COMMISSION IMPLEMENTING REGULATION (EU) No 288/2014
of 25 February 2014
laying down rules pursuant to Regulation (EU) No 1303/2013 of the European Parliament and of the Council laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund and laying down general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Fisheries Fund with regard to the model for operational programmes under the Investment for growth and jobs goal and pursuant to Regulation (EU) No 1299/2013 of the European Parliament and of the Council on specific provisions for the support from the European Regional Development Fund to the European territorial cooperation goal with regard to the model for cooperation programmes under the European territorial cooperation goal
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund and laying down general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Fisheries Fund and repealing Council Regulation (EC) No 1083/2006 (1), and in particular Article 96(9) thereof,
Having regard to Regulation (EU) No 1299/2013 of the European Parliament and of the Council on specific provisions for the support from the European Regional Development Fund to the European territorial cooperation goal (2), and in particular Article 8(11) thereof,
After consulting the Coordination Committee for the European Structural and Investment Funds established by Article 150(1) of Regulation (EU) No 1303/2013,
Whereas:
(1) |
It is necessary to lay down two models, one for operational programmes under the Investment for growth and jobs goal and one for cooperation programmes under the European territorial cooperation goal. Each model will set out uniform conditions for the presentation of information in each section of the operational or cooperation programmes. This is necessary to ensure that information is consistent, comparable and, where necessary, can be aggregated. |
(2) |
The provisions in this Regulation are closely linked, since they deal with provisions concerning the content of programmes under cohesion policy. To ensure coherence between those provisions, which should enter into force at the same time, and to facilitate a comprehensive view and compact access to them by all Union residents, it is desirable to include the provisions setting out the models for programmes under cohesion policy to be established by implementing acts required by Regulation (EU) No 1303/2013 and Regulation (EU) No 1299/2013 in a single Regulation. |
(3) |
The models will form the basis for the development of the electronic data exchange system referred to in Article 74(4) of Regulation (EU) No 1303/2013 as regards the content and submission of operational programmes and cooperation programmes. They should therefore establish the manner in which data on operational programmes and cooperation programmes will be entered into the system for electronic data exchange. However, this should not affect the final presentation of operational programmes and cooperation programmes, including the layout of text and tables, since the electronic data exchange system is to allow for different structuring and presentation of the data that has been entered in this system. |
(4) |
The model for operational programmes should correspond to the structure of the operational programme set out in Article 96 of Regulation (EU) 1303/2013 and the model for cooperation programmes should correspond to the structure of the cooperation programme set out in Article 8 of Regulation (EU) No 1299/2013. In order to ensure consistent conditions for the entry of data, the models should establish the technical characteristics of each field in the electronic data exchange system. In addition to the structured data, the models should provide for the option to submit unstructured information in the form of compulsory or non-compulsory annexes. For such annexes it is not necessary to establish technical characteristics. |
(5) |
To ensure the correct application of Regulation (EU) No 1303/2013 and of Regulation (EU) No 1299/2013 the models should identify information which is subject to a Commission implementing decision approving the programme. In addition, the model for the operational programmes under the Investment in growth and jobs goal should also identify elements which may be presented in the Partnership Agreement only, in accordance with Article 96(8) of Regulation (EU) No 1303/2013. |
(6) |
It is also necessary to specify sections of the model for operational programmes under the Investment in growth and jobs goal which should not be completed by the Member States if operational programmes are dedicated exclusively to technical assistance or to the Youth Employment Initiative as referred to in Article 16 of Regulation (EU) No 1304/2013 of the European Parliament and of the Council (3). As the content requirements for the operational programmes dedicated to joint uncapped guarantee and securitization financial instruments in favour of micro, small and medium-sized enterprises as defined in Commission Recommendation 2003/361/EC (4) and implemented by the European Investment Bank represent a subset of the requirements for the content of other programmes under the Investment in growth and jobs goal, it is necessary to identify the fields of the respective model which should be included in such dedicated programmes. |
(7) |
In order to allow for the prompt application of the measures provided for in this Regulation, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS REGULATION:
Article 1
1. The model for preparing operational programmes under the Investment for growth and jobs goal is set out in Annex I to this Regulation.
2. The model for preparing cooperation programmes under the European territorial cooperation goal is set out in Annex II to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
Done at Brussels, 25 February 2014.

(11) This list includes common result indicators for which a target value has been set and all programme-specific result indicators. Target values for common result indicators must be quantified; for programme-specific result indicators, they may be qualitative or quantitative. Target values may be presented as a total (men+women) or broken down by gender, the baseline values can be adjusted accordingly. ‘M’ = men, ‘W’=women, ‘T’= total.
(12) Regulation (EU) No 1304/2013 of the European Parliament and of the Council of 17 December 2013 on the European Social Fund and repealing Council Regulation (EC) No 1081/2006 (OJ L 347, 20.12.2013, p. 470).
(13) This list includes common result indicators for which a target value has been set and all programme-specific result indicators. Target values for common result indicators must be quantified; for programme-specific result indicators they may be qualitative or quantitative. All result indicators in Annex II to Regulation (EU) No 1304/2013 used to monitor YEI implementation must be linked to a quantified target value. Target values may be presented as a total (men+women) or broken down by gender, the baseline values may be adjusted accordingly. ‘M’ = men, ‘W’=women, ‘T’= total.
(14) For the ESF, this list includes common output indicators for which a target value has been set. Target values may be presented as a total (men+women) or broken down by gender. For the ERDF and the Cohesion Fund, gender breakdown is in most cases not relevant. ‘M’ = men, ‘W’=women, ‘T’= total.
(15) Only for programmes supported by the ESF.
(16) For the ESF, this list includes common output indicators for which a target value has been set and all programme-specific output indicators.
(17) Where YEI is implemented as part of a priority axis, YEI milestones and targets must be distinguished from other milestones and targets for the priority axis in accordance with implementing acts referred to in the fifth subparagraph of Article 22(7) of Regulation (EU) No 1303/2013, as YEI resources (specific allocation and matching ESF support) are excluded from the performance reserve.
(18) Milestones may be presented as a total (men+women) or broken down by gender. ‘M’ = men, ‘W’=women, ‘T’= total.
(19) Target values may be presented as a total (men+women) or broken down by gender. ‘M’ = men, ‘W’=women, ‘T’= total.
(20) Amounts include total Union support (the main allocation and the allocation from the performance reserve).
(21) Include, where appropriate, quantified information on the ESF’s contribution to the thematic objectives referred to in points (1) to (7) of the first paragraph of Article 9 of Regulation (EU) No 1303/2013.
(22) Required where Union support for technical assistance in the programme exceeds EUR 15 million.
(23) Required where objectively justified given the content of the action and where Union support for technical assistance in the programme exceeds EUR 15 million.
(24) Target values may be qualitative or quantitative. Target values may be presented as a total (men+women) or broken down by gender, the baseline values may be adjusted accordingly. ‘M’ = men, ‘W’=women, ‘T’= total.
(25) Target values for output indicators under technical assistance are optional. Target values may be presented as a total (men+women) or broken down by gender. ‘M’ = men, ‘W’=women, ‘T’= total.
(26) Amounts include total Union support (the main allocation and the allocation from the performance reserve).
(27) Total allocation (Union support) less allocation to performance reserve.
(28) Total allocation from the ESF, including matching ESF support for YEI. The columns for the performance reserve do not include matching ESF support for YEI, as this is excluded from the performance reserve.
(*1) To be completed only when priority axes are expressed in total costs.
(*2) This rate may be rounded to the nearest whole number in the table. The precise rate used to reimburse payments is the ratio (f).
(29) The national counterpart is divided pro-rata between the main allocation and the performance reserve.
(30) This priority axis comprises the specific allocation to YEI and the matching ESF support.
(31) This part of a priority axis comprises the specific allocation to YEI and the matching ESF support.
(32) ESF allocation without the matching support for the YEI.
(33) The sum of total ESF support in less developed, transition and more developed regions and the resources allocated to the YEI in Table 18a equals the sum of total ESF support in such regions and the specific allocation to the YEI in Table 17.
(34) ESF allocation without the matching support for the YEI.
(35) ESF allocation without the matching support for the YEI.
(36) Includes the YEI special allocation and the matching support from the ESF.
(*3) To be completed only when priority axes are expressed in total costs.
(*4) This rate may be rounded to the nearest whole number in the table. The precise rate used to reimburse payments is the ratio (f).
(37) To be completed for every (part of a) priority axis which implements the YEI.
(38) The YEI (specific allocation and matching ESF support) is considered a Fund and appears as a separate row even if it is part of a priority axis.
(39) For the purposes of this table, the YEI (specific allocation and matching ESF support) is considered as a fund.
(40) This table is generated automatically on the basis of tables on categories of intervention under each priority axis.
(41) Regulation (EU) No 1301/2013 of the European Parliament and of the Council of 17 December 2013 on the European Regional Development Fund and on specific provisions concerning the Investment for growth and jobs goal and repealing Regulation (EC) No 1080/2006 (OJ L 347, 20.12.2013, p. 289).
(42) If the programme covers more than one category of region, a breakdown by category may be necessary.
(43) Tables 25 and 26 cover only applicable general and thematic ex-ante conditionalities which are completely unfulfilled or partially fulfilled (see Table 24) at the time of submission of the programme.
(44) The target value may be presented as a total (men+women) or broken down by gender.

COMMISSION REGULATION (EU) No 289/2014
of 21 March 2014
amending Annexes II, III and V to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for foramsulfuron, azimsulfuron, iodosulfuron, oxasulfuron, mesosulfuron, flazasulfuron, imazosulfuron, propamocarb, bifenazate, chlorpropham and thiobencarb in or on certain products
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 396/2005 of the European Parliament and of the Council of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin and amending Council Directive 91/414/EEC (1), and in particular Article 14(1)(a), Article 18(1)(b) and Article 49(2) thereof,
Whereas:
(1) |
For foramsulfuron, azimsulfuron, iodosulfuron, oxasulfuron, mesosulfuron, flazasulfuron and imazosulfuron maximum residue levels (MRLs) were set in Annex II and Part B of Annex III to Regulation (EC) No 396/2005. For propamocarb MRLs were set in Part A of Annex III to that Regulation. |
(2) |
For foramsulfuron, the European Food Safety Authority, hereinafter ‘the Authority’, submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (2). The Authority recommended, for certain products, raising or keeping the existing MRLs or setting MRLs at the level identified by the Authority. It concluded that concerning the MRL for maize grain some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, MRL for this product should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. This MRL will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation. |
(3) |
For azimsulfuron, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (3). It recommended lowering the MRL for rice. |
(4) |
For iodosulfuron, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (4). It proposed to change the residue definition. It recommended lowering the MRLs for barley grain, maize grain, rye grain and wheat grain. For linseed it recommended keeping the existing MRL. It concluded that concerning the MRLs for linseed and maize forage some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, MRLs for those products should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. Those MRLs will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation. |
(5) |
For oxasulfuron, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (5). It recommended lowering the MRLs for soya bean. |
(6) |
For mesosulfuron, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (6). It proposed to change the residue definition. It recommended, for certain products, raising or keeping the existing MRLs or setting MRLs at the level identified by the Authority. |
(7) |
For flazasulfuron, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (7). It recommended lowering the MRLs for citrus fruit and table and wine grapes. It concluded that concerning the MRLs for table olives and olives for oil production some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, MRLs for those products should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. Those MRLs will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation. |
(8) |
For imazosulfuron, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (8). It concluded that concerning the MRLs for barley grain, rice grain, rye grain and wheat grain some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, MRLs for those products should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. Those MRLs will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation. |
(9) |
For propamocarb, the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (9). It proposed to change the residue definition. As regards rocket (rucola) and leek, after submitting the opinion referred to in the first sentence, the Authority submitted a further opinion concerning the MRLs (10). It is appropriate to take that opinion into account. |
(10) |
The Authority indicated that the evaluated use for propamocarb in leek as well as the existing MRL for lettuce may raise concerns of consumer protection. The Authority therefore recommended lowering the existing MRLs for lettuce. The MRL for leek should be set at the specific limit of determination or at the default MRL as laid down in Article 18(1)(b) of Regulation (EC) No 396/2005. |
(11) |
The Authority recommended lowering the existing MRLs for potatoes, radishes, onions, tomatoes, peppers, aubergines (egg plants), cucumbers, gherkins, courgettes, pumpkins, broccoli, Brussels sprouts, head cabbage, Chinese cabbage, kohlrabi, lettuce. It recommended, for certain products, raising or keeping the existing MRLs or setting MRLs at the level identified by the Authority. It concluded that concerning the MRLs for cauliflower, lamb’s lettuce, scarole, cress, land cress, rocket (rucola), red mustard, Brassica spp. (leaves and sprouts), fresh herbs, swine (muscle, fat, kidney), bovine (muscle, fat, kidney), sheep (muscle, fat, kidney), goat (muscle, fat, kidney), milk (cattle, sheep, goat), poultry (muscle, fat, liver) and birds’ eggs some information was not available and that further consideration by risk managers was required. As there is no risk for consumers, MRLs for those products should be set in Annex II to Regulation (EC) No 396/2005 at the existing level or the level identified by the Authority. Those MRLs will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation. For other products the Authority recommended raising or keeping the existing MRLs. |
(12) |
As regards products of plant and animal origin for which neither relevant authorisations nor import tolerances were reported at Union level nor Codex MRLs were available, the Authority concluded that further consideration by risk managers was required. Taking into account the current scientific and technical knowledge, MRLs for those products should be set at the specific limit of determination or at the default MRL as laid down in Article 18(1)(b) of Regulation (EC) No 396/2005. |
(13) |
As regards thiobencarb the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(1) of Regulation (EC) No 396/2005 (11). As regards bifenazate and chlorpropham the Authority submitted a reasoned opinion on the existing MRLs in accordance with Article 12(2) of Regulation (EC) No 396/2005 in conjunction with Article 12(1) thereof (12) (13). It proposed to change the residue definitions. The European Union reference laboratories identified reference standards as commercially not available for the residue definitions proposed by the Authority. Residue definitions for bifenazate and chlorpropham should be set in Annex II to Regulation (EC) No 396/2005 and the residue definition for thiobencarb should be set in Annex V to Regulation (EC) No 396/2005. Those residue definitions will be reviewed; the review will take into account the information available within 2 years from the publication of this Regulation. |
(14) |
Based on the reasoned opinions of the Authority and taking into account the factors relevant to the matter under consideration, the appropriate modifications to the MRLs fulfil the requirements of Article 14(2) of Regulation (EC) No 396/2005. |
(15) |
Through the World Trade Organisation, the trading partners of the Union were consulted on the new MRLs and their comments have been taken into account. |
(16) |
Regulation (EC) No 396/2005 should therefore be amended accordingly. |
(17) |
A reasonable period should be allowed to elapse before the modified MRLs become applicable in order to permit Member States, third countries and food business operators to prepare themselves to meet the new requirements which will result from the modification of the MRLs. |
(18) |
In order to allow for the normal marketing, processing and consumption of products, this Regulation should provide for a transitional arrangement for products which have been lawfully produced before the modification of the MRLs and for which information shows that a high level of consumer protection is maintained. |
(19) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |

COMMISSION IMPLEMENTING REGULATION (EU) No 290/2014
of 21 March 2014
concerning the authorisation of a preparation of endo-1,4-beta-xylanase and endo-1,3(4)-beta-glucanase produced by Talaromyces versatilis sp. nov. IMI CC 378536 as a feed additive for poultry, weaned piglets and pigs for fattening and amending Regulations (EC) No 1259/2004, (EC) No 943/2005, (EC) No 1206/2005 and (EC) No 322/2009 (holder of the authorisation Adisseo France S.A.S.)
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 9(2) thereof,
Whereas:
(1) |
Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such authorisation. Article 10 of that Regulation provides for the re-evaluation of additives authorised pursuant to Council Directive 70/524/EEC (2). |
(2) |
A preparation of endo-1,4-beta-xylanase EC 3.2.1.8 and endo-1,3(4)-beta-glucanase EC 3.2.1.6 produced by Penicillium funiculosum IMI SD 101 was authorised without a time limit in accordance with Directive 70/524/EEC as a feed additive for chickens for fattening by Commission Regulation (EC) No 1259/2004 (3); for laying hens and turkeys for fattening by Commission Regulation (EC) No 943/2005 (4); for pigs for fattening by Commission Regulation (EC) No 1206/2005 (5); and for ducks for fattening and weaned piglets by Commission Regulation (EC) No 322/2009 (6). That preparation was subsequently entered in the Register of feed additives as an existing product, in accordance with Article 10(1)(b) of Regulation (EC) No 1831/2003. |
(3) |
In accordance with Article 10(2) of Regulation (EC) No 1831/2003 in conjunction with Article 7 of that Regulation, an application was submitted for the re-evaluation of that preparation of endo-1,4-beta-xylanase EC 3.2.1.8 and endo-1,3(4)-beta-glucanase EC 3.2.1.6 produced by Talaromyces versatilis sp. nov. IMI CC 378536 (formerly Penicillium funiculosum IMI SD 101), as a feed additive for chickens, turkeys and ducks for fattening, laying hens, weaned piglets, pigs for fattening, and, in accordance with Article 7 of that Regulation, for a new use for all major and minor poultry species, requesting that additive to be classified in the additive category ‘zootechnical additives’. That application was accompanied by the particulars and documents required under Article 7(3) of Regulation (EC) No 1831/2003. |
(4) |
The European Food Safety Authority (‘the Authority’) concluded in its opinion of 10 July 2013 (7) that, under the proposed conditions of use, the preparation of endo-1,4-beta-xylanase EC 3.2.1.8 and endo-1,3(4)-beta-glucanase EC 3.2.1.6 produced by Talaromyces versatilis sp. nov. IMI CC 378536 does not have an adverse effect on animal health, human health or the environment, and that it has a potential to favourably affect animal performance in chickens and turkeys for fattening, laying hens, weaned piglets and pigs for fattening. Since the mode of action can be considered to be similar in all poultry species, this conclusion can be extrapolated to ducks, guinea fowls, quails, geese, pheasant and pigeons. The Authority does not consider that there is a need for specific requirements of post-market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |
(5) |
The assessment of the preparation of endo-1,4-beta-xylanase EC 3.2.1.8 and endo-1,3(4)-beta-glucanase EC 3.2.1.6 produced by Talaromyces versatilis sp. nov. IMI CC 378536 shows that the conditions for authorisation, as provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. Accordingly, the use of that preparation should be authorised as specified in the Annex to this Regulation. |
(6) |
As a consequence of the granting of a new authorisation under Regulation (EC) No 1831/2003, Regulations (EC) No 1259/2004, (EC) No 943/2005, (EC) No 1206/2005 and (EC) No 322/2009 should be amended accordingly. |
(7) |
Since safety reasons do not require the immediate application of the modifications to the conditions of authorisation, it is appropriate to allow a transitional period for interested parties to prepare themselves to meet the new requirements resulting from the authorisation. |
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS REGULATION:

COMMISSION IMPLEMENTING REGULATION (EU) No 291/2014
of 21 March 2014
amending Regulation (EC) No 1289/2004 as regards the withdrawal time and maximum residues limits of the feed additive decoquinate
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 13(3) thereof,
Whereas:
(1) |
Regulation (EC) No 1831/2003 provides for the possibility to modify the authorisation of a feed additive further to a request from the holder of the authorisation and an opinion of the European Food Safety Authority (the Authority). |
(2) |
The use of decoquinate belonging to the group of coccidiostats and other medicinal substances was authorised for 10 years in accordance with Council Directive 70/524/EEC (2) as a feed additive for the use on chickens for fattening by Commission Regulation (EC) No 1289/2004 (3). |
(3) |
The holder of the authorisation submitted an application requesting a reduction in the authorised withdrawal time from three days to zero days before slaughter and the introduction of maximum residues limits (MRLs) for liver (1,0 mg/kg), kidney (0,8 mg/kg), muscle (0,5 mg/kg) and skin/fat (1,0 mg/kg) from animals fed with the additive. The holder of the authorisation submitted the relevant data to support its request. |
(4) |
The Authority concluded in its opinion of 12 September 2013 (4) that the modification from three days to zero days of withdrawal time does not compromise consumer safety and the new data submitted confirm that no MRLs are necessary. |
(5) |
However, for the purpose of the feasibility of controls, it was considered appropriate to established MRLs as proposed by the applicant. |
(6) |
The conditions provided for in Article 5 of Regulation (EC) No 1831/2003 are satisfied. |
(7) |
Regulation (EC) No 1289/2004 should therefore be amended accordingly. |
(8) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS REGULATION:
Article 1

COMMISSION IMPLEMENTING REGULATION (EU) No 292/2014
of 21 March 2014
concerning the authorisation of a preparation of 6-phytase produced by Trichoderma reesei (CBS 126897) as a feed additive for poultry, weaned piglets, pigs for fattening and sows (holder of the authorisation ROAL Oy)
(2) |
In accordance with Article 7 of Regulation (EC) No 1831/2003 an application was submitted for the authorisation of a preparation of 6-phytase produced by Trichoderma reesei (CBS 126897). That application was accompanied by the particulars and documents required under Article 7(3) of Regulation (EC) No 1831/2003. |
(3) |
That application concerns the authorisation of a preparation of 6-phytase produced by Trichoderma reesei (CBS 126897) as a feed additive for poultry and pigs to be classified in the additive category ‘zootechnical additives’. |
(4) |
The European Food Safety Authority (‘the Authority’) concluded in its opinions of 11 September (2) and 9 October 2013 (3) that, under the proposed conditions of use, the preparation of 6-phytase produced by Trichoderma reesei (CBS 126897) does not have an adverse effect on animal health, human health or the environment, and that it has a potential to improve the phosphorus utilisation, digestibility and bone mineralisation or the performance in chickens and turkeys for fattening. These conclusions can be extended to chickens reared for laying and turkeys reared for breeding. Since the mode of action of the additive can be considered similar in all poultry species, this conclusion can be extrapolated to minor poultry species for fattening or reared for laying or breeding. Furthermore, the Authority concluded that the additive has a potential to increase bone mineralisation, ileal digestibility, phosphorus utilisation and performance of the laying hens. These conclusions can be extrapolated to minor laying poultry species. The Authority also concluded that the additive has the potential to improve the phosphorus digestibility, phosphorus retention or the performance parameters in piglets, pigs for fattening and sows. The Authority does not consider that there is a need for specific requirements of post-market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Reference Laboratory set up by Regulation (EC) No 1831/2003. |
(5) |
The assessment of the preparation of 6-phytase produced by Trichoderma reesei (CBS 126897) shows that the conditions for authorisation, as provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. Accordingly, the use of that preparation should be authorised as specified in the Annex to this Regulation. |
(6) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS REGULATION:
Article 1

(2) |
Regulation (EC) No 1083/2006 was amended by Regulation (EU) No 1298/2013 of the European Parliament and of the Council (4) with a view to address the specific problems of unemployment, in particular youth unemployment, and poverty and social exclusion in those countries by adding a total envelope of EUR 125 513 290, in 2004 prices, under the European Social Fund. |
(3) |

(4) |
The indicative amounts of the commitment appropriations for the regions eligible to benefit from Structural Funds under the Regional competitiveness and employment objective should be revised for those Member States. |

Directive 2004/41/EC of the European Parliament and of the Council (2) amended Council Decision 95/408/EC (3) and provided that provisional lists of third countries and third country establishments drawn up in accordance with Decision 95/408/EC should continue to apply mutatis mutandis, pending the adoption of the necessary provisions on the basis of Regulation (EC) No 852/2004 of the European Parliament and of the Council (4), Regulation (EC) No 853/2004 of the European Parliament and of the Council (5), Regulation (EC) No 854/2004 or Council Directive 2002/99/EC (6). The Decision was applicable until the date of application of Regulation (EC) No 852/2004, Regulation (EC) No 853/2004, and Regulation (EC) No 854/2004, namely, 1 January 2006. |
(2) |
Lists of third country establishments from which Member States authorise imports of certain products of animal origin which were adopted on the basis of Decision 95/408/EC still continue to exist. |
(3) |
Article 12 of Regulation (EC) No 854/2004 lays down the procedure for drawing up and updating the list of establishments from which imports of certain products of animal origin are authorised. Based on the provisions of this Article, in particular, paragraph 5, which states that the Commission shall arrange for up-to-date versions of all lists drawn up or updated to be available to the public, the lists of establishments from which Member States authorise imports of certain products of animal origin for human consumption are published on the European Commission’s website (7). |
(4) |
In the interest of clarity of Union legislation, and in view of the drawing up of lists of third country establishments from which imports of certain products of animal origin are permitted, former lists adopted on the basis of Decision 95/408/EC became obsolete and it is thus necessary to formally repeal them for reasons of legal certainty. |
(5) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
