amending Annex II to Implementing Regulation (EU) 2019/627 as regards the health mark to be used for certain meat intended for human consumption in the United Kingdom in respect of Northern Ireland

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, amending Regulations (EC) No 999/2001, (EC) No 396/2005, (EC) No 1069/2009, (EC) 1107/2009, (EU) 1151/2012, (EU) No 652/2014, (EU) 2016/429 and (EU) 2016/2031 of the European Parliament and of the Council, Council Regulations (EC) No 1/2005 and (EC) No 1099/2009 and Council Directives 98/58/EC, 1999/74/EC, 2007/43/EC, 2008/119/EC and 2008/120/EC, and repealing Regulations (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council, Council Directives 89/608/EEC, 89/662/EEC, 90/425/EEC, 91/496/EEC, 96/23/EC, 96/93/EC and 97/78/EC and Council Decision 92/438/EEC (Official Controls Regulation) (1), and in particular the introductory phrase and point (e) of Article 18(8) thereof,

Whereas:

Commission Implementing Regulation (EU) 2019/627 (2) lays down uniform practical arrangements for the performance of official controls in relation to the production of products of animal origin intended for human consumption. Annex II to that Implementing Regulation sets out the practical arrangements for the health mark which, inter alia, indicates the fitness of the meat for human consumption.

In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement) and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, Regulation (EU) 2017/625, as well as the Commission acts based on it, will continue to apply in the United Kingdom in respect of Northern Ireland after the end of the transitional period. For that reason, it is necessary to amend the requirements laid down in Annex II to that Regulation concerning the health mark that should be used in the United Kingdom in respect of Northern Ireland.

Annex II to Implementing Regulation (EU) 2019/627 should be therefore amended accordingly.

(4)

As the transition period provided for in the Withdrawal Agreement ends on 31 December 2020, this Regulation should apply from 1 January 2021.

(5)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Annex II to Implementing Regulation (EU) 2019/627 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2021.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Decisions 93/52/EEC, 2003/467/EC, 2004/558/EC and 2008/185/EC as regards the listing of Member States and regions thereof recognised as officially free of several terrestrial animal diseases

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 64/432/EEC of 26 June 1964 on animal health problems affecting intra-Community trade in bovine animals and swine (1), and in particular Articles 9(2) and 10(2) thereof,

Having regard to Council Directive 91/68/EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals (2), and in particular Section II of Chapter 1 of Annex A thereto,

Whereas:

Directive 64/432/EEC establishes the animal health conditions governing trade in the Union in bovine and porcine animals. It lays down the conditions whereby Member States or regions thereof may be recognised as officially free of tuberculosis, brucellosis, enzootic bovine leukosis and infectious bovine rhinotracheitis as regards bovine herds, and Aujeszky’s disease as regards porcine herds.

Even though the Channel Islands and the Isle of Man, as internally self-governing dependencies of the British Crown, are not part of the Union, they have a special, limited relationship with the Union. As a result, Regulation (EEC) No 706/73 of the Council (3) provides that for the purpose of applying rules concerning, amongst others, animal health legislation, the United Kingdom, the Channel Islands and the Isle of Man are to be treated as a single Member State.

Directive 91/68/EEC establishes the animal health conditions governing trade in the Union in ovine and caprine animals. It lays down the conditions whereby Member States or regions thereof may be recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds.

(4)

Article 2 of Commission Decision 93/52/EEC (4) provides that Member States listed in Annex I thereto are recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds, in accordance with the conditions laid down in Directive 91/68/EEC. The United Kingdom is listed in Annex I to that Decision as officially brucellosis (B. melitensis) free.

Article 1 of Commission Decision 2003/467/EC (5) provides that regions of Member States listed in Chapter 2 of Annex I thereto are declared officially tuberculosis-free as regards bovine herds, in accordance with the conditions laid down in Directive 64/432/EEC. In respect of the United Kingdom, the territories of Scotland and the Isle of Man are listed as officially tuberculosis-free regions.

Article 2 of Decision 2003/467/EC provides that regions of Member States listed in Chapter 2 of Annex II thereto are declared officially brucellosis-free as regards bovine herds, in accordance with the conditions laid down in Directive 64/432/EEC. In respect of the United Kingdom, the territories of England, Scotland and Wales, Northern Ireland and the Isle of Man are listed as officially brucellosis-free regions.

Article 3 of Decision 2003/467/EC provides that Member States and regions thereof listed in Annex III thereto are declared officially enzootic-bovine-leukosis-free as regards bovine herds, in accordance with the conditions laid down in Directive 64/432/EEC. In Chapter 1 of Annex III to Decision 2003/467/EC, the United Kingdom is listed as officially enzootic-bovine-leukosis-free Member State, and in Chapter 2 of that Annex, Jersey and the Isle of Man are listed as officially enzootic-bovine-leukosis-free regions.

Commission Decision 2004/558/EC (6) lists the Member States and regions thereof, which are authorised to apply additional guarantees for infectious bovine rhinotracheitis in accordance with Articles 9 and 10 of Directive 64/432/EEC. Jersey is listed in Annex II to that Decision as a region in which additional guarantees for infectious bovine rhinotracheitis apply in accordance with Article 10 of Directive 64/432/EEC.

Commission Decision 2008/185/EC (7) lays down additional guarantees for movements of pigs between Member States. Those guarantees are linked to the classification of the Member States or regions thereof according to their disease status for Aujeszky’s disease. The United Kingdom is listed in Annex I to that Decision as free of Aujeszky’s disease. Point 2(d) of Annex III to that Decision lists the institutes responsible for checking the quality of the ELISA method in each Member State. Among the listed institutes is one in the United Kingdom. In accordance with section 36 of Annex 2 to the Protocol on Ireland/Northern Ireland, references to national reference laboratories in the acts listed in that section are not to be read as including the reference laboratory in the United Kingdom.

In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement), and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, Directives 64/432/EEC and 91/68/EEC, as well as the Commission acts based on them, apply to and in the United Kingdom in respect of Northern Ireland after the end of the transition period provided for in the Withdrawal Agreement. For that reason, references to the United Kingdom in Annex I to Decision 93/52/EEC, in Chapter 2 of Annex II to Decision 2003/467/EC as well as in Chapter 1 of Annex III thereto and in Annex I to Decision 2008/185/EC should be replaced by references to the United Kingdom in respect of Northern Ireland.

Furthermore, it is necessary to delete the references to the United Kingdom from Chapter 2 of Annex I to Decision 2003/467/EC, as well as from Chapter 2 of Annex III to that Decision, from Annex II to Decision 2004/558/EC, and from Annex III to Decision 2008/185/EC.

(12)

Decisions 93/52/EEC, 2003/467/EC, 2004/558/EC and 2008/185/EC should therefore be amended accordingly.

(13)

As the transition period provided for in the Withdrawal Agreement ends on 31 December 2020, this Decision should apply from 1 January 2021.

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to Decision 93/52/EEC, Chapter 2 of Annex II and Chapter 1 of Annex III to Decision 2003/467/EC and Annex I to Decision 2008/185/EC are amended as set out in Annex I to this Decision.

Article 2

Chapter 2 of Annex I and Chapter 2 of Annex III to Decision 2003/467/EC, Annex II to Decision 2004/558/EC and Annex III to Decision 2008/185/EC are amended as set out in Annex II to this Decision.

Article 3

This Decision shall apply from 1 January 2021.

Article 4

This Decision is addressed to the Member States.

amending Part C of Annex I to Decision 2009/177/EC as regards the disease-free status of the United Kingdom in respect of Northern Ireland for certain aquatic animal diseases

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 2006/88/EC of 24 October 2006 on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquatic animals (1), and in particular Articles 49(1), 50(2)(a), 50(3), 51(2) and 61(3) thereof,

Whereas:

(1)

Commission Decision 2009/177/EC (2) implements Directive 2006/88/EC as regards surveillance and eradication programmes and disease-free status of Member States, zones and compartments. The second and fourth column of the table in Part C of Annex I to that Decision lists those Member States which have been declared disease-free in accordance with Article 49(1) of Directive 2006/88/EC, and those zones and compartments which have been declared disease-free in accordance with Article 50(3) of that Directive. The disease to which this disease-free status applies is set out in the first column of the same table.

(2)

In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement), and in particular Article 5(4) of the Protocol on Ireland / Northern Ireland in conjunction with Annex 2 to that Protocol, Directive 2006/88/EC, as well as the Commission acts based on it, applies to and in the United Kingdom in respect of Northern Ireland after the end of the transition period provided for in the Withdrawal Agreement. For that reason, references to the United Kingdom in Part C of Annex I to Decision 2009/177/EC should be replaced by references to the United Kingdom in respect of Northern Ireland.

Annex I to Decision 2009/177/EC should therefore be amended accordingly.

(4)

As the transition period provided for in the Withdrawal Agreement ends on 31 December 2020, this Decision should apply from 1 January 2021.

amending Annex I to Decision 2010/221/EU as regards the reference to the United Kingdom in respect of Northern Ireland for the approval of national measures for limiting the impact of certain diseases in aquaculture animals and wild aquatic animals in accordance with Article 43 of Council Directive 2006/88/EC

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 2006/88/EC of 24 October 2006 on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases of aquatic animals (1), and in particular to Article 43(2) thereof,

Whereas:

(1)

Commission Decision 2010/221EU (2) approves national measures for limiting the impact of certain diseases in aquaculture animals and wild aquatic animals in accordance with Article 43 of Directive 2006/88/EC.

(2)

The territory of the United Kingdom is listed in the second column of the table set out in Annex I to Decision 2010/221/EU, as being free from several of the diseases listed in first column of that table.

(3)

In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement), and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, Directive 2006/88/EC, as well as the Commission acts based on it, applies to and in the United Kingdom in respect of Northern Ireland after the end of the transition period provided for in the Withdrawal Agreement. For that reason, references to the United Kingdom in Annex I to Decision 2010/221/EU should be replaced by references to the United Kingdom in respect of Northern Ireland.

Annex I to Decision 2010/221/EU should therefore be amended accordingly.

(5)

As the transition period provided for in the Withdrawal Agreement ends on 31 December 2020, this Decision should apply from 1 January 2021.

(6)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to Decision 2010/221/EU is replaced by the text set out in the Annex to this Decision.

Article 2

This Decision shall apply from 1 January 2021.

Article 3

This Decision is addressed to the Member States.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 92/66/EEC of 14 July 1992 introducing Community measures for the control of Newcastle disease (1), and in particular Article 21(3) thereof,

Having regard to Council Directive 2001/89/EC of 23 October 2001 on Community measures for the control of classical swine fever (2), and in particular Article 22(3) thereof,

Having regard to Council Directive 2003/85/EC of 29 September 2003 on Community measures for the control of foot-and-mouth disease repealing Directive 85/511/EEC and Decisions 89/531/EEC and 91/665/EEC and amending Directive 92/46/EEC (3), and in particular Article 72(7) thereof,

Having regard to Council Directive 2005/94/EC of 20 December 2005 on Community measures for the control of avian influenza and repealing Directive 92/40/EEC (4), and in particular Article 62(4) thereof,

Whereas:

Commission Decision 93/455/EEC (5) approves the contingency plans for the control of foot-and-mouth disease for the Member States listed in the Annex thereto.

(2)

Commission Decision 1999/246/EC (6) approves the contingency plans for the control of classical swine fever for the Member States listed in the Annex thereto.

(3)

The Annex to Commission Decision 2007/24/EC (7) sets out the list of Member States having approved contingency plans for the control of avian influenza and Newcastle disease.

(4)

In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement), and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, Directives 92/66/EEC, 2001/89/EC, 2003/85/EC and 2005/94/EC, as well as the Commission acts based on them, apply to and in the United Kingdom in respect of Northern Ireland after the end of the transition period provided for in the Withdrawal Agreement. For that reason, references to the United Kingdom in the Annexes to Decisions 93/455/EEC, 1999/246/EC and 2007/24/EC should be replaced by references to the United Kingdom in respect of Northern Ireland.

The Annexes to Decisions 93/455/EEC, 1999/246/EC and 2007/24/EC should therefore be amended accordingly.

(6)

As the transition period provided for in the Withdrawal Agreement ends on 31 December 2020, this Decision should apply from 1 January 2021.

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 93/455/EEC is replaced by the text set out in Annex I to this Decision.

Article 2

In the Annex to Decision 1999/246/EC, in the list, the entry for the United Kingdom is replaced by the following:

amending Annex I to Decision 2004/3/EC authorising, in respect of the marketing of seed potatoes in all or part of the territory of certain Member States, more stringent measures against certain diseases than are provided for in Annexes I and II to Council Directive 2002/56/EC, as regards the entry for the United Kingdom

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 2002/56/EC of 13 June 2002 on the marketing of seed potatoes (1), and in particular Article 17(2) thereof,

Whereas:

(1)

Directive 2002/56/EC provides that, in respect of the marketing of seed potatoes in all or part of the territory of one or more Member States, the Commission is to authorise more stringent measures than those provided for in Annexes I and II thereto to be taken against harmful organisms which do not exist in those regions or which appear particularly harmful to crops in those regions.

Commission Decision 2004/3/EC (2), in that regard, authorises, in respect of the marketing of seed potatoes in all or part of the territory of certain Member States, more stringent measures against certain diseases than are provided for in Annexes I and II to Directive 2002/56/EC. More particularly, Decision 2004/3/EC provides that the Member States listed in column 1 of Annex I thereto are authorised, in respect of the marketing of seed potatoes in the regions listed against their names in column 2 of that Annex, to place certain restrictions on the marketing of seed potatoes. As regards the United Kingdom, column 2 of Annex I to Decision 2004/3/EC currently lists the regions of Cumbria, Northumberland (England), Northern Ireland and Scotland for the purposes of that authorisation.

In accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement), and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, Directive 2002/56/EC, as well as the Commission acts based on it, applies to and in the United Kingdom in respect of Northern Ireland after the end of the transition period provided for in the Withdrawal Agreement. For that reason, at the end of the transition period only Northern Ireland should be listed as a region in column 2 of Annex I to Decision 2004/3/EC.

Annex I to Decision 2004/3/EC should therefore be amended accordingly.

(5)

As the transition period provided for in the Withdrawal Agreement ends on 31 December 2020, this Decision should apply from 1 January 2021.
