COUNCIL DECISION (EU) 2020/649

of 7 May 2020

on the position to be taken on behalf of the European Union during the 56th session of the Committee of Experts for the Carriage of Dangerous Goods of the Intergovernmental Organisation for International Carriage by Rail as regards certain amendments to Appendix C to the Convention concerning International Carriage by Rail

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 91 in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Union acceded to the Convention concerning International Carriage by Rail of 9 May 1980 as amended by the Vilnius Protocol of 3 June 1999 (‘COTIF’) by means of Council Decision 2013/103/EU (1).

(2)

All Member States, with the exception of Cyprus and Malta, are Parties to COTIF.

(3)

Article 6 COTIF states that international rail traffic and admission of railway material in international traffic are to be governed by rules listed in that Article, in particular the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID), which form Appendix C to COTIF.

(4)

Directive 2008/68/EC of the European Parliament and of the Council (2) lays down requirements for the transport of dangerous goods by road, by rail or by inland waterway within or between Member States on the basis of the RID.

(5)

Pursuant to letter (d) of Article 13 § 1 and Article 33 § 5 COTIF, the Intergovernmental Organisation for International Carriage by Rail (OTIF) Committee of Experts for the Carriage of Dangerous Goods (‘RID Expert Committee’) can amend the Annex to the RID.

(6)

The RID Expert Committee, during its 56th session on 27 May 2020, is to adopt amendments to adapt the Annex to the RID to scientific and technical progress.

(7)

The envisaged amendments concern technical standards and aim at ensuring safe and efficient transport of dangerous goods while taking into account scientific and technical progress in the sector and the development of new substances and articles that could pose a danger while being transported.

(8)

The envisaged amendments are considered to be appropriate for the safe transport of dangerous goods in a cost-effective manner and can therefore be supported.

(9)

It is appropriate to establish the position to be taken on the Union’s behalf in the RID Expert Committee, as the amendments to the RID will be binding on the Union,

HAS ADOPTED THIS DECISION:

Article 1

The position to be taken on the Union’s behalf during the 56th session of the Intergovernmental Organisation for International Carriage by Rail Committee of Experts for the Carriage of Dangerous Goods in the framework of the Convention concerning International Carriage by Rail of 9 May 1980, as amended by the Vilnius Protocol of 3 June 1999, shall be as set out in the table of amendments in document ST 7049/20 (3).

Minor changes to the documents referred to in that table of amendments may be agreed to by the representatives of the Union in the RID Expert Committee without a further decision of the Council.

Article 2

The decisions of the RID Expert Committee, once adopted, shall be published in the Official Journal of the European Union, indicating the date of their entry into force.

Article 3

This Decision shall enter into force on the date of its adoption.

COUNCIL DECISION (EU) 2020/650

of 8 May 2020

appointing a member, proposed by the Republic of Estonia, of the Committee of the Regions

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 305 thereof,

Having regard to the proposal of the Estonian Government,

Whereas:

(1)

On 10 December 2019, 20 January 2020, 3 February 2020 and 26 March 2020, the Council adopted Decisions (EU) 2019/2157 (1), (EU) 2020/102 (2), (EU) 2020/144 (3) and (EU) 2020/511 (4) appointing the members and alternate members of the Committee of the Regions for the period from 26 January 2020 to 25 January 2025.

(2)

A member's seat on the Committee of the Regions has become vacant following the end of the mandate on the basis of which Mr Siim SUURSILD (Representative of a local body with political accountability to an elected Assembly: Pärnu City Council) was proposed,

HAS ADOPTED THIS DECISION:

Article 1

The following is hereby appointed as member of the Committee of the Regions for the remainder of the current term of office, which runs until 25 January 2025:

Mr Siim SUURSILD, Member of a Local Assembly: Pärnu City Council (change of mandate).

Article 2

This Decision shall enter into force on the date of its adoption.

COUNCIL DECISION (CFSP) 2020/651

of 14 May 2020

amending Decision (CFSP) 2019/797 concerning restrictive measures against cyber-attacks threatening the Union or its Member States

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 17 May 2019, the Council adopted Decision (CFSP) 2019/797 (1) concerning restrictive measures against cyber-attacks threatening the Union or its Member States.

(2)

Decision (CFSP) 2019/797 applies until 18 May 2020. On the basis of a review of that Decision, the restrictive measures set out therein should be extended until 18 May 2021.

(3)

Decision (CFSP) 2019/797 should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Article 10 of Decision (CFSP) 2019/797 is replaced by the following:

‘Article 10

This Decision shall apply until 18 May 2021 and shall be kept under constant review. It shall be renewed, or amended as appropriate, if the Council deems that its objectives have not been met.’.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

COUNCIL DECISION (CFSP) 2020/652

of 14 May 2020

amending Decision 2014/219/CFSP on the European Union CSDP Mission in Mali (EUCAP Sahel Mali)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union and in particular Articles 42(4) and 43(2) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 15 April 2014, the Council adopted Decision 2014/219/CFSP (1) on the European Union CSDP Mission in Mali (EUCAP Sahel Mali).

(2)

On 25 June 2018, in its conclusions on Sahel/Mali, the Council underlined the importance of the regionalisation of CSDP in the Sahel with the aim of strengthening, as appropriate, the civilian and military support to cross-border cooperation, the regional cooperation structures – in particular those of the G5 Sahel – and the capacity and ownership of the G5 countries to address the security challenges in the region.

(3)

On 18 February 2019, the Council approved a joint civil-military Concept of Operations on Regionalisation of CSDP action in the Sahel.

(4)

On 21 February 2019, the Council adopted Decision (CFSP) 2019/312 (2), extending EUCAP Sahel Mali and providing it with a financial reference amount until 14 January 2021.

(5)

On 17 March 2020, the Political and Security Committee amended the Operations Plan for EUCAP Sahel Mali and agreed that resources provided to it for the regionalisation of CSDP action in the Sahel should be increased.

(6)

Decision 2014/219/CFSP should be amended accordingly.

(7)

EUCAP Sahel Mali will be conducted in the context of a situation which may deteriorate and could impede the achievement of the objectives of the Union’s external action as set out in Article 21 of the Treaty on European Union,

HAS ADOPTED THIS DECISION:

Article 1

In Article 14(1) of Decision 2014/219/CFSP, the sixth and seventh paragraphs are replaced by the following:

‘The financial reference amount intended to cover the expenditure related to EUCAP Sahel Mali between 1 March 2019 and 14 January 2021 shall be EUR 69 650 000.’.

Article 2

This Decision shall enter into force on the date of its adoption.
