amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2019/1356]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

(1) |
Commission Implementing Decision (EU) 2017/1178 of 2 June 2017 amending Implementing Decision (EU) 2016/2008 concerning animal health control measures relating to lumpy skin disease in certain Member States (1) is to be incorporated into the EEA Agreement. |
|
(2) |
This Decision concerns legislation regarding live animals other than fish and aquaculture animals and animal products such as ova, embryo and semen. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland. |

(3) |
This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein. |

Annex I to the EEA Agreement should therefore be amended accordingly, |

Commission Implementing Regulation (EU) 2017/1145 of 8 June 2017 on the withdrawal from the market of certain feed additives authorised pursuant to Council Directives 70/524/EEC and 82/471/EEC and repealing the obsolete provisions authorising those feed additives (1) is to be incorporated into the EEA Agreement. |

Implementing Regulation (EU) 2017/1145 repeals Commission Regulations (EC) No 937/2001 (2), (EC) No 871/2003 (3), (EC) No 277/2004 (4), (EC) No 278/2004 (5), (EC) No 1332/2004 (6), (EC) No 1463/2004 (7), (EC) No 1465/2004 (8), (EC) No 833/2005 (9), (EC) No 492/2006 (10), (EC) No 1443/2006 (11), (EC) No 1743/2006 (12), (EC) No 757/2007 (13) and (EC) No 828/2007 (14) which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement. |

amending Protocol 31 to the EEA Agreement, on cooperation in specific fields outside the four freedoms [2019/1371]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 86 and 98 thereof,
Whereas:

It is appropriate to extend the cooperation of the Contracting Parties to the EEA Agreement to include the participation of the EFTA States in the Union's preparatory action on defence research which is funded from the general budget of the European Union. |
|
(2) |
It is appropriate that the participation of the EFTA States in the activities financed from budget line 02 04 77 03 commence from 11 April 2017 even if this Decision is adopted, or if the fulfilment of constitutional requirements for this Decision, if any, is notified, after 10 July 2017. |
|
(3) |
Institutions, undertakings, organisations and nationals of the EFTA States should be entitled to participate in activities which start before the entry into force of this Decision. The costs incurred for their participation in such activities, the implementation of which starts after 11 April 2017, should be considered eligible under the same conditions as those applicable to costs incurred by institutions, undertakings, organisations and nationals of the EU Member States, provided that this Decision has entered into force before the end of the preparatory action concerned. |

(4) |
Protocol 31 to the EEA Agreement should therefore be amended in order to allow for this extended cooperation to take place from 11 April 2017, |

This Decision extends the cooperation of the Contracting Parties to include the participation of the EFTA States in the Union's preparatory action on defence research. The EFTA States consider that defence matters fall outside the scope of the EEA Agreement, and therefore that the adoption of this Decision does not extend the scope of the EEA Agreement to include defence matters beyond the participation of the EFTA States in that preparatory action. The EFTA States also stress that Iceland and Liechtenstein shall not participate in, and shall not financially contribute to, this preparatory action.
