COMMISSION DELEGATED REGULATION (EU) 2020/578
of 21 February 2020
amending Regulation (EU) 2018/196 of the European Parliament and of the Council on additional customs duties on imports of certain products originating in the United States of America
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/196 of the European Parliament and of the Council of 7 February 2018 on additional customs duties on imports of certain products originating in the United States of America (1), and in particular Article 3(3) thereof,
Whereas:

As a result of the United States’ failure to bring the Continued Dumping and Subsidy Offset Act (CDSOA) in compliance with its obligations under the World Trade Organization (WTO) agreements, Regulation (EU) 2018/196 originally imposed a 4,3 % ad valorem additional customs duty on imports of certain products originating in the United States of America. In conformity with the WTO authorisation to suspend the application of concessions to the United States, the Commission is to adjust the level of suspension annually to the level of nullification or impairment caused by the CDSOA to the European Union at that time. In 2019, the level of suspension was adjusted to 0,001 % ad valorem additional customs duty and Regulation (EU) 2018/196 was amended accordingly. |

The CDSOA disbursements for the most recent year for which data are available relate to the distribution of anti-dumping and countervailing duties collected during the Fiscal Year 2019 (1 October 2018-30 September 2019). On the basis of the data published by the United States’ Customs and Border Protection and pursuant to Article 3(1)(a) of Regulation (EU) 2018/196, the level of nullification or impairment caused to the Union is calculated at USD 25 506,30. |

The level of nullification or impairment and consequently of suspension has increased compared to the 2019 level. However, the level of suspension cannot be adjusted to the level of nullification or impairment in accordance with Article 3(1)(c) by adding products to the list in Annex I to Regulation (EU) 2018/196, as all products from the list in Annex II to Regulation (EU) 2018/196 have already been added to Annex I. As a consequence, in accordance with Article 3(1)(e) of that Regulation, the Commission should keep the list of products in Annex I unchanged and amend the rate of the additional duty in order to adjust the level of suspension to the level of nullification or impairment. The four products listed in Annex I should therefore be maintained on the list and the rate of additional import duty should be amended and set at 0,012 %. |

The effect of a 0,012 % ad valorem additional import duty on imports from the United States of the products in Annex I represents, over one year, a value of trade that does not exceed USD 25 506,30. |

To make sure that there are no delays in the application of the amended rate of additional import duty, this Regulation should enter into force on the day of its publication. |

Regulation (EU) 2018/196 should therefore be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Article 2 of Regulation (EU) 2018/196 is replaced by the following:
‘Article 2
An ad valorem duty of 0,012 % additional to the customs duty applicable under Regulation (EU) No 952/2013 of the European Parliament and of the Council (*1) shall be imposed on the products originating in the United States listed in Annex I to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
It shall apply from 1 May 2020.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

granting a Union authorisation for the biocidal product family ‘HYPRED’s octanoic acid based products’

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular the first subparagraph of Article 44(5) thereof,
Whereas:

On 25 August 2015, HYPRED SAS, submitted an application in accordance with Article 43(1) of Regulation (EU) No 528/2012 for authorisation of a biocidal product family named ‘HYPRED‘s octanoic acid based products’ of product-type 4, as described in Annex V to that Regulation, providing written confirmation that the competent authority of the Netherlands had agreed to evaluate the application. The application was recorded under the case number BC-LR019297-17 in the Register for Biocidal Products. |

‘HYPRED‘s octanoic acid based products’ contains octanoic acid, as the active substance, which is included in the Union list of approved active substances referred to in Article 9(2) of Regulation (EU) No 528/2012. |

On 19 December 2017, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation (EU) No 528/2012, an assessment report and the conclusions of its evaluation to the European Chemicals Agency (‘the Agency’). |
|
(4) |
On 11 July 2019, the Agency submitted to the Commission an opinion (2), including the draft summary of the biocidal product characteristics (‘SPC’) of ‘HYPRED‘s octanoic acid based products’ and the final assessment report on the biocidal product family in accordance with Article 44(3) of Regulation (EU) No 528/2012. |

The opinion concludes that ‘HYPRED‘s octanoic acid based products’ is a ‘biocidal product family’ within the meaning of Article 3(1)(s) of Regulation (EU) No 528/2012, that it is eligible for Union authorisation in accordance with Article 42(1) of that Regulation and that subject to compliance with the draft SPC, it meets the conditions laid down in Article 19(1) and (6) of that Regulation. |

On 25 July 2019, the Agency transmitted to the Commission the draft SPC in all the official languages of the Union in accordance with Article 44(4) of Regulation (EU) No 528/2012. |
|
(7) |
The Commission concurs with the opinion of the Agency and considers it therefore appropriate to grant a Union authorisation for ‘HYPRED‘s octanoic acid based products’. |
|
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS REGULATION:
Article 1
A Union authorisation with authorisation number EU-0021020-0000 is granted to HYPRED SAS for the making available on the market and use of the biocidal product family ‘HYPRED‘s octanoic acid based products’ in accordance with the summary of the biocidal product characteristics set out in the Annex.
The Union authorisation is valid from 18 May 2020 until 30 April 2030.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

5.4. Instructions for safe disposal of the product and its packaging
Do not discharge the product directly to sewer or to the environment.
Dispose the product and its packaging in accordance with applicable local and national regulations.
5.5. Conditions of storage and shelf-life of the product under normal conditions of storage
Shelf-life: 2 years in HDPE
Conditions of storage: keep only in the original packaging. Keep container closed. Do not store at temperature above 40 °C.
6. OTHER INFORMATION
The cleaning properties of the product has not been assessed as they are not covered by Regulation (EU) No 528/2012.

granting a Union authorisation for the biocidal product family ‘SOPURCLEAN’

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular the first subparagraph of Article 44(5) thereof,
Whereas:

On 28 August 2015, SOPURA N.V., submitted an application in accordance with Article 43(1) of Regulation (EU) No 528/2012 for authorisation of a biocidal product family named ‘SOPURCLEAN’ of product-type 4, as described in Annex V to that Regulation, providing written confirmation that the competent authority of Belgium had agreed to evaluate the application. The application was recorded under the case number BC-PJ019489-22 in the Register for Biocidal Products. |

(2) |
‘SOPURCLEAN’ contains octanoic acid and decanoic acid, as the active substances, which are included in the Union list of approved active substances referred to in Article 9(2) of Regulation (EU) No 528/2012. |
|
(3) |
On 15 December 2017, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation (EU) No 528/2012, an assessment report and the conclusions of its evaluation to the European Chemicals Agency (‘the Agency’). |
|
(4) |
On 15 July 2019, the Agency submitted to the Commission an opinion (2), including the draft summary of the biocidal product characteristics (‘SPC’) of ‘SOPURCLEAN’ and the final assessment report on the biocidal product family in accordance with Article 44(3) of Regulation (EU) No 528/2012. |
|
(5) |
The opinion concludes that ‘SOPURCLEAN’ is a ‘biocidal product family’ within the meaning of Article 3(1)(s) of Regulation (EU) No 528/2012, that it is eligible for Union authorisation in accordance with Article 42(1) of that Regulation and that subject to compliance with the draft SPC, it meets the conditions laid down in Article 19(1) and (6) of that Regulation. |

(6) |
On 26 July 2019, the Agency transmitted to the Commission the draft SPC in all the official languages of the Union in accordance with Article 44(4) of Regulation (EU) No 528/2012. |
|
(7) |
The Commission concurs with the opinion of the Agency and considers it therefore appropriate to grant a Union authorisation for ‘SOPURCLEAN’. |
|
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS REGULATION:
Article 1
A Union authorisation with authorisation number EU-0021157-0000 is granted to SOPURA N.V. for the making available on the market and use of the biocidal product family ‘SOPURCLEAN’ in accordance with the summary of the biocidal product characteristics set out in the Annex.
The Union authorisation is valid from 18 May 2020 until 30 April 2030.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

5.1. Instructions for use
For an effect on bacteria and on yeasts

Rinsing and cleaning before disinfection: |
Not mandatory (even if a pre-rinsing is always recommended and usually performed by the users). For disinfection procedures in slaughterhouses, cleaning with a cold alkaline solution) is mandatory before disinfection.
|

Disinfecting cycle:
In case of outbreaks of Pediococcus damnosus, the product must be used at 2 %.
|

5.2. Risk mitigation measures
Use in well-ventilated places.
During the mixing, loading and application phases: wear a protective coverall. Wear protective chemical resistant gloves during product handling phase (glove material to be specified by the authorisation holder within the product information). Use eye protection during handling of the product. Wear face protection.
5.3. Particulars of likely direct or indirect effects, first aid instructions and emergency measures to protect the environment
Particulars of likely direct or indirect adverse effects:

Severe chemical burns and/or corrosion of the eyes, mucosae, respiratory and digestive tract with the risk of perforation and intense pain. Absence of visual oral burns does not exclude esophageal burns. |

If aspiration and/or ingestion occurs this may induce chemical pneumonia and metabolic acidosis. |
First aid instructions:

Relocate the individual from the exposure source and remove any contaminated/spattered clothing articles. |

Keep only in the original packaging tightly closed in a cool and well-ventilated place
Keep the product away from direct sunlight, source of heat and ignition.
The product must be stored at temperatures below +30 °C.
Do not discharge unused product on the ground, into water courses, into pipes (e.g. sink, toilets) nor down the drains.
Dispose of unused product, its packaging and all other waste, in accordance with local regulations.
5.5. Conditions of storage and shelf-life of the product under normal conditions of storage
Storage conditions:

Store in a clean area allowing recuperation of leaks and effusion. |

Protect from freezing. Provide local exhaust or general room ventilation to minimize dust and/or vapour concentrations. Keep container closed when not in use. |

Packaging material: Use approved materials suitable for corrosive liquids.
Shelf-life: 12 months in the original packaging.
6. OTHER INFORMATION
Any product in meta SPC1 shall contain sufficient amounts of acids to yield a pH ≤ 2 at the dilution of 1,5 %.

Not mandatory (even if a pre-rinsing is always recommended and usually performed by the users).
For disinfection procedures in slaughterhouses, cleaning with a cold alkaline solution is mandatory before disinfection.

In case of outbreaks of Pediococcus damnosus, the product must be used at 2 %.

Particulars of likely direct or indirect adverse effects:

Severe chemical burns and/or corrosion of the eyes, mucosae, respiratory and digestive tract with the risk of perforation and intense pain. Absence of visual oral burns does not exclude esophageal burns. |

amending Implementing Regulation (EU) 2018/659 on the conditions for the entry into the Union of live equidae and of semen, ova and embryos of equidae

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC (1), and in particular Article 17(3) thereof,
Having regard to Council Directive 2009/156/EC of 30 November 2009 on animal health conditions governing the movement and importation from third countries of equidae (2), and in particular Article 12(1) and (4), Article 13(2), Article 16 and Article 19(b) thereof,
Whereas:

(1) |
Commission Implementing Regulation (EU) 2018/659 (3) lays down the conditions for entry into the Union of equidae and of semen, ova and embryos of equidae. It sets out the list of third countries from where Member States are to authorise the entry of equidae and of semen, ova and embryos of animals of the equine species, and specifies the animal health and veterinary certification conditions for such entries. |
|
(2) |
Directive 2009/156/EC lays down the animal health requirements governing imports of equidae into the Union. It provides that imports of equidae into the Union are only authorised from third countries or parts of the territory thereof which have been free from glanders (Burgholderia mallei) for a period of at least six months. |
|
(3) |
On 25 December 2019, Turkey notified through the Animal Disease Notification System, that a case of glanders was confirmed on 4 December 2019 in a horse on the Büyükada Island, Province of Istanbul, Turkey. The entry into the Union of equidae and of germinal products of equidae from Turkey should be suspended for a period of at least 6 months. It is therefore necessary to amend the entry for Turkey in Annex I to Implementing Regulation (EU) 2018/659. |
|

A new Show Jumping League has been established in the United Arab Emirates under the auspices of the Fédération Equestre Internationale (‘FEI’) which includes qualifying tests for the Show Jumping World Cup. Based on the animal health guarantees provided by the United Arab Emirates, adding the series of show jumping competitions of the United Arab Emirates International Show Jumping League to the list of events for which the re-entry into the Union after a temporary export of less than 90 days is authorised is justified. It is therefore necessary to amend the model health certificate and the model declaration set out in Chapter 1 of Section B of Part 2 of Annex II to Implementing Regulation (EU) 2018/659. |

Implementing Regulation (EU) 2018/659 should therefore be amended accordingly. |
|
(6) |
In order to avoid a negative impact on trade, it is necessary to provide for a transitional period until 31 October 2020 during which animal health certificates issued in accordance with Implementing Regulation (EU) 2018/659, as amended by Implementing Regulation (EU) 2019/2147 (4), shall be accepted provided they are issued prior to 21 October 2020. |
|

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Implementing Regulation (EU) 2018/659 is amended as follows:

(1) |
In Annex I, the entry for Turkey is amended in accordance with Annex I to this Regulation. |
|
(2) |
In Annex II, Chapter 1 of Section B of Part 2 is replaced by the text set out in Annex II to this Regulation. |
Article 2
Until 31 October 2020, Member States shall authorise the re-entry into the Union of registered horses accompanied by the relevant animal health certificate drawn up in accordance with the model health certificate set out in Chapter 1 of Section B of Part 2 of Annex II to Implementing Regulation (EU) 2018/659, as amended by Implementing Regulation (EU) 2019/2147, provided that the animal health certificate was issued prior to 21 October 2020.

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
