DECISION OF THE EEA JOINT COMMITTEE

No 123/2018

of 6 July 2018

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2021/185]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2018/313 of 28 February 2018 amending Decision 2009/821/EC as regards the lists of border inspection posts and veterinary units in Traces (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(3)

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 39 (Commission Decision 2009/821/EC) in Part 1.2 of Chapter I of Annex I to the EEA Agreement:

‘—

32018 D 0313: Commission Implementing Decision (EU) 2018/313 of 28 February 2018 (OJ L 60, 2.3.2018, p. 40).’.

Article 2

The text of Implementing Decision (EU) 2018/313 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 July 2018, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

No 124/2018

of 6 July 2018

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2021/186]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2018/136 of 25 January 2018 designating the European Union reference laboratory for foot-and-mouth disease and amending Annex II to Council Directive 92/119/EEC as regards the European Union reference laboratory for swine vesicular disease (1) is to be incorporated into the EEA Agreement.

(2)

Implementing Decision (EU) 2018/136 repeals, with effect from 1 January 2019, Commission Implementing Decision 2012/767/EU (2) which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 1 January 2019.

(3)

This Decision concerns legislation regarding live animals other than fish and aquaculture animals and animal products such as ova, embryo and semen. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland.

(4)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(5)

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the EEA Agreement shall be amended as follows:

1.

the following indent is added in point 9 (Council Directive 92/119/EEC) in Part 3.1:

‘—

32018 D 0136: Commission Implementing Decision (EU) 2018/136 of 25 January 2018 (OJ L 24, 27.1.2018, p. 3).’;

2.

the following point is inserted after point 47 (Commission Regulation (EU) No 415/2013) in Part 3.2:

‘48.

32018 D 0136: Commission Implementing Decision (EU) 2018/136 of 25 January 2018 designating the European Union reference laboratory for foot-and-mouth disease and amending Annex II to Council Directive 92/119/EEC as regards the European Union reference laboratory for swine vesicular disease (OJ L 24, 27.1.2018, p. 3).

This act shall not apply to Iceland.’;

3.

the text of point 35 (Commission Implementing Decision 2012/767/EU) in Part 3.2 shall be deleted with effect from 1 January 2019.

Article 2

The text of Implementing Decision (EU) 2018/136 in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 July 2018, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

No 125/2018

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2021/187]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2018/187 of 6 February 2018 amending Annex II to Decision 2008/185/EC as regards the approval of the control programme for the eradication of Aujeszky's disease for the region of Emilia-Romagna in Italy (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision (EU) 2018/193 of 7 February 2018 authorising laboratories in Brazil and the Russian Federation to carry out serological tests to monitor the effectiveness of rabies vaccines in dogs, cats and ferrets (2) is to be incorporated into the EEA Agreement.

(3)

This Decision concerns legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

Commission Regulation (EU) 2017/894 of 24 May 2017 amending Annexes III and VII to Regulation (EC) No 999/2001 of the European Parliament and of the Council as regards the genotyping of ovine animals (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Commission Implementing Regulation (EU) 2018/338 of 7 March 2018 concerning the authorisation of a preparation of 6-phytase, produced by Aspergillus niger (DSM 25770) as feed additive for chickens for fattening, chickens reared for laying, pigs for fattening, sows, minor porcine species for fattening or for reproduction, turkeys for fattening, turkeys reared for breeding, all other avian species (excluding laying birds) and weaned piglets (holder of the authorisation BASF SE) (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Regulation (EU) 2018/347 of 5 March 2018 concerning the authorisation of the preparation of Saccharomyces cerevisiae CNCM I-1079 as a feed additive for piglets and sows and amending Regulations (EC) No 1847/2003 and (EC) No 2036/2005 (holder of authorisation Danstar Ferment AG represented by Lallemand SAS) (2) is to be incorporated into the EEA Agreement.

(3)

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(4)

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2018/353 of 9 March 2018 correcting Implementing Regulation (EU) 2017/1145 on the withdrawal from the market of certain feed additives authorised pursuant to Council Directives 70/524/EEC and 82/471/EEC and repealing the obsolete provisions authorising those feed additives (1) is to be incorporated into the EEA Agreement.

(2)

Implementing Regulation (EU) 2018/353 states that Commission Regulation (EC) No 1443/2006 (2) was erroneously repealed. As Commission Regulation (EC) No 1443/2006 was repealed by Decision of the EEA Joint Committee No 194/2017, it is consequently to be reincorporated into the EEA Agreement.

(3)

Implementing Regulation (EU) 2018/353 repeals Commission Regulation (EC) No 1459/2005 (3) which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(4)

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

(3)

Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2018/213 of 12 February 2018 on the use of bisphenol A in varnishes and coatings intended to come into contact with food and amending Regulation (EU) No 10/2011 as regards the use of that substance in plastic food contact materials (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. Commission Implementing Regulation (EU) 2018/184 of 7 February 2018 amending Implementing Regulation (EU) No 540/2011 as regards the extension of the approval periods of the active substances FEN 560 (also called fenugreek or fenugreek seed powder) and sulfuryl fluoride (5) is to be incorporated into the EEA Agreement.

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2018/55 of 9 January 2018 amending Implementing Regulation (EU) 2015/1998 as regards adding the Republic of Singapore to the third countries recognised as applying security standards equivalent to the common basic standards on civil aviation security (1) is to be incorporated into the EEA Agreement.

(2)

Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 66he (Commission Implementing Regulation (EU) 2015/1998) of Annex XIII to the EEA Agreement:

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Regulation (EU) 2017/1128 of the European Parliament and of the Council of 14 June 2017 on cross-border portability of online content services in the internal market (1),as corrected by OJ L 198, 28.7.2017, p. 42, is to be incorporated into the EEA Agreement.

(2)

Annex XVII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 11 (Directive 2014/26/EU of the European Parliament and of the Council) of Annex XVII to the EEA Agreement:

32017 R 1128: Regulation (EU) 2017/1128 of the European Parliament and of the Council of 14 June 2017 on cross-border portability of online content services in the internal market (OJ L 168, 30.6.2017, p. 1), as corrected by OJ L 198, 28.7.2017, p. 42.

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

(a)

in Article 2(5) of the Regulation, the term “Articles 56 and 57 TFEU” shall read “Articles 36 and 37 of the EEA Agreement”;

(b)

in Article 9(2) of the Regulation, the words “2 June 2018” shall read “two months and one day after the date of entry into force of the EEA Joint Committee No 158/2018 of 6 July 2018”.’

Article 2

The text of Regulation (EU) 2017/1128, as corrected by OJ L 198, 28.7.2017, p. 42, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Commission Directive (EU) 2017/164 of 31 January 2017 establishing a fourth list of indicative occupational exposure limit values pursuant to Council Directive 98/24/EC, and amending Commission Directives 91/322/EEC, 2000/39/EC and 2009/161/EU (1) is to be incorporated into the EEA Agreement.

(2)

Annex XVIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XVIII to the EEA Agreement shall be amended as follows:

(2)

Decision (EU) 2018/229 repeals Commission Decision 2013/480/EU (2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(3)

Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

The text of point 13cab (Commission Decision 2013/480/EU) of Annex XX to the EEA Agreement is replaced by the following:

Commission Delegated Regulation (EU) 2016/1851 of 14 June 2016 adopting the programme of ad hoc modules, covering the years 2019, 2020 and 2021, for the labour force sample survey provided for by Council Regulation (EC) No 577/98 (1) is to be incorporated into the EEA Agreement.

(2)

Annex XXI to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XXI to the EEA Agreement shall be amended as follows:

amending Protocol 30 to the EEA Agreement, on specific provisions on the organisation of cooperation in the field of statistics [2021/230]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

The EEA statistical programme 2018 to 2020 should be based on Regulation (EU) No 99/2013 of the European Parliament and of the Council (1) as last amended by Regulation (EU) 2017/1951 of the European Parliament and of the Council of 25 October 2017 amending Regulation (EU) No 99/2013 on the European statistical programme 2013-17, by extending it to 2020 (2), and should include those programme elements which are necessary for the description and monitoring of all relevant economic, social and environmental aspects of the European Economic Area.

(2)

Regulation (EU) 2017/1951 should be included in Protocol 30 in order to ensure that the cooperation is extended to 2020.

(3)

Protocol 30 to the EEA Agreement should therefore be amended in order to allow for that extended cooperation to take place from 1 January 2018,

HAS ADOPTED THIS DECISION:

Article 1

Protocol 30 to the EEA Agreement shall be amended as follows:

1.

the word ‘2017’ in the title of Article 5 is replaced by the word ‘2020’;

2.

the following indent is added in Article 5(1):

‘—

32017 R 1951: Regulation (EU) 2017/1951 of the European Parliament and of the Council of 25 October 2017 (OJ L 284, 31.10.2017, p. 1).’;

3.

the words ‘2013-17’ and ‘31 December 2017’ in Article 5(2) are replaced by the words ‘2013-20’ and ‘31 December 2020’;

4.

the words ‘2013 to 2017’ in Article 5(3) are replaced by the words ‘2013 to 2020’;

5.

the text of Article 5(4) is replaced by the following:

‘The EFTA States shall contribute financially in accordance with Article 82(1)(a) of the Agreement and the Financial Regulations thereto to an amount representing 75 per cent of the amount shown in budget lines 29 02 05 (European statistical programme 2013-17) and 29 01 04 05 (Statistical information policy – Expenditure on administrative management) entered in the budget of the European Union for 2013 and to an amount representing 75 per cent of the amount shown in budget lines 29 02 01 (Providing quality statistical information, implementing new methods of production of European statistics and strengthening the partnership within the European Statistical System) and 29 01 04 01 (Support expenditure for the European statistical programme) entered in the budget of the European Union for 2014 to 2020.’.

Article 2

This Decision shall enter into force on 7 July 2018, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

It shall apply from 1 January 2018.

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

amending Protocol 31 to the EEA Agreement, on cooperation in specific fields outside the four freedoms [2021/231]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 86 and 98 thereof,

Whereas:

(1)

It is appropriate to extend the cooperation of the Contracting Parties to the EEA Agreement to include Decision (EU) 2017/864 of the European Parliament and of the Council of 17 May 2017 on a European Year of Cultural Heritage (2018) (1).

(2)

Protocol 31 to the EEA Agreement should therefore be amended in order to allow for this extended cooperation to take place from 1 January 2018,

HAS ADOPTED THIS DECISION:

Article 1

Article 5 of Protocol 31 to the EEA Agreement shall be amended as follows:

1.

in paragraph 5, the words ‘, in the programme referred to in the fifteenth indent as from 1 January 2018’ shall be inserted after the words ‘in the programme referred to in the fourteenth indent as from 1 January 2014’;

2.

the following indent shall be added in paragraph 8:

‘—

32017 D 0864: Decision (EU) 2017/864 of the European Parliament and of the Council of 17 May 2017 on a European Year of Cultural Heritage (2018) (OJ L 131, 20.5.2017, p. 1).’.

Article 2

This Decision shall enter into force on the day following the last notification under Article 103(1) of the EEA Agreement (*1).

It shall apply from 1 January 2018.

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 86 and 98 thereof,

Whereas:

It is appropriate to continue the cooperation of the Contracting Parties to the EEA Agreement in Union actions funded from the general budget of the Union regarding the operation and development of the internal market of goods and services and regarding internal market governance tools.

(2)

Protocol 31 to the EEA Agreement should therefore be amended in order to allow for this extended cooperation to take place from 1 January 2018,

HAS ADOPTED THIS DECISION:

Article 1

Article 7 of Protocol 31 to the EEA Agreement shall be amended as follows:

1.

in paragraph 12, the words ‘and 2017’ are replaced by the words ‘, 2017 and 2018’;

2.

in paragraph 14, the words ‘the financial year 2017’ are replaced by the words ‘the financial years 2017 and 2018’.

Article 2

This Decision shall enter into force on the day following the last notification under Article 103(1) of the EEA Agreement (*1).

It shall apply from 1 January 2018.
