COMMISSION IMPLEMENTING REGULATION (EU) 2020/404
of 12 March 2020
amending Regulation (EC) No 594/2009 concerning the classification of certain goods in the Combined Nomenclature
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code (1), and in particular Article 57(4) and Article 58(2) thereof,
Whereas:

By Commission Regulation (EC) No 594/2009 (2), a product described in the row corresponding to item 1 in the table in the Annex to that Regulation as consisting of vinylidene fluoride and hexafluoro propylene copolymer in primary form has been classified under CN code 3904 69 90. |
|
(2) |
By Commission Regulation (EU) No 861/2010 (3) CN code ‘3904 69 90 Other’ was replaced by CN codes ‘3904 69 20 Fluoroelastomer FKM’ and ‘3904 69 80 Other’ to introduce a specific CN code for fluoroelastomers FKM. |

(3) |
By Commission Implementing Regulation (EU) No 441/2013 (4) CN code 3904 69 90 was replaced by CN code 3904 69 80 in the Annex to Regulation (EC) No 594/2009. Thus, classification of the product described in the row corresponding to item 1 in the table in the Annex to Regulation (EC) No 594/2009 under ‘other’ was maintained contrary to the general rule that the heading which provides for the most specific description is to be preferred to headings providing a more general description. |

That period should be set at three months. |

The measures provided for in this Regulation are in accordance with the opinion of the Customs Code Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EC) No 594/2009 is amended as follows:

in Article 2, the following paragraph is added: ‘Binding tariff information issued in accordance with this Regulation as amended by Implementing Regulation (EU) No 441/2013 in respect of the goods described in column (1) of point 1 of the table set out in the Annex to this Regulation in its version adopted on 8 July 2009 may continue to be invoked in accordance with Article 34(9) of Regulation (EU) No 952/2013 for a period of three months from 6 April 2020.’; |

(2) |
the row for point 1 in the table set out in the Annex is deleted. |
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2020/405

specifying the arrangements for, and contents of, the quality reports to be transmitted under Regulation (EU) 2018/1091 of the European Parliament and of the Council on integrated farm statistics

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/1091 of the European Parliament and of the Council of 18 July 2018 on integrated farm statistics and repealing Regulations (EC) No 1166/2008 and (EU) No 1337/2011 (1), and in particular Article 11(4) thereof,
Whereas:

(1) |
Article 11(4) of Regulation (EU) 2018/1091 requires the Member States to transmit to the Commission quality reports describing the statistical process for each reference year, and allows the Commission to adopt implementing acts setting out the practical arrangements for, and the contents of, those reports. |
|
(2) |
There is a need to ensure common quality reporting for the exchange of quality-related data and metadata. |
|
(3) |
The measures provided for in this Regulation are in accordance with the opinion of the European Statistical System Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
This Regulation lays down the practical arrangements for, and the contents of, the quality reports that Member States transmit to the Commission (Eurostat) in accordance with Regulation (EU) 2018/1091.
Article 2
The quality reports referred to in Article 1 shall contain information on the quality criteria and statistical concepts as set out in the Annex to this Regulation. They shall also refer to all cases of non-compliance with those quality criteria.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX
Quality reports – quality criteria and statistical concepts
(a) The quality reports must include information on all the quality criteria referred to in Article 12(1) of Regulation (EC) No 223/2009, as follows:
1. RELEVANCE
|
(a) |
a description of users, their respective needs and a justification of those needs; |
|
(b) |
procedures used to measure user satisfaction and produce the statistical results; |
|
(c) |
the extent to which the required statistics are available. |
2. ACCURACY
|
(a) |
an accuracy assessment that summarises the various dataset components; |
|
(b) |
a description of sampling errors; |
|
(c) |
a description of any other errors. |
3. TIMELINESS AND PUNCTUALITY
|
(a) |
the time-lag between the event or phenomenon described and the data availability (timeliness); |
|
(b) |
the time-lag between the target date for data delivery and the actual delivery date (punctuality). |
4. ACCESSIBILITY AND CLARITY
|
(a) |
conditions and means by which users can obtain and use the data, e.g. news releases, publications, online databases or micro data access; |
|
(b) |
conditions and means by which users can interpret the data, e.g. documentation on methodology and quality management. |
5. COMPARABILITY
|
(a) |
the extent to which statistics are comparable between geographical areas; |
|
(b) |
the extent to which statistics are comparable over time. |
6. COHERENCE
|
(a) |
the extent to which statistics are reconcilable with data from other sources (cross-domain coherence); |
|
(b) |
the extent to which statistics are consistent within a given dataset (internal coherence). |
(b) Member States must also report on:
1. QUALITY MANAGEMENT
|
(a) |
the systems and frameworks in place to manage the quality of statistical products and processes; |
|
(b) |
their assessment of the quality of the data. |
2. DATA REVISION
|
(a) |
the revision policy and, if applicable, why validated data has been revised, e.g. new data sources, new methods or other relevant information; |
|
(b) |
the dates, size and magnitude of any revisions. |
(c) In accordance with Article 11(4) of Regulation (EU) 2018/1091, the quality reports must include information on the statistical process, in particular the methodology and the sampling frame used, as follows:
1. STATISTICAL PRESENTATION
The following aspects of the disseminated data, which can be displayed as tables, graphs or maps:

data description; |
|
(b) |
classification system; |
|
(c) |
sector coverage; |
|
(d) |
statistical concepts and definitions; |

reference area (geographical scope); |

time coverage (length of time for which data are available); |

(i) |
reference period (period covered by the report); |
|
(j) |
unit of measurement. |
2. STATISTICAL PROCESSING
The following aspects of all operations performed on data to derive new information:

(a) |
sampling frame; |
|
(b) |
sampling design (if relevant); |
|
(c) |
source data; |
|
(d) |
frequency of data collection; |
|
(e) |
data collection mode including, if relevant, the questionnaires (in English); |
|
(f) |
data validation; |
|
(g) |
data compilation; |
|
(h) |
adjustment. |
3. RELEASE POLICY
The rules for disseminating the data at national level.
4. FREQUENCY OF DISSEMINATION
The frequency with which the data are disseminated at national level.
(d) In line with the statistical principles in Article 2(1) of Regulation (EC) No 223/2009, points (a), (e) and (f), Member States must report on:
1. INSTITUTIONAL MANDATE

(a) |
legal acts or other agreements that assign responsibility and authority for the collection, processing and dissemination of statistics; |
|
(b) |
procedures for data sharing and coordination between data-producing entities. |
2. CONFIDENTIALITY
|
(a) |
legislative measures or other formal procedures preventing any unauthorised disclosure of data that could directly or indirectly lead to the identification of a person or economic entity; |
|
(b) |
the rules applying to the treatment of micro data and aggregated data to ensure statistical confidentiality and prevent unauthorised disclosure. |
3. COST AND BURDEN
|
(a) |
the cost and burden associated with the collection and production of the statistical product; |
|
(b) |
the burden on respondents; |
|
(c) |
the average duration of farm interviews (where possible and relevant depending on the data collection mode). |

of 16 March 2020
amending the Annex to Implementing Decision (EU) 2020/47 on protective measures in relation to highly pathogenic avian influenza of subtype H5N8 in certain Member States
(notified under document C(2020) 1719)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,
Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary checks applicable in intra-Union trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,
Whereas:

(1) |
Commission Implementing Decision (EU) 2020/47 (3) was adopted following outbreaks of highly pathogenic avian influenza of subtype H5N8 in holdings where poultry are kept in certain Member States, and the establishment of protection and surveillance zones by those Member States in accordance with Council Directive 2005/94/EC (4). |
|
(2) |
Implementing Decision (EU) 2020/47 provides that the protection and surveillance zones established by the Member States listed in the Annex to that Implementing Decision, in accordance with Directive 2005/94/EC, are to comprise at least the areas listed as protection and surveillance zones in that Annex. |
|
(3) |
The Annex to Implementing Decision 2020/47 was recently amended by Commission Implementing Decision (EU) 2020/384 (5), following outbreaks of highly pathogenic avian influenza of subtype H5N8 in poultry in Bulgaria and Poland that needed to be reflected in that Annex. |
|
(4) |
Since the date of adoption of Implementing Decision (EU) 2020/384, Poland has notified the Commission of two new outbreaks of highly pathogenic avian influenza of subtype H5N8 in holdings where poultry are kept, in the zgierskim and wrocławskim districts. |
|
(5) |
In addition, Bulgaria has notified the Commission of additional outbreaks of highly pathogenic avian influenza of subtype H5N8 in holdings where poultry are kept in the Plovdiv and Kurdzhali regions. |
|
(6) |
One of the new outbreaks, in the zgierskim district of Poland, is located within the boundaries of areas currently listed in the Annex to Implementing Decision (EU) 2020/47. However, the boundaries of the new protection and surveillance zones around this new outbreak, established by the competent authorities of Poland, in accordance with Directive 2005/94/EC go beyond the areas currently listed in the Annex to Implementing Decision (EU) 2020/47, and accordingly the areas listed in that Annex need to be updated. |
|
(7) |
The other new outbreak, in the wrocławskim district of Poland, is located outside the boundaries of areas currently listed in the Annex to Implementing Decision (EU) 2020/47, and the competent authorities of that Member State have taken the necessary measures required, in accordance with Directive 2005/94/EC, including the establishment of new protection and surveillance zones around this new outbreak. |
|
(8) |
The new outbreaks in Bulgaria, in the Plovdiv region, are located within the boundaries of the areas currently listed in the Annex to Implementing Decision (EU) 2020/47, but the duration of the measures required, in accordance with Directive 2005/94/EC, in the protection and surveillance zones has to be extended, to take account of the current epidemiological situation in that Member State. |
|
(9) |
The new outbreak in Bulgaria, in the Kurdzhali region, is located outside the boundaries of areas currently listed in the Annex to Implementing Decision (EU) 2020/47, and the competent authorities of that Member State have taken the necessary measures required, in accordance with Directive 2005/94/EC, including the establishment of new protection and surveillance zones around this new outbreak. |
|
(10) |
The Commission has examined the measures taken by Bulgaria and Poland, in accordance with Directive 2005/94/EC, and it is satisfied that the boundaries of the new protection and surveillance zones, established by the competent authorities of Poland and Bulgaria, are at a sufficient distance to the holdings where the recent outbreaks of highly pathogenic avian influenza of subtype H5N8 have been confirmed. It has also examined the extension of the required duration of the measures in the protection and surveillance zones in Bulgaria, in the Plovdiv region, where there has been the new outbreaks, and it is satisfied that the extended duration is appropriate based on the current epidemiological situation. |
|
(11) |
In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Bulgaria and Poland, the new protection and surveillance zones established by those Member States, and the adapted duration of the measures applicable in the Plovdiv region of Bulgaria, in accordance with the requirements of Directive 2005/94/EC. Therefore, the protection and surveillance zones listed for Bulgaria and Poland in the Annex to Implementing Decision (EU) 2020/47, and the required duration of the measures applicable in certain protection and surveillance zones in the Plovdiv region listed for Bulgaria in that Annex, should be amended. |
|
(12) |
Implementing Decision (EU) 2020/47 should therefore be amended accordingly. |
|
(13) |
Given the urgency of the epidemiological situation in the Union as regards the spread of highly pathogenic avian influenza of subtype H5N8, it is important that the amendments made to the Annex to Implementing Decision (EU) 2020/47 by this Decision take effect as soon as possible. |
|
(14) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Implementing Decision (EU) 2020/47 is replaced by the text set out in the Annex to this Decision.
Article 2
This Decision is addressed to the Member States.

amending Decision (EU) 2019/1311 on a third series of targeted longer-term refinancing operations (ECB/2020/13)
THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,
Having regard to the Treaty on the Functioning of the European Union, and in particular the first indent of Article 127(2) thereof,
Having regard to the Statute of the European System of Central Banks and of the European Central Bank, and in particular the first indent of Article 3.1, Article 12.1, the second indent of Article 18.1 and the second indent of Article 34.1 thereof,
Having regard to Guideline (EU) 2015/510 of the European Central Bank of 19 December 2014 on the implementation of the Eurosystem monetary policy framework (General Documentation Guideline) (ECB/2014/60) (1),

Pursuant to Article 1(4) of Guideline (EU) 2015/510 (ECB/2014/60), the Governing Council may, at any time, change the tools, instruments, requirements, criteria and procedures for the implementation of Eurosystem monetary policy operations. |
|

On 22 July 2019, in pursuing its price stability mandate and to preserve favourable bank lending conditions and support the accommodative stance of monetary policy in Member States whose currency is the euro, the Governing Council adopted Decision (EU) 2019/1311 of the European Central Bank (ECB/2019/21) (2). This Decision provided for a third series of targeted longer-term refinancing operations (TLTROs-III) to be conducted over the period from September 2019 to March 2021. |

On 12 March 2020, in order to support bank lending to those most affected by the spread of the coronavirus disease (COVID-19), in particular small and medium-sized enterprises, the Governing Council decided to change three parameters of TLTRO-III, namely to increase the borrowing allowance from 30 % to 50 %, modify the maximum bid limit for individual TLTROs-III and, starting from September 2021, offer an early repayment option for amounts borrowed under TLTROs-III 12 months after the settlement of each operation, instead of 24 months. |

In order to apply these adjusted parameters with immediate effect, this Decision should enter into force without delay. |

Therefore, Decision (EU) 2019/1311 (ECB/2019/21) should be amended accordingly, |
HAS ADOPTED THIS DECISION:

in Article 5a, paragraph 1 is replaced by the following: ‘1. From September 2021, starting 12 months after the settlement of each TLTRO-III, participants shall, on a quarterly basis, have the option of terminating or reducing the amount of TLTRO-III concerned before maturity.’; |

in Annex I, Section 1, the third paragraph is replaced by the following: ‘The borrowing allowance equals 50 % of the reference outstanding amount relating to the participant (*1) minus the amounts borrowed by the participant in the targeted longer-term refinancing operations pursuant to Decision (EU) 2016/810 (ECB/2016/10) (TLTROs-II) and still outstanding at the settlement date of the respective TLTRO-III, or zero if such amount is negative, i.e.:
