.	21.6.2021
				Gutseriev also supported Lukashenka in disputes with Russia over oil deliveries. Gutseriev owns the “Slavkali” company, which is building Nezhinsky potassium chloride mining and processing plant based on the Starobinsky potash salt deposit near Lyuban. It is the largest investment in Belarus, worth $2 billion. Lukashenka promised to rename the town of Lyuban to Gutserievsk in his honor. His other businesses in Belarus include “Slavneft” fueling stations and oil depots, a hotel, a business center and an airport terminal in Minsk. Lukashenka came to Gutseriev’s defense after criminal investigation was initiated against him in Russia. Lukashenka also thanked Gutseriev for his financial contributions to charity and investments of billions of dollars in Belarus. Gutseriev is reported to have gifted Lukashenka luxurious presents.
				He also declared to be the owner of a residency, which de facto belongs to Lukashenka, thus covering him up when journalists started to investigate Lukashenka’s assets. Gutseriev is reported to have attended Lukashenka’s secret inauguration on 23 September 2020. In October 2020 Lukashenka and Gutseriev both appeared at the opening on an orthodox church, which the latter sponsored. According to media reports, when the striking employees of Belarusian state-owned media were fired in August 2020, Russian media workers were flown to Belarus on board of aircraft belonging to Gutseriev in order to replace the fired workers, and lodged in hotel Minsk Renaissance belonging to Gutseriev. Mikhail Gutseriev is therefore benefitting from and supporting the Lukashenka regime.

				He is the co-owner of “Bremino Group” – the initiator and co-administrator of the Bremino-Orsha special economic zone project, created by a presidential decree signed by Aliaksandr Lukashenka. The company has received state support for developing the Bremino-Orsha zone, as well as a number of financial and tax advantages and other benefits. Aleksin and other owners of Bremino Group received support from Viktar Lukashenka.
				Companies “Inter Tobacco” and “Energo-Oil”, which belong to Aleksin and members of his close family, were given exclusive privileges to import tobacco products to Belarus, based on a decree signed by Aliaksandr Lukashenka, and received state support for the creation of Tabakierka kiosks. He was allegedly involved in the establishment of the first government-approved private military company in Belarus “GardServis”, with reported links to the Belarussian security apparatus. He is therefore benefitting from the Lukashenka regime.

He therefore bears responsibility for diverting passenger flight FR4978 to Minsk on 23 May 2021 without a proper justification. This politically motivated decision was aimed at arresting and detaining the opposition journalist Raman Pratasevich and Sofia Sapega and is a form of repression against civil society and democratic opposition of Belarus.	21.6.2021

OJSC BelAZ has offered its premises and equipment to stage a political rally in support of the regime. Therefore OJSC “Belaz” benefits from and supports the Lukashenka regime.	21.6.2021
				The employees of OJSC “Belaz” who took part in strikes and peaceful protests in the aftermath of the fraudulent August 2020 elections in Belarus were threatened with layoffs and intimidated by the company management. A group of employees was locked indoors by OJSC Belaz to prevent them from joining the other protesters. The company management presented a strike to the media as a staff meeting. Therefore OJSC “Belaz” is responsible for the repression of civil society and supports the Lukashenka regime.

The privileged position in the flower export sector to Russia, from which the company benefits, is conditioned on the support of the regime. The main Belarusian suppliers of cut flowers are the companies that are closely connected with the leadership of the republic. Logex is therefore benefitting from the Lukashenka regime.	21.6.2021

NNK is owned by Interservice, a company belonging to Mikalai Varabei who is one of the leading businessmen benefitting from and supporting the Lukashenka regime. NNK is also reported to be connected to Aliaksei Aleksin, another prominent Belarusian businessman who benefits from the Lukashenka regime. According to media reports Aleksin was the founder of NNK alongside Varabei. NNK was also used by the Belarusian authorities to adapt the Belarusian economy to restrictive measures introduced by the EU.	21.6.2021’

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EU) No 401/2013 of 2 May 2013 concerning restrictive measures in view of the situation in Myanmar/Burma and repealing Regulation (EC) No 194/2008 (1), and in particular Article 4i thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 2 May 2013, the Council adopted Regulation (EU) No 401/2013.

(2)

On 29 April 2021, the Council, considering the ongoing activities undermining democracy and the rule of law in Myanmar/Burma, as well as the brutal repression and serious human rights violations in the country, adopted Decision (CFSP) 2021/711 (2) which renewed the restrictive measures in place, including all designations.

(3)	In view of the continuing grave situation in Myanmar/Burma, eight persons and four entities should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures in Annex IV to Regulation (EU) No 401/2013.

(4)	Regulation (EU) No 401/2013 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex IV to Regulation (EU) No 401/2013 is amended as set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

			The Minister for Home Affairs is responsible for the Myanmar Police Force, Fire Service and Prison Service. Functions of the Ministry for Home Affairs encompass State Security and Law and Order. In that capacity, Lieutenant General Soe Htut is responsible for serious human rights violations committed by the Myanmar Police since the military coup of 1st February 2021, including killing of civilians and unarmed protesters, violations of freedom of association and peaceful assembly, arbitrary arrests and detention of opposition leaders and peaceful protesters and violations of freedom of expression. Additionally, as a member of the SAC, Lieutenant General Soe Htut has been directly involved in and responsible for decision making concerning state functions and is therefore responsible for undermining democracy and the rule of law in Myanmar/Burma. He is also directly responsible for the repressive decisions taken by the SAC, including legislation that violates human rights and limits freedoms of citizens of Myanmar, and for the serious human rights violations committed by the Myanmar security forces.
37.	Tun Tun, Naung (a.k.a. Tun Tun Naing; a.k.a. Htun Htun Naung)	Date of birth: 30 April 1963; Nationality: Myanmar/Burma; Gender: Male	Lieutenant General Tun Tun Naung is a member of the Myanmar Armed Forces (Tatmadaw) and was previously a Commander. He is the Minister of Border Affairs and member of the National Defence and Security Council. In 2013, Tun Tun Naung was the Northern Commander overseeing the Burmese military’s conflict with the Kachin Independence Army. In this conflict, the Myanmar troops under the command of Tun Tun Naung carried out serious human rights abuses and violations of international humanitarian law. In 2017, Tun Tun Naung was commanding officer of the “1st Bureau of Special Operations”. Under his command, troops committed atrocities and serious human rights violations against ethnic minorities in Rakhine state during the “Rohingya clearance operations”. These operations commenced on 25 August 2017 and involved arbitrary killings, physical abuse, torture, sexual violence, and detention of Rohingya people. As Commander in 2013 and 2017, Tun Tun Naung is responsible for serious human rights violations committed in Myanmar/Burma.	21.6.2021
			On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency and transferred the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. During these events, Tun Tun Naung accepted an appointment as Minister for Border Affairs in the Union Government on 1 February 2021and thereby a seat at the National Defence and Security Council. As member of the Union Government and Minister for Border Affairs, Tun Tun Naung is responsible for activities undermining democracy and the rule of law in Myanmar and actions that threaten the peace, security and stability of the country.
38.	Win Shein (a.k.a. He was Permanent Secretary in this department under the democratically elected government. On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency and transferred the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. On 2 February, the SAC was established to exercise those powers, preventing the democratically elected government from fulfilling its mandate. Colonel Khin Maung Yi was appointed Minister for Natural Resources and Environmental Conservation (MONREC) on 2 February 2021 by the State Administrative Council (SAC) led by Commander-in-Chief Min Aung Hlaing.	21.6.2021
			According to Myanmar law, MONREC is sole responsible for management the exploitation of natural resources of Myanmar, having a crucial role in the exploitation and trade of, among others, resources such as gemstones, pearls and other mineral resources as well as forestry. Under his leadership, MONREC controls Myanmar Pearl Enterprise (MPE), Myanmar Gems Enterprise (MGE) and Myanmar Timber Enterprise (MTE), having exclusive rights on the production and trade of resources on their areas of competence. By accepting his nomination to Minister for Natural Resources and Environmental Conservation and through his role in the exploitation of natural resources of Myanmar, Khin Maung Yi contributes to the funding of the military regime, therefore he is responsible for undermining democracy and the rule of law in Myanmar/Burma.

Tin Aung San	Date of birth: 16 October 1960 ; Nationality: Myanmar/Burma; Gender: Male National ID: 12/La Ma Na (N) 089 489	Admiral Tin Aung San is the Commander-in-Chief of the Myanmar Navy and serves as the Minister of Transport and Communication. He is also member of the State Administration Council (SAC). On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. 			Admiral Tin Aung San was appointed Minister of Transport and Communication on 3 February 2021 by the State Administrative Council (SAC), led by Commander-in-Chief Min Aung Hlaing. As a Government Minister, he is responsible for communication and networks and thus makes decisions and implement policies that define the freedom of access to data on-line. Since he took over the ministry, there have been numerous shutdowns and deliberate slowing-downs of the internet, as well as orders for providers to prevent Facebook, Twitter and Instagram on-line. He is therefore directly responsible for limiting press freedom and access to information on-line and by doing so he is undermining democracy and rule of law in Myanmar/Burma. Being a member of the SAC, Tin Aung San has been directly involved in and responsible for decision making concerning state functions and is therefore responsible for undermining democracy and the rule of law in Myanmar/Burma. He is also directly responsible for the repressive decisions taken by the SAC, including legislation that violates human rights and limits freedoms of citizens of Myanmar, and for the serious human rights violations committed by the Myanmar security forces.
41.	Thida Oo a.k.a. Daw Thida Oo	Nationality: Myanmar/Burma; Gender: Female	Thida Oo has been the Attorney-General of the Union of Myanmar since 2 February 2021, when she was appointed by the Commander-in-Chief of the Myanmar Armed Forces (Tatmadaw) Min Aung Hlaing. She is a member of the Myanmar Investment Commission (MIC). On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency on 1 February transferring the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. 			Thida Oo has been part of the government that emerged from the coup since its first day, using the power granted by the 2010 Attorney General of the Union Law to pursue politically motivated trials and subsequent arbitrary detention and to act as an enabling force for the abuses committed by the military regime. She is therefore engaged in actions and policies undermining democracy and the rule of law in Myanmar/Burma, as well as actions that threaten the peace, security and stability of Myanmar/Burma.
42.	Aung Lin Tun	Nationality: Myanmar/Burma; Gender: Male	Major General Aung Lin Tun is a member of the Myanmar Armed Forces (Tatmadaw) and serves as Deputy Minister of Defence. On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency on 1 February and transferred the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. 			Major General Aung Lin Tun was appointed Deputy Minister of Defence on 11 May 2021 by the State Administrative Council (SAC), led by Commander-in-Chief Min Aung Hlaing. Before his promotion, he was part of the Office of the Chief Commander of the Army and was involved in all repressive actions taken by SAC and Tatmadaw since the coup. As Deputy Minister of Defence, Major General Aung Lin Tun is engaged in policies and activities undermining democracy and the rule of law in Myanmar/Burma as well as actions that threaten the peace, security and stability of the country. Additionally, being a member of the military regime, Major General Aung Lin Tun is directly responsible for serious human rights violations committed by the security forces against peaceful protesters.
43.	Zaw Min Tun	Place of birth: Yenanchaung, Myanmar; Nationality: Myanmar/Burma; Gender: Male	Brigadier-General Zaw Min Tun is the Press Team Leader of the State Administrative Council and the Deputy Minister for Information. He was the former Head of the Tatmadaw’s True News Information Team. On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency on 1 February and transferred the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. On 2 February, the SAC was established to exercise those powers, preventing the democratically elected government from fulfilling its mandate. He was appointed SAC Press Team Leader on 5 February 2021 and Deputy Minister for Information on 7 February 2021 by the State Administrative Council (SAC) led by Commander-in-Chief Min Aung Hlaing. As State Administration Council’s spokesperson, Brigadier-General Zaw Min Tun has presided over all the SAC’s press conferences, which aim to relay and justify SAC’s narratives over the coup and of the junta’s actions since then.	21.6.2021’;
			As Government Deputy Minister of Information, he bears direct responsibility for state-owned media and thus for the broadcast and publication of official news. Since the nominations of Chit Naing as Minister of Information and Zaw Min Tung as his deputy, the newspapers have been filled with pro-military articles. Hence, Zaw Min Tun bears responsibility for junta propaganda and spreading disinformation through state media that are not reporting accurately. THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 22 April 2013, the Council adopted Decision 2013/184/CFSP (1).

(2)	On 22 March 2021 and 19 April 2021, the Council designated 21 persons and two entities in response to the military coup staged in Myanmar/Burma on 1 February 2021 and the ensuing military and police repression against civilians and peaceful demonstrators.

(4)	In view of the continuing grave situation in Myanmar/Burma, eight persons and four entities should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures in the Annex to Decision 2013/184/CFSP.

(5)	Decision 2013/184/CFSP should therefore be amended accordingly,

In that capacity, Lieutenant General Soe Htut is responsible for serious human rights violations committed by the Myanmar Police since the military coup of 1st February 2021, including killing of civilians and unarmed protesters, violations of freedom of association and peaceful assembly, arbitrary arrests and detention of opposition leaders and peaceful protesters and violations of freedom of expression. Additionally, as a member of the SAC, Lieutenant General Soe Htut has been directly involved in and responsible for decision making concerning state functions and is therefore responsible for undermining democracy and the rule of law in Myanmar/Burma. He is also directly responsible for the repressive decisions taken by the SAC, including legislation that violates human rights and limits freedoms of citizens of Myanmar, and for the serious human rights violations committed by the Myanmar security forces.
37.	Tun Tun, Naung (a.k.a. Tun Tun Naing; a.k.a. Htun Htun Naung)	Date of birth: 30 April 1963; Nationality: Myanmar/Burma; Gender: Male	Lieutenant General Tun Tun Naung is a member of the Myanmar Armed Forces (Tatmadaw) and was previously a Commander. He is the Minister of Border Affairs and member of the National Defence and Security Council. In 2013, Tun Tun Naung was the Northern Commander overseeing the Burmese military’s conflict with the Kachin Independence Army. In this conflict, the Myanmar troops under the command of Tun Tun Naung carried out serious human rights abuses and violations of international humanitarian law. In 2017, Tun Tun Naung was commanding officer of the “1st Bureau of Special Operations”. Under his command, troops committed atrocities and serious human rights violations against ethnic minorities in Rakhine state during the “Rohingya clearance operations”. These operations commenced on 25 August 2017 and involved arbitrary killings, physical abuse, torture, sexual violence, and detention of Rohingya people. As Commander in 2013 and 2017, Tun Tun Naung is responsible for serious human rights violations committed in Myanmar/Burma.	21.6.2021

On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. 			Admiral Tin Aung San was appointed Minister of Transport and Communication on 3 February 2021 by the State Administrative Council (SAC), led by Commander-in-Chief Min Aung Hlaing. As a Government Minister, he is responsible for communication and networks and thus makes decisions and implement policies that define the freedom of access to data on-line. Since he took over the ministry, there have been numerous shutdowns and deliberate slowing-downs of the internet, as well as orders for providers to prevent Facebook, Twitter and Instagram on-line. He is therefore directly responsible for limiting press freedom and access to information on-line and by doing so he is undermining democracy and rule of law in Myanmar/Burma. Being a member of the SAC, Tin Aung San has been directly involved in and responsible for decision making concerning state functions and is therefore responsible for undermining democracy and the rule of law in Myanmar/Burma. He is also directly responsible for the repressive decisions taken by the SAC, including legislation that violates human rights and limits freedoms of citizens of Myanmar, and for the serious human rights violations committed by the Myanmar security forces.

Daw Thida Oo	Nationality: Myanmar/Burma; Gender: Female	Thida Oo has been the Attorney-General of the Union of Myanmar since 2 February 2021, when she was appointed by the Commander-in-Chief of the Myanmar Armed Forces (Tatmadaw) Min Aung Hlaing. She is a member of the Myanmar Investment Commission (MIC). On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and overthrowing the democratically elected government. On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As Deputy Minister of Defence, Major General Aung Lin Tun is engaged in policies and activities undermining democracy and the rule of law in Myanmar/Burma as well as actions that threaten the peace, security and stability of the country. Additionally, being a member of the military regime, Major General Aung Lin Tun is directly responsible for serious human rights violations committed by the security forces against peaceful protesters.

Zaw Min Tun	Place of birth: Yenanchaung, Myanmar; Nationality: Myanmar/Burma; Gender: Male	Brigadier-General Zaw Min Tun is the Press Team Leader of the State Administrative Council and the Deputy Minister for Information. He was the former Head of the Tatmadaw’s True News Information Team. On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, staged a coup in Myanmar by setting aside the results of the elections held on 8 November 2020 and by overthrowing the democratically elected government. As part of the coup, Vice-President Myint Swe, functioning as Acting President, declared a state of emergency on 1 February and transferred the legislative, executive and judicial powers of the state to the Commander-in-Chief of Defence Services Senior General Min Aung Hlaing. On 2 February, the SAC was established to exercise those powers, preventing the democratically elected government from fulfilling its mandate. He was appointed SAC Press Team Leader on 5 February 2021 and Deputy Minister for Information on 7 February 2021 by the State Administrative Council (SAC) led by Commander-in-Chief Min Aung Hlaing. On 2 February 2021, the military regime appointed a new cabinet, including a new minister for Natural Resources and Environmental Conservation (MONREC). Through the SAC and the new cabinet, the military regime acquired control over and benefits from state-owned enterprises, including MTE. On 1 February 2021, the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, seized power from the civilian legitimate Government in a coup d’état and established the State Administration Council (SAC) to exercise legislative, executive and judicial powers of the State. On 2 February, the SAC was established to exercise those powers, preventing the democratically elected government from fulfilling its mandate.	21.6.2021’.
			According to MWVO’s mandate, the non-governmental organization acts as a reserve force of the Tatmadaw and takes part in shaping the national defence and security policy. Additionally, MWVO organizes pro-regime rallies and practises people’s militia, therefore supporting Tatmadaw carrying out activities undermining democracy and the rule of law Myanmar/Burma. The central patron group of MWVO is represented by high-ranking figures of Tatmadaw such as Commander-in-Chief Min Aung Hlaing and Deputy-Commander-in-Chief Soe Win. Members of the MWVO are part of the governance structure of the military-led conglomerates, the Myanmar Economic Holdings Limited (MEHL) and Myanmar Economic Corporation Limited (MEC). Therefore, MWVO is associated with persons and entities listed under Council Decision (CFSP) 2013/184 and Council Regulation (EU) No 401/2013.

implementing Decision 2012/642/CFSP concerning restrictive measures in view of the situation in Belarus

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 31(2) thereof,

Having regard to Council Decision 2012/642/CFSP of 15 October 2012 concerning restrictive measures in view of the situation in Belarus (1), and in particular Article 6(1) thereof,

Having regard to the proposals from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 15 October 2012, the Council adopted Decision 2012/642/CFSP.

On 2 October 2020, the Council adopted Implementing Decision (CFSP) 2020/1388 (2) which designated 40 persons identified as responsible for the repression and intimidation of peaceful demonstrators, opposition members and journalists in the wake of the 2020 presidential elections in Belarus, as well as for the Central Electoral Commission’s misconduct of the electoral process for those elections.

(4)	On 6 November 2020, in view of the gravity of the situation in Belarus, the Council adopted Implementing Decision (CFSP) 2020/1650 (3), which designated Aliaksandr Lukashenka and 14 other persons, among them persons from his close circle.

(5)	On 17 December 2020, in view of the repression of civil society in Belarus the Council adopted Implementing Decision (CFSP) 2020/2130 (4), which designated 29 persons and 7 entities.

(6)	Given the escalation of the serious human rights violations in Belarus, and the violent repression of civil society, democratic opposition and journalists as well as of persons belonging to national minorities, additional designations of persons and entities should be adopted.

(8)	78 persons and 7 entities should therefore be added to the list of persons and entities subject to restrictive measures set out in the Annex to Decision 2012/642/CFSP,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 2012/642/CFSP is hereby amended as set out in the Annex to this Decision.

Article 2

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

As the Head of the Intergovernmental Commission created by the Office of the General Prosecutor to investigate citizens' complaints about abuse of powers by law enforcement officers, Dzmitry Hara is responsible for inaction of this institution, since no case of such an investigation is known, despite applications for the initiation of criminal cases complaining about the use of violence, ill-treatment and torture.

As of March 2021, he is the Chairman of the Investigative Committee of Belarus. In this position he is responsible for prosecuting human rights defenders and participants in peaceful protests.

He made public comments condemning the sportsmen of Belarus expressing their protests against the Lukashenka regime, namely protesting against violence and persecution of peaceful protesters, journalists, human rights activists. He publicly demanded these sportsmen to return all money the state had invested in them.

He therefore benefits from and supports the Lukashenka regime.

Mikhail Gutseriev is a prominent Russian businessman, with business interests in Belarus in the sectors of energy, potash, hospitality and others. He is a long-time friend of Aliaksandr Lukashenka and thanks to this association has accumulated significant wealth and influence among the political elite in Belarus. “Safmar”, a company controlled by Gutseriev, was the only Russian oil firm that carried on supplying oil to Belarussian refineries during the energy crisis between Belarus and Russia in early 2020.

Gutseriev also supported Lukashenka in disputes with Russia over oil deliveries. Gutseriev owns the “Slavkali” company, which is building Nezhinsky potassium chloride mining and processing plant based on the Starobinsky potash salt deposit near Lyuban. It is the largest investment in Belarus, worth $2 billion. Lukashenka promised to rename the town of Lyuban to Gutserievsk in his honor. His other businesses in Belarus include “Slavneft” fueling stations and oil depots, a hotel, a business center and an airport terminal in Minsk. Lukashenka came to Gutseriev’s defense after criminal investigation was initiated against him in Russia. Lukashenka also thanked Gutseriev for his financial contributions to charity and investments of billions of dollars in Belarus. Gutseriev is reported to have gifted Lukashenka luxurious presents.

He also declared to be the owner of a residency, which de facto belongs to Lukashenka, thus covering him up when journalists started to investigate Lukashenka’s assets. Gutseriev is reported to have attended Lukashenka’s secret inauguration on 23 September 2020. In October 2020 Lukashenka and Gutseriev both appeared at the opening on an orthodox church, which the latter sponsored. According to media reports, when the striking employees of Belarusian state-owned media were fired in August 2020, Russian media workers were flown to Belarus on board of aircraft belonging to Gutseriev in order to replace the fired workers, and lodged in hotel Minsk Renaissance belonging to Gutseriev. Mikhail Gutseriev is therefore benefitting from and supporting the Lukashenka regime.

He is the co-owner of “Bremino Group” – the initiator and co-administrator of the Bremino-Orsha special economic zone project, created by a presidential decree signed by Aliaksandr Lukashenka. The company has received state support for developing the Bremino-Orsha zone, as well as a number of financial and tax advantages and other benefits. Aleksin and other owners of Bremino Group received support from Viktar Lukashenka.

Companies “Inter Tobacco” and “Energo-Oil”, which belong to Aleksin and members of his close family, were given exclusive privileges to import tobacco products to Belarus, based on a decree signed by Aliaksandr Lukashenka, and received state support for the creation of Tabakierka kiosks. He was allegedly involved in the establishment of the first government-approved private military company in Belarus “GardServis”, with reported links to the Belarussian security apparatus. He is therefore benefitting from the Lukashenka regime.

This politically motivated decision was aimed at arresting and detaining opposition journalist Raman Pratasevich and Sofia Sapega and is a form of repression against civil society and democratic opposition in Belarus.

He has made several public statements, declaring readiness to use the army against peaceful protesters in August 2020 and likening protesters' use of the historical white-red-white flag to Nazi collaborators.

OJSC BelAZ has offered its premises and equipment to stage a political rally in support of the regime. Therefore OJSC “Belaz” benefits from and supports the Lukashenka regime. The employees of OJSC “Belaz” who took part in strikes and peaceful protests in the aftermath of the fraudulent August 2020 elections in Belarus were threatened with layoffs and intimidated by the company management. A group of employees was locked indoors by OJSC Belaz to prevent them from joining the other protesters. The company management presented a strike to the media as a staff meeting. Therefore OJSC “Belaz” is responsible for the repression of civil society and supports the Lukashenka regime.	21.6.2021

It is the only private company entitled to export oil products from Belarus - an indication of close links to the authorities and highest level of state privileges. NNK is owned by Interservice, a company belonging to Mikalai Varabei who is one of the leading businessmen benefitting from and supporting the Lukashenka regime. NNK is also reported to be connected to Aliaksei Aleksin, another prominent Belarusian businessman who benefits from the Lukashenka regime. According to media reports Aleskin was the founder of NKK alongside Varabei. NNK was also used by the Belarusian authorities to adapt the Belarusian economy to restrictive measures introduced by the EU. NNK is therefore benefitting from the Lukashenka regime.	21.6.2021’
