COUNCIL DECISION (EU) 2020/1253

of 4 September 2020

further extending the temporary derogation from the Council’s Rules of Procedure introduced by Decision (EU) 2020/430, and extended by Decisions (EU) 2020/556, (EU) 2020/702 and (EU) 2020/970, in view of the travel difficulties caused by the COVID-19 pandemic in the Union

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 240(3) thereof,

Whereas:

Council Decision (EU) 2020/430 (1) introduced a one-month derogation from the first subparagraph of Article 12(1) of the Council’s Rules of Procedure (2) as regards decisions to use the ordinary written procedure, where those decisions are taken by the Committee of the Permanent Representatives of the Governments of the Member States (Coreper). That derogation was foreseen until 23 April 2020.

Decision (EU) 2020/430 provides that, if justified by continued exceptional circumstances, the Council may renew that Decision. On 21 April 2020, the Council by Decision (EU) 2020/556 (3) extended the derogation provided for in Article 1 of Decision (EU) 2020/430 for a further period of one month from 23 April 2020. That extension of the derogation was foreseen until 23 May 2020. On 20 May 2020, the Council by Decision (EU) 2020/702 (4) extended the derogation provided for in Article 1 of Decision (EU) 2020/430 for a further period until 10 July 2020. On 3 July 2020, the Council by Decision (EU) 2020/970 (5) extended that derogation for a further period until 10 September 2020.

Given that the exceptional circumstances caused by the COVID-19 pandemic continue, with a number of extraordinary preventive and containment measures taken by Member States still in place, it is necessary to extend the derogation provided for in Article 1 of Decision (EU) 2020/430, as extended by Decisions (EU) 2020/556, (EU) 2020/702 and (EU) 2020/970, for a further limited period until 10 November 2020,

HAS ADOPTED THIS DECISION:

Article 1

The derogation provided for in Article 1 of Decision (EU) 2020/430, as extended by Decisions (EU) 2020/556, (EU) 2020/702 and (EU) 2020/970, is hereby further extended until 10 November 2020.

Article 2

This Decision shall take effect on the date of its adoption.

It shall be published in the Official Journal of the European Union.

COUNCIL DECISION (CFSP) 2020/1254

of 7 September 2020

amending Decision 2012/392/CFSP on the European Union CSDP mission in Niger (EUCAP Sahel Niger)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Articles 42(4) and 43(2) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 16 July 2012, the Council adopted Decision 2012/392/CFSP (1) establishing a European Union CSDP mission in Niger to support the capacity building of the Nigerien security actors to fight terrorism and organised crime (EUCAP Sahel Niger).

(2)

On 18 September 2018, the Council adopted Decision (CFSP) 2018/1247 (2) which extended EUCAP Sahel Niger until 30 September 2020.

(3)

On 22 May 2019, the Council adopted Decision (CFSP) 2019/832 (3) which provides that EUCAP Sahel Niger is to contribute, without prejudice to its core mandate in Niger, to the regionalisation of CSDP action in the Sahel.

(4)

On 28 May and 30 June 2020, the Political and Security Committee agreed in the context of the strategic review of EUCAP Sahel Niger to extend that mission until 30 September 2022.

(5)

Decision 2012/392/CFSP should be amended accordingly.

(6)

EUCAP Sahel Niger will be conducted in the context of a situation which may deteriorate and could impede the achievement of the objectives of the Union’s external action as set out in Article 21 of the Treaty on European Union,

HAS ADOPTED THIS DECISION:

Article 1

Decision 2012/392/CFSP is amended as follows:

(1)

in Article 3(1), points (c) and (d) are replaced by the following:

‘(c)

in support of the Union’s objectives on migration, strengthen the Nigerien security forces’ capacities in border management and in the fight against irregular migration;

(d)

facilitate national, regional and international coordination in the fight against terrorism, organised crime and irregular migration, and in border management’;

(2)

in Article 13(1), the following subparagraph is added:

‘The financial reference amount to cover the expenditure related to EUCAP Sahel Niger for the period from 1 October 2020 to 30 September 2022 shall be EUR 73 758 441,09.’;

(3)

in Article 16, the second sentence is replaced by the following:

‘It shall apply until 30 September 2022.’.

Article 2

This Decision shall enter into force on the date of its adoption.
