THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),

Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules for Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (2), and in particular Article 138(1) thereof,

Whereas:

Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XV, Part A thereto,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 are fixed in the Annex hereto.

Article 2

This Regulation shall enter into force on 27 August 2009.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 776/2009

amending Regulation (EC) No 924/2008 fixing the quantitative limit for the exports of out-of-quota sugar and isoglucose until the end of the 2008/2009 marketing year

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1), and in particular Article 61, first subparagraph, point (d), in conjunction with Article 4 thereof,

Whereas:

According to Article 61, first subparagraph, point (d) of Regulation (EC) No 1234/2007, the sugar produced during a marketing year in excess of the quota referred to in Article 56 of that Regulation may be exported only within the quantitative limit to be fixed.

Detailed implementing rules for out-of-quota exports, in particular concerning the issue of export licences, are laid down by Commission Regulation (EC) No 951/2006 of 30 June 2006 laying down detailed rules for the implementation of Council Regulation (EC) No 318/2006 as regards trade with third countries in the sugar sector (2). However, the quantitative limit should be fixed per marketing year in view of the possible opportunities on the export markets.

Commission Regulation (EC) No 924/2008 (3) has fixed the quantitative limit for the exports of out-of-quota sugar at 650 000 tonnes in respect of marketing year 2008/2009. Applications submitted for export licences for out-of-quota sugar have reached the quantity made available by that Regulation.

The fact that the fixed quantitative limit was reached 3 months prior to the end of the 2008/2009 marketing year indicates significant interest for exporting out-of-quota sugar by Community producers of sugar. In order to ensure that Community producers of sugar can continue to supply their established traditional markets as well as make use of new market opportunities it is appropriate to increase the quantitative limit fixed for exports of out-of-quota sugar in respect of marketing year 2008/2009. On the basis of the applications submitted so far and the need to extend to 3 months the validity of the export licences it can be estimated that an increase by 300 000 tonnes should be sufficient to permit a continued trade flow for Community exports of out-of-quota sugar.

According to Article 8a of Regulation (EC) No 951/2006 export licences issued for out-of-quota sugar exports are valid from the actual day of issue until 30 September of the marketing year in respect of which the export licence was issued. However, such a limitation would lead to major difficulties for exporters and unnecessary interruption of sugar trade towards the end of the marketing year. It is therefore appropriate to allow for exports to take place beyond 30 September 2009 by fixing the validity of the export licences at 3 months.

Regulation (EC) No 924/2008 should therefore be amended accordingly.

(7)

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EC) No 924/2008 is amended as follows:

1.

In Article 1, paragraph 1 is replaced by the following:

‘1.   For the 2008/2009 marketing year, running from 1 October 2008 to 30 September 2009, the quantitative limit referred to in Article 61, first subparagraph, point (d) of Regulation (EC) No 1234/2007 shall be 950 000 tonnes for exports without refund of out-of-quota white sugar falling within CN code 1701 99.’;

2.

The following Article 1a is inserted:

‘Article 1a

Validity of export licences issued for out-of-quota sugar exports in 2008/2009

By way of derogation from the provisions of Article 8a of Regulation (EC) No 951/2006 the validity of export licences issued after 1 July 2009 in respect of the quantities referred to in Article 1(1) shall expire by the end of the third month following the month during which the export licence was issued.’

Article 2

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 777/2009

amending Regulation (EC) No 575/2009 fixing an acceptance percentage for the issuing of export licences, rejecting export-licence applications and suspending the lodging of export-licence applications for out-of-quota sugar

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),

Having regard to Commission Regulation (EC) No 951/2006 of 30 June 2006 laying down detailed rules for the implementation of Council Regulation (EC) No 318/2006 as regards trade with third countries in the sugar sector (2), and in particular Article 7e in conjunction with Article 9(1) thereof,

Whereas:

According to Article 61, first subparagraph, point (d) of Regulation (EC) No 1234/2007 the sugar produced during a marketing year in excess of the quota referred to in Article 56 of that Regulation may be exported only within the quantitative limit to be fixed.

(2)

Commission Regulation (EC) No 924/2008 of 19 September 2008 fixing the quantitative limit for the exports of out-of-quota sugar and isoglucose until the end of the 2008/2009 marketing year (3) has fixed the quantitative limit at 650 000 tonnes.

(3)

The quantities of sugar covered by applications for export licences exceeded that quantitative limit. Therefore Commission Regulation (EC) No 575/2009 (4) suspended the lodging of applications for out-of-quota sugar export licences for the period 6 July 2009 to 30 September 2009.

(4)

By amendment of Regulation (EC) No 924/2008, introduced by Commission Regulation (EC) No 776/2009 (5), the quantitative limit for the exports of out-of-quota sugar in respect of marketing year 2008/2009 was increased by 300 000 tonnes.

(5)

As the quantitative limit in respect of marketing year 2008/2009 is increased the lodging of applications should once again be possible.

(6)

Regulation (EC) No 575/2009 should therefore be amended accordingly.

(7)

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets,

HAS ADOPTED THIS REGULATION:

Article 1

In Article 1 of Regulation (EC) No 575/2009, paragraph 3 is deleted.

Article 2

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

setting the allocation coefficient for the issuing of import licences applied for from 17 to 21 August 2009 for sugar products under tariff quotas and preferential agreements

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),

Having regard to Commission Regulation (EC) No 950/2006 of 28 June 2006 laying down detailed rules of application for the 2006/07, 2007/08 and 2008/09 marketing years for the import and refining of sugar products under certain tariff quotas and preferential agreements (2), and in particular Article 5(3) thereof,

Whereas:

Applications for import licences were submitted to the competent authorities in the period from 17 to 21 August 2009 in accordance with Commission Regulation (EC) No 950/2006 and/or Council Regulation (EC) No 508/2007 of 7 May 2007 opening tariff quotas for imports into Bulgaria and Romania of raw cane sugar for supply to refineries in the marketing years 2006/07, 2007/08 and 2008/09 (3), for a total quantity equal to or exceeding the quantity available for order number 09.4351 (2008-2009).

(2)

In these circumstances, the Commission should establish an allocation coefficient for licences to be issued in proportion to the quantity available and/or inform the Member States that the limit established has been reached,

HAS ADOPTED THIS REGULATION:

Article 1

Licences shall be issued within the quantitative limits set in the Annex to this Regulation in respect of import licence applications submitted from 17 to 21 August 2009, in accordance with Article 4(2) of Regulation (EC) No 950/2006 and/or Article 3 of Regulation (EC) No 508/2007.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DECISION

of 20 August 2009

authorising methods for grading pig carcases in Slovakia

(notified under document C(2009) 6389)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1), and in particular Article 43, point (m), in conjunction with Article 4 thereof,

Whereas:

Under Annex V, point B.IV, paragraph 1 of Regulation (EC) No 1234/2007, the grading of pig carcases is to be determined by estimating the lean meat content by means of statistically proven assessment methods based on the physical measurement of one or more anatomical parts of the pig carcase. The authorisation of grading methods is subject to compliance with a maximum tolerance for statistical error in assessment. This tolerance is defined in Article 23(3) of Commission Regulation (EC) No 1249/2008 of 10 December 2008 laying down detailed rules on the implementation of the Community scales for the classification of beef, pig and sheep carcases and the reporting of prices thereof (2).

Slovakia has asked the Commission to authorise three methods for grading pig carcases and has presented the results of its dissection trials in the second part of the protocol provided for in Article 23(4) of Regulation (EC) No 1249/2008.

(3)

Examination of this request has revealed that the conditions for authorising these grading methods are fulfilled.

(4)

No modification of the apparata or grading methods may be authorised except by means of a new Commission Decision adopted in the light of experience gained. For this reason, the present authorisation may be revoked.

(5)

The measures provided for in this Decision are in accordance with the opinion of the Management Committee for the Common Organisation of the Agricultural Markets,

HAS ADOPTED THIS DECISION:

Article 1

The use of the following methods is hereby authorised for grading pig carcases pursuant to Regulation (EC) No 1234/2007 in Slovakia:

(a)

the apparatus termed ‘Two-point, (Zwei punkte — ZP)’ and assessment methods related thereto, details of which are given in Part 1 of the Annex,

(b)

the apparatus termed ‘Fat-O-Meater (FOM)’ and assessment methods related thereto, details of which are given in Part 2 of the Annex,

(c)

the apparatus termed ‘Ultrafom 300 (UFOM)’ and assessment methods related thereto, details of which are given in Part 3 of the Annex.

Article 2

Modifications of the apparata or the assessment methods shall not be authorised.

Article 3

This Decision is addressed to the Slovak Republic.

ANNEX

METHODS FOR GRADING PIG CARCASES IN SLOVAKIA

PART 1

Two-Point (Zwei Punkte — ZP)

1.

Grading of pig carcases shall be carried out using the manual method termed ‘Two-Point (Zwei punkte — ZP)’.

2.

This method may be implemented using a ruler, with the grading determined on the basis of the prediction equation. It is based on the manual measurement on the mid-line of the split carcase of the thickness of the muscle and of the thickness of the fat.

3.

The lean meat content of carcases shall be calculated according to the following formula:

the thickness of muscle, measured on the mid-line of the split carcase at the shortest connection between the front (cranial) end of the musculus gluteus medius and the upper (dorsal) edge of the spinal canal (in millimetres),

F

=

the thickness of fat (including rind), measured on the mid-line of the split carcase at the thinnest location above the musculus gluteus medius (in millimetres).

This formula shall be valid for carcases weighing between 60 and 120 kilograms.

PART 2

Fat-O-Meater (FOM)

1.

Grading of pig carcases shall be carried out using the apparatus termed ‘Fat-O-Meater (FOM)’.

2.

The apparatus shall be equipped with a probe of 6-millimetre diameter containing a photodiode of the Siemens SFH 950 type and a photodetector (type SFH 960), having an operation distance of between 3 and 103 millimetres. The results of the measurements are converted into estimated lean meat content by means of a computer.

3.

The lean meat content of the carcase shall be calculated according to the following formula:

the thickness of muscle measured between the second and third last ribs, 70 mm beside the mid-line of the split carcase (in millimetres),

the thickness of fat (including rind), measured in the same point as the thickness of muscle (in millimetres).

This formula shall be valid for carcases weighing between 60 and 120 kilograms.

PART 3

Ultrafom 300 (UFOM)

1.

Grading of pig carcases shall be carried out using the apparatus termed ‘Ultrafom 300 (UFOM)’.

2.

The apparatus shall be equipped with an ultrasonic probe at 4 MHz (Krautkrämer MB 4 SE). The ultrasonic signal is digitised, stored and processed by a microprocessor (type Intel 80 C 32). The results of the measurements shall be converted into estimated lean meat content by means of the Ultrafom apparatus itself.

3.

The lean meat content of the carcase shall be calculated according to the following formula:

COMMISSION DECISION

of 26 August 2009

amending Decision 2006/139/EC as regards its period of applicability and the list of authorities in Canada approved for keeping a herdbook or register of certain animals

(notified under document C(2009) 6522)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 94/28/EC of 23 June 1994 laying down the principles relating to the zootechnical and genealogical conditions applicable to imports from third countries of animals, their semen, ova and embryos, and amending Directive 77/504/EEC on pure-bred breeding animals of the bovine species (1), and in particular Article 3 thereof,

Whereas:

Commission Decision 2006/139/EC of 7 February 2006 implementing Council Directive 94/28/EC as regards a list of authorities in third countries approved for the keeping of a herdbook or register of certain animals (2) provides that Member States are to authorise the importation of breeding animals of certain species, their semen, ova and embryos as ‘pure-bred’ or ‘hybrid’ only if they are entered or registered in a herdbook or register kept by an authority approved for that purpose. The approved authorities are listed in the Annex to that Decision.

In accordance with Article 18 of Council Directive 2008/73/EC of 15 July 2008 simplifying procedures of listing and publishing information in the veterinary and zootechnical fields and amending Directives 64/432/EEC, 77/504/EEC, 88/407/EEC, 88/661/EEC, 89/361/EEC, 89/556/EEC, 90/426/EEC, 90/427/EEC, 90/428/EEC, 90/429/EEC, 90/539/EEC, 91/68/EEC, 91/496/EEC, 92/35/EEC, 92/65/EEC, 92/66/EEC, 92/119/EEC, 94/28/EC, 2000/75/EC, Decision 2000/258/EC and Directives 2001/89/EC, 2002/60/EC and 2005/94/EC (3), the procedure for listing of bodies in respect of the species and/or races concerned that the competent authority of the third country has approved for the purpose of Directive 94/28/EC will be replaced by an Internet-based information coming into effect on 1 January 2010. For the sake of clarity and legal certainty it is therefore necessary to introduce an end date for the validity of Decision 2006/139/EC.

The entry for Bulgaria in the Annex to Decision 2006/139/EC became obsolete with the accession of that Member State and should therefore be deleted for the sake of legal clarity.

In addition, Canada has requested to update several entries for that country in the Annex to Decision 2006/139/EC.

Canada has provided guarantees regarding compliance with the relevant requirements laid down in Community legislation and, in particular those laid down in Directive 94/28/EC.

Decision 2006/139/EC should therefore be amended accordingly.

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Zootechnics,

HAS ADOPTED THIS DECISION:

Article 1

Decision 2006/139/EC is amended as follows:

1.

The following Article is inserted:

‘Article 2a

This Decision shall apply until 31 December 2009.’

2.

The Annex is amended in accordance with the Annex to this Decision.

Article 2

This Decision is addressed to the Member States.
