COMMISSION REGULATION (EC) No 1495/2007

of 18 December 2007

establishing the standard import values for determining the entry price of certain fruit and vegetables

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Commission Regulation (EC) No 3223/94 of 21 December 1994 on detailed rules for the application of the import arrangements for fruit and vegetables (1), and in particular Article 4(1) thereof,

Whereas:

(1)

Regulation (EC) No 3223/94 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto.

(2)

In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 4 of Regulation (EC) No 3223/94 shall be fixed as indicated in the Annex hereto.

Article 2

This Regulation shall enter into force on 19 December 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 1496/2007

amending Regulation (EC) No 1043/2005 implementing Council Regulation (EC) No 3448/93 as regards the system of granting export refunds on certain agricultural products exported in the form of goods not covered by Annex I to the Treaty, and the criteria for fixing the amount of such refunds

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 3448/93 of 6 December 1993 laying down the trade arrangements applicable to certain goods resulting from the processing of agricultural products (1), and in particular the first subparagraph of Article 8(3) thereof,

Whereas:

(1)

The introductory words of Article 54(3) of Commission Regulation (EC) No 1043/2005 (2) make a detailed reference to the textual arrangement of Article 17 of Commission Regulation (EC) No 800/1999 of 15 April 1999 laying down common detailed rules for the application of the system of export refunds on agricultural products (3).

(2)

Article 17 of Regulation (EC) No 800/1999 has been replaced by Commission Regulation (EC) No 1001/2007 of 29 August 2007 amending Regulations (EC) No 800/1999 and (EC) No 2090/2002 as regards controls in the framework of export refunds on agricultural products.

(3)

For reasons of clarity it is appropriate to adapt the introductory words of Article 54(3) of Regulation (EC) No 1043/2005 to take account of this development.

(4)

Regulation (EC) No 1043/2005 should therefore be amended accordingly.

(5)

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee on horizontal questions concerning trade in processed agricultural products not listed in Annex I,

HAS ADOPTED THIS REGULATION:

Article 1

In Article 54(3) of Regulation (EC) No 1043/2005, the introductory words are replaced by the following:

‘For the goods listed in Annex II to this Regulation and by way of derogation from Article 17 of Regulation (EC) No 800/1999, the amount set out in Article 17(1)(a)(ii) of Regulation (EC) No 800/1999 shall apply regardless of the country or territory of destination to which the goods are exported:’

Article 2

This Regulation shall enter into force on the day following its publication in the Official Journal of the European Union.

It shall apply from 2 September 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 1497/2007

of 18 December 2007

establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, standard leakage checking requirements for stationary fire protection systems containing certain fluorinated greenhouse gases

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Regulation (EC) No 842/2006 of the European Parliament and of the Council of 17 May 2006 on certain fluorinated greenhouse gases (1), and in particular Article 3(7) thereof,

Whereas:

(1)

In fire protection systems comprising several interconnected containers installed in response to a specific fire risk in a defined space, the charge of fluorinated greenhouse gases should be calculated on the basis of the total charge of those containers in order to ensure that the frequency of the checks corresponds to the effective charge of fluorinated greenhouse gases.

(2)

Pursuant to Regulation (EC) No 842/2006, records for fire protection systems shall contain certain information. In order to ensure the effective implementation of Regulation (EC) No 842/2006, it is appropriate to provide for further information to be entered into the system records.

(3)

Information on the fluorinated greenhouse gas charge should be included in the system records. Where the fluorinated greenhouse gas charge is unknown, the operator of the fire protection system concerned should ensure that certified personnel determine that charge in order to facilitate the leakage checking.

(4)

Before the leakage check is carried out, certified personnel should carefully go through the information contained in the system records to determine any previous issues and consult previous reports.

(5)

In order to ensure an efficient leakage control, the leakage checks should focus on those parts of the fire protection system which are most likely to leak.

(6)

Where there is a presumption of a leakage, it should be followed up by a check to identify and repair it.

(7)

Defective installation of new systems constitutes a significant risk of leakage. Therefore, newly installed systems should be checked for leakage immediately after they have been put into service.

(8)

In order to ensure the effectiveness of the repair to the system, the follow up check provided for in Regulation (EC) No 842/2006 should focus on the parts of the system where leakage has been detected and on the adjacent parts.

(9)

The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 18(1) of Regulation (EC) No 2037/2000 of the European Parliament and of the Council (2),

HAS ADOPTED THIS REGULATION:

Article 1

Subject matter and scope

This Regulation establishes, pursuant to Regulation (EC) No 842/2006, the standard leakage checking requirements for working and temporarily out of operation stationary systems consisting of one or more interconnected containers including associated parts installed in response to a specific fire risk in a defined space, hereinafter ‘fire protection systems’.

This Regulation shall apply to fire protection systems containing 3 kg or more of fluorinated greenhouse gases.

Article 2

System records

1.   The operator shall indicate his name, postal address and telephone number in the records referred to in Article 3(6) of Regulation (EC) No 842/2006, hereinafter ‘system records’.

2.   The fluorinated greenhouse gas charge for a fire protection system shall be indicated in the system records.

3.   Where the fluorinated greenhouse gas charge for a fire protection system is not indicated in the manufacturer's technical specifications or on the label of that system, the operator shall ensure that it is determined by certified personnel.

Article 3

Checking system records

1.   Before carrying out leakage checks, certified personnel shall check the system records.

2.   Special attention shall be paid to relevant information on any repeating issues or problem areas.

Article 4

Visual and manual checks

1.   To identify damage and signs of leakage, certified personnel shall carry out visual checks of operating controls, containers, components and connections which are under pressure.

2.   Any presumption of fluorinated greenhouse gas leakage in the fire protection system shall be checked by certified personnel.

3.   One or more of the following situations shall constitute a presumption of leakage:

(a)

a fixed leakage detection system indicates leakage;

(b)

a container shows a loss in pressure, adjusted for temperature, of more than 10 %;

(c)

a container shows a loss in extinguishant quantity of more than 5 %;

(d)

other signs indicating charge loss.

4.   Pressure gauges and weight-monitoring devices shall be checked once every 12 months to ensure their proper functioning.

Article 5

Repair of leakage

1.   The operator shall ensure that a repair or a replacement is carried out by personnel certified to undertake that specific activity.

2.   The operator shall ensure that a leakage test is carried out prior to recharging.

Article 6

Follow-up check

Certified personnel shall, when carrying out the follow-up check referred to in the second subparagraph of Article 3(2) of Regulation (EC) No 842/2006, focus on those areas where leakages have been found and repaired as well as on adjacent areas in cases where stress has been applied during the repair.

Article 7

Requirements for newly commissioned systems

Newly installed systems shall be checked for leakage immediately after they have been put into service.

Article 8

Entry into force

This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 1498/2007

laying down specific rules for issuing import licences for sugar and sugar and cocoa mixtures with ACP/OCTs or EC/OCTs cumulation of origin

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Decision 2001/822/EC of 27 November 2001 on the association of the overseas countries and territories with the European Community (Overseas Association Decision) (1), and in particular the fifth subparagraph of Article 6(4) of Annex III thereto,

Whereas:

(1)

Decision 2001/822/EC allows ACP/OCTs or EC/OCTs cumulation of origin for the quantities laid down in that Decision with regard to products falling within CN Chapter 17 and CN codes 1806 10 30 and 1806 10 90 .

(2)

Specific rules for issuing import licences have been established for these products under Commission Regulation (EC) No 192/2002 of 31 January 2002 laying down detailed rules for issuing import licences for sugar and sugar and cocoa mixtures with ACP/OCTs or EC/OCTs cumulation of origin (2) so as to permit the requisite controls on imports of the quantities provided for in Decision 2001/822/EC.

(3)

Commission Regulation (EC) No 1301/2006 of 31 August 2006 laying down common rules for the administration of import tariff quotas for agricultural products managed by a system of import licences (3) applies to import licences for the import tariff quota periods commencing from 1 January 2007. Regulation (EC) No 1301/2006 lays down, in particular, detailed rules for applications for import licences, the status of applicants and the issue of licences. It limits the validity of licences to the final day of the tariff quota period. The provisions of Regulation (EC) No 1301/2006 should apply, without prejudice to the additional rules laid down by this Regulation.

(4)

The rules laid down in the above Regulation should therefore apply to Regulation (EC) No 192/2002. However, certain rules should be adapted to reflect the specific characteristics of the trade covered by Regulation (EC) No 192/2002. In the interests of clarity and rationality, Regulation (EC) No 192/2002 should be repealed and replaced by a new Regulation.

(5)

Commission Regulation (EC) No 1291/2000 of 9 June 2000 laying down common detailed rules for the application of the system of import and export licences and advance-fixing certificates for agricultural products (4) should also apply, subject to the specific measures provided for in this Regulation.

(6)

With a view to ensuring orderly management, preventing speculation and providing for effective controls, detailed rules should be laid down for submitting licence applications and the documents that the interested parties must produce. To this end, the rules laid down in Regulation (EC) No 1301/2006 should apply.

(7)

The specific features of the licence application form for importing the products in question should be laid down and, in order to ensure that such imports are managed strictly, it should be laid down that the rights deriving from licences are not transferable.

(8)

Rules should also be laid down regarding time limits for the submission of licence applications and the issue of licences by the competent authorities of the Member States,

HAS ADOPTED THIS REGULATION:

Article 1

1.   Regulations (EC) No 1291/2000 and (EC) No 1301/2006 shall apply to the import at zero-rate customs duty of products falling within CN Chapter 17 and CN codes 1806 10 30 and 1806 10 90 with OCTs origin subject to cumulation with sugar of ACP and/or EC origin, unless otherwise provided for in this Regulation.

2.   Import licences issued under this Regulation shall bear the serial number 09.4652.

Article 2

For the purposes of this Regulation the concept of ‘originating products’ and the relevant administrative methods shall be those set out in Annex III to Decision 2001/822/EC.

Article 3

1.   Import licence applications shall relate to a quantity of not less than 25 tonnes.

2.   Import licence applications shall be accompanied by the following documents:

(a)

the export licence issued by the OCTs authorities in accordance with the model form set out in Annex I, issued by the bodies responsible for issuing EUR 1 certificates;

(b)

proof that the applicant has lodged a security of EUR 12 per 100 kilograms.

Article 4

The licence application and import licence shall show:

(a)

in section 7, the OCTs of provenance, the word ‘yes’ being marked with a cross;

(b)

in section 8, the OCTs of origin, the word ‘yes’ being marked with a cross;

(c)

in section 20 of the licence, one of the entries listed in Annex II.

Article 5

Article 9 of Regulation (EC) No 1291/2000 notwithstanding, the rights deriving from import licences shall not be transferable.

Article 6

1.   By way of derogation from Article 6(1) of Regulation (EC) No 1301/2006, licence applications shall be submitted in the first seven days of January, April, July and October of each year.

An applicant may submit only one licence application per month of submission of licence applications. Where, in a given month, applicants submit more than one application, all their applications in that month shall be rejected and the securities lodged when the applications were submitted shall be taken over by the Member State concerned.

2.   Licence applications shall be notified no later than the twelfth day of the month of submission of licence applications and shall be broken down by eight-digit CN code and by OCTs of origin.

3.   Import licences shall be issued by the Member States from the twenty-fifth and no later than the thirtieth day of the month of submission of licence applications.

Article 7

Import licences shall become valid on their actual day of issue, within the meaning of Article 23(2) of Regulation (EC) No 1291/2000.

Article 8

Regulation (EC) No 192/2002 is hereby repealed.

Article 9

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1784/2003 of 29 September 2003 on the common organisation of the market in cereals (1), and the other regulations on the common organisation of the markets in agricultural products,

Having regard to Commission Regulation (EEC) No 3846/87 of 17 December 1987 establishing an agricultural product nomenclature for export refunds (2), and in particular the fourth subparagraph of Article 3 thereof,

Whereas:

(1)

The full version of the refund nomenclature valid at 1 January 2008, as it ensues from the regulatory provisions on export arrangements for agricultural products, should be published.

(2)

The amendments to the combined nomenclature applicable from 2008 concerning milk, meat preparations and sugar introduced by Commission Regulation (EC) No 1214/2007 (3) must be taken into consideration and the refund nomenclature must be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EEC) No 3846/87 is amended as follows:

1.

Annex I is replaced by the text in Annex I to this Regulation.

2.

Annex II is replaced by the text in Annex II to this Regulation.

Article 2

This Regulation shall enter into force on 1 January 2008.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

When completing customs formalities, the applicant shall state on the declaration provided for this purpose the dry matter content of the product.

(6)  The export refund is payable for products having a dry matter content of at least 78 %. The export refund provided for products having a dry matter content of less than 78 % shall be adjusted by using the following formula: ((actual dry matter content)/78) × export refund.

The dry matter content is determined by method 2 laid down in Annex II to Commission Directive 79/796/EEC (OJ L 239, 22.9.1979, p. 24), or by any other suitable analysis method offering at least the same guarantees.

Where the cheese is presented in a film of plastic, and where the net weight declared includes the weight of the film in plastic, the refund amount shall be reduced by 0,5%.

When completing customs formalities, the applicant shall state that the cheese is packed in a film of plastic and whether the declared net weight includes the weight of the film in plastic.

(d)

Where the cheese is presented in paraffin or ash, and where the net weight declared includes the weight of the paraffin or the ash, the refund amount shall be reduced by 2%.

When completing customs formalities, the applicant shall state that the cheese is packed in paraffin or in ash, and whether the declared net weight includes the weight of the ash or the paraffin.

(e)

Where the cheese is presented in wax, when completing customs formalities, the applicant must state on the declaration the net weight of the cheese not incorporating the weight of the wax.

(43)  Where, for products falling within this code, the milk-protein content (nitrogen content × 6,38) in non-fat milk solids is less than 34 %, no refund is payable. Where, for powdered products falling within this code, the water content in product weight is more than 5 %, no refund is payable.

When completing the customs formalities, the interested party must indicate on the relevant declaration the minimum milk-protein content in non-fat milk solids and, for powdered products, the maximum water content.

When completing customs formalities, the applicant must state on the declaration provided for that purpose the maximum content by weight of sucrose and whether or not lon-lactic matter has been added and, where this is the case, the maximum content by weight of non-lactic matter added per 100 kilograms of finished product.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 9(2) thereof,

Whereas:

(1)

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such authorisation.

(2)

In accordance with Article 7 of Regulation (EC) No 1831/2003, an application was submitted for the authorisation of the preparation set out in the Annex to this Regulation. That application was accompanied by the particulars and documents required under Article 7(3) of Regulation (EC) No 1831/2003.

(3)

The application concerns a new use of the preparation of 6-phytase EC 3.1.3.26 (Ronozyme) produced by Aspergillus oryzae (DSM 14223), as a feed additive for ducks, to be classified in the additive category ‘zootechnical additives’.

(4)

The use of the preparation of 6-phytase EC 3.1.3.26 produced by Aspergillus oryzae (DSM 14223) was authorised without a time limit for chickens for fattening, laying hens, turkeys for fattening, piglets, pigs for fattening and sows by Commission Regulation (EC) No 255/2005 (2) and provisionally authorised for salmonids by Commission Regulation (EC) No 521/2005 (3).

New data were submitted in support of an application for authorisation for ducks. The European Food Safety Authority (the Authority) concluded in its opinion of 10 July 2007 that the preparation of 6-phytase EC 3.1.3.26 (Ronozyme) produced by Aspergillus oryzae (DSM 14223) does not have an adverse effect on animal health, human health or the environment (4). It further concluded that the preparation does not present any other risk which would, in accordance with Article 5(2) of Regulation (EC) No 1831/2003, exclude authorisation for this additional animal category. According to that opinion, the use of that preparation is efficacious in digestibility of feedingstuffs. Authority does not consider that there is a need for specific requirements of post market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Community Reference Laboratory set up by Regulation (EC) No 1831/2003.

The assessment of that preparation shows that the conditions for authorisation, provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. Accordingly, the use of that preparation should be authorised, as specified in the Annex to this Regulation.

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS REGULATION:

Article 1

The preparation specified in the Annex, belonging to the additive category ‘zootechnical additives’ and to the functional group ‘digestibility enhancers’, is authorised as an additive in animal nutrition subject to the conditions laid down in that Annex.

Article 2

This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

The use of the preparation of endo-1,4-beta-xylanase EC 3.2.1.8 produced by Trichoderma longibrachiatum (CNCM MA 6-10) was authorised without a time limit for chickens for fattening by Commission Regulation (EC) No 1453/2004 (2), without a time limit for turkeys for fattening by Commission Regulation (EC) No 943/2005 (3), without a time limit for laying hens by Commission Regulation (EC) No 1810/2005 (4) and for ten years for piglets (weaned) by Commission Regulation (EC) No 497/2007 (5).

The quantities for which import licence applications covered by the quota with serial number 09.4170 have not been lodged under Regulation (EC) No 812/2007, to be added to the subperiod 1 April to 30 June 2008, are 1 843 025 kg.

Article 2

This Regulation shall enter into force on 19 December 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

This Regulation shall enter into force on 19 December 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

2.   The quantities for which import licence applications have not been lodged pursuant to Regulation (EC) No 533/2007, to be added to the subperiod 1 April to 30 June 2008, are set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on 19 December 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Commission Regulation (EC) No 2172/2005 of 23 December 2005 laying down detailed rules for the application of an import tariff quota for live bovine animals of a weight exceeding 160 kg and originating in Switzerland provided for in the Agreement between the European Community and the Swiss Confederation on trade in agricultural products (2), and in particular Article 4(1) thereof,

Whereas:

Article 1(1) of Regulation (EC) No 2172/2005 sets the duty-free annual tariff quota for which Community importers may lodge an application for import rights in accordance with Article 3 of that Regulation at 4 600 head of cattle.

(2)

The quantities of import rights applied for are such that the applications may be accepted in full,

HAS ADOPTED THIS REGULATION:

Article 1

Each application for import rights lodged in accordance with Article 3(3) of Regulation (EC) No 2172/2005 for the quota period from 1 January to 31 December 2008 shall be accepted at a rate of 100 % of the import rights applied for.

Article 2

This Regulation shall enter into force on 19 December 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Whereas:

The representative prices and additional duties applicable to imports of white sugar, raw sugar and certain syrups for the 2007/08 marketing year are fixed by Commission Regulation (EC) No 1109/2007 (3). These prices and duties have been last amended by Commission Regulation (EC) No 1457/2007 (4).

(2)

The data currently available to the Commission indicate that the said amounts should be changed in accordance with the rules and procedures laid down in Regulation (EC) No 951/2006,

HAS ADOPTED THIS REGULATION:

Article 1

The representative prices and additional duties on imports of the products referred to in Article 36 of Regulation (EC) No 951/2006, as fixed by Regulation (EC) No 1109/2007 for the 2007/2008 marketing year are hereby amended as set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on 19 December 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Council Directive 89/556/EEC of 25 September 1989 on animal health conditions governing intra-Community trade in and imports from third countries of embryos of domestic animals of the bovine species (3), and in particular Article 5(3) thereof,

Having regard to Council Directive 90/426/EEC of 26 June 1990 on animal health conditions governing the movement and import from third countries of equidae (4), and in particular Article 7 thereof,

Having regard to Council Directive 90/429/EEC of 26 June 1990 laying down the animal health requirements applicable to intra-Community trade in and imports of semen of domestic animals of the porcine species (5), and in particular Article 5(3) thereof,

Having regard to Council Directive 91/68/EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals (6), and in particular Article 8a(6) thereof,

Having regard to Council Directive 92/65/EEC of 13 July 1992 laying down animal health requirements governing trade and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC (7), and in particular Article 17(3)(c) and Article 18(1) fourth indent thereof,

Whereas:

Commission Decision 2001/106/EC of 24 January 2001 establishing a model for the lists of entities approved by Member States in accordance with various provisions of Community veterinary legislation, and the rules applying to the transmission of these lists to the Commission (8), has been substantially amended several times (9). In the interests of clarity and rationality the said Decision should be codified.

(2)

Intra-Community trade of bovine, porcine, ovine, caprine and equine animals is permitted from assembly centres approved by the competent authorities of the Member State where they are located.

(3)

Intra-Community trade of semen of domestic animals of the bovine and porcine species is permitted from centres approved by the competent authorities of the Member State where they are located.

(4)

Intra-Community trade of embryos and ova of the bovine species is permitted if they have been collected, processed and stored by embryo collection teams approved by the competent authorities of the Member State where they are acting.

(5)

Each Member State is to send to the Commission and to the other Member States the lists of assembly centres, semen collection centres and embryo collection teams it has approved on its territory.

(6)

It is necessary to harmonise the model of those lists and the way they are transmitted in order to set up a simple access to up-to-date lists for the Community.

(7)

It is convenient and appropriate to use that harmonised model for the approved quarantine facilities or centres for imported birds other than poultry.

(8)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

Article 1

The lists of the entities listed in Annex I shall be transmitted to the Commission under Word or Excel to the following mailbox: Inforvet@ec.europa.eu

The lists shall be drawn up in accordance with the model formats listed in Annex II.

Any modification of the format or change in the destination shall be notified by the Commission to the Member States in the framework of the Standing Committee on the Food Chain and Animal Health.

Article 2

Decision 2001/106/EC is repealed.

References to the repealed Decision shall be construed as references to this Decision and shall be read in accordance with the correlation table in Annex IV.

Article 3

This Decision is addressed to the Member States.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (1), and in particular Article 15(1) thereof,

Whereas:

(1)

Under Directive 2000/29/EC, plants of Vitis L., other than fruits, originating in third countries in principle are not to be introduced into the Community.

(2)

Slovenia has requested a derogation to permit imports of plants of Vitis L., other than fruits, from Croatia or the former Yugoslav Republic of Macedonia for a limited period of time in order to enable specialised nurseries to multiply these plants in the Community before re-exporting them to Croatia or the former Yugoslav Republic of Macedonia.

(3)

The Commission considers that there is no risk of spreading harmful organisms to plants or plant products provided that plants of Vitis L., other than fruits originating in Croatia or the former Yugoslav Republic of Macedonia are subject to the specific conditions laid down in this Decision.

(4)

Member States should therefore for a limited period be authorised to permit the introduction into their territory of such plants subject to specific conditions.

(5)

That authorisation should be terminated if it is established that the specific conditions laid down in this Decision are not sufficient to prevent the introduction of harmful organisms into the Community or have not been complied with.

(6)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plant Health,

HAS ADOPTED THIS DECISION:

Article 1

By way of derogation from Article 4(1) of Directive 2000/29/EC with regard to point 15 of Part A of Annex III to that Directive, Member States shall be authorised to permit the introduction into their territory of plants of Vitis L., other than fruits, intended for grafting in the Community and originating in Croatia or the former Yugoslav Republic of Macedonia (hereinafter referred to as the plants).

In order to qualify for that derogation, the plants shall be subject, in addition to the requirements laid down in Annexes I and II to Directive 2000/29/EC, to the conditions provided for in the Annex to this Decision.

In order to qualify for that derogation, the plants shall be introduced into the Community, in the following periods:

(a)

between 1 January 2008 and 30 April 2008;

(b)

between 1 January 2009 and 30 April 2009;

(c)

between 1 January 2010 and 30 April 2010.

Article 2

1.   Member States which make use of the derogation provided for in Article 1 shall provide the Commission and the other Member States with:

(a)

the information on the quantities of plants imported pursuant to this Decision; and

(b)

a detailed technical report on the official inspections referred to in point 6 of the Annex.

That information and that report shall be provided as regards introductions covered by Article 1(a) by 15 November 2008 at the latest, as regards introductions covered by Article 1(b) by 15 November 2009 at the latest, and as regards introductions covered by Article 1(c) by 15 November 2010 at the latest.

2.   Any Member State in which the plants are subsequently grafted after their introduction into its territory shall also provide the Commission and the other Member States with a detailed technical report of the official inspections and testing referred to in point 8(b) of the Annex.

That report shall be provided as regards introductions covered by Article 1(a) by 15 November 2008 at the latest, as regards introductions covered by Article 1(b) by 15 November 2009 at the latest, and as regards introductions covered by Article 1(c) by 15 November 2010 at the latest.

Article 3

Member States shall immediately notify the Commission and the other Member States of all consignments introduced into their territory pursuant to this Decision, which were subsequently found not to comply with this Decision.

Article 4

This Decision is addressed to the Member States.

ANNEX

SPECIFIC CONDITIONS APPLYING TO PLANTS OF VITIS L., OTHER THAN FRUITS, ORIGINATING IN CROATIA OR THE FORMER YUGOSLAV REPUBLIC OF MACEDONIA BENEFITING FROM THE DEROGATION PROVIDED FOR IN ARTICLE 1

1.

The plants shall be propagating material in the form of dormant buds of the varieties Babić, Borgonja, Dišeča belina, Graševina, Grk, Hrvatica, Kraljevina, Malvasija dubrovačka, Malvazija (syn. Malvazija istarska bijela), Maraština, Muškat momjanski (syn. Muškat istarski), Muškat ruža porečki, Plavac mali, Plavac veliki, Plavka (syn. Plavina), Pošip, Škrlet, Teran, Trnjak,, Vugava or Žlahtina, in case of introduction from Croatia, or Aleksandriski muškat, Alikant buse, Belan, Belo zimsko, Beogradska bessemena, Demir kapija, Grenaš crn, Kadarka, Krainski bojadiser, Kratošija, Moldavija, Ohridsko crno, Plavec mal, Plovdina, Prokupec, R’kaciteli, Semijon, Smederevka, Stanušina, Sultanina, Temjanika, Teran, Vranec, Župljanka or Žilavka, in case of introduction from the former Yugoslav Republic of Macedonia, that shall be:

(a)

intended to be grafted in the Community at the premises referred to in point 7, onto rootstocks produced in the Community;

(b)

harvested in stock nurseries, which are officially registered in Croatia or the former Yugoslav Republic of Macedonia. Member States making use of this derogation shall make the lists of the registered nurseries available to the Commission and to the other Member States, at the latest by 31 December of the year preceding the introduction of the plants into the Community. These lists shall include the name of the variety, the number of rows planted with this variety, the number of plants per row for each of these nurseries, as far as they are deemed suitable for dispatch to the Community in 2008, 2009 or 2010 under the conditions laid down in this Decision;

(c)

properly packed and the packaging made recognisable with a marking, enabling the identification of the registered nursery and the variety.

2.

The plants shall be accompanied by a phytosanitary certificate issued in Croatia or the former Yugoslav Republic of Macedonia in accordance with Article 13(1) of Directive 2000/29/EC, on the basis of the examination laid down therein, confirming, in particular, freedom from the following harmful organisms:

3.

The official plant protection organisation of Croatia or the former Yugoslav Republic of Macedonia shall ensure the identity and integrity of the plants from the time of harvesting as referred to in point 1(b) until they are exported to the Community.

4.

The plants shall be introduced through points of entry designated for the purpose by the Member State in which they are situated.

Those points of entry and the name and address of the responsible official body referred to in Directive 2000/29/EC in charge of each point of entry shall be notified sufficiently in advance by the Member State making use of the derogation to the Commission and shall be made available on request to other Member States.

Where the introduction of the plants into the Community takes place in a Member State other than the Member State making use of the authorisation referred to in Article 1 (hereinafter referred to as the authorisation), the responsible official bodies of the Member State of introduction shall inform and cooperate with the responsible official bodies of the Member States making use of the authorisation to ensure that this Decision is complied with.

5.

Prior to introduction into the Community, the importer shall be officially informed of the conditions laid down in points 1 to 4; the said importer shall notify details of each introduction sufficiently in advance to the responsible official bodies in the Member State of introduction and that Member State, without delay, shall convey the details of the notification to the Commission, indicating:

(a)

the type of material;

(b)

the variety and the quantity;

(c)

the declared date of introduction and confirmation of the point of entry;

(d)

the names, addresses and the locations of the premises referred to in point 7 where the buds will be grafted and stored.

The importer shall inform the official bodies concerned of any changes to the above details as soon as they are known.

The Member State concerned shall inform the Commission of the above details, and details of any change to them without delay.

At least two weeks before the date of introduction the importer shall notify the responsible official body of the premises referred to in point 7 where the plants are to be grafted.

6.

The inspections, including testing, as appropriate, required pursuant to Article 13 of Directive 2000/29/EC and in accordance with provisions laid down in the present Decision, shall be made by the responsible official bodies of the Member State making use of this authorisation, and where appropriate, in cooperation with the responsible official bodies of the Member State where the plants are to be stored.

During those inspections, Member State(s) shall also inspect, and where appropriate, test for harmful organisms mentioned in point 2. Any finding of such harmful organisms shall immediately be notified to the Commission. Appropriate action shall be taken to destroy the harmful organisms and where appropriate the plants concerned.

7.

The plants shall be grafted only at premises officially registered and approved for the purposes of this authorisation.

The person intending to graft the plants shall notify in advance the responsible official bodies of the Member State in which the premises are situated of the name and address of the owner of those premises.

Where the place of grafting is situated in a Member State other than the Member State making use of the authorisation, the responsible official bodies of the Member State making use of the authorisation shall inform the responsible official bodies of the Member State where the plants are to be grafted of the names and addresses of the premises where the plants are to be grafted. Such information shall be given at the moment of the receipt of the advance notification from the importer as referred to in the fourth paragraph of point 5.

8.

At the premises referred to in point 7:

(a)

the plants which have been found free from the harmful organisms referred to in point 2 may then be used for grafting onto rootstock of Community origin. The grafted plants shall subsequently be kept under appropriate conditions in a suitable growing medium but shall not be planted or further grown in fields. The grafted plants shall remain at the premises for no more than 18 months before being exported to a destination outside the Community as referred to in point 9;

(b)

in the period following grafting the plants shall be visually inspected by the said responsible official bodies of the Member State in which they are grafted, at appropriate times, for the presence of harmful organisms or for signs or symptoms caused by any harmful organism; as a result of such visual inspection any harmful organism having caused such signs or symptoms shall be identified by an appropriate testing procedure;

(c)

any grafted plant which has not been found free, during the said inspections or testing referred to in points (a) and (b), from harmful organisms listed in point 2, or otherwise of quarantine concern, shall be immediately destroyed under the control of the said responsible official bodies.

9.

Any plant resulting from a successful grafting using the buds referred to in point 1 shall only be released as grafted plants for export to Croatia or to the former Yugoslav Republic of Macedonia. The responsible official bodies of a Member State making use of this authorisation shall ensure that any plant or part of the plant not so exported shall be officially destroyed. Records shall be kept of the amounts of successfully grafted plants, of officially destroyed plants and of plants subsequently re-exported to Croatia or to the former Yugoslav Republic of Macedonia. This information shall be made available to the Commission.

approving certain national programmes for the control of salmonella in flocks of laying hens of Gallus gallus

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Regulation (EC) No 2160/2003 of the European Parliament and of the Council of 17 November 2003 on the control of salmonella and other specified food-borne zoonotic agents (1) and, in particular Article 6(2) thereof,

Whereas:

(1)

The purpose of Regulation (EC) No 2160/2003 is to ensure that proper and effective measures are taken to detect and control salmonella and other zoonotic agents at all relevant stages of production, processing and distribution, particularly at the level of primary production, in order to reduce their prevalence and the risk they pose to public health.

(2)

A Community target was established for the reduction of the prevalence of all salmonella serotypes with public health significance in laying flocks of Gallus gallus at the level of primary production by Commission Regulation (EC) No 1168/2006 of 31 July 2006 implementing Regulation (EC) No 2160/2003 of the European Parliament and of the Council as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in laying hens of Gallus gallus and amending Regulation (EC) No 1003/2005 (2).

(3)

In order to achieve the Community target Member States are to establish national programmes for the control of salmonella in laying flocks of Gallus gallus and submit them to the Commission in accordance with Regulation (EC) No 2160/2003.

(4)

Certain Member States have submitted their national programmes for the control of salmonella in laying flocks of Gallus gallus.

(5)

Those programmes were found to comply with relevant Community veterinary legislation and in particular with Regulation (EC) No 2160/2003.

(6)

The national control programmes should therefore be approved.

(7)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION

Article 1

The national programmes for the control of salmonella in laying flocks of Gallus gallus submitted by the Member States listed in the Annex are approved.

Article 2

This Decision shall apply from 1 January 2008.

The national programme for the control of salmonella in breeding flocks of Gallus gallus submitted by Finland was approved by Commission Decision 2006/759/EC of 8 November 2006 approving certain national programmes for the control of salmonella in breeding flocks of Gallus gallus (2).

(2)

Finland has now submitted amendments to its national programme for approval.

(3)

The proposed amendments to that programme take into account the evolution in the situation in Finland. They comply with the relevant Community veterinary legislation and, in particular, with the requirements laid down in Regulation (EC) No 2160/2003.

(4)

The amendments to the national programme for the control of salmonella in breeding flocks of Gallus gallus submitted by Finland should therefore be approved.

(5)

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

amending Decision ECB/2001/16 on the allocation of monetary income of the national central banks of participating Member States from the financial year 2002

THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,

Having regard to the Statute of the European System of Central Banks and of the European Central Bank (hereinafter the ‘ESCB Statute’), and in particular Article 32 thereof,

Whereas:

(1)

Article 32 of the ESCB Statute lays down general rules for the allocation of monetary income of national central banks (NCBs) of Member States that have adopted the euro. The general rules laid down in Article 32 of the ESCB Statute also apply to the income resulting from the write-off of euro banknotes that have been withdrawn from circulation.

(2)

Article 32.5 of the ESCB Statute specifies that the sum of the NCBs’ monetary income is allocated to the NCBs in proportion to their paid up shares in the ECB’s capital. Pursuant to Article 32.7 of the ESCB Statute, the Governing Council is competent to take all other measures necessary for the application of Article 32. This includes the competence to take account of other factors when deciding on the allocation of income resulting from the write-off of euro banknotes that have been withdrawn from circulation. In this context, the principles of equal treatment and fairness require that account be taken of the time period during which the withdrawn euro banknotes were issued. The allocation key for this specific income must therefore reflect both the relevant share in the ECB’s capital and the length of the issue phase.

(3)

The withdrawal of euro banknotes needs to be regulated by separate decisions to be taken pursuant to Article 5 of Decision ECB/2003/4 of 20 March 2003 on the denominations, specifications, reproduction, exchange and withdrawal of euro banknotes (1).

This Decision is without prejudice to the liabilities of issuing authorities, pursuant to Decision ECB/2001/15 of 6 December 2001 on the issue of euro banknotes (2).

(5)

Article 14(2) of Guideline ECB/2007/2 of 26 April 2007 on a Trans-European Automated Real-time Gross settlement Express Transfer system (TARGET2) (3) provides that the TARGET2 system will replace the current TARGET system. The NCBs of Member States that have adopted the euro will migrate to TARGET2 in accordance with the schedule specified in Article 13 of Guideline ECB/2007/2. Furthermore, certain NCBs of Member States that have not adopted the euro will connect to TARGET2 on the basis of a separate agreement with the ECB and the NCBs of Member States that have adopted the euro. It is therefore necessary to update the references to ‘TARGET’ in Decision ECB/2001/16 of 6 December 2001 on the allocation of monetary income of the national central banks of participating Member States from the financial year 2002 (4).

Some further changes to Decision ECB/2001/16 are also needed in relation to the measurement of monetary income and the treatment of frontloaded euro banknotes,

HAS DECIDED AS FOLLOWS:

Article 1

Decision ECB/2001/16 is amended as follows:

The following definitions are inserted after the definition of ‘daily foreign exchange reference rate’:

‘(n)

“withdrawn euro banknotes” means any euro banknote type or series that has been withdrawn from circulation by a decision of the Governing Council taken pursuant to Article 5 of Decision ECB/2003/4;

(o)

“issue key” means the average subscribed capital key during the issue phase of a type or series of withdrawn euro banknotes;

(p)

“issue phase”, in relation to a euro banknote type or series, means the period starting on the date on which the first issue of a euro banknote of this type or series is recorded in the liability base and ending on the date on which the last issue of a euro banknote of this type or series is recorded in the liability base;

(q)

“to write off” means to eliminate withdrawn euro banknotes from the balance sheet item “banknotes in circulation”.’

2.

Article 3(3) is replaced by the following:

‘3.   Where the value of an NCB’s earmarkable assets exceeds or falls short of the value of its liability base, the difference shall be offset by applying the reference rate to the value of the difference.’

3.

The following Article 5a is inserted after Article 5:

‘Article 5a

Calculation and allocation of income resulting from the write-off of euro banknotes

1.   Withdrawn euro banknotes shall remain part of the liability base until they are exchanged or written off, whichever event occurs first.

2.   The Governing Council may decide to write off withdrawn euro banknotes, in which case it shall specify the write-off date and the total amount of the provision to be made for those withdrawn euro banknotes that are still expected to be exchanged.

3.   Withdrawn euro banknotes shall be written off as follows:

(a)

On the write-off date, the ECB’s and the NCBs’ balance sheet items “banknotes in circulation” shall be reduced by the total amount of withdrawn euro banknotes still in circulation. For this purpose, the actual amounts of withdrawn euro banknotes that were put into circulation shall be adjusted to their pro-rata amounts calculated in accordance with the issue key, and the differences shall be settled among the ECB and the NCBs.

(b)

The adjusted amount of withdrawn euro banknotes shall be written off from the balance sheet item “banknotes in circulation” to the NCBs’ profit and loss accounts.

(c)

Each NCB shall establish a provision for withdrawn euro banknotes that are still expected to be exchanged. The provision shall be equivalent to the relevant NCB’s share in the total amount of the provision calculated using the issue key.

4.   Withdrawn euro banknotes that are exchanged after the write-off date shall be recorded in the books of the NCB that has accepted them. The inflow of withdrawn euro banknotes shall be redistributed among NCBs at least once a year by applying the issue key, and the differences shall be settled between them. Each NCB shall set off the pro-rata amount against its provision or, in the event that the inflow exceeds the provision, record a corresponding expense in its profit and loss account.

5.   The Governing Council shall review the total amount of the provision on an annual basis.’

Annex I is amended in accordance with Annex I to this Decision.

Annex II is amended in accordance with Annex II to this Decision.

6.

All references in Decision ECB/2001/16 to ‘TARGET’ shall be construed as references to ‘TARGET2’ once the relevant NCB has migrated to TARGET2.

This Decision shall enter into force on 1 January 2008.

ANNEX I

Annex I to Decision ECB/2001/16 is amended as follows.

The following subparagraph is inserted at the end of paragraph 1 in Part A:

‘In the event that the cash change-over date is a day on which TARGET/TARGET2 is closed, the liability of a new Eurosystem NCB which results from euro banknotes that have been frontloaded pursuant to Guideline ECB/2006/9 of 14 July 2006 on certain preparations for the euro cash changeover and on frontloading and sub-frontloading of euro banknotes and coins outside the euro area (1) and have then entered into circulation before the cash change-over date form part of the liability base (as part of the correspondent accounts under liability item 10.4 of the HBS) until the liability becomes part of the intra-Eurosystem liabilities resulting from TARGET/TARGET2 transactions.

ANNEX II

Annex II to Decision ECB/2001/16 is amended as follows.

The following paragraph is inserted at the end of Part A, after the paragraph ending ‘as at 31 December 2002 ’:

‘6.

claims resulting from euro banknotes that have been frontloaded pursuant to Guideline ECB/2006/9 and have then entered into circulation before the cash change-over date (part of asset item 4.1 of the HBS until the cash change-over date and thereafter part of the correspondent accounts under asset item 9.5 of the HBS), but only until such claim becomes part of the intra-Eurosystem claims resulting from TARGET/TARGET2 transactions.’
