COMMISSION REGULATION (EC) No 1/2007

of 3 January 2007

establishing the standard import values for determining the entry price of certain fruit and vegetables

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Commission Regulation (EC) No 3223/94 of 21 December 1994 on detailed rules for the application of the import arrangements for fruit and vegetables (1), and in particular Article 4(1) thereof,

Whereas:

(1)

Regulation (EC) No 3223/94 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto.

(2)

In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 4 of Regulation (EC) No 3223/94 shall be fixed as indicated in the Annex hereto.

Article 2

This Regulation shall enter into force on 4 January 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 2/2007

of 3 January 2007

on the issue of system B export licences in the fruit and vegetables sector (tomatoes and table grapes)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 2200/96 of 28 October 1996 on the common organisation of the market in fruit and vegetables (1),

Having regard to Commission Regulation (EC) No 1961/2001 of 8 October 2001 on detailed rules for implementing Council Regulation (EC) No 2200/96 as regards export refunds on fruit and vegetables (2), and in particular Article 6(6) thereof,

Whereas:

(1)

Commission Regulation (EC) No 1510/2006 (3) fixes the indicative quantities for which system B export licences may be issued.

(2)

In the light of the information available to the Commission today, there is a risk that the indicative quantities laid down for the current export period for tomatoes and table grapes will shortly be exceeded. This overrun will prejudice the proper working of the export refund scheme in the fruit and vegetables sector.

(3)

To avoid this situation, applications for system B licences for tomatoes and table grapes after 3 January 2007 should be rejected until the end of the current export period,

HAS ADOPTED THIS REGULATION:

Article 1

Applications for system B export licences for tomatoes and table grapes submitted pursuant to Article 1 of Regulation (EC) No 1510/2006, export declarations for which are accepted after 3 January and before 1 March 2007, are hereby rejected.

Article 2

This Regulation shall enter into force on 4 January 2007.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 247(1), (2) and (3) thereof,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 160b(3) thereof,

Having regard to the Act concerning the conditions of accession to the European Union of the Republic of Bulgaria and Romania and the adjustments to the Treaties on which the European Union is founded, and in particular Article 47 thereof,

Having regard to the Opinions of the European Parliament,

Whereas:

In accordance with Article 47 of the said Act of Accession, the Court of Auditors should be enlarged by the appointment of two additional members for a term of office of six years,

HAS DECIDED AS FOLLOWS:

COUNCIL DECISION

appointing the Bulgarian and Romanian members of the European Economic and Social Committee

(2007/3/EC, Euratom)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 259 thereof,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 167 thereof,

Having regard to the Act of Accession of Bulgaria and Romania, and in particular Articles 12 and 48 thereof,

Having regard to the proposals made by the governments of the Republic of Bulgaria and Romania,

Having regard to the opinion of the European Commission,

Whereas:

(1)

The members of the European Economic and Social Committee have been appointed, for the period from 21 September 2006 to 20 September 2010, by Council Decisions 2006/524/EC, Euratom (1), 2006/651/EC, Euratom (2) and 2006/703/EC, Euratom (3).

(2)

Following the accession of the Republic of Bulgaria and of Romania to the European Union, the European Economic and Social Committee should be enlarged by the appointment of 27 members representing the various economic and social components of organised civil society,

HAS DECIDED AS FOLLOWS:

Article 1

The persons whose names and titles are listed in the Annex are hereby appointed members of the European Economic and Social Committee for the period up to 20 September 2010.

Article 2

This Decision shall take effect on the date of its adoption.

It shall apply from 1 January 2007.

COUNCIL DECISION

of 1 January 2007

amending the Council’s Rules of Procedure

(2007/4/EC, Euratom)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular the first subparagraph of Article 207(3) thereof,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 121(3) thereof,

Having regard to the Treaty on European Union, and in particular Articles 28(1) and 41(1) thereof,

Having regard to Article 2(2) of Annex III to the Council’s Rules of Procedure (1),

Whereas:

(1)

Article 11(5) of the Council’s Rules of Procedure (hereinafter referred to as Rules of Procedure) provides that when a decision is to be adopted by the Council by a qualified majority, and if a member of the Council so requests, it shall be verified that the Member States constituting the qualified majority represent at least 62 % of the total population of the European Union calculated according to the population figures set out in Article 1 of Annex III to the Rules of Procedure.

(2)

Article 2(2) of Annex III to the Rules of Procedure on detailed rules for implementing the provisions concerning the weighting of votes in the Council provides that, with effect from 1 January each year, the Council shall, in accordance with the data available to the Statistical Office of the European Communities on 30 September of the preceding year, amend the figures set out in Article 1 of that Annex.

(3)

The Rules of Procedure should therefore be amended accordingly,

HAS DECIDED AS FOLLOWS:

Article 1

Article 1 of Annex III to the Rules of Procedure shall be replaced by the following:

For the purposes of implementing Article 205(4) of the EC Treaty, Article 118(4) of the Euratom Treaty, and the third subparagraph of Article 23(2) and Article 34(3) of the EU Treaty, the total population of each Member State for the period from 1 January to 31 December 2007 shall be as follows:

COUNCIL DECISION

of 1 January 2007

determining the order in which the office of President of the Council shall be held

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular the second paragraph of Article 203 thereof,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular the second paragraph of Article 116 thereof,

Having regard to the Treaty on European Union, and in particular Articles 28(1) and 41(1) thereof,

Whereas:

(1)

By Decision 2005/902/EC, Euratom (1) the Council established the order in which the office of President of the Council was to be held for the Member States of the European Union at the date of 1 January 2006.

(2)

The European Union was enlarged on 1 January 2007 to include two new Member States.

(3)

The order in which the office of President of the Council shall be held should accordingly be determined taking into account the new Member States, and a new Decision should be adopted to replace Decision 2005/902/EC, Euratom of 12 December 2005,

HAS DECIDED AS FOLLOWS:

Article 1

1.   The order in which the Member States shall hold the Presidency of the Council from 1 January 2007 is set out in the Annex hereto.

2.   The Council, acting unanimously on a proposal from the Member States concerned, may decide that a Member State may hold the Presidency during a period other than that resulting from the order established in the Annex hereto.

Article 2

This Decision shall take effect on 1 January 2007.

Decision 2005/902/EC, Euratom shall be repealed.

Article 3

This Decision shall be published in the Official Journal of the European Union.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular the fourth paragraph of Article 263 thereof,

Having regard to the Act of Accession of Bulgaria and Romania, and in particular Articles 13 and 49 thereof,

Having regard to the proposals made by the governments of the Republic of Bulgaria and of Romania,

Whereas:

(1)

The members and alternate members of the Committee of the Regions were appointed for the period from 26 January 2006 to 25 January 2010 by Council Decision 2006/116/EC (1).

(2)

Following the accession of the Republic of Bulgaria and Romania to the European Union, the Committee of the Regions should be enlarged by the appointment of 27 members and 27 alternate members representing regional and local bodies in the new Member States who either hold a regional or local authority electoral mandate or are politically accountable to an elected assembly,

HAS DECIDED AS FOLLOWS:

Article 1

The following persons are hereby appointed to the Committee of the Regions for the period up to 25 January 2010:

Article 2

DECISION OF THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION

of 1 January 2007

appointing judges at the Court of Justice of the European Communities

(2007/7/EC, Euratom)

THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 223 thereof,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 139 thereof,

Having regard to the Act concerning the conditions of accession to the European Union of the Republic of Bulgaria and Romania and the adjustments to the Treaties on which the European Union is founded, and in particular Article 46(1) and (2), first subparagraph, thereof,

Whereas:

(1)

Article 46(1) and (2), first subparagraph, of the Act of Accession provides for the appointment of two judges to the Court of Justice. The term of office of one of those judges is to expire on 6 October 2009. This judge is to be chosen by lot. The term of office of the other judge is to expire on 6 October 2012.

(2)

Two additional judges at the Court of Justice of the European Communities should therefore be appointed, in accordance with the said Article, after having drawn lots as provided for therein,

HAVE DECIDED AS FOLLOWS:

Article 1

Ms Camelia TOADER is hereby appointed a judge at the Court of Justice of the European Communities for the period from 1 January 2007 to 6 October 2009.

Article 2

Mr Alexander ARABADJIEV is hereby appointed a judge at the Court of Justice of the European Communities for the period from 1 January 2007 to 6 October 2012.

Article 3

This Decision shall take effect on 1 January 2007.

Article 4

This Decision shall be published in the Official Journal of the European Union.

appointing judges at the Court of First Instance of the European Communities

(2007/8/EC, Euratom)

THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 224 thereof,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 140 thereof,

Having regard to the Act concerning the conditions of accession to the European Union of the Republic of Bulgaria and Romania and the adjustments to the Treaties on which the European Union is founded, and in particular Article 46(1) and (2), second subparagraph, thereof,

Whereas:

(1)

Article 46(1) and (2), second subparagraph, of the Act of Accession provides for the appointment of two judges to the Court of First Instance. The term of office of one of those judges is to expire on 31 August 2007. This judge is to be chosen by lot. The term of office of the other judge is to expire on 31 August 2010.

(2)

Two additional judges to the Court of First Instance should therefore be appointed, in accordance with the said Article, after having drawn lots as provided for therein,

HAVE DECIDED AS FOLLOWS:

Article 1

Mr Theodore CHIPEV is hereby appointed a judge at the Court of First Instance for the period from 1 January 2007 to 31 August 2007.

Article 2

Mr Valeriu CIUCĂ is hereby appointed a judge at the Court of First Instance for the period from 1 January 2007 to 31 August 2010.

Article 3

This Decision shall take effect on 1 January 2007.

Article 4

This Decision shall be published in the Official Journal of the European Union.
