COUNCIL REGULATION (EC) No 380/2008

amending Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty establishing the European Community, and in particular Article 63(3)(a) thereof,
Having regard to the proposal from the Commission,
Having regard to the opinion of the European Parliament (1),
Whereas:

The Amsterdam Treaty aims to establish progressively an area of freedom, security and justice and confers the right of initiative on the Commission in order to take the relevant measures on a harmonised immigration policy. |
(2) |
It is essential that the uniform format for residence permits should contain all the necessary information and meet very high technical standards, in particular as regards safeguards against counterfeiting and falsification. This will contribute to the objective of preventing and fighting against illegal immigration and illegal residence. It must also be suited to use by all the Member States. |
(3) |
The integration of biometric identifiers is an important step towards the use of new elements, which establish a more reliable link between the holder and the residence permit as an important contribution to ensuring that it is protected against fraudulent use. The specifications set out in the International Civil Aviation Organisation (ICAO) document No 9303 Part 3 on Size 1 and 2 machine readable official documents should be taken into account. |

Furthermore, the vast majority of Member States apply the principle of one person one document, which enhances security even further. It should be examined whether this principle should be rendered mandatory. |

At its meeting in Thessaloniki on 19 and 20 June 2003, the European Council stressed that a coherent approach was needed in the EU on biometric identifiers or biometric data, which would result in harmonised solutions for documents for third country nationals, EU citizens’ passports and information systems. |
(6) |
The use of new technologies such as e-government and digital signature for access to e-services should be facilitated by giving Member States the possibility to use the storage medium used for the incorporation of biometric identifiers or an additional storage medium for that purpose in residence permits. |
(7) |
The purpose of this Regulation is solely to set the security features and biometric identifiers to be used by the Member States in a uniform format of residence permit for third-country nationals. |
(8) |
This Regulation only lays down specifications that are not secret; these specifications need to be supplemented by further specifications which may remain secret in order to prevent counterfeiting and falsifications and which may not include personal data or references to such data. Powers to adopt such supplementary specifications should be conferred on the Commission, which should be assisted by the Committee established by Article 6 of Council Regulation (EC) No 1683/95 of 29 May 1995 laying down a uniform format for visas (2). |

With regard to the personal data to be processed in the context of the uniform format for residence permits, Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (3) applies. It must be ensured that no further information is stored on the uniform format for residence permits unless provided for in Council Regulation (EC) No 1030/2002 (4), its Annex or unless it is mentioned in the relevant travel document. |
(10) |
In accordance with the principle of proportionality, it is necessary and appropriate for the achievement of the basic objective of introducing biometric identifiers in interoperable formats to lay down rules for all Member States implementing the Schengen Convention. This Regulation does not go beyond what is necessary in order to achieve the objectives pursued in accordance with the third paragraph of Article 5 of the Treaty. |

In accordance with Articles 1 and 2 of the Protocol on the position of Denmark, annexed to the Treaty on European Union and the Treaty establishing the European Community, Denmark does not take part in the adoption of this Regulation, and is therefore not bound by it or subject to its application. Given that this Regulation builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark should, in accordance with Article 5 of that Protocol, decide within a period of six months after the adoption of this Regulation, whether it will implement it in its national law. |

As regards Iceland and Norway, this Regulation constitutes a development of provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the association of those two States with the implementation, application and development of the Schengen acquis (5) which fall within the area referred to in Article 1, point C of Council Decision 1999/437/EC (6) on certain arrangements for the application of that Agreement. |

In accordance with Article 3 of the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, the United Kingdom gave notice, by letter of 29 December 2003, of its wish to take part in the adoption and application of this Regulation. |

HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EC) No 1030/2002 is hereby amended as follows:

in Article 3, the first paragraph shall be replaced by the following: ‘In accordance with the procedure referred to in Article 7(2), it may be decided that the specifications referred to in Article 2 shall be secret and not be published. In that case they shall be made available only to the bodies designated by the Member States as responsible for the printing and to persons duly authorised by a Member State or the Commission.’; |

in Article 4, the second paragraph shall be replaced by the following: ‘No information in machine-readable form shall be included on the resident permit or on the storage medium of the residence permit referred to in Article 4a, unless provided for in this Regulation, or its Annex or unless it is mentioned in the related travel document by the issuing State in accordance with its national legislation. Member States may also store data for e-services such as e-government and e-business as well as additional provisions relating to the residence permit on a chip referred to in point 16 of the Annex. However, all national data must be logically separated from the biometric data referred to in Article 4a. For the purposes of this Regulation, the biometric features in residence permits shall only be used for verifying:

the following Articles shall be inserted: ‘Article 4a The uniform format for residence permits shall include a storage medium containing the facial image and two fingerprint images of the holder, both in interoperable formats. The data shall be secured and the storage medium shall be of sufficient capacity and capability to guarantee the integrity, authenticity and confidentiality of the data. Article 4b For the purposes of this Regulation, Member States shall take biometric identifiers comprising the facial image and two fingerprints from third-country nationals. The procedure shall be determined in accordance with the national practice of the Member State concerned and with the safeguards laid down in the Convention for the Protection of Human Rights and Fundamental Freedoms and in the United Nations Convention on the Rights of the Child. The following biometric identifiers shall be taken:
The technical specifications for the capture of biometric identifiers shall be set out in accordance with the procedure described in Article 7(2) and with ICAO standards and the technical specifications for passports issued by Member States to their nationals pursuant to Council Regulation (EC) No 2252/2004 of 13 December 2004 on standards for security features and biometrics in passports and travel documents issued by Member States (*1). The capture of fingerprints is compulsory as of six years of age. Persons for whom fingerprinting is physically impossible shall be exempt from the requirement to give fingerprints. |

the following Article shall be inserted: ‘Article 5a Where Member States use the uniform format for purposes other than those covered by this Regulation, appropriate measures must be taken to ensure that confusion with the residence permit referred to in Article 1 is not possible and the purpose is clearly indicated on the card.’; |

in Article 9, the third paragraph shall be replaced by the following: ‘The storage of the facial image as primary biometric identifier shall be implemented at the latest two years, and the storage of the two fingerprint images at the latest three years, after the adoption of the respective technical measures provided for in Article 2(1)(d) and (e). However, the validity of residence permits already issued shall not be affected by the implementation of this Regulation, unless the Member State concerned decides otherwise. For a transitional period of two years after the adoption of the technical specifications for the facial image referred to in the third paragraph of this Article, the residence permit may continue to be issued in sticker form.’; |

Article 2
This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing the standard import values for determining the entry price of certain fruit and vegetables
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules of Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (1), and in particular Article 138(1) thereof,
Whereas:

Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto. |
(2) |
In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 shall be fixed as indicated in the Annex hereto.
Article 2
This Regulation shall enter into force on 29 April 2008.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 382/2008
of 21 April 2008
on rules of application for import and export licences in the beef and veal sector
(Recast)
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1254/1999 of 17 May 1999 on the common organisation of the market in beef and veal (1), and in particular Article 29(2), Article 33(12) and Article 41 thereof,
Whereas:

Commission Regulation (EC) No 1445/95 of 26 June 1995 on rules of application for import and export licences in the beef and veal sector and repealing Regulation (EEC) No 2377/80 (2) has been substantially amended several times (3). Since further amendments are to be made, it should be recast in the interests of clarity. |
(2) |
Regulation (EC) No 1254/1999 makes all imports into the Community of the products listed in Article 1(1)(a) of that Regulation subject to presentation of an import licence. Experience has shown the need for close monitoring of the trend of trade in all products of the beef and veal sector of particular importance for the balance of this particularly sensitive market. Accordingly to improve market management import licences should also be required for products of CN codes 1602 50 31 to 1602 50 80 and 1602 90 69. |
(3) |
It is necessary to monitor imports into the Community of young male animals, in particular calves. Issuing of import licences for those animals should be made conditional on the indication of their country of provenance. |
(4) |
Under Article 6(4) of Council Decision 79/542/EEC of 21 December 1976 drawing up a list of third countries or parts of third countries, and laying down animal and public health and veterinary certification conditions, for importation into the Community of certain live animals and their fresh meat (4), the original of the veterinary certificate must accompany bovine animals until they reach the border inspection post. |
(5) |
There are order numbers in the Integrated Tariff of the European Communities (TARIC) that enable identification of the import tariff quotas, the products involved and in certain cases their origin. The Member States should be required to put those numbers on the import licences or extract(s) therefrom and to use them in their notifications to the Commission. |
(6) |
The competent national authority issuing the import licence does not always know the country of origin of the quantities imported under tariff quotas opened for several countries or of the quantities imported subject to CCT duties. Identification of the country of origin in the case of tariff quotas or in the case of non-preferential imports should be made a primary requirement within the meaning of Commission Regulation (EEC) No 2220/85 of 22 July 1985 laying down common detailed rules for the application of the system of securities for agricultural products (5), and entry of the country of origin for the quotas in question and for non-preferential imports in column 31 of the import licence or extract thereof should therefore be required. |
(7) |
Regulation (EC) No 1254/1999 requires presentation of an export licence with advance fixing of the refund in the case of any export operation for which an export refund is claimed. Specific rules of application for that arrangement should be determined, covering in particular submission of applications and the information to be given on applications and licences. The provisions of Commission Regulation (EC) No 1291/2000 of 9 June 2000 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products (6), should accordingly be supplemented. |
(8) |
Article 33(11) of Regulation (EC) No 1254/1999 provides for the export volume obligations arising from the agreements concluded in accordance with Article 300 of the Treaty to be respected on the basis of export licences. Precise rules should therefore be laid down on lodging of applications, issuing of licences and the length of validity of these licences. |
(9) |
Further, notification of decisions on export licence applications should be made only after a reflection period enabling the Commission to assess the quantities applied for and the relevant expenditure and if appropriate take particular action on the applications in question. In the interests of applicants they should be able to withdraw applications if an acceptance percentage applying to these has been set. |
(10) |
In the case of applications for quantities not exceeding 25 tonnes immediate issuing of the licence, if the operator so requests, should be permitted. To prevent circumvention of the standard provisions the period of validity of such licences should be restricted. |
(11) |
To permit very precise management of quantities exported the tolerance rules set in Regulation (EC) No 1291/2000 should not apply. |
(12) |
It is necessary to incorporate in this Regulation the special export provisions of Commission Regulation (EC) No 1643/2006 of 7 November 2006 laying down detailed rules for the application of granting of assistance for the export of beef and veal products which may benefit from a special import treatment in a third country (7), and Commission Regulation (EC) No 2051/96 of 25 October 1996 laying down certain detailed rules for granting of assistance for the export of beef and veal which may benefit from a special import treatment in Canada and amending Regulation (EC) No 1445/95 (8). |
(13) |
To be able to run these import and export licence arrangements properly, the Commission needs precise information on licence applications made and the use of those issued. Administrative efficiency dictates that communications from Member States to the Commission be made in a single prescribed form. |

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Beef and Veal, |
HAS ADOPTED THIS REGULATION:
CHAPTER I
SCOPE
Article 1
This Regulation sets rules of application for import and export licences in the beef and veal sector.
CHAPTER II
IMPORT LICENCES
Article 2
1. All importation into the Community of the products listed at (a) in Article 1(1) of Regulation (EC) No 1254/1999 or of CN codes 1602 50 31 to 1602 50 80 and 1602 90 69 shall be subject to presentation of an import licence.
2. For imports of products falling within CN codes 0102 90 05 to 0102 90 49, with the exception of import quotas for live bovine animals governed by the respective regulations containing the rules of application, the import licence application and the licence shall show:
(a) |
in box 7, the country of provenance; |
(b) |
in box 8, the country of origin, which shall correspond to the exporting country within the meaning of Part 2 of Annex I, (Models of Veterinary Certificates), to Decision 79/542/EEC. The licence shall carry with it an obligation to import from that country; |
(c) |
in box 20, the following entry: ‘The country of origin specified in box 8 corresponds to the exporting country indicated on the original or the copy of the veterinary certificate.’ |
3. Release of the animals referred to in paragraph 2 for free circulation shall be subject to presentation of the original of the veterinary certificate, or of a copy certified correct by the Community border inspection post, provided that the issuing country is the same as that indicated in box 8 of the import licence.
Article 3
Licences shall be valid 90 days from their date of issue as defined in Article 23(1) of Regulation (EC) No 1291/2000.
Article 4
The security against import licences shall be:
(a) |
EUR 5 per head for live animals; |
(b) |
EUR 12 per 100 kg net weight for other products. |
Article 5
1. Without prejudice to more specific provisions, licence applications shall be made for products of a single CN code or one of the groups of the CN codes listed in the same indent in Annex I.
2. The information shown on the application shall be carried over to the licence.
3. In the case of imports under an import quota, the body issuing the import licence shall indicate the order number for the quota in the Integrated Tariff of the European Communities (TARIC) in box 20 of the licence or extracts thereof.
Article 6
1. No later than the 10th day of each month, Member States shall notify the Commission the quantities of products, in kilograms product weight or heads, for which import licences were issued in the previous month in relation to out of quota imports.
2. No later than 31 October each year, Member States shall notify the Commission the quantities of products, in kilograms product weight or heads, for which import licences issued during the period from 1 July of the previous year to 30 June of the year in question were unused in relation to out of quota imports.
3. No later than 31 October each year, Member States shall notify the Commission the quantities of products, in kilograms product weight or heads, broken down by month of import and per country of origin, which were actually released for free circulation during the period from 1 July of the previous year to 30 June of the year in question in relation to out of quota imports.
However, as of the period starting on 1 July 2009, Member States shall forward to the Commission details of the quantities of products put into free circulation as of 1 July 2009 in relation to out of quota imports in accordance with Article 4 of Commission Regulation (EC) No 1301/2006 (9).
Article 7
The notifications referred to in Article 6(1), 6(2) and the first subparagraph of Article 6(3) shall be made as indicated in Annexes II, III and IV, using the product categories indicated in Annex V.
Article 8
1. When the quantity actually imported is attributed to the licence or the extract, the country of origin must be shown in column 31 of the import licence or extract thereof in addition to the information already stipulated by Regulation (EC) No 1291/2000.
2. The requirement laid down in paragraph 1 of this Article is a primary requirement within the meaning of Article 20 of Regulation (EEC) No 2220/85.
CHAPTER III
EXPORT LICENCES
Article 9
Without prejudice to Article 5(1) of Regulation (EC) No 1291/2000, all exports of beef and veal products for which an export refund is claimed shall require presentation of an export licence with advance fixing of the refund, in accordance with the provisions of Articles 10 to 16 of this Regulation.
Article 10
1. The period of validity of licences for exports of products for which a refund is claimed and which are subject to the issuing of an export licence with advance fixing of the refund, calculated from the date of issue within the meaning of Article 23(2) of Regulation (EC) No 1291/2000, shall be:
(a) |
five months plus the current month for products falling within CN code 0102 10 and 75 days for products falling within CN codes 0102 90 and ex 1602; |
(b) |
60 days for other products. |
2. The validity of licences for exports of beef and veal issued under the procedure laid down in Article 49 of Regulation (EC) No 1291/2000 shall expire at the end of the:
(a) |
fifth month, from the month of issue within the meaning of Article 23(2) of that Regulation, for products falling within CN code 0102 10; |
(b) |
fourth month, from the month of issue within the meaning of Article 23(2) of that Regulation, for other products. |
3. By derogation from Article 49(5) of Regulation (EC) No 1291/2000, the time limit of 21 days for products falling within CN code 0102 10 is replaced by 90 days.
4. Licence applications and licences shall contain in box 15 the product description, in box 16 the 12-figure code of the agricultural product export refund nomenclature and in box 7 the country of destination.
5. The product categories indicated in the second paragraph of Article 14 of Regulation (EC) No 1291/2000 are listed in Annex VI to this Regulation.
Article 11
The security for licences with advance fixing of the refund shall be:
(a) |
EUR 26 per head for live animals; |
(b) |
EUR 15 per 100 kg for products falling within code 0201 30 00 9100 of the agricultural product export refund nomenclature; |
(c) |
EUR 9 per 100 kg net weight for other products. |
Article 12
1. Applications for export licences with advance fixing of the refund as referred to in Article 10(1), (2) and (3) may be lodged with the competent authorities from Monday to Friday each week.
Export licences shall be issued on the Wednesday following the week in which the application is lodged, provided that none of the particular measures referred to in paragraphs 2 or 3 of this Article have since been taken by the Commission.
However, licences applied for within the framework of Article 16 of Regulation (EC) No 1291/2000 shall be issued immediately.
By way of derogation from the second subparagraph of this paragraph, the Commission may, in accordance with the procedure referred to in Article 43(2) of Regulation (EC) No 1254/1999, set a day other than Wednesday for the issuing of export licences when it is not possible to respect this day.
2. Where the issue of export licences would or might result in the available budgetary amounts being exceeded or in the maximum quantities which may be exported with a refund being exhausted during the period concerned, in view of the limits referred to in Article 33(11) of Regulation (EC) No 1254/1999, or would not allow exports to continue during the remainder of the period, the Commission may:
(a) |
set an acceptance percentage for the quantities applied for; |
(b) |
reject applications for which licences have not yet been granted; |
(c) |
suspend lodging of licence applications for a maximum period of five working days, extendable by the procedure referred to in Article 43(2) of Regulation (EC) No 1254/1999. |
In the circumstances referred to in point (c) of the first subparagraph, licence applications made during the suspension period shall be invalid.
The measures provided for in the first subparagraph may be implemented or modulated by category of product and by destination or group of destinations.
3. The measures provided for in paragraph 2 may also be adopted where export licence applications relate to quantities which exceed or might exceed the normal disposable quantities for one destination or group of destinations and issuing the licences requested would entail a risk of speculation, distortion of competition between operators, or disturbance of the trade concerned or the Community market.
4. If the quantities applied for are refused or reduced the security shall be immediately released for all quantities for which the application has not been accepted.
5. By way of derogation from paragraph 1, if an acceptance percentage of less than 90 % is set, licences shall be issued no later than the 11th working day following publication of that percentage in the Official Journal of the European Union. Applicants may within 10 working days following publication:
(a) |
either withdraw the application, in which case the security shall be released immediately; or |
(b) |
request immediate issue of the licence, in which case the competent authority shall immediately issue it but at the earliest on the fifth working day following that on which the application was lodged. |
6. Notwithstanding paragraph 1, licences in respect of applications for a quantity not exceeding 25 tonnes of products falling within CN codes 0201 and 0202 shall be issued immediately. In such cases, notwithstanding Article 10 of this Regulation, the term of validity of the licences shall be limited to five working days from their actual day of issue within the meaning of Article 23(2) of Regulation (EC) No 1291/2000, and box 20 of licence applications and licences shall indicate at least one of the entries listed in Annex VII, Part A, to this Regulation.
Article 13
1. Quantities exported within the tolerance referred to in Article 8(4) of Regulation (EC) No 1291/2000 shall not confer entitlement to payment of a refund where exportation takes place under a licence as referred to in Article 10(1), (2) and (3) of this Regulation and the licence contains the following entry in box 22:
‘Refund valid for … tonnes (quantity for which licence is issued)’.
2. The second indent of Article 18(3)(b) of Commission Regulation (EC) No 800/1999 (10) shall not apply to special export refunds granted to products falling within CN codes 0201 30 00 9100 and 0201 30 00 9120 of the agricultural product nomenclature for export refunds established by Commission Regulation (EEC) No 3846/87 (11) where these products have been placed under the customs warehousing procedure in accordance with Article 4 of Commission Regulation (EC) No 1741/2006 (12).
Article 14
1. This Article shall apply to exports made pursuant to Regulation (EC) No 1643/2006.
2. Licence applications for the products indicated in Article 1 of Regulation (EC) No 1643/2006 may be lodged only in Member States meeting the health conditions required by the importing country.
3. Licence applications and licences shall carry the entry ‘USA’ in box 7. Licences shall carry an obligation to export from the Member State of issue to that destination.
4. Article 8(4) of Regulation (EC) No 1291/2000 notwithstanding, the quantities exported may not exceed those shown on the licence. Licences shall carry the entry ‘0’ in box 19.
5. Licences shall carry in box 22 one of the entries listed in Part B of Annex VII.
6. Member States shall communicate to the Commission:
(a) |
by 18.00 (Brussels time) on each working day, the total quantity of products for which applications have been lodged; |
(b) |
no later than the end of the month in which the applications were lodged, a list of applicants. |
7. If the quantities in respect of which licences have been applied for exceed those available, the Commission shall set a single acceptance percentage for the quantities requested.
8. Licences shall be issued on the 10th working day following the date on which the application was lodged. No licences shall be issued for applications which have not been transmitted to the Commission.
9. Article 10(1), (2) and (3) of this Regulation notwithstanding, licences shall be valid 90 days from the actual day of issue, Article 23(2) of Regulation (EC) No 1291/2000 applying, but not beyond 31 December of the year of issue.
10. Should the quantities applied for be reduced pursuant to paragraph 7 the security shall be immediately released for all quantities not granted.
11. Over and above the requirements specified in Article 32(1)(b) of Regulation (EC) No 1291/2000, release of security against export licences shall be conditional on presentation of proof of arrival at destination, Article 35(5) of that Regulation applying.
Article 15
1. This Article shall apply to exports to Canada pursuant to Regulation (EC) No 2051/96.
2. Licence applications for the products indicated in Article 1 of Regulation (EC) No 2051/96 may be lodged only in Member States meeting the health conditions required by the Canadian authorities.
3. Licence applications and licences shall carry the entry ‘Canada’ in box 7. Licences shall carry an obligation to export from the Member State of issue to that destination.
4. Article 8(4) of Regulation (EC) No 1291/2000 notwithstanding, the quantities exported may not exceed those shown on the licence. Licences shall carry the entry ‘0’ in box 19.
5. Licences shall carry in box 22 one of the entries listed in Part C of Annex VII.
6. Member States shall communicate to the Commission:
(a) |
by 6 p.m. (Brussels time) on each working day, the total quantity of products for which applications have been lodged; |
(b) |
no later than the end of the month in which the applications were lodged, a list of applicants. |
7. If the quantities for which licences have been applied for exceed those available the Commission shall set a single acceptance percentage applying to quantities requested.
8. Licences shall be issued on the 10th working day following the date on which the application is lodged. No licences shall be issued for applications which have not been transmitted to the Commission.

Article 16
1. Member States shall notify to the Commission:
(a) |
every Friday from 13.00:

(b) |
before the 15th day of each month for the previous month:
|
2. Notifications pursuant to paragraph 1 shall specify:
(a) |
the quantity by weight of product for each category referred to in Article 10(5); |
(b) |
the quantity breakdown by destination for each category. |
Notifications pursuant to paragraph 1(b)(ii) shall also specify the refund amount involved for each category.
3. All notifications indicated in paragraph 1, including ‘nil’ notifications, shall be made in the form shown in Annex VIII.
CHAPTER IV
FINAL PROVISIONS
Article 17
Regulation (EC) No 1445/95 is repealed.
References to the repealed Regulation shall be construed as references to this Regulation and shall be read in accordance with the correlation table in Annex X.
Article 18
This Regulation shall enter into force on the 10th day following its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Council Regulation (EEC) No 337/75 of 10 February 1975 establishing the European Centre for the Development of Vocational Training, and in particular Article 4 thereof (1),
Having regard to the nominations submitted by the SPANISH and the NETHERLANDS Governments,
Whereas:

By its Decision of 18 September 2006 (2), the Council appointed the members of the Governing Board of the European Centre for the Development of Vocational Training for the period from 18 September 2006 to 17 September 2009. |

Two members' seats on the Governing Board of the Centre in the category of Government representatives have become vacant as a result of the resignations of Ms Pilar GÓMEZ MUÑOZ and Mr Marcel NOLLEN, |
(3) |
The two members of the Governing Board of the aforementioned Centre should be appointed for the remainder of the current term of office, which expires on 17 September 2009, |

amending Decision 2006/968/EC implementing Council Regulation (EC) No 21/2004 as regards guidelines and procedures for the electronic identification of ovine and caprine animals

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 21/2004 of 17 December 2003 establishing a system for the identification and registration of ovine and caprine animals and amending Regulation (EC) No 1782/2003 and Directives 92/102/EEC and 64/432/EEC (1), and in particular Article 9(1) thereof,
Whereas:

Regulation (EC) No 21/2004 provides that each Member State is to establish a system for the identification and registration of ovine and caprine animals in accordance with that Regulation. Pursuant to Regulation (EC) No 21/2004, the first means of identification of those animals is eartags. The second means of identification includes the electronic identification of ovine and caprine animals. |
(2) |
Commission Decision 2006/968/EC (2) sets out guidelines and procedures for the approval of identifiers and readers for the electronic identification of ovine and caprine animals pursuant to Regulation (EC) No 21/2004. That Decision lays down minimum requirements concerning certain conformance and performance tests for the approval of those identifiers and readers. Those tests are to be carried out by designated test laboratories that operate and are assessed and accredited in accordance with certain European standards. |

Article 12(2) of Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules (3) refers to those European standards in relation to the designation by competent authorities of official laboratories. |
(4) |
It is appropriate to amend the reference in Decision 2006/968/EC to those standards in order to take into account the specific character of the test laboratories referred to in that Decision. |
(5) |
Article 18 of Commission Regulation (EC) No 2076/2005 of 5 December 2005 laying down transitional arrangements for the implementation of Regulations (EC) No 853/2004, (EC) No 854/2004, (EC) No 882/2004 of the European Parliament and of the Council and amending Regulations (EC) No 853/2004 and (EC) No 854/2004 (4) provides for a derogation from Article 12(2) of Regulation (EC) No 882/2004. Pursuant to that derogation, the competent authority may designate for a transitional period a test laboratory which has not been accredited. For the sake of clarity, Decision 2006/968/EC should refer to this derogation. |

Decision 2006/968/EC should therefore be amended accordingly. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee of the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Decision 2006/968/EC is amended in accordance with the Annex to this Decision.
Article 2
This Decision shall apply from 1 June 2008.

This Decision is addressed to the Member States.

In the Annex to Decision 2006/968/EC, Chapter IV is replaced by the following:
‘CHAPTER IV
Test laboratories
1. |
The competent authority shall designate test laboratories for carrying out the tests provided for in this Decision. |
2. |
However, the competent authority may only designate test laboratories that operate and are assessed and accredited in accordance with Article 12(2)(a) of Regulation (EC) No 882/2004. Article 18 of Regulation (EC) No 2076/2005 applies until 31 December 2009. |
3. |
Member States shall draw up and keep up-to-date lists of test laboratories designated by the competent authorities and make such information available to the other Member States and the public on a website.’ |

amending Annex I to Decision 2004/438/EC as regards raw milk and raw milk based products from Australia, milk and milk-based products from Serbia and updating the entry in that Annex for Switzerland

Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (1), and in particular Article 8(1) and (4) thereof,
Having regard to Regulation (EC) No 854/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption (2), and in particular Article 11(1) thereof,
Whereas:

Commission Decision 2004/438/EC of 29 April 2004 laying down animal and public health and veterinary certification conditions for introduction in the Community of heat-treated milk, milk-based products and raw milk intended for human consumption (3) contains a list in Annex I thereto of third countries from which imports into the Community of raw milk and raw-milk based products are allowed, subject to certain conditions. In addition, consignments of milk and milk-based products which comply with the animal health requirements set out in that Decision may transit through the Community to other third countries. |

Australia is included in the list of third countries from which imports into the Community of milk and milk products are allowed. Imports of milk and milk products from Australia are limited to products that have undergone a pasteurisation or sterilisation process. Australia has requested to be authorised to export also raw milk and raw-milk based products for human consumption. |
(3) |
The treatments provided for in Decision 2004/438/EC are applied to milk and milk products in order to protect the animal health status of the Community. In the light of the animal health situation in Australia, and in particular its foot-and-mouth disease free status from 1872 when the last outbreak was detected, imports of those products from that third country should be authorised as they do not represent an animal health risk. |

The entry for Australia for raw milk and raw-milk based products in column A of the list in Annex I to Decision 2004/438/EC should therefore be amended accordingly. |
(5) |
Serbia has requested to be included in the list of third countries from which imports into the Community of heat-treated milk and milk-based products for human consumption are authorised, so that the transit is allowed of such products through the territory of the Community, with the final destinations in other third countries. |
(6) |
General Commission animal health audits have been carried out in Serbia, most recently in June 2007, which demonstrate that the competent authorities can give appropriate guarantees that the animal health situation in that country can be considered satisfactory. |
(7) |
Accordingly heat-treated milk and milk-based products from that third country should be authorised concerning animal health aspects. |
(8) |
A further mission to fully assess the public health aspects will have to be carried out before the establishments can be listed for imports into the Community, however in the mean time transit of such products should be authorised. |
(9) |
The entries for Serbia for heat-treated milk and milk-based products for human consumption should be therefore added in columns B and C of the list in Annex I. |
(10) |
In addition, it is appropriate to update a footnote in that Annex for Switzerland in order to refer to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products. |
(11) |
Annex I to Decision 2004/438/EC should therefore be amended accordingly. |
(12) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |

amending Annex XI to Council Directive 2003/85/EC as regards the list of laboratories authorised to handle live foot-and-mouth disease virus

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 2003/85/EC of 29 September 2003 on Community measures for the control of foot-and-mouth disease repealing Directive 85/511/EEC and Decisions 89/531/EEC and 91/665/EEC and amending Directive 92/46/EEC (1), and in particular Article 67(2) thereof,
Whereas:
(1) |
Directive 2003/85/EC sets out minimum control measures to be applied in the event of an outbreak of foot-and-mouth disease and certain preventive measures aimed at increasing the awareness and preparedness of the competent authorities and the farming community concerning that disease. |
(2) |
The preventive measures set out in Directive 2003/85/EC include the provision that Member States are to ensure that the handling of live foot-and-mouth disease virus for research, diagnosis or manufacture is carried out only in approved laboratories listed in Annex XI to that Directive. |
(3) |
Part A of Annex XI to Directive 2003/85/EC lists national laboratories authorised to handle live foot-and-mouth disease virus for research and diagnostic purposes. |
(4) |
Denmark has officially informed the Commission of changes relating to the administration of its national reference laboratory for foot-and-mouth disease. |
(5) |
Latvia and Slovenia have officially informed the Commission that their respective national reference laboratories are no longer considered to meet the security standards laid down in Article 65(d) and should therefore bee deleted from the list in Part A of Annex XI to Directive 2003/85/EC. |
(6) |
The Netherlands have officially informed the Commission of changes relating to the name of their national reference laboratory for foot-and-mouth disease. |
(7) |
For security reasons it is important to keep the list of laboratories authorised to handle live foot-and-mouth disease virus in Directive 2003/85/EC updated. |
(8) |
Accordingly, it is necessary to replace the list of laboratories authorised to handle live foot-and-mouth disease virus in Part A of Annex XI to Directive 2003/85/EC by the list set out in the Annex to this Decision. |
(9) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
In Annex XI to Directive 2003/85/EC, Part A is replaced by the text in the Annex to this Decision.
Article 2
The Decision is addressed to the Member States.

COMMISSION DECISION

amending Decision 2006/133/EC requiring Member States temporarily to take additional measures against the dissemination of Bursaphelenchus xylophilus (Steiner et Buhrer) Nickle et al. (the pine wood nematode) as regards areas in Portugal, other than those in which it is known not to occur

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (1), and in particular Article 16(3) thereof,
Whereas:

In accordance with Commission Decision 2006/133/EC of 13 February 2006 requiring Member States temporarily to take additional measures against the dissemination of Bursaphelenchus xylophilus (Steiner et Buhrer) Nickle et al. (the pine wood nematode – PWN) as regards areas in Portugal, other than those in which it is known not to occur (2), Portugal has taken measures against the dissemination of the pine wood nematode. |
(2) |
Portugal has sent a report to the Commission on the execution of those measures in 2007 which shows that PWN has not spread beyond the demarcated areas, but continues to be present in those areas. |
(3) |
The implementation of the Portuguese measures in 2007 was evaluated by the Standing Committee on Plant Health in its meeting of 26-27 November 2007. It was concluded that the reduction of infection level in the demarcated area aimed at by Decision 2006/133/EC had not been fully achieved. |
(4) |
Therefore, Portugal should continue to take such measures in the form of an eradication plan until 31 March 2012, a realistic period to achieve a significant progress in the control of PWN. |
(5) |
To increase the efficiency of those measures in case of isolated outbreaks in the buffer zone of the demarcated area, a ‘focus zone’ should be established within the buffer zone where susceptible plants are removed. Around the focus zone there should be a zone where susceptible plants are inspected regularly (safety zone). |
(6) |
The requirements for the movement of susceptible wood in the form of packaging material originating in the demarcation area should be aligned with the Food and Agriculture Organization (FAO) International Standard for Phytosanitary Measures No 15 on Guidelines for regulating wood packaging material in international trade. |
(7) |
Decision 2006/133/EC should therefore be amended accordingly. |
(8) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plant Health, |
HAS ADOPTED THIS DECISION:
Article 1
Decision 2006/133/EC is amended as follows:
1. |
Article 2 is replaced by the following: ‘Article 2 Until 31 March 2012, Portugal shall ensure that the conditions laid down in the Annex are met in relation to susceptible wood, bark and plants, which are to be moved within or from demarcated areas in Portugal and defined as in accordance with Article 5, either to other areas in Portugal or to other Member States. Until 31 March 2012, Portugal shall implement an eradication plan to control the spread of PWN with the aim of eradicating it. That plan shall include details on the management, within the demarcated area, of plant species known to be highly susceptible to PWN under the conditions in Portugal. This plan shall be reviewed annually by 31 December’. |

In the second paragraph of Article 4, the words ‘by 15 December 2006 and 15 December 2007’ are replaced by the words ‘annually by 15 December’. |
3. |
The Annex to Decision 2006/133/EC is amended in accordance with the Annex to this Decision. |

laying down Community criteria for national programmes for the eradication, control and monitoring of certain animal diseases and zoonoses

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Decision 90/424/EEC of 26 June 1990 on expenditure in the veterinary field (1), and in particular the fourth subparagraph of Article 24(2) thereof,
Whereas:

Decision 90/424/EEC lays down the procedures governing the Community's financial contribution towards the programmes for the eradication, control and monitoring of animal diseases and zoonoses. Pursuant to that Decision, a Community financial measure is to be introduced to reimburse the expenditure incurred by the Member States for the financing of national programmes for the eradication, control and monitoring of the animal diseases and zoonoses listed in the Annex to that Decision. |
(2) |
Decision 90/424/EEC provides that each year, by 30 April at the latest, Member States are to submit to the Commission the annual or multi-annual programmes starting in the following year for which they wish to receive a financial contribution from the Community. |
(3) |
Article 24(2) of that Decision lists certain elements which have to be contained in the programmes submitted by the Member States, such as a description of the epidemiological situation of the disease, the area where the programme is to be applied, the objective and likely duration of the programme, the measures to be applied and the costs and benefits of the programme. |
(4) |
Council Decision 90/638/EEC of 27 November 1990 laying down Community criteria for the eradication and monitoring of certain animal diseases (2) laid down certain criteria for eradication and monitoring programmes in order to be approved pursuant to Decision 90/424/EEC. Decision 2006/965/EC repeals Decision 90/638/EEC from the date the present Decision takes effect. |
(5) |
New criteria for the national programmes for the eradication, control and monitoring of animal diseases and zoonoses listed in Annex I to Decision 90/424/EEC should be laid down in order to match technical and scientific progress and to take account of experience in the implementation of the programmes under Decision 90/638/EEC. Those new Community criteria should ensure that the measures provided for in those programmes are effective and secure the more rapid eradication, control and monitoring of the diseases and zoonoses concerned. |
(6) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
In order to be approved under the Community financial measure provided for in Article 24(1) of Decision 90/424/EEC, programmes submitted by the Member States to the Commission for the eradication, control and monitoring of the animal diseases and zoonoses listed in the Annex to that Decision must meet at least the criteria set out in the Annex to this Decision.

This Decision is addressed to the Member States.

ANNEX
Criteria for national eradication, control and monitoring programmes
(1) Objective of the programme
(a) |
The objective of monitoring programme shall be to investigate an animal population or subpopulation, and its environment (including wild reservoir and vectors), to detect changes in the occurrence and infection patterns of an animal disease or zoonoses listed in the Annex to Decision 90/424/EEC (‘animal disease or zoonoses’). |
(b) |
The objective of control programme shall be to obtain or maintain the prevalence of an animal disease or zoonoses, listed in the Annex to Decision 90/424/EEC, below a sanitary acceptable level; |
(c) |
The objective of an eradication programme shall be the biological extinction of an animal disease or zoonoses listed in the Annex to Decision 90/424/EEC. The final target of an eradication programme shall be to obtain the free or officially free-status of the territory according to Community legislation, where such possibility exists. |
(d) |
The objective of a programme either to control, monitor/survey or to eradicate an animal disease or zoonoses shall be in accordance with the Community policies. |
(2) Geographical demarcation of the programme
The programme shall apply to the whole territory, or if properly justified according to epidemiological criteria, to a well-defined part of the territory of one or more Member States or, in case of diseases that affect also wild animals, third countries.
(3) Duration of the programme
The duration of the programme shall be set in years for the estimated minimum time required to reach the objective of the programme. That duration shall be limited to the time during which that objective can reasonably be reached.
(4) Targets of the programme
(a) |
The targets of the programme shall be set to be attained by the date of completion of the programme. At least yearly interim targets shall be set as intermediate goals to be achieved if the programme covers more than one year. |
(b) |
The most appropriate indicators, such as incidence, prevalence (when it is possible), sanitary qualification of target animals and epidemiological units (for instance, flocks, herds, holdings, zones) shall be selected for the targets. Where necessary a definition shall be given. |
(5) Measures of the programme
(a) |
The suspicion or confirmation of the animal disease or zoonoses shall be notifiable. |
(b) |
The measures of the programme shall be aimed at the host animal population of the animal disease or zoonoses and/or relevant reservoir species or vectors. |
(c) |
All target animals of the programme, except poultry, aquatic animals, lagomorphs and wildlife, shall be identified and all epidemiological units (for instance, flocks, herds, holdings), shall be registered. Movements of those animals shall be controlled and registered. |
(d) |
The measures of the programme shall be based on the available relevant scientific knowledge and comply with Community legislation. In the case of programmes concerning diseases in aquaculture animals and financed by the European Fisheries Fund (1) the managing authority shall ensure that all the supporting documents regarding expenditure and audits on the programmes concerned are kept available for the Commission and the European Court of Auditors according to Article 87 of Regulation (EC) No 1198/2006. |
(e) |
The measures of the programme shall be selected as being the most efficient and effective measures to achieve the objective within the duration of the programme, and shall include at least:

(f) |
The laboratory tests used within the programme shall be those laid down in Community legislation for the animal disease or zoonoses concerned; where no tests are provided for in Community legislation, the tests used shall be standardized and validated according to generally accepted international standards. Testing laboratories involved in relevant monitoring or eradication programmes funded by the Community shall be able to deliver results which quality is acceptable to the relevant Community reference laboratory (CRL). Laboratories which failed CRL ring-tests, or national ring-tests when applicable, can only be involved in Community funded eradication programmes after specific checks have demonstrated that they can deliver the results at the required qualitative standard. |
(g) |
Vaccines used within the programme shall be in compliance with the European standards as regards safety, non-transmissibility, irreversibility of attenuation and immunogenic properties; they must have a marketing authorisation in accordance with Directive 2001/82/EC of the European Parliament and of the Council (2), unless the conditions provided for in Article 8 of that Directive apply. |
(6) Management of the programme
(a) |
The programme shall be under the control of the central veterinary authority. The competences and responsibilities of each veterinary service and stakeholder for implementing the measures of the programme shall be clearly defined and a clear chain of command shall be set out in the programme. |
(b) |
Sufficient resources (financial, personnel, equipment) shall be guaranteed for the whole duration of the programme. |
(c) |
The progress of the programme shall be regularly:

(7) Costs and benefits of the programme
(a) |
The programme shall be beneficial to the Community and to the parties involved in the Member States. |
(b) |
The tools and measures selected shall be used in the most cost-effective manner. |
(c) |
The goods and services used for the purposes of the programme shall be purchased or provided in accordance with the Community rules on public procurement. |
(d) |
The costs of the programme shall be the costs incurred by the Member State for the implementation of the measures of the programme and shall be auditable. |
(e) |
An adequate compensation shall be provided for to owners for animals which have to be slaughtered or culled in the framework of the programme and for the products which have to be destroyed, where applicable. |
(f) |
The beneficiary shall record the expenditure incurred which has been submitted to the Commission in its cost/accounting system and keep all original documents for seven years from the date of submission, for financial control purposes in accordance with Articles 9, 36 and 37 of Council Regulation (EC) No 1290/2005 (3). |
