COUNCIL REGULATION (EU) 2016/73

of 18 January 2016

fixing for 2016 the fishing opportunities for certain fish stocks in the Black Sea

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 43(3) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

Article 43(3) of the Treaty provides that the Council, on a proposal from the Commission, is to adopt measures on the fixing and allocation of fishing opportunities.

(2)

Regulation (EU) No 1380/2013 of the European Parliament and of the Council (1) requires that conservation measures be adopted taking into account available scientific, technical and economic advice, including, where relevant, reports drawn up by the Scientific, Technical and Economic Committee for Fisheries (STECF) and other advisory bodies, as well as in the light of any advice received from Advisory Councils.

(3)

It is incumbent upon the Council to adopt measures on the fixing and allocation of fishing opportunities by fishery or group of fisheries in the Black Sea, including certain conditions functionally linked thereto, as appropriate. In accordance with Article 16(4) of Regulation (EU) No 1380/2013, fishing opportunities should be fixed in accordance with the objectives of the common fisheries policy established in Article 2(2) of that Regulation. In accordance with Article 16(1) of that Regulation, fishing opportunities should be allocated to Member States in such a way as to ensure the relative stability of fishing activities of each Member State for each stock or fishery.

(4)

The total allowable catches (TACs) should therefore be established, in line with Regulation (EU) 1380/2013, on the basis of the available scientific advice, taking into account biological and socioeconomic aspects whilst ensuring fair treatment between fishing sectors, as well as in the light of the opinions expressed during the consultation of stakeholders.

(5)

The use of fishing opportunities set out in this Regulation is subject to Council Regulation (EC) No 1224/2009 (2) and in particular to Articles 33 and 34 thereof concerning the recording of catches and the notification of data on the exhaustion of fishing opportunities. It is therefore necessary to specify the codes to be used by the Member States when sending data to the Commission relating to landings of stocks subject to this Regulation.

(6)

In accordance with Article 2 of Council Regulation (EC) No 847/96 (3), when fixing the TACs, the Council is to decide to which stocks Articles 3 and 4 do not apply, in particular on the basis of the biological status of the stocks.

(7)

In order to avoid interruption of fishing activities and to ensure the livelihood of Union fishermen, this Regulation should apply from 1 January 2016. For reasons of urgency, this Regulation should enter into force immediately after its publication,

HAS ADOPTED THIS REGULATION:

COMMISSION REGULATION (EU) 2016/75

of 21 January 2016

amending Annex III to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for fosetyl in or on certain products

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (1), and in particular Article 14(1)(a) and Article 16(1)(a) thereof,

Whereas:

(1)

For fosetyl, maximum residue levels (MRLs) were set in Part A of Annex III to Regulation (EC) No 396/2005.

(2)

The residue definition for monitoring applicable to fosetyl comprises the parent compound fosetyl, the degradation product phosphorous acid and their salts. Salts of phosphorous acid are named phosphonates.

(3)

Commission Regulation (EU) No 991/2014 (2) amended Annex III to Regulation (EC) No 396/2005, setting temporary MRLs for fosetyl to avoid significant market disruptions in the trade of certain products. Those temporary MRLs were based on the available monitoring data and on a statement (3) of the European Food Safety Authority, hereinafter ‘the Authority’, in which it concluded that the proposed temporary MRLs are expected to sufficiently protect consumers.

(4)

Some temporary MRLs set by Regulation (EU) No 991/2014 apply only until 31 December 2015, after which the previous MRL of 2 mg/kg corresponding to the limit of determination should be applicable, as it was expected that by then the measures foreseen to prevent the occurrence of phosphonate residues in relevant crops in future growing seasons would take effect. However, the Commission received information from food business operators showing that for certain products belonging to the group of tree nuts, the period provided was insufficient for those measures to take effect. Monitoring data indicate the continued presence of phosphonates in or on those products at levels higher than 2 mg/kg.

(5)

Trading partners of the Union informed the Commission of ongoing efforts and timetables to generate supervised residue trial data with a view to submitting an application concerning MRLs for products belonging to the group of tree nuts according to Article 6(2) and (4) of Regulation (EC) No 396/2005.

(6)

To avoid significant market disruptions in the trade of the concerned products belonging to the group of tree nuts and as there is no risk for consumers identified from the current scientific data, it is appropriate to change the end date of applicability of those temporary MRLs for fosetyl. Those temporary MRLs should apply until an application for MRLs according to Article 6(2) and (4) of Regulation (EC) No 396/2005 has been evaluated and decided upon. Taking into account the information received on ongoing supervised residue trials and the planned submission of such an application, the entry into force of a decision on that application is expected not later than 1 March 2019.

(7)

Based on the statement of the Authority and taking into account the factors relevant to the matter under consideration, the appropriate modification to the MRL fulfils the requirements of Article 14(2) of Regulation (EC) No 396/2005.

(8)

Regulation (EC) No 396/2005 should therefore be amended accordingly.

(9)

MRLs for several products, including certain products belonging to the group of tree nuts, were modified by Regulation (EU) No 991/2014, with 31 December 2015 as the end date of applicability of those temporary MRLs. For those products belonging to the group of tree nuts, this Regulation sets MRLs at the same level as provided for in Regulation (EU) No 991/2014 for an additional period. In the interest of legal certainty, this Regulation should therefore apply from 1 January 2016.

(10)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Annex III to Regulation (EC) No 396/2005 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2016.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Done at Brussels, 21 January 2016.

L 16/23

COUNCIL DECISION (EU) 2016/77

of 18 January 2016

confirming the position taken on behalf of the European Union within the 10th Ministerial Conference of the World Trade Organization as regards export competition and development issues

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Articles 91, 100 and 207(4), in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Union attaches paramount importance to the functioning and progressive strengthening of the multilateral trading system. In this regard, whilst the Union had aimed for a comprehensive outcome in relation to the Doha Round at the 10th Ministerial Conference of the World Trade Organization (WTO) in Nairobi, WTO Members only reached consensus on a more limited set of issues: export competition in agriculture and development issues of particular interest to those WTO Members recognised as least-developed countries (LDCs).

(2)

Disciplining the use of agricultural export support measures is a long-standing request from many WTO Members interested in providing a level playing field for traders and is a key element of the Doha Round. The aim of the Union at the 10th Ministerial Conference of the WTO was to achieve a comprehensive and balanced outcome with regard to all forms of export support in agriculture (i.e. export subsidies, export credits, agricultural exporting state trading enterprises and food aid), not limited to export subsidies only, in line with the WTO's draft agricultural modalities (TN/AG/W/4/Rev.4) as updated by the joint proposal of the Union and a number of countries dated 16 November 2015 (JOB/AG/48).

(3)

Development is at the heart of the Doha Round of trade negotiations and several issues, including the implementation of preferential treatment in favour of LDC service-suppliers, preferential rules of origin for LDCs and cotton, have been the subject of active negotiations in the WTO.

(4)

The Decision on preferential rules of origin for least-developed countries taken at the ninth Ministerial Conference of the WTO in Bali (WT/MIN(13)/42) provides that preferential rules of origin should be as transparent, simple and objective as possible. The proposal submitted by the LDC Group (JOB/TNC/53) aimed at achieving binding outcomes in all the areas covered by that Decision. Taking into account the Union's existing unilateral scheme concerning preferential rules of origin, at the 10th Ministerial Conference of the WTO the Union supported those outcomes, which do not go beyond the current ambitious set of preferential rules in the Union and are binding for all WTO Members.

(5)

The position taken on behalf of the Union within the 10th Ministerial Conference of the WTO as regards export competition and development issues needs to be confirmed,

HAS ADOPTED THIS DECISION:

Article 1

The position taken on behalf of the Union within the 10th Ministerial Conference of the WTO regarding the WTO Decisions on export competition (WT/MIN(15)/45) and development issues (WT/MIN(15)/46, WT/MIN(15)/47, WT/MIN(15)/48) is hereby confirmed.

Article 2

This Decision shall enter into force on the date of its adoption.

Done at Brussels, 18 January 2016.

The President

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 31(2) thereof,

Having regard to Council Decision 2010/413/CFSP of 26 July 2010 concerning restrictive measures against Iran (1), and in particular Article 23(1) thereof,

Having regard to the proposal of the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 26 July 2010, the Council adopted Decision 2010/413/CFSP concerning restrictive measures against Iran.

(2)

On 17 January 2016, the United Nations Security Council (UNSC) removed two entities from the list of persons and entities subject to the measures imposed by points (c) and (d) of paragraph 6 of Annex B to UNSC Resolution 2231(2015).

(3)

The restrictive measures against those two entities, currently listed in Annex I to Decision 2010/413/CFSP, should therefore be suspended.

(4)

HAS ADOPTED THIS DECISION:
