DECISION OF THE EEA JOINT COMMITTEE

No 148/2007

of 7 December 2007

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 137/2007 of 26 October 2007 (1).

(2)

Commission Decision 2007/275/EC of 17 April 2007 concerning lists of animals and products to be subject to controls at border inspection posts under Council Directives 91/496/EEC and 97/78/EC (2) is to be incorporated into the Agreement.

(3)

Commission Decision 2007/276/EC of 19 April 2007 amending Decisions 2001/881/EC and 2002/459/EC as regards the list of border inspection posts (3) is to be incorporated into the Agreement.

(4)

Commission Decision 2007/345/EC of 10 May 2007 amending Annexes I and II to Decision 2002/308/EC establishing lists of approved zones and approved farms with regard to one or more of the fish diseases viral haemorrhagic septicaemia (VHS) and infectious haematopoietic necrosis (IHN) (4) is to be incorporated into the Agreement.

(5)

Decision 2007/275/EC repeals Commission Decision 2002/349/EC (5) which is incorporated into the Agreement and which is consequently to be repealed under the Agreement.

(6)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as follows:

1)

the following indent shall be added in points 39 (Commission Decision 2001/881/EC) and 46 (Commission Decision 2002/459/EC) in Part 1.2:

‘—

32007 D 0276: Commission Decision 2007/276/EC of 19 April 2007 (OJ L 116, 4.5.2007, p. 34).’;

2)

the following point shall be inserted after point 136 (Commission Decision 2006/677/EC) in Part 1.2:

Article 2

The texts of Decisions 2007/275/EC, 2007/276/EC and 2007/345/EC, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 December 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 137/2007 of 26 October 2007 (1).

(2)

Commission Decision 2007/142/EC of 28 February 2007 establishing a Community Veterinary Emergency Team to assist the Commission in supporting Member States and third countries in veterinary matters relating to certain animal diseases (2) is to be incorporated into the Agreement.

(3)

Commission Directive 2007/10/EC of 21 February 2007 amending Annex II to Council Directive 92/119/EEC as regards the measures to be taken within a protection zone following an outbreak of swine vesicular disease (3) is to be incorporated into the Agreement.

(4)

Commission Decision 2007/146/EC of 28 February 2007 amending Decision 2005/393/EC as regards the conditions for the exemption from the exit ban for intra-Community trade and as regards the demarcation of the restricted zones in Bulgaria, France, Germany, and Italy (4) is to be incorporated into the Agreement.

(5)

Commission Decision 2007/174/EC of 20 March 2007 amending Decision 2003/467/EC as regards the declaration that certain provinces or regions of Italy are officially free of bovine tuberculosis, bovine brucellosis and enzootic bovine leukosis and that a region of Poland is officially free of enzootic bovine leukosis (5) is to be incorporated into the Agreement.

(6)

Commission Decision 2007/182/EC of 19 March 2007 on a survey for chronic wasting disease in cervids (6) is to be incorporated into the Agreement.

(7)

Commission Decision 2007/227/EC of 11 April 2007 amending Decision 2005/393/EC as regards restricted zones in relation to bluetongue (7) is to be incorporated into the Agreement.

(8)

Commission Decision 2007/265/EC of 26 April 2007 amending Annex E to Council Directive 92/65/EEC to include additional health measures for the trade in live bees, and to update the health certificates models (8) is to be incorporated into the Agreement.

(9)

Commission Decision 2007/268/EC of 13 April 2007 on the implementation of surveillance programmes for avian influenza in poultry and wild birds to be carried out in the Member States and amending Decision 2004/450/EC (9) is to be incorporated into the Agreement.

(10)

Commission Decision 2007/354/EC of 21 May 2007 amending Decision 2005/393/EC as regards restricted zones in relation to bluetongue (10) is to be incorporated into the Agreement.

(11)

Commission Decision 2007/357/EC of 22 May 2007 amending Decision 2005/393/EC as regards restricted zones in relation to bluetongue (11) is to be incorporated into the Agreement.

(12)

This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Directive 2007/10/EC and Decisions 2007/142/EC, 2007/146/EC, 2007/174/EC, 2007/182/EC, 2007/227/EC, 2007/265/EC, 2007/268/EC, 2007/354/EC and 2007/357/EC, in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 December 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 137/2007 of 26 October 2007 (1).

(2)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 139/2007 of 26 October 2007 (2).

(3)

Commission Decision 2007/23/EC of 22 December 2006 amending Appendix B of Annex VII to the 2005 Act of Accession as regards certain establishments in the meat, milk and fish sectors in Romania (3) is to be incorporated into the Agreement.

(4)

Commission Decision 2007/26/EC of 22 December 2006 amending the Appendix to Annex VI to the Act of Accession of Bulgaria and Romania as regards certain milk processing establishments in Bulgaria (4) is to be incorporated into the Agreement.

(5)

Commission Decision 2007/27/EC of 22 December 2006 adopting certain transitional measures concerning deliveries of raw milk to processing establishments and the processing of this raw milk in Romania with regard to the requirements of Regulation (EC) Nos 852/2004 and 853/2004 of the European Parliament and of the Council (5) is to be incorporated into the Agreement.

(6)

Commission Decision 2007/29/EC of 22 December 2006 laying down transitional measures for certain products of animal origin covered by Regulation (EC) No 853/2004 of the European Parliament and of the Council introduced into Bulgaria and Romania from third countries before 1 January 2007 (6) is to be incorporated into the Agreement.

(10)

Commission Decision 2007/264/EC of 25 April 2007 amending Decision 2007/30/EC as regards transitional measures for certain milk products obtained in Bulgaria (10) is to be incorporated into the Agreement.

(11)

Commission Decision 2007/398/EC of 11 June 2007 amending Decision 2007/31/EC laying down transitional measures as regards the dispatch of certain products of the meat and milk sectors covered by Regulation (EC) No 853/2004 of the European Parliament and of the Council from Bulgaria to other Member States (11) is to be incorporated into the Agreement.

(12)

As far as Chapter I of Annex I is concerned, this Decision shall apply to Iceland with the transitional period specified in paragraph 2 of the Introductory Part of Chapter I of Annex I for the areas which did not apply to Iceland prior to the review of this Chapter by Decision of the EEA Joint Committee No 133/2007 of 26 October 2007 (12).

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Annexes I and II to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2007/23/EC, 2007/26/EC, 2007/27/EC, 2007/29/EC, 2007/30/EC, 2007/31/EC, 2007/213/EC, 2007/264/EC and 2007/398/EC, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on the day following the last notification to the EEA Joint Committee under Article 103(1) of the Agreement (*1) or on the day of entry into force of the EEA Enlargement Agreement, whichever is the later.

Pending the entry into force of the EEA Enlargement Agreement, it shall apply provisionally from the date of entry into force of the Decision on the EEA Joint Committee No 137/2007 of 26 October 2007.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

ANNEX

Annexes I and II to the Agreement shall be amended as follows:

1)

the following shall be inserted in point 16 (Regulation (EC) No 852/2004 of the European Parliament and of the Council) and inserted before the adaptation text in point 17 (Regulation (EC) No 853/2004 of the European Parliament and of the Council) in Part 6.1 of Chapter I of Annex I, and point 54zzzh (Regulation (EC) No 852/2004 of the European Parliament and of the Council) in Chapter XII of Annex II to the Agreement:

‘The transitional arrangements set out in the following acts shall apply:

Commission Regulation (EC) No 635/2006 of 25 April 2006 repealing Regulation (EEC) No 1251/70 on the right of workers to remain in the territory of a Member State after having been employed in that State (3) is to be incorporated into the Agreement.

(5)

Directive 2004/38/EC repeals, with effect from 30 April 2006, Council Directives 64/221/EEC (4), 68/360/EEC (5), 72/194/EEC (6), 73/148/EEC (7), 75/34/EEC (8), 75/35/EEC (9), 90/364/EEC (10), 90/365/EEC (11) and 93/96/EEC (12), which are incorporated into the Agreement and which are consequently to be repealed under the Agreement.

(6)

Directive 2004/38/EC repeals, with effect from 30 April 2006, Articles 10 and 11 of Council Regulation (EEC) No 1612/68 (13), which is incorporated into the Agreement.

(7)

Regulation (EC) No 635/2006 repeals, with effect from 30 April 2006, Commission Regulation (EEC) No 1251/70 (14), which is incorporated into the Agreement and which consequently is to be repealed under the Agreement.

(8)

The concept of ‘Union Citizenship’ is not included in the Agreement.

(9)

Immigration policy is not part of the Agreement.

(10)

The Agreement does not apply to third country nationals. Family members within the meaning of the Directive having third country nationality shall nevertheless enjoy certain derived rights such as those foreseen in Articles 12(2), 13(2) and 18 when entering or moving to the host country.

(11)

Decision of the EEA Joint Committee No 191/1999 (15) of 17 December 1999 introduced new sectoral adaptations to Annex V and Annex VIII to the Agreement with regard to Liechtenstein, which were amended by the Agreement on the Participation of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic in the European Economic Area (16), signed in Luxembourg on 14 October 2003.

(12)

The incorporation of Directive 2004/38/EC into the Agreement shall be without prejudice to these sectoral adaptations with regard to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Annex VIII to the Agreement shall be amended as follows:

1)

the text of point 3 (Council Directive 73/148/EEC) shall be replaced by the following:

32004 L 0038: Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC (OJ L 158, 30.4.2004, p. 77, as corrected by OJ L 229, 29.6.2004, p. 35, OJ L 30, 3.2.2005, p. 27 and OJ L 197, 28.7.2005, p. 34).

The provisions of the Directive shall, for the purposes of the Agreement, be read with the following adaptations:

(a)

The Directive shall apply, as appropriate, to the fields covered by this Annex.

(b)

The Agreement applies to nationals of the Contracting Parties. However, members of their family within the meaning of the Directive possessing third country nationality shall derive certain rights according to the Directive.

(c)

The words “Union citizen(s)” shall be replaced by the words “national(s) of EC Member States and EFTA States”.

(d)

In Article 24(1) the word “Treaty” shall read “Agreement” and the words “secondary law” shall read “secondary law incorporated in the Agreement”.’;

2)

the texts of points 4 (Council Directive 75/34/EEC), 5 (Council Directive 75/35/EEC), 6 (Council Directive 90/364/EEC), 7 (Council Directive 90/365/EEC) and 8 (Council Directive 93/96/EEC) shall be deleted.

Article 2

Annex V to the Agreement shall be amended as follows:

1)

the text of point 1 (Council Directive 64/221/EEC) shall be replaced by the following:

‘The act referred to in point 3 of Annex VIII to this Agreement (Directive 2004/38/EC of the European Parliament and of the Council), as adapted for the purposes of the Agreement shall apply, as appropriate, to the fields covered by this Annex.’;

2)

Joint Declaration by the Contracting Parties to Decision of the EEA Joint Committee No 158/2007 incorporating Directive 2004/38/EC of the European Parliament and of the Council into the Agreement

The concept of Union Citizenship as introduced by the Treaty of Maastricht (now Articles 17 seq. EC Treaty) has no equivalent in the EEA Agreement. The incorporation of Directive 2004/38/EC into the EEA Agreement shall be without prejudice to the evaluation of the EEA relevance of future EU legislation as well as future case law of the European Court of Justice based on the concept of Union Citizenship. The EEA Agreement does not provide a legal basis for political rights of EEA nationals.

The Contracting Parties agree that immigration policy is not covered by the EEA Agreement. Residence rights for third country nationals fall outside the scope of the Agreement with the exception of rights granted by the Directive to third country nationals who are family members of an EEA national exercising his or her right to free movement under the EEA Agreement as these rights are corollary to the right of free movement of EEA nationals. The EFTA States recognise that it is of importance to EEA nationals making use of their right of free movement of persons, that their family members within the meaning of the Directive and possessing third country nationality also enjoy certain derived rights such as foreseen in Articles 12(2), 13(2) and 18. This is without prejudice to Article 118 of the EEA Agreement and the future development of independent rights of third country nationals which do not fall within the scope of the EEA Agreement.

Commission Decision 2007/151/EC of 6 March 2007 amending Decisions 94/741/EC and 97/622/EC as regards the questionnaires for the report on the implementation of Directive 2006/12/EC of the European Parliament and of the Council on waste and on the implementation of Council Directive 91/689/EEC on hazardous waste (2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following shall be added in points 1ca (Commission Decision 94/741/EC) and 1cb (Commission Decision 97/622/EC) of Annex XX to the Agreement:

‘, as amended by:

32007 D 0151: Commission Decision 2007/151/EC of 6 March 2007 (OJ L 67, 7.3.2007, p. 7).’

Article 2

The text of Decision 2007/151/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 December 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

Annex XX to the Agreement was amended by Decision of the EEA Joint Committee No 146/2007 of 26 October 2007 (1).

(2)

Commission Decision 2006/534/EC of 20 July 2006 concerning a questionnaire for Member States reports on the implementation of Directive 1999/13/EC during the period 2005-2007 (2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following point shall be inserted after point 21abb (Commission Decision 2002/529/EC) of Annex XX to the Agreement:

‘21abc.

32006 D 0534: Commission Decision 2006/534/EC of 20 July 2006 concerning a questionnaire for Member States reports on the implementation of Directive 1999/13/EC during the period 2005-2007 (OJ L 213, 3.8.2006, p. 4).’

Article 2

The text of Decision 2006/534/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 December 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

amending Annex XXI (Statistics) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XXI to the Agreement was amended by Decision of the EEA Joint Committee No 132/2007 of 26 October 2007 (1).

(2)

Commission Regulation (EC) No 833/2007 of 16 July 2007 ending the transitional period provided for in Council Regulation (EC) No 1172/98 on statistical returns in respect of the carriage of goods by road (2) is to be incorporated into the Agreement.

(3)

This Decision is not to apply to Iceland,

HAS DECIDED AS FOLLOWS:

Article 1

The following point shall be inserted after point 7fa (Commission Regulation (EC) No 642/2004) of Annex XXI to the Agreement:

‘7fb.

32007 R 0833: Commission Regulation (EC) No 833/2007 of 16 July 2007 ending the transitional period provided for in Council Regulation (EC) No 1172/98 on statistical returns in respect of the carriage of goods by road (OJ L 185, 17.7.2007, p. 9).

The provisions of the Regulation shall, for the purposes of the Agreement, be read with the following adaptation:

This Regulation shall not apply to Iceland.’

Article 2

The text of Regulation (EC) No 833/2007 in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 December 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Whereas:

Commission Regulation (EC) No 610/2007 of 1 June 2007 amending Regulation (EC) No 1725/2003 adopting certain international accounting standards in accordance with Regulation (EC) No 1606/2002 of the European Parliament and of the Council as regards International Financial Reporting Interpretations Committee’s (IFRIC) Interpretation 10 (2) is to be incorporated into the Agreement.

Commission Regulation (EC) No 611/2007 of 1 June 2007 amending Regulation (EC) No 1725/2003 adopting certain international accounting standards in accordance with Regulation (EC) No 1606/2002 of the European Parliament and of the Council as regards International Financial Reporting Interpretations Committee’s (IFRIC) Interpretation 11 (3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indents shall be added in point 10ba (Commission Regulation (EC) No 1725/2003) of Annex XXII to the Agreement:

The texts of Regulations (EC) No 610/2007 and (EC) No 611/2007 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force 20 days after its adoption, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
