COUNCIL IMPLEMENTING REGULATION (EU) 2021/138

implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism, and repealing Implementing Regulation (EU) 2020/1128

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 2580/2001 of 27 December 2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism (1), and in particular Article 2(3) thereof,

Having regard to the proposal of the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 30 July 2020, the Council adopted Implementing Regulation (EU) 2020/1128 (2) implementing Article 2(3) of Regulation (EC) No 2580/2001, establishing an updated list of persons, groups and entities to which Regulation (EC) No 2580/2001 applies (‘the list’).

(2)

The Council has provided, where practically possible, all the persons, groups and entities with statements of reasons explaining why they were entered into the list.

(3)

By way of a notice published in the Official Journal of the European Union, the Council informed the persons, groups and entities on the list that it had decided to keep them thereon. The Council also informed those persons, groups and entities concerned that it was possible to request a statement of the Council’s reasons for entering them into the list where such a statement had not already been communicated to them.

The Council has reviewed the list as required by Article 2(3) of Regulation (EC) No 2580/2001. When carrying out that review, the Council took into account the observations submitted to it by those concerned as well as the updated information received from the competent national authorities on the status of listed persons, groups and entities at the national level.

(5)

The Council has verified that competent authorities, as referred to in Article 1(4) of Council Common Position 2001/931/CFSP (3), have taken decisions with regard to all persons, groups and entities on the list to the effect that they have been involved in terrorist acts within the meaning of Article 1(2) and (3) of Common Position 2001/931/CFSP. The Council has also concluded that the persons, groups and entities to which Articles 2, 3 and 4 of Common Position 2001/931/CFSP apply should continue to be subject to the specific restrictive measures provided for in Regulation (EC) No 2580/2001.

The list should be updated accordingly, and Implementing Regulation (EU) 2020/1128 should be repealed,

HAS ADOPTED THIS REGULATION:

Article 1

The list provided for in Article 2(3) of Regulation (EC) No 2580/2001 is set out in the Annex to this Regulation.

Article 2

Implementing Regulation (EU) 2020/1128 is hereby repealed.

Article 3

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DELEGATED REGULATION (EU) 2021/139

of 4 December 2020

amending Annexes I and V to Regulation (EU) 2019/125 concerning trade in certain goods which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment to take into account the withdrawal of the United Kingdom from the Union

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2019/125 of the European Parliament and of the Council of 16 January 2019 concerning trade in certain goods which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment (1), and in particular the first paragraph of Article 24 thereof,

Whereas:

The Withdrawal Agreement (2) sets out the arrangements for the withdrawal of the United Kingdom of Great Britain and Northern Ireland (‘United Kingdom’) from the Union and from the European Atomic Energy Community.

(2)

The transition period set out in Part Four of the Withdrawal Agreement ends on 31 December 2020 when the Union law ceases to apply to and in the United Kingdom.

(3)

Pursuant to Article 5(4) of the Protocol on Ireland/Northern Ireland to the Withdrawal Agreement, read in conjunction with Annex 2 to that Protocol, the provisions of Regulation (EU) 2019/125 will apply to and in the United Kingdom in respect of Northern Ireland as from the end of the transition period.

Where Regulation (EU) 2019/125 establishes an authorisation requirement for trade from the Union to third countries, it would be the ‘competent authority’ of the United Kingdom which, from 1 January 2021will be responsible for deciding on any applications for such an authorisation pursuant to that Regulation made by exporters established or residing in Northern Ireland.

Subject to the application of Regulation (EU) 2019/125 to and in the United Kingdom in respect of Northern Ireland, in accordance with Article 5(4), of the Protocol on Ireland/Northern Ireland to the Withdrawal Agreement, read in conjunction with point 47 of Annex 2 to that Protocol, it is therefore appropriate to amend Annex I to Regulation (EU) 2019/125.

Pursuant to Articles 16 and 19 of Regulation (EU) 2019/125, an authorisation is required for exporting products listed in Annex IV to the Regulation which could be used for the execution of human beings by means of lethal injection.

(7)

Article 20(1) of Regulation (EU) 2019/125 provides for a ‘Union general export authorisation’.

(8)

In accordance with Annex V to Regulation (EU) 2019/125, the Union general export authorisation applies to exports of goods listed in any entry in Annex IV to Regulation (EU) 2019/125 and is valid throughout the Union for exports to the destinations listed in Part 2 of Annex V. Those destinations are third countries that have abolished capital punishment for all crimes and confirmed that abolition through an international commitment (3).

The Union general export authorisation helps minimise the regulatory burden placed on Union companies exporting goods listed in Annex IV to the Regulation when exporting such medicinal products for legitimate therapeutic purposes.

(10)

The United Kingdom ratified Protocol No 13 to the Convention for the Protection of Human Rights and Fundamental Freedoms concerning the abolition of the death penalty in all circumstances and therefore meets the requirements for inclusion in the list of destinations laid down in Annex V Part 2 to Regulation (EU) 2019/125.

(11)

Without prejudice to the application of Regulation (EU) 2019/125 to and in the United Kingdom in respect of Northern Ireland, in accordance with Article 5(4), read in conjunction with Annex 2, point 47, of the Protocol on Ireland/Northern Ireland annexed to the Withdrawal Agreement, it is therefore appropriate to amend Annex V to Regulation (EU) 2019/125.

It is appropriate to provide for the applicability of this Regulation after the end of the transition period, with effect from 1 January 2021. If the objection period ends later than 1 January 2021, it is appropriate for reasons of legal certainty and to avoid any potential detrimental disruption to the operations of Union companies wanting to export goods listed in Annex IV to the United Kingdom to provide for a retroactive applicability of the Regulation from 1 January 2021,

HAS ADOPTED THIS REGULATION:

Article 1

Annexes I and V to Regulation (EU) 2019/125 are amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the fifth day following that of its publication in the Official Journal of the European Union.

This Regulation shall apply from 1 January 2021.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2021/140

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications ‘Munster’/‘Munster-Géromé’ (PDO)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined France’s application for the approval of amendments to the specification for the protected designation of origin ‘Munster’/‘Munster-Géromé’, registered under Commission Regulation (EC) No 1107/96 (2).

(2)

By letter dated 8 August 2019, the French authorities notified the Commission that a transitional period under Article 15(4) of Regulation (EU) No 1151/2012, ending on 31 December 2023, had been granted to operators established on their territory who meet the conditions laid down in that Article pursuant to the order of 18 July 2019 amending the order of 8 November 2018 on amendments to the specification for the protected designation of origin ‘Munster’/‘Munster-Géromé’, published on 26 July 2019 in the Official Journal of the French Republic (3). The list of operators that benefitted from this transitional period is annexed to that order from the French Republic. During the national opposition procedure, the operators, who had been legally marketing ‘Munster’/‘Munster-Géromé’ continuously for at least five years prior to submission of the application, lodged an objection. Nineteen operators objected to the following provision: ‘The milk used to make “Munster”/“Munster-Géromé” must come exclusively from cows of the Vosges, Simmental, Prim’Holstein or Montbéliarde breeds or crosses with those breeds. In that case, only cows sired by a purebred bull of one of the above four breeds will be accepted’. Fourteen operators objected to the following provision: ‘At least 95 % of the basic ration (dry matter) for the dairy herd must be produced within the geographical area, as annual averages’. Four operators objected to the following provision: ‘At least 70 % of the basic ration (dry matter) for the dairy herd must be produced on the holding, as annual averages’. Ten operators objected to the following provision: ‘Grass in one form or another (dry matter) must account for at least 40 % of dairy cows’ basic ration (annual average) and at least 25 % of their basic ration every day of the year’. Thirteen operators objected to the following provision: ‘Each dairy cow must have at least 10 acres of grass pasture for grazing’. Seven operators objected to the following provision: ‘[Dairy cows] must be allowed to graze for a minimum of 150 days per year’. Twelve operators objected to the following provision: ‘Concentrate fodder must not account for more than 1,8 tonnes of dry matter per year per cow’. Five operators objected to the following provisions: ‘Maturing requires an atmosphere (90 percent relative humidity) specifically […]. During the leavening stage, the temperature must be at least 16 °C. During the wet treatment stage, the temperature of the maturing cellar must range between 10 °C and 16 °C’.

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union as required by Article 50(2)(a) of that Regulation (4).

(4)

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the amendments to the specification should be approved,

HAS ADOPTED THIS REGULATION:

Article 1

The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Munster’/‘Munster-Géromé’ (PDO) are hereby approved.

Article 2

The protection provided under Article 1 is subject to the transitional period granted by France under Article 15(4) of Regulation (EU) No 1151/2012 to operators meeting the conditions laid down in that Article, pursuant to the Order of 18 July 2019 amending the Order of 8 November 2018 on amendments to the specification for the protected designation of origin ‘Munster’/‘Munster-Géromé’ published on 26 July 2019 in the Official Journal of the French Republic.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1967/2006 of 21 December 2006 concerning management measures for the sustainable exploitation of fishery resources in the Mediterranean Sea, amending Regulation (EEC) No 2847/93 and repealing Regulation (EC) No 1626/94 (1), and in particular Article 4(5) and Article 13(5) and (10) thereof,

Whereas:

(1)

Article 4(1) of Regulation (EC) No 1967/2006 prohibits fishing with trawl nets, dredges, purse seines, boat seines, shore seines or similar nets above seagrass beds of, in particular, Posidonia oceanica or other marine phanerogams.

(2)

At the request of a Member State, the Commission may allow a derogation from Article 4(1) of Regulation (EC) No 1967/2006, provided that a number of conditions set out in Article 4(5) are fulfilled.

(3)

Article 13(1) of Regulation (EC) No 1967/2006 prohibits the use of towed gears within 3 nautical miles of the coast or within the 50 m isobath where that depth is reached at a shorter distance from the coast.

(4)

At the request of a Member State, the Commission may grant a derogation from Article 13(1) of Regulation (EC) No 1967/2006, provided that a number of conditions set out in Article 13(5) and (9) are fulfilled.

(5)

A derogation from Article 4(1) of Regulation (EC) No 1967/2006 and Article 13(1) and (2) thereof for the use of ‘gangui’ trawlers in certain territorial waters of France (Provence-Alpes-Côte d’Azur) was granted for the first time by Commission Implementing Regulation (EU) No 586/2014 (2). It applied until 6 June 2017.

(6)

An extension of that derogation was granted from 11 May 2018 until 11 May 2020 by Commission Implementing Regulation (EU) 2018/693 (3).

(7)

On 25 October 2019, the Commission received a request from France to extend this derogation for three years. On 3 December 2020, France reviewed its request for extension to two years. France provided information and scientific data to justify the renewal of the derogation, including an implementation report of the management plan adopted by France on 13 May 2014 (4) in accordance with Article 19 of Regulation (EC) No 1967/2006, an updated mapping of the seagrass beds of Posidonia oceanica in the area covered by Implementing Regulation (EU) 2018/693 and an implementation report on the reinforced control and monitoring measures.

During its 62nd plenary session held in November 2019 (5), the Scientific, Technical and Economic Committee for Fisheries (STECF) assessed the request for extending the derogation, the data and the implementation reports. The STECF concluded that certain data submitted by the French authorities needed to be improved, namely by clarifying the impact of the gear on the Posidonia beds and providing up to date catch data.

On 10 February 2020, France provided to the Commission updated catch composition data and a new analysis based on the data transmitted by the VMS transponders (‘VMS data’) installed in the authorised ‘gangui’ trawlers. The VMS data allow defining the actual Posidonia surface area affected by this gear. The analysis shows that the ‘gangui’ trawlers affect 19,9 % of the area covered by beds of Posidonia oceanica within the area covered by the French management plan and 7,1 % of the Posidonia oceanica beds in the territorial waters of France.

France furthermore committed to launching a socioeconomic study intended to enhance the knowledge on this fishery, namely by collecting updated price data as well as updated catch and catch composition data.

(11)

Finally, a French decree (6) published in February 2020 lowered the maximum allowable effort from 200 to 180 days per year for the gear ‘grand gangui’.

(12)

During its 64th plenary session held in July 2020 (7), the STECF assessed the VMS data provided by France and concluded that the areas of Posidonia beds affected by the gear were below the ceilings established under points (ii) and (iii) of the first subparagraph of Article 4(5) of Regulation (EC) No 1967/2006.

(13)

The STECF also assessed the catch composition data. It concluded that the fishery did not target cephalopods, since those species represent on average only 6 % of the total volume caught, and that the catches of species listed under Part A of Annex IX to Regulation (EU) 2019/1241 of the European Parliament and of the Council (8) were minimal.

(14)

The STECF acknowledged the effort made by the French administration to manage the gangui fishery and concluded that the French request for extending the derogation for a further 2 years complied with the relevant provisions of Regulation (EC) No 1967/2006.

(15)

The derogation requested concerns fishing activities by vessels of less than or equal to 12 metres overall length and engine power of less than or equal to 85 kW with bottom towed nets traditionally undertaken on Posidonia oceanica beds.

(16)

The fishery concerned affects less than 33 % of the area covered by seagrass beds of Posidonia oceanica within the area covered by the French management plan and less than 10 % of Posidonia oceanica beds in the territorial waters of France, in line with the ceilings established under points (ii) and (iii) of the first subparagraph of Article 4(5) of Regulation (EC) No 1967/2006.

There are specific geographical constraints given the limited size of the continental shelf.

(18)

The fishery has no significant impact on the marine environment.

(19)

The derogation requested by France concern a limited number of 17 vessels, of which only 10 were active in 2019. This represents a 53 % reduction of fishing effort in terms of number of vessels authorised as compared to 2014, when the French management plan was adopted.

(20)

The fishery conducted with ‘gangui’ trawlers target a variety of species that correspond to an ecological niche; the catch composition of this fishery, in particular as regards the variety of species caught, is not reflected in any other fishing gear. Therefore, the fishery cannot be undertaken with other gears.

(21)

The request covers vessels with a track record in the fishery of more than five years, which operate under the French management plan.

(22)

Those vessels are included on a list communicated to the Commission in accordance with Article 13(9) to Regulation (EC) No 1967/2006.

(23)

The French management plan guarantees no future increase in the fishing effort, as fishing authorisations may be issued only to specified 17 vessels involving a total of 838 kW that are already authorised by France. More specifically, according to the French management plan, any ‘gangui’ fishing authorisation is to be nullified when the authorised vessel concerned is replaced or the vessel master sells its vessel or retires. The Commission therefore notes that this provision will mechanically lead this fishery to disappear gradually over time.

The requested derogation complies with Article 8(1)(h) of Regulation (EC) No 1967/2006, as replaced by Article 8(1) and section I of Part B of Annex IX to Regulation (EU) 2019/1241, since it relates to trawlers operating with mesh sizes not smaller than 40 mm.

(25)

The fishing activities concerned fulfil the requirements of Article 9(3) of Regulation (EC) No 1967/2006, as replaced by Article 8(1) and section I of Part B of Annex IX to Regulation (EU) 2019/1241, as no square mesh below 40 mm is used in the ‘gangui’ net rigging.

(26)

The fishing activities concerned do not interfere with the activities of vessels using gears other than trawls, seines or similar towed nets.

(27)

The activity of ‘gangui’ trawlers is regulated in the French management plan to ensure that catches of species mentioned in Part A of Annex IX to Regulation (EU) 2019/1241 are minimal.

(28)

‘Gangui’ trawlers do not target cephalopods.

(29)

The French management plan includes measures for the monitoring of fishing activities, as provided for in the fifth subparagraph of Article 4(5) of Regulation (EC) No 1967/2006 and in the third subparagraph of Article 13(9) thereof. It also includes measures for the recording of fishing activities, thus fulfilling the conditions set out in Article 14 of Council Regulation (EC) No 1224/2009 (9).

(30)

The derogation requested therefore complies with the conditions laid down in Article 4(5) and in Article 13(5) and (9) of Regulation (EC) No 1967/2006 and should be granted.

(31)

France should report to the Commission in due time and in accordance with the monitoring plan provided for in the French management plan.

(32)

The duration of the derogation should be limited in order to allow prompt corrective management measures in case the report to the Commission shows a poor conservation status of the exploited stock, while providing scope to enhance the scientific basis for an improved management plan.

(33)

Since the derogation granted by Implementing Regulation (EU) 2018/693 expired on 11 May 2020, in order to ensure legal continuity, this Regulation should apply with effect from 12 May 2020. For reasons of legal certainty, this Regulation should enter into force as a matter of urgency.

(34)

The measures provided for in this Regulation are in accordance with the opinion of the Committee for Fisheries and Aquaculture,

HAS ADOPTED THIS REGULATION:

Article 1

Derogation

The first subparagraph of Article 4(1), the first subparagraph of Article 13(1) and Article 13(2) of Regulation (EC) No 1967/2006 shall not apply in the territorial waters of France adjacent to the coast of the Provence-Alpes-Côte d’Azur region to ‘gangui’ trawlers fulfilling the following requirements:

(a)

bearing a registration number mentioned in the French management plan adopted by France in accordance with Article 19 of Regulation (EC) No 1967/2006;

(b)

having a track record in the fishery of more than five years and not involving any future increase in fishing effort provided;

(c)

holding a fishing authorisation and operating under the management plan adopted by France in accordance with Article 19 of Regulation (EC) No 1967/2006.

Article 2

Reporting

By June of each year following the entry into force of this Regulation and by June 2021 for the first time, France shall submit to the Commission a report, based on scientific and technical data, on the implementation of the additional control and monitoring measures and on the compliance with the requirements for granting the derogation provided for by this Regulation.

Article 3

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

It shall apply from 12 May 2020 until 11 May 2022.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal of the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 27 December 2001, the Council adopted Common Position 2001/931/CFSP (1).

(2)

On 30 July 2020, the Council adopted Decision (CFSP) 2020/1132 (2) updating the list of persons, groups and entities subject to Articles 2, 3 and 4 of Common Position 2001/931/CFSP (‘the list’).

(3)

In accordance with Article 1(6) of Common Position 2001/931/CFSP, it is necessary to review at regular intervals the names of persons, groups and entities in the list to ensure that there are grounds for keeping them thereon.

(4)

This Decision sets out the result of the review that the Council has carried out in respect of persons, groups and entities to which Articles 2, 3 and 4 of Common Position 2001/931/CFSP apply.

(5)

The Council has verified that competent authorities, as referred to in Article 1(4) of Common Position 2001/931/CFSP, have taken decisions with regard to all persons, groups and entities on the list to the effect that they have been involved in terrorist acts within the meaning of Article 1(2) and (3) of Common Position 2001/931/CFSP. The Council has also concluded that the persons, groups and entities to which Articles 2, 3 and 4 of Common Position 2001/931/CFSP apply should continue to be subject to the specific restrictive measures provided for in Common Position 2001/931/CFSP.

The list should be updated accordingly, and Decision (CFSP) 2020/1132 should be repealed,

HAS ADOPTED THIS DECISION:

Article 1

The list of persons, groups and entities to which Articles 2, 3 and 4 of Common Position 2001/931/CFSP apply is set out in the Annex to this Decision.

Article 2

Decision (CFSP) 2020/1132 is hereby repealed.

Article 3

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

amending the Annex to the Monetary Agreement between the European Union and the Vatican City State

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Monetary Agreement of 17 December 2009 between the European Union and the Vatican City State (1), and in particular Article 8(3) thereof,

Whereas:

(1)

The Monetary Agreement between the Union and the Vatican (‘the Agreement’) entered into force on 1 January 2010.

(2)

Article 8(1) the Agreement requires the Vatican to implement Union legal acts and rules on euro banknotes and coins, prevention of money laundering, of fraud and counterfeiting of cash and non-cash means of payment; medals and tokens and statistical reporting requirements. Those acts and rules are listed in the Annex to the Monetary Agreement.

(3)

The Annex to the Monetary Agreement should be amended by the Commission every year to take into account the new relevant Union legal acts and rules and the amendments to the existing ones.

(4)

Some legal acts and rules of the Union are not relevant anymore and should therefore be deleted from the Annex, while other relevant legal acts and rules of the Union were adopted or amended and should be added to the Annex.

(5)

The Annex to the Monetary Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to the Monetary Agreement between the European Union and the Vatican City State is replaced by the text in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

updating Annex A to the Monetary Agreement between the European Union and the Principality of Monaco

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Monetary Agreement of 29 November 2011 between the European Union and the Principality of Monaco (1), and in particular Article 11(3) thereof,

Whereas:

(1)

Article 11(2) of the Monetary Agreement between the European Union and the Principality of Monaco (hereinafter ‘the Monetary Agreement’) requires the Principality of Monaco to apply the same rules as those established in the French Republic for the purposes of transposing European legal acts concerning the activities and prudential regulation of credit institutions and the prevention of systemic risks to payment and securities settlement systems contained in Annex A.

(2)

Pursuant to Article 11(3) of the Monetary Agreement, Annex A must be updated by the Commission upon amendment of any relevant acts and also each time a new text is adopted by the European Union.

(3)

New texts have been adopted by the European Union and amendments have been made to the texts already referred to in Annex A.

(4)

Annex A to the Monetary Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex A to the Monetary Agreement between the European Union and the Principality of Monaco is replaced by the text set out in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

amending the Annex to the Monetary Agreement between the European Union and the Republic of San Marino

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Monetary Agreement of 27 March 2012 between the European Union and the Republic of San Marino (1), and in particular Article 8(5) thereof,

Whereas:

(1)

The Monetary Agreement between the Union and San Marino (‘the Agreement’) entered into force on 1 September 2012.

(2)

Article 8(1) of the Agreement requires San Marino to implement Union legal acts and rules on euro banknotes and coins, banking and financial law, prevention of money laundering, prevention of fraud and counterfeiting of cash and non-cash means of payment, medals and tokens and statistical reporting requirements. Those acts and rules are listed in the Annex to the Monetary Agreement.

(3)

The Annex to the Monetary Agreement should be amended by the Commission once a year or more often if deemed appropriate to take into account the new relevant Union legal acts and rules and the amendments to the existing ones.

(4)

Some legal acts and rules of the Union are not relevant anymore and should therefore be deleted from the Annex, while other legal acts and rules of the Union were adopted or amended and should be added to the Annex.

(5)

The Annex to the Monetary Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to the Monetary Agreement between the European Union and the Republic of San Marino is replaced by the text in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

amending the Annex to the Monetary Agreement between the European Union and the Principality of Andorra

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Monetary Agreement of 30 June 2011 between the European Union and the Principality of Andorra (1), and in particular Article 8(4) thereof,

Whereas:

(1)

The Monetary Agreement between the Union and the Andorra (‘the Agreement’) entered into force on 1 April 2012.

(2)

Article 8(1) of the Agreement requires Andorra to implement Union acts concerning the rules on euro banknotes and coins, banking and financial law, prevention of money laundering, prevention of fraud and counterfeiting of cash and non-cash means of payment, medals and tokens and statistical reporting requirements. Those acts are listed in the Annex to the Monetary Agreement.

(3)

The Annex should be amended by the Commission every year to take into account the new relevant legal acts and rules of the Union and the amendments to the existing ones.

(4)

Some legal acts and rules of the Union are not relevant anymore and should therefore be deleted from the Annex, while other relevant legal acts and rules of the Union were adopted or amended and should be added to the Annex.

(5)

The Annex to the Monetary Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to the Monetary Agreement between the European Union and the Principality of Andorra is replaced by the text in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
