COMMISSION REGULATION (EU) 2020/1255
of 7 September 2020
amending Regulation (EC) No 1881/2006 as regards maximum levels of polycyclic aromatic hydrocarbons (PAHs) in traditionally smoked meat and smoked meat products and traditionally smoked fish and smoked fishery products and establishing a maximum level of PAHs in powders of food of plant origin used for the preparation of beverages

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EEC) No 315/93 of 8 February 1993 laying down Community procedures for contaminants in food (1), and in particular Article 2(3) thereof,
Whereas:

Commission Regulation (EC) No 1881/2006 (2) sets maximum levels for polycyclic aromatic hydrocarbons (PAHs) in food, including smoked meat and smoked meat products and smoked fish and smoked fishery products. |
(2) |
According to that Regulation, maximum levels for PAHs should be set at a level which is as low as reasonably achievable (ALARA) based upon good manufacturing and agricultural/fishery practices. In 2011, data for smoked fish and smoked meat showed that lower maximum levels were achievable. Nevertheless, adaptations of smoking technology were necessary in some cases. Therefore, for smoked meat and meat products and smoked fish and smoked fishery products a transition period of three years was granted before the lower maximum levels became applicable from 1 September 2014. |

However, despite of the application of good smoking practices, it was established in 2014 that the lower levels for PAHs were unachievable in Ireland, Spain, Croatia, Cyprus, Latvia, Poland, Portugal, Romania, Slovak Republic, Finland, Sweden and the United Kingdom for certain cases of traditionally smoked meat and smoked meat products and in Ireland, Latvia, Romania, Finland, Sweden and the United Kingdom for certain cases of traditionally smoked fish and smoked fishery products. In those cases, the adaptations of smoking practices to comply with the lower maximum PAH levels could not be achieved without changing significantly the organoleptic characteristics of the food. |

Based on the above considerations, and pursuant to Article 7(6) and (7) of Regulation (EC) No 1881/2006, a temporary derogation from the application of the lower maximum levels for PAHs as of 1 September 2014 was granted to the Member States concerned for the placing on their market of traditionally smoked meat and smoked meat products and/or smoked fish and smoked fishery products, smoked in their territory and intended for consumption in their territory. The maximum levels applicable before 1 September 2014 continued to apply to those smoked products. The derogation covered generally all smoked meat and smoked meat products and/or smoked fish and smoked fishery products, without indication of the specific names of foodstuffs. |

In accordance with Article 7(6) and (7) of Regulation (EC) No 1881/2006, the respective Member States have continued to monitor the presence of PAHs in those products and have established programmes to implement good smoking practices where possible. The situation was also reassessed in 2018 on the basis of detailed information provided by the Member States concerned including monitoring data on the presence of PAHs in traditionally smoked meat and smoked meat products and smoked fish and smoked fishery products and information on the implementation of good smoking practices and changes in organoleptic characteristics. Following a detailed assessment of the provided information, it was concluded that the lower PAH levels were not achievable by changing smoking practices within the limits of what is economically feasible and possible without losing typical organoleptic characteristics in certain traditionally smoked meat and smoked meat products in Ireland, Spain, Croatia, Cyprus, Latvia, Poland, Portugal, Slovak Republic, Finland and Sweden and in certain traditionally smoked fish and smoked fishery products in Latvia, Finland and Sweden. Therefore a derogation for local production and consumption should be granted without a time limit for certain traditionally smoked meat and smoked meat products, fish and smoked fishery products in these Member States concerned. |

Furthermore, certain powders of food of plant origin, used for the preparation of beverages, have been found to contain high levels of PAHs due to inappropriate drying practices applied to those powders. Given that PAHs are genotoxic carcinogens, it is therefore necessary to establish a maximum level for PAHs in those powders, achievable by applying good drying practices, with the aim to ensure a high level of human health protection. |

Regulation (EC) No 1881/2006 should therefore be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Amendments to Regulation (EC) No 1881/2006
Regulation (EC) No 1881/2006 is amended as follows:

in Article 7, paragraphs 6 and 7 are replaced by the following: ‘6. By way of derogation from Article 1, the following Member States may authorise the placing on their market of the following traditionally smoked meat and smoked meat products, smoked in their territory and intended for consumption in their territory with levels of PAHs higher than those set out in point 6.1.4 of the Annex, provided that those products comply with the maximum levels applicable before 1 September 2014, i.e. 5,0 μg/kg for benzo(a)pyrene and 30,0 μg/kg for the sum of benzo(a)pyrene, benz(a)anthracene, benzo(b)fluoranthene and chrysene:
Those Member States and concerned food business operators shall continue to monitor the presence of PAHs in traditionally smoked meat and smoked meat products referred to in the first subparagraph of this paragraph and shall ensure that good smoking practices are implemented where possible, without losing typical organoleptic characteristics of those products. 7. By way of derogation from Article 1, the following Member States may authorise the placing on their market of the following traditionally smoked fish and smoked fishery products, smoked in their territory and intended for consumption in their territory with levels of PAHs higher than those set out in point 6.1.5 of the Annex, provided that those smoked products comply with the maximum levels applicable before 1 September 2014, i.e. 5,0 μg/kg for benzo(a)pyrene and 30,0 μg/kg for the sum of benzo(a)pyrene, benz(a)anthracene, benzo(b)fluoranthene and chrysene:
Those Member States and concerned food business operators shall continue to monitor the presence of PAHs in traditionally smoked fish and smoked fishery products referred to in the first subparagraph of this paragraph and shall ensure that good smoking practices are implemented where possible, without losing typical organoleptic characteristics of those products.’; |

the Annex is amended in accordance with the Annex to this Regulation. |
Article 2
Foodstuffs, listed in the Annex to this Regulation, lawfully placed on the market prior to the entry into force may remain on the market after that date until 28 March 2021.
Article 3
Entry into force and application
This Regulation shall enter into force on twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2020/1256

amending Annex I to Implementing Regulation (EU) 2018/659 as regards the entry into the Union of live equidae and of semen, ova and embryos of equidae from Malaysia

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A (I) to Directive 90/425/EEC (1), and in particular Article 17(3) thereof,
Having regard to Council Directive 2009/156/EC of 30 November 2009 on animal health conditions governing the movement and importation from third countries of equidae (2), and in particular point (i) of Article 2, Article 12(1), (4) and (5), Article 13(2), Articles 15 and 16 and points (a) and (b) of Article 19 thereof,
Whereas:

Commission Implementing Regulation (EU) 2018/659 (3) establishes the list of third countries and parts of the territory of third countries from which the entry into the Union of equidae and of their semen, ova and embryos is authorised. It also lays down the animal health and veterinary certification requirements applicable to those consignments. |
(2) |
Directive 2009/156/EC lays down the animal health requirements governing imports of equidae into the Union. It provides that equidae imported into the Union must come from a third country that is free from African horse sickness. |
(3) |
Directive 92/65/EEC lays down the animal health requirements governing imports of semen, ova and embryos of equidae into the Union. It provides that only those commodities that come from a third country or part of the territory of a third country on a list of third countries drawn up in accordance with that Directive, may be imported into the Union. |
(4) |
The specific rules for official controls of consignments of animals and germinal products in transit through the Union, including equidae and their germinal products, are laid down in Commission Delegated Regulation (EU) 2019/2124 (4). |
(5) |
On 1 September 2020 the Department of Veterinary Services of Malaysia confirmed positive results in a test for the detection of genome of the African horse sickness virus carried out on samples taken from horses in the State of Terrenganu, in the north-east of the Malaysian peninsula, at least 60 km from the border with Thailand. The Department of Veterinary Services of Malaysia has duly declared movement controls on horses throughout that third country and informed the World Organisation for Animal Health (OIE). |

The entry into the Union of equidae and of germinal products of equidae from the Malaysian peninsula should no longer be authorised. Accordingly, the entry for Malaysia in Annex I to Implementing Regulation (EU) 2018/659 should be amended, so that the entry into the Union of equidae and germinal products of equidae from the Malaysian peninsula is no longer authorised. |

Implementing Regulation (EU) 2018/659 should therefore be amended accordingly. |
(8) |
Given the risks to animal health, the amendment to the entry for Malaysia in Annex I to Implementing Regulation (EU) 2018/659 should take effect as soon as possible. |

of 7 September 2020
amending the Annex to Implementing Decision 2014/709/EU concerning animal health control measures relating to African swine fever in certain Member States
(notified under document C(2020) 6199)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,
Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary checks applicable in intra-Union trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,
Whereas:

Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine fever in certain Member States, where there have been confirmed cases of that disease in domestic or feral pigs (the Member States concerned). The Annex to that Implementing Decision demarcates and lists certain areas of the Member States concerned in Parts I to IV thereof, differentiated by the level of risk based on the epidemiological situation as regards that disease. The Annex to Implementing Decision 2014/709/EU has been amended several times to take account of changes in the epidemiological situation in the Union as regards African swine fever that need to be reflected in that Annex. The Annex to Implementing Decision 2014/709/EU was last amended by Commission Implementing Decision (EU) 2020/1233 (5), following changes in the epidemiological situation as regards that disease in Poland and Slovakia. |

Since the date of adoption of Implementing Decision (EU) 2020/1233, there have been new occurrences of African swine fever in domestic pigs in Poland. |
(3) |
In August and September 2020, two outbreaks of African swine fever in domestic pigs were observed in the districts of jarosławski and ostródzki in Poland in areas currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. These outbreaks of African swine fever in domestic pigs constitute an increased level of risk, which should be reflected in that Annex. Accordingly, these areas of Poland listed in Part II of that Annex affected by these recent outbreaks of African swine fever, should now be listed in Part III of that Annex instead of in Part II thereof. |

In addition, in August 2020, three outbreaks of African swine fever in domestic pigs were observed in the districts of lubaczowski and krośnieński in Poland in areas listed in Part III of that Annex, located in close proximity to areas currently listed in Part II thereof. These outbreaks of African swine fever in domestic pigs constitute an increased level of risk, which should be reflected in that Annex. Accordingly, these areas of Poland listed in Part II of that Annex, that are in close proximity to the areas listed in Part III affected by these recent outbreaks of African swine fever, should now be listed in Part III of that Annex instead of in Part II thereof. |

In addition, in September 2020, one outbreak of African swine fever in domestic pigs was observed in the district of jarosławski in Poland in an area currently listed in Part I of the Annex to Implementing Decision 2014/709/EU. This outbreak of African swine fever in domestic pigs constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland listed in Part I of that Annex affected by this recent outbreak of African swine fever, should now be listed in Part III of that Annex instead of in Part I thereof. |

Following the recent outbreaks of African swine fever in domestic pigs in Poland, and taking into account the current epidemiological situation in the Union, regionalisation in this Member State has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes need to be reflected in the Annex to Implementing Decision 2014/709/EU. |

In order to take account of recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new high-risk areas of a sufficient size should be demarcated for Poland and duly listed in Part III of the Annex to Implementing Decision 2014/709/EU. Given that Part III of the Annex to Implementing Decision 2014/709/EU lists the areas where the epidemiological situation is still evolving and very dynamic, when any amendments are made to areas listed in that Part, particular consideration must always be given to the effect on the surrounding areas, as has been done in this instance. Parts I, II and III of that Annex should therefore be amended accordingly. |

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments made to the Annex to Implementing Decision 2014/709/EU by this Decision take effect as soon as possible. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Implementing Decision 2014/709/EU is replaced by the text set out in the Annex to this Decision.
