establishing the standard import values for determining the entry price of certain fruit and vegetables
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),
Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules for Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (2), and in particular Article 138(1) thereof,
Whereas:
Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XV, Part A thereto,
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 are fixed in the Annex hereto.
Article 2
This Regulation shall enter into force on 23 December 2009.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

opening and providing for the administration of import quotas for rice originating in the overseas countries and territories (OCTs)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Decision 2001/822/EC of 27 November 2001 on the association of the overseas countries and territories with the European Community (1), and in particular the seventh subparagraph of Article 6(5) of Annex III thereto,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (2), and in particular Article 148, in conjunction with Article 4 thereof,
Whereas:

Under Article 6 of Annex III to Decision 2001/822/EC, ACP/OCTs cumulation of origin for products falling within tariff heading 1006 is allowed for a total annual quantity of 160 000 tonnes, which include the 125 000 tonnes tariff quota for rice originating in African, Caribbean and Pacific (ACP) States provided for in the ACP – EC Partnership Agreement, expressed in husked-rice equivalent. An initial issue of import licences for 35 000 tonnes of rice originating in the overseas countries and territories (hereinafter: OCTs) is made each year and, within this quantity, import licences for 10 000 tonnes are issued for imports originating in the least-developed OCTs listed in Annex IB to that Decision. All other import licences are issued for imports originating in the Netherlands Antilles and Aruba. These 35 000 tonnes of rice reserved for the OCTs may be increased if the ACP States do not actually use their direct export options under the tariff quota provided for in the Cotonou agreement. |

From 1 January 2008, the trading arrangements of the ACP – EC Partnership Agreement no longer apply and the tariff quota for rice provided for therein is replaced by the preferential arrangements provided for in Article 6 of Council Regulation (EC) No 1528/2007 of 20 December 2007 applying the arrangements for goods originating in certain states which are part of the African, Caribbean and Pacific (ACP) Group of States provided for in agreements establishing, or leading to the establishment of, Economic Partnership Agreements (3). Under Article 3(3)(a) of that Regulation preferential arrangements for the products of tariff heading 1006 originating in certain states which are part of the ACP Group of States provided for in agreements establishing, or leading to the establishment of, Economic Partnership Agreements, shall continue only until 31 December 2009. As a result, as from 1 January 2010 it is no longer possible to provide for a possible increase of the OCTs quota linked to the use of an ACP quota and consequently the OCTs quotas must be opened on a yearly basis for a quantity limited to 35 000 tonnes. |

Without prejudice to the additional conditions or relevant derogations laid down for the management of those import arrangements, account should be taken of the provisions of the horizontal or sectoral implementing regulations, that is, Commission Regulations (EC) No 1342/2003 of 28 July 2003 laying down special detailed rules for the application of the system of import and export licences for cereals and rice (4), (EC) No 1301/2006 of 31 August 2006 laying down common rules for the administration of import tariff quotas for agricultural products managed by a system of import licences (5) and (EC) No 376/2008 of 23 April 2008 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products (6). |

To ensure balanced market management, the issue of import licences relating to the above import quotas is to be staggered over the year in several specific subperiods, the period of validity of the licences should be laid down and a maximum quantity per application should be fixed. |
(5) |
Quantities of rice at stages of processing other than husked rice shall be converted at the rates laid down in Article 1 of Commission Regulation (EC) No 1312/2008 of 19 December 2008 fixing the conversion rates, the processing costs and the value of the by-products for the various stages of rice processing (7). Provision should also be made for the conversion of quantities of broken rice. |
(6) |
In order to ensure proper administration of the import quotas, a security should be lodged in conjunction with an import licence application at a level commensurate with the risks involved. |
(7) |
With a view to optimise the use of the quotas in case of application of an allocation coefficient, it is appropriate to establish that the rights deriving from the licences may be transferred to transferees satisfying the eligibility conditions set out in Article 5 of Regulation (EC) No 1301/2006. |
(8) |
According to Article 6 of Annex III to Decision 2001/822/EC, licences not used to import rice originating in the least-developed OCTs listed in Annex IB thereto should be made available for the import of rice originating in the Netherlands Antilles and Aruba. To this end, it is appropriate to establish that in the September subperiod the quantities not used for the least-developed OCTs can be allocated for the import of rice originating in the Netherlands Antilles and Aruba. |

In order to ensure proper management of the quotas, it is appropriate to derogate from Article 11 of Regulation (EC) No 1301/2006 and adapt the notification obligations provided for in that Article. |
(10) |
As the import duties on the products of tariff heading 1006 originating in certain states which are part of the ACP Group of States provided for in agreements establishing, or leading to the establishment of, Economic Partnership Agreements, shall be eliminated as from 1 January 2010, the measures provided for in this Regulation should apply from the same date. |
(11) |
Commission Regulation (EC) No 1529/2007 of 21 December 2007 opening and providing for the administration in 2008 and 2009 of import quotas for rice originating in the ACP States which are part of the Cariforum region and the overseas countries and territories (OCTs) (8) will become obsolete at the end of 2009 quota period. For this reason, it should be repealed. |

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
1. This Regulation opens and provides for the administration of tariff rate quotas for the import of the following quantities of rice falling within CN code 1006, hereinafter called ‘tariff quotas’:
(a) |
25 000 tonnes originating in the Netherlands Antilles or Aruba; |
(b) |
10 000 tonnes originating in the least-developed overseas countries and territories (OCTs) listed in Annex IB to Decision 2001/822/EC. |
The tariff quotas are opened on an annual basis for the period from 1st January to 31st December.
2. The provisions of Regulations (EC) No 1342/2003, (EC) No 1301/2006 and (EC) No 376/2008 shall apply, except as otherwise provided for in this Regulation.
3. The tariff quotas are administered according to the simultaneous examination method referred to in Chapter II of Regulation (EC) No 1301/2006.
4. The customs duty for imports under the tariff quotas shall be nil. This rate shall be shown in Section 24 of the import license application and the import license in accordance with Article 9 of Regulation (EC) No 1301/2006.
5. The import tariff quota periods shall be divided in 3 subperiods as set out in Annex I.
The quantities referred to in Article 7(4) of Regulation (EC) No 1301/2006 and available for the following subperiod shall be communicated by the Commission before the 25th day of the last month of a given subperiod.
Where, for the September subperiod, the quantities covered by applications for the tariff quota referred to in paragraph 1(b) of this Article do not reach the total quantity available, the remaining quantity may be used to import products originating in the Netherlands Antilles or Aruba.
6. Unless otherwise specified, the quantities indicated in this Regulation shall be expressed in husked-rice equivalent.
Quantities of rice at stages of processing other than husked rice shall be converted at the rates laid down in Article 1 of Regulation (EC) No 1312/2008.
For the purposes of this Regulation, quantities of broken rice shall be converted into quantities of husked rice on the basis of product weight.
Article 2
1. Licence applications shall be submitted the first seven days of each subperiod set out in Annex I.
2. Without prejudice to Article 6(5) of Regulation (EC) No 1301/2006, the quantity applied for in respect of each subperiod and quota order number concerned shall not exceed 5 000 tonnes.
3. Member States shall notify the Commission, by the 14th day of the month in which applications are submitted, of the total quantities covered by license applications as referred to under Article 11(1)(a) of Regulation (EC) No 1301/2006, specifying the eight-digit CN code, the country of origin and the quantities, expressed in product weight, covered by those applications.
Article 3
1. Sections 7 and 8 of licence applications and licences shall show the country of origin and the mention ‘yes’ shall be marked by a cross. Licences shall give rise to an obligation to import from the specified country.
2. Section 20 of licence applications and licences shall show one of the entries listed in Annex II.
Article 4
The amount of the security as referred to in Article 14(2) of Regulation (EC) No 376/2008 shall be of EUR 46 per tonne.
Article 5
1. Import licences shall be issued between the 25th and the last day of the month in which applications are submitted.
2. By way of derogation from Article 6(7) of Regulation (EC) No 1342/2003 and without prejudice to Article 8(1) of Regulation (EC) No 376/2008, the rights deriving from the licences may be transferred to transferees satisfying the eligibility conditions set out in Article 5 of Regulation (EC) No 1301/2006
Article 6
1. By way of derogation from Article 11(1) of Regulation (EC) No 1301/2006, Member States shall notify the Commission at the latest:
(a) |
the second working day following the issue of the import licences, of the total quantities covered by import licences they have issued during the preceding month; |
(b) |
the last day of each month, including nil returns:

2. The quantities mentioned under paragraph 1 shall be expressed in product weight and broken down by eight-digit CN code, country of origin and quota year.
Article 7
For the purpose of the management of the tariff quotas, the quantities covered by licence applications, the quantities notified in accordance with Articles 2 and 6 and the quantities covered by import licences are expressed in kilograms and in whole numbers.
Article 8
Licences shall be valid from their actual day of issue within the meaning of Article 22(2) of Regulation (EC) No 376/2008, until the 31st December of the year of issue.
Article 9
Release for free circulation shall be subject to the presentation of an original of a movement certificate EUR.1 or a supplier’s declaration in accordance with Article 26(1) of Annex III to Decision 2001/822/EC.
Article 10
Regulation (EC) No 1529/2007 is repealed.
Article 11
This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.
It shall apply from 1 January 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing a prohibition of fishing for bluefin tuna in Atlantic Ocean, east of longitude 45o W, and Mediterranean by vessels flying the flag of France
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 2371/2002 of 20 December 2002 on the conservation and sustainable exploitation of fisheries resources under the Common Fisheries Policy (1), and in particular Article 26(4) thereof,
Having regard to Council Regulation (EEC) No 2847/93 of 12 October 1993 establishing a control system applicable to common fisheries policy (2), and in particular Article 21(3) thereof,
Whereas:

Council Regulation (EC) No 43/2009 of 16 January 2009 fixing for 2009 the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks applicable in Community waters and for Community vessels, in waters where catch limitations are required (3), lays down quotas for 2009. |
(2) |
According to the information received by the Commission, catches of the stock referred to in the Annex to this Regulation by vessels flying the flag of or registered in the Member State referred to therein have exhausted the quota allocated for 2009. |
(3) |
It is therefore necessary to prohibit fishing for that stock and its retention on board, transhipment and landing, |
HAS ADOPTED THIS REGULATION:
Article 1
Quota exhaustion
The fishing quota allocated to the Member State referred to in the Annex to this Regulation for the stock referred to therein for 2009 shall be deemed to be exhausted from the date set out in that Annex.
Article 2
Prohibitions
Fishing for the stock referred to in the Annex to this Regulation by vessels flying the flag of or registered in the Member State referred to therein shall be prohibited from the date set out in that Annex. It shall be prohibited to retain on board, tranship or land such stock caught by those vessels after that date.
Article 3
Entry into force
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) No 1276/2009

fixing the standard values to be used in calculating the financial compensation and the advance pertaining thereto in respect of fishery products withdrawn from the market during the 2010 fishing year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1), and in particular Article 21(5) and (8) thereof,
Whereas:

Regulation (EC) No 104/2000 provides for financial compensation to be paid to producer organisations which withdraw on certain conditions, the products listed in Annex I, (A) and (B) to that Regulation. The amount of such financial compensation should be reduced by standard values in the case of products intended for purposes other than human consumption. |
(2) |
Commission Regulation (EC) No 2493/2001 of 19 December 2001 on the disposal of certain fishery products which have been withdrawn from the market (2) specifies the ways of disposing of the products withdrawn from the market. The value of such products should be fixed at a standard level for each of these modes of disposal, taking into account the average revenues which may be obtained from such disposal in the various Member States. |

Under Article 7 of Commission Regulation (EC) No 2509/2000 of 15 November 2000 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards granting financial compensation for withdrawals of certain fishery products (3), special rules provide that, where a producer organisation or one of its members puts its products up for sale in a Member State other than the country in which it is recognised, that body responsible for granting the financial compensation must be informed. This body is the one in the Member State in which the producer organisation is recognised. The standard value deductible should therefore be the value applied in that Member State. |
(4) |
The same method of calculation should be applied to advances on financial compensation as provided for in Article 6 of Regulation (EC) No 2509/2000. |
(5) |
The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Fishery Products, |
HAS ADOPTED THIS REGULATION:
Article 1
For the 2010 fishing year, the standard values to be used in calculating financial compensation and associated advances for fishery products withdrawn from the market by producer organisations and intended for purposes other than human consumption, as referred to in Article 21(5) of Regulation (EC) No 104/2000, are set out in the Annex to this Regulation.
Article 2
The standard value to be deducted from financial compensation and associated advances shall be that applied in the Member State in which the producer organisation is recognised.
Article 3
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Union.
It shall apply from 1 January 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

fixing the Community withdrawal and selling prices for the fishery products listed in Annex I to Council Regulation (EC) No 104/2000 for the 2010 fishing year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1), and in particular Article 20(3) and Article 22 thereof,
Whereas:

Regulation (EC) No 104/2000 provides that the EU withdrawal and selling prices for each of the products listed in Annex I thereto are to be fixed on the basis of the freshness, size or weight and presentation of the product by applying the conversion factor for the product category concerned to an amount not more than 90 % of the relevant guide price. |
(2) |
The withdrawal prices may be multiplied by adjustment factors in landing areas which are very distant from the main centres of consumption in the EU. The guide prices for the 2010 fishing year were fixed for all the products concerned by Council Regulation (EC) No 1212/2009 (2). |
(3) |
The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Fishery Products, |
HAS ADOPTED THIS REGULATION:
Article 1
The conversion factors used for calculating the EU withdrawal and selling prices, as referred to in Article 20 and 22 of Regulation (EC) No 104/2000, for the 2010 fishing year for the products listed in Annex I to that Regulation, are set out in Annex I to this Regulation.
Article 2
The EU withdrawal and selling prices applicable for the 2010 fishing year and the products to which they relate are set out in Annex II.
Article 3
The withdrawal prices applicable for the 2010 fishing year in landing areas which are very distant from the main centres of consumption in the EU and the products to which those prices relate are set out in Annex III.
Article 4
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Union.
It shall apply from 1 January 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

fixing the amount of private storage aid for certain fishery products in the 2010 fishing year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1),
Having regard to Commission Regulation (EC) No 2813/2000 of 21 December 2000 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards the grant of private storage aid for certain fishery products (2), and in particular Article 1 thereof,
Whereas:
(1) |
The aid should not exceed the sum of technical and financial costs recorded in the EU during the fishing year preceding the year in question. |
(2) |
To discourage long-term storage, to shorten payment times and to reduce the burden of controls, private storage aid should be paid in one single instalment. |
(3) |
The measures provided for in this Regulation are in accordance with the Management Committee for Fishery Products, |
HAS ADOPTED THIS REGULATION:
Article 1
For the 2010 fishing year the amount of private storage aid, referred to in Article 25 of Regulation (EC) No 104/2000, for the products listed in Annex II to that Regulation shall be as follows:

fixing the amount of the carry-over aid and the flat-rate aid for certain fishery products for the 2010 fishing year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1),
Having regard to Commission Regulation (EC) No 2814/2000 of 21 December 2000 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards the grant of carry-over aid for certain fishery products (2), and in particular Article 5 thereof,
Having regard to Commission Regulation (EC) No 939/2001 of 14 May 2001 laying down detailed rules for the application of Council Regulation (EC) No 104/2000 as regards the grant of flat-rate aid for certain fishery products (3), and in particular Article 5 thereof,
Whereas:
(1) |
Regulation (EC) No 104/2000 provides that aid may be granted for quantities of certain fresh products withdrawn from the market and either processed to stabilise them and stored or preserved. |
(2) |
The purpose of that aid is to give suitable encouragement to producers’ organisations to process or preserve products withdrawn from the market so that their destruction can be avoided. |
(3) |
The aid level should not be such as to disturb the balance of the market for the products in question or distort competition. |
(4) |
The aid level should not exceed the technical and financial costs associated with the operations essential to stabilising and storage recorded in the EU during the fishing year preceding the year in question. |
(5) |
The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Fishery Products, |
HAS ADOPTED THIS REGULATION:
Article 1
For the 2010 fishing year, the amounts of the carry-over aid referred to in Article 23 of Regulation (EC) No 104/2000, and the amounts of the flat-rate aid referred to in Article 24(4) of that Regulation, are set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Union.
It shall apply from 1 January 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

fixing the reference prices for certain fishery products for the 2010 fishing year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1), and in particular Article 29(1) and (5) thereof,
Whereas:

Regulation (EC) No 104/2000 provides that reference prices valid for the EU may be fixed each year, by product category, for products that are the subject of a tariff suspension under Article 28(1). The same holds for products which, by virtue of being either the subject of a binding tariff reduction under the WTO or some other preferential arrangements, must comply with a reference price. |
(2) |
Pursuant to Article 29(3)(a) of Regulation (EC) No 104/2000, the reference price for the products listed in Annex I, Parts A and B to that Regulation, is to be the same as the withdrawal price fixed in accordance with Article 20(1) of that Regulation. |
(3) |
The EU withdrawal prices for the products concerned are fixed for the 2010 fishing year by Commission Regulation (EU) No 1277/2009 (2). |
(4) |
Pursuant to Article 29(3)(d) of Regulation (EC) No 104/2000, the reference price for products other than those listed in Annexes I and II to that Regulation is to be established in particular on the basis of the weighted average of customs values recorded on the import markets or in the ports of import in the three years immediately preceding the date on which the reference price is fixed. |

Article 1
The reference prices for the 2010 fishing year of fishery products, as referred to in Article 29 of Regulation (EC) No 104/2000, are set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Union.
It shall apply from 1 January 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

fixing the Community selling prices for the fishery products listed in Annex II to Council Regulation (EC) No 104/2000 for the 2010 fishing year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products (1), and in particular Article 25(1) and (6) thereof,
Whereas:
(1) |
An EU selling price is to be fixed for each of the products listed in Annex II to Regulation (EC) No 104/2000 before the beginning of the fishing year, at a level at least equal to 70 % and not exceeding 90 % of the guide price. |
(2) |
Council Regulation (EC) No 1212/2009 (2) fixes the guide prices for the 2010 fishing year for all the products concerned. |
(3) |
Market prices vary considerably depending on the species and how the products are presented, particularly in the case of squid and hake. |
(4) |
Conversion factors should therefore be fixed for the different species and presentations of frozen products landed in the EU in order to determine the price level that trigger the intervention measure provided for in Article 25(2) of Regulation (EC) No 104/2000. |
(5) |
The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Fishery Products, |
HAS ADOPTED THIS REGULATION:
Article 1
The EU selling prices, as referred to in Article 25(1) of Regulation (EC) No 104/2000, applicable during the 2010 fishing year for the products listed in Annex II to that Regulation and the presentations and conversion factors to which they relate are set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Union.
It shall apply from 1 January 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EU) No 409/2009 on the establishment of Community conversion factors and presentation codes used to convert fish processed weight into fish live weight
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the functioning of the European Union,
Having regard to Council Regulation (EEC) No 2847/93 of 12 October 1993, establishing a control system applicable to the Common Fishery Policy (1), and in particular Article 5 thereof,
Whereas:

Commission Regulation (EC) No 409/2009 (2), establishes Community conversion factors and presentation codes for the states of processing ‘fresh’ and ‘fresh salted’. |
(2) |
Species subject to fishing quotas are landed mainly in the states of processing ‘fresh’, ‘fresh salted’ and ‘frozen’. Consequently there is a need to complement Regulation (EC) No 409/2009 with Community conversion factors for frozen fish, so that Community conversion factors are available for all relevant processing states. |
(3) |
Commission Regulation (EC) No 1077/2008 (3) lays detailed rules for the implementation of the electronic record and transmission of logbook, landing declaration and transhipment data. |
(4) |
Regulation (EC) No 409/2009 should therefore be amended accordingly. |
(5) |
The measures provided for in this Regulation are in accordance with the opinion of the Fisheries and Aquaculture Committee. |

amending Directive 94/35/EC of the European Parliament and of the Council on sweeteners for use in foodstuffs with regard to neotame

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives (1), and in particular Article 31 thereof,
After consulting the European Food Safety Authority (EFSA),
Whereas:

Directive 94/35/EC of the European Parliament and of the Council of 30 June 1994 on sweeteners for use in foodstuffs (2) lays down a list of sweeteners that may be used in the Union and the conditions for their use. |
(2) |
The European Food Safety Authority (EFSA) evaluated the safety of neotame as a sweetener and flavour enhancer and expressed its opinion of 27 September 2007 (3). After considering all the data on stability, degradation products and toxicology, EFSA concluded that neotame is not of safety concern with respect to the proposed uses as a sweetener and flavour enhancer and established an acceptable daily intake (ADI) of 0–2 mg/kg bw/day. EFSA also noted that conservative estimates of neotame dietary exposure both in adults and children suggest that it is very unlikely that the ADI would be exceeded at the proposed use levels. |
(3) |
Neotame is a highly intense sweetener with a sweetness potency ranging from 7 000 to 13 000 times that of sucrose. It may be used as a replacement for sucrose or other sweeteners in a broad range of products. Neotame can be used alone or with other sweeteners. In addition, neotame can modify the flavour of foods and beverages. |
(4) |
It is necessary to amend the Annex of Directive 94/35/EC to permit the use of neotame in the same food applications as the other currently permitted intense sweeteners. Neotame should be assigned a new E number, namely E 961. In order to facilitate the marketing and use of this new sweetener, it is provided that products which comply with the provisions of this Directive may be marketed from the date of its entry into force. |
(5) |
In accordance with point 34 of the Interinstitutional agreement on better law-making (4), Member States are encouraged to draw up, for themselves and in the interests of the Union, their own tables, which will, as far as possible, illustrate the correlation between this Directive and the transposition measures, and to make them public. |

The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS DIRECTIVE:
Article 1
The Annex to Directive 94/35/EC is amended in accordance with the Annex to this Directive.
Article 2
1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 12 October 2010 at the latest. They shall forthwith communicate to the Commission the text of those provisions.
When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.
2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.
3. Products which comply with the provisions of this Directive may be marketed from the date of entry into force of this Directive.
Article 3
This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
Article 4
This Directive is addressed to the Member States.

amending, for the purpose of adaptation to technical progress, Annexes II and III to Council Directive 76/768/EEC concerning cosmetic products

THE EUROPEAN COMMISSION,
Having regard to the Treaty on European Union and to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 76/768/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to cosmetic products (1), and in particular Article 8(2) thereof,
After consulting the Scientific Committee on Consumer Safety,
Whereas:

The substance Verbena oil (Lippia citriodora Kunth.) is currently banned for use in cosmetic products, being listed in Annex II to Directive 76/768/EEC, under reference number 450. The ban of this substance was introduced on the basis of an opinion of May 2000 of the Scientific Committee on Cosmetic Products and Non-Food Products intended for Consumers (SCCNFP), subsequently replaced by the ‘Scientific Committee on Consumer Products (SCCP)’ by Commission Decision 2004/210/EC (2), and later by the ‘Scientific Committee on Consumer Safety (SCCS)’ by Commission Decision 2008/721/EC (3). The SCCNFP recommended the prohibition of Verbena (Lippia citriodora Kunth.) essential oils and derivatives, e.g. concrete and absolute, when used as a fragrance ingredient, based on the sensitising potential. |

However, the SCCNFP later concluded in an opinion issued in 2001 that Verbena absolute obtained from Lippia citriodora Kunth. should not be used such that the level in the finished cosmetic products exceeds 0,2 %. It is therefore appropriate to include Verbena absolute (Lippia citriodora Kunth.) together with its respective restriction in Annex III, Part 1 to Directive 76/768/EEC. It is also appropriate to amend reference number 450 of Annex II in order to specify that the substances Verbena essential oils (Lippia citriodora Kunth.) and derivatives other than absolute are prohibited when used as a fragrance ingredient. |

Directive 2008/42/EC of 3 April 2008 amending Council Directive 76/768/EEC, concerning cosmetic products, for the purpose of adapting Annexes II and III thereto to technical progress (4) included several allyl esters containing allyl alcohol as impurity in Annex III, Part 1 to Directive 76/768/EEC. The substance allyl phenethyl ether may contain allyl alcohol as impurity as well. For this substance, the SCCNFP issued an opinion in 2000 recommending an upper limit of 0,1 % of allyl alcohol as impurity. |

In the light of the SCCNFP opinion, as well as for consistency reasons, it is appropriate to include in Annex III, Part 1 to Directive 76/768/EEC the substance allyl phenethyl ether together with its respective restriction. |
(5) |
The group of substances Terpene terpenoids sinpine is currently regulated under reference number 130 in Annex III, Part 1 to Directive 76/768/EEC. However, the word ‘sinpine’ is a trade name and should therefore be deleted from the designation of that group of substances. |
(6) |
Directive 76/768/EEC should therefore be amended accordingly. |
(7) |
In view of a smooth transition from existing formulae of cosmetic products to formulae which comply with the requirements laid down in this Directive, it is necessary to provide for appropriate transitional periods. |
(8) |
The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Cosmetic Products, |
HAS ADOPTED THIS DIRECTIVE:
Article 1
Annexes II and III to Directive 76/768/EEC are amended in accordance with the Annex to this Directive.
Article 2
Member States shall take all necessary measures to ensure that, as from 15 February 2011, no cosmetic products which fail to comply with this Directive are placed on the market by Union manufacturers or by importers established within the Union.
Member States shall take all necessary measures to ensure that, as from 15 August 2011, no cosmetic products which fail to comply with this Directive are sold or disposed of to the final consumer in the Union.
Article 3
1. Member States shall adopt and publish, by 15 August 2010 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions.
They shall apply those provisions from 15 February 2011.
When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.
2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.
Article 4
This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
Article 5
This Directive is addressed to the Member States.

as regards a Union financial contribution for the year 2010 to the Community reference laboratory for transmissible spongiform encephalopathies

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules (1), and in particular Article 32(7) thereof,
Whereas:

Any liaison or reference laboratory designated as such in accordance with Union veterinary legislation and fulfilling the duties and requirements laid down therein, may receive Union aid in accordance with Article 31 of Council Decision 2009/470/EC of 25 May 2009 on expenditure in the veterinary field (2). |
(2) |
Commission Regulation (EC) No 1754/2006 of 28 November 2006 laying down detailed rules for the granting of Community financial assistance to Community reference laboratories for feed and food and the animal health sector (3) provides that the financial contribution from the Union is to be granted if the approved work programmes are efficiently carried out and that the beneficiaries supply all the necessary information within certain time limits. |

In accordance with Article 2 of Regulation (EC) No 1754/2006 the relationship between the Commission and each Community reference laboratories is laid down in a partnership agreement which is supported by a multi-annual work programme. |
(4) |
Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May 2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies (4), designates the Veterinary Laboratories Agency, Addlestone, United Kingdom as the Community Reference Laboratory for transmissible spongiform encephalopathies (TSEs). Its functions include collecting and collating data on the results of tests carried out in the Union and keeping abreast of trends in surveillance, epidemiology and prevention of TSEs throughout the world. |
(5) |
The Commission has assessed the work programme and corresponding budget estimates submitted by the Community reference laboratory for TSEs for the year 2010. Accordingly, a Union financial contribution should be granted to this Community reference laboratory in order to co-finance its activities to carry out the functions and duties provided for in Regulation (EC) No 882/2004 and in Regulation (EC) No 999/2001. The Union’s financial contribution should be at the rate of 100 % of eligible costs as defined in Regulation (EC) No 1754/2006. |
(6) |
Regulation (EC) No 1754/2006 lays down eligibility rules for the workshops organised by the Community reference laboratories. It also limits the financial assistance to a maximum of 32 participants in workshops. Derogations to that limitation should be provided in accordance with Article 13(3) of Regulation (EC) No 1754/2006 to some Community reference laboratory that needs support for attendance by more than 32 participants in order to achieve the best outcome of its workshops. |
(7) |
In accordance with Article 3(2)(a) of Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the Common Agricultural Policy (5), animal disease eradication and control programmes (veterinary measures) shall be financed from the European Agricultural Guarantee Fund (EAGF). Furthermore, Article 13, second paragraph of that regulation foresees that in duly justified exceptional cases, for measures and programmes covered by Council Decision 90/424/EEC of 26 June 1990 on expenditure in the veterinary field (6), expenditure relating to administrative and personnel costs incurred by Member States and beneficiaries of aid from the EAGF shall be borne by the Fund. For financial control purposes, Articles 9, 36 and 37 of Regulation (EC) No 1290/2005 are to apply. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee of the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
1. The Union grants financial aid to the Veterinary Laboratories Agency, Addlestone, United Kingdom, to carry out the functions and duties provided in Chapter B of Annex X to Regulation (EC) No 999/2001.
For the period from 1 January 2010 to 31 December 2010, that financial aid shall not exceed EUR 1 129 000.
Within the maximum referred to in the second subparagraph and without prejudice to the time limits laid down in Article 10 of Regulation (EC) No 1754/2006, an amount of EUR 600 000 shall be reserved for the design and the implementation of a protocol aiming to collect data to progress knowledge about genetic resistance to scrapie in goats in Cyprus.
2. In addition to the maximum amount provided for in paragraph 1, the Union grants financial aid to the laboratory referred to in paragraph 1 for the organisation of workshops. That aid shall not exceed EUR 60 000.
3. By way of derogation from Article 13(1) of Regulation (EC) No 1754/2006, the laboratory referred to in paragraph 1 shall be entitled to claim financial assistance for attendance by a maximum of 50 participants at one of its workshops referred to in paragraph 2 of this Article.

COMMISSION DECISION
of 22 December 2009
on adopting, pursuant to Council Directive 92/43/EEC, a second updated list of sites of Community importance for the Macaronesian biogeographical region
(notified under document C(2009) 10414)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora (1) and in particular the third subparagraph of Article 4(2) thereof,
Whereas:

The Macaronesian biogeographical region referred to in Article 1(c)(iii) of Directive 92/43/EEC, comprises the archipelagos of the Azores and Madeira (Portugal) and the Canary Islands (Spain) in the Atlantic ocean, as specified in the biogeographical map approved on 25 April 2005 by the Committee set up by Article 20 of that Directive, hereinafter the ‘Habitats Committee’. |
(2) |
It is necessary in the context of a process which was initiated in 1995 to make further progress in the actual establishment of the Natura 2000 network, which is an essential element of the protection of biodiversity in the Community. |
(3) |
The initial list and the first updated list of sites of Community importance for the Macaronesian biogeographical region, within the meaning of Directive 92/43/EEC were adopted by Commission Decisions 2002/11/EC (2) and 2008/95/EC (3). On the basis of Articles 4(4) and 6(1) of Directive 92/43/EEC, the Member State concerned shall designate the sites included in the list of sites of Community importance for the Macaronesian biogeographical region as special areas of conservation as soon as possible and within six years at most, establishing conservation priorities and the necessary conservation measures. |
(4) |
In the context of a dynamic adaptation of the Natura 2000 network, the lists of sites of Community importance are reviewed. A second update of the Macaronesian list is therefore necessary. |
(5) |
On the one hand, the second update of the list of sites of Community importance for the Macaronesian biogeographical region is necessary in order to include additional sites that have been proposed since 2006 by the Member States as sites of Community importance for the Macaronesian biogeographical region within the meaning of Article 1 of Directive 92/43/EEC. The obligations resulting from Articles 4(4) and 6(1) of Directive 92/43/EEC are applicable as soon as possible and within six years at most from the adoption of the second updated list of sites of Community importance for the Macaronesian biogeographical region. |
(6) |
On the other hand, the second update of the list of sites of Community importance for the Macaronesian biogeographical region is necessary in order to reflect any changes in site related information submitted by the Member States following the adoption of the initial and the first updated Community lists. In that sense, the second updated list of sites of Community importance for the Macaronesian biogeographical region constitutes a consolidated version of the list of sites of Community importance for the Macaronesian biogeographical region. However, it should be stressed that the obligations resulting from Articles 4(4) and 6(1) of Directive 92/43/EEC are applicable as soon as possible and within six years at most from the adoption of the initial or the first updated lists of sites of Community importance for the Macaronesian biogeographical region, depending on which list a site of Community importance was included as such for the first time. |
(7) |
For the Macaronesian biogeographical region, lists of sites proposed as sites of Community importance within the meaning of Article 1 of Directive 92/43/EEC have been transmitted to the Commission between November 1997 and October 2008 by the Member States concerned in accordance with Article 4(1) of that Directive. |
(8) |
The lists of proposed sites were accompanied by information on each site, supplied in the format established by Commission Decision 97/266/EC of 18 December 1996 concerning a site information format for proposed Natura 2000 sites (4). |
(9) |
That information includes the most recent and definitive map of the site transmitted by the Member States concerned, name, location and extent of the site, and the data yielded by application of the criteria specified in Annex III to Directive 92/43/EEC. |
(10) |
On the basis of the draft list drawn up by the Commission in agreement with each of the Member States concerned, which also identifies sites hosting priority natural habitat types or priority species, a second updated list of sites selected as sites of Community importance for the Macaronesian biogeographical region should be adopted. |
(11) |
Knowledge of the existence and distribution of the natural habitat types and species is constantly evolving, as a result of the surveillance in accordance with Article 11 of Directive 92/43/EEC. Therefore, the evaluation and selection of sites at Community level was done using the best available information at present, |
(12) |
Certain Member States have not proposed sufficient sites to meet the requirements of Directive 92/43/EEC for certain habitat types and species. For those habitat types and species it can therefore not be concluded that the Natura 2000 network is complete. Taking into account the delay in receiving the information and reaching agreement with the Member States, it is necessary to adopt a second updated list of sites, which will need to be revised in accordance with Article 4 of Directive 92/43/EEC. |
(13) |
Given that knowledge on the existence and distribution of some of the natural habitat types of Annex I and species of Annex II to Directive 92/43/EEC remains incomplete, it should not be concluded that the Natura 2000 network is either complete or incomplete. The list should be revised, if necessary, in accordance with Article 4 of Directive 92/43/EEC. |
(14) |
In the interests of clarity and transparency Decision 2008/95/EC should be replaced. |
(15) |
The measures provided for in this Decision are in accordance with the opinion of the Habitats Committee, |
HAS ADOPTED THIS DECISION:
Article 1
The second updated list of sites of Community importance for the Macaronesian biogeographical region in accordance with the third subparagraph of Article 4(2) of Directive 92/43/EEC is set out in the Annex to this Decision.
Article 2
Decision 2008/95/EC is repealed.
Article 3
This Decision is addressed to the Member States.
