establishing the standard import values for determining the entry price of certain fruit and vegetables

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Commission Regulation (EC) No 3223/94 of 21 December 1994 on detailed rules for the application of the import arrangements for fruit and vegetables (1), and in particular Article 4(1) thereof,

Whereas:

(1)	Regulation (EC) No 3223/94 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto.

(2)	In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 4 of Regulation (EC) No 3223/94 shall be fixed as indicated in the Annex hereto.

Article 2

This Regulation shall enter into force on 10 March 2006.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EC) No 936/97 opening and providing for the administration of tariff quotas for high-quality fresh, chilled and frozen beef and for frozen buffalo meat

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Decision 2006/106/EC of 30 January 2006 on the conclusion of an Agreement in the form of an Exchange of Letters between the European Community and Australia pursuant to Article XXIV:6 and Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions in the schedules of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic in the course of their accession to the European Union (1), and in particular Article 2 thereof,

Whereas:

(1)	Commission Regulation (EC) No 936/97 (2) provides for the opening and administration, on a multi-annual basis, of a number of quotas of high-quality beef.

(2)	As a result of the negotiations which led to the Agreement approved by Decision 2006/106/EC, the Community undertook to incorporate in its schedule for all Member States an increase of 150 tonnes of the annual import tariff quota of high-quality beef.

(3)

Moreover, qualification for the quota of high-quality beef allocated to Australia is subject to the conditions laid down in Regulation (EC) No 936/97. In order to refer to parameters which are verifiable and auditable, the definition of high-quality beef in Article 2(b) of that Regulation should be modified and should refer to official categories defined on the day of entry into force of this Regulation by the competent Australian authorities.

(4)

It is also appropriate to specify that the provisions of Article 13 of Regulation (EC) No 1760/2000 of the European Parliament and of the Council (3), which establishes a system for the identification and registration of bovine animals and sets out provisions regarding the labelling of beef and beef products, should be applicable to the import of high quality beef referred to in Article 2(b) of Regulation (EC) No 936/97.

(5)	Regulation (EC) No 936/97 should be amended accordingly.

(6)	The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Beef and Veal,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EC) No 936/97 is amended as follows:

Article 1(1) is amended as follows:

(a)	in the first indent of the first subparagraph, ‘60 100 tonnes’ is replaced by ‘60 250 tonnes’;

(b)	the second subparagraph is replaced by the following: ‘However, the total volume of tariff quotas shall be 59 675 tonnes in the 2005/2006 import year.’

In Article 2, point (b) is amended as follows:

(a)	in the first subparagraph, ‘7 000 tonnes’ is replaced by ‘7 150 tonnes’;

(b)

the second subparagraph is replaced by the following:

‘Selected cuts obtained from steer or heifer carcasses which have been classified under one of the following official categories “Y”, “YS”, “YG”, “YGS”, “YP” and “YPS” as defined by AUS-MEAT Australia. Beef colour shall conform to AUS-MEAT meat colour reference standards 1 B to 4, fat colour to AUS-MEAT fat colour reference standards 0 to 4 and fat depth (measured at the P8 site) to AUS-MEAT fat classes 2 to 5.

The cuts shall be labelled according to Article 13 of Regulation (EC) No 1760/2000 of the European Parliament and of the Council (*1).

The indication “High-quality Beef” may be added to the information on the label.

However, for the 2005/2006 import year the tariff quota shall be 7 075 tonnes product weight for meat corresponding to the CN codes mentioned in the first subparagraph and complying with the requirements provided for in the second, third ant fourth subparagraphs;

Article 2

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulations (EC) No 174/1999, (EC) No 581/2004 and (EC) No 582/2004 as regards the security levels on export licences in the milk sector

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1255/1999 of 17 May 1999 on the common organisation of the market in milk and milk products (1), and in particular Article 31(14) thereof,

Whereas:

(1)

Article 9 of Commission Regulation (EC) No 174/1999 of 26 January 1999 laying down special detailed rules for the application of Council Regulation (EEC) No 804/68 as regards export licences and export refunds in the case of milk and milk products (2) establishes the securities to be lodged on the day export licence applications are submitted.

(2)

Article 3 of Commission Regulation (EC) No 581/2004 of 26 March 2004 opening a standing invitation to tender for export refunds concerning certain types of butter (3) and Article 3 of Commission Regulation (EC) No 582/2004 of 26 March 2004 opening a standing invitation to tender for export refunds concerning skimmed milk powder (4) provide for the amounts of the tendering security to be lodged before the end of the period during which tenders may be submitted.

(3)	Following the trend of export refunds over the past months, it is appropriate to adjust the level of the securities while still ensuring that they remain sufficiently high to prevent speculative applications.

(4)	It is appropriate, in order to establish a correlation between refund and security amount and aiming at a harmonised approach for all refunds applicable, to fix the tendering securities by way of a percentage of the refund amount.

(5)	Regulations (EC) No 174/1999, (EC) No 581/2004 and (EC) No 582/2004 should therefore be amended accordingly.

(6)	The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Milk and Milk Products,

HAS ADOPTED THIS REGULATION:

Article 1

In the first paragraph of Article 9 of Regulation (EC) No 174/1999, points (a), (b), (c) and (d) are replaced by the following:

‘(a)	15 % for products covered by CN code 0405;

(b)	15 % for products covered by CN code 0402 10;

(c)	15 % for products covered by CN code 0406;

(d)	15 % for other products.’

Article 2

In Article 3(2) of Regulation (EC) No 581/2004, the first paragraph is replaced by the following:

‘2. The tendering security shall be 15 % of the most recent maximum tender refund amount fixed for the product codes and the destinations referred to in Article 1(1).

The tendering security may not, however, be less than EUR 6 per 100 kg.’

Article 3

In Article 3(2) of Regulation (EC) No 582/2004, the first paragraph is replaced by the following:

‘2. The tendering security shall be 15 % of the most recent maximum tender refund amount fixed for the product codes and the destinations referred to in Article 1(1).

The tendering security may not, however, be less than EUR 6 per 100 kg.’

Article 4

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EC) No 1291/2000 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1255/1999 of 17 May 1999 on the common organisation of the market in milk and milk products (1), and in particular Article 26(3) thereof,

Whereas:

(1)

Article 1(1) of Commission Regulation (EC) No 174/1999 of 26 January 1999 laying down special detailed rules for the application of Council Regulation (EEC) No 804/68 as regards export licences and export refunds in the case of milk and milk products (2), provides that exports from the Community of products for which an export refund is requested shall be subject to the presentation of an export licence.

(2)

However, the second subparagraph of Article 1(1) of Regulation (EC) No 174/1999 further lays down that an export licence must also be presented for the products referred to in category II of Annex I thereto, where no refund is applied for, except in the cases referred to in the first and fourth indents of Article 5(1) of Commission Regulation (EC) No 1291/2000 (3).

(3)	Article 5 of Regulation (EC) No 1291/2000 provides that a licence is not to be required and may not be produced for the purposes of exports with export refunds relating inter alia to small quantities not exceeding those set out in Annex III to that Regulation.

(4)	It is appropriate, where exports without refunds of skimmed-milk powder, as referred to in category II of Annex I to Regulation (EC) No 174/1999, relating to those small quantities, to exempt exporters from the obligation of an export licence.

(5)	Annex III to Regulation (EC) No 1291/2000 should therefore be amended accordingly.

(6)	The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Milk and Milk Products,

HAS ADOPTED THIS REGULATION:

Article 1

In Annex III to Regulation (EC) No 1291/2000, at the end of product sector D, the following text is added:

	Export licence without refund (Article 1(1) second subparagraph of Regulation (EC) No 174/1999)

Article 2

(1)	An invitation to tender for the refund for the export of barley to certain third countries was opened pursuant to Commission Regulation (EC) No 1058/2005 (2).

Article 7 of Commission Regulation (EC) No 1501/95 of 29 June 1995 laying down certain detailed rules for the application of Council Regulation (EEC) No 1766/92 on the granting of export refunds on cereals and the measures to be taken in the event of disturbance on the market for cereals (3), and in particular Article 13(3) thereof,

(3)	On the basis of the criteria laid down in Article 1 of Regulation (EC) No 1501/95, a maximum refund should not be fixed.

(4)	The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Cereals,

HAS ADOPTED THIS REGULATION:

Article 1

No action shall be taken on the tenders notified from 3 to 9 March 2006 in response to the invitation to tender for the refund for the export of barley issued in Regulation (EC) No 1058/2005.

Article 2

This Regulation shall enter into force on 10 March 2006.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Council Regulation (EC) No 1784/2003 of 29 September 2003 on the common organisation of the market in cereals (1), and in particular Article 12(1) thereof,

Whereas:

(1)	An invitation to tender for the maximum reduction in the duty on maize imported in Portugal from third countries was opened pursuant to Commission Regulation (EC) No 1809/2005 (2).

(2)	Article 7 of Commission Regulation (EC) No 1839/95 (3), allows the Commission to decide, in accordance with the procedure laid down in Article 25 of Regulation (EC) No 1784/2003 and on the basis of the tenders notified, to make no award.

(3)	On the basis of the criteria laid down in Articles 6 and 7 of Regulation (EC) No 1839/95 a maximum reduction in the duty should not be fixed.

(4)	The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Cereals,

HAS ADOPTED THIS REGULATION:

Article 1

No action shall be taken on the tenders notified from 3 to 9 March 2006 in response to the invitation to tender for the reduction in the duty on imported maize issued in Regulation (EC) No 1809/2005.

Article 2

This Regulation shall enter into force on 10 March 2006.

COMMISSION DECISION

approving on behalf of the European Community amendments to the annexes to the Agreement between the European Community and the United States of America on sanitary measures to protect public and animal health in trade in live animals and animal products

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Decision 98/258/EC of 16 March 1998 on the conclusion of the Agreement between the European Community and the United States of America on sanitary measures to protect public and animal health in trade in live animals and animal products (1), and in particular Article 4, third paragraph thereof,

Whereas:

(1)	The Joint Management Committee for the Agreement (the Committee), at its meeting on 27 October 2005 issued a recommendation concerning the determination of equivalence for fishery products. As a result of this recommendation it is appropriate to amend Annex V to the Agreement.

(2)	This amendment should be approved on behalf of the Community.

(3)	The measure provided for in this Decision is in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS DECIDED AS FOLLOWS:

Article 1

Pursuant to the recommendation made by the Joint Management Committee established under Article 14 of the Agreement between the European Community and the United States of America on sanitary measures to protect public and animal health in trade in live animals and animal products, the amendments to Annex V to the said Agreement are hereby approved on behalf of the European Community. The text of the Agreement in the form of an Exchange of Letters, including the amendments to Annex V to the Agreement, is attached to this Decision.

Article 2

The Director-General for Health and Consumer Protection is hereby empowered to sign the agreement in the form of an exchange of letters in order to bind the Community.

Article 3

This Decision shall apply from the first day of the month following the month in which the United States of America notifies the Commission in writing that its internal procedures for the approval of the amendments referred to in Article 1 have been completed.

Replace the text of Annex V, point 11 of the Agreement, as recommended by the Joint Management Committee established under Article 14(1) of the Agreement with the respective text of Appendix A as attached hereto.

I would be obliged if you would confirm the Agreement of the United States of America to such amendment of Annex V to the Agreement.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products (1), and in particular Article 11(1) thereof,

Whereas:

(1)

Council Directive 91/493/EEC provides that specific conditions shall be established for the imports of fishery products from each third country. These specific import conditions shall include: the procedure for obtaining a health certificate which must accompany consignments of fish when exported to the European Community, the placing of a mark identifying the fishery products and indicating the origin and the number of the establishment, and a list of approved establishments, factory vessels, or cold stores, and a list of registered freezer vessels.

(2)

Annex V to the Agreement between the European Community and the United States of America (USA) on sanitary measures to protect public and animal health in trade in live animals and animal products (the Agreement) established, inter alia, the sanitary measures for fish and fishery products and certain other animal products traded with the United States for which equivalence has been determined.

(3)

Annex II to the Agreement established that the regulatory authorities for the control of the public health conditions for fish and fishery products in the USA are the Food and Drug Administration (FDA) and the National Marine Fisheries Service — National Oceanic & Atmospheric Administration (NMFS-NOAA). Within the scope of the agreement, the FDA and the NMFS-NOAA are responsible, in particular, for effectively verifying and controlling the implementation of the sanitary rules in force in the USA related to production and processing of fishery products, and for providing information and additional guarantees on the fishery products exported to the EC territory.

(4)	An inspection has been carried out on behalf of the Commission in the USA to verify the conditions under which fishery products are produced, stored and dispatched to the Community.

(5)	Following the results of the inspection visit, FDA and NMFS-NOAA have provided guarantees with regard to their responsibilities described above and the implementation of the specific conditions laid down by the present Decision.

(6)	These guarantees concern also the controls that apply to brokers (exporters other than processors).

(7)	It is therefore appropriate to lay down detailed provisions concerning fishery products imported into the Community from the USA in accordance with Directive 91/493/EEC.

(8)	It is appropriate for this Decision to be applied 45 days after its publication providing for the necessary transitional period.

(9)	The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

Article 1

The ‘Food and Drug Administration (FDA)’ and ‘the National Marine Fisheries Service — National Oceanic & Atmospheric Administration (NMFS-NOAA)’ shall be the competent authorities in the United States of America (USA) responsible for the purposes of verifying and certifying compliance of fishery products with the relevant United States public health standards requirements of the Code of Federal Regulation which have been recognised for this purpose as equivalent to the European Community standards as prescribed in Council Decision 98/258/EC.

Article 2

Fishery products imported into the Community from the USA shall meet the requirements set out in Articles 3, 4 and 5.

Article 3

1. Each consignment shall be accompanied by a numbered original health certificate in accordance with the model set out in Annex I and comprising a single sheet, duly completed, signed and dated.

2. The health certificate shall be drawn up in at least one official language of the Member State where the checks are carried out.

3. The health certificate shall bear the name, capacity and signature of the representative of the FDA or of the NMFS-NOAA, and the latter’s official stamp in a colour different from that of the endorsements.

Article 4

The fishery products shall come from approved establishments, factory vessels, cold stores or from registered freezer vessels listed in Annex II.

Article 5

All packages shall bear the word ‘USA’ and the approval/registration number of the establishment, factory vessel, cold store or freezer vessel of origin in indelible letters, except in the case of frozen fishery products in bulk and intended for the manufacture of preserved foods.

Article 6

This Decision shall apply from 24 April 2006.

Article 7

This Decision is addressed to the Member States.

amending Decision 97/296/EC drawing up the list of third countries from which the import of fishery products is authorised for human consumption, with respect to the United States of America

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Decision 95/408/EC of 22 June 1995 on the conditions for drawing up, for an interim period, provisional lists of third country establishments from which Member States are authorised to import certain products of animal origin, fishery products or live bivalve molluscs (1), and in particular Article 2(2) thereof,

Whereas:

(1)

Commission Decision 97/296/EC of 22 April 1997 drawing up the list of third countries from which the import of fishery products is authorised for human consumption (2), lists the countries and territories from which import of fishery products for human consumption is authorised. Part I of the Annex to that Decision lists the countries and territories covered by a specific Decision pursuant to Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products (3), and part II of that Annex lists the countries and territories meeting the conditions set out in Article 2(2) of Decision 95/408/EC.

(2)	Commission Decision 2006/199/EC (4), sets specific import conditions for fishery products from the United States of America. This country should therefore be included in the list in part I of the Annex to Decision 97/296/EC.

(3)	In the interest of clarity, the lists concerned should be replaced in their entirety.

(4)	Decision 97/296/EC should therefore be amended accordingly.

(5)	This Decision should apply from the same day as Decision 2006/199/EC laying down specific conditions for import of fishery products from the United States of America.

(6)	The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Decision 97/296/EC is replaced by the text in the Annex to this Decision.

Article 2

This Decision shall apply from 24 April 2006.

Article 3

This Decision is addressed to the Member States.

concerning the extension of the agreement in the form of an Exchange of Letters between the European Union and the Government of Indonesia on the tasks, status, privileges and immunities of the European Union Monitoring Mission in Aceh (Indonesia) (Aceh Monitoring Mission — AMM) and its personnel

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 24 thereof,

Having regard to the recommendation from the Presidency,

Whereas:

(1)	On 9 September 2005, the Council adopted Joint Action 2005/643/CFSP on the European Union Monitoring Mission in Aceh, Indonesia (Aceh Monitoring Mission — AMM) (1).

(2)

Article 7 of the Joint Action 2005/643/CFSP provides that the status of the Aceh Monitoring Mission staff in Indonesia, including where appropriate the privileges, immunities and further guarantees necessary for the completion and smooth functioning of the Aceh Monitoring Mission, shall be agreed in accordance with the procedure laid down in Article 24 of the Treaty.

(3)

Following negotiations with the Government of Indonesia, on 3 October 2005 the Council adopted Decision 2005/765/CFSP concerning the conclusion of the agreement in the form of an Exchange of Letters between the European Union and the Government of Indonesia on the tasks, status, privileges and immunities of the European Union Monitoring Mission in Aceh (Indonesia) (Aceh Monitoring Mission — AMM) and its personnel (2) authorising the signature of the agreement in the form of an Exchange of Letters.

(4)

As stated in the letter of 14 September 2005 and its annexes from the Minister of Foreign Affairs of the Government of Indonesia regarding the tasks, status, privileges and immunities of the Aceh Monitoring Mission (AMM) and its personnel and the reply from the Secretary-General/High Representative of 3 October 2005, this agreement in the form of an Exchange of Letters may be extended for another period of up to six months by mutual consent (3).

(5)	On 13 February 2006 the Government of Indonesia invited the European Union to extend the mandate of the Aceh Monitoring Mission for a period of three months.

(6)	The Council, on 27 February 2006, adopted Joint Action 2006/202/CFSP amending and extending Joint Action 2005/643/CFSP on the European Union Monitoring Mission in Aceh (Indonesia) (Aceh Monitoring Mission — AMM) (4), extending the AMM for a period of three months.

(7)	The extension of the agreement in the form of an Exchange of Letters for a period of three months should be approved on behalf of the European Union,

HAS DECIDED AS FOLLOWS:

Article 1

The extension of the agreement in the form of an Exchange of Letters between the European Union and the Government of Indonesia on the tasks, status, privileges and immunities of the European Union Monitoring Mission in Aceh (Indonesia) (Aceh Monitoring Mission — AMM) and its personnel, is hereby approved on behalf of the European Union.

The text of the Exchange of Letters agreeing to this extension is attached to this Decision.

Article 2

The President of the Council is hereby authorised to designate the person(s) empowered to sign the Exchange of Letters in order to bind the European Union (5).

Article 3

This Decision shall be published in the Official Journal of the European Union.

Article 4

This Decision shall take effect on the day of its adoption.

A. Letter from the Government of the Republic of Indonesia

Jakarta, 13 February 2006

Dear Excellency,

On behalf of the Government of the Republic of Indonesia, I would like to express my appreciation to the European Union for its participation in the Aceh Monitoring Mission (AMM) and for its remarkable works that have been carried out since its deployment in the Province of Nanggroe Aceh Darussalam (NAD).

At this juncture, I have the honour to refer to the letter and its Annexes of the Indonesian Foreign Minister ad interim dated 14 September 2005 and your letter and its Annexes dated 3 October 2005 regarding the tasks, status, privileges and immunities of the Aceh Monitoring Mission (AMM).

In that regard, I have the honour to convey to you the decision of the Government of the Republic of Indonesia to invite the European Union to extend its presence in the Province of Nanggroe Aceh Darussalam (NAD) for a period of 3 (three) months from 16 March 2006 until 15 June 2006, or shorter depending on the date of the local election.

The status, privileges and immunities of the AMM will be identical to those stipulated in our exchange of letters respectively dated 14 September 2005 and 3 October 2005 constituting a legally binding instrument between the Government of the Republic of Indonesia and the European Union.

The works of the AMM during this period will include the tasks of AMM as stipulated in Article 5.2 of the Memorandum of Understanding Between the Government of the Republic of Indonesia and the Free Aceh Movement 15 August 2005, except tasks (a) and (b) that have been completed.

Against this backdrop, I foresee that the number of AMM personnel would amount to around 80 (eighty) personnel.

If the foregoing proposal is acceptable to the European Union, I have further the honour to propose that this letter as well as your affirmative letter in reply together constitute a legally binding instrument between the Government of the Republic of Indonesia and the European Union. This instrument shall enter into force on 16 March 2006 and be terminated on 15 June 2006. For the Government of the Republic of Indonesia this legal framework is based on Indonesian Law No 2 of 1982 dated 25 January 1982 concerning the Ratification of Convention on Special Mission, 1969.

I believe that the constructive cooperation that has been established, with a view to providing a peaceful, comprehensive and sustainable solution to the challenges facing Aceh, within the framework of the Unitary State of the Republic of Indonesia, can be further sustained and strengthened.

amending and extending Joint Action 2005/643/CFSP on the European Union Monitoring Mission in Aceh (Indonesia) (Aceh Monitoring Mission — AMM)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and, in particular Article 14 thereof,

Whereas:

(1)

On 9 September 2005 the Council adopted Joint Action 2005/643/CFSP (1) establishing from 15 September 2005 a European Union Monitoring Mission in Aceh (Indonesia) (Aceh Monitoring Mission — AMM) in order to assist Indonesia in implementing the final agreement on Aceh, as set out in the Memorandum of Understanding (MoU) between the Government of Indonesia (GoI) and the Free Aceh Movement (GAM), signed on 15 August 2005.

(2)	Article 15 of Joint Action 2005/643/CFSP provides that the Council shall, not later than 15 March 2006, evaluate whether the AMM should be extended.

(3)	On 13 February 2006 the Government of Indonesia invited the EU to extend the mandate of the AMM for a further period of three months. GAM also indicated its support for such an extension of the mission.

(4)	On 27 February 2006 the Council reiterated its support for the peace process in Aceh and confirmed its willingness to extend the mandate of the AMM for a further period of three months.

(5)	Joint Action 2005/643/CFSP should be amended accordingly,

HAS ADOPTED THIS JOINT ACTION:

Article 1

Joint Action 2005/643/CFSP is hereby amended as follows:

Article 2(2) shall be replaced by the following:

‘2. In particular, the AMM shall:

(a)	monitor the reintegration of active GAM members;

(b)	monitor the human rights situation and provide assistance in this field in the context of the task set out in (a) above;

(c)	monitor the process of legislation change;

(d)	rule on disputed amnesty cases;

(e)	investigate and rule on complaints and alleged violations of the MoU;

(f)	establish and maintain liaison and good cooperation with the parties.’;

2.	Article 4 shall be replaced by the following: ‘Article 4 Structure of the AMM The structure of the AMM, including the Headquarters and District offices, shall be specified in the OPLAN.’;

3.	In the second paragraph of Article 16 the date shall be replaced by the following date: ‘15 June 2006’.

Article 2

This Joint Action shall enter into force on the date of its adoption.

Article 3

This Joint Action shall be published in the Official Journal of the European Union.
