COMMISSION DECISION (EU) 2021/986
of 29 April 2021
approving the Decision of the Supply Agency of the European Atomic Energy Community adopting new Agency Rules to determine the manner in which demand is to be balanced against the supply of ores, source materials and special fissile materials
(notified under document C(2021) 2893)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 60, sixth subparagraph thereof,
Whereas:
(1) |
Pursuant to Article 2 of the Treaty establishing the European Atomic Energy Community (the ‘Euratom Treaty’), the European Atomic Energy Community is to ensure that all users in the Community receive a regular and equitable supply of ores and nuclear fuels, by means of a common supply policy based on the principle of equal access to sources of supply. |
(2) |
For that purpose, Article 52(2), point (b) of the Euratom Treaty established an Agency. |
(3) |
Rules adopted by the Agency require approval by the Commission, and are to determine the manner in which demand is to be balanced against supply of ores, source materials and special fissile materials. |
(4) |
The Agency, acting pursuant to the Euratom Treaty and its own statutes, adopted, by its Decision of 15 January 2021, new rules to update and replace the Agency rules currently in force. |
(5) |
Pursuant to Article 60, sixth subparagraph of the Euratom Treaty, the Agency rules should be approved by the Commission, |
HAS ADOPTED THIS DECISION:
Article 1
The Decision of the Supply Agency of the European Atomic Energy Community of 15 January 2021 adopting Agency Rules determining the manner in which demand is to be balanced against the supply of ores, source materials and special fissile materials, and repealing the Rules of the Supply Agency of the European Atomic Energy Community of 5 May 1960 is hereby approved.
Article 2
This Decision shall take effect on 1 July 2021.
Article 3
This Decision is addressed to the Supply Agency of the European Atomic Energy Community. It shall be published in the Official Journal of the European Union.

excluding from European Union financing certain expenditure incurred by the United Kingdom under the European Agricultural Guarantee Fund (EAGF) and under the European Agricultural Fund for Rural Development (EAFRD)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1306/2013 of 17 December 2013 on the financing, management and monitoring of the common agricultural policy and repealing Council Regulations (EEC) No 352/78, (EC) No 165/94, (EC) No 2799/98, (EC) No 814/2000, (EC) No 1290/2005 and (EC) No 485/2008 (1), and in particular Article 52 thereof, in conjunction with Articles 131 and 138 of the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community,
After consulting the Committee on the Agricultural Funds,
Whereas:

In accordance with Article 52 of Regulation (EU) No 1306/2013, the Commission is to carry out the necessary verifications, communicate to the United Kingdom the results of those verifications, take note of the comments provided by the United Kingdom, initiate a bilateral discussion so that an agreement may be reached and formally communicate its conclusions to the United Kingdom. |
(2) |
The United Kingdom has had an opportunity to request the launch of a conciliation procedure, but did not request it. |
(3) |
In accordance with Regulation (EU) No 1306/2013, only agricultural expenditure, which has been incurred in a way that has not infringed Union law may be financed. |
(4) |
In the light of the verifications carried out and the outcome of the bilateral discussion, part of the expenditure declared by the United Kingdom does not fulfil this requirement and cannot therefore be financed under the EAGF and the EAFRD. |
(5) |
The amounts that are not recognised as being chargeable to the EAGF and the EAFRD should be indicated. Those amounts do not relate to expenditure incurred more than 24 months before the Commission’s written notification of the results of the verifications to the United Kingdom. |
(6) |
The amounts excluded from Union financing by this Decision should also take into account any reductions or suspensions in accordance with Article 41 of Regulation (EU) No 1306/2013 due to the fact that such reductions or suspensions are of a provisional nature and without prejudice to decisions taken pursuant to Articles 51 or 52 of that Regulation. |
(7) |
As regards the cases covered by this Decision, the assessment of the amounts to be excluded on grounds of non-compliance with Union law was notified by the Commission to the United Kingdom in a summary report on the subject (2). |
(8) |
This Decision is without prejudice to any financial conclusions that the Commission may draw from the judgments of the Court of Justice of the European Union in cases pending on 31 March 2021, |
HAS ADOPTED THIS DECISION:
Article 1
The amounts set out in the Annex and related to expenditure incurred by the United Kingdom’s accredited paying agencies and declared under the EAGF and the EAFRD shall be excluded from Union financing.
Article 2
This Decision is addressed to the United Kingdom of Great Britain and Northern Ireland.

COMMISSION IMPLEMENTING DECISION (EU) 2021/989
of 17 June 2021
amending the Annex to Implementing Decision (EU) 2021/641 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States
(notified under document C(2021) 4257)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(1), point (c) thereof,
Whereas:

Highly pathogenic avian influenza (HPAI) is an infectious viral disease in birds and may have a severe impact on the profitability of poultry farming causing disturbance to trade within the Union and exports to third countries. HPAI viruses can infect migratory birds, which can then spread these viruses over long distances during their autumn and spring migrations. Therefore, the presence of HPAI viruses in wild birds poses a continuous threat for the direct and indirect introduction of these viruses into holdings where poultry or captive birds are kept. In the event of an outbreak of HPAI, there is a risk that the disease agent may spread to other holdings where poultry or captive birds are kept. |

Regulation (EU) 2016/429 establishes a new legislative framework for the prevention and control of diseases that are transmissible to animals or humans. HPAI falls within the definition of a listed disease in that Regulation, and it is subject to the disease prevention and control rules laid down therein. In addition, Commission Delegated Regulation (EU) 2020/687 (2) supplements Regulation (EU) 2016/429 as regards the rules for the prevention and control of certain listed diseases, including disease control measures for HPAI. |

Commission Implementing Decision (EU) 2021/641 (3) was adopted within the framework of Regulation (EU) 2016/429, and it lays down disease control measures in relation to outbreaks of HPAI. |

More particularly, Implementing Decision (EU) 2021/641 provides that the protection and surveillance zones established by the Member States following outbreaks of HPAI, in accordance with Delegated Regulation (EU) 2020/687, are to comprise at least the areas listed as protection and surveillance zones in the Annex to that Implementing Decision. |

The Annex to Implementing Decision (EU) 2021/641 was recently amended by Commission Implementing Decision (EU) 2021/906 (4) following further outbreaks of HPAI in poultry or captive birds in Germany, Lithuania, the Netherlands and Poland that needed to be reflected in that Annex. |

Since the date of adoption of Implementing Decision (EU) 2021/906, Poland has notified the Commission of new outbreaks of HPAI of subtype H5N8 in holdings where poultry or captive birds were kept in the Mazowieckie voivodeship of that Member State. |

In addition, the Netherlands has notified the Commission of a new outbreak of HPAI of subtype H5N8 in a holding where captive birds were kept in the Utrecht province of that Member State. |

The new outbreaks in Poland are located within the boundaries of the areas currently listed in the Annex to Implementing Decision (EU) 2021/641. However, the boundaries of the new protection and surveillance zones around these new outbreaks, established by the competent authorities of Poland in accordance with Delegated Regulation (EU) 2020/687 go beyond the areas currently listed in the Annex to Implementing Decision (EU) 2021/641, and accordingly the areas listed in that Annex need to be updated. |

The new outbreak in the Netherlands is located outside the areas currently listed in the Annex to Implementing Decision (EU) 2021/641 and the competent authorities of that Member State have taken the necessary disease control measures required in accordance with Delegated Regulation (EU) 2020/687, including the establishment of protection and surveillance zones around this new outbreak. |

The Commission has examined the disease control measures taken by the Netherlands and Poland in collaboration with those Member States, and it is satisfied that the boundaries of the protection and surveillance zones, established by the competent authorities of the Netherlands and Poland are at a sufficient distance to any holding where the recent outbreaks of HPAI has been confirmed. |

In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with the Netherlands and Poland, the new protection and surveillance zones established by those Member States in accordance with Delegated Regulation (EU) 2020/687. |

Therefore, the protection and surveillance zones listed for the Netherlands and Poland in the Annex to Implementing Decision (EU) 2021/641 should be amended. |

Accordingly, the Annex to Implementing Decision (EU) 2021/641 should be amended to update regionalisation at Union level to take account of the new protection and surveillance zones duly established by the competent authorities of the Netherlands and Poland in accordance with Delegated Regulation (EU) 2020/687 and the duration of the restrictions applicable therein. |

Implementing Decision (EU) 2021/641 should therefore be amended accordingly. |
(15) |
Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI, it is important that the amendments to be made to the Annex to Implementing Decision (EU) 2021/641 by this Decision take effect as soon as possible. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Implementing Decision (EU) 2021/641 is replaced by the text set out in the Annex to this Decision.
Article 2
This Decision is addressed to the Member States.

Die östliche Begrenzung des Sperrbezirks verläuft entlang der Stadtgrenze zu Bremen und dem Landkreis Diepholz bis zum Schnittpunkt mit der Varreler Landstr., entlang dieser in westlicher Richtung bis zur Syker Str. und von dort in nordwestlicher Richtung bis zur Langenwischstr., hier weiter bis zum Schnittpunkt mit der Tannenbergstr. und in nördlicher Richtung weiter bis zur Bremer Straße. Weiter über Kreuzweg, Sommerweg links in den Sommergarten. Hier entlang einer gedachter Linie über die Bahn und den Bürgerkampweg bis zur Heidkruger Bäke, weiter durch Brandhöfen bis zum Ende der Straße Auf dem Alrusch, weiter entlang Fuhlriedeweg und entlang einer gedachten Linie bis zur Ochtum und dieser folgend bis zur Stadtgrenze zu Bremen. |

Landkreis Diepholz Das Gebiet umfasst einen Teil der Gemeinde Stuhr im nördlichen Kreisgebiet. Er beginnt östlich vom Grollander See entlang der Kreisgrenze und verläuft südöstlich bis zur Einmündung in den Stuhrgraben. Entlang des Stuhrgrabens verläuft er in südwestlicher Richtung bis zur L 337 und folgt dieser in Richtung Stuhr bis zum Schnittpunkt mit der „Stuhrer Landstraße“. Die Grenze des Sperrbezirks folgt dieser bis zur „Blockener Straße“ (K 111). Der „Blockener Straße“ folgt sie in Richtung der Autobahn A 1 bis zur Einmündung in den „Barkener Weg“. Dann folgt sie dem „Barkener Weg“ in westlicher Richtung bis zum Schnittpunkt mit der „Moordeicher Landstraße“ (L 336). Dieser folgt sie in südwestlicher Richtung bis zur Einmündung in den „Birkenweg“. Danach verläuft sie über die Straße „Am Wilshauser Moor“ über die „Wilshauser Straße“ bis zur Kreuzung mit der „Schulstraße“ in Richtung Varrel. Von der „Schulstraße“ aus führt sie über die „Holländer Straße“ bis zur Einmündung in die „Delmenhorster Straße“. Der „Delmenhorster Straße“ folgt sie in nordwestlicher Richtung bis zur Kreuzung „Syker Straße“/ „Varreler Landstraße“, wo die Kreisgrenze verläuft. Die westliche Grenze des Sperrbezirkes verläuft entlang der Kreisgrenze in nördlicher, später nord-östlicher Richtung bis zum Ausgangspunkt östlich des Grollander Sees. |

Stadt Delmenhorst Das Gebiet umfasst Teile im nordöstlichen Bereich der Stadt Delmenhorst an der Grenze zu Bremen. Die östliche Begrenzung des Sperrbezirks verläuft entlang der Stadtgrenze zu Bremen und dem Landkreis Diepholz bis zum Schnittpunkt mit der Varreler Landstr., entlang dieser in westlicher Richtung bis zur Syker Str. und von dort in nordwestlicher Richtung bis zur Langenwischstr., hier weiter bis zum Schnittpunkt mit der Tannenbergstr. und in nördlicher Richtung weiter bis zur Bremer Straße. Weiter über Kreuzweg, Sommerweg links in den Sommergarten. Hier entlang einer gedachter Linie über die Bahn und den Bürgerkampweg bis zur Heidkruger Bäke, weiter durch Brandhöfen bis zum Ende der Straße Auf dem Alrusch, weiter entlang Fuhlriedeweg und entlang einer gedachten Linie bis zur Ochtum und dieser folgend bis zur Stadtgrenze zu Bremen. |

Landkreis Diepholz Das Gebiet beginnt an der östlichen Kreisgrenze in Höhe der A 1 und verläuft dann in südöstlicher Richtung entlang der Weser bis zur Schnittstelle mit der Bahnlinie und folgt dieser in Richtung Osnabrück in südlicher Richtung. An der Schnittstelle mit der Straße „Am Weitufer“ folgt sie dieser bis zum Übergang in „Im Bruch“. Der Straße „Im Bruch“ folgt die Grenze des Beobachtungsgebietes weiterhin in südlicher Richtung bis zur Einmündung in die Hauptstraße (L 335). Der L 335 folgt sie kurz in Richtung Leeste und mündet an der Kreuzung „Rumpsfelder Heide“/ „Rathausplatz“ in die „Rumpsfelder Heide“ ein. Diese folgt im weiteren Verlauf der „Rumpsfelder Heide“ bis zur Einmündung in „Hinter dem Felde“. Der Straße „Hinter dem Felde“ folgt sie bis zur Kreuzung mit der „Melchiorshauserstraße“, in die sie in Richtung B 6 einmündet. Sie überquert die Kreuzung „Syker Straße“/ B 6 und folgt der „Ristedter Straße“ bis zur Schnittstelle mit den Bahngleisen, denen sie entlang der Kreisgrenze bis zur Schnittstelle mit dem „Heudamm“ folgt. Dem „Heudamm“ folgt sie kurz in Richtung der Straße „Zum Heidkönig“, der sie bis zur Einmündung in die „Ristedter Straße“ (K 113) folgt. Ausgehend von der „Ristedter Straße“ verläuft die Grenze des Beobachtungs-gebietes dann durch Warwe entlang der „Warwer Straße“(K 114) in Richtung Fahrenhorst. Ab der Kreuzung mit der Straße B 51 verläuft sie über die „Kirchseelter Straße“ und die „Waldstraße“ über den „Bargweg“ auf den „Kettinger Mühlenweg“ bis zur Einmündung in die L 338 „Wildeshauser Straße“, auf der die Kreisgrenze verlauft. Die westliche Grenze des Beobachtungsgebietes verläuft dann entlang der Kreisgrenze nordwestlich in Richtung Bremen bis sie zum nordöstlichen Ausgangspunkt zurückkehrt. |

Landkreis Diepholz Das Gebiet umfasst einen Teil der Gemeinde Stuhr im nördlichen Kreisgebiet. Er beginnt östlich vom Grollander See entlang der Kreisgrenze und verläuft südöstlich bis zur Einmündung in den Stuhrgraben. Entlang des Stuhrgrabens verläuft er in südwestlicher Richtung bis zur L 337 und folgt dieser in Richtung Stuhr bis zum Schnittpunkt mit der „Stuhrer Landstraße“. Die Grenze des Sperrbezirks folgt dieser bis zur „Blockener Straße“ (K 111). Der „Blockener Straße“ folgt sie in Richtung der Autobahn A 1 bis zur Einmündung in den „Barkener Weg“. Dann folgt sie dem „Barkener Weg“ in westlicher Richtung bis zum Schnittpunkt mit der „Moordeicher Landstraße“ (L 336). Dieser folgt sie in südwestlicher Richtung bis zur Einmündung in den „Birkenweg“. Danach verläuft sie über die Straße „Am Wilshauser Moor“ über die „Wilshauser Straße“ bis zur Kreuzung mit der „Schulstraße“ in Richtung Varrel. Von der „Schulstraße“ aus führt sie über die „Holländer Straße“ bis zur Einmündung in die „Delmenhorster Straße“. Der „Delmenhorster Straße“ folgt sie in nordwestlicher Richtung bis zur Kreuzung „Syker Straße“/ „Varreler Landstraße“, wo die Kreisgrenze verläuft. Die westliche Grenze des Sperrbezirkes verläuft entlang der Kreisgrenze in nördlicher, später nord-östlicher Richtung bis zum Ausgangspunkt östlich des Grollander Sees. |

Decision of the Supply Agency of the European Atomic Energy Community adopting the Agency Rules determining the manner in which demand is to be balanced against the supply of ores, source materials and special fissile materials, and repealing the Rules of the Supply Agency of the European Atomic Energy Community of 5 May 1960, as amended by the Regulation of 15 July 1975
THE SUPPLY AGENCY,
Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Articles 2(d), 52, 55 and 60(6) thereof,
Having regard to the Statutes of the Euratom Supply Agency, established by Council Decision No 2008/114/EC, Euratom of 12 February 2008 (1), and in particular to Article 13(3)(a) thereof,
Having regard to Commission Regulation (Euratom) No 66/2006 of 16 January 2006 exempting the transfer of small quantities of ores, source materials and special fissile materials from the rules of the chapter on supplies (2),
Having regard to the Opinion that the Agency’s Advisory Committee, duly consulted and convened, delivered on the proposed new Rules on 13 May 2016,
Whereas:

The European Atomic Energy Community, pursuant to Article 2 of the Treaty establishing it (‘the Treaty’), shall ensure that all users in the Community receive a regular and equitable supply of ores and nuclear fuels, by means of a common supply policy based on the principle of equal access to sources of supply. |
(2) |
In the interest of the common supply policy, a Supply Agency (‘the Agency’ or the ‘Euratom Supply Agency’) was established by Chapter 6 of the Treaty. |
(3) |
Security of energy supply, which is the Agency’s main purpose, is a key objective of the Union policy on energy, as per Article 194 of the Treaty on the Functioning of the European Union. It has been reaffirmed in the Commission Communication on the European Energy Security Strategy (3), adopted in 2014 and endorsed by the Council. |
(4) |
In accordance with Article 60(6) of the Treaty, Agency rules, which shall require approval by the Commission, shall determine the manner in which demand is to be balanced against supply. |
(6) |
Since the 1970s, the development of new fuel cycle technologies and products, as well as the emergence of new market actors (notably, intermediaries) and new trade practices have substantially affected the Agency’s role in security of nuclear supply. At the same time, the number of actors in the market has increased considerably. |
(7) |
The Agency’s Statutes, established in 2008, enhanced its role in monitoring the market and providing relevant expertise, information and advice to the Community, hence reinforcing the need for the Agency to have a complete and up-to-date knowledge of the market in nuclear materials and services, including of the world market trends. |
(8) |
As a consequence of the above developments, the 1960/1975 Rules of the Agency no longer allow the Euratom Supply Agency to respond to developments in the nuclear market and may put at risk the Agency’s capacity to carry out its mission. |
(9) |
They need to be adapted in order to enhance legal certainty for the industry, the Member States and the European Commission, and to enable the Agency to ensure appropriate data collection for its Market Observatory. |
(10) |
Under Article 55 of the Treaty, the Agency is entitled to receive all information it needs to be able to exercise its right of option and its exclusive right to conclude supply contracts. |
(11) |
In fulfilling its tasks, the Agency acts pursuant to the principles of non-discrimination and equal access to sources of supply. |
(12) |
The procedures for balancing demand against supply must be determined in a way that makes it possible to meet needs under various supply situations. |
(13) |
It is appropriate to maintain direct contracting between users, producers and intermediaries, as long as the regular supply of nuclear materials to Community users is ensured. |
(14) |
In the light of the foregoing, the Agency took the initiative to update its Rules, in cooperation with its stakeholders. The Agency's Advisory Committee, duly convened and consulted on 13 May 2016, delivered a favourable opinion on the new Rules. |
(15) |
Pursuant to the Agency’s Statutes, its Rules are to be adopted by decision of the Agency’s Director General, requiring approval by the Commission. |
(16) |
For the sake of clarity, the Agency’s current Rules should be repealed upon the entry into force of the new ones. |
(17) |
It is, therefore, appropriate to adopt the Rules annexed to the present Decision and, upon their entry into force, repeal the Agency’s Rules currently in force, |
HAS ADOPTED THE FOLLOWING DECISION:
Article 1
The Rules of the Supply Agency of the European Atomic Energy Community, as they stand in the Annex of this Decision, determining the manner in which demand is to be balanced against the supply of ores, source materials and special fissile materials are hereby adopted.
Article 2
The Rules of the Supply Agency of the European Atomic Energy Community determining the manner in which demand is to be balanced against the supply of ores, source materials and special fissile materials, as they are currently in force (6), shall be repealed upon the entry into force of the new ones.
Article 3
This Decision shall enter into force on 1 July 2021, subject to its approval by the European Commission. It shall be published in the Official Journal of the European Union jointly with the Commission decision approving it.

SCOPE, DEFINITIONS AND GENERAL PRINCIPLES
Article 1
Scope
These Rules determine the manner in which demand is to be balanced against supply of ores, source materials and special fissile materials.
Article 2
Definitions
For the purpose of these Rules, the following definitions apply:
(1) |
‘Agency’ means the Euratom Supply Agency established by the Treaty; |
(2) |
‘Community’ means the European Atomic Energy Community (Euratom); |
(3) |
‘Community production’ means nuclear materials produced in the Community, including but not limited to:

(4) |
‘intermediary’ means any person or undertaking that purchases nuclear materials with the purpose of re-selling them as such; |
(5) |
‘nuclear materials’ means any of the ores, source materials and special fissile materials as defined in Article 197 of the Treaty; |
(6) |
‘ores’ has the meaning given to it in Article 197(4) of the Treaty; |
(7) |
‘person’ has the meaning given to it in Article 196 (a) of the Treaty; |
(8) |
‘producer’ means any person or undertaking that produces, processes, converts or shapes ores, source materials or special fissile materials; |
(9) |
‘proformae’ refers to the Agency’s end-of-year questionnaires collecting data directly from users; |
(10) |
‘related services’ means one of the following services: conversion, enrichment, fuel fabrication, reprocessing or storage of special fissile materials; |
(11) |
‘Rules’ means these Rules of the Supply Agency of the European Atomic Energy Community determining the manner in which demand is to be balanced against the supply of ores, source materials and special fissile materials; |
(12) |
‘small quantities’ means the quantities defined in the Small Quantities Regulation; |
(13) |
‘Small Quantities Regulation’ means Commission Regulation (Euratom) No 66/2006 of 16 January 2006exempting the transfer of small quantities of ores, source materials and special fissile materials from the rules of the chapter on supplies, and any future versions thereof; |
(14) |
‘source materials’ has the meaning given to it in Article 197(3) of the Treaty; |
(15) |
‘special fissile materials’ has the meaning given to it in Article 197(1) of the Treaty; |
(16) |
‘supply contract’ means:

‘Treaty’ means the Treaty establishing the European Atomic Energy Community; |
(18) |
‘undertaking’ has the meaning given to it in Article 196 (b) of the Treaty; |
(19) |
‘user’ means any person or undertaking that buys nuclear materials or related services to use in its own or affiliated nuclear power plants or research reactors within the Community or to use in the fields listed in Annex 1 to the Treaty; |
(20) |
‘working day’ refers to the working days of the Agency, as published on the Agency’s website. |
Article 3
Confidentiality
Contracts, notifications and any other information related to contracts communicated to the Agency shall not be disclosed to any third party without the written permission of the contracting parties.
CHAPTER 2
SUBMISSION OF INFORMATION
Article 4
Submission of information by users
1. When requested to do so by the Agency, users shall fill out and submit the proformae for a given year by 31 January of the following year.
2. The proformae shall specify, among others:
(a) |
designation of the product; |
(b) |
supplier; |
(c) |
nature, chemical form and other relevant specifications of nuclear materials; |
(d) |
quantities (in metric units); |
(e) |
country of origin of natural uranium (if known); |
(f) |
actual and/or intended use; |
(g) |
delivery dates; |
(h) |
price terms; |
(i) |
stocks; |
(j) |
estimated future requirements. |
Article 5
Submission of information by producers
1. When requested to do so by the Agency, producers shall notify the Agency of their current and estimated future production, and that of all their majority-owned subsidiaries. They shall also notify the Agency of their planned deliveries and of stocks owned and/or held by them, based on contracts already signed.
2. The information shall include:
(a) |
designation of the product; |
(b) |
counterparties; |
(c) |
nature, chemical form and other relevant specifications of nuclear materials; |
(d) |
quantities (in metric units); |
(e) |
country of origin of natural uranium (if known); |
(f) |
delivery year; |
(g) |
price terms (if known); |
(h) |
uranium stocks, including information about availability for sale; |
(i) |
estimated future production. |
3. The information shall be communicated to the Agency within 20 (twenty) working days from the date on which the request is received.
Article 6
Submission of information by intermediaries
1. Intermediaries shall communicate to the Agency information on any contracts other than supply contracts for the purchase, sale, exchange, loan or lease of ores and/or source materials signed during the previous month. They shall do so on a monthly basis.
2. The information shall cover, among others:
(a) |
designation of the product; |
(b) |
counterparties; |
(c) |
nature, chemical form and other relevant specifications of nuclear materials; |
(d) |
quantities (in metric units); |
(e) |
country of origin of natural uranium (if known); |
(f) |
delivery dates; |
(g) |
price terms. |
3. The information shall be communicated to the Agency within 15 (fifteen) working days of the end of the month concerned.
Article 7
Submission of additional information
When requested to do so by the Agency, users, producers and intermediaries shall communicate to the Agency any additional information it needs to be able to perform the tasks conferred upon it by the Treaty. The information shall be communicated to the Agency within 10 (ten) working days from the date on which the request is received (or, upon a justified request, a longer period of time as agreed by the Agency in writing).
Article 8
Analysis based on information received
1. Based on the information provided under Articles 4, 5, 6 and 7 of the Rules and on additional information communicated by market participants, the Agency shall analyse market trends and supply potential. It shall include the main results of this analysis in its Annual Report, to be published on its website by 30 June every year.
2. The Agency shall also publish its uranium price indices and additional reports on the market for nuclear materials, including reports resulting from working groups established by the Advisory Committee.
CHAPTER 3
SUPPLY CONTRACTS
Article 9
Conclusion of supply contracts
1. Supply contracts are void unless concluded by the Agency.
2. The Agency concludes a supply contract by signing it.
Article 10
Procedures applicable to the conclusion of supply contracts
1. The following procedures apply to supply contracts:
(a) |
simplified procedure; |
(b) |
centralised procedure, following the Agency’s decision if the regular supply of nuclear materials is endangered. |
2. Implementation of the simplified procedure does not deprive the Agency of the exclusive rights conferred upon it by the Treaty.
Article 11
Simplified procedure
1. Users are authorised to invite tenders directly from producers, intermediaries or other users of their choice and to negotiate the supply contract freely.
2. The supply contract shall include at least the following information:
(a) |
designation of the contracting parties, including the Agency; |
(b) |
quantities of materials to be supplied or the methodology used to determine such quantities; |
(c) |
chemical form of the materials to be supplied; |
(d) |
country of origin of the nuclear materials to be supplied; if this is unknown when the supply contract is signed, the user shall communicate it to the Agency in writing as soon as possible; |
(e) |
schedule of deliveries (if it is known when the supply contract is signed); |
(f) |
place of delivery; |
(g) |
mode of delivery (physical or book transfer); |
(h) |
price and terms of payment including, where applicable, the method used to calculate the price; |
(i) |
duration of the supply contract; |
(j) |
the date(s) on which the parties signed the supply contract. |
3. All originals of the supply contract shall be submitted to the Agency for signature within 10 (ten) working days from the date on which the contract is signed by all parties except the Agency (or, upon a justified request, a longer period of time agreed by the Agency in writing).
4. Originals of the supply contract shall be accompanied by a completed submission form, available on the Agency’s website.
5. Except in cases where Article 15 of the present Rules is applicable, the Agency shall decide on the conclusion of the contract within 10 (ten) working days from the date on which it receives it, provided that all the information required has been communicated to the Agency. If the Agency requests additional information, this time period will start once the Agency receives all the information required for it to be able to perform the task of supervising sources of supply.
6. If the Agency concludes the supply contract, it will keep one original for its records and return the remaining originals to the party that has sent them, informing it about the reference number attributed.
7. If the Agency establishes that the regular and equitable supply of nuclear materials to Community users is endangered, it may decide to suspend the application of this simplified procedure and revert to the centralised procedure provided for in Article 12 of the Rules.
Article 12
Centralised procedure
1. This procedure applies if the Agency establishes that the regular supply of nuclear materials to users is endangered, including but not limited to situations where nuclear materials are not available to users within a reasonable period of time or are available only at excessively high prices.
2. The Agency’s decision to suspend the application of the simplified procedure and defining the scope of application of the centralised procedure takes effect upon its publication in the Official Journal of the European Union.
3. In such situations, nuclear materials can only be supplied to and/or exchanged with non-Community customers after the requirements of Community users have been met.
4. A supply contract signed by the parties before the Agency’s decision under paragraph 2 of this Article is published shall be processed in accordance with the procedure applicable on the date on which the parties sign the contract.
Article 13
Modifications made to supply contracts
1. Any modifications (amendments, supplements, side letters, assignment agreements, mutually agreed terminations) to a supply contract must be concluded by the Agency, in accordance with the procedure used for the original contract.
2. In the event of a unilateral notice of cancellation of a supply contract, the Agency shall be notified within 10 (ten) working days from the date on which the unilateral cancellation notice is sent or received, as applicable.
Article 14
Refusal to conclude a supply contract
1. Within the framework of either procedure referred to in Article 10 of the Rules, the Agency has the right to object to a contract which might prejudice the achievement of the Treaty’s objectives.
2. If the Agency decides not to conclude a supply contract, it shall inform the parties concerned in a reasoned decision and return all submitted documents to the party that had submitted them.
3. The Agency may decide not to conclude a supply contract, in particular if a clarification requested by the Agency is not submitted within 10 (ten) working days from the request being received.
4. This decision or a lack of decision may be referred to the Commission in accordance with the provisions of Article 5(5) of the Statutes of the Agency.
Article 15
Commission authorisation
1. A prior Commission authorisation is needed for the export of Community production (Articles 59 (b) and 62.1 (c) of the Treaty) and for the conclusion of supply contracts with a duration of more than 10 years (Article 60 of the Treaty).
2. In these cases, the Agency initiates the procedure for obtaining Commission authorisation.
CHAPTER 4
NOTIFICATION OF CONTRACTS FOR RELATED SERVICES AND FOR SMALL QUANTITIES
Article 16
Contracts for related services
1. Contracts for related services under Article 75 of the Treaty shall be notified to the Agency within 10 (ten) working days from the date on which they are signed (or, upon a justified request, a longer period of time as agreed by the Agency in writing).
2. The notification shall include at least the following information:
(a) |
designation of the contracting parties; |
(b) |
known or estimated quantities of materials concerned; |
(c) |
chemical form of the materials concerned; |
(d) |
country of origin of the materials concerned; if this is unknown when the contract is signed, it shall be communicated to the Agency in writing as soon as possible; |
(e) |
schedule of deliveries; |
(f) |
place of delivery; |
(g) |
duration of the contract; |
(h) |
the date(s) on which the parties signed the contract. |
3. Notification of the contract shall be made using the form available on the Agency’s website.
4. The Agency shall acknowledge the notification and communicate the reference number attributed to the contract within 15 (fifteen) working days from the date on which it receives it, provided that all the information required has been communicated to the Agency.
5. If the Agency requests additional information, the time period specified in paragraph 4 of this Article will be interrupted by this request and will start anew when the information is received.
6. Any modification of the initial contract as regards one of the items referred to in paragraph 2 above, including cancellation of the contract, shall be notified to the Agency in accordance with the procedure set out in this article.
7. If a contract for related services includes provisions relating to the supply of nuclear materials, it shall be treated as a supply contract and shall be submitted to the Agency for conclusion.
Article 17
Contracts for small quantities
1. Any transfer, import or export of small quantities of ores, source materials and special fissile materials shall be notified to the Agency.
2. Any person who imports or exports small quantities and any supplier who transfers small quantities within the Community shall submit a quarterly statement of such transactions to the Agency.
3. Quarterly statements shall be submitted to the Agency within one month from the end of the quarter during which the transactions took place and shall include information provided for in Article 3 of the Small Quantities Regulation.
4. Provided that it has received all the information required, the Agency shall acknowledge the quarterly statements and communicate the reference numbers attributed to the contracts if possible within 15 (fifteen) working days from the date on which it receives them.
CHAPTER 5
FINAL PROVISIONS
Article 18
Entry into force
1. These Rules enter into force on the date set in the Agency’s Decision by which they are adopted.
2. Supply contracts signed by the parties before the date on which the present Rules enter into force shall be processed in accordance with the provisions applicable on the day of their signature.
