DECISION OF THE EEA JOINT COMMITTEE

No 34/2012

of 30 March 2012

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 3/2012 of 10 February 2012 (1).

(2)

Commission Implementing Decision 2011/707/EU of 26 October 2011 amending Decision 2009/821/EC as regards the lists of border inspection posts and veterinary units in Traces (2) is to be incorporated into the Agreement.

(3)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in Agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the Agreement. This Decision is therefore not to apply to Liechtenstein,

HAS ADOPTED THIS DECISION:

Article 1

The following indent shall be added in point 39 (Commission Decision 2009/821/EC) in Part 1.2 of Chapter I of Annex I to the Agreement:

‘—

32011 D 0707: Commission Implementing Decision 2011/707/EU of 26 October 2011 (OJ L 281, 28.10.2011, p. 29).’.

Article 2

The text of Implementing Decision 2011/707/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 31 March 2012, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

No 35/2012

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 3/2012 of 10 February 2012 (1).

(2)

Commission Regulation (EU) No 350/2011 of 11 April 2011 amending Regulation (EC) No 1251/2008 as regards the placing on the market requirements for consignments of Pacific oysters intended for Member States or parts thereof with national measures regarding ostreid herpes virus 1 μνar (OsHV-1 μνar) approved by Decision 2010/221/EU (2) is to be incorporated into the Agreement.

(3)

Commission Implementing Decision 2011/358/EU of 17 June 2011 amending Decision 2009/719/EC authorising certain Member States to revise their annual BSE monitoring programmes (3) is to be incorporated into the Agreement.

(4)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the Agreement. This Decision is therefore not to apply to Liechtenstein,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the Agreement shall be amended as follows:

(1)

the following indent shall be added in point 86 (Commission Regulation (EC) No 1251/2008) in Part 4.2:

‘—

32011 R 0350: Commission Regulation (EU) No 350/2011 of 11 April 2011 (OJ L 97, 12.4.2011, p. 9).’;

(2)

under the heading ‘ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT’ the following indent shall be added in point 41b (Commission Decision 2009/719/EC) in Part 7.2:

‘—

Article 2

The texts of Regulation (EU) No 350/2011 and Implementing Decision 2011/358/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

Commission Implementing Decision 2011/403/EU of 7 July 2011 amending Annexes II and III to Decision 2010/221/EU as regards the withdrawal of an eradication programme regarding bacterial kidney disease for the territory of Great Britain and the approval of a surveillance programme regarding ostreid herpesvirus 1 μνar for Guernsey (2) is to be incorporated into the Agreement.

(3)

This Decision concerns legislation regarding veterinary matters. Whereas:

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 5/2012 of 10 February 2012 (1).

Commission Regulation (EU) No 170/2011 of 23 February 2011 concerning the authorisation of Saccharomyces cerevisiae MUCL 39885 as a feed additive for piglets (weaned) and amending Regulation (EC) No 1200/2005 (holder of authorisation Prosol SpA) (2) is to be incorporated into the Agreement.

(3)

Commission Regulation (EU) No 171/2011 of 23 February 2011 concerning the authorisation of 6-phytase (EC 3.1.3.26) produced by Aspergillus oryzae DSM 14223 as a feed additive for poultry and for porcine species and amending Regulation (EC) No 255/2005 (holder of authorisation DSM Nutritional Products Ltd represented by DSM Nutritional products Sp. z o.o) (3) is to be incorporated into the Agreement.

Commission Regulation (EU) No 184/2011 of 25 February 2011 concerning the authorisation of Bacillus subtilis C-3102 (DSM 15544) as a feed additive for chickens reared for laying, turkeys, minor avian species and other ornamental and game birds (holder of authorisation Calpis Co. Ltd Japan, represented by Calpis Co. Ltd Europe Representative Office) (4) is to be incorporated into the Agreement.

Commission Regulation (EU) No 212/2011 of 3 March 2011 concerning the authorisation of Pediococcus acidilactici CNCM MA 18/5M as a feed additive for laying hens (holder of authorisation Lallemand SAS) (5) is to be incorporated into the Agreement.

Commission Regulation (EU) No 221/2011 of 4 March 2011 concerning the authorisation of 6-phytase (EC 3.1.3.26) produced by Aspergillus oryzae DSM 14223 as a feed additive for salmonids (holder of authorisation DSM Nutritional Products Ltd represented by DSM Nutritional products Sp. Z o.o) (6) is to be incorporated into the Agreement.

Commission Regulation (EU) No 335/2011 of 7 April 2011 amending Regulation (EC) No 1091/2009 as regards the minimum content of the enzyme preparation of endo-1,4-beta-xylanase produced by Trichoderma reesei (MUCL 49755) and endo-1,3(4)-beta-glucanase produced by Trichoderma reesei (MUCL 49754) as a feed additive in feed for chickens for fattening (7) is to be incorporated into the Agreement.

(8)

Commission Regulation (EU) No 336/2011 of 7 April 2011 amending Regulation (EC) No 1292/2008 as regards the use of the feed additive Bacillus amyloliquefaciens CECT 5940 in feed containing diclazuril, monensin sodium and nicarbazin (8) is to be incorporated into the Agreement.

Commission Regulation (EU) No 337/2011 of 7 April 2011 concerning the authorisation of an enzyme preparation of endo-1,4-beta-xylanase and endo-1,3(4)-beta-glucanase as feed additive for poultry, weaned piglets and pigs for fattening (holder of the authorisation Danisco Animal Nutrition) (9) is to be incorporated into the Agreement.

(10)

Commission Implementing Regulation (EU) No 361/2011 of 13 April 2011 concerning the authorisation of Enterococcus faecium NCIMB 10415 as a feed additive for chickens for fattening (holder of authorisation DSM Nutritional products Ltd represented by DSM Nutritional Products Sp. z o.o) and amending Regulation (EC) No 943/2005 (10) is to be incorporated into the Agreement.

(11)

Commission Implementing Regulation (EU) No 371/2011 of 15 April 2011 concerning the authorisation of dimethylglycine sodium salt as feed additive for chickens for fattening (holder of the authorisation Taminco N.V.) (11) is to be incorporated into the Agreement.

(12)

Commission Implementing Regulation (EU) No 373/2011 of 15 April 2011 concerning the authorisation of the preparation of Clostridium butyricum FERM-BP 2789 as a feed additive for minor avian species except laying birds, weaned piglets and minor porcine species (weaned) and amending Regulation (EC) No 903/2009 (holder of authorisation Miyarisan Pharmaceutical Co. Ltd, represented by Miyarisan Pharmaceutical Europe S.L.U.) (12) is to be incorporated into the Agreement.

(13)

Commission Implementing Regulation (EU) No 388/2011 of 19 April 2011 concerning the authorisation of maduramicin ammonium alpha as a feed additive for chickens for fattening (holder of authorisation Alpharma (Belgium) BVBA) and amending Regulation (EC) No 2430/1999 (13) is to be incorporated into the Agreement.

(14)

Commission Implementing Regulation (EU) No 389/2011 of 19 April 2011 concerning the authorisation of an enzyme preparation of endo-1,4-beta-xylanase, subtilisin and alpha-amylase as feed additive for laying hens (holder of authorisation Danisco Animal Nutrition) (14) is to be incorporated into the Agreement.

(15)

Commission Implementing Regulation (EU) No 406/2011 of 27 April 2011 amending Regulation (EC) No 2380/2001 as regards the composition of the feed additive maduramicin ammonium alpha (15) is to be incorporated into the Agreement.

(16)

Commission Implementing Regulation (EU) No 495/2011 of 20 May 2011 amending Regulation (EC) No 109/2007 as regards the composition of the feed additive monensin sodium (16) is to be incorporated into the Agreement.

(17)

Commission Implementing Regulation (EU) No 496/2011 of 20 May 2011 concerning the authorisation of sodium benzoate as a feed additive for weaned piglets (holder of the authorisation Kemira Oyj) (17) is to be incorporated into the Agreement.

(18)

Commission Implementing Regulation (EU) No 515/2011 of 25 May 2011 concerning the authorisation of vitamin B 6 as a feed additive for all animal species (18) is to be incorporated into the Agreement.

(19)

Commission Implementing Regulation (EU) No 516/2011 of 25 May 2011 amending Regulation (EC) No 600/2005 as regards the use of the preparation of Bacillus licheniformis DSM 5749 and Bacillus subtilis DSM 5750 in feed containing formic acid (19) is to be incorporated into the Agreement.

Commission Implementing Regulation (EU) No 527/2011 of 30 May 2011 concerning the authorisation of a preparation of endo-1,4-β-xylanase produced by Trichoderma reesei (MUCL 49755), endo-1,3(4)-β-glucanase produced by Trichoderma reesei (MUCL 49754) and polygalacturonase produced by Aspergillus aculeatus (CBS 589.94) as feed additive for weaned piglets (holder of the authorisation Aveve NV) (20) is to be incorporated into the Agreement.

(21)

Commission Implementing Regulation (EU) No 528/2011 of 30 May 2011 concerning the authorisation of endo-1,4-β-xylanase produced by Trichoderma reesei (ATCC PTA 5588) as a feed additive for weaned piglets and pigs for fattening (holder of authorisation Danisco Animal Nutrition) (21) is to be incorporated into the Agreement.

(22)

Commission Implementing Regulation (EU) No 532/2011 of 31 May 2011 concerning the authorisation of robenidine hydrochloride as a feed additive for rabbits for breeding and rabbits for fattening (holder of authorisation Alpharma Belgium BVBA) and amending Regulations (EC) No 2430/1999 and (EC) No 1800/2004 (22) is to be incorporated into the Agreement.

(23)

Commission Regulation (EU) No 574/2011 of 16 June 2011 amending Annex I to Directive 2002/32/EC of the European Parliament and of the Council as regards maximum levels for nitrite, melamine, Ambrosia spp. and carry-over of certain coccidiostats and histomonostats and consolidating Annexes I and II thereto (23) is to be incorporated into the Agreement.

(24)

Commission Regulation (EU) No 575/2011 of 16 June 2011 on the Catalogue of feed materials (24) is to be incorporated into the Agreement.

(25)

Commission Implementing Regulation (EU) No 868/2011 of 31 August 2011 concerning the authorisation of a preparation of Lactobacillus plantarum (DSM 21762) and of a preparation of Lactobacillus buchneri (DSM 22963) as feed additives for all animal species (25) is to be incorporated into the Agreement.

(26)

Regulation (EU) No 171/2011 repeals Commission Regulation (EC) No 1500/2007 (26) which is incorporated in the Agreement and is therefore to be repealed under the Agreement.

(27)

Regulation (EU) No 575/2011 repeals Commission Regulation (EU) No 242/2010 (27) which is incorporated in the Agreement and is therefore to be repealed under the Agreement.

(28)

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the Agreement. This Decision is therefore not to apply to Liechtenstein,

HAS ADOPTED THIS DECISION:

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 5/2012 of 10 February 2012 (1).

Commission Regulation (EU) No 26/2011 of 14 January 2011 concerning the authorisation of vitamin E as a feed additive for all animal species (2) is to be incorporated into the Agreement.

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the Agreement. This Decision is therefore not to apply to Liechtenstein,

HAS ADOPTED THIS DECISION:

Legislation regarding feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the Agreement. This Decision is therefore not to apply to Liechtenstein,

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 8/2012 of 10 February 2012 (1).

(2)

Directive 2009/58/EC of the European Parliament and of the Council of 13 July 2009 on the coupling device and the reverse of wheeled agricultural or forestry tractors (2) is to be incorporated into the Agreement.

(3)

Directive 2009/59/EC of the European Parliament and of the Council of 13 July 2009 on rear-view mirrors for wheeled agricultural or forestry tractors (3) is to be incorporated into the Agreement.

(4)

Directive 2009/60/EC of the European Parliament and of the Council of 13 July 2009 on the maximum design speed of and load platforms for wheeled agricultural or forestry tractors (4) is to be incorporated into the Agreement.

(5)

Directive 2009/61/EC of the European Parliament and of the Council of 13 July 2009 relating to the installation of lighting and light-signalling devices on wheeled agricultural and forestry tractors (5) is to be incorporated into the Agreement.

(6)

Directive 2009/68/EC of the European Parliament and of the Council of 13 July 2009 on the component type-approval of lighting and light-signalling devices on wheeled agricultural or forestry tractors (6) is to be incorporated into the Agreement.

(7)

Commission Directive 2010/62/EU of 8 September 2010 amending, for the purpose of adapting their technical provisions, Council Directives 80/720/EEC and 86/297/EEC and Directives 2003/37/EC, 2009/60/EC and 2009/144/EC of the European Parliament and of the Council relating to the type-approval of agricultural or forestry tractors (7) is to be incorporated into the Agreement.

(8)

Directive 2009/58/EC repeals Council Directive 79/533/EEC (8) which is incorporated in the Agreement and is therefore to be repealed under the Agreement.

(9)

Directive 2009/59/EC repeals Council Directive 74/346/EEC (9) which is incorporated in the Agreement and is therefore to be repealed under the Agreement.

(10)

Directive 2009/60/EC repeals Council Directive 74/152/EEC (10) which is incorporated in the Agreement and is therefore to be repealed under the Agreement.

(11)

Directive 2009/61/EC repeals Council Directive 78/933/EEC (11) which is incorporated in the Agreement and is therefore to be repealed under the Agreement.

(12)

Directive 2009/68/EC repeals Council Directive 79/532/EEC (12) which is incorporated in the Agreement and is therefore to be repealed under the Agreement,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex II to the Agreement shall be amended as follows:

(1)

the text of points 3 (Council Directive 74/152/EEC), 4 (Council Directive 74/346/EEC), 14 (Council Directive 78/933/EEC), 15 (Council Directive 79/532/EEC) and 16 (Council Directive 79/533/EEC) shall be deleted;

(2)

the following indent shall be added in points 18 (Council Directive 80/720/EEC), 19 (Council Directive 86/297/EEC) and 28 (Directive 2003/37/EC of the European Parliament and of the Council):

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as stated in the introduction to Chapter XII of Annex II to the Agreement. This Decision is therefore not to apply to Liechtenstein,

HAS ADOPTED THIS DECISION:

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Articles 98 and 101 thereof,

Whereas:

(1)

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 27/2012 of 10 February 2012 (1).

(2)

Protocol 37 to the Agreement was amended by Decision of the EEA Joint Committee No 104/2011 of 30 September 2011 (2).

(3)

Commission Decision 2009/584/EC of 31 July 2009 establishing the High Level Steering Group on SafeSeaNet (3) is to be incorporated into the Agreement.

(4)

For the Agreement to function well, Protocol 37 to the Agreement is to be amended to include the High Level Steering Group on SafeSeaNet set up by Decision 2009/584/EC, and Annex XIII is to be amended in order to specify the procedures for association with this Group,

HAS ADOPTED THIS DECISION:

Article 1

The following shall be inserted after point 55aa (deleted) of Annex XIII to the Agreement:

Modalities for the association of the EFTA States in accordance with Article 101 of the Agreement:

Each EFTA State may, in accordance with Article 3 of Decision 2009/584/EC, appoint a person to participate as an observer in the meetings of the High Level Steering Group on SafeSeaNet.’.

The following point shall be inserted in Protocol 37 (containing the list provided for in Article 101) to the Agreement:

Commission Decision 2012/21/EU of 20 December 2011 on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest (2) is to be incorporated into the Agreement.

(3)

Decision 2012/21/EU repeals Commission Decision 2005/842/EC (3) which is incorporated in the Agreement and is therefore to be repealed under the Agreement,

HAS ADOPTED THIS DECISION:

Article 1

The text of point 1h (Commission Decision 2005/842/EC) of Annex XV to the Agreement shall be replaced by the following:

32012 D 0021: Commission Decision 2012/21/EU of 20 December 2011 on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest (OJ L 7, 11.1.2012, p. 3).

The provisions of the Decision shall, for the purposes of this Agreement, be read with the following adaptations:

amending Annex XXI (Statistics) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XXI to the Agreement was amended by Decision of the EEA Joint Committee No 30/2012 of 10 February 2012 (1).

(2)

Commission Regulation (EU) No 216/2010 of 15 March 2010 implementing Regulation (EC) No 862/2007 of the European Parliament and of the Council on Community statistics on migration and international protection, as regards the definitions of categories of the reasons for the residence permits (2) is to be incorporated into the Agreement,

HAS ADOPTED THIS DECISION:

Article 1

The following point shall be inserted after point 18ar (Commission Regulation (EU) No 317/2010) of Annex XXI to the Agreement:

‘18as.

32010 R 0216: Commission Regulation (EU) No 216/2010 of 15 March 2010 implementing Regulation (EC) No 862/2007 of the European Parliament and of the Council on Community statistics on migration and international protection, as regards the definitions of categories of the reasons for the residence permits (OJ L 66, 16.3.2010, p. 1).’.

Article 2

The text of Regulation (EU) No 216/2010 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

HAS ADOPTED THIS DECISION:

Article 1

The following point shall be inserted after point 18z (Regulation (EC) No 1338/2008 of the European Parliament and of the Council) of Annex XXI to the Agreement:

‘18z1.

32011 R 0328: Commission Regulation (EU) No 328/2011 of 5 April 2011 implementing Regulation (EC) No 1338/2008 of the European Parliament and of the Council on Community statistics on public health and health and safety at work, as regards statistics on causes of death (OJ L 90, 6.4.2011, p. 22).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

Liechtenstein is exempted from transmitting data on stillbirths.’.

Article 2

The text of Regulation (EU) No 328/2011 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 31 March 2012, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).
