THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 715/2007 of the European Parliament and of the Council of 20 June 2007 on type-approval of motor vehicles with respect to emissions from light passenger and commercial vehicles (Euro 5 and Euro 6) (1), and in particular Articles 8 and 14(3) thereof,

Having regard to Directive 2007/46/EC of the European Parliament and of the Council of 5 September 2007 establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles (Framework Directive) (2), and in particular Article 39(2) thereof.

Whereas:

(1)

In the German language version of Commission Regulation (EU) 2017/1151 (3) the meaning of the provisions in points 4.2.1.1.2 and 4.2.2.1 of Sub-Annex 4 to Annex XXI and in points 3.2.3.2.2.2.2 and 3.2.4.1.1.2.2 of Sub-Annex 7 to Annex XXI, specifying that additional wheels and tyres are not to be considered as optional equipment, has been inversed.

(2)

The German language version of Regulation (EU) 2017/1151 should therefore be corrected accordingly. The other language versions are not affected.

(3)

The measures provided for in this Regulation are in accordance with the opinion of the Technical Committee — Motor Vehicles,

HAS ADOPTED THIS REGULATION:

Article 2

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING DECISION (EU) 2020/50

of 21 January 2020

amending Implementing Decision (EU) 2019/919 on the harmonised standards for recreational craft and personal watercraft drafted in support of Directive 2013/53/EU of the European Parliament and of the Council as regards small craft identification, coding system, hull construction and scantlings for monohulls

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,

Whereas:

In accordance with Article 14 of Directive 2013/53/EU of the European Parliament and of the Council (2), products which are in conformity with harmonised standards or parts thereof the references of which have been published in the Official Journal of the European Union, are presumed to be in conformity with the requirements covered by those standards or parts thereof set out in Article 4(1) of Directive 2013/53/EU and Annex I to that Directive.

By Commission Implementing Decision C(2015) 8736 (3), the Commission made a request to CEN/Cenelec for drafting, revision and completion of the work on harmonised standards in support of Directive 2013/53/EU addressing stricter essential requirements set out in Article 4(1) of Directive 2013/53/EU and Annex I to that Directive in comparison with the repealed Directive 94/25/EC of the European Parliament and of the Council (4).

Specifically, CEN/Cenelec were requested to adopt new standard for watercraft identification for which the essential requirements are set out in point 2.1 of Part A of Annex I to Directive 2013/53/EU. CEN/Cenelec were also requested to duly take into account the items being the subject of implementing acts adopted on the basis of Article 49 of Directive 2013/53/EU so as to avoid an overlap of requirements.

On the basis of the request set out in Implementing Decision C(2015) 8736, CEN drafted standard EN ISO 10087:2019 Small craft — Craft identification — Coding system.

The Commission together with CEN has assessed whether the standard EN ISO 10087:2019 drafted by CEN complies with the request set out in Implementing Decision C(2015) 8736 and whether it is consistent with the implementing acts adopted on the basis of Article 49 of Directive 2013/53/EU.

Commission Implementing Regulation (EU) 2017/1 (5), adopted on basis of Article 49(1)(c) of Directive 2013/53/EU, lays down rules on watercraft identification, in particular the minimum rules regarding the procedure for the assignment and administration of the unique code of the manufacturer.

(7)

The standard EN ISO 10087:2019 sets out the details on the watercraft identification number regarding the size and permanency of marking, location, duplicate of identification number, time of marking and display format. It complements the composition of watercraft identification number set out in Article 3 of Implementing Regulation (EU) 2017/1.

By Implementing Decision C(2015) 8736 CEN/Cenelec were also requested to revise standards the references of which were published in the Official Journal of the European Union C 87 of 13 March 2015.

On the basis of the request set out in Implementing Decision C(2015) 8736, CEN drafted standard EN ISO 12215-5:2019 Small craft — Hull construction and scantlings, part 5.

The Commission together with CEN has assessed whether the standard EN ISO 12215-5:2019 drafted by CEN complies with the request set out in Implementing Decision C(2015) 8736.

(11)

The standard EN ISO 12215-5:2019 addresses the essential requirements set out in point 3.1 of Part A of Annex I to Directive 2013/53/EU and sets out the details on the design pressures for monohull craft, design stresses and scantlings determination.

The standards EN ISO 10087:2019 and EN ISO 12215-5:2019 satisfy the requirements which they aim to cover and which are set out in Article 4(1) of Directive 2013/53/EU, as well as in points 2.1 and 3.1 of Part A of Annex I to that Directive. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union.

Standard EN ISO 12215-5:2019 is to replace standard EN ISO 12215-5:2018. It is therefore necessary to withdraw the reference of standard EN ISO 12215-5:2018 from the Official Journal of the European Union.

(14)

In order to give manufacturers sufficient time to prepare for application of standard EN ISO 12215-5:2019, it is necessary to defer the withdrawal of the reference of the standard that is replaced until 30 June 2021.

References of harmonised standards drafted in support of Directive 2013/53/EU are published in Commission Implementing Decision (EU) 2019/919 (6). In order to ensure that the references of harmonised standards drafted in support of Directive 2013/53/EU are listed in the same act, the references of standards EN ISO 10087:2019 and EN ISO 12215-5:2019 should be included in Annex I to that Implementing Decision, and the reference to standard EN ISO 12215-5:2018 should be deleted from that Annex.

Implementing Decision (EU) 2019/919 should therefore be amended accordingly.

(17)

Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to Implementing Decision (EU) 2019/919 is amended in accordance with the Annex to this Decision.

Article 2

This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

Point (1) of the Annex shall apply from 1 July 2021.

DECISION No 2/2019 OF THE EUROPEAN UNION/SWITZERLAND STATISTICAL COMMITTEE

of 2 December 2019

replacing Annex A to the Agreement between the European Community and the Swiss Confederation on cooperation in the field of statistics [2020/51]

THE EUROPEAN UNION/SWITZERLAND STATISTICAL COMMITTEE,

Having regard to the Agreement between the European Community and the Swiss Confederation on cooperation in the field of statistics (1), hereinafter referred to as ‘the Agreement’, and in particular Article 4(4) thereof,

Whereas:

(1)

The Agreement entered into force on 1 January 2007 and contains Annex A concerning legal acts in the field of statistics.

(2)

New legal acts in the field of statistics have been adopted and should be referred to in Annex A. Consequently, Annex A should be amended,

HAS DECIDED AS FOLLOWS:

Article 1

Annex A to the Agreement is replaced by the Annex to this Decision.

Article 2

This Decision shall enter into force on the date of its adoption.

‘ANNEX A

LEGAL ACTS IN THE FIELD OF STATISTICS REFERRED TO IN ARTICLE 2

SECTORAL ADAPTATIONS

1.

By virtue of the Treaty of Lisbon, entered into force on 1 December 2009, the European Union shall replace and succeed the European Community.

2.

The term “Member State(s)” contained in the acts referred to in this Annex shall be understood to include Switzerland, in addition to its meaning in the relevant European Union acts.

3.

The Statistical Programme Committee (SPC) referred to in Article 3(2) of this Agreement has been replaced by the European Statistical System Committee (ESS Committee) established by Article 7(1) of Regulation (EC) No 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics and repealing Regulation (EC, Euratom) No 1101/2008 of the European Parliament and of the Council on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities, Council Regulation (EC) No 322/97 on Community Statistics, and Council Decision 89/382/EEC, Euratom establishing a Committee on the Statistical Programmes of the European Communities (1).

4.

The Community statistical programme referred to in Article 5(1) and (2), and in Article 8(1) of this Agreement has been replaced by the European statistical programme provided for in Article 13 of Regulation (EC) No 223/2009.

5.

The Joint Committee notes that the rules governing the handling of statistics from Switzerland referred to in Article 5(3) of this Agreement are now provided for in Regulation (EC) No 223/2009 without prejudice to more specific rules which are referred to in this Annex.

6.

References to the “Nomenclature of the Economic Activities in the European Communities (NACE Rev. 1)” shall, except where otherwise provided, be read as references to “Nomenclature of Economic Activities in the European Communities (NACE Rev. 2)”, as defined by Regulation (EC) No 1893/2006 of the European Parliament and of the Council of 20 December 2006 establishing the statistical classification of economic activities NACE Revision 2 and amending Council Regulation (EEC) No 3037/90 as well as certain EC Regulations on specific statistical domains (2). The referred code numbers shall be read as the corresponding converted code numbers in NACE Rev. 2.

7.

Provisions laying down by whom the costs for carrying out surveys and the like shall be borne shall not apply for the purposes of this Agreement.

8.

The Appendices shall form an integral part of this Annex.

For Annex IV (Construction), Switzerland is exempted from providing results for characteristics 15 44 1, 18 12 1, 18 12 2, 18 15 0, 18 16 0, 18 31 0, 18 32 0, 23 11 0 and 23 12 0;

For Annex VII (Pension funds), Switzerland is exempted from providing results for characteristic 48 61 0;

(h)

Annex VIII (Business services) is not applicable to Switzerland;

For Annex IX (Business demography), Switzerland is permitted to transmit results for all characteristics of series 9A, 9B, 9E, 9F and 9M only, having as first reference year 2015; besides, Switzerland is permitted to transmit results for those series within 23 months of the end of the reference year, except for results relating to deaths included in those series, that shall be transmitted within 35 months of the end of the reference year.

For Annex B (Construction), Switzerland is exempted from providing data for the variable 412 (Building permits: square metres of useful floor area or alternative size measure);

(e)

For Annex D (Other services), Switzerland is permitted to apply the year as reference period for the variable 310 (Output prices); besides, Switzerland is permitted to transmit data for the variable 310 within 10 months after the end of the reference period.

Article 5(1) Statistical data: Statistical data referred to in Article 5(1)(e) shall be collected for the first time by 1 January 2016;

The provisions of Article 5(1)(f) and (k) shall not apply;

The classification referred to in Article 5(1)(h) shall be made at least down to the first six digits;

For Switzerland, the provisions of Article 5(1)(m)(ii) and (iii) shall not apply;

(d)

Article 6 Compilation of external trade statistics: The provisions of Article 6 shall not apply for statistical data for which Switzerland is exempted from collecting pursuant to Article 5 of the Regulation thereof;

(e)

Article 7 Data exchange: The provisions of Article 7(2) shall not apply.

Article 7 (Amendment to Regulation (EU) No 1151/2010) is not applicable. Switzerland shall however store the data and metadata for the 2011 reference year until 1 January 2035 and shall inform the Commission (Eurostat) about the changes or revisions to these data before they are implemented.

8.   Demographic statistics

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

Articles 4 “Total population for specific Union purposes”, 5(2) “Frequency and reference time”, and 8 “Feasibility studies” are not applicable.

9.   Acts of which the Contracting Parties shall take note

The Contracting Parties shall take note of the following recommendation which shall have no binding force:

Switzerland is exempted from the statistics of animals for slaughter as required by Annex II, categories of livestock statistics, bovine animals aged over 1 year but under 2 years, female (heifers; animals that have not yet calved);

Switzerland is exempted from the statistics of other as required by Annex II, categories of livestock statistics, bovine animals aged over 1 year but under 2 years, female (heifers; animals that have not yet calved);

Switzerland is exempted from the statistics of animals for slaughter as required by Annex II, categories of livestock statistics, bovine animals of 2 years and over, female, heifers;

Switzerland is exempted from the statistics of other as required by Annex II, categories of livestock statistics, bovine animals of 2 years and over, female, heifers;

Switzerland is exempted from the statistics of pigs with a live weight of 50 kg or more but less than 80 kg as required by Annex II, categories of livestock statistics, fattening pigs, including cull boars and cull sows;

Switzerland is exempted from the statistics of pigs with a live weight of 80 kg or more but less than 110 kg as required by Annex II, categories of livestock statistics, fattening pigs, including cull boars and cull sows;

Switzerland is exempted from the statistics of pigs with a live weight of 110 kg or more as required by Annex II, categories of livestock statistics, fattening pigs, including cull boars and cull sows;

Switzerland is exempted from the statistics of sows covered for the first time as required by Annex II, categories of livestock statistics, breeding pigs with a live weight of 50 kg and over, covered sows;
