DECISION OF THE EEA JOINT COMMITTEE

No 17/2010

of 1 March 2010

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 1/2010 of 29 January 2010 (1).

(2)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 4/2010 of 29 January 2010 (2).

(3)

Commission Regulation (EC) No 479/2007 of 27 April 2007 amending Regulation (EC) No 2076/2005 laying down transitional arrangements for the implementation of Regulations (EC) No 853/2004, (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council and amending Regulations (EC) No 853/2004 and (EC) No 854/2004 (3) is to be incorporated into the Agreement.

(4)

Commission Regulation (EC) No 1243/2007 of 24 October 2007 amending Annex III to Regulation (EC) No 853/2004 of the European Parliament and the Council laying down specific hygiene rules for food of animal origin (4) is to be incorporated into the Agreement.

(5)

Commission Regulation (EC) No 1244/2007 of 24 October 2007 amending Regulation (EC) No 2074/2005 as regards implementing measures for certain products of animal origin intended for human consumption and laying down specific rules on official controls for the inspection of meat (5) is to be incorporated into the Agreement.

(6)

Commission Regulation (EC) No 1245/2007 of 24 October 2007 amending Annex I to Regulation (EC) No 2075/2005, as regards the use of liquid pepsin for the detection of Trichinella in meat (6) is to be incorporated into the Agreement.

(7)

Commission Regulation (EC) No 1246/2007 of 24 October 2007 amending Regulation (EC) No 2076/2005 as regards the extension of the transitional period granted to food business operators importing fish oil intended for human consumption (7) is to be incorporated into the Agreement.

(8)

Commission Regulation (EC) No 1441/2007 of 5 December 2007 amending Regulation (EC) No 2073/2005 on microbiological criteria for foodstuffs (8) is to be incorporated into the Agreement.

(9)

As far as Chapter I of Annex I is concerned, this Decision shall apply to Iceland with the transitional period specified in paragraph 2 of the Introductory Part of Chapter I of Annex I for the areas which did not apply to Iceland prior to the review of this Chapter by Decision of the EEA Joint Committee No 133/2007 of 26 October 2007 (9).

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Annex I and Annex II to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Regulations (EC) No 479/2007, (EC) No 1243/2007, (EC) No 1244/2007, (EC) No 1245/2007, (EC) No 1246/2007 and (EC) No 1441/2007 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on the day of the entry into force of the Decision of the EEA Joint Committee No 137/2007 of 26 October 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1). In case not all the notifications would have been made by that day, it shall enter into force on the day following the last notification to the EEA Joint Committee. This Decision shall apply provisionally from 1 March 2010 until its entry into force.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

No 18/2010

of 1 March 2010

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 1/2010 of 29 January 2010 (1).

(2)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 4/2010 of 29 January 2010 (2).

(3)

Council Regulation (EC) No 301/2008 of 17 March 2008 adapting Annex I to Regulation (EC) No 882/2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules (3) is to be incorporated into the Agreement.

(4)

Commission Regulation (EC) No 737/2008 of 28 July 2008 designating the Community reference laboratories for crustacean diseases, rabies and bovine tuberculosis, laying down additional responsibilities and tasks for the Community reference laboratories for rabies and bovine tuberculosis and amending Annex VII to Regulation (EC) No 882/2004 of the European Parliament and of the Council (4) is to be incorporated into the Agreement.

Commission Regulation (EC) No 1019/2008 of 17 October 2008 amending Annex II to Regulation (EC) No 852/2004 of the European Parliament and of the Council on the hygiene of foodstuffs (5) is to be incorporated into the Agreement.

(6)

Commission Regulation (EC) No 1020/2008 of 17 October 2008 amending Annexes II and III to Regulation (EC) No 853/2004 of the European Parliament and of the Council laying down specific hygiene rules for food of animal origin and Regulation (EC) No 2076/2005 as regards identification marking, raw milk and dairy products, eggs and egg products and certain fishery products (6) is to be incorporated into the Agreement.

Commission Regulation (EC) No 1021/2008 of 17 October 2008 amending Annexes I, II and III to Regulation (EC) No 854/2004 of the European Parliament and of the Council laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption and Regulation (EC) No 2076/2005 as regards live bivalve molluscs, certain fishery products and staff assisting with official controls in slaughterhouses (7) is to be incorporated into the Agreement.

(8)

Commission Regulation (EC) No 1022/2008 of 17 October 2008 amending Regulation (EC) No 2074/2005 as regards the total volatile basic nitrogen (TVB-N) limits (8) is to be incorporated into the Agreement.

(9)

Commission Regulation (EC) No 1023/2008 of 17 October 2008 amending Regulation (EC) No 2076/2005 as regards the extension of the transitional period granted to food business operators importing fish oil intended for human consumption (9) is to be incorporated into the Agreement.

(10)

Commission Regulation (EC) No 1029/2008 of 20 October 2008 amending Regulation (EC) No 882/2004 of the European Parliament and of the Council to update a reference to certain European standards (10) is to be incorporated into the Agreement.

(11)

Commission Regulation (EC) No 1250/2008 of 12 December 2008 amending Regulation (EC) No 2074/2005 as regards certification requirements for import of fishery products, live bivalve molluscs, echinoderms, tunicates and marine gastropods intended for human consumption (11) is to be incorporated into the Agreement.

(12)

Commission Decision 2008/337/EC of 24 April 2008 amending Decision 2006/968/EC implementing Council Regulation (EC) No 21/2004 as regards guidelines and procedures for the electronic identification of ovine and caprine animals (12) is to be incorporated into the Agreement.

(13)

Commission Decision 2008/654/EC of 24 July 2008 on guidelines to assist Member States in preparing the annual report on the single integrated multiannual national control plan provided for in Regulation (EC) No 882/2004 of the European Parliament and of the Council (13) is to be incorporated into the Agreement.

(14)

As far as Chapter I of Annex I is concerned, this Decision shall apply to Iceland with the transitional period specified in paragraph 2 of the Introductory Part of Chapter I of Annex I for the areas which did not apply to Iceland prior to the review of this Chapter by Decision of the EEA Joint Committee No 133/2007 of 26 October 2007 (14).

Article 2

The texts of Regulations (EC) No 301/2008, (EC) No 737/2008, (EC) No 1019/2008, (EC) No 1020/2008, (EC) No 1021/2008, (EC) No 1022/2008, (EC) No 1023/2008, (EC) No 1029/2008 and (EC) No 1250/2008 and Decisions 2008/337/EC and 2008/654/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on the day of the entry into force of the Decision of the EEA Joint Committee No 137/2007 of 26 October 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1). THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

(3)

Commission Regulation (EC) No 829/2007 of 28 June 2007 amending Annexes I, II, VII, VIII, X and XI to Regulation (EC) No 1774/2002 of the European Parliament and of the Council as regards the placing on the market of certain animal by-products (3) is to be incorporated into the Agreement.

Decision of the EEA Joint Committee No 137/2007 of 26 October 2007 (2) incorporated Regulation (EC) No 852/2004 of the European Parliament and of the Council (3) into the Agreement and repealed Commission Directives 96/3/Euratom, ECSC, EC (4), 98/28/EC (5) and 2004/4/EC (6), as corrected by OJ L 81, 19.3.2004, p. 92, under the Agreement.

According to Article 17(3) of Regulation (EC) No 852/2004, Directives 96/3/Euratom, ECSC, EC, 98/28/EC and 2004/4/EC shall remain in force pending their replacement by decisions adopted in accordance with that Regulation or Regulation (EC) No 178/2002 of the European Parliament and of the Council (7). Such decisions have not been adopted yet.

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 18/2010 of 1 March 2010 (1).

(2)

Commission Directive 2008/84/EC of 27 August 2008 laying down specific purity criteria on food additives other than colours and sweeteners (Codified version) (2) is to be incorporated into the Agreement.

(3)

Directive 2008/84/EC repeals Commission Directive 96/77/EC (3) which is incorporated into the Agreement and is therefore to be repealed under the Agreement.

(4)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1.

the text of point 54zf (Commission Directive 96/77/EC) shall be deleted;

2.

the following point shall be inserted after point 54zzzzf (Commission Directive 98/28/EC):

‘54zzzzg.

32008 L 0084: Commission Directive 2008/84/EC of 27 August 2008 laying down specific purity criteria on food additives other than colours and sweeteners (Codified version) (OJ L 253, 20.9.2008, p. 1).’

Article 2

The text of Directive 2008/84/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 13 March 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

(2)

Commission Directive 2009/9/EC of 10 February 2009 amending Directive 2001/82/EC of the European Parliament and of the Council on the Community code relating to medicinal products for veterinary use (2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 15p (Directive 2001/82/EC of the European Parliament and of the Council) of Chapter XIII of Annex II to the Agreement:

Article 2

The text of Directive 2009/9/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 13 March 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Commission Regulation (EC) No 771/2008 of 1 August 2008 laying down the rules of organisation and procedure of the Board of Appeal of the European Chemicals Agency (2) is to be incorporated into the Agreement.

(3)

Commission Regulation (EC) No 987/2008 of 8 October 2008 amending Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) as regards Annexes IV and V (3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XV of Annex II to the Agreement shall be amended as follows:

(2)

Annex XX to the Agreement was amended by Decision of the EEA Joint Committee No 150/2009 of 4 December 2009 (2).

(3)

Commission Regulation (EC) No 303/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of companies and personnel as regards stationary refrigeration, air conditioning and heat pump equipment containing certain fluorinated greenhouse gases (3) is to be incorporated into the Agreement.

Commission Regulation (EC) No 304/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of companies and personnel as regards stationary fire protection systems and fire extinguishers containing certain fluorinated greenhouse gases (4) is to be incorporated into the Agreement.

Commission Regulation (EC) No 305/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of personnel recovering certain fluorinated greenhouse gases from high-voltage switchgear (5) is to be incorporated into the Agreement.

Commission Regulation (EC) No 306/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of personnel recovering certain fluorinated greenhouse gas-based solvents from equipment (6), as corrected by OJ L 280, 23.10.2008, p. 38, is to be incorporated into the Agreement.

Commission Regulation (EC) No 307/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements for training programmes and the conditions for mutual recognition of training attestations for personnel as regards air-conditioning systems in certain motor vehicles containing certain fluorinated greenhouse gases (7) is to be incorporated into the Agreement.

Commission Regulation (EC) No 308/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, the format for notification of the training and certification programmes of the Member States (8) is to be incorporated into the Agreement,

Directive 2009/20/EC of the European Parliament and of the Council of 23 April 2009 on the insurance of shipowners for maritime claims (2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following point shall be inserted after point 56v (Directive 2005/35/EC of the European Parliament and of the Council) of Annex XIII to the Agreement:

‘56w.

32009 L 0020: Directive 2009/20/EC of the European Parliament and of the Council of 23 April 2009 on the insurance of shipowners for maritime claims (OJ L 131, 28.5.2009, p. 128).’

Article 2

The text of Directive 2009/20/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 13 March 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 13/2010 of 29 January 2010 (1).

(2)

Commission Regulation (EC) No 1144/2009 of 26 November 2009 amending Regulation (EC) No 474/2006 establishing the Community list of air carriers which are subject to an operating ban within the Community (2) is to be incorporated into the Agreement.

(3)

Regulation (EC) No 552/2004 of the European Parliament and of the Council of 10 March 2004 on the interoperability of the European Air Traffic Management network (the interoperability Regulation) (3), which has been incorporated into the Agreement by Decision of the EEA Joint Committee No 67/2006 of 2 June 2006 (4), repeals Council Directive 93/65/EEC (5), Commission Directive 97/15/EC (6), and Regulations (EC) No 2082/2000 (7) and (EC) No 980/2002 (8), which are incorporated into the Agreement and which are consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XIII to the Agreement shall be amended as follows:

1.

the text of point 66zab (Commission Regulation (EC) No 474/2006) shall be amended as follows:

(i)

the following indent shall be added:

‘—

32009 R 1144: Commission Regulation (EC) No 1144/2009 of 26 November 2009 (OJ L 312, 27.11.2009, p. 16).’;

(ii)

the following shall be added:

‘The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

The provisions of the Annexes to the Regulation shall apply as long as they are in force in the European Union.’;

2.

the text of point 66c (Council Directive 93/65/EEC) shall be deleted.

Article 2

The text of Regulation (EC) No 1144/2009 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 13 March 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XIX to the Agreement was amended by Decision of the EEA Joint Committee No 86/2009 of 3 July 2009 (1).

(2)

Directive 2006/114/EC of the European Parliament and of the Council of 12 December 2006 concerning misleading and comparative advertising (codified version) (2) is to be incorporated into the Agreement.

(3)

Directive 2006/114/EC repeals Council Directive 84/450/EEC (3), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The text of point 2 (Council Directive 84/450/EEC) of Annex XIX to the Agreement shall be replaced by the following:

32006 L 0114: Directive 2006/114/EC of the European Parliament and of the Council of 12 December 2006 concerning misleading and comparative advertising (codified version) (OJ L 376, 27.12.2006, p. 21).’

Article 2

The text of Directive 2006/114/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 13 March 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Whereas:

Annex XXI to the Agreement was amended by Decision of the EEA Joint Committee No 156/2009 of 4 December 2009 (1).

(2)

Regulation (EC) No 1006/2009 of the European Parliament and of the Council of 16 September 2009 amending Regulation (EC) No 808/2004 concerning Community statistics on the information society (2) is to be incorporated into the Agreement.

(3)

Commission Regulation (EC) No 1022/2009 of 29 October 2009 amending Regulations (EC) No 1738/2005, (EC) No 698/2006 and (EC) No 377/2008 as regards the International Standard Classification of Occupations (ISCO) (3) is to be incorporated into the Agreement.

(4)

Commission Regulation (EC) No 1023/2009 of 29 October 2009 implementing Regulation (EC) No 808/2004 of the European Parliament and of the Council concerning Community statistics on the information society (4) is to be incorporated into the Agreement.

(5)

Commission Recommendation 2009/824/EC of 29 October 2009 on the use of the International Standard Classification of Occupations (ISCO-08) (5) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XXI to the Agreement shall be amended as follows:

the following indent shall be added in point 28 (Regulation (EC) No 808/2004 of the European Parliament and of the Council):
