supplementing Regulation (EU) 2015/760 of the European Parliament and of the Council with regard to regulatory technical standards on financial derivative instruments solely serving hedging purposes, sufficient length of the life of the European long-term investment funds, assessment criteria for the market for potential buyers and valuation of the assets to be divested, and the types and characteristics of the facilities available to retail investors

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2015/760 of the European Parliament and of the Council of 29 April 2015 on European long-term investment funds (1), and in particular Article 9(3), Article 18(7), Article 21(3) and Article 26(2) thereof,
Whereas:

In order to ensure a common approach to the application of Regulation (EU) 2015/760, it is necessary to lay down provisions to specify the criteria for establishing the circumstances in which the use of financial derivative instruments solely serves hedging purposes, the circumstances in which the life of a European long-term investment fund (‘ELTIF’) is considered sufficient in length, the criteria to be used for certain elements of the itemised schedule for the orderly disposal of the ELTIF assets and the facilities available to retail investors. |

To ensure coherence among those provisions which should enter into force at the same time, and, to facilitate a comprehensive view and easy access to those provisions, it is appropriate to adopt the regulatory technical standards concerned in a single Regulation. |
(3) |
With respect to the circumstances in which the use of financial derivative instruments solely serves the purpose of hedging the risks inherent to the investments of an ELTIF, it is necessary to take into account financial derivative instruments whose underlying corresponds to the assets in which the ELTIF has invested and whose exposures are intended to be hedged, as well as trades in assets that, albeit not being the same in which the ELTIF has invested, relate to the same asset class. This is the case, in particular, where a financial derivative instrument to hedge an exposure to a specific item is not available as a dedicated type of derivative, but rather as an item among other items included in an index which is the underlying of a financial derivative instrument. In addition, the use of financial derivative instruments might in some cases constitute a hedging strategy only if it is pursued in combination with trades in some assets, whereby that type of strategy should not be prohibited. In order to ensure that the use of financial derivative instruments solely serves the purpose of hedging the risks inherent to the investments of an ELTIF, the manager of the ELTIF should take all reasonable steps to ensure that the financial derivative instruments used effectively reduce the relevant risk at the ELTIF level and are also efficient in stressed market conditions. The reduction of risk should be verifiable through the use of adequate risk management systems identifying the risk intended to be mitigated and the way in which the derivative would mitigate such risk. |

In situations where an ELTIF invests in assets that have different maturity profiles, the life of an ELTIF should be set with reference to the individual asset within the ELTIF portfolio which has the longest investment horizon having regard to the liquidity of that asset. |
(5) |
The assessment of the market for potential buyers to be included in the schedule for the orderly disposal of the ELTIF assets should take into account market risks including whether the potential buyers are typically dependent on obtaining loans from third parties, whether there is a risk of illiquidity of the assets before sale, whether there are risks associated with legislative changes, such as fiscal reforms, or political changes and whether there is a risk of deterioration of the economic situation in the market which is relevant to the ELTIF assets. No specific assessment of those risks should be requested under this Regulation for assets other than eligible investment assets since assets referred to in Article 50(1) of Directive 2009/65/EC of the European Parliament and of the Council (2) are supposed to be liquid by their nature. |

The valuation of the assets to be included in the schedule for the orderly disposal of the ELTIF assets should be carried out at a moment in time that is sufficiently close to the beginning of the disposal of the assets. However, if the ELTIF carried out a valuation in accordance with Directive 2011/61/EU of the European Parliament and of the Council (3) at a moment in time that is sufficiently close to the beginning of the disposal of the assets, an additional valuation should not be required. Nevertheless, the preparation of the schedule for the orderly disposal of the ELTIF assets should start as soon as it is appropriate and well in advance of the time-line for its disclosure to the competent authority of the ELTIF. |

The facilities to be made available to retail investors in each Member State where marketing activities are carried out by the manager of the ELTIF may be performed by one or more entities in person, by telephone or electronically, which can be the manager of the ELTIF or another entity subject to regulation governing the tasks entrusted to it by the manager of the ELTIF. |
(8) |
In order to avoid any potential market disruption it is necessary to give ELTIFs, which were authorised before the entry into force of this Regulation, their managers and their competent authorities sufficient time to adapt to the requirements contained in this Regulation. |
(9) |
The provisions on the sufficient length of the life of ELTIF should only be applied by ELTIFs submitting an application for authorisation after the entry into force of this Regulation as, pursuant to Regulation (EU) 2015/760, the length of the life of the ELTIF has to be set by the time the application for authorisation as an ELTIF is made to the competent authority of the ELTIF. |
(10) |
In order to allow competent authorities and managers of the ELTIFs authorised under Regulation (EU) 2015/760 before the entry into force of this Regulation to adapt to the new requirements contained in this Regulation, the date of application of this Regulation should be 1 year after its entry into force. The requirement on the sufficient length of the life of the ELTIF is deemed to be fulfilled under this Regulation by the ELTIFs already authorised under Regulation (EU) 2015/760 before the entry into force of this Regulation. |

This Regulation is based on regulatory technical standards submitted by the European Securities and Markets Authority (ESMA) to the Commission. |

ESMA has conducted open public consultations on the draft regulatory technical standards, analysed the potential related costs and benefits and requested the opinion of the Securities and Markets Stakeholder Group established in accordance with Article 37 of Regulation (EU) No 1095/2010 of the European Parliament and of the Council (4), |
HAS ADOPTED THIS REGULATION:
Article 1
Hedging derivatives
1. The circumstances in which the use of financial derivative instruments shall be considered as solely serving the purpose of hedging the risks inherent to other investments of the European long-term investment fund (‘ELTIF’) as referred to in Article 9(2)(d) of Regulation (EU) 2015/760 are fulfilled when they meet all of the criteria set out in paragraphs 2, 3 and 4 of this Article.
2. A financial derivative instrument shall only be used for hedging risks arising from exposures to assets referred to in Article 9(1) of Regulation (EU) 2015/760.
The purpose of hedging the risks arising from exposures to assets referred to in the first subparagraph shall only be considered to be fulfilled where the use of that financial derivative instrument results in a verifiable and objectively measurable reduction of those risks at the ELTIF level.
Where financial derivative instruments to hedge the risks arising from the exposure to the assets referred to in the first subparagraph are not available, financial derivative instruments with an underlying of the same asset class may be used.
3. The use of the financial derivative instruments aimed to provide a return for the ELTIF shall not be deemed to serve the purpose of hedging the risks.
4. The manager of the ELTIF shall take all reasonable steps to ensure that the financial derivative instruments used to hedge the risks inherent to other investments of the ELTIF reduce the risks at the ELTIF level in accordance with paragraph 2, including in stressed market conditions.
Article 2
Sufficient length of the life of the ELTIF
For the purpose of Article 18(3) of Regulation (EU) 2015/760, the life of an ELTIF shall be considered sufficient in length to cover the life-cycle of each of the individual assets of the ELTIF where the following conditions are met:
(a) |
the ELTIF aligns the date for the end of its life to the date of the end of the investment horizon of the individual asset within the ELTIF portfolio which has the longest investment horizon at the time of the submission of the application for authorisation as an ELTIF to the competent authority of the ELTIF; |
(b) |
any investment made by the ELTIF after the date of its authorisation as an ELTIF does not have a residual investment horizon exceeding the remaining life of the ELTIF at the time that investment is made. |
Article 3
Criteria for the assessment of the market for potential buyers
For the purpose of Article 21(2)(a) of Regulation (EU) 2015/760, the manager of an ELTIF shall assess all of the following elements in relation to each asset in which the ELTIF invests:
(a) |
whether one or more potential buyers are present in the market; |
(b) |
whether the manager of the ELTIF, based on an assessment conducted with due skill, care and diligence at the time of the completion of the schedule, expects the potential buyers to be dependent on external financing for buying the relevant asset; |
(c) |
where there are no potential buyers for an asset, the length of time likely to be necessary to find one or more buyers for that asset; |
(d) |
the specific maturity profile of the asset; |
(e) |
whether the manager of the ELTIF, based on an assessment conducted with due skill, care and diligence at the time of the completion of the schedule, expects the following risks to materialise:

(f) |
the manager's assessment of whether the elements listed under points (a) and (b) may be impacted adversely during the disposal period by overall economic conditions in the market or markets relevant to the asset. |
Article 4
Criteria for the valuation of the assets to be divested
1. For the purpose of Article 21(2)(c) of Regulation (EU) 2015/760, the valuation of the assets to be divested shall comply with the following criteria:
(a) |
it shall start as soon as it is appropriate and well in advance of the deadline for the disclosure of the itemised schedule for the orderly disposal of the ELTIF assets to the competent authority of the ELTIF; |
(b) |
it shall be concluded no more than 6 months before the deadline referred to in point (a). |
2. Valuations made in accordance with Article 19 of Directive 2011/61/EU may be taken into account where a valuation has been concluded no more than 6 months before the deadline referred to in paragraph 1 of this Article.
Article 5
Specifications on the facilities available to retail investors
1. For the purposes of Article 26(1) of Regulation (EU) 2015/760, the manager of an ELTIF shall put in place facilities to perform the following tasks:
(a) |
process retail investors' subscription, payment, repurchase and redemption orders relating to the units or shares of the ELTIF, in accordance with the conditions set out in the ELTIF marketing documents; |
(b) |
provide retail investors with information on how orders referred to in point (a) can be made and how repurchase and redemption proceeds are paid; |
(c) |
facilitate the handling of information relating to the retail investors' exercise of their rights arising from their investment in the ELTIF in the Member State where the ELTIF is marketed; |
(d) |
make available to retail investors, for inspection and for the obtaining of copies of:
|
(e) |
provide investors with information relevant to the tasks they perform in a durable medium as defined in Article 2(1)(m) of Directive 2009/65/EC. |
2. The manager of the ELTIF shall ensure that the facilities referred to in Article 26(1) of Regulation (EU) 2015/760 have the following technical infrastructure:
(a) |
they perform their tasks in the official language or official languages of the Member State where the ELTIF is marketed; |
(b) |
they perform their tasks in person, by telephone or electronically. |
3. The manager of an ELTIF shall ensure that the facilities referred to in Article 26(1) of Regulation (EU) 2015/760 are of the following types and have the following characteristics:
(a) |
are performed by one or more entities which are either the manager of the ELTIF or a third entity subject to regulation governing the tasks to be performed; |
(b) |
where the facilities are performed by a third entity, the latter receives all the relevant information and documents from the manager of the ELTIF; |
(c) |
where the facilities are performed by a third entity, the appointment of the entity is evidenced by a written contract. The written contract shall specify which of the tasks referred to in paragraph 1 are not performed by the manager of the ELTIF. |
Article 6
Transitional provisions
An ELTIF authorised under Regulation (EU) 2015/760 before the entry into force of this Regulation shall be deemed to fulfil the requirements set out in Article 2 of this Regulation.
An ELTIF authorised under Regulation (EU) 2015/760 before the entry into force of this Regulation shall apply Articles 1, 3, 4 and 5 of this Regulation from 1 May 2019.
Article 7
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EC) No 1484/95 as regards fixing representative prices in the poultrymeat and egg sectors and for egg albumin

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 183(b) thereof,
Having regard to Regulation (EU) No 510/2014 of the European Parliament and of the Council of 16 April 2014 laying down the trade arrangements applicable to certain goods resulting from the processing of agricultural products and repealing Council Regulations (EC) No 1216/2009 and (EC) No 614/2009 (2), and in particular Article 5(6)(a) thereof,
Whereas:

Commission Regulation (EC) No 1484/95 (3) lays down detailed rules for implementing the system of additional import duties and fixes representative prices in the poultrymeat and egg sectors and for egg albumin. |
(2) |
Regular monitoring of the data used to determine representative prices for poultrymeat and egg products and for egg albumin shows that the representative import prices for certain products should be amended to take account of variations in price according to origin. |
(3) |
Regulation (EC) No 1484/95 should therefore be amended accordingly. |
(4) |
Given the need to ensure that this measure applies as soon as possible after the updated data have been made available, this Regulation should enter into force on the day of its publication, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Regulation (EC) No 1484/95 is replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

on the maximum buying-in price for skimmed milk powder for the first individual invitation to tender within the tendering procedure opened by Implementing Regulation (EU) 2018/154
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) No 1370/2013 of 16 December 2013 determining measures on fixing certain aids and refunds related to the common organisation of the markets in agricultural products (1), and in particular Article 3 thereof,
Whereas:

Commission Implementing Regulation (EU) 2018/154 (2) has opened buying-in of skimmed milk powder by a tendering procedure for the public intervention period from 1 March to 30 September 2018, in accordance with the conditions provided for in Commission Implementing Regulation (EU) 2016/1240 (3). |
(2) |
In accordance with Article 14(1) of Implementing Regulation (EU) 2016/1240, on the basis of the tenders received in response to individual invitations to tender, the Commission has to fix a maximum buying-in price or to decide not to fix a maximum buying-in price. |
(3) |
In the light of the tenders received for the first individual invitation to tender, a maximum buying-in price should not be fixed. |
(4) |
The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
For the first individual invitation to tender for the buying-in of skimmed milk powder within the tendering procedure opened by Implementing Regulation (EU) 2018/154, in respect of which the time limit for the submission of tenders expired on 20 March 2018, no maximum buying-in price shall be fixed.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Commission Implementing Regulation (EU) 2016/1240 of 18 May 2016 laying down rules for the application of Regulation (EU) No 1308/2013 of the European Parliament and of the Council with regard to public intervention and aid for private storage (2), and in particular Article 32 thereof,
Whereas:

Commission Implementing Regulation (EU) 2016/2080 (3) has opened the sale of skimmed milk powder by a tendering procedure. |

In the light of the tenders received for the 18th partial invitation to tender, a minimum selling price should be fixed. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
For the 18th partial invitation to tender for the selling of skimmed milk powder within the tendering procedure opened by Implementing Regulation (EU) 2016/2080, in respect of which the period during which tenders were to be submitted ended on 20 March 2018, the minimum selling price shall be 105,00 EUR/100 kg.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Directive 93/49/EEC as regards requirements to be fulfilled by the propagating material of certain genera or species of Palmae in respect of Rhynchophorus ferrugineus (Olivier)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 98/56/EC of 20 July 1998 on the marketing of propagating material of ornamental plants (1), and in particular Article 5(5) thereof,
Whereas:

Rhynchophorus ferrugineus (Olivier) has been found in most of the endangered Union territories and it has been concluded that this harmful organism is now known to occur in a substantial part of Union territory. Commission Decision 2007/365/EC (2) on emergency measures in respect of Rhynchophorus ferrugineus (Olivier) has therefore been repealed by Commission Implementing Decision (EU) 2018/490 (3). |
(2) |
Rhynchophorus ferrugineus (Olivier) causes severe damage to plants of host species belonging to the Palmae family with the exception of plants with a diameter of the stem at the base of less than 5 cm. |
(3) |
Those plants are present in many parts of the Union where they are planted in large numbers for ornamental purposes and are of high environmental and economic importance. |
(4) |
It is therefore appropriate to set out specific requirements to ensure the quality of the propagating material of certain genera and species of Palmae, which are most commonly marketed in the Union and which are at risk of being infested by that harmful organism if such requirements are not fulfilled. Those requirements should include specific growing conditions or treatment of that material, as well as the condition of being free of Rhynchophorus ferrugineus (Olivier). |
(5) |
Commission Directive 93/49/EEC (4) should be therefore amended accordingly. |
(6) |
The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Plants, Animal, Food and Feed, |
HAS ADOPTED THIS DIRECTIVE:
Article 1
Amendment of Commission Directive 93/49/EEC
Commission Directive 93/49/EEC is amended as follows:
(1) |
The following Article 3a is added: ‘Article 3a Propagating material of Palmae belonging to the genera and species referred to in the Annex and having a diameter of the stem at the base of over 5 cm shall comply with one of the following requirements:
This Article shall apply without prejudice to the rules on protected zones adopted pursuant to point (h) of Article 2(1) and Article 5(3) of Directive 2000/29/EC’ |
(2) |
The Annex is amended in accordance with the Annex to this Directive. |
Article 2
Transposition
1. Member States shall adopt and publish, by 30 September 2018 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.
They shall apply those provisions from 1 October 2018.
When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.
2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.
Article 3
Entry into force
This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
Article 4

authorising Denmark to apply a special measure derogating from Article 75 of Directive 2006/112/EC on the common system of value added tax
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 291(2) thereof,
Having regard to Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (1), and in particular Article 395(1) thereof,
Having regard to the proposal from the European Commission,
Whereas:

By letter registered with the Commission on 21 November 2017, in accordance with Article 395(2) of Directive 2006/112/EC, Denmark requested authorisation to apply a special measure governing the right to deduct input VAT, derogating from Article 75 of that Directive. |
(2) |
In accordance with the second subparagraph of Article 395(2) of Directive 2006/112/EC, by letters dated 7 December 2017 and 8 December 2017, the Commission transmitted the request submitted by Denmark to the other Member States and, by letter dated 11 December 2017, notified Denmark that it had all the information necessary to consider the request. |

Without a derogating measure, the legislation in Denmark provides that if a light goods vehicle with a maximum authorised total weight of 3 tonnes is registered with the Danish authorities as being used for business purposes only, the taxable person is allowed to deduct the full input VAT on the purchase and running costs of the vehicle. If such a vehicle is subsequently used for private purposes, the taxable person loses the right to deduct the VAT incurred on the purchase cost of the vehicle. |

To mitigate the consequences of that regime, Denmark has requested authorisation to apply a special measure derogating from Article 75 of Directive 2006/112/EC. The derogation was granted by Council Implementing Decision 2012/447/EU (2) and subsequently by Council Implementing Decision (EU) 2015/992 (3). The latter Decision expired on 31 December 2017. |

The measure would allow taxable persons who have registered a vehicle only for business purposes to use the vehicle for private purposes, and to calculate the taxable amount of the deemed supply of services pursuant to Article 75 of Directive 2006/112/EC on a daily flat-rate basis, rather than lose their right to deduct the VAT incurred on the purchase cost of the vehicle. |

This simplified calculation method should, however, be limited to 20 days of use for private purposes for each calendar year, and the flat-rate amount of VAT to be paid should be fixed at DKK 40 for each day of use for private purposes. This amount has been set by the Danish Government on the basis of an analysis of national statistics. |

This measure, which should apply to light goods vehicles with a maximum authorised total weight of 3 tonnes, aims to simplify the VAT obligations of taxable persons who make occasional use for private purposes of a vehicle that was registered only for business purposes, thus simplifying the procedure for collecting VAT. However, it would remain possible for a taxable person to choose to register a light goods vehicle as being used for both business and private purposes. In doing so, the taxable person would lose the right to deduct the VAT incurred on the purchase cost of the vehicle but would not be required to pay a daily charge for any use for private purposes. |

Authorising a measure which ensures that a taxable person who makes occasional use for private purposes of a vehicle registered only for business purposes is not deprived of the full right to deduct the input VAT on that vehicle is consistent with the general rules on deduction as laid down by Directive 2006/112/EC. |

The authorisation should be valid for a limited period and should therefore expire on 31 December 2020. |
(10) |
In order to ensure that the objectives pursued by the measure are achieved, including ensuring an uninterrupted application of the previously authorised derogation and providing legal certainty with regard to the tax period, it is appropriate that this Decision applies from 1 January 2018. As Denmark requested the renewal of the authorisation on 21 November 2017 and continued to apply the legal regime established in its national law on the basis of the previously authorised derogation as from 1 January 2018, the legitimate expectations of the persons concerned are duly respected. |

In the event that Denmark requests a further extension of the derogating measure beyond 31 December 2020, it should submit a report to the Commission together with the extension request by 31 March 2020. |

It is considered that the derogation would only have a negligible effect on the overall amount of VAT revenue collected at the stage of final consumption and will have no adverse impact on the Union's own resources accruing from VAT, |
HAS ADOPTED THIS DECISION:
Article 1
By way of derogation from Article 75 of Directive 2006/112/EC, where a taxable person uses a light goods vehicle, which has been registered as being solely for business use, for private purposes, or those of his staff, or more generally for purposes other than those of his business, Denmark is authorised to determine the taxable amount by reference to a flat rate for each day of such use.
The flat rate per day as referred to in the first paragraph shall be DKK 40.
Article 2
The measure referred to in Article 1 shall only apply to light goods vehicles with a maximum authorised total weight of 3 tonnes.
This measure shall not apply where the use for private purposes exceeds 20 days per calendar year.
Article 3
This Decision shall take effect on the date of its notification.
It shall apply from 1 January 2018 to 31 December 2020.
Any request for the extension of the measure provided for in this Decision shall be submitted to the Commission by 31 March 2020 and shall be accompanied by a report which includes a review of the measure.

authorising Hungary to apply a special measure derogating from Article 193 of Directive 2006/112/EC on the common system of value added tax
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 291(2) thereof,
Having regard to Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (1), and in particular Article 395(1) thereof,
Having regard to the proposal from the European Commission,
Whereas:

Pursuant to Article 193 of Directive 2006/112/EC, any taxable person carrying out a taxable supply of goods or services, as a general rule, is liable for the payment of value added tax (VAT) to the tax authorities. |
(2) |
In order to combat VAT fraud in the sector of temporary employment agencies, in 2014 Hungary requested authorisation to introduce a special measure derogating from Article 193 of Directive 2006/112/EC to provide that, for supplies of staff engaged in activities other than those covered by point (a) of Article 199(1) of that Directive, the person liable for payment of VAT is the taxable person to whom the supplies are made (‘reverse charge mechanism’). The authorisation was granted by Council Implementing Decision (EU) 2015/2349 (2) and expired on 31 December 2017. |

By letter registered with the Commission on 26 June 2017, Hungary has requested authorisation to apply a special measure derogating from Article 193 of Directive 2006/112/EC in order to make the recipient liable for the payment of VAT for the supply of staff. |

In accordance with the second subparagraph of Article 395(2) of Directive 2006/112/EC, by letter dated 11 December 2017, the Commission transmitted the request submitted by Hungary to the other Member States. By letter dated 12 December 2017, the Commission notified Hungary that it had all the information necessary to consider the request. |

According to information provided by Hungary, a number of traders in the sector of temporary employment agencies engage in fraudulent activities by supplying services without paying the applicable VAT to the tax authorities. Since this type of activity does not necessarily require large input costs or investments, the VAT these agencies receive often exceeds largely the deductible VAT they have paid to their suppliers. A number of these agencies, which often have little or no assets, subsequently disappear after only a few months, making the recovery of unpaid VAT difficult or impossible. |

By designating the person to whom such services are supplied as the person liable for the payment of VAT in such cases, the derogation would eliminate the opportunity to engage in that form of tax evasion. Hungary submitted that after the introduction of the reverse charge mechanism for the supply of staff in Hungary, the number of employment agencies decreased, suggesting a cleansing of the market. According to Hungary, the reverse charge mechanism has proven to be an appropriate and effective tool in combating fraudulent practices in the temporary employment agencies sector. |

Based on information provided by Hungary, a significant number of measures were introduced to combat VAT fraud, and other anti-fraud measures with particular focus on temporary employment agencies are planned by Hungary. Notwithstanding those measures, Hungary considers that, to further reduce the damage done to the sector, the protective reverse charge mechanism should continue to apply. |

For a number of situations involving the supply of staff, listed in point (a) of Article 199(1) of Directive 2006/112/EC, it is already possible to specify the recipient as the person liable for the payment of VAT. Therefore, in order to prevent tax evasion, Hungary should be authorised to apply the reverse charge mechanism to supplies of staff not already covered by Directive 2006/112/EC. |

The derogation should be limited in time and should therefore expire on 31 December 2020. |

In order to ensure that the objectives pursued by the measure are achieved, including ensuring an uninterrupted application of the previously authorised derogation and providing legal certainty with regard to the tax period, it is appropriate that this Decision applies from 1 January 2018. The measures to be undertaken by Hungary should eliminate fraud in the sector concerned and, therefore, no further derogation from Article 193 of Directive 2006/112/EC should be required with regard to the supply of staff. |

HAS ADOPTED THIS DECISION:
Article 1
By way of derogation from Article 193 of Directive 2006/112/EC, Hungary is authorised to provide that the person liable for payment of VAT is the taxable person to whom supplies of staff, engaged in activities other than those covered by point (a) of Article 199(1) of Directive 2006/112/EC, are made.
Article 2
This Decision shall take effect on the date of its notification.
It shall apply from 1 January 2018 to 31 December 2020.

Having regard to Protocol No 4 on the Statute of the European System of Central Banks and of the European Central Bank, annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, and in particular Article 27.1 thereof,
Having regard to the Recommendation of the European Central Bank of 26 January 2018 to the Council of the European Union on the external auditors of the Oesterreichische Nationalbank (ECB/2018/1) (1),
Whereas:

The accounts of the European Central Bank (ECB) and national central banks of the Member States whose currency is the euro are audited by independent external auditors recommended by the ECB's Governing Council and approved by the Council of the European Union. |

Article 37(1) of the Austrian Federal Act on the Oesterreichische Nationalbank provides that the General Meeting of the Oesterreichische Nationalbank elects one external auditor and one alternate external auditor for a period of up to five years. The alternate external auditor will be mandated only in the event that the external auditor is unable to perform the audit. |
(3) |
The mandate of both the current external auditor and the current alternate external auditor of the Oesterreichische Nationalbank ended following the audit for the financial year 2017. It is therefore necessary to appoint external auditors from the financial year 2018. |
(4) |
The Oesterreichische Nationalbank has selected Ernst & Young Wirtschaftsprüfungsgesellschaft m.b.H. as its external auditor and Deloitte Audit Wirtschaftsprüfungs GmbH as its alternate external auditor, for the financial years 2018 to 2022. |

The Governing Council of the ECB recommended that Ernst & Young Wirtschaftsprüfungsgesellschaft m.b.H. be appointed as the external auditor of the Oesterreichische Nationalbank and that Deloitte Audit Wirtschaftsprüfungs GmbH be appointed as the alternate external auditor of the Oesterreichische Nationalbank, for the financial years 2018 to 2022. |

Article 1(9) of Decision 1999/70/EC shall be replaced by the following:
‘9. Ernst & Young Wirtschaftsprüfungsgesellschaft m.b.H. is hereby approved as the external auditor of the Oesterreichische Nationalbank for the financial years 2018 to 2022.

Having regard to Council Directive 97/78/EC of 18 December 1997 laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (2), and in particular Article 22(6) thereof,
Whereas:

Directive 91/496/EEC lays down the principles of veterinary checks on animals entering the Union from third countries. Directive 97/78/EC lays down the principles of veterinary checks on products entering the Union from third countries. Both those Directives also provide for measures which can be adopted by the Commission, if a disease liable to present a serious threat to animal or public health manifests itself or spreads in the territory of a third country. |

Following notification from Algeria and Tunisia of outbreaks of foot-and-mouth disease in those countries, protection measures were adopted at Union level by Commission Implementing Decisions (EU) 2017/675 (3) and (EU) 2017/887 (4). |

Decision (EU) 2017/675 applies until 30 April 2018. |

As the foot-and-mouth disease situation in Algeria and Tunisia still remains uncertain and a significant number of consignments of live bovine animals is exported from Member States to those countries, it is appropriate to prolong the measures in place. |

The measures provided for by this Decision should apply for a period of time which allows a full evaluation of the evolution of the foot-and-mouth disease in the affected areas. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (1), and in particular the fourth sentence of Article 16(3) thereof,
Whereas:

Despite the measures set out by the Commission Decision 2007/365/EC (2) to prevent the introduction into and spread within the Union of Rhynchophorus ferrugineus (Olivier), it appears from the annual surveys carried out by the Member States pursuant to that Decision that the organism is now widespread throughout most parts of the endangered area. |
(2) |
As a result, it is not feasible to prevent its further introduction into and spread within most of the Union territory. |
(3) |
Decision 2007/365/EC should therefore be repealed. |
(4) |
This Decision should apply from the same date as Commission Implementing Directive (EU) 2018/484 (3) to ensure consistency with the provisions of that Directive. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |

on the compliance of the joint proposal submitted by the Member States concerned for the extension of the North Sea Mediterranean rail freight corridor with Article 5 of Regulation (EU) No 913/2010 of the European Parliament and of the Council

Having regard to Regulation (EU) No 913/2010 of the European Parliament and of the Council of 22 September 2010 concerning a European rail network for competitive freight (1), and in particular Article 5(6) thereof,
Whereas:

In accordance with Article 5(5) of Regulation (EU) No 913/2010, the ministries responsible for rail transport in Belgium, France, Luxembourg, Netherlands and United Kingdom sent the Commission a letter of intent, which it received on 14 June 2017. The letter of intent was also signed by Switzerland, which is already participating as a third country in this rail freight corridor on the grounds of the Annex to Regulation (EU) No 913/2010. The letter includes a proposal to extend the North Sea Mediterranean rail freight corridor to Geneva. |

The Commission has examined the proposal included in the letter of intent pursuant to Article 5(6) of Regulation (EU) No 913/2010 and considers the proposal to be in compliance with Article 5 of that Regulation for the reasons set out below. |

The proposal takes account of the criteria set out in Article 4 of Regulation (EU) No 913/2010. The total number of participating countries in the corridor remains at six, and five of them are Member States of the Union. The general alignment of the corridor with the North Sea Mediterranean Core Network Corridor remains unchanged. The proposed extension is consistent with the TEN-T network and complies with the following TEN-T requirements: full electrification of the line tracks, at least 22,5 tonnes axle load, 100 km/h line speed and the possibility of running trains with a length of 740 meters. |

The transport market study included in the letter of intent indicates that the extension is expected to result in additional international rail transport volumes and to create a modal shift from road to rail by providing a shorter route to and from the French maritime ports of the Mediterranean Sea for goods and raw materials entering or leaving Switzerland, which will provide significant socioeconomic benefits by reducing carbon emissions and road congestion. |

The proposed extension is consistent with the objective of setting up a European rail network for competitive freight. The extension will connect major economic sectors from the area of Geneva with important European maritime ports such as Amsterdam, Antwerp, Dunkirk, Marseille, Rotterdam and Zeebrugge, and thus strengthen the interconnection of the TEN-T network with Switzerland, a key third country. |

Article 1
The proposal included in the letter of intent received on 14 June 2017 concerning the extension of the North Sea Mediterranean rail freight corridor to Geneva, jointly sent to the Commission by the ministries responsible for rail transport in Belgium, France, Luxembourg, Netherlands, United Kingdom and Switzerland, is in compliance with Article 5 of Regulation (EU) No 913/2010.
Article 2
This Decision is addressed to the Kingdom of Belgium, the French Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands, the United Kingdom of Great Britain and Northern Ireland and to the Swiss Confederation.

amending the Annex to the Monetary Agreement between the European Union and the Republic of San Marino
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Monetary Agreement of 27 March 2012 between the European Union and the Republic of San Marino, and in particular Article 8(5) thereof,
Whereas:

Article 8 of the Monetary Agreement between the European Union and the Republic of San Marino (‘the Monetary Agreement’) requires the Republic of San Marino to implement Union legal acts and rules on euro banknotes and coins, banking and financial law, prevention of money laundering, prevention of fraud and counterfeiting of cash and non-cash means of payment, medals and tokens and statistical reporting requirements. Those acts and rules are listed in the Annex to the Monetary Agreement. |
(2) |
The Annex to the Monetary Agreement needs to be amended by the Commission once a year or more often if deemed appropriate to take into account the new relevant Union legal acts and rules and the amendments to the existing ones. |
(3) |
Some new relevant legal acts and rules of the Union and some amendments to existing legal acts were adopted and have to be added to the Annex. |

The Annex to the Monetary Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to the Monetary Agreement between the European Union and the Republic of San Marino is replaced by the text in the Annex to this Decision.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

amending the Annex to the Monetary Agreement between the European Union and the Principality of Andorra
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Monetary Agreement of 30 June 2011 between the European Union and the Principality of Andorra, and in particular Article 8(4) thereof,
Whereas:

Article 8 of the Monetary Agreement between the European Union and the Principality of Andorra (hereinafter ‘the Monetary Agreement’) requires the Principality of Andorra to implement Union acts concerning the rules on euro banknotes and coins, banking and financial law, prevention of money laundering, prevention of fraud and counterfeiting of cash and non-cash means of payment, medals and tokens and statistical reporting requirements. Those acts are listed in the Annex to the Monetary Agreement. |
(2) |
The Annex needs to be amended by the Commission every year to take into account the new relevant legal acts and rules of the Union and the amendments to the existing ones. |
(3) |
Some new relevant legal acts and rules of the Union and some amendments to existing legal acts were adopted and have to be added to the Annex. |
(4) |
The Annex to the Monetary Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to the Monetary Agreement between the European Union and the Principality of Andorra is replaced by the Annex to this Decision.
Article 2
This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

updating Annex A to the Monetary Agreement between the European Union and the Principality of Monaco
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Monetary Agreement of 29 November 2011 between the European Union and the Principality of Monaco, and in particular Article 11(3) thereof,
Whereas:

Article 11(2) of the Monetary Agreement between the European Union and the Principality of Monaco (hereinafter ‘the Monetary Agreement’) requires the Principality of Monaco to apply the same rules as those established in the French Republic for the purposes of transposing European legal acts concerning the activities and prudential regulation of credit institutions and the prevention of systemic risks to payment and securities settlement systems contained in Annex A. |
(2) |
The update of the Annex A is made according to Article 11(3) of the Monetary Agreement which foresees that Annex A needs to be updated by the Commission upon amendment of any relevant texts and also each time a new text is adopted by the European Union, |
(3) |
New texts have been adopted by the European Union and amendments have been made to the texts already existing in Annex A. |
(4) |
Annex A to the Monetary Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Sole Article
Annex A to the Monetary Agreement between the European Union and the Principality of Monaco is replaced by the Annex to this Decision.
This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

amending the Annex to the Monetary Agreement between the European Union and the Vatican City State
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Monetary Agreement of 17 December 2009 between the European Union and the Vatican City State, and in particular Article 8(3) thereof,
Whereas:

Article 8(1) of the Monetary Agreement between the European Union and the Vatican City State (‘the Monetary Agreement’) requires the Vatican City State to implement Union legal acts and rules on euro banknotes and coins, prevention of money laundering, of fraud and counterfeiting of cash and non-cash means of payment; medals and tokens and statistical reporting requirements. Those acts and rules are listed in the Annex to the Monetary Agreement. |
(2) |
The Annex to the Monetary Agreement needs to be amended by the Commission every year to take into account the new relevant Union legal acts and rules and the amendments to the existing ones. |
(3) |
Some new relevant legal acts and rules of the Union and some amendments to existing legal acts were adopted and have to be added to the Annex. |
(4) |
The Annex to the Monetary Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to the Monetary Agreement between the European Union and the Vatican City State is replaced by the text in the Annex to this Decision.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING DECISION (EU) 2018/496
of 22 March 2018
on the establishment of the 2018 annual priority list for the development of network codes and guidelines

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 714/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to the network for cross-border exchanges in electricity and repealing Regulation (EC) No 1228/2003 (1), and in particular Article 6(1) thereof,
Having regard to Regulation (EC) No 715/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to natural gas transmission networks and repealing Regulation (EC) No 1775/2005 (2), and in particular Article 6(1) thereof,
Whereas:

The development and implementation of network codes and guidelines are essential in order to achieve full integration of the internal energy market. The Third Energy Package (3) has created an institutional framework for the development of network codes with a view to harmonising, where necessary, the technical, operational and market rules governing the electricity and gas grids. For that purpose, the Agency for the Cooperation of Energy Regulators (‘ACER’), the European Networks of Transmission System Operators (‘ENTSOs’) and the Commission work in close cooperation with all relevant stakeholders. |

The areas in which network codes can be developed are set out in Articles 8(6) of Regulation (EC) No 714/2009 and Regulation (EC) No 715/2009. Besides the possibility to develop network codes, the Commission can also decide to develop guidelines in the areas set out in Article 18(1), (2) and (3) of Regulation (EC) No 714/2009 and Article 23(1) of Regulation (EC) No 715/2009. In accordance with Article 6(1) of Regulation (EC) No 714/2009 and Article 6(1) of Regulation (EC) No 715/2009, the Commission should first establish an annual priority list identifying the areas to be included in the development of network codes. |

During the public consultation (4), the majority of stakeholders supported the prioritisation of the ongoing work and emphasised the importance of a proper and well-coordinated implementation of adopted network codes and guidelines whereby a structured involvement of stakeholders is ensured. A few respondents signalled that in the future it could be necessary to consider amending the adopted network codes and guidelines. |

Acknowledging the responses of stakeholders and having regard to the future legislative initiatives in the context of the market design initiative, the various actions needed to ensure the full integration of the internal energy market and the fact that the implementation of network codes and guidelines will require significant resources from all relevant parties including the European Commission, ACER, ENTSOs and stakeholders, no new areas have been added to the annual priority lists, |
HAS ADOPTED THIS DECISION:
Article 1
It is hereby established that no new areas have been identified for the development, in 2018, of network codes and guidelines for electricity and gas.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
