COMMISSION REGULATION (EU) 2016/1067

of 1 July 2016

amending Annex III to Regulation (EC) No 110/2008 of the European Parliament and of the Council on the definition, description, presentation, labelling and the protection of geographical indications of spirit drinks

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 110/2008 of the European Parliament and of the Council of 15 January 2008 on the definition, description, presentation, labelling and the protection of geographical indications of spirit drinks and repealing Council Regulation (EEC) No 1576/89 (1), and in particular Article 20(3) thereof,

Whereas:

Pursuant to Article 20(1) of Regulation (EC) No 110/2008, Member States are to submit to the Commission a technical file for each established geographical indication registered in Annex III to Regulation (EC) No 110/2008 not later than 20 February 2015.

(2)

Until 20 February 2015, the Commission received technical files for 243 geographical indications out of the 330 established geographical indications. For the other 87 established geographical indications, no technical file was received within the given deadline.

(3)

In accordance with Article 20(3) of Regulation (EC) No 110/2008, the 87 established geographical indications for which no technical file was submitted to the Commission by 20 February 2015 should be removed from Annex III to that Regulation.

(4)

The other 243 established geographical indications for which technical files were submitted by 20 February 2015 shall, for the time being, remain in Annex III to Regulation (EC) No 110/2008. In accordance with Article 9 of Commission Implementing Regulation (EU) No 716/2013 (2), the Commission will assess whether the technical files submitted for those geographical indications fulfil the requirements laid down in Article 15(1) of Regulation (EC) No 110/2008.

In the light of the above, Annex III to Regulation (EC) No 110/2008 should be replaced by the Annex to this Regulation.

(6)

Regulation (EC) No 110/2008 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Committee for Spirit Drinks,

HAS ADOPTED THIS REGULATION:

Article 1

Annex III to Regulation (EC) No 110/2008 is replaced by the text in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

(1)  The geographical indication Irish Whiskey/Uisce Beatha Eireannach/Irish Whisky covers whisky/whiskey produced in Ireland and Northern Ireland.

(2)  The protection of the geographical indication Pisco under this Regulation shall be without prejudice to the use of the name Pisco for products originating in Chile protected under the Association Agreement between the Union and Chile of 2002.

(3)  The geographical indication Somerset Cider Brandy must be accompanied by the sales denomination ‘cider spirit’.

(4)  This product must bear on the label the sales denomination ‘flavoured vodka’. The term ‘flavoured’ may be replaced by the name of the predominant flavour.

(5)  The geographical indication Irish Cream covers the corresponding liqueur produced in Ireland and Northern Ireland.’

COMMISSION IMPLEMENTING REGULATION (EU) 2016/1068

of 1 July 2016

approving N-cyclopropyl-1,3,5-triazine-2,4,6-triamine (cyromazine) as an existing active substance for use in biocidal products of product-type 18

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular the third subparagraph of Article 89(1) thereof,

Whereas:

Commission Delegated Regulation (EU) No 1062/2014 (2) establishes a list of existing active substances to be evaluated for their possible approval for use in biocidal products. That list includes N-cyclopropyl-1,3,5-triazine-2,4,6-triamine (cyromazine).

(2)

Cyromazine has been evaluated for use in products of product-type 18, Insecticides, acaricides and products to control other arthropods, as described in Annex V to Regulation (EU) No 528/2012.

(3)

Greece was designated as evaluating competent authority and submitted the assessment reports together with its recommendations on 28 August 2014.

(4)

In accordance with Article 7(2) of Delegated Regulation (EU) No 1062/2014, the opinion of the European Chemicals Agency was formulated on 10 December 2015 by the Biocidal Products Committee, having regard to the conclusions of the evaluating competent authority.

(5)

According to that opinion, biocidal products of product-type 18 and containing cyromazine may be expected to satisfy the criteria of Article 19(1)(b) of Regulation (EU) No 528/2012, provided that certain specifications and conditions concerning their use are complied with.

(6)

It is therefore appropriate to approve cyromazine for use in biocidal products of product-type 18, subject to compliance with certain specifications and conditions.

(7)

Since cyromazine meets the criteria for being very persistent (vP) according to Annex XIII to Regulation (EC) No 1907/2006 of the European Parliament and of the Council (3), treated articles treated with or incorporating cyromazine should be labelled appropriately when placed on the market.

(8)

A reasonable period should be allowed to elapse before an active substance is approved in order to permit interested parties to take the preparatory measures necessary to meet the new requirements.

(9)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Biocidal Products,

HAS ADOPTED THIS REGULATION:

Article 1

N-cyclopropyl-1,3,5-triazine-2,4,6-triamine (cyromazine) is approved as an active substance for use in biocidal products of product-type 18, subject to the specifications and conditions set out in the Annex.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

The authorisations of biocidal products are subject to the following conditions.

(1)

The product assessment shall pay particular attention to the exposures, the risks and the efficacy linked to any use covered by an application for authorisation, but not addressed in the Union level risk assessment of the active substance.

(2)

In view of the risks identified for the uses assessed, the product assessment shall pay particular attention to:

(a)

professional users;

(b)

the surface water, sediment and soil compartment for products used in animal housing.

(3)

For products that may lead to residues in food or feed, the need to set new or to amend existing maximum residue levels (MRLs) in accordance with Regulation (EC) No 470/2009 of the European Parliament and of the Council (2) or Regulation (EC) No 396/2005 of the European Parliament and of the Council (3) shall be verified, and any appropriate risk mitigation measures shall be taken to ensure that the applicable MRLs are not exceeded.

The placing on the market of treated articles is subject to the following condition:

The person responsible for the placing on the market of a treated article treated with or incorporating cyromazine shall ensure that the label of that treated article provides the information listed in the second subparagraph of Article 58(3) of Regulation (EU) No 528/2012.

Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,

Whereas:

(1)

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto.

(2)

The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

on subjecting 1-phenyl-2-(pyrrolidin-1-yl)pentan-1-one (α-pyrrolidinovalerophenone, α-PVP) to control measures

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Decision 2005/387/JHA of 10 May 2005 on the information exchange, risk-assessment and control of new psychoactive substances (1), and in particular Article 8(3) thereof,

Having regard to the proposal from the European Commission,

Having regard to the opinion of the European Parliament (2),

Whereas:

(1)

A risk assessment report on the new psychoactive substance 1-phenyl-2-(pyrrolidin-1-yl)pentan-1-one (α-pyrrolidinovalerophenone, α-PVP) was drawn up in accordance with Decision 2005/387/JHA by a special session of the extended Scientific Committee of the European Monitoring Centre for Drugs and Drug Addiction, and was subsequently submitted to the Commission and to the Council on 27 November 2015.

(2)

α-PVP is a potent psychostimulant, structurally related to cathinone, pyrovalerone and methylendioxypyrovaleron (MDPV), which are controlled under the 1971 United Nations Convention on Psychotropic Substances. α-PVP has been detected in all 28 Member States, as well as Turkey and Norway, and the information from seizures and collected samples indicate that it is mainly present in powder and tablet form. The available information suggests that multi-kilogram quantities of α-PVP are imported into the Union drug market from China and then distributed across the Union. Two illicit production sites have been seized in a Member State, indicating that the capacity to manufacture α-PVP also exists within the Union.

(3)

Eight Member States have reported a total of 115 deaths and 191 acute intoxications where α-PVP was detected. In most cases, the use of α-PVP was combined with other pharmacologically active substances, either intentionally or unintentionally. If α-PVP were to become more widely available and used, the implications for individual and public health could be significant.

(4)

The available data suggests that α-PVP is used by stimulant users in recreational settings as well as by high-risk drug users, including those injecting stimulants and opioids, and that polydrug use may be common among them. There is limited data on prevalence of drug use, long-term consequences and on the social risks associated with the substance.

(5)

There is no available information or any published study assessing in a comprehensive way the health risks associated with α-PVP, namely chronic and acute toxicity, but observations in animals suggest similar effects to those observed in other stimulants. Adverse symptoms observed in humans include tachycardia, hyperthermia, diaphoresis, agitation, convulsions or seizures, confusion and aggression. Data from non-clinical studies suggest that α-PVP may have an abuse liability and possibly a dependence potential in humans.

α-PVP has no established or acknowledged human or veterinary medical use. Apart from its use in analytical reference materials and in scientific research investigating its chemistry, pharmacology and toxicology as a result of its emergence on the drug market, there is no indication that it is being used for other purposes.

(7)

Despite the limited scientific evidence available on α-PVP, the evidence and information on the health risks that the substance poses, as documented in its detection in fatalities and acute intoxications, provides sufficient grounds for subjecting α-PVP to control measures across the Union.

(8)

Given that 16 Member States control α-PVP under national legislation complying with the obligations of the 1971 United Nations Convention on Psychotropic Substances and that five Member States use other legislative measures to control it, subjecting this substance to control measures across the Union would help avoid the emergence of obstacles in cross-border law enforcement and judicial cooperation, and would help protect from the risks that its availability and use could pose.

(9)

Decision 2005/387/JHA confers upon the Council implementing powers with a view to giving a quick and expertise-based response at Union level to the emergence of new psychoactive substances detected and reported by the Member States, by subjecting those substances to control measures across the Union. As the conditions and procedure for triggering the exercise of such implementing powers have been met, an implementing decision should be adopted in order to put α-PVP under control across the Union.

Denmark is bound by Decision 2005/387/JHA and is therefore taking part in the adoption and application of this Decision, which implements Decision 2005/387/JHA.

Ireland is bound by Decision 2005/387/JHA and is therefore taking part in the adoption and application of this Decision, which implements Decision 2005/387/JHA.

(12)

The United Kingdom is not bound by Decision 2005/387/JHA and is therefore not taking part in the adoption of this Decision, which implements Decision 2005/387/JHA, and is not bound by it or subject to its application,

HAS ADOPTED THIS DECISION:

Article 1

The new psychoactive substance 1-phenyl-2-(pyrrolidin-1-yl)pentan-1-one (α-pyrrolidinovalerophenone, α-PVP) shall be subjected to control measures across the Union.

Article 2

By 3 July 2017, Member States shall take the necessary measures, in accordance with their national law, to subject the new psychoactive substance referred to in Article 1 to control measures and criminal penalties, as provided for under their legislation, complying with their obligations under the 1971 United Nations Convention on Psychotropic Substances.

Article 3

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Decision shall apply in accordance with the Treaties.

COUNCIL DECISION (CFSP) 2016/1071

of 1 July 2016

amending Decision 2014/512/CFSP concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 31 July 2014, the Council adopted Decision 2014/512/CFSP (1).

(2)

On 19 March 2015, the European Council agreed that the necessary measures would be taken to clearly link the duration of the restrictive measures to the complete implementation of the Minsk agreements, bearing in mind that the complete implementation was foreseen for 31 December 2015.

(3)

On 21 December 2015, the Council renewed Decision 2014/512/CFSP until 31 July 2016 in order to enable it to further assess the implementation of the Minsk agreements.

(4)

Having assessed the implementation of the Minsk agreements, Decision 2014/512/CFSP should be renewed for a further six months in order to enable the Council to further assess their implementation.

(5)

Decision 2014/512/CFSP should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The first subparagraph of Article 9(1) of Decision 2014/512/CFSP is replaced by the following:

‘1.   This Decision shall apply until 31 January 2017.’.

Article 2

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING DECISION (EU) 2016/1072

of 29 June 2016

terminating the anti-dumping proceeding concerning imports of certain ceramic foam filters originating in the People's Republic of China

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community (1), and in particular Article 9(1) thereof,

Whereas:

1.   PROCEDURE

(1)

On 14 August 2015, the European Commission (‘the Commission’) initiated an anti-dumping investigation with regard to imports into the Union of certain ceramic foam filters originating in the People's Republic of China (‘the PRC’) on the basis of Article 5 of Regulation (EC) No 1225/2009 (‘the basic Regulation’). It published a Notice of Initiation in the Official Journal of the European Union (2) (‘the Notice of Initiation’).

(2)

The Commission initiated the investigation following a complaint lodged on 1 July 2015 by Vesuvius GmbH (‘the complainant’). The complainant represents more than 25 % of the total Union production of the ceramic foam filters in question. The complaint contained evidence of dumping and of resulting material injury that was sufficient to justify the initiation of the investigation.

In the Notice of Initiation, the Commission invited interested parties to contact it in order to participate in the investigation. In addition, the Commission specifically informed the complainant, other known Union producers, the known exporting producers and the PRC's authorities, known importers, suppliers and users, traders, as well as associations known to be concerned about the initiation of the investigation and invited them to participate.

Interested parties had an opportunity to comment on the initiation of the investigation and to request a hearing with the Commission and/or the Hearing Officer in trade proceedings.

2.   WITHDRAWAL OF THE COMPLAINT AND TERMINATION OF THE PROCEEDING

By the letter of 8 March 2016 addressed to the Commission, the complainant withdrew its complaint.

(6)

In accordance with Article 9(1) of the basic Regulation, when the complainant withdraws its complaint, the proceeding may be terminated unless such termination would not be in the Union interest.

(7)

The Commission considered that the anti-dumping proceeding should be terminated since the investigation had not brought to light any consideration demonstrating that such termination would not be in the Union interest. Interested parties were informed accordingly and were given an opportunity to comment. The Commission received no comments which would lead to the conclusion that such termination would not be in the Union interest.

(8)

The Commission therefore concludes that the anti-dumping proceeding concerning imports into the Union of certain ceramic foam filters originating in the PRC should be terminated.

(9)

This Decision is in accordance with the opinion of the Committee established by Article 15(1) of the basic Regulation,

HAS ADOPTED THIS DECISION:

Article 1

The anti-dumping proceeding concerning imports into the Union of ceramic foam filters characterised by average porosity of up to 60 ppi (pores per inch) and by thermal shock resistance capable of withstanding the change of temperature caused by the passage of molten metal from ambient temperature to a minimum of 1 300 °C and made from ceramic material other than those:

of siliceous fossil meals or of similar siliceous earths, or

containing zirconia (zirconium dioxide ZrO2) in quantities greater than fifty percent by weight,

originating in the People's Republic of China and currently falling within CN codes ex 6903 10 00, ex 6903 20 10, ex 6903 20 90, ex 6903 90 10, ex 6903 90 90 and ex 6909 19 00 is hereby terminated.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING DECISION (EU) 2016/1073

of 1 July 2016

on the equivalence of designated contract markets in the United States of America in accordance with Regulation (EU) No 648/2012 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 648/2012 of the European Parliament and of the Council of 4 July 2012 on OTC derivatives, central counterparties and trade repositories (1), and in particular Article 2a(2) thereof,

Whereas:

(1)

Regulation (EU) No 648/2012 lays down clearing and bilateral risk-management requirements for over-the-counter (‘OTC’) derivative contracts as well as reporting requirements for such contracts. Point (7) of Article 2 of Regulation (EU) No 648/2012 defines OTC derivatives as derivative contracts the execution of which does not take place on a regulated market within the meaning of point (14) of Article 4(1) of Directive 2004/39/EC of the European Parliament and the of the Council (2) or on a third country market considered as equivalent to a regulated market in accordance with Article 2a of Regulation (EU) No 648/2012. Therefore, any derivative contract the execution of which takes place on a third country market not deemed equivalent to regulated markets are classified as OTC for the purposes of Regulation (EU) No 648/2012.

In accordance with Article 2a of Regulation (EU) No 648/2012, a third-country market is considered equivalent to a regulated market where it complies with legally binding requirements which are equivalent to the requirements laid down in Title III of Directive 2004/39/EC and is subject to effective supervision and enforcement in that third country on an ongoing basis.

(3)

In order for a third country market to be considered equivalent to a regulated market within the meaning of Directive 2004/39/EC, the substantive outcome of the applicable legally binding requirements and supervisory and enforcement arrangements should be equivalent to Union requirements in respect of the regulatory objectives they achieve. The purpose of this equivalence assessment is therefore to verify that the legally binding requirements which apply to designated contract markets (DCMs) in the United States of America (USA) are equivalent to the requirements laid down in Title III of Directive 2004/39/EC, and that those markets are subject to effective supervision and enforcement on an ongoing basis. Markets which are authorised as DCMs on the date of adoption of this Decision should be therefore identified as markets considered equivalent to a regulated market within the meaning of Directive 2004/39/EC.

DCMs are boards of trade that operate under the regulatory oversight of the Commodity Futures Trading Commission (the CFTC) pursuant to Section 5 of the Commodity Exchange Act (CEA), 7 USC 7. The legally binding requirements for DCMs authorised in the USA consist of the CEA, which together with the Commodity Futures Trading Commission's regulations (CFTC regulations) establish the legal framework for the operation of the DCM. Part 38 of the CFTC's regulations specifies the requirements for operating as a board of trade and sets out 23 core principles that DCMs must comply with on an initial and ongoing basis. The CFTC regulations require DCMs to operate a trading facility which generally, under the CEA, means a multilateral system in which participants have the ability to execute transactions in accordance with non-discretionary rules. DCMs must provide members with impartial access to their markets and services. The access criteria must be impartial, transparent, and applied in a non-discriminatory manner. In addition, CFTC regulations subject DCMs to organisational requirements with regards to conflicts of interest policy, risk management, trading and clearing and settlement arrangements, listing rules as well as monitoring of compliance. Under Core Principle 2 (17 CFR §38.150 (2015)) the board of trade must establish, monitor and enforce compliance with the internal rules of the DCM, including rules prohibiting abusive trade practices on it. To this end, it must have the capacity to detect, investigate and apply appropriate sanctions to any person that violates any internal rule of the DCM.

The legally binding requirements applicable to DCMs authorised in the USA which are set out in the legal framework for the operation of DCMs deliver substantial results equivalent to those of the requirements laid down in Title III of Directive 2004/39/EC in the following areas: authorisation process, definitional requirements, access to the DCM, organisational requirements, requirements for senior management, admission of derivatives to trading, suspension and removal of derivatives from trading, monitoring of compliance and access to clearing and settlement arrangements.

Under Directive 2004/39/EC, pre- and post-trade transparency requirements apply only to shares admitted to trading on regulated markets. As shares are neither traded nor admitted to trading on DCMs, the Commission considers that the assessment of those requirements is not relevant for the purposes of this Decision

It should therefore be concluded that the legally binding requirements for DCMs established in the USA deliver results equivalent to those of the requirements laid down in Title III of Directive 2004/39/EC.

(8)

The DCMs operate under the supervision of the CFTC. The primary objective of the CFTC's compliance programme is to evaluate DCM compliance with applicable provisions of the CEA, including the 23 core principles with which DCMs must comply, and CFTC regulations implementing those core principles. To this end, the CFTC conducts examinations of a DCM's compliance with core principles and regulations relating to trade surveillance, market surveillance, audit trail, and DCM disciplinary programmes. Under the market surveillance programme, the CFTC monitors traders to ensure that they comply with provisions in the CEA and CFTC regulations. To this end, the surveillance programme monitors trading activity on DCMs, futures positions, swap transactions and swap positions in order to detect and prevent market abusive practices and to ensure compliance with the CEA and CFTC regulations. In addition, the market review programme reviews all DCM rule filings and the product review programme reviews DCM product terms and conditions filings; both programmes review the filings to ensure consistency with the CEA and the CFTC's regulations.

The CFTC also has enforcement responsibilities. Under CEA Section 6b, the CFTC may issue an order directing the cessation of specified activities and impose civil or criminal penalties if a DCM is found to violate the CEA or the CFTC's regulations. Pursuant to CEA Section 6c(a)) the CFTC may also bring an action in US federal court against any registered entity or other person that violates provisions of the CEA as well as relevant CFTC rules, regulations and orders. DCMs assume certain supervisory responsibilities and are required to monitor and enforce compliance with the internal rules of each DCM. Under ‘emergency powers’ (CEA § 8a(9)) the CFTC is authorised to direct a DCM to take such action as, in the CFTC's judgment, is necessary to maintain or restore orderly trading in or liquidation of a given derivative contract. The DCMs are also required to have arrangements and resources for effective enforcement of its internal rules.

It should therefore be concluded that DCMs are subject to effective supervision and enforcement in the USA on an ongoing basis.

(11)

The conditions laid down in Article 2a of Regulation (EU) No 648/2012 should therefore be considered to be satisfied with respect to DCMs authorised in the USA.

(12)

This Decision is based on the legally binding requirements relating to DCMs applicable in the USA at the time of the adoption of this Decision. The Commission should continue monitoring on a regular basis the evolution of the legal and supervisory arrangements for DCMs and the fulfilment of the conditions on the basis of which this Decision has been taken. In particular, the Commission should review this Decision in light of the entry into application of Regulation (EU) No 600/2014 of the European Parliament and of the Council (3) and Directive 2014/65/EU of the European Parliament and of the Council (4).

(13)

The regular review of the legal and supervisory arrangements applicable to DCMs in the USA is without prejudice to the possibility of the Commission to undertake a specific review at any time where relevant developments make it necessary for the Commission to reassess the equivalence granted by this Decision. Such re-assessment could lead to the repeal of this Decision.

(14)

The measures provided for in this Decision are in accordance with the opinion of the European Securities Committee,

HAS ADOPTED THIS DECISION:

Article 1

For the purposes of point 7 of Article 2 of Regulation (EU) No 648/2012, the boards of trade designated by the Commodity Futures Trading Commission as contract markets in the United States of America and set out in the Annex shall be considered as equivalent to regulated markets as defined in point 14 of Article 4(1) of Directive 2004/39/EC.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

DECISION No 1/2016 OF THE EU-REPUBLIC OF MOLDOVA SANITARY AND PHYTOSANITARY SUB-COMMITTEE

of 1 June 2016

modifying Annex XXIV-B to the Association Agreement [2016/1074]

THE SANITARY AND PHYTOSANITARY SUB-COMMITTEE,

Having regard to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part (1), signed in Brussels on 27 June 2014, and in particular Article 181 and Article 191 thereof,

Whereas:

(1)

In accordance with Article 464(3) and (4) of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part (‘the Agreement’), parts of the Agreement, including the provisions on sanitary and phytosanitary measures, have been applied provisionally since 1 September 2014.

Article 181(1) of the Agreement provides that the Republic of Moldova is to gradually approximate its sanitary and phytosanitary and animal welfare law to that of the Union as set out in Annex XXIV to the Agreement.

(3)

Article 181(4) of the Agreement provides that the Republic of Moldova is to submit a list of Union acquis regarding sanitary, phytosanitary and animal welfare to which it intends to approximate its domestic legislation (‘the list’), no later than three months after the entry into force of the Agreement. The list is to serve as a reference document for the implementation of Chapter 4 (Sanitary and Phytosanitary Measures) of Title V (Trade and trade-related matters) of the Agreement.

Article 191 of the Agreement established the Sanitary and Phytosanitary Sub-Committee, which is to consider any matter related to Chapter 4 of Title V of the Agreement, including its implementation, and which may review and modify Annex XXIV to the Agreement.

The Republic of Moldova submitted the list to the European Commission in November 2014, following which, in consultation with the European Commission, it was finalised in July 2015.

(6)

It is appropriate that the Sanitary and Phytosanitary Sub-Committee takes a decision to modify Annex XXIV-B to the Agreement to include the list as set out in the Annex to this Decision,

HAS ADOPTED THIS DECISION:

Article 1

Annex XXIV-B to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and the Republic of Moldova, of the other part, is hereby modified as set out in the Annex to this Decision.

Article 2

This Decision shall enter into force on the day of its adoption.

Annex XXIV-B to the Agreement is replaced by the following:
