COMMISSION REGULATION (EC) No 12/2008

of 9 January 2008

establishing the standard import values for determining the entry price of certain fruit and vegetables

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules of Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (1), and in particular Article 138(1) thereof,

Whereas:

(1)

Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto.

(2)

In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 shall be fixed as indicated in the Annex hereto.

Article 2

This Regulation shall enter into force on 10 January 2008.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 13/2008

laying down the allocation coefficient to be applied to import licence applications lodged from 2 to 4 January 2008 under the tariff quota opened by Regulation (EC) No 955/2005 for rice originating in Egypt

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1785/2003 of 29 September 2003 on the common organisation of the market in rice (1),

Having regard to Commission Regulation (EC) No 1301/2006 of 31 August 2006 laying down common rules for the administration of import tariff quotas for agricultural products managed by a system of import licences (2), and in particular Article 7(2) thereof,

Whereas:

Commission Regulation (EC) No 955/2005 (3) opened an annual import tariff quota for 5 605 tonnes of rice falling within CN code 1006 originating in Egypt (serial No 09.4097).

(2)

The notification made in accordance with Article 5(a) of Regulation (EC) No 955/2005 shows that the applications lodged until 4 January 2008, at 13.00 (Brussels time) in accordance with Article 4(1) of that Regulation exceed the quantities available. The extent to which licences may be issued should therefore be determined and the allocation coefficient to be applied to the quantities applied for should be laid down.

(3)

No further import licences should be issued under Regulation (EC) No 955/2005 for the current quota period,

HAS ADOPTED THIS REGULATION:

Article 1

1.   Applications for import licences for rice originating in Egypt under the quota referred to in Regulation (EC) No 955/2005 lodged until 4 January 2008, at 13.00 (Brussels time) shall be accepted for the quantities applied for multiplied by an allocation coefficient of 8,123188 %.

2.   The issue of licences for quantities requested from 13.00 (Brussels time) on Friday 4 January 2008 is hereby suspended for the current quota period.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Directive 94/39/EC as regards feedingstuffs intended for the reduction of the risk of milk fever

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 93/74/EEC of 13 September 1993 on feedingstuffs intended for particular nutritional purposes (1), and in particular Article 6(c) thereof,

Whereas:

By Directive 94/39/EC (2), the Commission established a list of intended uses of animal feedingstuffs for particular nutritional purposes.

(2)

In its opinion of 8 December 2004 the European Food Safety Authority (the Authority) concluded that zeolite (synthetic sodium aluminium silicate) has the potential of reducing the risk of milk fever in dairy cows (3). However, it could not fully assess the risk for animal and human health due to missing data. Taking into account the additional information received, the Authority concluded in its opinion of 11 July 2007 that adding zeolite to feedingstuffs for dairy cows for a period of about two weeks before calving does not pose a risk to animal or human health or to the environment (4). Zeolite should therefore be included in the line ‘reduction of the risk of milk fever’ in the list of intended uses in Part B of the Annex to Directive 94/39/EC.

In its opinion of 12 June 2007 the Authority concluded that feedingstuffs with high calcium content administered around parturition can be very effective in treating mild cases of milk fever and in preventing relapses in dairy cattle and therefore that a new entry should be added to the list concerning the prevention of the risk of milk fever (5). The Authority further concluded that a marginal risk for animal health cannot be completely excluded making it necessary to balance the individual risk against the overall benefits of the administration. In order to allow the dairy herd manager such assessment, the different sources of calcium should be indicated on the label together with their quantity. Further, the label should include a recommendation to seek advice of a nutritional expert. The Authority neither expects a risk for the consumer nor an additional risk for the environment. Feedingstuffs with high calcium content should therefore be included in the line ‘reduction of the risk of milk fever’ in the list of intended uses in Part B of the Annex to Directive 94/39/EC.

Directive 94/39/EC should therefore be amended accordingly.

(5)

The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DIRECTIVE:

Article 1

The Annex to Directive 94/39/EC is amended in accordance with the Annex to this Directive.

Article 2

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 24 June 2008 at the latest. They shall forthwith inform the Commission thereof.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Article 3

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

Article 4

This Directive is addressed to the Member States.

DECISION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

amending the Interinstitutional Agreement of 17 May 2006 on budgetary discipline and sound financial management as regards the multiannual financial framework

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Interinstitutional Agreement between the European Parliament, the Council and the Commission of 17 May 2006 on budgetary discipline and sound financial management (1), and in particular to Points 21, 22, first and second subparagraphs, and 23 thereof,

Having regard to the proposal from the Commission,

Whereas:

At the conciliation meeting on 23 November 2007 the two arms of the budgetary authority have agreed to provide part of the financing required for the European Global Navigation Satellite System GNSS programmes (EGNOS — GALILEO) by a revision of the multiannual financial framework 2007-2013 in accordance with Points 21, 22 and 23 of the Interinstitutional Agreement, so as to raise the ceilings for commitment appropriations under sub-Heading 1a for the years 2008 to 2013 by an amount of EUR 1 600 million in current prices. This raising will be offset by lowering the ceiling for commitment appropriations under Heading 2 for the year 2007 by the same amount.

(2)

In order to keep an appropriate relationship between commitments and payments, the annual ceilings for payment appropriations will be adjusted. The adjustment will be neutral.

(3)

Annex I of the Interinstitutional Agreement on budgetary discipline and sound financial management should therefore be amended accordingly (2),

HAVE DECIDED AS FOLLOWS:

DECISION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

of 18 December 2007

on the mobilisation of the European Globalisation Adjustment Fund

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (1), and in particular point 28 thereof,

Having regard to Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 establishing the European Globalisation Adjustment Fund (2),

Having regard to the proposal from the Commission,

Having regard to the Budgetary Conciliation of 13 July 2007,

Whereas:

(1)

The European Union has created a European Globalisation Adjustment Fund (‘the Fund’) to provide additional support to workers who suffer from the consequences of major structural changes in world trade patterns and to assist their reintegration into the labour market.

(2)

The Interinstitutional Agreement of 17 May 2006 allows the mobilisation of the Fund within the annual ceiling of EUR 500 million.

(3)

Regulation (EC) No 1927/2006 contains the provisions whereby the Fund may be mobilised.

(4)

Germany and Finland submitted applications to mobilise the Fund, concerning two cases of redundancies in the mobile phone sector: BenQ in Germany and Perlos Oyj in Finland,

HAVE DECIDED AS FOLLOWS:

Article 1

For the general budget of the European Union for the financial year 2007, the European Globalisation Adjustment Fund shall be mobilised for a total amount of EUR 14 794 688.

Article 2

This Decision shall be published in the Official Journal of the European Union.
