COMMISSION IMPLEMENTING REGULATION (EU) 2018/1506
of 10 October 2018
on exceptional market support measures for the eggs and poultrymeat sectors in Italy
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 220(1)(a) thereof,
Whereas:
(1) |
Between 30 April 2016 and 28 September 2017, 43 outbreaks of highly pathogenic avian influenza of subtype H5 and H7 were confirmed and notified by Italy. The species affected are ducks, turkeys, Guinea fowls, and Gallus domesticus chicks, chickens, pullets and laying hens. |
(2) |
Italy immediately and efficiently took all the necessary animal health and veterinary measures required in accordance with Council Directive 2005/94/EC (2). |
(3) |
In particular, Italy took control, monitoring and preventive measures and established protection and surveillance zones (‘the regulated zones’) pursuant to Commission Implementing Decisions (EU) 2016/697 (3), (EU) 2017/155 (4), (EU) 2017/247 (5) (EU) 2017/263 (6), (EU) 2017/417 (7), (EU) 2017/554 (8), (EU) 2017/696 (9), (EU) 2017/780 (10), (EU) 2017/977 (11), (EU) 2017/1397 (12), (EU) 2017/1415 (13), (EU) 2017/1484 (14), (EU) 2017/1519 (15) and (EU) 2017/1593 (16). |

Italy informed the Commission that the necessary health and veterinary measures, which had been applied to contain and eradicate the spread of the disease, had affected a very large number of operators and that those operators suffered income losses not eligible for Union financial contribution under Regulation (EU) No 652/2014 of the European Parliament and of the Council (17). |

On 9 March 2018, the Commission received a formal request from Italy for part-financing of certain exceptional measures pursuant to Article 220(3) of Regulation (EU) No 1308/2013 for the outbreaks confirmed between 30 April 2016 and 28 September 2017. On 1 June 2018, 14 June 2018, 22 June 2018 and 11 July 2018 Italian authorities clarified and documented their request. |

As a result of the animal health and veterinary measures referred to in recital 3, fallowing periods were prolonged, placing of birds was prohibited and movements were restricted on holdings of all types of poultry in the regulated zones established following outbreaks of highly pathogenic avian influenza of subtype H5 and H7. This concerned the following species: ducks, turkeys, Guinea fowls, and Gallus domesticus chicks, chickens, pullets and laying hens. This led to a loss of production of hatching eggs, consumption eggs and poultry meat in these holdings. It is therefore appropriate to compensate the losses due to destructed, processed and downgraded eggs as well as non-produced animals, longer rearing or culling. |

In accordance with Article 220(5) of Regulation (EU) No 1308/2013, the Union part-financing has to be equivalent to 50 % of the expenditure borne by Italy for the exceptional market support measures. The maximum quantities eligible for financing in respect of each exceptional market support measure should be fixed by the Commission after scrutinising the request related to outbreaks confirmed between 30 April 2016 and 28 September 2017 received from Italy. |

To avoid any risk of overcompensation, the flat rate amount of part-financing should be based on technical and economic studies or accounting documents and fixed at an appropriate level for each animal and product according to categories. |
(9) |
To avoid any risk of double funding, losses suffered should not have been compensated by state aid or insurance and the Union part-financing under this Regulation should be limited to eligible animals and products for which no Union financial contribution has been received under Regulation (EU) No 652/2014. |
(10) |
The extent and duration of the exceptional market support measures provided for in this Regulation should be limited to what is strictly necessary to support the market. In particular, the exceptional market support measures should apply only to the production of poultry and eggs in the holdings located in the regulated zones and for the duration of the animal health and veterinary measures laid down in the Union and Italian legislation relevant to the 43 outbreaks of highly pathogenic avian influenza confirmed between 30 April 2016 and 28 September 2017, and to the respective regulated zones. |
(11) |
To ensure flexibility in case the numbers of animals or eggs eligible for compensation differ from the maximum numbers set in this Regulation which are based on estimates, compensation may be adjusted within certain limits, as long as the maximum amount of expenditure part-financed by the Union is respected. |
(12) |
For the sake of a sound budgetary management of these exceptional market support measures, only those payments made by Italy to beneficiaries by 30 September 2019 at the latest, should be eligible for Union part-financing. Article 5(2) of Commission Delegated Regulation (EU) No 907/2014 (18) should not be applicable. |
(13) |
In order to ensure the eligibility and the correctness of the payments, Italy should carry out ex-ante checks. |
(14) |
To allow the Union to perform its financial control, Italy should communicate to the Commission the clearance of payments. |
(15) |
In order to ensure an immediate implementation of the measures laid down in this Regulation by Italy, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
The Union shall provide part-financing equivalent to 50 % of the expenditure borne by Italy to support the market of hatching eggs, consumption eggs and poultry meat seriously affected by the 43 outbreaks of highly pathogenic avian influenza of subtype H5 and H7 which were detected and notified by Italy between 30 April 2016 and 28 September 2017.
Article 2
Expenditure borne by Italy shall be eligible for Union part-financing only:
(a) |
for the duration of the application of animal health and veterinary measures referred to in Union and Italian legislation listed in the Annex and related to the period laid down in Article 1; and |
(b) |
for those poultry holdings that have been subject to the animal health and veterinary measures and located in the zones referred to in Union and Italian legislation listed in the Annex (‘the regulated zones’); and |
(c) |
if it has been paid by Italy to the beneficiaries by 30 September 2019 at the latest. Article 5(2) of Delegated Regulation (EU) No 907/2014 shall not apply; and |
(d) |
if the animal or product, for the period referred to in point (a), has not benefitted from any compensation by means of state aid or insurance and for which no Union financial contribution has been received under Regulation (EU) No 652/2014. |
Article 3
1. The maximum level of Union part-financing shall be EUR 11,1 million, detailed as follows:
(a) |
for the loss of production of poultry located in the regulated zone, the following flat rates shall apply:

(b) |
for losses related to longer rearing due to transfer ban in the regulated zones, the following flat rates shall apply per animal:
|
(c) |
for culling of poultry in the regulated zones, the following flat rates shall apply per animal:
|
(d) |
for loss of production of breeders located in the regulated zones, the following flat rates shall apply per animal:
|
2. Where the number of animals or eggs eligible for compensation exceeds the maximum number of animals or eggs per item set in paragraph 1, expenditure eligible for Union part-financing may be adjusted per item and go beyond the amounts resulting from the application of the maximum numbers per item, provided that the total of adjustments remains below 10 % of the maximum level of expenditure part-financed by the Union referred to in paragraph 1.
Article 4
Italy shall carry out administrative and physical checks in accordance with Articles 58 and 59 of Regulation (EU) No 1306/2013 of the European Parliament and of the Council (19).
In particular, Italy shall verify:
(a) |
the eligibility of the applicant submitting the request for support; |
(b) |
for each eligible applicant: the eligibility, the quantity and the value of the actual loss of production; |
(c) |
that funding has not been received by any eligible applicant from any other sources to compensate the losses referred to in Article 2 of this Regulation. |
For eligible applicants for which administrative checks are completed, aid can be paid without waiting for all checks being made, notably those on applicants selected for on-the-spot checks.
In cases where the eligibility of an applicant was not confirmed, the aid shall be recovered and sanctions applied.
Article 5
Italy shall communicate to the Commission the clearance of payments.
Article 6
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

on exceptional market support measures for the eggs and poultrymeat sectors in Poland
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 220(1)(a) thereof,
Whereas:

Between 3 December 2016 and 16 March 2017, 65 outbreaks of highly pathogenic avian influenza of subtype H5 were confirmed and notified by Poland. The species affected are ducks, geese, turkeys, Gallus domesticus chickens and laying hens. |
(2) |
Poland immediately and efficiently took all the necessary animal health and veterinary measures required in accordance with Council Directive 2005/94/EC (2). |
(3) |
In particular, Poland took control, monitoring and preventive measures and established protection and surveillance zones (‘the regulated zones’) pursuant to Commission Implementing Decisions (EU) 2016/2219 (3), (EU) 2016/2367 (4), (EU) 2017/14 (5), (EU) 2017/116 (6), (EU) 2017/155 (7), (EU) 2017/247 (8), (EU) 2017/417 (9) and (EU) 2017/554 (10). |

In applying those measures, Poland managed to contain and eradicate the spread of the disease. The Union and national animal health and veterinary measures were applied until 22 May 2017 in all relevant holdings. |

On 17 July 2017, the Commission received a formal request from Poland for part-financing of certain exceptional measures pursuant to Article 220(3) of Regulation (EU) No 1308/2013. On 11 April 2018, 10 May 2018 and 19 June 2018 the Polish authorities clarified their request. |

As a result of the animal health and veterinary measures applied, fallowing periods were prolonged, placing of birds was prohibited and movements were restricted on holdings of all types of poultry in the regulated zones established following outbreaks of highly pathogenic avian influenza of subtype H5. This concerned the following species: ducks, geese, turkeys and Gallus domesticus chickens and laying hens. This led to a loss of production in these poultry holdings. It is therefore appropriate to compensate these losses. |

Since the restrictions related to the outbreaks of avian influenza came into force at different dates in the regulated zones concerned and since this Regulation does not provide for a deadline for the submission of the applications for aid, it is appropriate for the purposes of Article 29(4) of Delegated Regulation (EU) No 907/2014, to consider the date of entry into force of this Regulation as the operative event for the exchange rate regarding the amounts set out in this Regulation. |

In order to ensure an immediate implementation of the measures laid down in this Regulation by Poland, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
The Union shall provide part-financing equivalent to 50 % of the expenditure borne by Poland to support the market of eggs and poultrymeat seriously affected by the 65 outbreaks of highly pathogenic avian influenza of subtype H5 which were detected and notified by Poland between 3 December 2016 and 16 March 2017.
Article 2
Expenditure borne by Poland shall be eligible for Union part-financing only:
(a) |
for the duration of the application of animal health and veterinary measures referred to in Union and Polish legislation listed in the Annex and related to the period laid down in Article 1; and |
(b) |
for those poultry holdings that have been subject to the animal health and veterinary measures and located in the zones referred to in Union and Polish legislation listed in the Annex (‘the regulated zones’); and |
(c) |
if it has been paid by Poland to the beneficiaries by 30 September 2019 at the latest. Article 5(2) of Delegated Regulation (EU) No 907/2014 shall not apply; and |
(d) |
if the animal or product, for the period referred to in point (a), has not benefitted from any compensation by means of state aid or insurance and for which no Union financial contribution has been received under Regulation (EU) No 652/2014. |
Article 3
The maximum level of Union part-financing shall be EUR 1,411 million, for the loss of production of poultry located in the regulated zones. The following flat rates shall apply:
(a) |
EUR 0,0059 per day per laying hen falling within CN code 0105 94 00 up to a maximum of 186 598 animals; |
(b) |

Article 4
Poland shall carry out administrative and physical checks in accordance with Articles 58 and 59 of Regulation (EU) No 1306/2013 of the European Parliament and of the Council (13).
In particular, Poland shall verify:
(a) |
the eligibility of the applicant submitting the request for support; |
(b) |
for each eligible applicant: the eligibility, the quantity and the value of the actual loss of production; |
(c) |
that funding has not been received by any eligible applicant from any other sources to compensate the losses referred to in Article 2 of this Regulation. |
For eligible applicants for which administrative checks are completed, aid can be paid without waiting for all checks being made, notably those on applicants selected for on-the-spot checks.
In cases where the eligibility of an applicant was not confirmed, the aid shall be recovered and sanctions applied.
Article 5
For the purposes of Article 29(4) of Delegated Regulation (EU) No 907/2014, the operative event for the exchange rate as regards the amounts set out in Article 3 of this Regulation shall be the entry into force of this Regulation.
Article 6
Poland shall communicate to the Commission the clearance of payments.
Article 7
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

After consulting the Committee on the Agricultural Funds,
Whereas:

Article 3(1)(e) of Commission Delegated Regulation (EU) No 906/2014 (2) provides for the financing of the depreciation of agricultural products stored in public intervention. |
(2) |
Points 1, 2 and 3 of Annex V to Delegated Regulation (EU) No 906/2014 lay down the method for calculating the depreciation percentage, which is to be applied in the form of a coefficient. The depreciation percentage at the time of the buying in of the agricultural products must not exceed the difference between the buying in price and the estimated disposal price for each of the products concerned. That percentage is to be fixed for each product before the beginning of each accounting year. The Commission may also restrict the depreciation at the time of buying in to a fraction of that depreciation percentage, but that fraction may not be less than 70 % of the overall depreciation. |

The coefficient for skimmed milk powder to be applied by the Member States to the monthly buying in values in the 2019 accounting year should therefore be fixed. |

In the interest of a sound management of the expenditure financed by the European Agricultural Guarantee Fund, the Commission should be notified of the expenditure resulting from the application of the depreciation coefficients, |
HAS ADOPTED THIS REGULATION:
Article 1
In respect of skimmed milk powder which is bought in under public intervention and is stored or taken over by Member States between 1 October 2018 and 30 September 2019, Member States shall apply a depreciation coefficient of 0,21 to the value of the skimmed milk powder bought in every month.
Article 2
Member States shall notify the Commission of the expenditure amounts resulting from the application of the depreciation coefficients provided for in Article 1 of this Regulation through the declarations of expenditure established in accordance with Commission Implementing Regulation (EU) No 908/2014 (3).
Article 3
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
It shall apply from 1 October 2018.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (1), and in particular the fourth sentence of Article 16(3) thereof,
Whereas:

Article 9(8) of Commission Implementing Decision (EU) 2015/789 (2) sets out conditions for the movement of certain host plants which have never been grown inside the demarcated areas, and more specific conditions for certain host plants, including plants for planting of Polygala myrtifolia L. |
(2) |
Experience has shown that plants for planting of Polygala myrtifolia L. have proven to be particularly susceptible to Xylella fastidiosa (Wells et al.) (the ‘specified organism’). In order to ensure higher phytosanitary protection of the Union territory, it is appropriate to require that visual inspection, sampling and testing be carried out as close to the time of their first movement out of their production site as possible. The same requirement should apply to plants for planting of Polygala myrtifolia L. introduced into the Union which are originating in a third country where the specified organism is not present. |

Implementing Decision (EU) 2015/789 should therefore be amended accordingly. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food, and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
Implementing Decision (EU) 2015/789 is amended as follows:

In Article 9, paragraph 8, the second subparagraph is replaced by the following: ‘However, plants for planting, other than seeds, of Coffea, Lavandula dentata L., Nerium oleander L., Olea europaea L., Polygala myrtifolia L. and Prunus dulcis (Mill.) D.A. Webb, shall only be moved within the Union if they have been grown in a site that is subject to annual official inspection and sampling, taking into account the technical guidelines for the survey of Xylella fastidiosa provided on the Commission website, as well as testing in line with international standards for the presence of the specified organism, confirming the absence of the specified organism, using a sampling scheme able to identify with 99 % reliability the level of presence of infected plants of 5 %. In addition, and prior to its first movement out of its production site, each lot of plants for planting of Polygala myrtifolia L. which is to be moved within the Union shall be subjected to official visual inspection and sampling, as close to the time of that movement as possible, taking into account the technical guidelines for the survey of Xylella fastidiosa provided on the Commission website, as well as testing in line with international standards for the presence of the specified organism, confirming the absence of the specified organism, using a sampling scheme able to identify with 99 % reliability a level of presence of infected plants of 5 %. By way of derogation from the first subparagraph of Article 3(2), the presence of the specified organism shall be screened by one test, and in case of positive results, its presence shall be identified by carrying out, in line with international standards, at least one positive molecular test. Those tests shall be listed in the Commission database of tests for the identification of the specified organism and its subspecies.’ |

In Article 16, the second paragraph is replaced by the following: ‘Plants for planting, other than seeds, of Coffea, Lavandula dentata L., Nerium oleander L., Olea europaea L., Polygala myrtifolia L., and Prunus dulcis (Mill.) D.A. Webb shall only be introduced into the Union if they have been grown in a site that is subject to annual official inspection, with sampling and testing carried out at the appropriate times on those plants for the presence of the specified organism and in accordance with international standards, confirming the absence of the specified organism, using a sampling scheme able to identify with 99 % reliability the level of presence of infected plants of 5 %. In addition, and prior to its first movement out of its production site and as close to the time of that movement as possible, each lot of plants for planting of Polygala myrtifolia L. shall be subjected to official visual inspection and sampling, as well as testing in line with international standards for the presence of the specified organism, confirming the absence of the specified organism, using a sampling scheme able to identify with 99 % reliability a level of presence of infected plants of 5 %.’ |

Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,
Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,
Whereas:

Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine fever in certain Member States, where there have been confirmed cases of that disease in domestic or feral pigs (the Member States concerned). The Annex to that Implementing Decision demarcates and lists certain areas of the Member States concerned in Parts I to IV thereof, differentiated by the level of risk based on the epidemiological situation as regards that disease. The Annex to Implementing Decision 2014/709/EU has been amended several times to take account of changes in the epidemiological situation in the Union as regards African swine fever that need to be reflected in that Annex. The Annex to Implementing Decision 2014/709/EU was last amended by Commission Implementing Decision (EU) 2018/1282 (5), following recent instances of African swine fever in Lithuania and Poland. |

The risk of the spread of African swine fever in wildlife is linked to the natural slow spread of that disease among feral pig populations, and also the risks linked to human activity, as demonstrated by the recent epidemiological evolution of that disease in the Union, and as documented by the European Food Safety Authority (EFSA) in the Scientific Opinion of the Panel on Animal Health and Welfare, published on 14 July 2015; in the Scientific Report of EFSA on Epidemiological analyses on African swine fever in the Baltic countries and Poland, published on 23 March 2017; and in the Scientific Report of EFSA on Epidemiological analyses of African swine fever in the Baltic States and Poland, published on 8 November 2017 (6). |

Since the date of adoption of Implementing Decision (EU) 2018/1282, the epidemiological situation in the Union has evolved as regards African swine fever, and there have been further instances of that disease that need to be reflected in the Annex to Implementing Decision 2014/709/EU. |
(4) |
In October 2018, a case of African swine fever in a feral pig was observed in the county of Borsod-Abaúj-Zemplén in Hungary. This case of African swine fever in the feral pig population constitutes an increased level of risk which should be reflected in the Annex to Implementing Decision 2014/709/EU. Accordingly, the areas of Hungary affected by the recent case of African swine fever should be listed in Parts I and II of that Annex. |

In October 2018, a case of African swine fever in feral pigs was observed in the county of Mrągowski in Poland. This case of African swine fever in the feral pig population also constitutes an increased level of risk which should be reflected in the Annex to Implementing Decision 2014/709/EU. Accordingly, the areas of Poland affected by African swine fever should be listed in Parts I and II of that Annex. |

In order to take account of recent developments in the epidemiological evolution of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new high-risk areas of a sufficient size should be demarcated for Hungary and Poland and duly listed in Parts I and II of the Annex to Implementing Decision 2014/709/EU.
