COMMISSION IMPLEMENTING REGULATION (EU) No 902/2014

of 19 August 2014

amending Council Regulation (EC) No 1415/2004 as regards the adaptation for the United Kingdom of the maximum annual fishing effort in certain fishing areas

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1954/2003 of 4 November 2003 on the management of the fishing effort relating to certain Community fishing areas and resources (1), and in particular Article 12(1) thereof,

Whereas:

Regulation (EC) No 1954/2003 provides for the adoption of a Regulation fixing the maximum annual fishing effort for each Member State and for each area and fishery defined in Articles 3 and 6 of that Regulation. Accordingly, Council Regulation (EC) No 1415/2004 (2) established the maximum annual fishing effort for those fishing areas and fisheries.

According to Article 12(1) of Regulation (EC) No 1954/2003 the Commission may, upon request of a Member State, shift the fishing effort between areas or divisions in order to allow the Member State to fully take up its fishing possibilities.

(3)

On 2 June 2014, the United Kingdom requested the Commission to transfer 30 000 kW days from ICES area VII to ICES area VIII. On 16 June 2014, the United Kingdom submitted additional information on the utilisation of quotas and the operation of vessels in ICES area VIII. The information provided by the United Kingdom warrants the requested shift of fishing effort between the areas concerned.

Regulation (EC) No 1415/2004 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Committee for Fisheries and Aquaculture,

HAS ADOPTED THIS REGULATION:

Amendment to Regulation (EC) No 1415/2004

In Annex I to Regulation (EC) No 1415/2004, the column regarding maximum annual fishing effort for demersal species for the United Kingdom in Table A ‘Demersal species excluding those covered by Regulation (EC) No 2347/2002’, is replaced by the following:

Article 2

Entry into force

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) No 903/2014

of 19 August 2014

establishing the standard import values for determining the entry price of certain fruit and vegetables

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),

Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,

Whereas:

(1)

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto.

(2)

The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

DECISION OF THE EUROPEAN CENTRAL BANK

of 13 August 2014

on the identification of TARGET2 as a systemically important payment system pursuant to Regulation (EU) No 795/2014 on oversight requirements for systemically important payment systems

THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 127(2) thereof,

Having regard to the Statute of the European System of Central Banks and of the European Central Bank, and in particular Article 3.1, Article 22 and the first indent of Article 34.1 thereof,

Having regard to Regulation (EU) No 795/2014 of the European Central Bank of 3 July 2014 on oversight requirements for systemically important payment systems (ECB/2014/28) (1), and in particular Article 1(2) and (3) thereof,

Whereas:

The fourth indent of Article 127(2) of the Treaty and the fourth indent of Article 3.1 of the Statute of the European System of Central Banks and of the European Central Bank (hereinafter the ‘Statute of the ESCB’) empower the Eurosystem to promote the smooth operation of payment systems.

(2)

The Eurosystem promotes the smooth operation of payment systems, inter alia, by conducting oversight.

(3)

The European Central Bank (ECB) has implemented the principles for financial market infrastructures issued by the Committee on Payment and Settlement Systems (CPSS) of the Bank for International Settlements (BIS) and the Technical Committee of the International Organization of Securities Commissions (IOSCO) (hereinafter the ‘CPSS-IOSCO principles’), which harmonise and strengthen existing international oversight standards for, inter alia, systemically important payment systems (SIPS), by means of Regulation (EU) No 795/2014 (ECB/2014/28).

In order to carry out the identification exercise pursuant to Article 1(2) of Regulation (EU) No 795/2014 (ECB/2014/28) for TARGET2, the Governing Council is verifying that the criterion mentioned in point (a) of Article 1(3) of Regulation (EU) No 795/2014 (ECB/2014/28) is fulfilled, and two out of four of the criteria mentioned in point (b) of Article 1(3) of Regulation (EU) No 795/2014 (ECB/2014/28) are fulfilled, as described in the Annex to this Decision. For the verification exercise on which this Decision is based, public data for the calendar year 2012 has been used, combined with responses to ECB surveys.

Under Guideline ECB/2012/27 (2) TARGET2 has a decentralised structure linking together a multiplicity of payment systems. The TARGET2 component systems are harmonised to the greatest extent possible, with certain exceptions in the event of national law constraints. TARGET2 is also characterised by a single technical platform called the Single Shared Platform. The Governing Council has final competence in relation to TARGET2 and safeguards its public function: this governance arrangement is reflected in the oversight of TARGET2 component systems,

HAS ADOPTED THIS DECISION:

Article 1

Definitions

Terms used in this Decision have the same meaning as those in Regulation (EU) No 795/2014 (ECB/2014/28).

Article 2

Identification of SIPS and SIPS operator

1.   TARGET2 component systems fulfilling the criterion of Article 1(3)(a) of Regulation (EU) No 795/2014 (ECB/2014/28) shall collectively be identified as a systemically important payment system for the purposes of Regulation (EU) No 795/2014 (ECB/2014/28).

2.   Operators of the TARGET2 component systems referred to in paragraph 1 shall ensure compliance with the requirements set out in Articles 3 to 21 of Regulation (EU) No 795/2014 (ECB/2014/28).

Article 3

Competent authority

The ECB shall be the competent authority for the oversight of TARGET2.

Article 4

Entry into force

This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

DECISION No 2/2014 OF THE ACP-EU COMMITTEE OF AMBASSADORS

appointing the members of the Executive Board of the Centre for the Development of Enterprise (CDE)

THE ACP-EU COMMITTEE OF AMBASSADORS,

Having regard to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (1), as first amended in Luxembourg on 25 June 2005 (2) and as amended for the second time in Ouagadougou on 22 June 2010 (3), and in particular Article 2(6) of Annex III thereof,

Having regard to Decision No 8/2005 of the ACP-EC Committee of Ambassadors of 20 July 2005 on the Statutes and rules of procedure of the Centre for the Development of Enterprise (4) (CDE), and in particular Article 9(1) thereof,

Whereas:

Article 9 of the Statutes and rules of procedure of the Centre for the Development of Enterprise (CDE), adopted by Decision No 8/2005 of the ACP EC Committee of Ambassadors, provides that the Committee of Ambassadors shall appoint the members of the Executive Board, for a maximum period of five years.

(2)

The term of office of the three EU members of the Executive Board of the Centre for the Development of Enterprise, appointed by Decision No 3/2013 of the ACP EU Committee of Ambassadors (5), which was extended by Decision No 1/2014 of the ACP-EU Committee of Ambassadors (6), will expire on 6 September 2014,

HAS DECIDED AS FOLLOWS:

Article 1

Without prejudice to any subsequent decisions that the Committee might have to take under its prerogatives, the following are hereby appointed members of the Executive Board of the Centre for the Development of Enterprise:
