establishing the standard import values for determining the entry price of certain fruit and vegetables

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Commission Regulation (EC) No 3223/94 of 21 December 1994 on detailed rules for the application of the import arrangements for fruit and vegetables (1), and in particular Article 4(1) thereof,

Whereas:

(1)

Regulation (EC) No 3223/94 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto.

(2)

In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 4 of Regulation (EC) No 3223/94 shall be fixed as indicated in the Annex hereto.

Article 2

This Regulation shall enter into force on 15 February 2005.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 252/2005

of 14 February 2005

amending Regulation (EC) No 349/2003 suspending the introduction into the Community of specimens of certain species of wild fauna and flora

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (1) and in particular Article 19, point 2, thereof,

After consulting the Scientific Review Group,

Whereas:

(1)

Article 4(6) of Regulation (EC) No 338/97 provides that the Commission may establish restrictions to the introduction of certain species into the Community in accordance with the conditions laid down in points (a) to (d) thereof.

(2)

A list of species, for which the introduction into the Community is suspended, was last established in Commission Regulation (EC) No 349/2003 of 25 February 2003 suspending the introduction into the Community of specimens of certain species of wild fauna and flora (2).

(3)

The enlargement of the European Union to 25 Member States from 1 May 2004 requires that all pre-existing suspensions in respect of species originating from the new Member States be deleted from that list.

(4)

On the basis of recent information the Scientific Review Group has concluded that the conservation status of certain species listed in Annexes A and B to Council Regulation (EC) No 338/97 will be seriously jeopardised if their introduction into the Community from certain countries of origin is not suspended, these species and their countries of origin being the following:

Blastomussa spp., Cynarina lacrymalis, Plerogyra spp., Trachyphyllia geoffroyi from Indonesia (all specimens except maricultured specimens attached to artificial substrates)

Chamaeleo gracilis from Benin (wild and ranched specimens)

Euphorbia bulbispina and Euphorbia guillauminiana from Madagascar

Geochelone pardalis from Mozambique (ranched specimens)

Mantella aurantiaca, Pachypodium rosulatum, Pachypodium sofiance from Madagascar

Naja spp. from Lao People’s Democratic Republic

Psittacus erithacus from Nigeria

Ursus arctos from the province of British Columbia, Canada (hunting trophies).

The Scientific Review Group has also concluded that the suspension of the introduction into the Community of the species Psittacus erithacus from the Democratic Republic of the Congo is no longer warranted by virtue of its conservation status.

(6)

The Scientific Review Group has concluded that the introduction into the Community of Chrysemys picta and Oxyura jamaicensis presents an ecological threat to wild species of fauna and flora indigenous to the Community and should therefore be suspended.

(7)

The countries of origin of the species which are subject to the new restrictions to introduction into the Community pursuant to this Regulation have all been consulted.

(8)

Article 41 of Commission Regulation (EC) No 1808/2001 of 30 August 2001, laying down detailed rules concerning the implementation of Council Regulation (EC) No 338/97 of the protection of species of wild fauna and flora by regulating trade therein (3), contains provisions for the implementation by the Member States of the restrictions established by the Commission.

The Annex to Regulation (EC) No 349/2003 should therefore be amended accordingly, and for clarity purposes, replaced.

(10)

The measures provided for in this Regulation are in accordance with the opinion of the Committee on Trade in Wild Fauna and Flora,

HAS ADOPTED THIS REGULATION:

Article 1

The Annex to Regulation (EC) No 349/2003 is replaced by the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

fixing Community producer and import prices for carnations and roses with a view to the application of the arrangements governing imports of certain floricultural products originating in Cyprus, Israel, Jordan, Morocco and the West Bank and the Gaza Strip

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 4088/87 of 21 December 1987 fixing conditions for the application of preferential customs duties on imports of certain flowers originating in Cyprus, Israel, Jordan, Morocco and the West Bank and the Gaza Strip (1), and in particular Article 5(2)(a) thereof,

Whereas:

HAS ADOPTED THIS REGULATION:

Article 1

The Community producer and import prices for uniflorous (bloom) carnations, multiflorous (spray) carnations, large-flowered roses and small-flowered roses as referred to in Article 1b of Regulation (EEC) No 700/88 for a fortnightly period shall be as set out in the Annex.

Article 2

This Regulation shall enter into force on 15 February 2005.

It shall apply from 16 February to 1 March 2005.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 1258/1999 of 17 May 1999 on the financing of the common agricultural policy (1), and in particular Article 7(3) thereof,

After consulting the Fund Committee,

Whereas:

(1)

Commission Decision 2002/461/EC of 12 June 2002 on the clearance of the accounts of Member States' expenditure financed by the European Agricultural Guidance and Guarantee Fund (EAGGF), Guarantee Section, for the 2001 financial year (2) cleared the accounts of all the paying agencies except for the Belgian agency ‘Betaalorgaan van de Vlaamse Gemeenschap’, the Spanish FEGA and Basque Country paying agencies, and the Greek paying agencies.

(2)

Following the transmission of new information by Belgium, Spain and Greece, and after additional checks, the Commission can now take a decision on the veracity, completeness, and accuracy of the accounts submitted by the paying agencies concerned.

(3)

In clearing the accounts of the Belgian, Spanish and Greek paying agencies concerned, the Commission must take account of the amounts already paid to Belgium and withheld from Spain and Greece on the basis of Decision 2002/461/EC. Accordingly, this Decision has no financial consequences.

(4)

In accordance with Article 7(3) of Regulation (EC) No 1258/1999 and Article 7(1) of Commission Regulation (EC) No 1663/95 of 7 July 1995 laying down detailed rules for the application of Council Regulation (EEC) No 729/70 regarding the procedure for the clearance of the accounts of the EAGGF Guarantee Section (3), this Decision, adopted on the basis of accounting information, does not prejudice decisions taken subsequently by the Commission excluding from Community financing expenditure not effected in accordance with Community rules,

HAS ADOPTED THIS DECISION:

Article 1

The accounts of the Belgian paying agency ‘Betaalorgaan van de Vlaamse Gemeenschap’, the Spanish FEGA and Basque Country paying agencies, and the Greek paying agencies GEDIDAGEP/ OPEKEPE concerning expenditure financed by the EAGGF Guarantee Section for the 2001 financial year are hereby cleared.

The amounts which are recoverable from, or payable to, each Member State in accordance with this Decision are set out in the Annex.

Article 2

This Decision is addressed to the Kingdom of Belgium, the Kingdom of Spain and the Hellenic Republic.

granting Italy a partial derogation on the submission of data on the landings of fishery products in Member States

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 1382/91 of 21 May 1991 on the submission of data on the landings of fishery products in Member States (1), and in particular Article 5(4) and (5) thereof,

Whereas:

(1)

The collection of data on the landings of fishery products by Italian coastal vessels as laid down in Regulation (EEC) No 1382/91 imposes a very heavy workload on the national authorities.

(2)

The increased use of sampling techniques would significantly reduce this workload and has been demonstrated by the Italian authorities to significantly increase the quality of the resultant data.

(3)

The level of sampling envisaged in this proposed technique exceeds the limit of 10 % by weight of the fishery products provided for in Article 1 of Regulation (EEC) No 1382/91.

(4)

In accordance with Article 5(4) of Regulation (EEC) No 1382/91, in cases where the inclusion of a particular sector of the fisheries of a Member State would cause difficulties to the national authorities incommensurate with the importance of that sector, the Commission may grant a derogation permitting such a Member State to exclude data for that sector from the national data submissions.

Italy should be authorised to employ sampling techniques to estimate more than the 10 % maximum by weight of fishery products landed on condition that resultant estimates of the total weight of landings are of at least an equivalent standard of reliability.

In accordance with Article 5(5) of Regulation (EEC) No 1382/91, this derogation shall be granted for a maximum of three years.

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Agricultural Statistics, set up by Council Decision 72/279/EEC (2),

HAS ADOPTED THIS DECISION:

Article 1

Italy is authorised to employ sampling techniques to estimate more than the 10 % maximum by weight of fishery products landed in the reference month foreseen in Article 1 of Regulation (EEC) No 1382/91.

Article 2

This authorisation shall end on 31 December 2006.

Article 3

This Decision is addressed to the Italian Republic.

COMMISSION DECISION

of 11 February 2005

fixing for the year 2005 an indicative allocation between the Member States of the financing under the Community Tobacco Fund of the measures referred to in Articles 13 and 14 of Regulation (EC) No 2182/2002

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 2075/92 of 30 June 1992 on the common organisation of the market in raw tobacco (1), and in particular Article 14a thereof,

Whereas:

Articles 13 and 14 of Commission Regulation (EC) No 2182/2002 of 6 December 2002 laying down detailed rules for the application of Council Regulation (EEC) No 2075/92 with regard to the Community Tobacco Fund (2) provide for measures to promote a switch of tobacco production. Those measures are to be financed by the Community Tobacco Fund set up by Article 13 of Regulation (EEC) No 2075/92.

The total amount available to the Community Tobacco Fund for 2005 is EUR 28,8 million, 50 % of which should be used to finance specific measures to help tobacco growers to switch to other crops or to other economic activities that create employment, and to fund related studies.

It is therefore necessary to fix an indicative allocation of the available amount between the Member States concerned in accordance with Article 17(2) of Regulation (EC) No 2182/2002.

The measures provided for in this Decision are in accordance with the opinion of the Management Committee for Tobacco,

HAS ADOPTED THIS DECISION:

Article 1

For the year 2005, the indicative allocation between the Member States of the financing under the Community Tobacco Fund of the measures referred to in Articles 13 and 14 of Regulation (EC) No 2182/2002 shall be as set out in the Annex.

Article 2

This Decision is addressed to the Member States.
