COUNCIL REGULATION (EU) No 1412/2013

of 17 December 2013

opening and providing for the administration of autonomous Union tariff quotas for imports of certain fishery products into the Canary Islands from 2014 to 2020

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 349 thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national parliaments,

Having regard to the opinion of the European Parliament,

Having regard to the opinion of the European Economic and Social Committee,

After consulting the Committee of the Regions,

Acting in accordance with a special legislative procedure,

Whereas:

(1)

The exceptional geographical situation of the Canary Islands in relation to the sources of supply of certain fishery products which are essential for domestic consumption entails additional costs for that sector. That natural handicap, recognised by Article 349 of the Treaty, resulting from the Canary Islands’ insularity, remoteness and outermost location can be remedied, inter alia, by temporarily suspending customs duties on imports of the products in question from third countries within autonomous Union tariff quotas of an appropriate volume.

(2)

Council Regulation (EC) No 645/2008 (1) opened and provided for the administration of autonomous Community tariff quotas on imports of certain fishery products into the Canary Islands for the period from 1 January 2007 to 31 December 2013.

(3)

In July 2010 and June 2012, the Spanish authorities submitted reports on the implementation of the measures referred to in Article 3 of Regulation (EC) No 645/2008. The Commission has examined the impact of those measures on the basis of those reports.

(4)

The reports submitted by the Spanish authorities included information on the utilisation rate of the tariff quotas for the period from 2007 to 2011. That information showed that, on average, over that period, the tariff quota with order number 09.2997 was almost fully utilised, and that the tariff quota with order number 09.2651 was not exhausted.

(5)

Since the tariff quota with order number 09.2997 was almost fully utilised, and the non-exhaustion of the tariff quota with order number 09.2651 could be linked to temporary and exogenous factors, it is appropriate to set the volume of the tariff quotas at the same level.

(6)

The sharp decline in local demand for products covered by the tariff quota with order number 09.2651, due to the difficult economic conditions in the Canary Islands following the economic and financial crises, may explain the under-utilisation of that tariff quota.

(7)

In September 2012, Spain requested the extension of Union tariff quotas for imports of certain fishery products into the Canary Islands, in accordance with Article 349 of the Treaty.

(8)

Tariff quotas similar to those opened pursuant to Regulation (EC) No 645/2008 for certain fishery products are justified as they would cover the needs of the Canary Islands' domestic market, while ensuring that flows of reduced-duty imports into the Union remain predictable and clearly identifiable.

(9)

Therefore, with the aim of giving a long-term perspective to economic operators to reach a level of activity which stabilises the economic and social environment of the Canary Islands, it is appropriate to extend, for an additional period, the autonomous tariff quota regime of the Common Customs Tariff duties for the goods listed in the Annex to this Regulation.

(10)

In order to avoid undermining the integrity and the coherence of the internal market, measures should be taken to ensure that fishery products for which suspension is granted are intended solely for the Canary Islands’ domestic market.

(11)

Measures should be taken to ensure that the Commission is kept regularly informed of the volume of imports in question so that, if necessary, it can take steps to prevent any speculative movement or deflection of trade.

(12)

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission allowing the Commission to temporarily withdraw the suspension in the case of a deflection of trade. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council (2). The final decision on whether the suspension should be maintained or withdrawn definitely should, however, be made by the Council in accordance with Article 349 of the Treaty within the time period for which suspension is temporarily withdrawn pursuant to the Commission decision to temporarily withdraw the suspension.

(13)

The provisions to be adopted should ensure continuity with the measures set out in Regulation (EC) No 645/2008. Therefore, it is appropriate to apply the measures provided for in this Regulation from 1 January 2014 to 31 December 2020,

HAS ADOPTED THIS REGULATION:

Article 1

1.   From 1 January 2014 to 31 December 2020, the Common Customs Tariff duties applicable to imports into the Canary Islands of the fishery products listed in the Annex to this Regulation shall be suspended in full for the quantities indicated in that Annex.

2.   The suspension referred to in paragraph 1 shall be granted exclusively for products intended for the Canary Islands' domestic market. It shall only apply to fishery products which are unloaded from ship or aircraft before the customs declaration for release into free circulation is submitted to the customs authorities in the Canary Islands.

Article 2

The tariff quotas referred to in Article 1 of this Regulation shall be managed in accordance with Articles 308a, 308b and 308c(1) of Commission Regulation (EEC) No 2454/93 (3).

Article 3

By 30 June 2019, the Commission shall examine the impact of the measures provided for in Article 1 and, on the basis of its findings, submit any relevant proposals for the period after 31 December 2020.

Article 4

1.   Where the Commission has reasons to believe that the suspensions laid down pursuant to this Regulation have led to a deflection of trade for a specific product, it may adopt implementing acts, temporarily withdrawing the suspension for a period not exceeding 12 months. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 5(2).

The payment of the import duties imposed upon products for which the suspension has been temporarily withdrawn shall be secured by a guarantee, and the release of the products concerned for free circulation on the Canary Islands' domestic market shall be conditional upon the provision of such guarantee.

2.   Within the maximum 12-month period referred to in paragraph 1 of this Article, the Council, in accordance with Article 349 of the Treaty, shall adopt a final decision on whether to maintain or definitively withdraw the suspension. If the suspension is definitively withdrawn, the amounts of duties secured by guarantees shall be collected definitively.

3.   If no definitive decision has been adopted within the maximum 12-month period in accordance with paragraph 2, the securing guarantees shall be released.

Article 5

1.   The Commission shall be assisted by the Customs Code Committee, established by Article 247a(1) of Council Regulation (EEC) No 2913/92 (4). That Committee shall be a committee within the meaning of Regulation (EU) No 182/2011.

2.   Where reference is made to this paragraph, Article 5 of Regulation (EU) No 182/2011 shall apply.

Article 6

The Commission and the customs authorities of the Member States shall cooperate closely to ensure the proper management and control of the application of this Regulation.

Article 7

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2014 until 31 December 2020.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COUNCIL DIRECTIVE 2013/61/EU

amending Directives 2006/112/EC and 2008/118/EC as regards the French outermost regions and Mayotte in particular

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 113 thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national parliaments,

Having regard to the opinion of the European Parliament (1),

Having regard to the opinion of the European Economic and Social Committee (2),

Acting in accordance with a special legislative procedure,

Whereas:

By means of European Council Decision 2012/419/EU (3), the European Council decided that, from 1 January 2014, the status of Mayotte will be that of an outermost region within the meaning of Article 349 of the Treaty on the Functioning of the European Union (TFEU) instead of that of an overseas country or territory (OCT) within the meaning of Article 355(2) TFEU. Union tax provisions will apply to Mayotte after this amendment of status.

(2)

As regards value added tax (VAT) and excise duties, Mayotte is in a situation similar to that of the other French outermost regions (Guadeloupe, French Guiana, Martinique, Réunion and Saint-Martin), which fall outside the territorial scope of Council Directive 2006/112/EC (4) and Council Directive 2008/118/EC (5), and should therefore be excluded from the territorial scope of those Directives as from the date its status is amended under the TFEU. The relevant provisions of Directive 2006/112/EC and Directive 2008/118/EC should consequently be adapted and their application to the French overseas territories at the same time be clarified.

(3)

In order to make it clear that Mayotte and the other French outermost regions are excluded from the scope of Directives 2006/112/EC and 2008/118/EC regardless of any change in their status under French law, reference should be made in those Directives to Article 349 and Article 355(1) TFEU in respect of those regions.

(4)

Directives 2006/112/EC and 2008/118/EC should therefore be amended accordingly,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Point (c) of Article 6(1) of Directive 2006/112/EC is replaced by the following:

‘(c)

the French territories referred to in Article 349 and Article 355(1) of the Treaty on the Functioning of the European Union;’.

Article 2

Article 5 of Directive 2008/118/EC is hereby amended as follows:

(1)

Point (b) of paragraph (2) is replaced by the following:

‘(b)

the French territories referred to in Article 349 and Article 355(1) of the Treaty on the Functioning of the European Union;’.

(2)

Paragraph (5) is replaced by the following:

‘France may give notice, by means of a declaration, that this Directive and the Directives referred to in Article 1 apply to the territories referred to in point (b) of paragraph (2), subject to measures to adapt to the extreme remoteness of those territories, in respect of all or some of the excise goods referred to in Article 1, as from the first day of the second month following the deposit of such declaration.’.

Article 3

1.   Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive with effect from 1 January 2014. They shall communicate to the Commission the text of those provisions before 1 January 2015.

When Member States adopt those provisions, they shall contain a reference to this Directive or shall be accompanied by such a reference on the occasion of their official publication. The methods of making such reference shall be laid down by Member States.

2.   Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

Article 4

This Directive shall enter into force on 1 January 2014.

Article 5

This Directive is addressed to the Member States.

amending Directive 2010/18/EU implementing the revised Framework Agreement on parental leave concluded by BUSINESSEUROPE, UEAPME, CEEP and ETUC, following the amendment of the status of Mayotte with regard to the European Union

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 349 thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national parliaments,

Having regard to the opinion of the European Parliament (1),

Acting in accordance with a special legislative procedure,

Whereas:

By European Council Decision 2012/419/EU (2), the European Council decided to amend the status of Mayotte with regard to the Union with effect from 1 January 2014. From that date, Mayotte will cease to be an overseas country or territory and will become an outermost region of the Union within the meaning of Article 349 and Article 355(1) of the Treaty on the Functioning of the European Union (TFEU). Following this amendment of the legal status of Mayotte, Union law will apply to Mayotte from 1 January 2014. Taking account of the particular structural social and economic situation of Mayotte, certain specific measures aimed at laying down the conditions of application of Union law should be established.

(2)

Considering the specific structural social and economic situation of Mayotte, in particular the fact that the labour market is underdeveloped and the employment rate is low due to its remoteness, insularity, difficult topography and climate, an additional implementation period for Council Directive 2010/18/EU (3) should be provided for in order to ensure that equal treatment in the particular field of parental leave is achieved progressively and in a way that does not destabilise the gradual economic development of Mayotte. That additional implementation period should allow the specific disadvantaged structural social and economic situation of Mayotte, as a new outermost region, to be improved.

(3)

Directive 2010/18/EU should therefore be amended accordingly,

HAS ADOPTED THIS DIRECTIVE:

Article 1

In Article 3(2) of Directive 2010/18/EU, the following subparagraph is added:

‘By way of derogation from the first subparagraph, the additional period referred to therein shall be extended to 31 December 2018 as regards Mayotte as an outermost region of the Union within the meaning of Article 349 TFEU.’.

Article 2

This Directive shall enter into force on 1 January 2014.

Article 3

This Directive is addressed to the French Republic.

amending Council Directives 91/271/EEC and 1999/74/EC, and Directives 2000/60/EC, 2006/7/EC, 2006/25/EC and 2011/24/EU of the European Parliament and of the Council, following the amendment of the status of Mayotte with regard to the European Union

Whereas:

By European Council Decision 2012/419/EU (3), the European Council decided to amend the status of Mayotte with regard to the Union with effect from 1 January 2014. From that date, Mayotte will cease to be an overseas country or territory and will become an outermost region of the Union within the meaning of Article 349 and Article 355(1) of the Treaty on the Functioning of the European Union (TFEU) (hereinafter ‘Mayotte’). Following this amendment of the legal status of Mayotte, Union law will apply to Mayotte from 1 January 2014. Taking account of the particular structural social and economic situation of Mayotte, certain specific measures should be provided for in a number of areas.

(2)

It is appropriate to take account of the particular situation in Mayotte as regards the state of the environment, which needs to be considerably improved for it to comply with environmental objectives laid down by Union law, and for which additional time is needed. Specific measures in order to gradually improve the environment should be adopted within specific time-limits.

(3)

In order to comply with the requirements of Council Directive 91/271/EEC (4), measures need to be taken in Mayotte to ensure that agglomerations are provided with collecting systems for urban waste water. Such measures call for infrastructure works that should follow appropriate administrative and planning procedures and, furthermore, require the establishment of systems for measuring and monitoring urban waste water discharges. Due to the specific structural and economic situation of Mayotte, a sufficient period of time should be granted to France to allow those requirements to be met.

In the field of agriculture, as regards Council Directive 1999/74/EC (5), it is noted that, in Mayotte, laying hens are reared in unenriched cages. In view of the considerable investment and preparatory work required to replace unenriched cages by enriched cages or alternative systems, it is necessary to postpone the prohibition of using unenriched cages for a period of up to 48 months from 1 January 2014. In order to prevent distortions of competition, eggs derived from establishments using unenriched cages should be marketed only on the local market of Mayotte. In order to facilitate the necessary controls, eggs produced in unenriched cages should bear a special mark.

In respect of Directive 2000/60/EC of the European Parliament and of the Council (6), the proper implementation of that Directive as regards river basin management plans requires that France adopts and implements management plans containing technical and administrative measures to achieve good water status for, and to prevent the deterioration of, all bodies of surface waters. Due to the specific structural and economic situation of the new outermost region of Mayotte, a sufficient period of time should be granted for the adoption and implementation of such measures.

In respect of Directive 2006/7/EC of the European Parliament and of the Council (7), the current state of surface waters in Mayotte needs to be considerably improved for them to comply with the requirements of that Directive. The quality of bathing waters depends directly upon urban waste water treatment, and the provisions of Directive 2006/7/EC may only be complied with progressively once agglomerations that affect the quality of urban waste waters comply with the requirements of Directive 91/271/EEC. Therefore, specific time-limits need to be adopted in order to allow France to meet the Union standards as regards bathing water quality in Mayotte as a new outermost region and due to its special social and economic situation.

In the area of social policy, account should be taken of the difficulties to comply with Directive 2006/25/EC of the European Parliament and of the Council (8) in Mayotte as of 1 January 2014. Due to its prevailing special social and economic situation, there are no technical facilities available in Mayotte for the implementation of measures necessary to comply with that Directive in the field of artificial optical radiation. Therefore, it is appropriate to grant a derogation to France from certain provisions of that Directive until 31 December 2017, provided that such facilities are not available in Mayotte and without prejudice to the general principles of protection and prevention in the area of health and safety of workers.

In order to guarantee a high level of protection of the health and safety of workers at work, consultation with the social partners should be ensured, the risks resulting from the derogation should be reduced to a minimum and the workers concerned should benefit from reinforced health surveillance. It is important to reduce the duration of the derogation as much as possible. Therefore, the national derogating measures should be reviewed every year and should be withdrawn as soon as the circumstances justifying them no longer subsist.

(9)

In respect of Directive 2011/24/EU of the European Parliament and of the Council (9), its transposition requires a number of adaptations to ensure continuity of care and information to patients. It is therefore appropriate to grant France an additional period of 30 months from 1 January 2014 to bring into force the provisions necessary to comply with that Directive in respect of Mayotte.

Directives 91/271/EEC, 1999/74/EC, 2000/60/EC, 2006/7/EC, 2006/25/EC and 2011/24/EU should therefore be amended accordingly,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Amendments to Directive 91/271/EEC

Directive 91/271/EEC is amended as follows:

(1)

In Article 3, the following paragraph is inserted:

‘(1a)   By way of derogation from the first and second subparagraphs of paragraph 1, in respect of Mayotte as an outermost region within the meaning of Article 349 of the Treaty on the Functioning of the European Union (hereinafter “Mayotte”), France shall ensure that all agglomerations are provided with collecting systems for urban waste water:

by 31 December 2020 at the latest for agglomerations of more than 10 000 p.e., which will cover at least 70 % of the load generated in Mayotte;

by 31 December 2027 at the latest for agglomerations of more than 2 000 p.e.’.

(2)

In Article 4, the following paragraph is inserted:

‘(1a)   By way of derogation from paragraph 1, in respect of Mayotte, France shall ensure that urban waste water entering collecting systems is, before discharge, subject to secondary treatment or an equivalent treatment:

by 31 December 2020 at the latest for agglomerations of more than 15 000 p.e., which, along with the agglomerations referred to in Article 5 (2a), will cover at least 70 % of the load generated in Mayotte;

by 31 December 2027 at the latest for agglomerations of more than 2 000 p.e.’.

(3)

In Article 5 the following paragraph is added:

‘(2a)   By way of derogation from paragraph 2, in respect of Mayotte, France shall ensure that urban waste water entering collecting systems shall before discharge into sensitive areas be subject to more stringent treatment than that described in Article 4 by 31 December 2020 at the latest for agglomerations of more than 10 000 p.e., which, along with the agglomerations referred to in Article 4(1a), will cover at least 70 % of the load generated in Mayotte.’.

(4)

In Article 7, the following paragraph is added:

‘By way of derogation from the first paragraph, in respect of Mayotte, the time limit defined therein shall be 31 December 2027.’.

(5)

Article 17 is amended as follows:

(a)

In paragraph 1, the following subparagraph is added:

‘By way of derogation from the first subparagraph, in respect of Mayotte, France shall establish a programme for the implementation of this Directive by 30 June 2014.’.

(b)

In paragraph 2, the following subparagraph is added:

‘By way of derogation from the first subparagraph, in respect of Mayotte, France shall provide the Commission with information on the programme by 31 December 2014.’.

Article 2

Amendment to Directive 1999/74/EC

In Article 5 of Directive 1999/74/EC, the following paragraph is added:

‘3.   By way of derogation from paragraph 2, in Mayotte as an outermost region within the meaning of Article 349 of the Treaty on the Functioning of the European Union (hereinafter “Mayotte”), laying hens may continue to be reared in cages as referred to in this Chapter until 31 December 2017.

From 1 January 2014, no cages as referred to in this Chapter may be built or brought into service for the first time in Mayotte.

Eggs derived from establishments rearing laying hens in cages as referred to in this Chapter shall only be placed on the local market of Mayotte. Those eggs and their packs shall be clearly identified with a special mark, so as to allow the necessary controls. A clear description of this special mark shall be communicated to the Commission by 1 January 2014.’.

Article 3

Amendments to Directive 2000/60/EC

Directive 2000/60/EC is hereby amended as follows:

(1)

Article 4 is amended as follows:

(a)

in paragraph 1, the following subparagraph is added:

‘As regards Mayotte as an outermost region within the meaning of Article 349 of the Treaty on the Functioning of the European Union (hereinafter “Mayotte”), the time limit referred to in points (a)(ii), (a)(iii), (b)(ii) and (c) shall be 22 December 2021.’.

(b)

in paragraph 4, the introductory sentence is replaced by the following:

‘The time limits laid down in paragraph 1 may be extended for the purposes of phased achievement of the objectives for bodies of water, provided that no further deterioration occurs in the status of the affected body of water when all the following conditions are met:’.

(2)

Article 11 is amended as follows:

(a)

in paragraph 7, the following subparagraph is added:

‘As regards Mayotte, the time limits referred to in the first subparagraph shall be 22 December 2015 and 22 December 2018, respectively.’.

(b)

in paragraph 8, the following subparagraph is added:

‘As regards Mayotte, the time limit referred to in the first subparagraph shall be 22 December 2021.’.

(3)

Article 13 is amended as follows:

(a)

in paragraph 6, the following subparagraph is added:

‘As regards Mayotte, the time limit referred to in the first subparagraph shall be 22 December 2015.’.

(b)

in paragraph 7, the following subparagraph is added:

‘As regards Mayotte, the time limit referred to in the first subparagraph shall be 22 December 2021.’.

Article 4

Amendments to Directive 2006/7/EC

Directive 2006/7/EC is hereby amended as follows:

(1)

Article 5 is amended as follows:

(a)

in paragraph 2, the following subparagraph is added:

‘As regards Mayotte as an outermost region within the meaning of Article 349 of the Treaty on the Functioning of the European Union (hereinafter “Mayotte”), the time limit referred to in the first subparagraph shall be 31 December 2019.’.

(b)

in paragraph 3, the following subparagraph is added:

‘As regards Mayotte, the time limit referred to in the first subparagraph shall be 31 December 2031.’.

(2)

In Article 6(1), the following subparagraph is added:

‘As regards Mayotte, the time limit referred to in the first subparagraph shall be 30 June 2015.’.

(3)

In Article 13(2), the following subparagraph is added:

‘As regards Mayotte, the time limit referred to in the first subparagraph shall be 30 June 2014.’.

Article 5

Amendment to Directive 2006/25/EC

In Directive 2006/25/EC, the following Article is added:

‘Article 14a

1.   Without prejudice to the general principles of protection and prevention in the area of health and safety of workers, France may, until 31 December 2017, derogate from the application of the provisions necessary to comply with this Directive in Mayotte as an outermost region within the meaning of Article 349 of the Treaty on the Functioning of the European Union (hereinafter “Mayotte”), provided that such application requires specific technical facilities that are not available in Mayotte.

The first subparagraph does not apply to the obligations set out in Article 5(1) of this Directive, or to the provisions of this Directive which reflect the general principles laid down in Directive 89/391/EEC.

2.   All derogations from this Directive resulting from the application of measures existing on 1 January 2014 or from the adoption of new measures shall be preceded by a consultation with the social partners in accordance with national law and practice. Such derogations shall be applied under conditions which, taking into account the particular circumstances prevailing in Mayotte, guarantee that the resulting risks for workers are reduced to a minimum and that the workers concerned benefit from reinforced health surveillance.

3.   The national derogating measures shall be reviewed every year, after consultation with the social partners, and shall be withdrawn as soon as the circumstances justifying them no longer subsist.’.

Article 6

Amendment to Directive 2011/24/EU

In Article 21 of Directive 2011/24/EU, the following paragraph is added:

‘3.   By way of derogation from the first sentence of paragraph 1, France shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive in respect of Mayotte as an outermost region within the meaning of Article 349 TFEU by 30 June 2016.’.

Article 7

Transposition

1.   France shall adopt and publish the laws, regulations and administrative provisions necessary to comply with this Directive as follows:

(a)

in respect of Articles 1(1), 1(2) and 1(3), by 31 December 2018;

(b)

in respect of Article 1(5), by the dates referred to in points (a) and (b) therein respectively;

(c)

in respect of Article 2, by 1 January 2014;

(d)

in respect of Article 3(1), by 31 December 2018;

(e)

in respect of Articles 3(2) and 3(3), by the dates referred to therein;

(f)

in respect of point (a) of Article 4(1), by 31 December 2018;

(g)

in respect of point (b) of Article 4(1), by 30 June 2021;

(h)

in respect of Articles 4(2) and 4(3), by the dates referred to therein;

(i)

in respect of Article 5, by 1 January 2014, unless France does not make use of the possibility foreseen in that Article;

(j)

in respect of Article 6, by 30 June 2016.

France shall communicate forthwith the text of those provisions to the Commission.

When France adopts those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. France shall determine how such reference is to be made.

2.   France shall communicate to the Commission the text of the main provisions of national law which it adopts in the field covered by this Directive.

Article 8

Entry into force

This Directive shall enter into force on 1 January 2014.

Addressee

This Directive is addressed to the French Republic.

COUNCIL DECISION No 1413/2013/EU

of 17 December 2013

amending Decision 2002/546/EC as regards its period of application

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 349 thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national Parliaments,

Having regard to the opinion of the European Parliament (1),

Acting in accordance with a special legislative procedure,

Whereas:

(1)

Council Decision 2002/546/EC (2) authorises Spain to apply exemptions from, or reductions in, the tax known as ‘Arbitrio sobre Importaciones y Entregas de Mercancías en las Islas Canarias’ (hereinafter ‘AIEM’) to certain products produced in the Canary Islands. The Annex to that Decision contains a list of products to which tax exemptions and reductions may be applied. The difference between the tax on products produced in the Canary Islands and that on other products is not to exceed 5, 15 or 25 percentage points, depending on the product.

(2)

The exemptions from, and reductions in, the AIEM establish differentiated taxation, benefiting the local production of some products. This constitutes state aid that requires the approval of the Commission.

(3)

Council Decision 2002/546/EC was originally applicable until 31 December 2011. At the end of 2011, Council Decision 895/2011/EU (3) amended Decision 2002/546/EC, extending its period of application until 31 December 2013, based on the Commission confirmation that the specific structural, social and economic situation of the Canary Islands, which is compounded by the special constraints referred to in Article 349 TFEU which justified the authorisation of total exemptions and partial reductions of the AIEM tax to a list of products produced in this outermost region, still persists.

Since the structural, social and economic situation in the Canary Islands is still in place, it is necessary to further extend the period of application of Decision 2002/546/EC.

(5)

On 28 June 2013, the Commission adopted its Guidelines on regional state aid for 2014-2020, setting out how Member States can grant aid to companies in order to support the development of disadvantaged regions in the Union between 2014 and 2020. These Guidelines, which will enter into force on 1 July 2014, form part of a broader strategy to modernise state aid control, which aims to foster growth in the single market by encouraging more effective aid measures and focusing the Commission's enforcement on cases with the biggest impact on competition.

(6)

It is therefore appropriate to extend the period of application of Decision 2002/546/EC by six months, so that its expiry date coincides with the date of entry into force of the Guidelines on regional state aid for 2014–2020.

(7)

Decision 2002/546/EC should be amended accordingly.

(8)

Given the urgent need to extend the validity of Decision 2002/546/EC before the end of 2013, an exception to the eight-week period referred to in Article 4 of Protocol No 1 on the role of National Parliaments in the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, should apply,

HAS ADOPTED THIS DECISION:

Article 1

In the first sentence of Article 1(1) of Decision 2002/546/EC, the date ‘31 December 2013’ is replaced by ‘30 June 2014’.

Article 2

This Decision shall enter into force on the day of its adoption.

Article 3

This Decision is addressed to the Kingdom of Spain.

COUNCIL REGULATION (EU) No 1414/2013

laying down the weightings applicable from 1 July 2013 to the remuneration of officials, temporary staff and contract staff of the European Union serving in third countries

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union, as laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68 (1), and in particular the first paragraph of Article 13 of Annex X thereto,

Having regard to the proposal from the European Commission,

Whereas:

(1)

It is necessary to take account of changes in the cost of living in third countries and to determine accordingly the weightings applicable from 1 July 2013 to remuneration paid in the currency of the country of employment to officials, temporary staff and contract staff of the Union serving in third countries.

(2)

The weightings in respect of which payment has been made on the basis of Council Regulation (EU) No 679/2013 (2) may lead to back-dated upward or downward adjustments to remuneration.

(3)

Provision should be made for back-payments in the event of an increase in remuneration as a result of the new weightings.

(4)

Provision should be made for the recovery of sums overpaid, in the event of a reduction in remuneration, as a result of the new weightings for the period between 1 July 2013 and the date of entry into force of this Regulation.

(5)

Provision should be made for any such recovery to be restricted to a period of no more than six months preceding the date of entry into force of this Regulation,

HAS ADOPTED THIS REGULATION:

Article 1

1.   With effect from 1 July 2013, the weightings applicable to the remuneration of officials, temporary staff and contract staff of the Union serving in third countries, payable in the currency of the country of employment, shall be as set out in the Annex.

2.   The exchange rates for the calculation of such remuneration shall be established in accordance with Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council (3) and shall correspond to the rates applicable on 1 July 2013.

Article 2

1.   The institutions shall make back-payments in the event of an increase in remuneration as a result of the application of the weightings set out in the Annex.

2.   The institutions shall make retrospective downward adjustments to remuneration in the event of a reduction in remuneration as a result of the weightings set out in the Annex for the period between 1 July 2013 and the date of entry into force of this Regulation.

3.   Retrospective adjustments involving the recovery of sums overpaid shall be restricted to a period of six months preceding the date of entry into force of this Regulation. Recovery shall be spread over no more than 12 months from that date.

Article 3

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

The mathematical formula used to calculate the CC is therefore: PPP (provided by Eurostat) divided by TX = CC. The amounts due to staff are calculated by applying the invariable PPP established by this table — not by multiplying each time the CC by the TX of the date of the transaction, since this TX is variable and will produce a different (wrong) PPP.

adjusting, from 1 July 2013, the rate of contribution to the pension scheme of officials and other servants of the European Union

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union, laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (1), and in particular Article 83a thereof and Annex XII thereto,

Having regard to the proposal from the European Commission,

Whereas:

(1)

In accordance with Article 13 of Annex XII to the Staff Regulations, Eurostat submitted a report on the 2013 five-yearly actuarial assessment of the pension scheme updating the parameters referred to in that Annex. According to this assessment, the rate of contribution required to maintain actuarial balance of the pension scheme is 10,3 % of the basic salary.

(2)

In the interests of the actuarial balance of the pension scheme of officials and other servants of the Union, the rate of contribution should therefore be adjusted to 10,3 % of the basic salary.

(3)

However, in the light of recent and future judgments in the cases on the 2011 and 2012 adjustment of salaries and pensions and in the case on the 2011 adjustment of the rate of contribution to the pension scheme, the result of this adjustment may be subject to change. The implementation of those judgments may have an impact on the calculation of the rates of contribution for the years 2012 and 2013 and thus require the Council to re-adjust the said rates of contribution with retroactive effect. Where applicable, this may lead to a recovery of overpaid sums from staff,

HAS ADOPTED THIS REGULATION:

Article 1

With effect from 1 July 2013, the rate of the contribution referred to in Article 83(2) of the Staff Regulations shall be 10,3 %.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

adjusting with effect from 1 July 2013 the correction coefficients applied to the remuneration and pensions of officials and other servants of the European Union

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union, laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (1), and in particular Articles 63 and 64 of the Staff Regulations and Annex XIII thereto, and the first paragraph of Article 20 and Articles 64, 92 and 132 of the Conditions of Employment of Other Servants,

Having regard to the proposal from the European Commission,

Whereas:

(1)

In order to guarantee that officials and other servants of the Union enjoy the same purchasing power regardless of their place of employment, the correction coefficients applied to the remuneration and pensions of officials and other servants of the Union should be adjusted under the 2013 review,

(2)

According to Regulation (EU, Euratom) No 1023/2013 of the European Parliament and of the Council (2), which amends the Staff Regulations, there is to be no update of the remuneration and pensions of officials and other servants of the Union in 2013 and 2014. This adjustment will be limited to maintaining the same purchasing power in various places of employment in 2013.

HAS ADOPTED THIS REGULATION:

Article 1

With effect from 1 July 2013, the date ‘1 July 2010’ in the second paragraph of Article 63 of the Staff Regulations shall be replaced by ‘1 July 2013’.

Article 2

With effect from 1 July 2013, the correction coefficients applicable to the remuneration of officials and other servants under Article 64 of the Staff Regulations shall be as indicated in column 2 of the following table.

With effect from 1 January 2014, the correction coefficients applicable under Article 17(3) of Annex VII to the Staff Regulations to transfers by officials and other servants shall be as indicated in column 3 of the following table.

With effect from 1 July 2013, the correction coefficients applicable to pensions under Article 20(1) of Annex XIII to the Staff Regulations shall be as indicated in column 4 of the following table.

COUNCIL REGULATION (EU) No 1417/2013

of 17 December 2013

laying down the form of the laissez-passer issued by the European Union

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to Protocol No 7 on the privileges and immunities of the European Union annexed to the Treaty on European Union, the Treaty on the Functioning of the European Union and the Treaty establishing the European Atomic Energy Community, and in particular the first paragraph of Article 6 thereof,

Whereas:

(1)

The first paragraph of Article 6 of Protocol No 7 on the privileges and immunities of the European Union (‘Protocol’) provides that the Council prescribes the form of the laissez-passer which are to be recognised as valid travel documents by the authorities of the Member States.

(2)

It is recalled that the first paragraph of Article 6 of the Protocol applies to members of the institutions of the Union and servants of the Union, who are subject either to the Staff Regulations of Officials or the Conditions of Employment of Other Servants of the European Union (1).

(3)

Article 23 of the Staff Regulations of Officials, as well as Articles 11 and 81 of the Conditions of Employment of Other Servants of the European Union, lay down the conditions under which the laissez-passer is issued to servants of the Union.

(4)

In the interest of the Union and in order to comply with the duty of care, the benefit of the laissez-passer may be extended, on exceptional basis and upon due motivation, to special applicants.

(5)

In any event, a laissez-passer does not grant privileges and immunities to its holder.

(6)

The laissez-passer is to be recognised as a valid travel document by the authorities of the Member States. The Commission should make use of the possibility provided for under the second paragraph of Article 6 of the Protocol to conclude necessary agreements with third countries with a view to recognising laissez-passer as valid travel documents for border crossing and within the territory of third countries.

(7)

Developments at Union level, in particular the establishment of the European External Action Service, have further enhanced the need for a coherent approach at the international and Union levels.

(8)

The form of the laissez-passer should be upgraded to achieve enhanced security standards and to contribute to ensuring a proper level of protection against forgery, counterfeiting and falsification. Common security standards and interoperable biometric identifiers should be integrated into the laissez-passer in order to establish a reliable link between the rightful holder and the document, making an important contribution to ensuring protection against its fraudulent use.

(9)

In particular, the form of the laissez-passer should comply with the security standards and technical specifications applicable to the national travel documents issued by Member States pursuant to Council Regulation (EC) No 2252/2004 (2). This allows for compliance with the specifications of the International Civil Aviation Organisation (‘ICAO’), in particular those appearing in ICAO Document 9303 on machine-readable travel documents, as they will contribute to protecting the laissez-passer against fraudulent use and to having it internationally recognised as a valid travel document. Likewise, the Union should participate in the ICAO Public Key Directory following the applicable ICAO standards and recommended practices with a view to allowing facilitated worldwide validation of laissez-passer.

(10)

In order to ensure that uniform conditions for future security standards and technical specifications for passports and travel documents issued by Member States apply equally, where appropriate, to Union laissez-passer, implementing powers should be conferred on the Commission. Moreover, implementing powers should be conferred on the Commission to establish rules for institutions, agencies or other bodies of the Union, as well as to the European External Action Service (hereinafter referred to as the ‘institutions’), in cases of loss, theft, issuance of duplicates and returns of laissez-passer. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council (3).

(11)

The advisory procedure should be used for the adoption of implementing acts ensuring, where appropriate, compliance with future minimum security standards and technical specifications for passports and travel documents issued by Member States adopted pursuant to Regulation (EC) No 2252/2004, which may remain secret in order to prevent the risk of counterfeiting and falsifications. The advisory procedure should also be used for the adoption of implementing acts on the handling of cases of loss, theft, issuance of duplicates and returns of laissez-passer by the institutions. Under the advisory procedure the Commission should be assisted by the Committee established by Article 6 of Council Regulation (EC) no 1683/95 (4).

(12)

It should be ensured that no further information is stored in the laissez-passer's electronic medium other than that pursuant to this Regulation and the Annexes thereto.

(13)

Each institution, individually or acting together on the basis of service-level agreements, responsible for the processing of the personal data of its own staff or of other agents, and the Commission acting as a central point for processing purposes, should ensure compliance with Regulation (EC) No 45/2001 of the European Parliament and of the Council (5).

(14)

In order to ensure that personal data are not made available to more persons than necessary, it is essential that the Commission coordinate the implementation of this Regulation and designate a single entity having the responsibility for the production and personalisation of the laissez-passer. Specific consideration should be given by the Commission to ensure secure access to the personal data contained in the laissez-passer for the purposes of production and personalisation by the authorised single entity ensuring an adequate level of data protection.

(15)

Personal data should be kept in the register or by the entity only for the time necessary to achieve the purposes for which they were collected and to ensure that data subjects are able to access their personal data in order to exercise their rights. Personal data should be automatically deleted after a period following the closure of the proceeding. This period of time should be justified and motivated.

(16)

In order to prevent falsification and fraudulent use of the laissez-passer, the single entity designated by the Commission to produce and personalise the laissez-passer should be selected in accordance with the provisions applicable to the award of contracts, in particular those of Regulation (EC, Euratom) No 966/2012 of European Parliament and Council (6), and taking due account of the sensitive nature of the documents to be produced.

(17)

In accordance with the principle of proportionality, this Regulation does not go beyond what is necessary to achieve the objectives pursued in accordance with the second subparagraph of Article 5(4) of the Treaty on European Union.

(18)

This Regulation should replace Regulation (ECSC, EEC, Euratom) No 1826/69 of the Council (7). Regulation (ECSC, EEC, Euratom) No 1826/69 should therefore be repealed with effect from 25 November 2015 following a transitional period.

(19)

It is necessary to provide for a transitional period from the entry into force of this Regulation until 24 November 2015, when it will still be possible to issue and use laissez-passer pursuant to Regulation (ECSC, EEC, Euratom) No 1826/69. However, this transitional possibility should be applied in such a way that, from the moment when laissez-passer start being issued pursuant to this Regulation, no more laissez-passer are issued pursuant to Regulation (ECSC, EEC, Euratom) No 1826/69, and such laissez-passer still in circulation are systematically replaced until 24 November 2015. This approach will limit as much as possible the period during which the two forms of laissez-passer circulate simultaneously,

HAS ADOPTED THIS REGULATION:

Article 1

Scope

1.   The laissez-passer shall be accorded solely in the interest of the Union to members of the institutions of the Union referred to in paragraph 2 and its servants. It shall be issued to servants in accordance with the conditions laid down in Article 23 of the Staff Regulations of Officials, as well as Articles 11 and 81 of the Conditions of Employment of Other Servants of the European Union. The laissez-passer may be issued, solely in the interest of the Union in exceptional cases and upon due motivation, to special applicants pursuant to Annex II.

2.   This Regulation shall apply to the institutions, agencies and other bodies of the European Union, as well as to the European External Action Service (hereinafter referred to as the ‘institutions’).

Article 2

Process

1.   For the purposes of this Regulation, each institution may conclude agreements with other institutions with a view to creating synergies and alleviating the costs. These institutions shall be responsible for the processing of personal data of staff or special applicants referred to in Article 1(1). Such data shall include the biographical and biometric data used to identify unambiguously the laissez-passer applicant, including the facial image and two digital finger prints as biometric features.

2.   For the purposes of this Regulation, the Commission shall act as a central point with a view to transmitting the personal data processed by institutions to the entity referred to in paragraph 3.

3.   The Commission shall designate an entity to be responsible for designing, producing and personalising the laissez-passer, taking into account the sensitive nature of the documents to be produced. It shall do so in accordance with the provisions applicable to the award of contracts, in particular those in Regulation (EC, Euratom) No 966/2012. Any transfer of personal data during the process shall be done in accordance with Regulation (EC) No 45/2001.

4.   Each laissez-passer shall remain the property of the Union.

Article 3

Linguistic regime

The laissez-passer shall be issued in all official languages of the institutions of the Union as indicated in Annex I. The presentation of biographical data shall take into account ICAO recommendations.

Article 4

Validity

1.   Without prejudice to Article 5(2), a laissez-passer shall be issued for a maximum period of six years and for no less than twelve months subject to the conditions of return specified in the implementing acts adopted in accordance with Article 6(4). The period of its validity shall be adapted to the length of the mandate for a member of an institution, to the length of stay or of posting for an official or to the length of the contract for a temporary agent or for a contract agent.

2.   All laissez-passer that have expired or have no blank pages for visa affixes must be returned to the issuing authority for formal cancellation or renewal. The laissez-passer shall also be returned when its holder leaves his function or service. This paragraph shall also apply to the special applicants referred to in Article 1(1). In any event, when an original holder returns his laissez-passer, a dependent family member shall equally return his laissez-passer.

Article 5

Personal data - Rights of individuals

1.   Persons to whom a laissez-passer is issued shall have the right to verify the personal data contained in it, pursuant to Regulation (EC) No 45/2001, and, where appropriate, to ask for its rectification or erasure.

2.   Persons for whom fingerprinting is physically impossible shall be exempted from the obligation to provide them. Where fingerprinting of the designated fingers is temporarily impossible, the fingerprinting of the other fingers shall be allowed. Where it is also temporarily impossible to take fingerprints of any of the other fingers, a temporary laissez-passer may be issued, having a validity of 12 months or less.

3.   The laissez-passer shall contain no machine-readable information other than that pursuant to this Regulation.

4.   For the purposes of this Regulation, the biometric features in the laissez-passer shall only be used for verifying:

the authenticity of the document;

the identity of the holder by means of directly available comparable features.

5.   The personal data shall be secured, in particular against unauthorised access, and its integrity, authenticity and confidentiality shall be guaranteed.

6.   Access to fingerprints on the storage medium in the laissez-passer shall only be granted by the Commission to third countries under the conditions set out in Article 9 of Regulation (EC) No 45/2001.

Article 6

Technical specifications and security standards

1.   In order to guarantee an equivalent security level, the laissez-passer shall comply with the minimum security standards provided for in Regulation (EC) No 2252/2004 and in Commission Decision C(2005) 409 of 28 February 2005 establishing the technical specifications on the standards for security features and biometrics in passports and travel documents issued by Member States, Commission Decision C(2006) 2909 of 28 June 2006 establishing the technical specifications on the standards for security features and biometrics in passports and travel documents issued by Member States, Commission Decision C(2008) 8657 of 22 December 2008 laying down a certificate policy as required in the technical specifications on the standards for security features and biometrics in passports and travel documents issued by Member States and updating the normative reference documents, Commission Decision C(2009) 7476 of 5 October 2009 amending Commission Decision (C(2008) 8657 final) laying down a certificate policy as required in the technical specifications on the standards for security features and biometrics in passports and travel documents issued by Member States, Commission Decision C(2011) 5499 of 4 August 2011 amending Commission Decision C(2006) 2909 final laying down the technical specifications on the standards for security features and biometrics in passports and travel documents issued by Member States and Commission Implementing Decision C(2013) 6181 of 30 September 2013 amending Commission Decision C(2006) 2909 final laying down the technical specifications on the standards for security features and biometrics in passports and travel documents issued by Member States.

2.   In order to ensure, where appropriate, compliance of the laissez-passer with future minimum security standards adopted pursuant to Regulation (EC) No 2252/2004, the Commission shall establish, by means of implementing acts, additional technical specifications in accordance with international standards, including in particular the standards and recommended practices of ICAO for laissez-passer, relating to the following:

(a)

additional security features and requirements, including enhanced anti-forgery, counterfeiting and falsification standards;

(b)

technical specifications for the storage medium of the biometric features and their security, including prevention of unauthorised access and facilitated validation;

(c)

requirements for quality and common technical standards for the facial image and the fingerprints.

Those implementing acts shall be adopted in accordance with the advisory procedure referred to in Article 7(2).

3.   In accordance with the advisory procedure referred to in Article 7(2), it may be decided that the specifications referred to in paragraph 2 of this Article shall be secret and not be published. In that case, they shall be made available only to the single entity designated by the Commission in accordance with Article 2(3) and on the condition that this single entity shall guarantee an adequate level of protection.

4.   The Commission shall establish, by means of implementing acts, rules for institutions in cases of loss, theft, issuance of duplicates and returns of laissez-passer. Those implementing acts shall apply to all laissez passer. They shall be adopted in accordance with the advisory procedure referred to in Article 7(2).

Article 7

Committee procedure

1.   The Commission shall be assisted by the Committee established by Article 6 of Regulation (EC) No. 1683/95. That Committee shall be a committee within the meaning of Regulation (EU) No 182/2011.

2.   Where reference is made to this paragraph, Article 4 of Regulation (EU) No 182/2011 shall apply.

Article 8

Repeal and transitional provisions

1.   Regulation (ECSC, EEC, Euratom) No 1826/69 is repealed with effect from 25 November 2015. During the period from 1 January 2014 until 24 November 2015, Regulation (ECSC, EEC, Euratom) No 1826/69 shall continue to apply.

2.   Any laissez-passer issued pursuant to Regulation (ECSC, EEC, Euratom) No 1826/69 shall cease to be valid with effect from 25 November 2015.

Article 9

Entry into force

This Regulation shall enter into force on the fourth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX II

Article 1

Definitions

1.

In this Regulation, the term ‘special applicants’ means family members of a member of an institution, and the following applicants if they are on long stay outside the Union, including long-term posting:

(a)

family members of officials and other servants of the Union who fulfil the conditions laid down in Article 23 of the Staff Regulations of Officials or Articles 11 and 81 of the Conditions of Employment of Other Servants of the European Union to be issued the laissez-passer,

(b)

officials and other servants of the Union who do not fulfil the conditions laid down in Article 23 of the Staff Regulations of Officials or Articles 11 and 81 of the Conditions of Employment of Other Servants of the European Union to be issued the laissez-passer, and their family members,

(c)

Seconded National Experts (‘SNEs’) and their family members, and

(d)

Junior Professionals in Delegation (‘JPDs’) and their family members.

2.

In this Regulation, the term ‘original holder’ means members of an institution, officials and other servants of the Union, SNEs and JPDs holding a laissez-passer pursuant to this Regulation.

3.

The term ‘family member’ referred to in this Regulation shall cover mutatis mutandis the spouse or registered partner within the meaning of Article 1 of Annex VII of the Staff Regulations of Officials, the unmarried partner within the meaning of Article 72(1) of the Staff Regulations of Officials, the dependent children within the meaning of Article 2 of Annex VII of the Staff Regulations of Officials and the persons recognised as dependent children within the meaning of Article 2(4) of Annex VII of the Staff Regulations of Officials.

4.

Children who are members of the family as defined under Article 1 of the present Annex are covered by the exemption from the requirement to give fingerprints in accordance with point (a) of Article 1(2a) of Regulation (EC) No 2252/2004.

Article 2

General Conditions applicable to the categories of applicants under Article 1

1.

The attribution of a laissez-passer to the categories of special applicants under Article 1 shall only be possible in exceptional circumstances and solely if it is in the interest of the Union.

2.

In case of a long stay outside the Union, including long-term posting, the laissez-passer shall be granted for the sole purpose of the safe and correct running of the service, when exceptional circumstances and the impossibility to use national passports or travel documents justify it, in particular if it is required for the purpose of travel and proper notification and residency in a third country.

3.

The duration of validity of the laissez-passer held by a family member shall never exceed the duration of the validity of the laissez-passer held by the original holder.

4.

Any application for a laissez-passer under this Annex shall be duly motivated taking full account of the conditions listed in paragraphs 1 to 3.

5.

Applicants under Article 1 shall undergo the same identification and application procedure as the other Union laissez-passer holders.

COMMISSION IMPLEMENTING REGULATION (EU) No 1418/2013

of 17 December 2013

concerning production and marketing plans pursuant to Regulation (EU) No 1379/2013 of the European Parliament and of the Council on the common organisation of the markets in fishery and aquaculture products

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1379/2013 of the European Parliament and of the Council of 11 December 2013 on the Common organisation of the markets in fishery and aquaculture products (1), and in particular Article 29,

Whereas:

(1)

Producer organisations for fishery and aquaculture should contribute to the achievement of the objectives of the Common Fisheries Policy and the Common organisation of the markets in fishery and aquaculture products.

(2)

In particular, Regulation (EU) No 1379/2013 provides that fishery producer organisations deploy measures to promote sustainable fishing activities, reduce unwanted catches, improve traceability of fishery products and eliminate IUU fishing practices, and that aquaculture producer organisations deploy measures to promote sustainable aquaculture, ascertain consistency with national strategic plans and ensure sustainable aquaculture practices.

(3)

Furthermore, Regulation (EU) No 1379/2013 provides that fishery and aquaculture producer organisations deploy measures to improve marketing of products and economic returns of producers, stabilise the market and reduce environmental impact of fishing activities.

(4)

The production and marketing plans that producer organisations submit to their competent national authorities should aim at achieving the objectives of the Common organisation of the markets in fishery and aquaculture products.

(5)

To facilitate a homogeneous implementation by all producer organisations of the production and marketing plans and to make sure that the structure of the plans reflects the contribution to the achievement of the objectives referred to in Articles 3 and 7 of the Regulation (EU) No 1379/2013, a common format should be defined by the Commission.

(6)

Single time-limits for the submission of the production and marketing plans should be established in order to allow timely approval of those plans in view of the need to elaborate appropriate financial programming for financial support which would be available for the execution of those plans under a future Union legal act establishing the conditions for the financial support for maritime and fishery policy for the period 2014-2020.

(7)

The measures provided for in this Regulation are in accordance with the opinion of the Examination Committee for fishery and aquaculture products.

HAS ADOPTED THIS REGULATION:

Article 1

Format and structure of production and marketing plans

The format and structure of production and marketing plans referred to in Article 28 of Regulation (EU) No 1379/2013 (the ‘plans’) shall be as set out in the Annex to this Regulation.

Article 2

Time-limits and procedures for submission of plans

1.   Producer organisations shall submit their first plans to their competent national authorities by end of February 2014. For the producer organisations recognized after 1 January 2014, they shall submit their first plans to the competent national authorities eight weeks after their recognition. Subsequent plans shall be submitted eight weeks prior to the expiry of the plans in place.

2.   If a competent national authority considers that a plan submitted by a producer organisation aims to achieve the objectives referred to in Articles 3 and 7 of Regulation (EU) No 1379/2013, it shall approve that plan within six weeks following receipt and inform the producer organisation immediately.

3.   Where a competent national authority finds that the objectives referred to in Articles 3 and 7 of Regulation (EU) No 1379/2013 cannot be achieved by a plan as submitted, it shall inform the producer organisation accordingly within the deadline referred to in paragraph 2 of this Article. The producer organisation shall submit an amended plan within two weeks.

4.   The deadline for approval of the amended plan shall be four weeks following receipt.

5.   If competent national authority does not approve or does not refuse the plan according to paragraph 2 or 4, the plan is considered as approved.

Article 3

Revision of plans

1.   If a competent national authority considers that a revised plan submitted pursuant to Article 28(4) of Regulation (EU) No 1379/2013 aims to achieve the objectives referred to in Articles 3 and 7 of that Regulation, it shall approve that plan within four weeks following receipt and inform the producer organisation immediately.

2.   Where a competent national authority finds that the objectives referred to in Articles 3 and 7 of Regulation (EU) No 1379/2013 cannot be achieved by the revised plan as submitted, it shall inform the producer organisation accordingly within the deadline referred to in paragraph 1 of this Article. The producer organisation shall submit an amended plan within two weeks.

3.   The deadline for approval of the amended plan shall be four weeks following receipt.

4.   If competent national authority does not approve or does not refuse the revised plan according to paragraph 1 or 3, the plan is considered as approved.

Article 4

Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2014.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

This section shall provide a description of the penalties applicable to the different types of infringements that could occur in the implementation of the production and marketing plans. In addition, it may describe the appropriate measures provided for in Article 8 of the Regulation (EU) No 1379/2013 that the producer organisation intends to deploy to ensure the control and the compliance of their members’ activities with the rules they have established.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1379/2013 of the European Parliament and of the Council of 11 December 2013 on the common organisation of the markets in fishery and aquaculture products (1), and in particular Articles 21, 27 and 32 thereof,

Whereas:

(1)

Regulation (EU) No 1379/2013 provides for the recognition of producer organisations and inter-branch organisations, the extension of rules of producer organisations and inter-branch organisations, and the fixation of the prices triggering the storage mechanism.

(2)

It is necessary to specify the time-limits, procedures and the form of applications for the recognition and the withdrawal of recognition of producer organisations and inter-branch organisations, and the format, time-limits and procedures of the communication by Member States to the Commission of their decisions to grant or withdraw recognition.

(3)

It is necessary to specify the format and procedure of the notification by the Member States to the Commission of the rules of producer organisations or inter-branch organisations they intend to make binding on all producer organisations or operators in a specific area or in specific areas.

(4)

It is necessary to specify the format of the publication by Member States of the trigger prices to be applied by producer organisations recognised in their territories.

(5)

The measures provided for in this Regulation are in accordance with the opinion of the Examination Committee for fishery and aquaculture products,

HAS ADOPTED THIS REGULATION:

Article 1

Definitions

For the purposes of this Regulation, the following definitions apply:

(a)

‘producer organisations’ means fishery and aquaculture producer organisations and associations thereof, established pursuant to Articles 6 and 9 of Regulation (EU) No 1379/2013;

(b)

‘inter-branch organisations’ means organisations of operators established pursuant to Article 11 of Regulation (EU) No 1379/2013.

Article 2

Time-limits, procedures and form of applications for the recognition of producer organisations and inter-branch organisations

1.   Within three months of receipt of an application for recognition pursuant to Articles 14 and 16 of Regulation (EU) No 1379/2013, the Member State concerned shall inform the producer organisation or the inter-branch organisation in writing of its decision. If recognition is refused, the Member State shall give reasons for the refusal.

2.   The form of applications for the recognition of producer organisations and inter-branch organisations shall be as set out in Annex I.

Article 3

Time-limits and procedure for the withdrawal of recognition of producer organisations and inter-branch organisations

When a Member State intends to withdraw the recognition of a producer organisation or an inter-branch organisation pursuant to Article 18 of Regulation (EU) No 1379/2013, it shall notify that intention to the organisation concerned together with the reasons for the withdrawal. The Member State shall allow the producer organisation or the inter-branch organisation concerned to submit its observations within two months.

Article 4

Format, time-limits and procedures for communicating decisions to grant or withdraw recognition

1.   The format of the communication by Member States to the Commission of their decisions to grant or withdraw recognition of producer organisations or inter-branch organisations pursuant to Articles 14, 16 or 18 of Regulation (EU) No 1379/2013 shall be as set out in Annex II.

2.   Member States shall transmit the communication of a decision referred to in the first paragraph within two months of the date of that decision.

3.   Communications shall be transmitted in the form of a XML file, one for each communication. The XML file shall be sent to the Commission as an attachment to the functional mailbox: MARE-B2@ec.europa.eu with the subject: communication on POs/IBOs.

Article 5

Format and procedure of the notification by the Member States of the rules they intend to make binding on all producers or operators

1.   The format of the notification by Member States to the Commission of the rules of producer organisations or inter-branch organisations which they intend to make binding on all producers or operators in a specific area or in specific areas, as provided for in Articles 22 and 23 of Regulation (EU) No 1379/2013, shall be as set out in Annex III.

2.   Member States shall transmit the notification to the Commission at least two months in advance of the intended date of entry into force of the extension of rules.

3.   Any intended modification to the rules made binding to all producers or operators shall be notified in in accordance with paragraphs 1 and 2.

Article 6

Format of the publication of trigger prices

The format of the publication by Member States of the trigger prices referred to in Article 31(4) of Regulation (EU) No 1379/2013 shall be as set out in Annex IV to this Regulation.

Article 7

Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2014.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

where appropriate, the name of the region or regions where the trigger price apply followed by their NUTS codes in accordance with Regulation (EC) No 1059/2003 of the European Parliament and of the Council (1);

(d)

the name of fishery products subject to the fixation of trigger prices together with the FAO alpha-3 code of each species;

(e)

for each species, the applicable trigger price by weight;

(f)

the currency used.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1), and in particular Articles 4(4), 5(4), 6(7), 7(10), 9(5), 10(4), 12(5), 13(7), 17(5), 21(8), 23(5), 24(8), 25(6), 26(3), 27(6), 29(5), 34(2) and 35(3) thereof,

Having regard to Council Regulation (EC) No 2799/98 of 15 December 1998 establishing agrimonetary arrangements for the euro (2), and in particular Article 3(2) thereof,

Whereas:

(1)

Regulation (EU) No 1379/2013 of the European Parliament and of the Council (3) replaces Regulation (EC) No 104/2000 with effect from 1 January 2014, with the exception of Article 4 of Regulation (EC) No 104/2000 which applies until 12 December 2014.

(2)

Regulation (EU) No 1379/2013 has made significant changes to the provisions on consumer information, recognition of producer organisations, extension of rules, production and marketing planning, recognition of inter-branch organisations, prices, intervention, notifications and financing.

(3)

It is therefore appropriate to repeal the following implementing Regulations:

Commission Regulation (EC) No 347/96 of 27 February 1996 establishing a system of rapid reporting of the release of salmon for free circulation in the European Community (4),

Commission Regulation (EC) No 1924/2000 of 11 September 2000 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards the grant of specific recognition to producers’ organisations in the fisheries sector in order to improve the quality of their products (5),

Commission Regulation (EC) No 1925/2000 of 11 September 2000 establishing the operative events for the exchange rates to be applied when calculating certain amounts provided for by the mechanisms of Council Regulation (EC) No 104/2000 on the common organisation of the market in fishery and aquaculture products (6),

Commission Regulation (EC) No 248/2009 of 19 March 2009 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards notifications concerning recognition of producer organisations, the fixing of prices and intervention within the scope of the common organisation of the market in fishery and aquaculture products (22).

Since the provisions of Regulation (EU) No 1379/2013 on recognition of producer organisations, extension of rules, production and marketing planning, recognition of inter-branch organisations, prices, intervention and notifications apply from 1 January 2014, Regulations (EC) No 347/96, (EC) No 1924/2000, (EC) No 1925/2000, (EC) No 2508/2000, (EC) No 2509/2000, (EC) No 2813/2000, (EC) No 2814/2000, (EC) No 150/2001, (EC) No 939/2001, (EC) No 1813/2001, (EC) No 2183/2001, (EC) No 2318/2001, (EC) No 2493/2001, (EC) No 2306/2002, (EC) No 802/2006, (EC) No 2003/2006, (EC) No 696/2008 and (EC) No 248/2009 should be repealed with effect from 1 January 2014. Since the provisions of Regulation (EU) No 1379/2013 on consumer information apply from 13 December 2014, Regulation (EC) No 2065/2001 should be repealed with effect from 13 December 2014,

The measures provided for in this Regulation are in accordance with the opinion of the Examination Committee for fishery and aquaculture products.

HAS ADOPTED THIS REGULATION:

Article 1

Repeals

1.   Regulations (EC) No 347/96, (EC) No 1924/2000, (EC) No 1925/2000, (EC) No 2508/2000, (EC) No 2509/2000, (EC) No 2813/2000, (EC) No 2814/2000, (EC) No 150/2001, (EC) No 939/2001, (EC) No 1813/2001, (EC) No 2183/2001, (EC) No 2318/2001, (EC) No 2493/2001, (EC) No 2306/2002, (EC) No 802/2006, (EC) No 2003/2006, (EC) No 696/2008 and (EC) No 248/2009 are repealed with effect from 1 January 2014.

2.   Regulation (EC) No 2065/2001 is repealed with effect from 13 December 2014.

3.   The provisions of the repealed Regulations shall continue to apply to expenditure incurred pursuant to Regulation (EC) No 104/2000.

Article 2

Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COUNCIL IMPLEMENTING DECISION

of 17 December 2013

authorising the Republic of Poland to introduce measures derogating from point (a) of Article 26(1) and Article 168 of Directive 2006/112/EC on the common system of value added tax

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (1), and in particular Article 395(1) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

By a letter registered with the Commission on 18 June 2013, the Republic of Poland requested authorisation to introduce special measures derogating from point (a) of Article 26(1) and Article 168 of Directive 2006/112/EC, as regards certain motorised road vehicles and expenditure related thereto (the ‘measures’).

(2)

In accordance with the second subparagraph of Article 395(2) of Directive 2006/112/EC, the Commission transmitted the requested derogations to the other Member States by letter dated 10 October 2013. By letter dated 14 October 2013, the Commission notified the Republic of Poland that it had all the information necessary to consider the request.

(3)

Article 168 of Directive 2006/112/EC establishes a taxable person's right to deduct value added tax (VAT) charged on supplies of goods and services received by him for the purposes of his taxed transactions. Point (a) of Article 26(1) of that Directive contains a requirement to account for VAT when a business asset is put to use for the private purposes of the taxable person or his staff or, more generally, for purposes other than those of his business.

The measures requested by the Republic of Poland deviate from those provisions in that they restrict the right to deduct VAT on the purchase, hire, rent or lease of certain motorised road vehicles and expenditure related thereto, and relieve the taxable person from accounting for VAT on the non-business use of vehicles covered by the restriction.

(5)

The non-business use of motor vehicles is difficult to identify accurately, and even where it is possible, the mechanism for doing so is often burdensome. Under the requested measures, the amount of VAT on expenditure eligible for deduction concerning motor vehicles, which are not used entirely for business purposes should, with some exceptions, be set at a flat percentage rate. Based on currently available information, the Republic of Poland believes that a rate of 50 % is justifiable. At the same time, to avoid double taxation, the requirement for accounting for VAT on the non-business use of a motor vehicle should be suspended where it has been subject to this restriction. Those measures could be justified by the need to simplify the procedure for charging VAT and to prevent evasion through incorrect record keeping and false tax declarations.

The restriction on the right of deduction under the measures should apply to VAT paid on the purchase, intra-Community acquisition, importation, hire or leasing of specified motorised road vehicles and on expenditure related thereto, including the purchase of fuel.

(7)

Certain types of motor vehicles should be excluded from the scope of the measures as - due to their nature or the type of business they are used for - any non-business use is considered as negligible. Therefore, the measures should not apply to vehicles with more than 9 seats (including the driver's) or with a total maximum weight of more than 3 500 kilograms. In addition, the restriction on the right of deduction shall not apply to VAT charged on any expenditure that is entirely related to the taxable person's business.

Those derogating measures should be limited in time to allow for an evaluation of their effectiveness and of the appropriate percentage, since the proposed percentage is based on initial findings regarding business use.

(9)

Should the Republic of Poland consider a further extension of the measures beyond 2016 necessary, a report on the application of the measures in question, including a review of the percentage applied, should be submitted to the Commission together with an extension request no later than 1 April 2016.

(10)

On 29 October 2004, the Commission adopted a proposal for a Council Directive amending Council Directive 77/388/EEC (2), now Directive 2006/112/EC, that includes the harmonisation of the categories of expenses for which exclusions from the right of deduction may apply. Under that proposal, exclusions from the right to deduct could be applied to motorised road vehicles. The derogating measures provided for in this Decision should expire on the date of the entry into force of such an amending Directive, if that date is earlier than the date of expiry of this Decision.

The derogation will only have a negligible effect on the overall amount of tax collected at the stage of final consumption and will not have an adverse effect on the Union's own resources accruing from VAT,

HAS ADOPTED THIS DECISION:

Article 1

1   By way of derogation from Article 168 of Directive 2006/112/EC, the Republic of Poland is hereby authorised to limit to 50 % the right to deduct VAT on the purchase, intra-Community acquisition, importation, hire or leasing of motorised road vehicles as well as VAT charged on expenditure related to those vehicles, where the vehicle is not entirely used for business purposes.

2.   The limit of 50 % referred to in paragraph 1 shall not apply to motor vehicles with a total maximum weight of more than 3 500 kilograms or motor vehicles with more than nine seats including the driver's seat.

3.   The limit of 50 % referred to in paragraph 1 shall not apply to VAT charged on any expenditure that is entirely related to the taxable person's business.

Article 2

By way of derogation from point (a) of Article 26(1) of Directive 2006/112/EC, the Republic of Poland is authorised not to treat as a supply of services for consideration the private use by a taxable person or his staff or, more generally, the use for purposes other than those of his business, of a vehicle to which the limit of 50 % referred to in Article 1 of this Decision applies.

Article 3

1.   This Decision shall take effect on the day of its notification.

This Decision shall apply from 1 January 2014. It shall expire on 31 December 2016 or, if earlier, on the date of entry into force of Union rules determining the expenditure relating to motorised road vehicles that is not eligible for a full deduction of VAT.

2.   Any request for the extension of the measures provided for in this Decision shall be submitted to the Commission by 1 April 2016. Such request shall be accompanied by a report including a review of the percentage restriction applied on the right to deduct VAT on the basis of this Decision.

Article 4

This Decision is addressed to the Republic of Poland.

establishing the ecological criteria for the award of the EU Ecolabel for imaging equipment

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 66/2010 of the European Parliament and of the Council of 25 November 2009 on the EU Ecolabel (1), and in particular Article 8(2) thereof,

After consulting the European Union Eco-labelling Board,

Whereas:

(1)

Under Regulation (EC) No 66/2010, the EU Ecolabel may be awarded to products which have a reduced environmental impact during their entire life cycle.

(2)

Regulation (EC) No 66/2010 provides that specific EU Ecolabel criteria are to be established according to product groups.

(3)

The criteria aim, in particular, at promoting products that have a reduced environmental impact along their life cycle, which are resource efficient including energy efficient, and which contain a limited amount of hazardous substances. Since the main environmental impacts of imaging equipment along the life cycle are related to the use of paper, energy consumption and the use of hazardous substances, the products with improved performance on these aspects should be promoted. It is therefore appropriate to establish EU Ecolabel criteria for the product group ‘imaging equipment’.

(4)

The EU Ecolabel criteria will complement the ecodesign requirements for imaging equipment to be placed on the EU market that are laid down in a self-regulation measure concluded by the industry under Directive 2009/125/EC of the European Parliament and of the Council of 21 October 2009 establishing a framework for the setting of ecodesign requirements for energy-related products (2). The self-regulation measure was recognised by the European Commission in the Report from the Commission to the European Parliament and the Council on the voluntary ecodesign scheme for imaging equipment (3).

The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 16 of Regulation (EC) No 66/2010,

HAS ADOPTED THIS DECISION:

Article 1

1.   The product group ‘imaging equipment’ shall comprise products which are marketed for office or domestic use, or both, and produce printed images, in the form of paper document or photo, through a marking process from one or both of the following:

(a)

a digital image, provided by a network or card interface;

(b)

a hardcopy through a copying process.

Imaging equipment which have the additional function to produce a digital image from a hard copy through a scanning process are included in the scope of this Decision. This Decision shall apply to products which are marketed as printers, copiers and multifunctional devices.

2.   Fax machines, digital duplicators, mailing machines and scanners are excluded from the scope of this Decision.

3.   Large products which are not typically used in household and office equipment shall also be excluded from the scope of this Decision where they meet one of the following technical specifications:

(a)

standard black and white format products with maximum speed over 66 A4 images per minute;

(b)

standard colour format products with maximum speed over 51 A4 images per minute;

(c)

designed for A2 media and larger; or

(d)

products marketed as plotters;

speed to be rounded to the nearest integer.

Article 2

For the purpose of this Decision, the following definitions shall apply:

(1)

‘printer’ means a commercially available imaging product that serves as a hard copy output device, and is capable of receiving information from single-user or networked computers, or other input devices, where the unit is capable of being powered from a wall outlet or from a data or network connection;

(2)

‘copier’ means a commercially available imaging product whose sole function is the production of hard copy duplicates from graphic hard copy originals, where the unit is capable of being powered from a wall outlet or from a data or network connection;

(3)

‘multifunction device’ means a commercially available imaging product which is a physically integrated device or a combination of functionally integrated components that performs two or more of the core functions of copying, printing, scanning, or faxing, where the unit is capable of being powered from a wall outlet or from a data or network connection and the copy functionality is distinct from single sheet convenience copying offered by fax machines;

(4)

‘packaging’ means all products made of any materials of any nature used for the containment, protection, handling, delivery and presentation of goods, from the producer to the user;

(5)

‘recycling’ means any recovery operation by which waste materials are reprocessed into products, materials or substances whether for the original or other purposes, including the reprocessing of organic material but not energy recovery and reprocessing into materials that are to be used as fuels or for backfilling operations;

(6)

‘reuse’ means any operation by which products or components that are not waste are used again for the same purpose for which they were conceived;

(7)

‘reused content (of a product)’ means the content of a product which has undergone a reuse operation;

(8)

‘cartridge anti-reutilisation devices’ means devices fitted on the cartridge and or software/hardware that is necessary for the cartridge functioning that result in hampering the direct cartridge reuse;

(9)

‘spare part’ means an interchangeable part that is kept in an inventory and used for the repair or replacement of failed parts;

(10)

‘consumables’ means articles other than electricity which are also marketed separately from the main imaging equipment and that are necessary for the product operation;

(11)

‘networked equipment’ means equipment that can connect to a network and has one or more network ports;

(12)

‘network port’ means a wired or wireless physical interface of the network connection located at the equipment through which the equipment is able to be remotely activated;

(13)

‘networked equipment with high network availability (HiNA equipment)’ means equipment with one or more of the following functionalities as the main function(s): router, network switch, wireless network access point, hub, modem, VoIP telephone, video phone;

(14)

‘large format printing equipment’ means printing equipment designed for printing on A2 media and larger, including those designed to accommodate continuous-form media above 406 mm wide.

Article 3

The criteria for awarding the EU Ecolabel under Regulation (EC) No 66/2010, for a product falling within the product group ‘imaging equipment’ defined in Article 1 of this Decision as well as the related assessment and verification requirements, are set out in the Annex.

Article 4

The criteria and the related assessment requirements set out in the Annex, shall be valid for four years from the date of adoption of this Decision.

Article 5

For administrative purposes, the code number assigned to the product group ‘imaging equipment’ shall be 43.

Article 6

This Decision is addressed to the Member States.

The specific assessment and verification requirements are indicated within each criterion.

All imaging equipment applying for EU Ecolabel must fulfil the criteria. Where the applicant is required to provide declarations, documentation, analyses, test reports, or other evidence to show compliance with the criteria, it is understood that these may originate from the applicant and/or his supplier(s) and/or their supplier(s), as appropriate.

Where appropriate, test methods other than those indicated for each criterion may be used if their equivalence is accepted by the competent body assessing the application.

Where possible, the testing should be performed by laboratories that meet the general requirements of European Standard EN ISO 17025 or equivalent.

Where appropriate, competent bodies may require supporting documentation and may carry out independent verifications.

PAPER MANAGEMENT

Criterion 1.   Availability of N-up printing

Imaging equipment shall offer as a standard feature the capability to print and/or copy two or more pages of a document on one sheet of paper when the product is managed by original software provided by the manufacturer.

Assessment and verification: the applicant shall provide to the awarding competent body a declaration of compliance with those requirements including an explanation as to how users can access the printing of two or more pages on one sheet of paper.

Criterion 2.   Duplex printing

Imaging equipment with a maximum operating speed for monochrome printing and/or copying of 19 images per minute (ipm) or more for A4 size paper shall be equipped with an automatic double-side print/copy unit.

The duplex printing and/or copying function shall be set as default in the original software provided by the manufacturer. For the devices receiving a printing order from a computer, a message should be formulated by the manufacturer and displayed on the computer screen of the user when the default setting is changed into one-side printing. The content of this message should highlight the fact that one-side printing mode will contribute to significantly higher environmental impacts than double-side printing.

Assessment and verification: the applicant shall provide to the awarding competent body a declaration of compliance with those requirements including declaration of the speed for monochrome printing and an explanation as to which message and where and when such message for devices receiving a printing order from computer, is displayed to users.

Criterion 3.   Use of recycled paper

Imaging equipment shall be capable of processing recycled paper made of 100 % post-consumer paper that meets the requirements of EN 12281:2002.

Assessment and verification: the applicant shall provide to the awarding competent body a declaration of compliance with those requirements.

Criterion 4.   Energy efficiency

(a)

The energy consumption of the product shall fulfil the energy efficiency requirements of Energy Star v.2.0 (1) criteria for imaging equipment.

(b)

Power consumption in a condition providing ‘networked standby’:

(i)

the power consumption of equipment with HiNA functionality, in a condition providing networked standby into which the equipment is switched by the power management function, or a similar function, shall not exceed 3,00 W;

(ii)

the power consumption of other networked equipment in a condition providing networked standby into which the equipment is switched by the power management function, or a similar function, shall not exceed 1,50 W;

(iii)

networked equipment that has one or more standby mode(s) shall comply with the requirements for these standby mode(s) when all network ports are disconnected or, for wireless network ports, the network ports are deactivated;

(iv)

the power consumption limits as stipulated at points (i) and (ii) above shall not apply to large format printing equipment and to printing equipment with a power supply of a rated power larger than 750 W.

Assessment and verification:

As regards point (a): the applicant shall provide to the competent bodies a declaration of compliance with the energy efficiency requirements as set in Energy Star v.2.0 and a test report with the results of the energy efficiency test according to the methods specified in Energy Star. Energy Star v.2.0 labelled products are deemed to comply with the requirements of this criterion and the applicant shall submit a copy of the Energy Star registration form.

As regards point (b): the applicant shall provide to the competent bodies a declaration that it meets the criteria including a test report stating the consumption in the network standby mode.

INDOOR AIR EMISSIONS

Criterion 5.   Restriction on indoor emissions

In the use phase the product shall not emit the air pollutants listed in Table 1 in amounts higher than the maximum emission rates:

All the maximum emission rates set out in Table 1 shall be measured in accordance with the requirements described in Blue Angel RAL UZ 171 of July 2012 (2).

Assessment and verification: the applicant shall submit to the competent body a test report containing the results of the emission test according to the methods specified in Blue Angel RAL UZ 171 of July 2012. The testing laboratory performing the test shall be accredited according to EN ISO/IEC 17025. The applicant shall attach a copy of the valid accreditation certificate of the test laboratory.

NOISE EMISSIONS

Criterion 6.   Noise emissions

The noise emission shall be rated by the declared A-weighted sound power level depending on printing speed per minute given in dB with one decimal place accuracy (or in B with two decimal places accuracy).

The declared A-weighted sound power level LWAd of the product shall not exceed the following limits while operating:

(a)

for monochrome printing — the A-weighted sound power level limit value LWAd,lim,bw shall be determined depending on the operating speed Sbw given with one decimal place accuracy according to the following formula:

For serial electrophotographic colour devices with Sco ≤ 0,5 Sbw the sound power level shall be determined and indicated. For assessment purposes compliance with LWAd,lim,bw for monochrome printouts with printing speed Sbw shall be considered exclusively.

Assessment and verification: the applicant shall demonstrate compliance with the criteria requirements and submit a test report containing the results of the A-weighted sound power according to the methods specified in ISO 7779 3rd edition (2010). The testing laboratory performing the test must be accredited according to EN ISO/IEC 17025 as well as according to ISO 7779 for acoustic measurements. The applicant shall attach a copy of the valid accreditation certificate of the test laboratory.

SUBSTANCES AND MIXTURES IN IMAGING EQUIPMENT

Criterion 7.   Excluded or limited substances and mixtures

(a)   Hazardous substances and mixtures

According to Article 6(6) of Regulation (EC) No 66/2010 the EU Ecolabel may not be awarded to any product or any article of it as defined in Article 3(3) of Regulation (EC) No 1907/2006 of the European Parliament and of the Council (3) or homogenous part of it that contains substances meeting criteria for classification with the hazard statements or risk phrases as specified in Table 2 in accordance with Regulation (EC) No 1272/2008 of the European Parliament and of the Council (4) or Council Directive 67/548/EC (5), or substances referred to in Article 57 of Regulation (EC) No 1907/2006. In case the threshold for classification of a substance or mixture with a hazard class differs from the one of a risk phrase than the former prevails. The risk phrases in Table 2 generally refer to substances. However, if information on substances cannot be obtained, the classification rules for mixtures apply. Substances or mixtures which change their properties through processing and thus become no longer bioavailable, or undergo chemical modification in a way that removes the previously identified hazard are exempted from criterion 7(a).

Concentration limits for substances or mixtures which may be or have been assigned the hazard statements or risk phrase listed in Table 2, meeting the criteria for classification in the hazard classes or categories, and for substances meeting the criteria set out in point (a), (b) or (c) of Article 57 of Regulation (EC) No 1907/2006, shall not exceed the generic or specific concentration limits determined in accordance with Article 10 of Regulation (EC) No 1272/2008. Where specific concentration limits are determined they shall prevail over the generic ones.

Concentration limits for substances meeting criteria set out in point (d), (e) or (f) of Article 57 of Regulation (EC) No 1907/2006 shall not exceed 0,1 % weight by weight.

The final product shall not be labelled with a hazard statement.

For imaging equipment, the substances/components in Table 3 are exempted from the obligation in Article 6(6) of Regulation (EC) No 66/2010 following application of Article 6(7) of the same Regulation:

Assessment and verification: for the product or any article or homogenous part of it, the applicant shall provide a declaration of compliance with criterion 7(a), together with related documentation, such as declarations of compliance signed by their suppliers, on the non-classification of the substances or materials with any of the hazard classes associated to the hazard statements referred to in Table 2 in accordance with Regulation (EC) No 1272/2008, as far as this can be determined, as a minimum, from the information meeting the requirements listed in Annex VII to Regulation (EC) No 1907/2006. This declaration shall be supported by summarised information on the relevant characteristics associated to the hazard statements referred to in Table 2, to the level of detail specified in Sections 10, 11 and 12 of Annex II to Regulation (EC) No 1907/2006.

Information on intrinsic properties of substances may be generated by means other than tests, for instance through the use of alternative methods such as in vitro methods, by quantitative structure activity models or by the use of grouping or read-across in accordance with Annex XI to Regulation (EC) No 1907/2006. The sharing of relevant data across the supply chain is strongly encouraged.

The information provided shall relate to the forms or physical states of the substance or mixtures as used in the final product.

For substances listed in Annexes IV and V to Regulation (EC) No 1907/2006 which are exempted from registration obligations under points (a) and (b) of Article 2(7) of that Regulation, a declaration by the applicant shall suffice to comply with criterion 7(a).

(b)   Substances listed in accordance with Article 59(1) of Regulation (EC) No 1907/2006

No derogation from the exclusion in Article 6(6) of Regulation (EC) No 66/2010 shall be given concerning substances identified as substances of very high concern and included in the list provided for in Article 59(1) of Regulation (EC) No 1907/2006 (6), present in mixtures, in an article or in any homogeneous part of a complex article in concentrations > 0,1 %. Specific concentration limits determined in accordance with Article 10 of Regulation (EC) No 1272/2008 shall apply in cases where the concentration is lower than 0,1 %.

Assessment and verification: reference to the list of substances identified as substances of very high concern shall be made on the date of application. The applicant shall provide a declaration of compliance with criterion 7(b), together with related documentation, including declarations of compliance signed by the material suppliers and copies of relevant Safety Data Sheets for substances or mixtures in accordance with Annex II to Regulation (EC) No 1907/2006 for substances or mixtures. Concentration limits shall be specified in the safety data sheets in accordance with Article 31 of Regulation (EC) No 1907/2006 for substances and mixtures.

Criterion 8.   Mercury in light sources

Mercury or its compounds shall not intentionally be added to light sources used in imaging equipment.

Assessment and verification: the applicant shall declare to the competent body that the light sources of the product do not contain more than 0,1 mg of mercury or its compounds per lamp. The applicant shall also provide a brief description of the lighting system used.

REUSE, RECYCLING AND END-OF-LIFE MANAGEMENT

Criterion 9.   Design for disassembly

The manufacturer shall demonstrate that the imaging equipment can be easily dismantled by professionally trained personnel using the tools usually available to them, for the purpose of repairs and replacements of worn-out parts, upgrading older or obsolete parts, and separating parts and materials, ultimately for recycling or reuse.

Assessment and verification: a report shall be submitted with the application detailing the dismantling of the imaging equipment. It shall include an exploded diagram, in written or digital form, of the product, labelling the main components as well as identifying any hazardous substances in components.

INK AND TONER CONSUMABLES

Criterion 10.   Design for recycling and/or reuse of toner and/or ink cartridges

The products must accept remanufactured toner and/or ink cartridges.

The products shall be designed taking reuse of toner and/or ink cartridge into consideration.

The design of the cartridge recommended by the manufacturer (OEM) for use in the product shall promote its durability. Devices and practices that would prevent its reutilisation (sometimes referred to as anti-reutilisation devices/practises) shall not be present or applied. This requirement shall not apply to imaging equipment that is not using cartridges.

Assessment and verification: the applicant shall declare compliance with the criterion. The applicant shall provide to the competent body a copy of the user information. The applicant shall submit instructions on how the cartridge can be remanufactured and/or refilled or provide a proof (i.e. one sample) that cartridges has been remanufactured or refilled following the provided instructions.

Criterion 11.   Toner and/or ink cartridge take-back requirement

The applicant shall offer to users a take-back system for the return, in person or by shipment, of toner and/or ink modules and toner and/or ink containers supplied or recommended by the applicant for use in the product, in order to channel such modules and containers to reuse and/or material recycling with preference given to reuse. This also applies to residual toner containers.

Third parties may be subcontracted to perform this task and they shall be provided with instructions for proper handling of residual toner. Non-recyclable product parts shall be properly disposed. Modules and containers shall be taken back free of charge by the return facility named by the applicant. The product documents shall include detailed information on the return system.

Assessment and verification: a declaration that a take back system is offered to users for toner and/or ink modules and toner and/or ink containers and that such consumables collected are channelled for reuse and/or recycling signed either by the applicant or by the subcontracted third parties shall be provided to the awarding competent body.

Criterion 12.   Substances in ink and toners

(a)

No substances may be added to toners and inks (including solid inks) supplied or recommended by applicant for use in the product which contain mercury, cadmium, lead, nickel or chromium-VI-compounds as constituents. High molecular weight complex nickel compounds as colorants shall be exempted. Production-related contamination by heavy metals, such as cobalt and nickel oxides shall be kept as low as technically possible and economically reasonable.

(b)

Azo colorants that might release carcinogenic aromatic amines appearing on the list of aromatic amines according to Annex XVII to Regulation (EC) No 1907/2006, shall not be used in toners and inks supplied or recommended by the applicant for use in the product.

(c)

Only those substances which are listed as so-called existing substances in Annex II to Commission Regulation (EC) No 2032/2003 (7) may be added as active biocides to inks supplied or recommended by the applicant for use in the product.

Assessment and verification: the applicant shall declare compliance with those requirements. A declaration of compliance signed by the ink and toner supplier(s) and copies of relevant safety data sheets about materials and substances shall also be provided to the awarding competent body.

OTHER CRITERIA

Criterion 13.   Packaging

Where cardboard boxes are used for the final packaging, they shall be made of at least 80 % recycled material.

Where plastic bags are used for the final packaging, they shall be made of at least 75 % of recycled material or they shall be biodegradable or compostable, in agreement with the definitions provided by the EN 13432 or equivalent.

Assessment and verification: the applicant shall declare compliance with those requirements and copies of material specifications from packaging material suppliers, shall also be provided to the competent body. Only primary packaging, as defined in Directive 94/62/EC of the European Parliament and of the Council (8) is subject to the criterion.

Criterion 14.   Warranty, guarantee of repairs and supply of spare parts

The applicant shall provide a guarantee (or warranty) for repair or replacement of minimum 5 years.

The applicant shall ensure that a supply of spare parts and necessary infrastructure for equipment repair is available for a period of at least 5 years after the end of production of a given model and that users are informed about the guaranteed availability of spare parts. This clause shall not apply in the case of unavoidable and temporary circumstances that are beyond manufacturer’s control such as a natural disaster.

Assessment and verification: the applicant shall declare to the competent body the guarantee of repairs and supply of spare parts and provide samples of the product information sheet and warranty terms to the awarding competent body. The applicant can also make available spare parts for its product, free of charge or at a cost, via third parties.

Criterion 15.   User Information

The applicant shall inform the user, in all the languages of the countries in which the product is marketed, as follows:

(a)

Environmental relevance of paper consumption

The following message shall be included in the instruction manual of the product:

‘The main environmental impacts of this product along its life cycle are related to the consumption of paper. The less paper is used the lower the overall life cycle environmental impacts. It is recommended to apply double side printing and make use of the function of multiple page printing in one paper sheet.’

(b)

Noise

When the measured A-weighted sound power level of the device exceeds 63,0 dB(A), the following message shall be included in the instruction manual of the product:

‘This device has noise emissions LWAd higher than 63,0 dB(A) and is not suitable for use in rooms where people do primarily intellectual work. This device should be placed in a separate room because of its noise emission’.

(c)

Ink and toner cartridges:

the following message shall be included in the instruction manual of the product:

‘The cartridges of this equipment are designed for reuse. It is recommended to reuse the cartridge as this is saving resource.’

In addition, the cartridge ink yield and the yield of number of printouts shall be clearly written on the packaging of the recommended for use (OEM) cartridge.

Criterion 15(c) is not applicable to cartridge free imaging equipment.

(d)

A guide shall be provided with instructions on how to maximise the environmental performance of the particular imaging equipment (covering paper management functions, energy efficiency functions, waste management of the product and of any consumables such as ink and/or toner cartridges) in written form as a specific part of the user manual and in digital form accessible via the manufacturers website. Such specific part of the user manual shall also include information on the percentage of total recycled and reused content by mass of the product.

(e)

Recycled paper:

the following message shall be included in the instruction manual of the product:

‘This product is capable of processing recycled paper made of 100 % post-consumer paper’

Assessment and verification: a declaration signed by the manufacturer declaring compliance with those requirements and evidence of the required user information in the form of a copy of the booklet or manual where the information is presented shall be provided by the applicant to the awarding competent body. A copy of the instruction manual shall be supplied to the awarding competent body. This manual shall be available for free access on the manufacturer’s website.

Criterion 16.   Information appearing on the EU Ecolabel

Optional label with text box shall contain the following text:

Minimised use of hazardous substances

COMMISSION IMPLEMENTING DECISION

of 17 December 2013

confirming or amending the average specific emissions of CO2 and specific emissions targets for manufacturers of new light commercial vehicles for the calendar year 2012 pursuant to Regulation (EU) No 510/2011 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 510/2011 of the European Parliament and of the Council of 11 May 2011 setting emission performance standards for new light commercial vehicles as part of the Union’s integrated approach to reduce CO2 emissions from light-duty vehicles (1), and in particular Article 8(6) and Article 10(1) thereof,

Whereas:

(1)

The Commission is required, pursuant to Article 8(6) of Regulation (EU) No 510/2011, to confirm or amend each year the average specific emissions of CO2 and the specific emissions target for each manufacturer of light commercial vehicles in the Union. On that basis, the Commission is to determine whether manufacturers and pools of manufacturers formed in accordance with Article 7(1) of that Regulation have complied with their specific emissions targets in accordance with Article 4 of that Regulation.

For the calendar years 2012 and 2013, the specific emissions targets are not binding and the Commission should therefore calculate indicative targets. As those indicative targets will serve as indicators to manufacturers of the effort required to reach the mandatory target in 2014, it is appropriate to determine the average specific emissions of CO2 of manufacturers for 2012 and 2013 in accordance with the requirements set out in the third paragraph of Article 4 of Regulation (EU) No 510/2011 and take into account 70 % of the manufacturer’s new light commercial vehicles registered in that year.

The detailed data to be used for the calculation of the average specific emissions of CO2 and the specific emissions targets are set out in point 1 of Part A of Annex II to Regulation (EU) No 510/2011 and are based on Member States’ registrations of new light commercial vehicles.

(4)

Where light commercial vehicles are type-approved in a multi-stage process, point 7 of Part B of Annex II to Regulation (EU) No 510/2011 requires that the manufacturer of the base vehicle take responsibility for the CO2 emissions of the completed vehicle. Pending the applicability of the procedure for determining CO2 emissions from this category of vehicles as provided for in Section 5 of Annex XII to Commission Regulation (EC) No 692/2008 (2), the Commission should calculate the specific emissions target for manufacturers of base vehicles using the mass in running order of the completed vehicle as defined in Article 3(1)(g) of Regulation (EU) No 510/2011 and should use the specific emissions of CO2 of the base vehicle in accordance with the second paragraph of Article 4 of that Regulation.

The complete datasets for all Member States were made available to the Commission by the end of March 2013. Where, as a result of the verification of the data by the Commission, it was evident that certain data were missing or manifestly incorrect, the Commission contacted the Member States concerned and, subject to the agreement of those Member States, adjusted or completed the data accordingly. Where no agreement could be reached with a Member State, the provisional data of that Member State were not adjusted.

It should be noted that several Member States have not been able to distinguish between complete and completed light commercial vehicles in their current monitoring systems. As a consequence, the 2012 data for light commercial vehicles should be considered incomplete with regard to the monitoring of vehicles type-approved in a multi-stage process. In order to ensure a full and accurate monitoring of the CO2 emissions and the technical data relating in particular to multi-stage vehicles, it is necessary to adjust the monitoring systems both at Union and Member State level. Therefore, the final values as confirmed in this Decision should not be considered fully representative of the CO2 emissions performance of the new vehicle fleet in 2012.

On 18 June 2013, the Commission published the provisional data on light commercial vehicles and notified 60 manufacturers of the provisional calculations of their average specific emissions of CO2 in 2012 and their specific emissions targets in accordance with Article 8(4) of Regulation (EU) No 510/2011. Manufacturers were asked to verify the data and to notify the Commission of any errors within three months of receipt of the notification in accordance with the Article 8(5) of that Regulation. Four manufacturers notified the Commission that they accepted the preliminary data without corrections whilst 24 manufacturers submitted notifications of errors.

For the 36 manufacturers that did not notify any errors in the datasets, the provisional data and provisional calculations of the average specific emissions of CO2 and the specific emissions targets should be confirmed without adjustments.

(9)

The Commission has verified the corrections notified by the manufacturers and the respective justifications and the datasets have been adjusted as appropriate.

(10)

In the case of records with missing or incorrect identification parameters, such as type, variant, version code or type-approval number, the fact that manufacturers cannot verify or correct those records should be taken into account. As a consequence, it is appropriate to apply an error margin to the CO2 emissions and mass values in those records.

(11)

The error margin should be calculated as the difference between the distances to the specific emissions target expressed as the specific emissions targets subtracted from the average emissions calculated including and excluding those registrations that cannot be verified by the manufacturers. Regardless of whether that difference is positive or negative, the error margin should always improve the distance to the target of the manufacturer.

(12)

Article 1

The values relating to the performance of manufacturers, as confirmed or amended for each manufacturer of light commercial vehicles and for each pool of manufacturers of light commercial vehicles in respect of the 2012 calendar year in accordance with Article 8(6) of Regulation (EU) No 510/2011, are specified in the Annex to this Decision.

The values referred to in points (a) to (e) of Article 10(1) of Regulation (EU) No 510/2011 for each manufacturer of light commercial vehicles and for each pool of manufacturers of light commercial vehicles in respect of the 2012 calendar year are also specified in the Annex to this Decision.

Column A:

Table 1: ‘Manufacturer name’ means the name of the manufacturer as notified to the Commission by the manufacturer concerned or, where no such notification has taken place, the name registered by the registration authority of the Member State.

Table 2: ‘Pool name’ means the name of the pool declared by the pool manager.

Column B:

‘P’ means that the manufacturer is a member of a pool (listed in Table 2) formed in accordance with Article 7 of Regulation (EU) No 510/2011 and the pooling agreement is valid for the calendar year 2012.

Column C:

‘Number of registrations’ means the total number of new cars registered by Member States in a calendar year, not counting those registrations that relate to records where the values for mass or CO2 are missing and those records which the manufacturer does not recognise. The number of registrations reported by Member States may otherwise not be changed.

Column D:

‘Average CO2 (70 %) corrected’ means the average specific emissions of CO2 that have been calculated on the basis of the 70 % lowest emitting vehicles in the manufacturer’s fleet in accordance with the third paragraph of Article 4 of Regulation (EU) No 510/2011. Where appropriate, the average specific emissions of CO2 have been adjusted to take into account the corrections notified to the Commission by the manufacturer concerned. The records used for the calculation include those that contain a valid value for mass and CO2 emissions.

Column E:

‘Specific emissions target’ means the emissions target calculated on the basis of the average mass of all vehicles attributed to a manufacturer applying the formula set out in Annex I to Regulation (EU) No 510/2011.

Column F:

‘Distance to target’ means the difference between the average specific emissions of CO2 specified in column D and the specific emissions target in column E. Where the value in column F is positive, the average specific emissions of CO2 exceed the specific emissions target.

Column G:

‘Distance to target adjusted’ means that where the values in this column are different from those in column F, the values in that column have been adjusted to take into account an error margin. The error margin is calculated in accordance with the following formula:

Where appropriate, the average specific emissions of CO2 have been adjusted to take into account the corrections notified to the Commission by the manufacturer concerned. The records used for the calculation include those that contain a valid value for mass and CO2 emissions but do not take into account the super-credits referred to in Article 5 of Regulation (EU) No 510/2011.

determining quantitative limits and allocating quotas for substances controlled under Regulation (EC) No 1005/2009 of the European Parliament and of the Council on substances that deplete the ozone layer, for the period 1 January to 31 December 2014

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1005/2009 of the European Parliament and of the Council of 16 September 2009 on substances that deplete the ozone layer (1), and in particular to Articles 10(2) and 16(1) thereof,

Whereas:

(1)

The release for free circulation in the Union of imported controlled substances is subject to quantitative limits.

(2)

The Commission is required to determine those limits and allocate quotas to undertakings.

(3)

Furthermore, the Commission is required to determine the quantities of controlled substances other than hydrochlorofluorocarbons that may be used for essential laboratory and analytical uses, and the companies that may use them.

(4)

The determination of the allocated quotas for essential laboratory and analytical uses has to ensure that the quantitative limits set out in Article 10(6) are respected, applying Commission Regulation (EU) No 537/2011 (2). As those quantitative limits include quantities of hydrochlorofluorocarbons licensed for laboratory and analytical uses, the production and import of hydrochlorofluorocarbons for those uses should also be covered by that allocation.

The Commission has published notice to undertakings intending to import or export controlled substances that deplete the ozone layer to or from the European Union in 2014 and to undertakings intending to produce or import these substances for essential laboratory and analytical uses in 2014 (3), and has thereby received declarations on intended imports in 2014.

The quantitative limits and quotas should be determined for the period 1 January to 31 December 2014, in line with the annual reporting cycle under the Montreal Protocol on Substances that Deplete the Ozone Layer.

The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 25(1) of Regulation (EC) No 1005/2009,

HAS ADOPTED THIS DECISION:

Article 2

Allocation of quotas for release for free circulation

1.   The allocation of quotas for chlorofluorocarbons 11, 12, 113, 114 and 115 and other fully halogenated chlorofluorocarbons during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex I.

2.   The allocation of quotas for halons during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex II.

3.   The allocation of quotas for carbon tetrachloride during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex III.

4.   The allocation of quotas for 1,1,1-trichloroethane during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex IV.

5.   The allocation of quotas for methyl bromide during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex V.

6.   The allocation of quotas for hydrobromofluorocarbons during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex VI.

7.   The allocation of quotas for hydrochlorofluorocarbons during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex VII.

8.   The allocation of quotas for bromochloromethane during the period 1 January to 31 December 2014 shall be for the purposes and to the undertakings indicated in Annex VIII.

9.   The individual quotas for undertakings shall be as set out in Annex IX.

Article 3

Quotas for laboratory and analytical uses

The quotas for importing and producing controlled substances for laboratory and analytical uses in the year 2014 shall be allocated to the undertakings listed in Annex X.

The maximum quantities that may be produced or imported in 2014 for laboratory and analytical uses allocated to these undertakings are set out in Annex XI.

Article 4

Period of validity

This Decision shall apply from 1 January 2014 and shall expire on 31 December 2014.
