COMMISSION IMPLEMENTING REGULATION (EU) No 878/2012
of 26 September 2012
establishing the standard import values for determining the entry price of certain fruit and vegetables
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),
Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,
Whereas:

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto. |
(2) |
The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) No 879/2012
of 26 September 2012
fixing the allocation coefficient for the issuing of import licences applied for from 8 to 14 September 2012 for sugar products under certain tariff quotas and suspending submission of applications for such licences
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),
Having regard to Commission Regulation (EC) No 1301/2006 of 31 August 2006 laying down common rules for the administration of import tariff quotas for agricultural products managed by a system of import licences (2), and in particular Article 7(2) thereof,
Having regard to Commission Regulation (EC) No 891/2009 of 25 September 2009 opening and providing for the administration of certain Community tariff quotas in the sugar sector (3), and in particular Article 5(2) thereof,
Whereas:

Quantities covered by applications for import licences submitted to the competent authorities from 8 to 14 September 2012 in accordance with Regulation (EC) No 891/2009, exceed the quantity available under order numbers 09.4317, 09.4318, 09.4319, 09.4320 and 09.4321. |
(2) |
In these circumstances, an allocation coefficient for licences to be issued regarding order numbers 09.4317, 09.4318, 09.4319, 09.4320 and 09.4321 should be fixed in accordance with Regulation (EC) No 1301/2006. Submission of further applications for licences for these order numbers should be suspended until the end of the marketing year, in accordance with Regulation (EC) No 891/2009, |
HAS ADOPTED THIS REGULATION:
Article 1
1. The quantities for which import licence applications have been lodged under Regulation (EC) No 891/2009 from 8 to 14 September 2012 shall be multiplied by the allocation coefficients set out in the Annex to this Regulation.
2. Submission of further applications for licences, which correspond to the order numbers indicated in the Annex, shall be suspended until the end of the marketing year 2012/13.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

DECISION OF THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES
of 20 September 2012
appointing a Judge to the Court of Justice
(2012/521/EU)
THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 19 thereof,
Having regard to the Treaty on the Functioning of the European Union, and in particular Articles 253 and 255 thereof,
Whereas:
(1) |
The terms of office of 14 Judges and four Advocates-General of the Court of Justice are due to expire on 6 October 2012. Therefore, for the period from 7 October 2012 to 6 October 2018, 14 Judges and four Advocates-General had to be appointed to the Court of Justice. |
(2) |
On 25 April 2012, by Decision 2012/244/EU (1), the Representatives of the Governments of the Member States appointed 11 Judges and three Advocates-General to the Court of Justice for the period from 7 October 2012 to 6 October 2018. On 20 June 2012, by Decision 2012/345/EU (2), the Representatives of the Governments of the Member States appointed two Judges and one Advocate-General to the Court of Justice for the same period. |
(3) |
To complete the partial replacement of the Judges and Advocates-General of the Court of Justice, the Representatives of the Governments of the Member States should appoint one further Judge to the post remaining to be filled. |
(4) |
Mr Anthony BORG BARTHET has been proposed for the vacant post of Judge of the Court of Justice. |
(5) |
The panel set up by Article 255 of the Treaty on the Functioning of the European Union has given an opinion on the suitability of Mr Anthony BORG BARTHET to perform the duties of Judge of the Court of Justice, |
HAVE ADOPTED THIS DECISION:
Article 1
Mr Anthony BORG BARTHET is hereby appointed Judge to the Court of Justice for the period from 7 October 2012 to 6 October 2018.
Article 2
This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

DECISION No 3/2012 OF THE ACP-EU COMMITTEE OF AMBASSADORS
of 13 September 2012
concerning the reassignment of a part of the unallocated resources of the 10th European Development Fund (EDF) to Intra-ACP cooperation

THE ACP-EU COMMITTEE OF AMBASSADORS,
Having regard to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (1), as first amended in Luxembourg on 25 June 2005 (2), and amended for the second time in Ouagadougou on 22 June 2010 (3) (‘the ACP-EU Partnership Agreement’), and in particular paragraph 6 of Annex Ib thereto,
Whereas:

The 10th European Development Fund (EDF) Intra-ACP remaining funds are insufficient to meet the programming requirements which emerged from the 10th EDF Intra-ACP Mid-Term Review. |
(2) |
In order to continue providing a rapid and efficient response to situations of violent conflicts in Africa, the replenishment of the African Peace Facility is required. |
(3) |
To allow for the financing of EU and ACP priorities, the necessary amount should be transferred from the unallocated resources of the 10th EDF to the envelope for Intra-ACP cooperation. |
(4) |
It is appropriate for the ACP-EU Committee of Ambassadors to adopt this decision without delay, |
HAS ADOPTED THIS DECISION:
Article 1
Intra-ACP cooperation
An amount of EUR 195 million shall be transferred from the unallocated resources of the 10th EDF to the envelope for Intra-ACP cooperation, in accordance with the objectives set out in Articles 11, 28, 29 and 30 of the ACP-EU Partnership Agreement.
Article 2
Financing request
In accordance with Article 12b(a) of Annex IV to the ACP-EU Partnership Agreement, the ACP-EU Committee of Ambassadors requests the Commission to finance the activities proposed by the EU and the ACP Group of States, respectively, and notably to provide additional funding to the African Peace Facility for a total amount of EUR 100 million, in order to support the efforts of the African Union and regional organisations to address security challenges across Africa.
This Decision shall enter into force on the date of its adoption.
