COMMISSION IMPLEMENTING REGULATION (EU) 2020/1716

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications (‘Paprika Žitava’/‘Žitavská paprika’ (PDO))

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Whereas:

(1)

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Slovakia’s application for the approval of amendments to the specification for the protected designation of origin ‘Paprika Žitava’/‘Žitavská paprika’, registered under Commission Implementing Regulation (EU) No 126/2014 (2).

(2)

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (3) as required by Article 50(2)(a) of that Regulation.

(3)

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the amendments to the specification should be approved,

HAS ADOPTED THIS REGULATION:

Article 1

The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Paprika Žitava’/‘Žitavská paprika’ (PDO) are hereby approved.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Spain’s application for the approval of amendments to the specification for the protected designation of origin ‘Vinagre de Jerez’, registered under Commission Implementing Regulation (EU) No 985/2011 (2).

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (3) as required by Article 50(2)(a) of that Regulation.

Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined Italy’s application for the approval of amendments to the specification for the protected geographical indication ‘Peperone di Senise’, registered under Commission Regulation (EC) No 1263/96 (2). These amendments include changing the name ‘Peperone di Senise’ to ‘Peperoni di Senise’.

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union (3) as required by Article 50(2)(a) of that Regulation.

COMMISSION REGULATION (EU) 2020/1720

of 17 November 2020

amending Regulation (EU) No 142/2011 as regards imports of petfood from Georgia

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1069/2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (1), and in particular the first and the third subparagraphs of Article 41(3) and Article 42(2) thereof,

Whereas:

(1)

Commission Regulation (EU) No 142/2011 (2) lays down rules implementing Regulation (EC) No 1069/2009 including public and animal health conditions for imports of petfood. The requirements for the importation into and transit through the Union of petfood including dogchews are set out in Annex XIV to that Regulation, including the list of third countries.

(2)

On 19 March 2019, Georgia asked to be listed in Annex XIV to Regulation (EU) No 142/2011 for the importation into the Union of processed petfood, other than canned petfood.

(3)

The Commission carried out on-the spot controls, including an in-depth assessment of the applicant third country’s veterinary legislation and the capacity of the applicant third country’s competent authorities to implement that legislation and perform official controls, with a view to listing the applicant third country in Annex XIV to Regulation (EU) No 142/2011 for the importation into the Union of processed petfood, other than canned petfood. The competent authorities of Georgia provided the Commission with assurances that Georgia can comply with the relevant health conditions and sufficient guarantees for the controls they carry out on the production of processed petfood, other than canned petfood. It is therefore justified to add Georgia to the list of third countries from where processed petfood, other than canned petfood, may be imported into and transit through the Union.

(4)

Regulation (EU) No 142/2011 should therefore be amended accordingly.

(5)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Annex XIV to Regulation (EU) No 142/2011 is amended in accordance with the text in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following the date of publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

The petfood and the dogchews must have been produced in accordance with Chapter II of Annex XIII.

Third countries listed in Part 1 of Annex II to Regulation (EU) No 206/2010 or in Annex I to Regulation (EC) No 798/2008, from which Member States authorise imports of fresh meat from the same species and where only bone-in meat is authorised.

In the case of fish materials, third countries listed in Annex II to Decision 2006/766/EC.

(b)

In the case of dogchews and petfood other than raw petfood:

specifying technical items of data sets of the sample survey in the income and living conditions domain on health and quality of life pursuant to Regulation (EU) 2019/1700 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2019/1700 of the European Parliament and of the Council of 10 October 2019 establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples, amending Regulations (EC) No 808/2004, (EC) No 452/2008 and (EC) No 1338/2008 of the European Parliament and of the Council, and repealing Regulation (EC) No 1177/2003 of the European Parliament and of the Council and Council Regulation (EC) No 577/98 (1), and in particular Article 7(1) thereof,

Whereas:

(1)

To ensure the accurate implementation of the sample survey as regards the living conditions domain, the Commission should specify the technical items of the data set.

(2)

The EU statistics on income and living conditions survey (‘EU-SILC survey’) is a key instrument for providing information required by the European Semester and the European Pillar of Social Rights, in particular on income distribution, poverty and social exclusion. It also provides information on health care, health determinants, health status and disability from the three yearly module on Health; and data on well-being and social and cultural participation from the six yearly module on Quality of life.

(3)

The measures provided for in this Regulation are in accordance with the opinion of the European Statistical System Committee,

HAS ADOPTED THIS REGULATION:

Article 1

The technical characteristics of the data set for the three yearly module on Health and six yearly module on Quality of life in the income and living conditions domain are set out in the Annex and refer to:

(a)

the variable’s identifier;

(b)

the variable’s name;

(c)

the modality label and code;

(d)

the collection unit;

(e)

the mode of collection;

(f)

the reference period.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DECISION (EU) 2020/1722

of 16 November 2020

on the Union-wide quantity of allowances to be issued under the EU Emissions Trading System for 2021

(notified under document C(2020)7704)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a system for greenhouse gas emission allowance trading within the Union and amending Council Directive 96/61/EC (1), and in particular Article 9 and Article 9a thereof,

Whereas:

Commission Decision 2010/634/EU (2) set the Union-wide quantity of allowances to be issued for auctioning or free allocation for 2013, pursuant to Article 9 and Article 9a(1) of Directive 2003/87/EC. To take account of the accession of Croatia to the Union, the extension of the EU Emissions Trading System (‘EU ETS’) to the EEA-EFTA States, and additional information and more accurate data that had become available, Commission Decision 2013/448/EU (3) amended Decision 2010/634/EU accordingly, setting out a Union-wide quantity of 2 084 301 856 allowances for 2013. This amount was to decrease annually by the linear reduction factor of 1,74 % in order to determine the total quantity of allowances to be issued in the calendar years following 2013.

Directive (EU) 2018/410 of the European Parliament and of the Council (4) amended Directive 2003/87/EC to increase the linear reduction factor to 2,2 % starting in 2021, amounting to a reduction of 43 003 515 allowances to be issued in the Union each year. The Union-wide quantity of allowances for 2021 set out in this Decision is reduced by this amount.

On 1 February 2020, the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (5) (the ‘Withdrawal Agreement’) entered into force. Pursuant to Article 127 of the Withdrawal Agreement, Directive 2003/87/EC applies to and in the United Kingdom until 31 December 2020, when the transition period established in Article 126 of the Withdrawal Agreement will end. In addition, as from the end of the transition period, the Protocol to the Withdrawal Agreement on Ireland/Northern Ireland applies. Pursuant to Article 9 and Annex 4 of the Protocol on Ireland/Northern Ireland, Directive 2003/87/EC continues to apply to and in the United Kingdom in respect of the generation of electricity in Northern Ireland. As a result, the emissions from electricity generation in Northern Ireland remain subject to the ETS Directive after the end of the transition period.

The Union-wide quantity of allowances for 2021 should therefore be calculated on the basis of the average annual quantity of allowances issued by the current Member States in accordance with their respective national allocation plans during the years 2008 to 2012 (6), and the average annual quantity of allowances for the period from 2008 to 2012 allocated as a consequence of Northern Irish installations generating electricity. Since a concerned installation in Northern Ireland produced both electricity and heat during the reference period, the average annual quantity of allowances allocated as a consequence of the generation of electricity by this installation is determined by deducting emissions from heat production, using the heat benchmark used to determine the number of allowances allocated for free.

Furthermore, pursuant to Article 9a of Directive 2003/87/EC, and in particular paragraphs 1 and 4 thereof, the Union-wide quantity of allowances for 2021 should take account of the latest scientific data with regard to the global warming potential of greenhouse gases, and the exclusion from the EU ETS of small installations by Croatia, France, Germany, Italy, Slovenia, Spain, Portugal, and Iceland pursuant to Article 27 of Directive 2003/87/EC.

On this basis, for 2021 the Union-wide quantity of allowances referred to in Article 9 of Directive 2003/87/EC should amount to 1 571 583 007,

HAS ADOPTED THIS DECISION:

Article 1

For 2021, the Union-wide quantity of allowances referred to in Article 9 of Directive 2003/87/EC amounts to 1 571 583 007.

Article 2

This Decision is addressed to the Member States.

COMMISSION IMPLEMENTING DECISION (EU) 2020/1723

on measures to prevent the introduction into the Union of the foot-and-mouth disease virus from Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia and Turkey

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 91/496/EEC of 15 July 1991 laying down the principles governing the organisation of veterinary checks on animals entering the Community from third countries and amending Directives 89/662/EEC, 90/425/EEC and 90/675/EEC (1), and in particular Article 18(6) thereof,

Having regard to Council Directive 97/78/EC of 18 December 1997 laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (2), and in particular Article 22(6) thereof,

Whereas:

Foot-and-mouth disease is one of the most contagious diseases of cattle, sheep, goats and pigs. The virus causing the disease has the potential for rapid spread, notably through products obtained from infected animals and contaminated objects including means of transport like livestock vehicles or vessels. The virus can also persist in a contaminated environment outside the host animal for several weeks depending on the temperature. Accordingly, veterinary checks should be carried out on means of transport upon their return to the Union from certain third countries after such transport, in order to reduce the risk of the introduction of the foot-and-mouth disease virus into the Union.

Commission Implementing Decision (EU) 2017/675 (3), as amended by Commission Implementing Decisions (EU) 2017/887 (4), (EU) 2018/489 (5) and (EU) 2019/242 (6), was adopted following outbreaks of foot-and-mouth disease in Algeria, Libya, Morocco and Tunisia and established protection measures at Union level which took into account the survival of the foot-and-mouth disease virus in the environment and potential transmission routes of that virus. Those measures provided for appropriate cleansing and disinfection of livestock vehicles and vessels from those third countries entering the Union territory either directly or after transiting through other third countries, as this is the most appropriate way to reduce the risk of rapid virus transmission over large distances. However, Implementing Decision (EU) 2017/675 expired on 31 December 2019.

The latest outbreaks of foot-and-mouth disease in the third countries referred to in Implementing Decision (EU) 2017/675 were notified to the World Organisation for Animal Health (OIE) by Algeria in June 2019 and by Libya in March 2020. However, despite the absence of notified outbreaks in the other third countries referred to in that Implementing Decision, the circulation of the foot-and-mouth disease virus in their territory cannot be excluded, as scheduled serosurveillance has not been completed.

Algeria, Egypt, Israel (7), Lebanon, Libya, Morocco, Palestine (8), Syria, Tunisia and the Anatolian part of Turkey are not free of foot-and-mouth disease, and possible virus circulation in this area constitutes a non-negligible risk to the susceptible livestock population of the Union.

(5)

The Member States export a significant number of consignments of live animals to those third countries. Livestock vehicles and vessels used for the transport of these animals may be contaminated with the foot-and-mouth disease virus and therefore constitute a risk for the introduction of that disease upon their return to the Union.

(6)

Cleansing and disinfection of livestock vehicles and vessels has been shown to be the most appropriate way to reduce the risk of virus transmission over large distances.

(7)

It is therefore necessary to ensure that all livestock vehicles and vessels returning from those third countries to the Union are appropriately cleansed and disinfected. The operator or driver should submit an appropriate documented declaration of such cleansing and disinfection to the competent authority at the point of entry into the Union.

(8)

Regulation (EU) No 576/2013 of the European Parliament and of the Council (9) lays down the animal health conditions applicable to the non-commercial movement of pet animals. However, as non-commercial movement of pet animals pose a low-risk of spreading foot-and-mouth disease, they should be excluded from the scope of this Decision.

(9)

Member States should also have the possibility to subject vehicles which transport feed from or have transported feed to the third countries not free from foot-and-mouth disease, and for which a significant risk of the introduction of the disease into the territory of the Union cannot be excluded, to on-the-spot cleaning and disinfection of the wheels or any other part of the vehicle deemed necessary to mitigate that risk.

Considering the foot-and-mouth disease situation in Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia and the Anatolian part of Turkey, it is appropriate to lay down measures in this Decision to prevent the introduction of the foot-and-mouth disease virus into the Union.

Regulation (EU) 2016/429 of the European Parliament and of the Council (10) lays down rules on certain listed diseases, including foot-and-mouth disease. That Regulation applies from 21 April 2021. Regulation (EU) 2017/625 of the European Parliament and of the Council (11) repealed Directives 91/496/EEC and 97/78/EC, but Article 164(2) thereof provides that Article 18(6) of Directive 91/496/EEC and Article 22(6) of Directive 97/78/EC are to continue to apply in relation to the matters governed by Regulation (EU) 2016/429, until the date of application of Regulation (EU) 2016/429. Accordingly, the rules laid down in this Decision should apply until 20 April 2021.

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

Subject matter and scope

This Decision lays down rules on the cleaning and disinfection of vehicles and vessels transporting terrestrial animals and vehicles transporting feed for terrestrial animals when such vehicles or vessels return to the Union from Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia or Turkey.

This Decision shall not apply to the non-commercial movement of pet animals of the species listed in Annex I to Regulation (EU) No 576/2013 as referred to in Article 5 of that Regulation.

Article 2

Definitions

For the purpose of this Decision, ‘livestock vehicle’ or ‘livestock vessel’ means any vehicle or vessel being used or which has been used for the transport of terrestrial animals.

Article 3

Information to be provided by the operator or driver of a livestock vehicle or livestock vessel at the point of entry into the Union

1.   Member States shall ensure that the operator or driver of a livestock vehicle or livestock vessel upon arrival in the Union from Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia or Turkey, either directly or after transiting through any other third country, provides the competent authority of the Member State at the point of entry into the Union with information showing that the livestock or loading compartment, where applicable the truck body, the loading ramp, the equipment which came into contact with the animals, the wheels and the driver’s cabin and any protective clothes and protective boots used during unloading have been cleansed and disinfected after the last unloading of the animals.

2.   The information referred to in paragraph 1 shall be included in a declaration completed in accordance with the model set out in Annex I or in any other equivalent format which includes at least the information set out in that model.

3.   The original of the declaration referred to in paragraph 2 shall be kept by the competent authority for a period of three years following its reception.

Article 4

Checks on livestock vehicles to be carried out at the point of entry into the Union

1.   The competent authority of the Member State of the point of entry into the Union shall carry out visual checks on livestock vehicles coming from Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia and Turkey, either directly or after transiting through any other third country, in order to determine whether they have been satisfactorily cleansed and disinfected.

2.   Where the visual checks referred to in paragraph 1 show that the cleansing and disinfection of the livestock vehicle have been satisfactorily carried out or where the competent authority has ordered, organised and carried out additional disinfection of previously cleansed livestock vehicles, the competent authority shall attest that fact by issuing a certificate in accordance with the model set out in Annex II.

3.   Where the visual checks referred to in paragraph 1 show that the cleansing and disinfection of the livestock vehicle have not been satisfactorily carried out, the competent authority shall take one of the following measures:

(a)

subject the livestock vehicle to a proper cleansing and disinfection at a place designated by the competent authority, which must be as close as possible to the point of entry into the Member State concerned and then issue the certificate referred to in paragraph 2;

(b)

where there is no suitable facility for the cleansing and disinfection in the vicinity of the point of entry or where there is a risk that residual animal products may escape from the uncleansed livestock vehicle:

(i)

refuse the entry into the Union of the livestock vehicle; or

(ii)

perform a preliminary on-the-spot disinfection of the livestock vehicle not satisfactorily cleansed and disinfected pending the application of the measures provided for in point (a).

4.   The original of the certificate referred to in paragraph 2 shall be kept by the operator or driver of the livestock vehicle for a period of three years. A copy of that certificate shall be kept by the competent authority for a period of three years following its reception.

5.   All expenditure incurred under paragraphs 1 to 4 shall be borne by the responsible operators.

Article 5

Checks on livestock vessels at the point of exit from the Union

1.   The competent authority of the Member State of the point of exit of a livestock vessel shall carry out visual checks to verify whether it has been satisfactorily cleansed and disinfected, prior to the loading the animals, when it first travels from the Union after returning from Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia or Turkey, either directly or after transiting through any other third country.

2.   Where the visual checks referred to in paragraph 1 show that cleansing and disinfection have been satisfactorily carried out, the competent authority shall authorise the loading of animals.

3.   Where the visual checks referred to in paragraph 1 show that cleansing and disinfection of the livestock vessel have not been satisfactorily carried out, the competent authority shall take one of the following measures:

(a)

subject the livestock vessel to proper cleansing and disinfection at a place designated by the competent authority;

(b)

not authorise the loading of the animals.

4.   All expenditure incurred under paragraphs 1, 2 and 3 shall be borne by the responsible operators.

Article 6

Checks on vehicles transporting feed at the point of entry into the Union

The competent authority of the Member State of the point of entry into the Union may subject any vehicle transporting feed from or which has transported feed to Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Palestine, Syria, Tunisia or Turkey for which a significant risk of the introduction of foot-and-mouth disease into the Union cannot be excluded to an on-the-spot cleaning or disinfection of the wheels or any other part of the vehicle deemed necessary to mitigate that risk.

Article 7

Applicability

This Decision shall apply until 20 April 2021.

amending the Annex to Implementing Decision (EU) 2020/1654 concerning certain interim protective measures in relation to highly pathogenic avian influenza of subtype H5N8 in the United Kingdom

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(3) thereof, in conjunction with Article 131 of the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (‘Withdrawal Agreement’),

Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary checks applicable in intra-Union trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(3) thereof, in conjunction with Article 131 of the Withdrawal Agreement,

Whereas:

(1)

Commission Implementing Decision (EU) 2020/1654 (3) was adopted following an outbreak of highly pathogenic avian influenza (HPAI) of subtype H5N8 in one holding where poultry or other captive birds are kept in the county of Cheshire in the United Kingdom, and the establishment of protection and surveillance zones by the competent authority of the United Kingdom in accordance with Council Directive 2005/94/EC (4).

(2)

Implementing Decision (EU) 2020/1654 provides that the protection and surveillance zones established by the United Kingdom in accordance with Directive 2005/94/EC are to comprise at least the areas listed as protection and surveillance zones in the Annex to that Implementing Decision.

(3)

Since the date of adoption of Implementing Decision (EU) 2020/1654, the United Kingdom has notified the Commission of a new outbreak of HPAI of subtype H5N8 in a holding where poultry or other captive birds are kept in the county of Herefordshire, and it has taken the necessary measures required in accordance with Directive 2005/94/EC, including the establishment of protection and surveillance zones around this new outbreak.

(4)

The Commission has examined those measures in collaboration with the United Kingdom, and it is satisfied that the borders of the protection and surveillance zones, established by the competent authority of the United Kingdom, are at a sufficient distance to the holding where the new outbreak of HPAI of subtype H5N8 has been confirmed.

(5)

In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with the United Kingdom the new protection and surveillance zones established by the United Kingdom in accordance with Directive 2005/94/EC. Therefore, the protection and surveillance zones listed for the United Kingdom in the Annex to Implementing Decision (EU) 2020/1654 should be amended.

Accordingly, pending the next meeting of the Standing Committee on Plants, Animals, Food and Feed, the Annex to Implementing Decision (EU) 2020/1654 should be amended to update regionalisation at Union level to take account of the new protection and surveillance zones established in accordance with Directive 2005/94/EC by the United Kingdom and the duration of the restrictions applicable therein.

(7)

Implementing Decision (EU) 2020/1654 should therefore be amended accordingly.

(8)

Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI of subtype H5N8, it is important that the amendments to be made to the Annex to Implementing Decision (EU) 2020/1654 by this Decision take effect as soon as possible.

This Decision is to be reviewed at the next meeting of the Standing Committee on Plants, Animals, Food and Feed,

Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(3) thereof,

Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary checks applicable in intra-Union trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(3) thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2020/1664 (3) was adopted following confirmation of the presence of highly pathogenic avian influenza (HPAI) of subtype H5N8 in migratory and non-migratory wild birds in Germany, as well as an outbreak of that virus in one holding where poultry or other captive birds are kept in the Nordfriesland district of Germany and the establishment of protection and surveillance zones by the competent authority of that Member State in accordance with Council Directive 2005/94/EC (4).

(2)

Implementing Decision (EU) 2020/1664 provides that the protection and surveillance zones established by Germany in accordance with Directive 2005/94/EC are to comprise at least the areas listed as protection and surveillance zones in the Annex to that Implementing Decision.

(3)

Since the date of adoption of Implementing Decision (EU) 2020/1664, Germany has notified the Commission of additional outbreaks of HPAI of subtype H5N8 in holdings where poultry or other captive birds are kept in the Segeberg and Vorpommern-Rügen districts of that Member State, and it has taken the measures required in accordance with Directive 2005/94/EC, including the establishment of protection and surveillance zones around these new outbreaks.

(4)

The Commission has examined those measures in collaboration with Germany, and it is satisfied that the borders of the protection and surveillance zones, established by the competent authority of that Member State, are at a sufficient distance to the holdings where the new outbreaks of HPAI of subtype H5N8 have been confirmed.

(5)

In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Germany, the new protection and surveillance zones established by the competent authority of that Member State in accordance with Directive 2005/94/EC. Therefore, the protection and surveillance zones listed for Germany in the Annex to Implementing Decision (EU) 2020/1664 should be amended.

Accordingly, pending the next meeting of the Standing Committee on Plants, Animals, Food and Feed, the Annex to Implementing Decision (EU) 2020/1664 should be amended to update regionalisation at Union level to take account of the new protection and surveillance zones established by Germany in accordance with Directive 2005/94/EC and the duration of the restrictions applicable therein.

(7)

Implementing Decision (EU) 2020/1664 should therefore be amended accordingly.

(8)

Given the urgency of the epidemiological situation in the Union as regards the spread of HPAI of subtype H5N8, it is important that the amendments to be made to the Annex to Implementing Decision (EU) 2020/1664 by this Decision take effect as soon as possible.
