COMMISSION REGULATION (EU) No 848/2010

derogating, for the marketing year 2010/2011, from Article 63(2)(a) of Council Regulation (EC) No 1234/2007 as regards the dates for communicating the carry forward of surplus sugar

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1), and in particular Article 85, point (c), in conjunction with Article 4 thereof,

Whereas:

According to Article 63(2), point (a) of Regulation (EC) No 1234/2007, each undertaking having decided to carry forward all or part of its production in excess of the sugar quota has to inform the Member State concerned of its decision before a date to be determined by that Member State within the time limits fixed by that Article.

(2)

In order to facilitate the supply of the out-of-quota sugar on the Union market, thereby allowing undertakings to respond to unforeseen changes in demand in the last months of the marketing year 2010/2011, it is necessary to give Member States the possibility to fix later dates for undertakings to communicate the quantity of surplus sugar to be carried forward.

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets,

HAS ADOPTED THIS REGULATION:

Article 1

By way of derogation from Article 63(2)(a) of Regulation (EC) No 1234/2007, for the marketing year 2010/2011, the undertakings having decided to carry forward quantities of sugar, in accordance with Article 63(1) of that Regulation, inform the Member State concerned before a date to be determined by that Member State between 1 February and 15 August 2011.

Article 2

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Union.

It shall apply from 1 October 2010 to 30 September 2011.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) No 849/2010

of 27 September 2010

amending Regulation (EC) No 2150/2002 of the European Parliament and of the Council on waste statistics

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 2150/2002 of the European Parliament and of the Council of 25 November 2002 on waste statistics (1), and in particular Article 6(2) thereof,

Whereas:

(1)

The evaluation of the first two data deliveries in 2006 and 2008 revealed the need for a review of certain conceptual shortcomings of the Annexes to Regulation (EC) No 2150/2002.

(2)

The Commission has informed the European Parliament and the Council on the implementation of the Regulation (EC) No 2150/2002 (2) and has proposed a number of changes.

(3)

Regulation (EC) No 2150/2002 should therefore be amended accordingly.

(4)

The measures provided for in this Regulation are in accordance with the opinion of the European Statistical System Committee, established by Regulation (EC) No 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics (3),

HAS ADOPTED THIS REGULATION:

Article 1

Annexes I, II and III to Regulation (EC) No 2150/2002 are replaced by the text set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

GENERATION OF WASTE

SECTION 1

Coverage

1.

The statistics shall be compiled for all activities classified within the coverage of Sections A to U of NACE Rev. 2. These Sections cover all economic activities.

This Annex also covers:

(a)

waste generated by households;

(b)

waste arising from recovery and/or disposal operations.

2.

Waste recycled on the site where it was generated shall not be covered by this Annex.

SECTION 3

Characteristics

Statistics shall be compiled on the following characteristics and breakdowns:

1.

The quantity of waste generated for each waste category listed in Section 2(1) and for each waste generating activity listed in Section 8(1).

2.

The population served by a collection scheme for mixed household and similar waste.

SECTION 4

Reporting unit

1.

The reporting unit to be used for all waste categories is 1 tonne of (normal) wet waste except for the waste categories “industrial effluent sludges,”“common sludges”, “sludges and liquid waste from waste treatment” and “dredging spoils” were the reporting unit is 1 tonne of dry matter.

2.

The reporting unit for characteristic referred to in Section 3(2) is the percentage of the population served.

SECTION 5

First reference year and periodicity

1.

The first reference year is the second calendar year following the entry into force of this Regulation.

2.

The first reference year for waste statistics based on this revision is 2010.

3.

Member States shall furnish data for every second year after the first reference year.

SECTION 6

Transmission of results to Eurostat

The results shall be transmitted within 18 months of the end of the reference year.

SECTION 7

Report on the coverage and quality of statistics

1.

For each item listed in Section 8 (activities and households), Member States shall indicate the percentage to which the compiled statistics represent the universe of waste of the respective item. The minimum requirement for the coverage shall be defined by the Commission. These measures, designed to amend non-essential elements of this Regulation, by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 7(3).

2.

Member States shall submit a quality report, indicating the degree of precision for the collected data. A description shall be given on the estimations, aggregations or exclusions, and the way these procedures affect the distribution of waste categories, listed in Section 2(1) by economic activities and households, as referred to in Section 8.

3.

The Commission shall include the coverage and quality reports in the report provided for in Article 8 of this Regulation.

For economic activities, statistical units are local units or kind-of-activity units, as defined in Council Regulation (EEC) No 696/93 (1), according to each Member State's statistical system.

In the quality report, to be produced under Section 7, a description of how the chosen statistical unit affects the groupings of NACE Rev. 2 data distribution should be included.

‘ANNEX II

RECOVERY AND DISPOSAL OF WASTE

SECTION 1

Coverage

1.

The statistics are to be compiled for all recovery and disposal facilities which run any of the operations referred to in Section 8(2) and which belong to or are part of the economic activities according to the groupings of NACE Rev. 2, mentioned in Annex I, Section 8(1.1).

2.

Facilities whose waste treatment activities are limited to the recycling of waste on the site where the waste was generated, are not covered by this Annex.

SECTION 2

Waste categories

The list of waste categories for which the statistics are to be compiled, according to the recovery or disposal operations as referred to in Section 8(2), are the categories mentioned in Annex I, Section 2(1).

SECTION 3

Characteristics

Statistics shall be compiled on the following characteristics and breakdowns:

The results are to be compiled for each item amongst the types of operations listed in Section 8(2), according to the characteristics referred to in Section 3.

initiating a ‘new exporter’ review of Council Regulation (EC) No 1659/2005 imposing a definitive anti-dumping duty on imports of certain magnesia bricks originating in the People’s Republic of China, repealing the duty with regard to imports from one exporter in this country and making these imports subject to registration

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community (‘the basic Regulation’) (1) and in particular Article 11(4) thereof,

After consulting the Advisory Committee,

Whereas:

A.   REQUEST FOR A REVIEW

The Commission has received an application for a ‘new exporter’ review pursuant to Article 11(4) of the basic Regulation. The application was lodged by TRL China Ltd (‘the applicant’), an exporting producer in the People’s Republic of China (‘the country concerned’).

B.   PRODUCT

The product under review is chemically bonded, unfired magnesia bricks, whose magnesia component contains at least 80 % MgO, whether or not containing magnesite, originating in the People’s Republic of China (‘the product concerned’), currently falling within CN codes ex 6815 91 00, ex 6815 99 10 and ex 6815 99 90 (TARIC codes 6815910010, 6815991020 and 6815999020).

C.   EXISTING MEASURES

The measures currently in force are a definitive anti-dumping duty imposed by Council Regulation (EC) No 1659/2005 (2) under which imports into the Union of the product concerned originating in the People’s Republic of China, including the product concerned produced by the applicant, are subject to a definitive anti-dumping duty of 39,9 % with the exception of several companies specifically mentioned which are subject to individual duty rates.

D.   GROUNDS FOR THE REVIEW

The applicant alleges that it operates under market economy conditions as defined in Article 2(7)(c) of the basic Regulation or alternatively claims individual treatment in conformity with Article 9(5) of the basic Regulation. It further alleges that it did not export the product concerned to the Union during the period of investigation on which the anti-dumping measures were based, i.e. the period from 1 April 2003 to 31 March 2004 (‘the original investigation period’) and that it is not related to any of the exporting producers of the product which are subject to the above mentioned anti-dumping measures.

The applicant further alleges that it has begun exporting the product concerned to the Union after the end of the original investigation period.

E.   PROCEDURE

Union producers known to be concerned have been informed of the above application and have been given an opportunity to comment.

Having examined the evidence available, the Commission concludes that there is sufficient evidence to justify the initiation of a ‘new exporter’ review, pursuant to Article 11(4) of the basic Regulation. Upon receipt of the claim mentioned below under recital 13, it will be determined whether the applicant operates under market economy conditions as defined in Article 2(7)(c) of the basic Regulation or alternatively whether the applicant fulfils the requirements to have an individual duty established in accordance with Article 9(5) of the basic Regulation. If so, the applicant’s individual margin of dumping shall be calculated and, should dumping be found, the level of the duty to which its imports of the product concerned into the Union should be subject shall be determined.

If it is determined that the applicant fulfils the requirements to have an individual duty established, it may be necessary to amend the rate of duty currently applicable to imports of the product concerned from companies not individually mentioned in Article 1(2) of Regulation (EC) No 1659/2005.

(a)   Questionnaires

In order to obtain the information it deems necessary for its investigation, the Commission will send a questionnaire to the applicant.

(b)   Collection of information and holding of hearings

All interested parties are hereby invited to make their views known in writing and to provide supporting evidence.

(11)

Furthermore, the Commission may hear interested parties, provided that they make a request in writing showing that there are particular reasons why they should be heard.

(12)

Attention is drawn to the fact that the exercise of most procedural rights set out in the basic Regulation depends on the parties making themselves known within the period provided for by the present Regulation.

(c)   Market economy treatment/individual treatment

In the event that the applicant provides sufficient evidence that it operates under market economy conditions, i.e. that it meets the criteria laid down in Article 2(7)(c) of the basic Regulation, normal value will be determined in accordance with Article 2(7)(b) of the basic Regulation. For this purpose, duly substantiated claims must be submitted within the specific time limit set in Article 4(3) of this Regulation. The Commission will send claim forms to the applicant, as well as to the authorities of the People’s Republic of China. This claim form may also be used by the applicant to claim individual treatment, i.e. that it meets the criteria laid down in Article 9(5) of the basic Regulation.

(d)   Selection of the market economy country

In the event that the applicant is not granted market economy treatment but fulfils the requirements to have an individual duty established in accordance with Article 9(5) of the basic Regulation, an appropriate market economy country will be used for the purpose of establishing normal value in respect of the People’s Republic of China in accordance with Article 2(7)(a) of the basic Regulation. The Commission envisages using the United States of America again for this purpose as was done in the investigation which led to the imposition of measures on imports of the product concerned from the People’s Republic of China. Interested parties are hereby invited to comment on the appropriateness of this choice within the specific time limit set in Article 4(2) of this Regulation.

Furthermore, in the event that the applicant is granted market economy treatment, the Commission may, if necessary, also use findings concerning the normal value established in an appropriate market-economy country, e.g. for the purpose of replacing any unreliable cost or price elements in the People’s Republic of China which are needed in establishing the normal value, if reliable required data are not available in the People’s Republic of China. The Commission envisages using the United States of America also for this purpose.

F.   REPEAL OF THE DUTY IN FORCE AND REGISTRATION OF IMPORTS

Pursuant to Article 11(4) of the basic Regulation, the anti-dumping duty in force should be repealed with regard to imports of the product concerned which are produced and sold for export to the Union by the applicant. At the same time, such imports should be made subject to registration in accordance with Article 14(5) of the basic Regulation, in order to ensure that, should the review result in a finding of dumping in respect of the applicant, anti-dumping duties can be levied retroactively from the date of the initiation of this review. The amount of the applicant’s possible future liabilities cannot be estimated at this stage of the proceeding.

G.   TIME LIMITS

(17)

In the interest of sound administration, time limits should be stated within which:

interested parties may make themselves known to the Commission, present their views in writing and submit the replies to the questionnaire mentioned in recital 8(a) of this Regulation or provide any other information to be taken into account during the investigation,

interested parties may make a written request to be heard by the Commission,

interested parties may comment on the appropriateness of the United States of America which, in the event that the applicant will not be granted market economy treatment, is envisaged as a market-economy country for the purpose of establishing normal value in respect of the People’s Republic of China,

the applicant should submit a duly substantiated claim for market economy treatment.

H.   NON-COOPERATION

In cases in which any interested party refuses access to or does not provide the necessary information within the time limits, or significantly impedes the investigation, findings, affirmative or negative, may be made in accordance with Article 18 of the basic Regulation, on the basis of the facts available.

(19)

Where it is found that any interested party has supplied false or misleading information, the information shall be disregarded and use may be made, in accordance with Article 18 of the basic Regulation, of the facts available. If an interested party does not cooperate or cooperates only partially, and findings are therefore based on the facts available in accordance with Article 18 of the basic Regulation, the result may be less favourable to that party than if it had cooperated.

HAS ADOPTED THIS REGULATION:

Article 1

A review of Regulation (EC) No 1659/2005 is hereby initiated pursuant to Article 11(4) of Regulation (EC) No 1225/2009 in order to determine if and to what extent the imports of chemically bonded, unfired magnesia bricks, whose magnesia component contains at least 80 % MgO, whether or not containing magnesite, currently falling within CN codes ex 6815 91 00, ex 6815 99 10 and ex 6815 99 90 (TARIC codes 6815910010, 6815991020 and 6815999020), originating in the People’s Republic of China, produced and sold for export to the Union by TRL China Ltd (TARIC additional code A985) should be subject to the anti-dumping duty imposed by Regulation (EC) No 1659/2005.

Article 2

The anti-dumping duty imposed by Regulation (EC) No 1659/2005 is hereby repealed with regard to the imports identified in Article 1 of this Regulation.

Article 3

The customs authorities are hereby directed, pursuant to Article 14(5) of Regulation (EC) No 1225/2009, to take the appropriate steps to register the imports identified in Article 1 of this Regulation. Registration shall expire nine months following the date of entry into force of this Regulation.

Article 4

1.   Interested parties, if their representations are to be taken into account during the investigation, must make themselves known to the Commission, present their views in writing and submit the replies to the questionnaire mentioned in recital 8(a) of this Regulation or any other information, unless otherwise specified, within 37 days of the entry into force of this Regulation.

Interested parties may also apply in writing to be heard by the Commission within the same 37-day time limit.

2.   Parties to the investigation wanting to comment on the appropriateness of the United States of America, which is envisaged as a market economy third country for the purpose of establishing normal value in respect of the People’s Republic of China, must submit their comments within 10 days of the date of entry into force of this Regulation.

3.   A duly substantiated claim for market economy treatment must reach the Commission within 15 days of the date of the entry into force of this Regulation.

4.   All submissions and requests made by interested parties must be made in writing (not in electronic format, unless otherwise specified) and must indicate the name, address, e-mail address, telephone and fax numbers of the interested party. All written submissions, including the information requested in this Regulation, questionnaire replies and correspondence provided by interested parties on a confidential basis shall be labelled as ‘Limited’ (4) and, in accordance with Article 19(2) of Regulation (EC) No 1225/2009, shall be accompanied by a non-confidential version, which will be labelled ‘For inspection by interested parties’.

Having regard to Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freeze of funds and other financial resources in respect of the Taliban of Afghanistan, (1) and in particular Articles 7(1)(a) and 7a(5) (2) thereof,

Whereas:

Annex I to Regulation (EC) No 881/2002 lists the persons, groups and entities covered by the freezing of funds and economic resources under that Regulation.

(2)

On 9 September 2010 the Sanctions Committee of the United Nations Security Council decided to amend the identifying data concerning four natural persons from its list of persons, groups and entities to whom the freezing of funds and economic resources should apply.

(3)

Annex I should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EC) No 881/2002 is hereby amended as set out in the Annex to this Regulation.

Having regard to Commission Regulation (EC) No 951/2006 of 30 June 2006 laying down detailed rules for the implementation of Council Regulation (EC) No 318/2006 as regards trade with third countries in the sugar sector (2), and in particular Article 36(2), second subparagraph, second sentence thereof,

Whereas:

The representative prices and additional duties applicable to imports of white sugar, raw sugar and certain syrups for the 2009/10 marketing year are fixed by Commission Regulation (EC) No 877/2009 (3). These prices and duties have been last amended by Commission Regulation (EU) No 819/2010 (4).

The data currently available to the Commission indicate that those amounts should be amended in accordance with the rules and procedures laid down in Regulation (EC) No 951/2006,

HAS ADOPTED THIS REGULATION:

Article 1

The representative prices and additional duties applicable to imports of the products referred to in Article 36 of Regulation (EC) No 951/2006, as fixed by Regulation (EC) No 877/2009 for the 2009/10, marketing year, are hereby amended as set out in the Annex hereto.

Article 2

This Regulation shall enter into force on 28 September 2010.

Having regard to Commission Regulation (EC) No 1301/2006 of 31 August 2006 laying down common rules for the administration of import tariff quotas for agricultural products managed by a system of import licences (2), and in particular Article 7(2) thereof,

Having regard to Commission Regulation (EC) No 891/2009 of 25 September 2009 opening and providing for the administration of certain Community tariff quotas in the sugar sector (3), and in particular Article 5(2) thereof,

Whereas:

Quantities covered by applications for import licences submitted to the competent authorities from 8 to 14 September 2010 in accordance with Regulation (EC) No 891/2009, exceed the quantity available under order number 09.4320.

(2)

In these circumstances, an allocation coefficient for licences to be issued regarding order number 09.4320 should be fixed in accordance with Regulation (EC) No 1301/2006. Submission of further applications for licences for that order number should be suspended until the end of the marketing year, in accordance with Regulation (EC) No 891/2009,

HAS ADOPTED THIS REGULATION:

Article 1

1.   The quantities for which import licence applications have been lodged under Regulation (EC) No 891/2009 from 8 to 14 September 2010 shall be multiplied by the allocation coefficients set out in the Annex to this Regulation.

2.   Submission of further applications for licences, which correspond to the order numbers indicated in the Annex, shall be suspended until the end of the marketing year 2010/11.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COUNCIL DECISION 2010/573/CFSP

concerning restrictive measures against the leadership of the Transnistrian region of the Republic of Moldova

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Whereas:

(1)

On 25 February 2008, the Council adopted Common Position 2008/160/CFSP concerning restrictive measures against the leadership of the Transnistrian region of the Republic of Moldova (1). By Council Decision 2010/105/CFSP, (2) those restrictive measures were extended until 27 February 2011 but their application suspended until 30 September 2010.

On the basis of a re-examination of Common Position 2008/160/CFSP, the restrictive measures should be extended until 30 September 2011.

(3)

However, in order to encourage progress in reaching a political settlement to the Transnistrian conflict, addressing the remaining problems of the Latin-script schools and restoring free movement of persons, the restrictive measures should be suspended until 31 March 2011. At the end of that period, the Council will review the restrictive measures in the light of developments, notably in the areas mentioned above. The Council may decide to reapply or lift travel restrictions at any time,

HAS ADOPTED THIS DECISION:

1.   Member States shall take the necessary measures to prevent the entry into, or transit through, their territories of the persons who are responsible:

(i)

for preventing progress in arriving at a political settlement of the Transnistrian conflict in the Republic of Moldova, as listed in Annex I;

(ii)

for the design and implementation of the campaign of intimidation and closure against Latin-script Moldovan schools in the Transnistrian region of the Republic of Moldova, as listed in Annex II.

2.   Paragraph 1 will not oblige a Member State to refuse its own nationals entry into its territory.

3.   Paragraph 1 shall be without prejudice to the cases where a Member State is bound by an obligation of international law, namely:

(i)

as a host country of an international intergovernmental organisation;

(ii)

as a host country to an international conference convened by, or under the auspices of, the United Nations;

(iii)

under a multilateral agreement conferring privileges and immunities;

or

(iv)

under the 1929 Treaty of Conciliation (Lateran pact) concluded by the Holy See (State of the Vatican City) and Italy.

4.   Paragraph 3 shall be considered as applying also in cases where a Member State is host country of the Organisation for Security and Cooperation in Europe (OSCE).

5.   The Council shall be duly informed in all cases where a Member State grants an exemption pursuant to paragraphs 3 or 4.

6.   Member States may grant exemptions from the measures imposed in paragraph 1 where travel is justified on the grounds of urgent humanitarian need, or on grounds of attending intergovernmental meetings, including those promoted by the European Union, or hosted by a Member State holding the Chairmanship in office of the OSCE, where a political dialogue is conducted that directly promotes democracy, human rights and the rule of law in the Republic of Moldova.

7.   A Member State wishing to grant exemptions referred to in paragraph 6 shall notify the Council in writing. The exemption shall be deemed to be granted unless one or more of the Council Members raises an objection in writing within two working days of receiving notification of the proposed exemption. In the event that one or more of the Council members raises an objection, the Council, acting by a qualified majority, may decide to grant the proposed exemption.

8.   In cases where pursuant to paragraphs 3, 4, 6 and 7, a Member State authorises the entry into, or transit through, its territory of persons listed in Annexes I and II, the authorisation shall be limited to the purpose for which it is given and to the persons concerned thereby.

Article 2

The Council, acting upon a proposal by a member state or the High representative of the Union for Foreign Affairs and Security Policy, shall adopt modifications to the lists contained in Annex I and Annex II as required by political developments in the Republic of Moldova.

Article 3

Council Decision 2010/105/CFSP is hereby repealed.

Article 4

1.   This Decision shall enter into force on the date of its adoption.

2.   This Decision shall apply until 30 September 2011. It shall be kept under constant review. It may be renewed or amended, as appropriate, if the Council deems that its objectives have not been met.

3.   The restrictive measures provided for in this Decision shall be suspended until 31 March 2011. At the end of that period, the Council shall review the restrictive measures.

DECISION OF THE EUROPEAN CENTRAL BANK

of 21 September 2010

concerning the administration of EFSF loans to Member States whose currency is the euro

THE EXECUTIVE BOARD OF THE EUROPEAN CENTRAL BANK,

Having regard to the Statute of the European System of Central Banks and of the European Central Bank (hereinafter the ‘Statute of the ESCB’), and in particular Articles 17 and 21 thereof,

Whereas:

(1)

Pursuant to Article 17 of the Statute of the ESCB, in order to conduct its operations, the European Central Bank (ECB) may open accounts for credit institutions, public entities and other market participants.

(2)

Pursuant to Articles 21.1 and 21.2 of the Statute of the ESCB, the ECB may act as fiscal agent for Union institutions, bodies, offices or agencies, central governments, regional, local or other public authorities, other bodies governed by public law, or public undertakings of Member States.

(3)

Reference is made to the EFSF Framework Agreement between the Member States whose currency is the euro and European Financial Stability Facility, Société Anonyme (EFSF), a public limited liability company incorporated in Luxembourg, with the Member States whose currency is the euro as its shareholders. The EFSF Framework Agreement entered into force and became binding on 4 August 2010.

Pursuant to the EFSF Framework Agreement and in accordance with EFSF’s by-laws, EFSF is to provide financing in the form of loan facility agreements (hereinafter the ‘Loan Facility Agreements’) to Member States whose currency is the euro where such Member States are in financial difficulties and have entered into a memorandum of understanding with the European Commission containing policy conditionality.

Article 3(5) of the EFSF Framework Agreement states that the disbursement of the loan made available by EFSF to a Member State whose currency is the euro shall be made through the accounts of EFSF and the relevant Member State borrower which have been opened with the ECB for the purpose of the Loan Facility Agreement. Pursuant to Article 12(2) of the EFSF Framework Agreement, EFSF may contract the ECB to act as its paying agent and may appoint the ECB to maintain its bank and securities accounts.

It is necessary to lay down provisions concerning the EFSF cash account which is to be opened with the ECB for the operation of the Loan Facility Agreements,

HAS ADOPTED THIS DECISION:

Article 1

Opening of a cash account

The ECB shall, pursuant to the EFSF Framework Agreement and in connection with the Loan Facility Agreements, open a cash account in the name of EFSF.

Article 2

Acceptance of payments on the cash account

The ECB shall only accept payments to be made to or from the cash account opened in the name of EFSF, if those payments arise in connection with the Loan Facility Agreements.

Article 3

Acceptance of instructions and managing of the cash account

The ECB shall, in relation to the cash account opened in the name of EFSF, only accept and act upon the exclusive instructions of either EFSF or any agent that EFSF may appoint under the EFSF Framework Agreement to act on its behalf. If an agent is appointed and EFSF has requested the ECB to accept such agent, the agent shall act in relation to the following activities: (a) giving instructions related to the cash account opened in the name of EFSF, and (b) managing such account on an exclusive and permanent basis.

Article 4

Balance of the cash account

No amount shall be standing to the credit of the cash account opened in the name of EFSF after payments have been made in relation to any Loan Facility Agreement, nor shall amounts be transferred to such cash account before the day on which payments need to be made in relation to any Loan Facility Agreement. No amount shall be standing to the debit of the cash account opened in the name of EFSF at any time. Therefore, no payments shall be effected from the cash account opened in the name of EFSF beyond the amounts standing to the credit of that account.

Article 5

Remuneration

Notwithstanding Article 4 above, should any amounts stand overnight to the credit of the cash account opened in the name of EFSF, the ECB shall pay interest on such balance in an amount equivalent to the applicable ECB deposit facility rate on an actual/360 basis. Interest amounts paid by the ECB to the cash account shall not be affected by Article 2.

Article 6

Entry into force

This Decision shall enter into force on the day following its publication in the Official Journal of the European Union.

DECISION No 1/2010 OF THE EU-JORDAN ASSOCIATION COUNCIL

amending Article 15(7) of Protocol 3 to the Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States, of the one part, and the Hashemite Kingdom of Jordan, of the other part, concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation

THE ASSOCIATION COUNCIL,

Having regard to the Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States, of the one part, and the Hashemite Kingdom of Jordan, of the other part, and in particular Article 39 of Protocol 3 thereto,

Whereas:

(1)

Article 15(7) of Protocol 3 (1) to the Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States, of the one part, and the Hashemite Kingdom of Jordan, of the other part (2) (hereinafter referred to as ‘the Agreement’), allows for drawback of, or exemption from, customs duties or charges having an equivalent effect, subject to certain conditions, until 31 December 2009.

(2)

To provide clarity, long-term economic predictability and legal certainty for economic operators, the parties to the Agreement have agreed to extend the application period of Article 15(7) of Protocol 3 to the Agreement by three years, with effect from 1 January 2010.

(3)

Moreover, the rates of customs charges currently applicable in Jordan should be adjusted to bring them into line with those that apply in the European Union.

(4)

Protocol 3 to the Agreement should therefore be amended accordingly.

(5)

Since Article 15(7) of Protocol 3 to the Agreement no longer applies as of 31 December 2009, this Decision should apply from 1 January 2010,

HAS ADOPTED THIS DECISION:

Article 1

Article 15(7) of Protocol 3 to the Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States, of the one part, and the Hashemite Kingdom of Jordan, of the other part, concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation, is replaced by the following:

‘7.   Notwithstanding paragraph 1, Jordan may, except for products falling within Chapters 1 to 24 of the Harmonised System, apply arrangements for drawback of, or exemption from, customs duties or charges having an equivalent effect, applicable to non-originating materials used in the manufacture of originating products, subject to the following provisions:

(a)

a 4 % rate of customs charge shall be retained in respect of products falling within Chapters 25 to 49 and 64 to 97 of the Harmonised System, or such lower rate as is in force in Jordan;

(b)

an 8 % rate of customs charge shall be retained in respect of products falling within Chapters 50 to 63 of the Harmonised System, or such lower rate as is in force in Jordan.

This paragraph shall apply until 31 December 2012 and may be reviewed by common accord.’.

Article 2

This Decision shall enter into force on the day of its adoption.

It shall apply from 1 January 2010.
