COUNCIL REGULATION (EU) 2017/1133

of 20 June 2017

amending Regulation (EU) No 1388/2013 opening and providing for the management of autonomous tariff quotas of the Union for certain agricultural and industrial products

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 31 thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

In order to ensure the sufficient and uninterrupted supply of certain goods insufficiently produced in the Union and to avoid any disturbances on the market for certain agricultural and industrial products, autonomous tariff quotas were opened by Council Regulation (EU) No 1388/2013 (1). Products within those tariff quotas can be imported into the Union at reduced or zero duty rates. For those reasons it is necessary to open, with effect from 1 July 2017, tariff quotas at zero duty rates for an appropriate volume as regards seven new products.

(2)

In the case of five additional products, the tariff quota volumes should be increased, as this increase is in the interest of economic operators and of the Union.

(3)

Moreover, for one product the increase in tariff quota volume should only apply to the second half of the year 2017, while the existing tariff quota for that product should be given an end date of 31 December 2017.

(4)

Regulation (EU) No 1388/2013 should therefore be amended accordingly.

(5)

As the changes regarding the tariff quotas for the products concerned provided for in this Regulation have to apply from 1 July 2017, this Regulation should enter into force as a matter of urgency,

HAS ADOPTED THIS REGULATION:

Article 1

The Annex to Regulation (EU) No 1388/2013 is amended as follows:

(1)

the rows for the tariff quotas with order numbers 09.2828, 09.2842, 09.2844, 09.2846, 09.2848, 09.2850, 09.2868, and 09.2870 set out in Annex I to this Regulation are inserted following the order of the CN codes indicated in the second column of the table in the Annex to Regulation (EU) No 1388/2013;

(2)

the rows for the tariff quotas with order numbers 09.2629, 09.2658, 09.2668, 09.2669, 09.2687 and 09.2860 are replaced by the rows set out in Annex II to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

It shall apply from 1 July 2017.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COUNCIL REGULATION (EU) 2017/1134

amending Regulation (EU) No 1387/2013 suspending the autonomous Common Customs Tariff duties on certain agricultural and industrial products

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 31 thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Union production of 69 agricultural and industrial products that are not listed in the Annex to Council Regulation (EU) No 1387/2013 (1) is inadequate or non-existent. It is, therefore, in the interest of the Union to completely suspend the autonomous Common Customs Tariff (‘CCT’) duties on those products.

(2)

It is necessary to modify the conditions for 71 suspensions of autonomous CCT duties currently listed in the Annex to Regulation (EU) No 1387/2013 in order to take into account technical product developments and economic trends on the market. Certain product classifications have been amended to allow the industry to fully benefit from the suspensions in force. Moreover, the Annex to Regulation (EU) No 1387/2013 should be updated due to the need to align or clarify texts in some cases. The modified conditions relate to changes in the product description, classification or end-use requirements. The suspensions that require modifications should be deleted from the list of suspensions in the Annex to Regulation (EU) No 1387/2013, and the modified suspensions should be inserted into that list.

(3)

It is no longer in the interest of the Union to maintain the suspension of autonomous CCT duties for two of the products that are currently listed in the Annex to Regulation (EU) No 1387/2013.

(4)

In the interests of clarity, the entries modified by this Regulation should be marked with an asterisk.

(5)

Regulation (EU) No 1387/2013 should therefore be amended accordingly.

(6)

As the changes regarding the suspensions for the products concerned provided for in this Regulation have to apply from 1 July 2017, this Regulation should enter into force as a matter of urgency,

HAS ADOPTED THIS REGULATION:

Article 1

The Annex to Regulation (EU) No 1387/2013 is amended as follows:

(1)

the rows for the products listed in Annex I to this Regulation are inserted following the order of the CN codes indicated in the first column of the table in the Annex to Regulation (EU) No 1387/2013;

(2)

the rows for the products for which the CN and TARIC codes are set out in Annex II to this Regulation are deleted.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

It shall apply from 1 July 2017.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) 2017/1135

of 23 June 2017

amending Annexes II and III to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for dimethoate and omethoate in or on certain products

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (1), and in particular Article 14(1)(a) and Article 49(2) thereof,

Whereas:

For dimethoate (sum of dimethoate and omethoate expressed as dimethoate), maximum residue levels (MRLs) were set in Annex II and Part B of Annex III to Regulation (EC) No 396/2005.

On 22 April 2016 France informed the Commission of a national emergency measure taken in accordance with Article 54 of Regulation (EC) No 178/2002 of the European Parliament and of the Council (2) suspending the imports and placing on the market in France of fresh cherries from other Member States of the European Union or from third countries, in which the use of plant protection products containing the active substance dimethoate is allowed for the treatment of cherry trees. In accordance with Article 54(2) of that Regulation, on 28 April 2016, during a meeting of the Standing Committee on Plants, Animals, Food and Feed, it was agreed that an MRL review should be prioritised, in order to establish new MRLs, based on a scientific review carried out by the European Food Safety Authority, hereinafter ‘the Authority’. Therefore in accordance with Article 43 of Regulation (EC) No 396/2005, the Commission requested the Authority to carry out such a prioritised review of the existing MRLs for dimethoate and omethoate. The Authority submitted its reasoned opinion on 28 November 2016 (3).

The Authority proposed to change the residue definition of ‘sum of dimethoate and omethoate expressed as dimethoate’ to the separate residue definitions ‘dimethoate’ and ‘omethoate’ and concluded that the MRLs for melons and sugar beet roots may raise concerns of consumer protection. The Authority therefore recommended lowering the existing MRLs for these commodities. It concluded that concerning the MRLs for witloof no information was available and that further consideration by risk managers was required. Therefore the MRLs for this product should be set at the specific limit of determination. The Authority concluded that concerning the MRLs for Chinese cabbages no information was available on good agricultural practices that are safe for consumers and that further consideration by risk managers was required. Therefore the MRLs for this product should be set at the specific limit of determination. It concluded that concerning the MRLs for grapefruits, oranges, lemons, limes, mandarins, cherries, table olives, beetroots, carrots, celeriacs, horseradishes, parsnips, parsley roots, radishes, salsifies, swedes, turnips, garlic, onions, shallots, spring onions, tomatoes, aubergines, pumpkins, watermelons, broccoli, cauliflowers, Brussels sprouts, head cabbages, lettuces, asparagus, peas, olives for oil production, barley grains, oat grains, rye grains, wheat grains, sugar beet roots and chicory roots some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, the MRLs for those products should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. These MRLs will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation.

The Commission consulted the European Union reference laboratories for residues of pesticides as regards the need to adapt certain limits of determination. Those laboratories concluded that for certain commodities technical development requires the setting of specific limits of determination.

Based on the reasoned opinion of the Authority and taking into account the factors relevant to the matter under consideration, the appropriate modifications to the MRLs fulfil the requirements of Article 14(2) of Regulation (EC) No 396/2005.

Through the World Trade Organisation, the trading partners of the Union were consulted on the new MRLs and their comments have been taken into account.

Regulation (EC) No 396/2005 should therefore be amended accordingly.

In order to allow for the normal marketing, processing and consumption of products, this Regulation should provide for a transitional arrangement for products which have been produced before the modification of the MRLs and for which information shows that a high level of consumer protection is maintained. Because a risk to consumers cannot be excluded at the current MRL, the values for dimethoate and omethoate of 0,01 mg/kg for melons should apply to all products from the date of application of this Regulation.

A reasonable period should be allowed to elapse before the modified MRLs become applicable in order to permit Member States, third countries and food business operators to prepare themselves to meet the new requirements which will result from the modification of the MRLs.

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Annexes II and III to Regulation (EC) No 396/2005 are amended in accordance with the Annex to this Regulation.

Article 2

As regards the active substance dimethoate in and on all products except melons, Regulation (EC) No 396/2005 as it stood before being amended by this Regulation shall continue to apply to products which were produced before 17 January 2018.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 17 January 2018.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications (Emmental de Savoie (PGI))

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Whereas:

Pursuant to the first subparagraph of Article 53(1) of Regulation (EU) No 1151/2012, the Commission has examined France's application for the approval of amendments to the specification for the protected geographical indication ‘Emmental de Savoie’ registered under Commission Regulation (EC) No 1107/96 (2).

By letter of 23 November 2015, the French authorities notified the Commission that a transitional period under Article 15(4) of Regulation (EU) No 1151/2012, ending on 31 December 2017, had been granted to one operator that is established on their territory and meets the conditions of that Article in accordance with the Order of 29 October 2015 on the protected geographical indication ‘Emmental de Savoie’ published on 7 November 2015 in the Official Journal of the French Republic. During the national objection procedure, this operator that legally marketed ‘Emmental de Savoie’ continuously for at least the five years prior to lodging the application, lodged an objection concerning the 50 % minimum share of coarse green fodder in the dairy cows' basic ration for at least 150 days per year. The reason given was that time was needed for the operator's holding to be adapted. The operator in question is Le Seysselan GAEC, Vallod, 74910 SEYSSEL.

Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, the Commission published the amendment application in the Official Journal of the European Union as required by Article 50(2)(a) of that Regulation (3).

(4)

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the amendments to the specification should be approved,

HAS ADOPTED THIS REGULATION:

Article 1

The amendments to the specification published in the Official Journal of the European Union regarding the name ‘Emmental de Savoie’ (PGI) are hereby approved.

Article 2

The protection provided under Article 1 is subject to the transitional period granted by France pursuant to the Order of 29 October 2015 on the protected geographical indication ‘Emmental de Savoie’, published on 7 November 2015 in the Official Journal of the French Republic under Article 15(4) of Regulation (EU) No 1151/2012, to operators meeting the conditions of that Article.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Whereas:

Commission Regulation (EC) No 431/2008 (2) opened an annual import tariff quota for products in the beef and veal sector.

(2)

The quantities for which import rights applications have been lodged for the period 1 July 2017 to 30 June 2018 exceed those available. The extent to which import rights may be allocated should therefore be determined and an allocation coefficient laid down to be applied to the quantities applied for, calculated in accordance with Article 6(3) in conjunction with Article 7(2) of Commission Regulation (EC) No 1301/2006 (3).

(3)

In order to ensure the efficient management of the measure, this Regulation should enter into force on the day of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

The quantities for which import rights applications have been lodged under Regulation (EC) No 431/2008 for the period 1 July 2017 to 30 June 2018 shall be multiplied by the allocation coefficient set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

on the position to be taken on behalf of the European Union at the first meeting of the Conference of the Parties of the Minamata Convention on Mercury as regards the adoption of the required content of the certification referred to in Article 3(12) of the Convention and of the guidance referred to in Article 8(8) and (9) of the Convention

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 192(1) in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

On 11 May 2017, the Minamata Convention on Mercury (1) (the ‘Convention’) was approved, on behalf of the European Union, by way of Council Decision (EU) 2017/939 (2).

(2)

The Convention will enter into force on 16 August 2017. The first meeting of the Conference of the Parties to the Convention (the ‘COP 1’) will be held on 24-29 September 2017 in Geneva. In these circumstances, the Union should determine the position to be taken at the COP 1.

(3)

Article 3(8) of the Convention requires Parties that intend to import mercury from a non-Party to only allow such import on the condition that they are provided with certification from the exporting non-Party that the imported mercury is neither from primary mercury mining nor from excess mercury from the decommissioning of chlor-alkali facilities (the ‘certification’).

(4)

Article 3(12) of the Convention provides for the adoption of the required content of the certification by the COP 1. Such required content of the certification will therefore have legal effects.

(5)

Regulation (EU) 2017/852 of the European Parliament and of the Council (3) complies with the provisions of Article 3(8) of the Convention, as complemented by the proposed required content of the certification.

(6)

Article 8(4) of the Convention requires Parties to ensure that new point sources falling within the source categories listed in Annex D make use of best available techniques and best environmental practices to control and, where feasible, to reduce emissions of mercury and mercury compounds into the atmosphere.

(7)

Article 8(5) of the Convention provides that Parties shall control and, where feasible, reduce emissions to air of mercury and mercury compounds from the existing point sources falling within the source categories listed in Annex D by implementing one or more of the following measures: using best available techniques and best environmental practices; establishing quantified goals or emission limit values; establishing a multi-pollutant control strategy; or alternative measures.

Article 8(7) of the Convention requires Parties to establish and maintain an inventory of emissions of mercury and mercury compound to the atmosphere.

(9)

Article 8(8) of the Convention stipulates that the COP 1 shall adopt guidance on best available techniques and best environmental practices, taking into account any differences between new and existing sources and taking into account the need to minimise cross-media effects, and shall also adopt guidance aimed at supporting Parties in the implementation of their obligations under Article 8(5), in particular in determining goals and setting emission limit values.

Article 8(9) of the Convention provides for the adoption by the Conference of the Parties to the Convention, as soon as practicable, of guidance on criteria that Parties may develop pursuant to Article 8(2)(b), when choosing to apply control measures on emissions of mercury and mercury compounds to air only to the point sources falling within a given source category listed in Annex D, provided that at least 75 per cent of the emissions of the concerned source category are covered, and of guidance on the methodology to be used for preparing inventory of emissions to air of mercury and mercury compounds.

(11)

The second sentence of Article 8(10) of the Convention specifies that Parties shall take the guidance into account in implementing the relevant provisions of that Article. Such guidance will therefore have legal effects.

(12)

The Intergovernmental Negotiating Committee of the Convention, at its seventh session held on 10-15 March 2016 in Jordan, adopted, on a provisional basis, pending formal adoption by the COP 1, the four guidance documents referred to in Article 8(8) and (9) of the Convention.

(13)

Union legislation, including Directive 2010/75/EU of the European Parliament and of the Council (4) and Regulation (EC) No 166/2006 of the European Parliament and of the Council (5) complies with the provisions of Article 8 of the Convention, as complemented by the proposed guidance.

(14)

The proposed required content of the certification and the proposed four guidance documents should therefore be supported,

HAS ADOPTED THIS DECISION:

Article 1

The position to be taken on behalf of the European Union at the first meeting of the Conference of the Parties to the Minamata Convention on Mercury (the ‘Convention’), shall be to support the adoption of the required content of the certification referred to in Article 3(12) and of the guidance referred to in Article 8(8) and (9) of the Convention.

Minor changes to the documents referred to in the first paragraph may be agreed to by the representatives of the Union, in consultation with Member States during coordination meetings, without further decision of the Council.

Article 2

The Decision(s) of the Conference of the Parties to the Convention adopting the documents referred to in Article 1 shall be published in the Official Journal of the European Union.

Article 3

This Decision shall enter into force on the day of its adoption.

amending the Annex to Implementing Decision (EU) 2017/247 on protective measures in relation to outbreaks of the highly pathogenic avian influenza in certain Member States

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,

Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,

Whereas:

Commission Implementing Decision (EU) 2017/247 (3) was adopted following outbreaks of highly pathogenic avian influenza of subtype H5 in a number of Member States (‘the concerned Member States’), and the establishment of protection and surveillance zones by the competent authority of the concerned Member States in accordance with Council Directive 2005/94/EC (4).

(2)

Implementing Decision (EU) 2017/247 provides that the protection and surveillance zones established by the competent authorities of the concerned Member States in accordance with Directive 2005/94/EC are to comprise at least the areas listed as protection and surveillance zones in the Annex to that Implementing Decision. Implementing Decision (EU) 2017/247 also lays down that the measures to be applied in the protection and surveillance zones, as provided for in Article 29(1) and Article 31 of Directive 2005/94/EC, are to be maintained until at least the dates for those zones set out in the Annex to that Implementing Decision.

The Annex to Implementing Decision (EU) 2017/247 was subsequently amended by Commission Implementing Decisions (EU) 2017/417 (5), (EU) 2017/554 (6), (EU) 2017/696 (7), (EU) 2017/780 (8), (EU) 2017/819 (9) and (EU) 2017/977 (10), in order to take account of changes to the protection and surveillance zones established by the competent authorities of the Member States in accordance with Directive 2005/94/EC, following further outbreaks of highly pathogenic avian influenza of subtype H5 in the Union. In addition, Implementing Decision (EU) 2017/247 was amended by Implementing Decision (EU) 2017/696 in order to lay down rules regarding the dispatch of consignments of day-old chicks from the areas listed in the Annex to Implementing Decision (EU) 2017/247, following certain improvements in the epidemiological situation as regards that virus in the Union.

Furthermore, the period of application of Implementing Decision (EU) 2017/247 was prolonged until 31 December 2017 by Implementing Decision (EU) 2017/977, in order to take account of the dates for the implementation of measures in the new areas listed in the Annex to Implementing Decision (EU) 2017/247, as amended by Implementing Decision (EU) 2017/977.

The overall disease situation in the Union has been steadily improving. Since the date of the last amendment made to Implementing Decision (EU) 2017/247 by Implementing Decision (EU) 2017/977, only Belgium has detected new outbreaks of highly pathogenic avian influenza of subtype H5N8 in captive bird holdings. It has also notified the Commission that it has taken the necessary measures required in accordance with Directive 2005/94/EC, including the establishment of protection and surveillance zones around infected holdings. In relation to the other outbreaks in Belgium in small non-commercial holdings, the competent authority has granted a derogation from the zoning requirements, as provided for in Article 16(2) of Directive 2005/94/EC, following a risk assessment.

France has also established a surveillance zone, in accordance with Directive 2005/94/EC, in relation to the recent outbreaks confirmed in Belgium in captive bird holdings, near the boundary with France.

(7)

The Commission has examined the measures taken by Belgium and France in accordance with Directive 2005/94/EC, following the recent outbreaks of avian influenza of subtype H5N8 in Belgium, and it has satisfied itself that the boundaries of the protection and surveillance zones, established by the competent authority of Belgium and the surveillance zone established in France, are at a sufficient distance to any holding where an outbreak of highly pathogenic avian influenza of subtype H5 has been confirmed and that the derogation from the zoning requirements, granted by the competent authority in Belgium, was done in accordance with the requirements laid down in Directive 2005/94/EC.

In order to prevent any unnecessary disturbance to trade within the Union, and to avoid unjustified barriers to trade being imposed by third countries, it is necessary to rapidly describe at Union level, in collaboration with Belgium and France, the protection and surveillance zones established in Belgium as well as the surveillance zone established in France, in accordance with Directive 2005/94/EC, following the recent outbreaks in Belgium. Therefore, the new areas for Belgium and France should be inserted in the Annex to Implementing Decision (EU) 2017/247.

(9)

The Annex to Implementing Decision (EU) 2017/247 should be therefore be amended to update regionalisation at Union level to include the protection and surveillance zones established by Belgium, and the surveillance zone established in France, in accordance with Directive 2005/94/EC and the duration of the restrictions applicable therein.

(10)

Implementing Decision (EU) 2017/247 should therefore be amended accordingly.

(11)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Implementing Decision (EU) 2017/247 is amended in accordance with the Annex to this Decision.

Article 2

This Decision is addressed to the Member States.

on personal data that may be exchanged through the Early Warning and Response System (EWRS) established pursuant to Decision No 1082/2013/EU of the European Parliament and of the Council for the purposes of the coordination of contact tracing measures in relation to serious cross-border threats to health

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 292,

Whereas:

(1)

Decision No 2119/98/EC of the European Parliament and of the Council (1) established an early warning and response system (‘EWRS’) as a permanent communication network between the Commission and the competent public health authorities of the Member States for the prevention and control of certain categories of communicable diseases. The procedures governing the functioning of the EWRS were laid down in Commission Decision 2000/57/EC (2).

(2)

Decision No 2119/98/EC was repealed and replaced by Decision No 1082/2013/EU of the European Parliament and of the Council (3). The new Decision re-enacted the EWRS. It also extended the scope of the permanent communication network to cover other types of biological threats, and other categories of serious cross-border threats to health including threats of chemical, environmental or unknown origin. In addition, it laid down rules on epidemiological surveillance, monitoring, early warning of, and combating serious cross-border threats to health.

Decision 2000/57/EC was repealed and replaced by Commission Implementing Decision (EU) 2017/253 (4).

(4)

Pursuant to Article 9(3)(i) of Decision No 1082/2013/EU, notification of serious cross-border threats to health through the EWRS should include data necessary to permit the identification of infected persons as well as of individuals potentially in danger (‘contact tracing data’). In line with Article 16(9)(b) of that Decision, and the objective to ensure the effectiveness and uniform application of such notifications, it is appropriate to recommend an indicative list of personal data that may be communicated by the EWRS competent authorities.

(5)

The exchange of personal data through the EWRS should be carried out in accordance with the requirements of Directive 95/46/EC of the European Parliament and of the Council (5) and Regulation (EC) No 45/2001 of the European Parliament and of the Council (6). While, as a rule, Directive 95/46/EC and Regulation (EC) No 45/2001 preclude the processing of special categories of personal data, including data relating to an individual's health, such processing is nevertheless authorised insofar as it is necessary to protect the vital interests of the data subject, in accordance with Article 8(2)(c) of Directive 95/46/EC and with Article 10(2)(c) of Regulation (EC) No 45/2001, and also for reasons of substantial public interest, subject to the provision of suitable safeguards, as laid down in Union or Member State law, in accordance with, respectively, Articles 8(4) and 10(4) of those acts.

Only the personal data necessary for the above purposes as determined in the individual cases should be exchanged through the EWRS, and this Recommendation should not constitute an authorisation to exchange all the types of personal data it concerns.

The European Data Protection Supervisor was consulted in accordance with Article 28(2) of Regulation (EC) No 45/2001 and delivered an opinion on 24 August 2015 (C 2015-0629),

HAS ADOPTED THIS RECOMMENDATION:

1.

An indicative list of personal data that may be exchanged for the purpose of coordination of contact tracing measures is set out in the Annex to this Recommendation.

2.

This Recommendation is addressed to the Member States.
