COUNCIL REGULATION (EU) 2015/1776

repealing Regulation (EC) No 872/2004 concerning further restrictive measures in relation to Liberia

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215 thereof,

Having regard to Council Common Position 2004/487/CFSP of 29 April 2004 concerning further restrictive measures in relation to Liberia (1),

Having regard to the joint proposal of the High Representative of the Union for Foreign Affairs and Security Policy and of the European Commission,

Whereas:

(1)	Council Regulation (EC) No 872/2004 (2) provides for the freezing of funds and economic resources of the natural and legal persons, bodies and entities listed in the Annex to that Regulation.

(2)

On 5 October 2015, the Council adopted Decision (CFSP) 2015/1782 (3) implementing United Nations Security Council Resolution 2237 (2015) of 2 September 2015 which terminated the travel ban and asset freeze measures imposed by paragraph 4 of UNSCR 1521 (2003) and paragraph 1 of UNSCR 1532 (2004), respectively.

(3)	It is therefore appropriate to repeal Regulation (EC) No 872/2004 with immediate effect,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EC) No 872/2004 is repealed.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EU) No 208/2014 of 5 March 2014 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Ukraine (1), and in particular Article 14(1) thereof,

Whereas:

(1)	On 5 March 2014, the Council adopted Regulation (EU) No 208/2014.

(2)	On the basis of a review by the Council, the entry for one person should be amended.

(3)	Annex I to Regulation (EU) No 208/2014 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EU) No 208/2014 shall be amended as set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing fisheries conservation measures to protect reef zones in waters under the sovereignty of Denmark in the Baltic Sea and Kattegat

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on the Common Fisheries Policy, amending Council Regulations (EC) No 1954/2003 and (EC) No 1224/2009 and repealing Council Regulations (EC) No 2371/2002 and (EC) No 639/2004 and Council Decision 2004/585/EC (1), and in particular Article 11 thereof,

Having regard to joint recommendation by Denmark, Germany and Sweden,

Whereas:

(1)

Pursuant to Article 11 of Regulation (EU) No 1380/2013, Member States are empowered to adopt fisheries conservation measures in their waters that are necessary for the purpose of complying with their obligations under Union environmental legislation, including Article 6 of Council Directive 92/43/EEC (2).

(2)

Article 6 of Directive 92/43/EEC requires Member States to establish the necessary conservation measures for Special Areas of Conservation that correspond to the ecological requirements of natural habitat types and species present on the sites. It also requires Member States to take appropriate steps to avoid, in the special areas of conservation, the deterioration of natural habitats and the habitats of species as well as significant disturbance of the species for which the areas have been designated.

(3)

Denmark considers that, for the purpose of complying with Article 6 of Directive 92/43/EEC, conservation measures need to be adopted in certain areas under its sovereignty in the Kattegat and the Baltic Sea. If necessary fisheries conservation measures affect the fishery of other Member States, the Member States may submit these measures in joint recommendations to the Commission.

Germany and Sweden have a direct management interest in the fishery to be affected by such measures. In accordance with Article 11(3) of Regulation (EU) No 1380/2013, Denmark provided Germany and Sweden with relevant information on the measures required, including their rationale, scientific evidence in support and details on their practical implementation and enforcement.

On 13 March 2015 Denmark, Germany and Sweden submitted to the Commission two joint recommendations for fisheries conservation measures to protect reef structures in Danish Natura 2000 sites. Those recommendations were submitted after having consulted stakeholders, the Baltic Sea Advisory Council and North Sea Advisory Council

(6)	The recommended measures concern seven Natura 2000 sites in the Baltic Sea and three sites in the Kattegat. They comprise the prohibition of fishing activities with mobile bottom contacting gear in reef zones and the prohibition of all fishing activities in bubbling reef zones.

(7)

In its scientific advice, the Scientific, Technical and Economic Committee on Fisheries (‘STECF’) (3) states that the conservation objectives within the special areas referred to in the joint recommendations cannot be fully achieved without appropriate measures to prevent fishing activity in the areas.

(8)

Bottom fishing activity with mobile bottom contacting gear has a negative impact on reef habitats, as such activity affects both the reef structures and the biodiversity found at the reefs. Therefore the prohibition to fish with such gears in the relevant reef areas, as set out in the joint recommendations, should be included in this Regulation.

(9)	Bubbling reefs are especially fragile structures and any physical impact is a threat to their conservation status. Accordingly, the prohibition of all fishing activities in the relevant bubbling reef areas, as set out in the joint recommendations, should be included in this Regulation.

(10)

STECF identifies some concerns as regards the control and enforcement of the conservation measures and considers that additional control measures may be appropriate. In accordance with Article 5 of Council Regulation (EC) No 1224/2009 (4). Member States are required to adopt appropriate measures, allocate adequate resources and set up the structures necessary for ensuring control, inspection and enforcement of activities carried out within the scope of the common fisheries policy (CFP). This may include measures such as the requirement of submitting VMS positions with increased frequency by all vessels concerned or identifying the areas as high risk in the national control system based on risk management, addressing the concerns of STECF.

(11)	It is appropriate to ensure the assessment of the measures established by this Regulation, in particular as regards the control of compliance with fishing prohibitions.

(12)	The fisheries conservation measures established by this Regulation are without prejudice of any other existing or future management measures aiming at the conservation of the sites concerned, including fisheries conservation measures,

HAS ADOPTED THIS REGULATION:

Article 1

Subject matter and scope

1. This Regulation establishes fisheries conservation measures necessary for compliance with obligations under Article 6 of Directive 92/43/EEC.

2. This Regulation applies to fishing vessels flying the flag of Denmark, Germany and Sweden (‘the Member States concerned’) in waters under the sovereignty of Denmark in the Baltic Sea and Kattegat.

Article 2

Definitions

For the purposes of this Regulation, in addition to those laid down in Article 4 of Regulation (EU) No 1380/2013 and Article 2 of Commission Implementing Regulation (EU) No 404/2011 (5), the following definitions shall apply:

(a)	‘bottom contacting gear’ means any of the following gear: bottom trawl, beam trawl, bottom otter trawl, otter twin trawl, bottom pair trawl, nephrops trawl, shrimp trawl, seine net, Danish anchor seine, Scottish seine, boat or vessel seine and dredge;

(b)	‘Areas 1’ mean the geographical areas enclosed by sequentially joining with rhumb lines the positions listed in Annex I to this Regulation, which shall be measured according to the WGS84 coordinate system;

(c)	‘Areas 2’ mean the geographical areas enclosed by sequentially joining with rhumb lines the positions listed in Annex II to this Regulation, which shall be measured according to the WGS84 coordinate system.

Article 3

Fishing prohibition

1. It shall be prohibited to carry out any fishing activity with bottom contacting gears in Areas 1.

2. It shall be prohibited to carry out any fishing activity in Areas 2.

3. Fishing vessels carrying on board any bottom contacting gear may carry out fishing activities in Areas 1 with gears other than those gears and may transit across Areas 1, provided that the bottom contacting gears be lashed and stowed in accordance with the conditions laid down in Article 47 of Regulation (EC) No 1224/2009.

4. Fishing vessels may transit across Areas 2, provided that any gear carried on board be lashed and stowed in accordance with the conditions laid down in Article 47 of (EC) No 1224/2009.

Article 4

Assessment

1. Member States concerned shall assess the implementation of the measures set out in Article 3 at latest 18 months after the entry into force of this Regulation, including the control of compliance with the fishing prohibitions provided for in Article 3.

2. Member States concerned shall submit a summary report of the assessment to the Commission 19 months after the entry into force of this Regulation.

Article 5

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2016.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1),

Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,

Whereas:

(1)

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto.

(2)

The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Decision 2012/392/CFSP on the European Union CSDP mission in Niger (EUCAP Sahel Niger)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 28, Article 42(4) and Article 43(2) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 16 July 2012, the Council adopted Decision 2012/392/CFSP (1).

(2)	On 22 July 2014, the Council adopted Decision 2014/482/CFSP (2) which extended the application of Decision 2012/392/CFSP until 15 July 2016 and provided a financial reference amount until 15 July 2015.

(3)

On 13 July 2015, the Council adopted Decision (CFSP) 2015/1141 (3) which provided a financial reference amount until 15 July 2016. The Council underlined in that Decision that the financial reference amount would be revised within 3 months of the adoption of that Decision, taking into account the further operational planning concerning the two-pronged approach combining enhanced engagement in Niamey with a permanent presence in Agadez.

(4)	In view of the further operational planning the financial reference amount for the period from 16 July 2015 to 15 July 2016 should be revised.

(5)	EUCAP Sahel Niger will be conducted in the context of a situation which may deteriorate and could impede the achievement of the objectives of the Union's external action as set out in Article 21 of the Treaty on European Union,

HAS ADOPTED THIS DECISION:

Article 1

In Article 13 of Decision 2012/392/CFSP, paragraphs 1 and 2 are replaced by the following:

‘1. The financial reference amount intended to cover the expenditure related to EUCAP Sahel Niger for the period from 16 July 2012 to 31 October 2013 shall be EUR 8 700 000.

The financial reference amount to cover the expenditure related to EUCAP Sahel Niger for the period from 1 November 2013 to 15 July 2014 shall be EUR 6 500 000.

The financial reference amount to cover the expenditure related to EUCAP Sahel Niger for the period from 16 July 2014 to 15 July 2015 shall be EUR 9 155 000.

The financial reference amount to cover the expenditure related to EUCAP Sahel Niger for the period from 16 July 2015 to 15 July 2016 shall be EUR 18 400 000.

2. All expenditure shall be managed in accordance with the rules and procedures applicable to the general budget of the Union. Participation of natural and legal persons in the award of procurement contracts by EUCAP Sahel Niger shall be open without limitations. Moreover, no rule of origin for the goods purchased by EUCAP Sahel Niger shall apply.’.

Article 2

This Decision shall enter into force on the date of its adoption.

amending Decision 2014/119/CFSP concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 5 March 2014, the Council adopted Decision 2014/119/CFSP (1).

(2)	On 5 March 2015, the Council adopted Decision (CFSP) 2015/364 (2), which provided that the restrictive measures set out in Decision 2014/119/CFSP should apply until 6 March 2016 in respect of 14 persons and until 6 June 2015 in respect of four persons.

(3)	On 5 June 2015, the Council adopted Decision (CFSP) 2015/876 (3), which inter alia provided that in respect of one of those four persons, the application of the restrictive measures should be extended until 6 October 2015 and that the statement of reasons relating to him was to be updated.

(4)	In respect of that person, the application of restrictive measures should be extended until 6 March 2016 and the statement of reasons relating to him should be updated.

(5)	Decision 2014/119/CFSP should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Article 5 of Decision 2014/119/CFSP is replaced by the following:

‘Article 5

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

This Decision shall apply until 6 March 2016.

This Decision shall be kept under constant review. It shall be renewed, or amended as appropriate, if the Council deems that its objectives have not been met.’.

Article 2

The Annex to Decision 2014/119/CFSP shall be amended as set out in the Annex to this Decision.

Article 3

This Decision shall enter into force on the date of its publication in the Official Journal of the European Union.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal of the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)	On 29 April 2004, the Council adopted Common Position 2004/487/CFSP (1) providing for certain financial measures.

(2)	On 12 February 2008, the Council adopted Common Position 2008/109/CFSP (2) providing for travel restrictions and an arms embargo.

(3)	On 9 December 2014, the United Nations Security Council adopted UNSCR 2188 (2014) with regard to Liberia, extending the measures on travel and the arms embargo for a period of nine months.

(4)

On 2 September 2015 the United Nations Security Council adopted UNSCR 2237 (2015) with regard to Liberia, terminating the travel and financial measures set out in paragraph 4 of UNSCR 1521 (2003) and paragraph 1 of UNSCR 1532 (2004) and renewing the arms embargo with regard to all non-governmental entities and individuals operating in the territory of Liberia until 2 June 2016.

(5)	Common Position 2008/109/CFSP should therefore be amended accordingly and Common Position 2004/487/CFSP should be repealed.

(6)	Further action by the Union is needed in order to implement certain measures,

HAS ADOPTED THIS DECISION:

Article 1

Article 3 of Common Position 2008/109/CFSP is hereby deleted.

Article 2

Article 4 of Common Position 2008/109/CFSP shall be renumbered Article 3.

Article 5 of Common Position 2008/109/CFSP shall be renumbered Article 4.

Article 3

Common Position 2004/487/CFSP is hereby repealed.

Article 4

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,

Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,

Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,

Whereas:

Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine fever in certain Member States. The Annex to that Decision demarcates and lists certain areas of those Members States differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Italy, Latvia, Lithuania and Poland.

(2)

In September 2015, one case of African swine fever in wild boar and one outbreak in pigs were notified by Estonia within the areas listed in the Annex to Implementing Decision 2014/709/EU. The case in wild boar occurred in Part I of that Annex and the outbreak in pigs occurred in Part III in proximity of Part II of that Annex.

(3)

The evolution of the current epidemiological situation in the Union as regards African swine fever should be considered in the assessment of the risk represented by the animal health situation as regards that disease in Estonia. In order to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take into account the current animal health situation as regards that disease in those Member States.

(4)	Implementing Decision 2014/709/EU should therefore be amended accordingly.

(5)	The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

The Annex to Implementing Decision 2014/709/EU is replaced by the text in the Annex to this Decision.

Article 2

This Decision is addressed to the Member States.

COMMISSION IMPLEMENTING DECISION (EU) 2015/1784

of 2 October 2015

amending Annex II to Decision 2003/467/EC as regards the declaration of the region of Northern Ireland of the United Kingdom as officially brucellosis-free as regards bovine herds

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 64/432/EEC of 26 June 1964 on animal health problems affecting intra-Community trade in bovine animals and swine (1), and in particular paragraph 7 of Annex A.II. thereto,

Whereas:

(1)	Directive 64/432/EEC applies to trade within the Union in bovine animals. It lays down the conditions whereby a region of a Member State may be declared officially brucellosis-free as regards bovine herds.

(2)

Chapter 2 of Annex II to Commission Decision 2003/467/EC (2) lists the regions of Member States which are declared officially brucellosis-free as regards bovine herds. In the entry for the United Kingdom of that Chapter the regions England, Scotland and Wales and also the Isle of Man are already listed.

(3)

The United Kingdom has submitted to the Commission documentation demonstrating compliance for the region of Northern Ireland with the conditions laid down in Directive 64/432/EEC for officially brucellosis-free status as regards bovine herds. Accordingly, it should be declared an officially brucellosis-free region as regards bovine herds.

(4)	The list set out in Chapter 2 of Annex II to Decision 2003/467/EC should therefore be amended to include Northern Ireland.

(5)	The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS DECISION:

Article 1

Annex II to Decision 2003/467/EC is amended in accordance with the Annex to this Decision.

Article 2

This Decision is addressed to the Member States.
